Instead of thinking of ‘public order’ as the type of power that police deploy to manage disorder, this article suggests that we understand it as a set of background affects. The problem of analysing these affects is that (aside from moments of unrest) the majority of the populace is anaesthetised to them. Most people take the public feelings of calm predictability for granted. Crucially, however, the everyday management of public order does not anaesthetise everyone. It also produces ‘suspect populations’, who (...) must remain attentive to its low background hum. This article focuses on the US ‘colony within’ literature, developed by civil rights and black nationalist traditions from the late 1960s. The article suggests that this internal colony analysis contains a nuanced exploration of the spatialised affects of public order; the clouds of suspicion; the atmospheres of tension; and the police encounters that generate an affective substrate of relations. New Critical Legal Thinking articulates the emergence of a stream of critical legal theory which is directly concerned with the relation between law and the political. The early critical legal studies claim that all law is politics is displaced with a different and more nuanced theoretical arsenal. Combining grand theory with a concern for grounded political interventions, the various contributors to this book draw on political theorists and continental philosophers in order to engage with current legal problematics, such as the (...) recent global economic crisis, the Arab spring and the emergence of biopolitics. The contributions instantiate the claim that a new and radical political legal scholarship has come into being: one which critically interrogates and intervenes in the contemporary relationship between law and power. Promoting ethical decisions and behaviors is challenging for any organization. Yet managers are still required to make ethical decisions under conditions which deplete their self-control resources, such as high stress and long hours. This study examines the relationships among symbolic and internal moral identity, self-control, and ethical behavior, and investigates whether self-control acts as the mechanism through which moral identity leads to ethical behavior. Findings indicate that internal moral identity overrides symbolic moral identity in the relationship with self-control and that (...) self-control fully mediates the relationship between internal moral identity and ethical behavior. The implications for organizations is that while rules, procedures, and ethics training are useful, managers with a strong moral compass will be more likely to practice self-control leading to more ethical behaviors. I draw upon Critical Disability Studies and Race Critical Code Studies to apply an oppositional reading of applied robotics in autism intervention. Roboticists identify care work as a prime legitimizing application for their creations. Popular imagination of robotics in therapeutic or rehabilitative contexts figures the robot as nurse or orderly. Likewise, the dominant narrative tropes of autism are robotic—misfit androids, denizens of the uncanny valley. Diagnostic measures reinforce tropes of autistic uncanniness: monotonous speech, jerky movements, and systematic, over-logical minds. Today, (...) robots are pitched as therapeutic tools to intervene in the social (under)development of autistic children; robots with monotonous voices, jerky, dis-coordinated movements, unsettling affect, and behavior predicated on a system of finite state logic. I present eerie and uneasy connections between the discredited works on autism and selfhood by Bettelheim and contemporary rehabilitative robotics research and imagine possibilities for robotics to divest from legacies of enslavement and policing. This paper presents a way of thinking about how to respond to the pluralism of modern societies that avoids any commitment to contractualist norms of political justification. The argument developed appeals to the notion of a constitutional settlement. Constitutional settlements are complex on-going social practices that both express certain values to which political societies are committed and establish procedures for resolving disputes among members of these societies. As such, they are a product of both moral commitment and the balance of (...) power. The paper shows how constitutional settlements relate to issues of stability and non-subjugation in politics, and explains how they can ground a distinction between justice and legitimacy. (shrink)

