Macmurray provides a conceptual and personal reference point around which we can locate a tradition of social humanism that unfolds from the British idealists to the communitarians. Some communitarian themes appear in the thought of the idealists: these include a vitalist analysis of behaviour, a 'thick' view of the person, and a positive concept of freedom defined in relation to others. Macmurray developed these themes and introduced others largely as a result of reworking idealism so as to come to terms (...) with the crisis of reason associated with the First World War. He rejected objective idealism with its concept of absolute mind for a personal idealism that incorporated an action-based metaphysics. Doing so prompted him to adopt other communitarian themes: these include an appeal to friendship and love, a contrast between society and community, and an appeal to religion to transcend the limits of justice. While contemporary communitarians have inherited much from philosophers such as Macmurray, they have also developed the tradition of social humanism. Philosophers such as Sandel, Taylor and Walzer have done so through grappling with the implications of multiculturalism for the idea of a cosmopolitan community. Ethical socialists like Tony Blair and Raymond Plant have done so through grappling with issues such as a decline in solidarity as it influences the welfare state. (shrink)

The interface between mental health services and the criminal justice system presents challenges both for professionals and patients. Both systems are stressed and inherently complex. Section 136 of the Mental Health Act is unusual being both an aspect of the Mental Health Act and a power of arrest. It has a long and controversial history related to concerns about who has been detained and how the section was applied. More recently, Section 136 has had a public profile stemming from the (...) use of police cells as places of safety for young, mentally disturbed individuals. This paper explores the current state of health of this piece of legislation. Specifically, we consider whether alternative approaches are more suitable for those individuals in crisis and/or distress who come into contact with the police. This requires careful thought as to the proper role of both health and criminal justice professionals who are daily grappling with an ethically contentious domain of multiagency work. (shrink)

This paper considers the political manipulation of language in the UK governmental fairness agenda. It employs Marcuse’s analytical notion of the suppression of the transitive meaning of “the word” within “the sentence.” Further to this it links the operationalizing of language with positivist and uncritical policy epistemologies used by the UK coalition government. Using this theoretical framework the paper draws out the two broad meanings of the term “fairness” used to legitimate public-sector cuts on the one hand, and by researchers (...) concerned with issues of structural inequality on the other. The modernist and scientific juxtaposition of object and subject are inappropriate when investigating the nature of “knowledge.” This commentary argues that the usual methodological dichotomy fails when it is applied to the domain of “knowledge.” The two instead coalesce within the topic itself, demanding the most careful self-awareness.

Substantial medical evidence shows that about half of ovarian cancers originate in the fallopian tube. Some medical organizations and clinical articles have suggested opportunistic salpingectomy to reduce the risk of ovarian cancer in patients at average risk of developing it. This entails removing the fallopian tubes at the same time as another procedure that would occur anyway. The authors argue that the principles of totality and double effect can justify such salpingectomies, even though there is a low incidence of ovarian (...) cancer. Since screening tools for ovarian cancer are ineffective and treatment options are poor, the good effect of reducing the risk of death from this type of ovarian cancer can be proportionate to the bad effects of the minor increase in surgical risk over the other procedure, the unintended side effect of infertility, and the removal of normally functioning tissue. The authors conclude that it is within the purview of a patient and physician to determine whether the benefits are proportionate to the risks in a particular case. (shrink)

We report on the deliberations of an interdisciplinary group of experts in science, law, and philosophy who convened to discuss novel ethical and policy challenges in stem cell research. In this report we discuss the ethical and policy implications of safety concerns in the transition from basic laboratory research to clinical applications of cell-based therapies derived from stem cells. Although many features of this transition from lab to clinic are common to other therapies, three aspects of stem cell biology pose (...) unique challenges. First, tension regarding the use of human embryos may complicate the scientific development of safe and effective cell lines. Second, because human stem cells were not developed in the laboratory until 1998, few safety questions relating to human applications have been addressed in animal research. Third, preclinical and clinical testing of biologic agents, particularly those as inherently complex as mammalian cells, present formidable challenges, such as the need to develop suitable standardized assays and the difficulty of selecting appropriate patient populations for early phase trials. We recommend that scientists, policy makers, and the public discuss these issues responsibly, and further, that a national advisory committee to oversee human trials of cell therapies be established. **NB we did not reccommend a NAC, we think it might be appropriate**. If stem cell-based therapies are developed, we will likely confront a difficult problem of justice: for biological reasons alone, the new therapies might benefit only a limited range of patients. In fact, they might benefit primarily white Americans, thereby exacerbating long-standing differences in health and health care.

