O texto analisa, ainda, a teoria de H. L. A. Hart da noçáo utilitarista de puniçáo e de justificaçáo da puniçáo, ampliando o debate aos princípios de justiça de Rawls.

O objetivo deste texto é participar do debate sobre uma filosofia da migração. Em uma época que se destaca pela discussão sobre o fechamento de fronteiras e se procura estabelecer critérios para aceitação de refugiados e migrantes, a filosofia pode auxiliar na compreensão do que se passa na atualidade. Nesse sentido, o tema das migrações, dos estrangeiros, da soberania e das atribuições do estado-nação ganham contornos demasiado importantes e que merecem um tratamento renovado. Mais do que fornecer ferramentas para a (...) solução de problemas políticos específicos, pragmáticos, a análise que se pretende aqui tem mais a ver com um exercício de compreensão de um tema que já se tornou clássico: o tema das migrações. A primeira parte deste trabalho busca, então, reconstruir as teorias que justificaram – e ainda justificam – um tratamento desigual entre cidadão e estrangeiro, entre o autóctone e o residente. Teorias da soberania, do Estado e da cidadania terão lugar especial para, em seguida, na segunda parte, propor que essas não são mais suficientes para dar conta do tema em questão. O soberanismo e a cidadania precisa ceder lugar para o tema da acolhida e da comunidade, horizontes que possibilitam como se pode encarar a demanda de coabitação com o estrangeiro, com o migrante, com o estrangeiro-residente. The methodology of Latin American economic structuralism has been generally interpreted as an implicit extension of classic French structuralism of Claude Lévi-Strauss and others, without careful examination of the methodological pronouncements of Latin American economists and social scientists. The present paper provides a detailed treatment of how Latin American structuralist methodology was formed between the 1950s and 1970s, with emphasis on Celso Furtado's views. Furtado was influenced by both C. Lévi-Strauss's and F. Braudel's apparently incompatible approaches to structure and history. (...) The study of the cultural Cold War and East–West interaction outside diplomacy and high politics has emerged as an important research field during the last two decades. With a few exceptions, however, scholarly interaction has been overshadowed by other forms of interaction. Existing research has mostly paid attention to technological exchange and to espionage, which was at times connected with scientific exchanges across the Iron Curtain. This article discusses scholarly exchanges in the human sciences between Finland and the Soviet Union. (...) Even though Finland was a western-style democracy with a market economy, it had close political ties with the Soviet Union, which allowed for the development of active scholarly connections between the countries. The paper argues against the growing tendency to interpret Brentano’s conception of inner consciousness in self-representational terms. This trend has received support from the tendency to see Brentano as a forerunner of contemporary same-order theories of consciousness and from the view that Brentano models intransitive consciousness on transitive consciousness, such that a mental state is conscious insofar as it is aware of itself as an object. However, this reading fails to take into account the Brentanian concept of object, which is (...) ultimately derived from ancient and medieval philosophy, as well as the secondary, elusive character that Brentano attributes to inner perception. According to Brentano, we have an aspectual but transparent consciousness of transcendent objects, whereas our awareness of our own mental acts is always complete but incidental, and ultimately opaque. Reversing the relationship between intentionality and consciousness faces difficulties at the textual interpretative level, but also raises theoretical problems, for it risks treating Brentano’s theory of mind as a form of subjectivism and idealism. This book not only articulates a tradition-specific Pentecostal rationality of Biblical Pragmatism, but also provides the first intellectual history of a major British classical Pentecostal denomination. Pentecostal theologians increasingly acknowledge that their theological methodology should be informed by a Pentecostal rationality, epistemology and theological hermeneutics. Simo Frestadius offers such a Pentecostal rationality from a Foursquare perspective. Frestadius first analyses and evaluates some of the main contemporary Pentecostal rationalities and epistemologies to date, with a particular emphasis on the works of Amos (...) Yong and James K.A. Smith and L. William Oliverio Jr., before proposing that Alasdair MacIntyre's tradition-focused and historically-minded narrative approach is conducive in providing a more tradition-constituted Pentecostal rationality. Utilising the methodological insights of MacIntyre, the book then provides a philosophically informed historical narrative of a major British Pentecostal tradition, namely, the Elim Foursquare Gospel Alliance, by exploring its underlying context and roots as a classical Pentecostal movement, its emergence as a religious tradition, and its two major 'epistemological crises'. Based on this historical narration and analysis, it is argued that Elim's tacit Pentecostal rationality is best defined as Pentecostal Biblical Pragmatism in a Foursquare Gospel framework. This form of rationality is then developed vis-à-vis Elim's Pentecostal concept of truth, biblical hermeneutics, and pragmatic epistemic justification in dialogue with William P. Alston. In doing the above, the book not only articulates a tradition-specific Pentecostal rationality of Biblical Pragmatism but also provides the first intellectual history of a major British classical Pentecostal denomination. In this article, we analyze how movement takes part in creating intersubjective meaning. We discuss what Daniel Stern termed ‘affect attunement,’ a primary way of constituting intersubjectivity. Based on an analysis of how movement, meaning-making, vitality affects, and primordial feelings interrelate in affect attunement, we show that primordial feelings and thereby movement play a much greater role in affect attunement than Stern proposed. This makes movement a primary meaning-making modality, indispensable to the development of intersubjectivity. To illustrate the relation between (...) movement and affect attunement in psychological development, we discuss the role of movement in autism. Recent research suggests that differences in movement precede the onset of social-communicative deficits and may be primary to autistic development. Building on the proposed interrelation of movement and primordial feelings in affect