In my paper, I document a “travel” journey of concept formation and its concrete expression in law, which also constituted a literal travel journey across continents. Through poetic-hermeneutical approaches to language, guided by previously existing concepts stemming from experiences of the Holocaust, communism, and African-American feminist analyses of rape as an attack on a racial/ethnic group, a previously invisible domain of the human condition was charted. Throughout history, sexual atrocities have been committed within the context of wars, but their weaponisation (...) as acts of genocide remained unarticulated. This changed in the 1990s with Serbia-Yugoslavia’s genocidal wars against its neighbours (Editorial comment: The author uses the term Serbia-Yugoslavia to refer to the entity that succeeded the breakup of the Socialist Federal Republic of Yugoslavia after Croatia and Slovenia declared independence on June 25th, 1991. The SFRY up to that point consisted of the six republics Bosnia and Herzegovina, Croatia, Macedonia, Montenegro, Serbia (including the so-called autonomous regions of Kosovo and Vojvodina), and Slovenia. Further declarations of independence by Macedonia and Bosnia and Herzegovina on April 27, 1992, left only Serbia and Montenegro who the same day declared themselves to be the Federal Republic of Yugoslavia (FRY). In 2003, the Federal Republic of Yugoslavia was reconstituted as the State Union of Serbia and Montenegro, which existed until Montenegro and Serbia declared their independence (on June 3rd and June 5th, 2006, respectively)). I sketch the genesis of the concept of sexual atrocities as genocide in connection with my personal journey and how it guided legal prosecution of this “new” crime. My own travel-experience began with my association with Asja Armanda, and her discovery of coordinated mass rapes, when she came to the aid of survivors fleeing the Serbian attacks on Croatia, crimes she attempted to bring to international attention to prevent their expansion into Bosnia-Herzegovina and Kosovo. Testimonials reached me in the U.S. as well. I went to Croatia to join Armanda, where we named the crime “sexual atrocities as genocide.” On the basis of this new concept, we filed a lawsuit in New York against Bosnian Serb leader Radovan Karadžić, pioneering this crime’s recognition under international law. I conclude with philosophical questions that Putin’s similar genocidal attack on Ukraine raises today. (shrink)

International law has recently recognized that sexual atrocities can be acts of genocide. This precedent was pioneered through a landmark lawsuit in New York against Radovan Karadžić, head of the Bosnian Serbs (Kadic v. Karadzic, 1993–2000), a case in which I played a central role. I argue that we may situate this development philosophically in relation to Hannah Arendt’s Eichmann in Jerusalem: A Report on the Banality of Evil. She aims to secure a better understanding of genocide than was achieved (...) at the Nuremberg Trials (1945) and at the Eichmann trial (1961). Arendt claims that these trials were limited by formalism because they applied familiar paradigms onto these new experiences in a manner that obscured what was distinctive about them and that demanded original thinking and a new paradigm. Nuremberg obscured genocide by miscasting it as a traditional “war crime,” a problem that the Jerusalem court exposed butcould have better clarified. Through a first-hand account, I show how we too had to secure a new paradigm by treating the facts on their own terms and coining the crime as “genocidal rape.” We had to wrest this paradigm from a prevailing approach that also formally applied the category of “war crimes” onto these experiences in a way that obscured them and interfered with justice. In Eichmann in Jerusalem: A Report on the Banality of Evil, Hannah Arendt aims to secure a more adequate understanding of the new crime of genocide so that it can be prosecuted in a manner that better serves justice. She criticizes the Nuremberg Trials and, to a lesser extent, the Jerusalem trial of Nazi war criminal Adolf Eichmann for miscasting this unprecedented crime in terms of familiar concepts and thereby obscuring it. Arendt claims that this atrocity, instead, demanded original thinking (...) that emanated from a closer grappling with these new experiences. I argue that her criticism reflects Heideggerian phenomenology. This approach questions absolute concepts from a position more consciously planted in the world, which Heidegger considers the source of original thinking. However, Arendt extends this approach to the domain of ethics and law and confronts genocide instead of aligning with those who perpetrated it. (shrink)

