Perfect ethical duties have usually puzzled commentators on Kant's ethics because they do not fit neatly within his taxonomy of duties. Ethical duties require the adoption of maxims of ends: the happiness of others and one's own perfection are Kant's two main categories. These duties, he claims, are of wide obligation because they do not specify what in particular one ought to do, when, and how much. They leave ‘a latitude for free choice’ as he puts it. Perfect duties, however, (...) such as the duties of respect, to avoid suicide, lying, and servility, do not appear to require the adoption of ends but only the performance or omission of specific types of actions. The puzzle is how these duties can be ethical, and therefore wide. Faced with this difficulty, Mary Gregor denies that perfect ethical duties are wide. She claims that they are an ‘anomaly’ and that they do not belong to ethics proper but to moral philosophy in general. She argues that these duties are derived from the categorical imperative, instead of, as Kant himself appears to have thought, the first principle of virtue. Taking a very different approach, Onora O'Neill finds the perfect/imperfect distinction of little importance and suggests doing without it altogether. Most other interpreters also assume that ‘wide’ is opposed to ‘perfect’ so that a wide perfect duty is a conceptual impossibility. (shrink)

I criticize the widely accepted “practical” interpretation of the universality test contained in Kant’s first formula of the categorical imperative in the Groundwork of the Metaphysics of Morals – the formula of the universal law of nature. I argue that this interpretation does not work for contradictions in conception because it wrongly takes contradictions in the will as the model for them and, as a consequence, cannot establish a clear distinction between the two kinds of contradiction. This interpretation also assumes (...) an understanding of universality that departs from Kant’s own and, cannot, for this reason, capture the kind of contradiction that he explicitly claims to establish. I provide an alternative interpretation, which I call revised logical interpretation, that allows us to account for contradictions in conception, including those examples that the practical interpretation cannot handle, as well as to establish a clear distinction between the two kinds of contradiction. Friends and foes of liberal neutrality assume that neutrality presupposes pluralism. On this view, the state should be neutral among the many permissible conceptions of the individual good that citizens affirm. I argue that neutrality need not be construed as a response to pluralism. I focus on the case of specifically religious neutrality and argue that it can be an appropriate political response to what I call “the fact of religious hegemony,” which is a social scenario in which a particular (...) religion is unanimously recognized as dominant. Religious neutrality, in this kind of context, requires the state to avoid all religious words and symbols that can be taken as an expression of endorsement or criticism of religion. I take this conception of religious neutrality from both political history and current political practice and discourse. Neutrality was originally conceived of as a proper political response in contexts of religious hegemony both in France and in Mexico. Today, and despite the growth of religious pluralism, this conception continues to be a live political posture in the places where it first originated. I call it “neutrality as independence from religion” and argue that it differs from liberal neutrality in crucial respects. (shrink)