attunement, we suggest that autistic movement differences illuminate the vital role played by movement in early intersubjective development. In this paper I argue that the debate between the so-called “presentists” – according to whom only the present is real – and the “eternalists”, according to whom past present and future are equally real, has no ontological significance. In particular, once we carefully distinguish between a tensed and a tenseless sense of existence, it is difficult to find a single ontological claim on which the two parties could disagree. Since the choice of using a tense or a tenseless language (...) is dictated by purely pragmatic reasons, we should abstain from bringing to bear pseudo-debates generated by the “tensed” or the “tenseless theories” of time on the question of understanding the philosophical implications of contemporary spacetime theories, or notions like becoming, change and persistence in time. The article defends the no-harm principle as an intuitively plausible and a common-sense way to justify individual emitters’ duties to take more radical steps in the fight against climate change. The appearance of climate change as requiring large-scale collective action should not lead us astray with respect to the fundamental moral nature of the problem: individual emitters who knowingly sustain and foster the carbon intensive ways of acting also bear personal moral responsibility for the foreseeable climate-related harm and acquire in (...) line with the no-harm principle a direct personal duty to contribute to the efforts of preventing the harm. The article examines more closely the so-called collectivistic approach, according to which emitters’ responsibilities are primarily collective, and argues that without individualistic grounds of emitters’ personal moral responsibility for the harm the collectivistic approach fails to provide unstructured emitters with sufficient reason to act together and fulfil their correlative duty of effective harm prevention. The article argues that since an emitter's personal moral responsibility warrants others to expect her personal engagement in the efforts of effective harm prevention and can justify blame if she fails, identifications of personal responsibility may also significantly increase unstructured emitters’ collective capability of remedying the climate crisis. In this paper I examine the role of dispositional properties in the most frequently discussed interpretations of non-relativistic quantum mechanics. After offering some motivation for this project, I briefly characterize the distinction between non-dispositional and dispositional properties in the context of quantum mechanics by suggesting a necessary condition for dispositionality – namely contextuality – and, consequently, a sufficient condition for non-dispositionality, namely non-contextuality. Having made sure that the distinction is conceptually sound, I then analyze the plausibility of the widespread, monistic (...) ontological thesis about the reducibility of dispositional properties to categorical properties in the context of the philosophy of quantum mechanics. I conclude that with the exception of Bohmian mechanics, the other “minimally realist” views of quantum mechanics require essential dispositions, i.e., dispositions of a non-reducible kind. Interestingly, seen behind the lenses of dispositionalism, Bohr’s and Bohm’s interpretations of quantum mechanics are much closer than it is usually recognized, a fact that could teach us something about the way the quantum world is. Taking the regime established by the Convention on Biological Diversity as a foundation, the purpose of this article is twofold. First, it examines how the international biodiversity regime integrates the private property paradigm into its toolbox for conservation and sustainability and then critically evaluates the shortcomings of the intellectual property mechanism. Second, it argues that the increasing ubiquity of open access emerging technologies should lead the international community to carefully assess the benefits for conservation research of reverting to a framework (...) that places biodiversity within the global commons. The impasse between global commons advocates and the intellectual property status quo obscures the underlying problematic of the “commodity fiction” of biodiversity and increasing use of digital sequence information likely exacerbates power asymmetries. One remedy explored here is an alternative to these two approaches that dislodges rather than discards the concept of private property. Drawing inspiration from Polanyi and building on May (2010), the article shows how a hybrid approach bridging a public and private conception of genetic resources and traditional knowledge could more effectively and equitably distribute benefits to countries and communities providing resources of value to industry. La thèse de l’« inexistence intentionnelle » formulée par Brentano a été traditionnellement interprétée comme une théorie de la « relation intentionnelle », autrement dit de la relation entre l’acte mental et son « objet immanent » ou « intentionnel », c’est-à-dire interne à la conscience. Se fondant sur la lecture du fameux passage sur l’intentionnalité de la Psychologie du point de vue empirique , le présent article démontre que l’interprétation ontologique de la théorie de l’intentionnalité du premier Brentano est (...) insoutenable, toute dominante qu’elle est. Pour ce faire, nous partirons des sources de la pensée de Brentano, en particulier de la théorie de la perception et des relatifs d’Aristote, pour rejeter la conception de l’objet immanent ou intentionnel comme entité immanente à la conscience et mettre en évidence la continuité qui existe entre la première conception de Brentano de l’intentionnalité et la seconde, consécutive à ce qu’on définit comme le tournant réiste de sa pensée.Brentano’s thesis of “intentional inexistence” has been traditionally interpreted as a theory of “intentional relationships”, i.e., of the relation between a mental act and its “immanent” or “intentional object”, within consciousness. Starting from the famous passage on intentionality in Psychology from an Empirical Standpoint , the present paper shows that the dominant ontological interpretation of Brentano’s former theory of intentionality is untenable. Proceeding from the sources of Brentano’s thought, in particular from Aristotle’s theory of perception and of relatives, the conception of the immanent or intentional object as an immanent entity to consciousness is rejected. Instead, the continuity between Brentano’s former conception of intentionality and the subsequent one, following the so-called reistic turning-point in his thought, is highlighted. (shrink)

