Jacques Derrida's face appeared prominently on the covers of his books as well as inside them, on posters for his public lectures, on drawings and lithographs. Derrida was also a film star whose face appeared on screen, demonstrated by the fact that at least three films depict him in some depth and reveal his talents and charisma as a performer. In the first of these, in chronological order, Ghost Dance, directed by Ken McMullen in 1983, Derrida, playing himself, is asked (...) whether he believes in ghosts and replies with a smile: ?that's a hard question because you see I am a ghost.? ?The cinema is the art of invoking ghosts,? he declares and then proceeds to explain that film is always a mise-en-scène of ghosts who send us to an invisible beyond. ?A ghost is a trace that signals in advance the presence of its absence.? This is a structure the film borrows from Sioux attempts to establish a relation with ancestors, to let their history haunt them, to make the past a living future. For Derrida, the figure of the ghost was to resurface ? perhaps we should say return ? with Specters of Marx (1993). This essay will be a ghost dance that attempts to argue that Jacques Derrida is not only a revenant (a returner) but also an arrivant, one who arrives. (shrink)

Slavoj Zizek is regarded as one of the pre-eminent European cultural theorists of the last decade. His growing body of work has generated considerable controversy and transformed the way we think about issues of popular culture and politics. This paper focuses on independent training providers (ITPs) – in other words, private companies – as suppliers of vocational education and training in post-war England. Whilst acknowledging the central role of further education (FE) colleges in delivering vocational learning, it draws attention to a large, diverse sector of ITPs operating alongside FE colleges, particularly during the 1960s and 1970s. Data suggest that around 15–20% of vocational learners were enrolled as fee-paying customers with private providers at that time – a figure (...) broadly similar to today. There are, it is argued, three related reasons for this. First, the post-war policy environment, and the varied and uneven nature of colleges at that time, allowed significant room for ITPs to operate as alternative providers of vocational education. Second, the far-reaching ‘efficiency’ gains required since FE colleges left local authority control have largely attenuated the space in which ITPs previously operated. Third, neoliberal assumptions about the superiority of private enterprise mean that ITPs now receive significant funding from the state, largely to deliver Apprenticeships and other programmes of work-related learning – which has, somewhat perversely, reduced the incentive for them to act as bone fide commercial providers of a broader range of vocational learning. Brian Calvert has offered us a clear and careful analysis of Locke′s views on punishment and capital punishment. 1 The primary goal of his paper–that of correcting the misperception of Locke as a wholehearted proponent of capital punishment for a wide range of offences–must be allowed to be both laudable and largely achieved in his discussion. But Calvert′s analysis also encourages, I think, a number of serious misunderstandings of Locke′s true position.

In his paper "Role Obligations," Michael Hardimon defends an account of the nature and justification of institutional obligations that he takes to be clearly superior to the "standard" voluntarist view. Hardimon argues that this standard view presents a "misleading and distorted" picture of role obligations (and of morality generally); and in its best form he claims this view still "leaves out" of its understanding of even contractual role obligations an "absolutely vital factor". I argue against Hardimon that a related version (...) of this "standard view" of institutional obligations is "standard" for a very good reason - namely, that it is true. (shrink)

Johnathan Cohen's book provides a lucid and penetrating treatment of the fundamental issues of contemporary analytical philosophy. This field now spans a greater variety of topics and divergence of opinion than fifty years ago, and Cohen's book addresses the presuppositions implicit to it and the patterns of reasoning on which it relies.

One challenge to the idea that animals have a moral right to life claims that any such right would require us to intervene in the wild to prevent animals from being killed by predators. I argue that belief in an animal right to life does not commit us to supporting a program of predator-prey intervention. One common retort to the predator challenge contends that we are not required to save animals from predators because predators are not moral agents. I suggest (...) that this retort fails to overcome the predator challenge. I seek to articulate a more satisfactory argument explaining why we are not required to save wild prey from predators and how this position is perfectly consistent with the idea that animals have a basic right to life. As its subtitle indicates, Democracy’s Discontent is a study of the political philosophies that have guided America’s public life. The “search” Michael Sandel describes has, in his view, temporarily come to a disappointing resolution in America’s acceptance of a liberal “public philosophy” that “cannot secure the liberty it promises” and has left Americans “discontented” with their “loss of self-government and the erosion of community”. This theme is unlikely to surprise readers familiar with Sandel’s earlier work. What may surprise them is (...) how little of Sandel’s second book is devoted to his critique of liberal theory or to his defense of his favored “republican” alternative. Far less than 10 percent of the book is devoted to characterizing liberal and republican political philosophy and to argument concerning their relative theoretical virtues. The body of Democracy’s Discontent is a history of American Constitutional law and political/economic debate, from pre-Revolutionary times to the Clinton presidency, all designed to show that the republican vision that has animated so much of that history has been recently abandoned to our detriment, replaced by a liberal public philosophy whose dramatic failure in practice “recapitulates” its “poverty in theory”. Sandel’s history is lively and engaging, and many of his analyses are insightful and persuasive. But the looseness in his treatment of theory regularly infects the conclusions he draws from this history and undermines his efforts to show that American political practice indicts liberal political philosophy. This volume is designed to set out some of the central issues in the theory of truth. It draws together, for the first time, the debates between philosophers who favor 'robust' or 'substantive' theories of truth, and those other, 'deflationist' or minimalists, who deny that such theories can be given. The editors provide a substantial introduction, in which they look at how the debates relate to further issues, such as the Liar paradox and formal truth theories.