In her book Extended Rationality: A Hinge Epistemology (2015), Annalisa Coliva puts forward an anti-sceptical proposal based on the idea that the notion of rationality extends to the unwarrantable presuppositions “that make the acquisition of perceptual warrants possible” (2015: 150). These presuppositions are commonly the target of sceptical arguments, and by showing that they are on the one hand unwarrantable, but on the other are constitutive components of rationality itself, she reveals that they are beyond rational doubt and thus avoids (...) scepticism. Part of Coliva’s defence of using extended rationality in this way involves distancing it from relativist interpretations, which she describes as “devastating” (2015: 120). She proposes two ways that someone might attempt to formulate epistemic relativism from her extended rationality view, and argues that both would be unsuccessful because they require describing alternative conceptions of rationality which are “unintelligible” (in the first case), or “inconceivable” (in the second). The superficial claim of this chapter is that Coliva’s arguments, as they stand, are insufficient to dismiss relativism. She fails to show that the conception of rationality needed for the first formulation of relativism is unintelligible, and overestimates the significance of the second formulation’s conception turning out to be inconceivable. But I also highlight a deeper problem: neither formulation follows a realistic blueprint for relativism, and so these were the wrong possibilities to consider in the first place. To address this issue, I propose a third, more plausible, way in which someone might attempt to formulate relativism on the basis of Coliva’s account. I leave open whether this strategy is successful, or whether a version of Coliva’s criticisms apply to it too. (shrink)

Sometimes we make a decision about an action we will undertake later and form an intention, but our judgment of what it is best to do undergoes a temporary shift when the time for action comes round. What makes it rational not to give in to temptation? Many contemporary solutions privilege diachronic rationality; in some “rational non-reconsideration” (RNR) accounts once the agent forms an intention, it is rational not to reconsider. This leads to other puzzles: how can someone be motivated (...) to follow a plan that is contrary to their current judgment? How can it be rational to form a plan to resist if we can predict that our judgment will shift? I show how these puzzles can be solved in a framework where there are multiple units of agency, distinguishing between the judgments of the timeslice and those of the person over time, and allowing that the timeslice can “self identify”, taking the person over time as the relevant unit of agency and doing intrapersonal team reasoning (with a different causal role for intentions than RNR accounts). On my account, resisting temptation is compatible with synchronic rationality, so synchronic and diachronic rationality are aligned. However, either resisting or succumbing to temptation can be instrumentally rational, depending on the unit of agency that is identified with. In order to show why we ought to resist temptation, we need to draw on a non-instrumental rationale. I sketch possible routes for doing this. (shrink)

Several European countries have recently started taking steps to protect access to abortion. France is one of these, with a bill having made its way through the legislature to enshrine the ‘liberté garantie’ (‘guaranteed freedom’) to an abortion in its constitution. It is the first country in the world to explicitly include abortion access in its constitution. Although abortion was decriminalised in France in 1975, proponents of the bill stated that they were motivated by protecting freedom for future generations (rather (...) than any perceived current threats)—the French minister for justice described this as characteristic of constitutional lawmaking.1 Enshrining such a freedom within the constitution was not without opposition. Although the bill passed through the Assemblée in January 2024 with 99 votes in favour and 13 against,2 it followed 8 hours of debate in which a number of issues were discussed. The Sénat (the upper house of Parliament) was initially thought to be more likely to oppose the bill. The bill was carried through the Sénat, however, with its Law Commission indicating prior to debate that it would not oppose making abortion a constitutional freedom, despite ‘some reservations’ about the text of the bill.3 Some of the issues raised in the Assemblée related to the language used, with some parliamentarians preferring to constitutionalise the ‘droit’ (right) to abortion; in line with language used in previous debates on the subject, rather than the term ‘liberté’ that was settled on.4 Other concerns were raised about the appropriateness of ‘preventative constitutionalisation’,5 the potential impact on a clinician’s ability to exercise conscientious objection6 and fears of creating an imbalance more generally between women’s …. Background In May 2020, England moved to an opt-out organ donation system, meaning adults are presumed to be an organ donor unless within an excluded group or have opted-out. This change aims to improve organ donation rates following brain or circulatory death. Healthcare staff in the UK are supportive of organ donation, however, both healthcare staff and the public have raised concerns and ethical issues regarding the change. The #options survey was completed by NHS organisations with the aim of understanding (...) awareness