According to Peirce one of the most important philosophical problems is continuity. Consequently, he set forth an innovative and peculiar approach in order to elucidate at once its mathematical and metaphysical challenges through proper non-classical logical reasoning. I will restrain my argument to the definition of the different types of discrete collections according to Peirce, with a special regard to the phenomenon called ?premonition of continuity? (Peirce, 1976, Vol. 3, p. 87, c. 1897).

Activities protesting against major polluters who cause climate change may cause damage to private property in the process. This paper investigates the case for a more international general basis of moral justification for such protests. Specific reference is made to the Kingsnorth case, which involved a protest by Greenpeace against coal-powered electricity generation in the UK. An appeal is made to Rawlsian fairness arguments, traditionally employed to support the obligation of citizens to their national governments as opposed to their international (...) duties. The argument made here, however, is that there seem to be sufficient reasons for holding that a stable climate is one of the first truly global public goods that is indispensable to acceptable standards of living everywhere. This would suffice to justify international and intergenerational 'atmospheric' political obligations, which in turn may justify protests - even those causing some damage to private property - against the laws and policies that violate the fair terms of cooperation in providing a stable climate. The fairness argument aims also to provide a ground from which Green political theory could integrate accounts of radical forms of citizenship into appeals to state political authority. This leads to justifying acts of civil disobedience on the basis of novel understandings of 'atmospheric' citizenship obligations. (shrink)