De acuerdo con Hume, las evaluaciones morales se basan en los sentimientos de aprobación o de desaprobación que experimentamos al contemplar el carácter de una persona desde un punto de vista general. También sostiene que la adopción de esta perspectiva no se debe a una exigencia de la razón, sino que obedece a operaciones naturales de la imaginación. En este trabajo discuto la pregunta sobre el mecanismo psicológico por el que adoptamos este punto de vista general. Para ello explico primero (...) otras operaciones de la imaginación que son centrales en las evaluaciones morales: la asociación de percepciones en la producción de las pasiones del amor, el orgullo, el odio y la humildad; la transmisión de fuerza y vivacidad entre las percepciones; y la simpatía. A continuación señalo que el supuesto mecanismo natural de la imaginación por el cual adoptaríamos el punto de vista general parece no poder existir. Sugiero que, en lugar de ello, esta perspectiva puede concebirse como una construcción social o, como Hume diría, un "artificio" de los seres humanos. In this thesis I consider two common, though directly opposed, interpretations of Kantian morality. According to what I call "the other-regarding interpretation," Kantian morality is primarily about the regulation of human interaction. According to what I call "the private and internal interpretation," Kantian morality is primarily self-regarding since what chiefly matters, on this view, is adopting moral motives. I argue that both interpretations rest on a failure to understand Kant's distinction between ethics and justice , a distinction which he introduces (...) in The Metaphysics of Morals, on which I primarily focus. As I interpret this distinction, ethics addresses the question about the supreme individual good , whereas justice addresses the question how to make possible the coexistence of the freedom of action of a plurality of agents who pursue their personal ends. I argue that the other-regarding interpretation tends to reduce morality to justice , whereas the internal and private interpretation reduces morality to ethics and cannot accommodate Kantian justice as part of morality. I focus most of my attention on the former view because it has been significantly more influential in recent debates. Against this view, I argue that ethics, on Kant's account, is about the pursuit of the supreme individual good , and not about the regulation of human interaction. The tendency to reduce morality to justice is manifest in the thesis that the justification of principles of personal morality rest upon an agreement as well as in a certain version of the thesis of the priority of the right over the good. Both theses are present in the work of Jurgen Habermas. The use of agreement is common among followers of John Rawls's who attempt to extend his Contractarian justification of principles of justice to the domain of personal morality. Such an extension, I argue, presupposes an understanding of personal morality by analogy with justice. Paradoxically, these two theses are regarded as "Kantian," though they have contributed to the distortion in recent debates of what I argue is central to Kant's ethics. (shrink)

Mis objeciones conceptuales y metodológicas se orientan eminentemente a cuestionar su tesis básica sobre el alcance y especificidad del rol motivacional de la felicidad en tanto que componente del bien supremo. In this work, the author highlights the significance of happiness in Kant's Ethics, aiming at establishing its relation to virtue. This paper is an investigation of the role of comedy in philosophical thinking, particularly of how comedy reveals the erotic dimension of philosophical thinking.In the first half of the paper, I show that the relation between comedy and Eros is a powerful means to understand in what way philosophy is not technē. Philosophy in its erotic and comedic character is, rather, engaged with an appearing of things as ‘birthed’ or ‘living.’ In the second part of the paper, I focus on (...) the role of comedy in the Laches. There I study the complex relationship between philosophy as erotic thinking and andreia or ‘manliness.’ I show that philosophy as erotic must distinguish itself from manliness and that the enactment of this differentiation is the core of the Laches. At the same time, manliness is not simply something that philosophy should not concern itself with. Philosophy must ask the question ‘what is manliness?’ as a way of enacting manliness and overcoming it, in an overcoming through which philosophy comes to its own erotic core. (shrink)

abstract The possibility that organ sales by living adults might be made legal is morally distressing to many of us. However, powerful arguments have been provided recently supporting legalisation (I consider two of those arguments: the Consequentialist Argument and the Autonomy Argument). Is our instinctive reaction against a market of organs irrational then? The aim of this paper is not to prove that legalization would be immoral, all things considered, but rather to show, first, that there are some kinds of (...) arguments, offered in favour of legalisation, that are, in an important sense, illegitimate, and second, that even if legalisation might not be wrong all things considered, there are good reasons for our negative moral intuitions. Moreover, identifying these reasons will help highlight some features of moral decisions in non‐ideal situations, which in turn might be relevant to some other moral or policy choices. (shrink)