In the study reported here we examined the impact of population size and two proxies of risk of resource failure on the diversity and complexity of the food-getting toolkits of hunter–gatherers and small-scale food producers. We tested three hypotheses: the risk hypothesis, the population-size hypothesis, and a hypothesis derived from niche construction theory. Our analyses indicated that the toolkits of hunter–gatherers are more affected by risk than are the toolkits of food producers. They also showed that the toolkits of food (...) producers are more affected by population size than are the toolkits of hunter–gatherers. This pattern is inconsistent with the predictions of both the risk hypothesis and the population-size hypothesis. In contrast, it is consistent with the predictions of the niche construction hypothesis. Our results indicate that niche construction has affected the evolution of technology in small-scale societies and imply that niche construction must be taken into account when seeking to understand technological variation among food producers and the technological changes that occurred in association with the various transitions to farming that have occurred over the last 10,000 years. My aim in this piece is to understand what kinds of acts sneering acts are. I aim to look at what sneering acts do and what social function they perform. In particular, I want to mark them out as acts of ‘making people feel’. I explore the grounds on which we might criticize sneering acts, and ask whether the thing that we do when we sneer is always vicious.

The text of Theaetetus 155b1-2 as recorded in the manuscripts and printed in current editions of the dialogue is marked by a syntactical anomaly (ἀλλά postpositum) and a logical non sequitur (arbitrary transition from a copulative to an existential use of εἷναι and vice versa). Attempts at emendation by Proclus, Stephanus and Campbell have all been unsuccessful. To find the way back to Plato's original text, the reader will have to fight his way through a logical tangle (the result of (...) a double negation) and abandon the modish, but erroneous, belief that there is no difference in ancient Greek between ``complete'' and ``incomplete'' uses of εἷναι. The modern editorial practice of printing Old English poetry one verse to a line with a distinct separation between half-lines distracts attention from a well-known and important fact, that Old English poetry is copied without exception in long lines across the writing space. Normal scribal practice does not distinguish verses, reserving capitals and points for major divisions of a work. In manuscripts of Latin poetry, however, quite another practice holds. Latin verses copied in England after the eighth century are regularly (...) transmitted in a format familiar to modern readers: verses are set out one to a line of writing, capitals begin each line, and often some sort of pointing marks the end of each verse. The regularity of this distinction in copying practice and the difference in the nature and level of the graphic conventions used for verse in the two languages imply that such scribal practice was deliberate and was useful and significant for contemporary readers. From the early 1970s Conor Cruise O'Brien acquired a reputation in Ireland and internationally as one of the most vociferous critics of nationalism. While many see the origins of his critique in his reaction to the emergence of militant nationalism in Northern Ireland at this time, in this article I argue that the foundations of O'Brien's anti-nationalism had already been laid in the postwar European context. The article illustrates how O'Brien's historical and intellectual experience in the aftermath (...) of the Second World War had an essentially conservative influence on his thought, providing him with a pool of ideas which he would later employ in his attack on nationalism, and Irish nationalism in particular. I therefore maintain that there is a lot more continuity in O'Brien's thought than is sometimes assumed. (shrink)

In chapter 3 of Wild Animal Ethics Johannsen argues for a collective obligation based on beneficence to intervene in nature in order to reduce the suffering of wild animals. In the same chapter he claims that the non-identity problem is merely a “theoretical puzzle” which doesn’t affect our reasons for intervention. In this paper I argue that the non-identity problem affects both the strength and the nature of our reasons to intervene. By intervening in nature on a large scale we (...) change which animals come into existence. In doing so, we enable harmful animals to inflict harms on other animals, and we put other animals in harm’s way. The harms that these animals will inflict and endure are foreseeable. Furthermore, since non-human animals aren’t moral agents, harmful animals cannot be morally responsible for their harmful actions. I argue therefore that by causing animals to exist, knowing that they will inflict and suffer harms, we become morally responsible for those harms. By engaging in identity-affecting actions then we take on secondary moral duties towards the animals we have thereby caused to exist, and these secondary moral duties may be extremely demanding, even more so than the initial costs of intervention. Finally, these duties are duties of justice rather than duties of beneficence, and as such are more stringent than purely beneficence-based moral reasons. Furthermore, this conclusion flows naturally from several plausible principles which Johannsen explicitly endorses. (shrink)