This article inspects Peirce’s resonances on Deleuze’s semiotic. Whereas most of the literature agrees that Deleuze adapts Peirce’s semiotic to serve his Bergsonian-based theory of sign, this article claims that the relationship of Deleuze with Peirce’s writings is more foliated than it may appear at first. The development of this hypothesis invites to trace back Deleuze’s works before his very acquaintance with Peirce in the 1980s. Therefore, one of Peirce’s classical issues – the role that relations and habits play for (...) the triadic conception of sign – is considered with Deleuze’s early studies, in which he developed this same issue as to approach Hume and Proust. This background echoes years later in Deleuze’s incursion to Peirce’s semiotic in the 1980s ninety-two classes and two books on cinema. In fact, Deleuze’s own triadic conception of sign and his acknowledged pragmatist inclination prove to be closer to Peirce’s pragmatism than the scholarly literature tends to think or argue. The aim of this article is not, however, to build an overwhelming philosophical identity between Deleuze and Peirce, it sets up instead a steadier basis from where to understand their differences. Deleuze’s ignored five-year long lectures on cinema shows to be exegetically revealing with respect to his debts towards Peirce. (shrink)

Franz Brentano was a leading philosopher and psychologist of the nineteenth century. Indeed, the impact of his scholarship was so great that he became synonymous with a school of thought and a new approach in scientific philosophy. The Brentano School stood against the Idealistic and post-Kantian German tradition and Brentano played a crucial role in the founding of Austrian philosophy. He had an enormous impact on the work of Husserl and Heidegger, as well as on Moore’s _Ethics_ and Stout and (...) Russell’s analysis of mind. In particular, situated between the phenomenology movement and the analytic tradition, the concept of intentionality was redefined by Brentano and has been—and remains—a key concept of twentieth- and twentieth-first century philosophy of mind. But Brentano not only reshaped philosophy of mind; he was also a remarkable and innovative thinker in several other fields of philosophy, and recent debate in metaethics, metaphysics, and the history of analytic philosophy shows a strong resurgence of interest in Brentano’s thought. Published to coincide with the centenary of Brentano’s death, this four-volume collection, a new title from Routledge Major Works, provides an essential intellectual tool for the exegetical evaluation of all aspects of Brentano’s work. This article provides the first historiographical analysis of the origins of Jewish Orthodoxy in Helsinki and describes the development of the rabbinate from the establishment of the congregation in the late 1850s up to the early 1980s. The origins of the Finnish Jewish community lies in the nineteenth-century Russian army. The majority of Jewish soldiers in Helsinki originated from the realm of Lithuanian Jewish culture, that is, mainly non-Hasidic Jewish Orthodoxy that emerged in the late eighteenth century. Initially, the Finnish (...) Jewish religious establishment continued this Orthodox-Litvak tradition. After the independence of Finland, the Helsinki congregation hired academic, Modern Orthodox rabbis educated in Western Europe. Following the devastation of the Shoah and the Second World War, the recruitment of rabbis faced new challenges. Overall, the rabbi recruitments were in congruence with the social and cultural development of the Helsinki community, yet respected its Orthodox roots. (shrink)

This paper argues that Deonna and Teroni's attitudinal theory of emotions faces two serious problems. The first is that their master argument fails to establish the central tenet of the theory, namely, that the formal objects of emotions do not feature in the content of emotions. The second is that the attitudinal theory itself is vulnerable to a dilemma. By pointing out these problems, our paper provides indirect support to the main competitor of the attitudinal theory, namely, the perceptual theory (...) of emotions. (shrink)

In 1877 Louis Paul Cailletet in France and Raoul Pictet in Switzerland liquefied oxygen in the form of a mist. The liquefaction of the first of the so-called permanent gases heralded the birth of low-temperature research and is often described in the literature as having started a ‘race’ for attaining progressively lower temperatures. In fact, between 1877 and 1908, when helium, the last of the permanent gases, was liquefied, there were many priority disputes—something quite characteristic of the emergence of a (...) new research field. This paper examines Cailletet’s path to the liquefaction of oxygen, as well as a debate between him and the Polish physicist Zygmunt Wróblewski over the latter’s contribution to the liquefaction of gases.