In his recent article, ‘A Gift to Theology? Jean-Luc Marion's ‘Saturated Phenomena’ in Christological Perspective’, Brian Robinette has critiqued Marion's phenomenology for confining theology to a one-sided approach to Christology, one that stresses only the passive, mystical reception of Christ. To correct this imbalance, Robinette brings Marion into dialogue with those more active Christologies or ‘prophetical-ethical’ liberation theologies of Gustavo Gutierrez, Johann Baptist Metz and others that stress a life-praxis focused on confronting evil and suffering. In this essay I am (...) arguing that Robinette has not fully developed the ‘logic’ of Marion's phenomenology of the ‘call and the gifted’, in which both a passive and an active element are operative. I explore more fully that very dynamic phenomenological process of the call-and-the-gifted as developed in Marion's work Being Given: Toward a Phenomenology of Givenness. Once viewed in Christological perspective, and especially in light of Christ's death and resurrection, Marion's phenomenology entails an ethical trope consistent with the mission of Christ as rendered in Scriptural revelation, and thus the gap between Marion's work and the prophetical-ethical theologies of Gutierrez and Baptist Metz becomes narrowed. In The Contemplative Self after Michel Henry: A Phenomenological Theology, Joseph Rivera provides a close and critical reconstruction of the philosophical anthropology of Michel Henry (1922-2002) while also addressing the question of how theology contributes to Henry's phenomenology. In conversation with other French figures such as Derrida, Marion, Lacoste, and Barbaras, Rivera undertakes a global thematic study of Henry's work. He shows how, for Henry, the theological debate is shifted onto a phenomenological problem, with a coincident will to (...) pursue the epistemological efforts of Husserl and Heidegger. The chapters tackle some of the most pressing debates in contemporary Continental philosophy, such as the "modern ego," the nature and experience of temporality, and the constitution of the body and otherness, and how a theological discourse may illumine those anthropological structures. The book expands on the modern narrative of the self from Descartes to Nietzsche, opens up the particular lines of inquiry Henry advances in dialogue with those figures and phenomenology in particular, and highlights the surprising theological turns in Henry's late work on Christianity. Because Henry's work is difficult, it is often misunderstood; Rivera's own vision of the self, one that is shaped by Henry but not in full agreement with him, advances insights internal to Henry but also brings into sharp focus many problematic points in Henry's phenomenological theology. An array of classical theological voices appear in the final chapters, such as St. Augustine, Tertullian, Irenaeus, Pseudo-Dionysius, and Gregory of Nyssa, all of whom are set in dialogue with Henry. A fresh and creative articulation of contemplation and selfhood, the volume is a valuable addition to the continuing conversation that seeks to build bridges between phenomenology and theology. Genetic research in human beings poses deep ethical problems, one being the problem of distributive justice. If we suppose that genetic technologies are able to produce visible benefits for the well being of people, and that these benefits are affordable to only a favored portion of society, then the consequence is obvious. We are introducing a new source of inequality. In the first section of this paper, I attempt to justify some concern for the distributive consequences of applying genetics to (...) human beings. This concern transcends a mere preoccupation for material equality. I argue that genetic inequality can undermine the very basis of social cooperation, at least regarding health care. The second section is more practical. My aim is to defend how, at least in some legal and cultural frameworks , the undesired distributive consequences of genetics are more likely to arise and more difficult to avoid. (shrink)

La recepción durante el siglo XX se preguntó si la filosofía nietzscheana era a-, im- o anti-política, es decir, si podía ser asimilada por la democracia, o si era antimoderna, elitista y reaccionaria. El italiano Roberto Esposito ha propuesto leerla como formando e informando el paradigma de la biopolítica. Se discuten cuatro lecturas de esa biopolítica: como formadora del paradigma de la inmunidad, como tanatopolítica, como liberal y neoliberal, y como biopolítica afirmativa. Twentieth-century readers wondered if Nietzschean philosophy was apolitical, (...) impolitic, or anti-political; that is, if it could be assimilated by democracy or if it was antimodern, elitist, and reactionary. The Italian philosopher Robert Esposito has proposed reading Nietzsche's philosophy as forming and informing the biopolitical paradigm. Four readings of these biopolitics are discussed: as part of the paradigm of immunity, as thanatopolitics, as liberal and neoliberal, and as affirmative biopolitics. (shrink)