and support of the change. This paper analyses the free-text responses from the survey. Methods The #options survey was registered as a National Institute of Health Research (NIHR) portfolio trial [IRAS 275992] 14 February 2020, and was completed between July and December 2020 across NHS organisations in the North-East and North Cumbria, and North Thames. The survey contained 16 questions of which three were free-text, covering reasons against, additional information required and family discussions. The responses to these questions were thematically analysed. Results The #options survey received 5789 responses from NHS staff with 1404 individuals leaving 1657 free-text responses for analysis. The family discussion question elicited the largest number of responses (66%), followed by those against the legislation (19%), and those requiring more information (15%). Analysis revealed six main themes with 22 sub-themes. Conclusions The overall #options survey indicated NHS staff are supportive of the legislative change. Analysis of the free-text responses indicates that the views of the NHS staff who are against the change reflect the reasons, misconceptions, and misunderstandings of the public. Additional concerns included the rationale for the change, informed decision making, easy access to information and information regarding organ donation processes. Educational materials and interventions need to be developed for NHS staff to address the concepts of autonomy and consent, organ donation processes, and promote family conversations. Wider public awareness campaigns should continue to promote the positives and refute the negatives thus reducing misconceptions and misunderstandings. In this paper I explore the relationship between social epistemology and relativism in the context of feminist epistemology. I do this by focusing on one particular branch of feminist epistemology - a branch known as standpoint theory - and investigating the connection between this view and epistemic relativism. I begin by defining both epistemic relativism and standpoint theory, and by briefly recounting the standard way that the connection between these two views is understood. The literature at the moment focuses on (...) an aspect of standpoint theory called the epistemic advantage thesis, and on an aspect of relativism which has been called equality. I then show that the connection between relativism and standpoint theory actually turns on a different aspect of standpoint theory, known as the standpoint thesis, and on an aspect of relativism which has been called non-neutrality. I argue that shifting our attention to these other aspects reveals that standpoint theory is clearly and unavoidably relativist, but that this isn’t a problem - standpoint theory can capture everything that it set out to, even on a relativist understanding of the view. Defences of perspectival realism are motivated, in part, by an attempt to find a middle ground between the realist intuition that science seems to tell us a true story about the world, and the Kuhnian intuition that scientific knowledge is historically and culturally situated. The first intuition pulls us towards a traditional, absolutist scientific picture, and the second towards a relativist one. Thus, perspectival realism can be seen as an attempt to secure situated knowledge without entailing epistemic relativism. A very (...) similar motivation is behind feminist standpoint theory, a view which aims to capture the idea that knowledge is socially situated, whilst retaining some kind of absolutism. Elsewhere I argue that the feminist project fails to achieve this balance; its commitment to situated knowledge unavoidably entails epistemic relativism (though of an unproblematic kind), which allows them to achieve all of their feminist goals. In this paper I will explore whether the same arguments apply to perspectival realism. And so I will be asking whether perspectival realism too is committed to an unproblematic kind of relativism, capable of achieving scientific goals; or, whether it succeeds in carving out a third view, between or beyond the relativism/absolutism dichotomy. In this volume, we suggest new perspectives with which critical animal studies (CAS) can contribute to the development of knowledge and praxis in two fields-dehumanization and critical border studies, both concerned with human migration, refuge, and territorial or other borders. CAS is an interdisciplinary field that reflects on the ethics of humans' relationships with other animals, how the oppression of nonhuman animals intersects with other forms of oppression, and how economic interests drive oppression. The book explores Oakeshott's thought on the key role human imagination plays in relation to the political. It addresses four main themes: imagination, foundational narratives, the question of political societies' identities as well as that of human living-together, to use Hannah Arendt's expression. The book's main objective is to show that Oakeshott may be rightfully understood to be a philosopher of the imagination as well as a foundationalist thinker in the Arendtian narrative constructivist tradition.