Two new philosophical problems surrounding the gradation of certainty began to emerge in the 17th century and are still very much alive today. One is concerned with the evaluation of inductive reasoning, whether in science, jurisprudence, or elsewhere; the other with the interpretation of the mathematical calculus of change. This book, aimed at non-specialists, investigates both problems and the extent to which they are connected. Cohen demonstrates the diversity of logical structures that are available for judgements of probability, and explores (...) the rationale for their appropriateness in different contexts of application. In this paper, I examine a solution to the Liar paradox found in the work of Ockham, Burley, and Pseudo-Sherwood. I reject the accounts of this solution offered by modern commentators. I argue that this medieval line suggests a non-hierarchical solution to the Liar, according to which ?true? is analysed as an indexical term, and paradox is avoided by minimal restrictions on tokens of ?true?. In certain respects, this solution resembles the recent approaches of Charles Parsons and Tyler Burge; in (...) other respects, it is related to a suggestion of Gödel. But, as a whole, it suggests an original solution to the Liar paradox, quite unlike any current proposals. (shrink)

The book was planned and written as a single, sustained argument. But earlier versions of a few parts of it have appeared separately. The object of this book is both to establish the existence of the paradoxes, and also to describe a non-Pascalian concept of probability in terms of which one can analyse the structure of forensic proof without giving rise to such typical signs of theoretical misfit. Neither the complementational principle for negation nor the multiplicative principle for conjunction applies (...) to the central core of any forensic proof in the Anglo-American legal system. In 1905, Richard discovered his paradox of definability, and in a letter written that year he presented both the paradox and a solution to it.Soon afterwards, Poincaré endorsed a variant of Richard?s solution.In this paper, I critically examine Richard?s and Poincaré?s ways out.I draw on an objection of Peano?s, and argue that their stated solutions do not work.But I also claim that their writings suggest another way out, different from their stated solutions, and different from the orthodox Tarskian approach.I argue (...) that this second solution does not prevent the return of the paradox. Modern states claim rights of jurisdiction and control over particular geographical areas and their associated natural resources. Boundaries of Authority explores the possible moral bases for such territorial claims by states, in the process arguing that many of these territorial claims in fact lack any moral justification. The book maintains throughout that the requirement of states' justified authority over persons has normative priority over, and as a result severely restricts, the kinds of territorial rights that states can justifiably claim, and (...) it argues that the mere effective administration of justice within a geographical area is insufficient to ground moral authority over residents of that area. The book argues that only a theory of territorial rights that takes seriously the morality of the actual history of states' acquisitions of power over land and the land's residents can adequately explain the nature and extent of states' moral rights over particular territories. Part I of the book examines the interconnections between states' claimed rights of authority over particular sets of subject persons and states' claimed authority to control particular territories. I answer an argument from Charles Travis to the conclusion that minimalism about truth cannot cope with the context sensitivity of words. To do this, I construct a thought experiment involving a community whose language does not manifest context sensitivity, but whose statements do seem to be subject to truth in a minimalist sense.

Technology used in online marketing has advanced to a state where collection, enhancement and aggregation of information are instantaneous. This proliferation of customer information focused technology brings with it a host of issues surrounding customer privacy. This article makes two key contributions to the debate concerning digital privacy. First, we use theories of justice to help understand the way consumers conceive of, and react to, privacy concerns. Specifically, it is argued that an important component of consumers' privacy concerns relates to (...) fairness judgments, which in turn comprise of the two primary components of distributive and procedural justice. Second, we make a number of prescriptions, aimed at both firms and regulators, based on the notion that consumers respond to perceived privacy violations in much the same way they would respond to an unfair exchange.