Edited by Ivette Fred-Rivera and Jessica Leech. What is the relationship between ontology and modality: between what there is, and what there could be, must be, or might have been? Throughout a distinguished career, Bob Hale’s work has addressed this question on a number of fronts, through the development of a Fregean approach to ontology, an essentialist theory of modality, and in his work on neo-logicism in the philosophy of mathematics. This collection of new essays engages with these themes (...) in Hale’s work in order to make further progress in our understanding of ontology, modality, and the relations between them. Some essays directly address questions in modal metaphysics, drawing on ontological concerns. Others raise questions in modal epistemology and its links to matters of ontology, such as the challenge to give an epistemology of essence. There are also several essays engaging with questions of what might be called ‘modal ontology’: the study of whether and what things exist necessarily or contingently. Such issues can be raised and addressed directly, but they also have an important bearing on the kinds of semantic commitments engendered in logic and mathematics, e.g., to the existence of sets, or numbers, or properties, and so on. It is thus explored in some chapters to what extent one’s ontology—and indeed, one’s ontology of necessary beings—interacts with other plausible assumptions and commitments. (shrink)

This article examines a specific case of lying, at the same time judicial and mediatic, promoted from the highest levels of political power, the Leon Trotsky case, from the perspective of the work done by the International Commission of Investigation chaired by the American philosopher John Dewey. After a general justification and contextualization of the subject, and a historical account of the events that surrounded the “Moscow Trials” and the constitution of the Dewey Commission, some of the reasons why the (...) commission concluded that such processes had been judicial assemblies are reported. It closes with a reference to the way Dewey later denounced the media falsification of these events through the book Mission to Moscow. (shrink)

En el presente artículo, se sostiene que el actual escenario internacional se ha caracterizado por una profunda interrelación, y la integración emerge como una estrategia de inserción global de relevancia, especialmente para países como Chile. Esta integración no es sólo económica sino que también incluye el movimiento de personas. No obstante, la integración y la movilidad de personas se ven afectadas por los prejuicios y las desconfianzas, lo que se ha reflejado en el fenómeno migratorio peruano en Chile. Desde esta (...) perspectiva, la construcción de un marco institucional para alcanzar mayores grados de integración de los inmigrantes peruanos en Chile, no sólo requiere avances en el ámbito económico-laboral, sino que también en el área educacional-cultural, promoviendo una educación basada en la interculturalidad, capaz de marcar el camino hacia una mayor tolerancia e integración entre ambas sociedades, y así superar quiebres históricos, como lo fue la Guerra del Pacifico. In this paper, I discuss exploitative transactions in bioethics. Examples of this kind of transactions allegedly include, among others, commercial surrogacy, organ selling, and research with human subjects in developing countries. The most problematic kind of exploitation is what Allan Wertheimer calls “mutually advantageous exploitation:” the weak party’s consent for the transaction is an effective and rational consent. Moreover, W does not suffer any harm by the transaction; on the contrary, the transaction benefits W. My aim in this paper is (...) twofold. From the perspective of individual ethics, I offer a model to understand the nature of the wrongfulness of the strong party’s action. And from the perspective of legal ethics, I suggest some reasons to believe that the prohibition of beneficial exploitative contracts is problematic and can only be justified in very exceptional cases. Bioethics embraces a number of ethical problems connected to medicine, biomedical research, and health law. Most of these have both a universal dimension and a more particular one. Reproductive rights, exploitation, commodification, biomedical research, and the protection of the environment, among others, are issues that can be discussed from a universal perspective.