The tributes are followed by synopses of a small sample of Dr. Hoffman's many journal articles published in (...) several different business ethics journals spanning 35 years (1982–2017). Doctors have an ethical and legal duty to respect patient confidentiality. We consider the basis for this duty, looking particularly at the meaning and value of autonomy in health care. Enabling patients to decide how information about them is disclosed is an important element in autonomy and helps patients engage as active partners in their care.Good quality data is, however, essential for research, education, public health monitoring, and for many other activities essential to provision of health care. We discuss whether (...) it is necessary to choose between individual rights and the wider public interest and conclude that this should only rarely be necessary. The paper makes some recommendations on practical steps which could help ensure that good quality information is available for work which benefits society and the public health, while still enabling patients’ autonomy to be respected. Teilhard’s cosmological speculation is a valuable basis for an environmental ethics that perceives individual natural objects as good in themselves and the world as good in itself. Teilhard perceives man as fundamentally part of a cosmic environmental whole that is greater than mankind taken individually or collectively. His holistic views on human biological and psychological and social evolution are, I argue, compatible with a biocentric environmental ethics. I discuss some similarities and differences with the views of the deep ecology movement. (...) I show that Teilhard’s hierarchical system is not humanistically oriented in a way that need be interpreted by Teilhardians as contrary to environmental well-being. I argue that Teilhard’s sympathies toward transportation technology, including the automobile, can be interpreted in his holistic manner. I conclude that Teilhard’s theocentric views are also a basis for supporting an environmental ethics which is both optimistic and not anthropocentric. (shrink)

The cosmic cycle described in the surviving fragments of Empedocles' poem is the alternation, in endless succession, of Love and Strife. Dr O'Brien's book is primarily an analysis of this elaborate system. It seeks to determine the positions which Love and Strife occupy in the world at different times.

It is suggested that George Cotkin's essay is unpersuasive in its two central claims. Firstly, the evidence is not persuasive that there has been a discernible "moral turn" among historians in the last two decades; rather, it is argued that an engagement with morality has been fairly constant in historical scholarship since its ancient origins. Secondly, it is felt that Cotkin is evasive on whether he wishes historians merely to have opinions about the moralities of others in the past or (...) to be moral agents themselves; the first position is thought to be tenable, the latter probably not. In this chapter I defend a novel view of the relationships among intention for the future, self-control, and co-operation. I argue that when an agent forms an intention for the future she comes to regard herself as criticizable if she does not act in accordance with her intention and as praiseworthy if she does. In forming intentions, then, agents acquire dispositions to have reflexive evaluative attitudes. In contexts where the agent has inclinations that run contrary to her unrescinded intention, these (...) evaluative attitudes help her to resist these inclinations. Intentions have, in other words, a built-in mechanism for self-control. I go on to argue that this mechanism can also function as a mechanism for co-operative behaviour. Sometimes a common species of co-operation just is the exercise of self-controlled behaviour in a social context. If this is on the right track, agents like us are not just equipped to formulate and abide by plans for the future, we are also thereby equipped for exercising self-control and participating in co-operative ventures. ANALOGY has not just to do with the abstruse details and niceties of metaphysics but rather underlies the structure of all metaphysical thought. It is the heart of metaphysics. No system of metaphysics can discard it, without prejudice to the richness and variety of being. Without analogy there is elimination and over-simplification. Metaphysics is far from being a straightforward science; it is highly complex and its method and style of argument are not easy to master. Its field of inquiry is (...) wide. Niche construction is the process whereby organisms, through their activities and choices, modify their own and each other’s niches. By transforming natural-selection pressures, niche construction generates feedback in evolution at various different levels. Niche-constructing species play important ecological roles by creating habitats and resources used by other species and thereby affecting the flow of energy and matter through ecosystems—a process often referred to as “ecosystem engineering.” An important emphasis of niche construction theory (NCT) is that acquired characters play an evolutionary (...) role through transforming selective environments. This is particularly relevant to human evolution, where our species has engaged in extensive environmental modification through cultural practices. Humans can construct developmental environments that feed back to affect how individuals learn and develop and the diseases to which they are exposed. Here we provide an introduction to NCT and illustrate some of its more important implications for the human sciences. (shrink)