La cuestión que se plantea es la relación que puede haber entre la crisis de legitimación de las sociedades contemporáneas, tras el declive de los grandes sistemas teóricos y metafísicos previos a la Ilustración, y la actual proliferación de las políticas de la memoria histórica. Apoyándose en los autores contemporáneos Paul Ricœur y Hannah Arendt, en este trabajo subyace la idea de que dichas políticas tratan de subsanar la ausencia de legitimación y, tal vez, de esperanza. Having visited Ireland regularly during the 1930s, Ludwig Wittgenstein resigned his Cambridge philosophy professorship in 1947 and moved there, living in a fishing village on the Atlantic coast and hotels in Dublin and the Wicklow Mountains. Although Wittgenstein spent some time out of the country, Ireland was effectively his base for three very productive years during which he worked on what would become one of his key books, the posthumously published Philosophical Investigations. Wittgenstein in Ireland represents the first sustained account (...) of Wittgenstein's time in Ireland, placing it in its historical context. Wall pays a good deal of attention to the representation of the Irish landscape in which the Austrian philosopher found himself able to work; a large part of his writings were produced in the bleak landscapes of Ireland and Norway. El objetivo de este artículo es mostrar cómo la imagen que dio Manuel Chaves Nogales de la revolución rusa a través de sus artículos en los años treinta, siendo vanguardia del periodismo de entonces, tuvo un sentido histórico. La hipótesis es que el periodismo, informando sobre el presente, puede aportar a los historiadores alguna lección. Para mostrar la conciencia histórica del periodismo de Chaves Nogales se contextualiza al autor entre otros viajeros de la época a la Unión Soviética, se analiza (...) la manera en la que Chaves interpreta las huellas de la revolución en las personas y en su entorno y se relaciona con la microhistoria. En este texto se plantea el análisis de la fisiocracia, el movimiento de economía política dirigido al mundo rural que surgió en Francia a mitad del siglo XVIII. Para ello, se parte de los trabajos y las publicaciones de economistas y de especialistas en historia de la economía, historia del pensamiento económico, y economía política. La bibliografía existente es inabarcable, máxime en el contexto de un artículo, no obstante, en las fuentes analizadas hay ciertas coincidencias a las que nos remitimos. (...) Sin ánimo de exhaustividad, se presenta una aproximación general a la fisiocracia, primera teoría de economía técnico-científica propiamente dicha, que incluye elementos y conceptos que forman parte de la economía como la noción de producto neto, la libertad de comercio (laissez-faire), la tasación, el impuesto único, la inversión del capital, el circuito económico, etc. Además, se destacan algunos de los presupuestos teóricos de la fisiocracia como economía política respecto a las preocupaciones agroecológicas y ecofeministas del presente, concretamente la puesta en valor de la producción primaria y la economía agraria. Did the Thai Rak Thai Party of Thailand, the first party in the country’s history to gain parliamentary dominance in 2001, represent a departure from traditional clientelistic Thai parties or was it old wine in a new bottle? This article argues that the TRT represented a new hybrid party that successfully established programmatic linkages in rural parts of the country by systematizing its use of informal social networks in local communities. By routinizing recruitment, training, and evaluation of its parliamentary candidates (...) and their vote-canvassing networks, the TRT imparted midlevel politicians with the incentives and ability to promote the party’s policy agenda to rural voters and to cultivate new policy-oriented linkages alongside traditional clientelistic ones. By identifying specific organizational mechanisms by which the TRT combined programmatic and clientelistic linkages with rural voters, this study contributes to literature that examines hybrid party strategies as well as informal party organization. The author analizes step by step, this confrontation, making it manifest that John Paul II advocates a style of philosophy which has a strong existential emphasis. This paper articulates and defends a novel hybrid account of well-being. We will call our view a Robust Hybrid. We call it robust because it grants a broad and not subservient role to both objective and subjective values. In this paper we assume, we think plausibly but without argument, that there is a significant objective component to well-being. Here we clarify what it takes for an account of well-being to have a subjective component. Roughly, we argue, it must allow that (...) favoring attitudes that are not warranted by the lights of objective values can ground benefits. Given this understanding, we show that there is an important and unrecognized expansion in the resources available to fully objectivist views: namely that such views can help themselves to the value of warranted love of objective goods. Such a move by the objectivist can help them respond to concerns that, on their view, a person’s well-being can be too alien to them. We next argue that, nonetheless, such objectivist views are still unconvincing due to their lack of a subjective component. This motivates a move from fully objective accounts to hybrid accounts. We show that many prominent hybrid theories in the literature are inadequate because they implausibly minimize the subjective component. This motivates a move to a robust hybrid view that has an expanded subjectivist component. We conclude with some remarks about the interrelation between the subjective and objective components in the hybrid account that we favor and a role for resonance in a theory of well-being other than serving as a hard constraint on any benefit. Many writers claim that democratic government rests on a principled commitment to the ideal of political equality. The ideal of political equality holds that political institutions ought to be arranged so that they distribute political standing equally to all citizens. I reject this common view. I argue that the ideal of political equality, under its most plausible characterizations, lacks independent justificatory force. By casting doubt on the ideal of political equality, I provide indirect support for the claim that democratic government (...) is only instrumentally justified. (shrink)