Los defensores de la ética de la virtud usualmente califican a la ética kantiana como una moralidad centrada en el acto porque, sostienen, su principal objeto de evaluación moral son los actos particulares, con lo cual un acto puede ser moralmente bueno a pesar de que el carácter de quien lo lleva a cabo no sea virtuoso. Sostienen que, por el contrario, la ética debe centrarse en el carácter de las personas, de modo que un acto es moralmente valioso sólo (...) cuando es la expresión de un carácter virtuoso. El propósito de este artículo es mostrar que, en contra de lo que sostienen los partidarios de la ética de la virtud, el principal objeto de evaluación moral en la ética kantiana es el carácter de las personas. El imperativo categórico no exige la realización de actos particulares, sino la adopción de máximas de fines, las cuales son principios para una vida completa. Sostengo que la adopción de estas máximas necesariamente requiere la adquisición de un carácter virtuoso, de tal modo que quien se compromete sinceramente con los principios éticos lleva a cabo acciones buenas y tiene también un carácter moral. El artículo, de intención didáctica, intenta ser una presentación alternativa a la concepción del método en Hegel. Parte de la premisa de que ésta es tomada como una estrategia para reconciliar la modernidad ilustrada, particular-mente tras el evento de la Revolución Francesa de 1789, tanto con el proyecto fundacional epistémico de la modernidad temprana como con su pasado antagónico: La concepción de la racionalidad retórica y hermenéutica, tal y como ésta procede de Platón y Aristóteles. El método de Hegel se (...) inscribiría en un afán por fusionar los aspectos omnipotentes de las narrativas ilustradas con los métodos premodernos de vinculación finita y fragmentaria con el sentido de la realidad. El texto sugiere la caducidad del proyecto, ante la ostensible inviabilidad contemporánea ante el optimismo ilustrado que lo inspira. (shrink)

En la filosofía política aristotélica, la definición biológica del hombre como “animal político” funciona como justificación para la creación de la polis. Aristóteles clasifica al hombre como un animal caracterizado por su habilidad racional y comunicativa, capacidades que lo determinan a formar comunidades con miras a la “vida buena”. Esta definición de la naturaleza humana supone la creación de la polis; el único espacio donde el hombre puede desarrollar sus virtudes y vivir una vida plena y feliz. Dentro de esta (...) polis, Aristóteles le otorga participación política solo a los individuos que cum-plen con esta descripción. A partir de esto surge la pregunta: ¿Quiénes quedan al margen de la polis? Fuera de este espacio político quedan todos los que hacen posible la vida en la polis: las mujeres, los trabajadores y los esclavos. Más allá de estas redes económicas y sociales queda el propósito de este artículo, la “bestia”: los seres humanos caracterizados por su carencia de disposición política tanto en instancias desarrolladas como la polis y las más primitivas como la aldea o el hogar. De esta manera, los hombres bestiales son inútiles para la vida en comunidad ya que no cumplen con su función como animales políticos y sus acciones no están guiadas por un bien común. Se argumentará que a partir de esto que la bestia padece una triple exclusión: la política, al negársele la posibilidad de ciudadanía; la social, al prohibirle la partici-pación en la comunidad que sustenta económicamente a la polis y, por último, la biológica al ser excluido del conjunto conceptual de los hombres. Se analizará la manera en que la influencia teórica de las ciencias biológicas y médicas sobre la noción de “vida” imponen una transformación de las construcciones políticas, ideológicas y legales de un Estado que puede ser descrito como biopolítico. Para esto, se acudirá al análisis de la transformación de la idea operativa de “vida” desde la perspectiva agambiana de la politización de la muerte y la pretensión de disolver el umbral de decidibilidad entre vida y muerte para tomar, luego, tres (...) ejemplos de instancias legales en las que puede terminarse con la vida sin contradecir el propósito biopolítico de protegerla; esto es, instancias en las cuales no existe penalización ante la finalización de la vida. Estos tres ejemplos, que se presentarán de manera progresiva son: a) la eutanasia, b) el aborto y c) la contracepción. Es importante aclarar que no se pretende defender ni condenar en un plano moral las instancias de decisión sobre la disposición de una vida distinta de la propia, ni tampoco dar argumentos para que algo así se haga. Por el contrario, lo que aquí se pretende es aportar una dimensión explicativa –y analítica– desde el marco de la biopolítica, siguiendo, quizá, la sugerencia agambiana respecto de la necesidad de adoptar una perspectiva de este tipo para poder tener una comprensión adecuada de ciertos fenómenos políticos.