Stich begins his paper "What is a Theory of Mental Representation?" (1992) by noting that while there is a dizzying range of theories of mental representation in today's philosophical market place, there is very little self-conscious reflection about what a theory of mental representation is supposed to do. This is quite remarkable, he thinks, because if we bother to engage in such reflection, some very surprising conclusions begin to emerge. The most surprising conclusion of all, according to Stich, is that (...) most of the philosophers in this field are undertaking work that is quite futile: It is my contention that most of the players in this very crowded field have no coherent project that could possibly be pursued successfully with the methods they are using. (p.244) Stich readily admits that this is a startling conclusion; so startling, he thinks, that some may even take it as an indication that he has simply "failed to figure out what those who are searching for a theory of mental representation are up to" (p.244). But it is a conclusion that he is willing to stand by, and he sets about it defending it in the body of his paper. Stich, I think, is right about this—I do take his conclusion to indicate that he has failed to figure out what those who are searching for a theory of mental representation are up to. And he has failed to do this largely because he has failed to distinguish between the theory of mind that is implicit in our folk psychology and the mental mechanism that is responsible for our capacity to make folk psychological judgements. When this conflation is undone, so too is the reasoning that takes Stich to his startling conclusion. This is not to say that the conclusion itself is clearly false; it is merely to say that Stich has failed to show that it is true. In what follows I will defend this analysis of Stich's self-conscious reflections on what a theory of mental representation is supposed to do. I will begin with a very brief exposition of Stich's survey of the logical terrain in this part of the philosophical landscape and the line of reasoning that subsequently delivers up the aforementioned conclusion. I will then go on to argue that the latter line of reasoning is fundamentally misdirected because of an error in the former survey. (shrink)

Stobaeus records a placitum where Empedocles says that the world is destroyed by the domination in turn of Love and of Strife. The placitum makes perfectly good sense in the context of Empedocles' belief that Love and Strife produce, in turn, a non-cosmic state of total unity (Love) and of total separation (Strife). But for over two hundred years scholars have been unable to hear that simple message. Sturz (1805) emended the text so as to make it fit the non-cyclical (...) interpretation of Empedocles that he had taken over from the pages of Tiedemann (1791). When Diels included Stobaeus' text in his edition of Aetius, in the "Doxographi graeci" (1879), he failed to remove the emendation, although his own reconstruction of the chapter heading in Aetius made the emendation impossible. Twenty years later, Diels saw the light, and printed Stobaeus' placitum, unemended, in his "Poetarum philosophorum fragmenta" (1901) and in successive editions of his "Fragmente der Vorsokratiker" (from 1903 onwards). But Kranz resurrected the emendation in the "Nachträge" to his sixth edition of the "Fragmente der Vorsokratiker" (1951). The emended placitum is used again by Uvo Hölscher (1965) to support a non-cyclical interpretation of Empedocles and is repeated in the latest collection of the fragments and testimonia (Brad Inwood, 1992). Hölscher fails to appreciate that the text that he uses to support his reconstruction is merely Sturz's translation into Greek of the non-cyclical interpretation of Empedocles proposed by Tiedemann at the end of the eighteenth century. Most models of corporate social responsibility revolve around the controversy as to whether business is a single dimensional entity of profit maximization or a multi-dimensional entity serving greater societal interests. Furthermore, the models are mostly descriptive in nature and are based on the experiences of western countries. There has been little attempt to develop a model that accounts for corporate social responsibility in diverse environments with differing socio-cultural and market settings. In this paper an attempt has been made to fill (...) this gap by developing a two-dimensional model of corporate social responsibility and empirically testing its validity in the context of two dissimilar cultures – Australia and Bangladesh. The two dimensions are the span of corporate responsibility and the range of outcomes of social commitments of businesses. The test results confirm the validity of the two-dimensional model in the two environments. The Factor analysis revealed two leading dimensions. Cluster analysis pointed to two distinctive clusters of managers in both Australia and Bangladesh, one consisting of managers with a broad contemporary concept of social responsibility, and the other with a limited narrow view. The paper concludes that corporate social responsibility is two-dimensional and universal in nature and that differing cultural and market settings in which managers operate may have little impact on the ethical perceptions of corporate managers. How is it that we think and refer in the first-person way? For most philosophers in the analytic tradition, the problem is essentially this: how two apparently conflicting kinds of properties can be reconciled and united as properties of the same entity. What is special about the first person has to be reconciled with what is ordinary about it. The range of responses reduces to four basic options. The orthodox view is optimistic: there really is a way of reconciling these (...) apparently contradictory properties as contained within the same thing. The heretical views are pessimistic and content to be so: there is no such way, and that is because there is simply nothing to reconcile – because there is really nothing special about what is in question; or there is really nothing ordinary about it; or there is really nothing ….