Most donated organs in the United States come from brain dead donors, while a small percentage come from patients who die in “controlled,” or expected, circumstances, typically after the family or surrogate makes a decision to withdraw life support. The number of organs available for transplant could be substantially if donations were permitted in “uncontrolled” circumstances–that is, from people who die unexpectedly, often outside the hospital. According to projections from the Institute of Medicine, establishing programs permitting “uncontrolled donation after circulatory (...) determination of death,” or uDCDD, throughout the United States has the potential to provide 22,000 more donation opportunities annually. In contrast, U.S. controlled donation after circulatory determination of death, or cDCDD, cases have increased progressively over the past decade from 87 to 848 donors, but currently account for only 10.6 percent of all deceased donors. Following the IOM recommendations, several projects exploring the feasibility of uDCDD were funded by the federal government, including a grant from the Health Resources and Services Administration that supported a pilot project in New York City in which the authors of this article participated.A key feature of our protocol, and indeed of many uDCDD protocols, is the initiation of preservation methods such as chest compressions and extracorporeal membrane oxygenation shortly after death in order to perfuse and preserve the donor's organs. Critics of uDCDD argue that the means of determining death deviates from generally ascribed principles. They assert that reinstituting circulation in order to preserve organs has the effect of “undoing” the prior determination of death. The result is that cDCDD is widely accepted and practiced routinely even though it only marginally increases the number of organs available for transplantation, and uDCDD is widely considered unacceptable despite being ethically embraced and proven to significantly increase organ donation opportunities in other countries. This article explores the evolution of this counterintuitive state of affairs and calls for a policy that, in line with the IOM report, allows for both cDCDD and uDCDD protocols. (shrink)

Jerry L. Walls, the author of books on hell and heaven, completes his tour of the afterlife with a philosophical and theological exploration and defense of purgatory, the traditional teaching that most Christians require a period of postmortem cleansing and purging of their sinful dispositions and imperfections before they will be fully made ready for heaven. He examines Protestant objections to the doctrine and shows that the doctrine of purgatory has been construed in different ways, some of which are fully (...) compatible with Protestant theology. In particular, while purgatory has often been understood as matter of punishment in order to make satisfaction for sins that have not been fully remitted, it can also be seen as the completion of the sanctification process, an account of the doctrine that is fully consistent with the Protestant doctrine of justification by faith. Purgatory assumes not only continuity of personal identity but also gradual moral and spiritual growth between death and resurrection. Different theories of personal identity are examined and assessed in light of these assumptions. Walls also shows that the traditional doctrine of purgatory is not understood as a second chance for salvation, but goes on to argue that it should be modified to allow for postmortem repentance. He concludes with an examination of C.S. Lewis's writings on purgatory, and suggests that Lewis can be a model for evangelicals and other Protestants to engage the doctrine of purgatory in a way that is true to their theology. (shrink)

In a number of publications, Gerald Gaus has presented an ambitious account of political morality that gives the ideal of public justification pride of place. This article critically discusses Gaus’s characterization and defense of the ideal of public justification in politics. It also presents an account and an argument in support of first-person political justification.

In the first edition of The Gay Science (GS), Nietzsche proposes that we treat knowledge as unconditionally valuable and life as a tragic quest for truth. In the second edition of GS, he seems to retract this proposal, suggesting that we substitute “incipit parodia” for “incipit tragœdia.” But Nietzsche does not say what he means by “parody,” or what role he believes it should play in our evaluative lives. This article proposes that by introducing parody into GS, Nietzsche intends not (...) only to correct the original text by mocking his earlier treatment of science as tragic, but also to designate parody as a basis for new tasks, duties, and values beyond what science can offer. This article speculates that parodic value creation might consist in the imitation of behaviors and practices associated with preexisting values without the reproduction of the beliefs and feelings corresponding to those practices.