In this article, I examine the consequences of Mamou’s recent solution to the so-called problem of reindividuation. The problem is first proposed by John Broome as an argument against the Humean view of rationality and subjective decision theory. Essentially, Broome argues that the reindividuation of outcomes must be constrained in some way if the axioms of rationality are not to be vacuous, but the constraints on individuation cannot be consistent with the Humean view of rationality. Mamou offers an elegant Humean (...) solution to this problem. We do not need such rules for reindividuation since the subjective decision theory operates under the assumption of maximal relevance of description, and only under that assumption do the axioms tell anything. Thus the problem of reindividuation dissolves in a quite natural and simple way. However, I argue that if we connect this solution to the topic of justification for the requirements of rationality, problems arise. I examine the influence of the solution on the common argument for the axioms of decision theory, the so-called money-pump arguments. These arguments are a staple in the justification of the axioms of subjective decision theory. I argue that they are in collision with Mamou’s solution. This collision brings us to the dilemma: either accept Broome’s conclusions or lose the money-pump arguments as an effective tool for justification of the axioms. I conclude that neither of the options is really good for the defenders of the Humean view of rationality. (shrink)

Xenophobia is one of the key drivers of marginalisation, discrimination, and conflict, yet many prominent machine learning fairness frameworks fail to comprehensively measure or mitigate the resulting xenophobic harms. Here we aim to bridge this conceptual gap and help facilitate safe and ethical design of artificial intelligence (AI) solutions. We ground our analysis of the impact of xenophobia by first identifying distinct types of xenophobic harms, and then applying this framework across a number of prominent AI application domains, reviewing the (...) potential interplay between AI and xenophobia on social media and recommendation systems, healthcare, immigration, employment, as well as biases in large pre-trained models. In this paper I make the case for a feminist hinge epistemology in three steps. My first step is to explain hinge epistemologies as contemporary epistemologies that take Wittgenstein’s work in On Certainty as their starting point. My second step is to make three criticisms of this literature as it currently stands. My third step is to introduce feminist epistemologies, which argue that social factors like race and gender affect what different people and groups justifiably believe, and argue that developing (...) a feminist hinge epistemology is both plausible and desirable. Universities and other research institutions are increasingly providing additional training in research integrity to improve the quality and reliability of research. Various training courses have been developed, with diverse learning goals and content. Despite the importance of training that focuses on moral character and professional virtues, there remains a lack of training that adopts a virtue ethics approach. To address this, we, a European Commission-funded consortium, have designed a train-the-trainer programme for research integrity. The programme is based on (1) virtue (...) ethics, (2) the ethos of science, (3) learning by doing and (4) learner-centred teaching. The blended learning programme combines e-learning modules with participatory group sessions. Trainers are taught how to guide researchers through a series of structured exercises for fostering reflection on scientific virtues, and how to promote understanding and application of the European Code of Conduct for Research Integrity. Trainers are provided with adaptable tools and resources that can be used and combined in different ways. The programme implementation began in Spring 2020 and 470 trainers have participated to date. When trainers were asked to grade – between 0 (very bad) and 10 (excellent) – the e-learning modules and the participatory exercises, 60% scored a grade 8 or higher (median = 8, IQR = 2) for the e-learning modules, whereas 80% scored a grade 8 or higher (median = 9, IQR = 1) for the participatory exercises. A majority felt that the training helped them as a trainer to learn about ways to organise and teach a research integrity course (82%) and would recommend the interactive exercises to others (92%). Trainers have educated over 3300 researchers in Europe using our virtue-based approach. The VIRT2UE train-the-trainer programme fosters research integrity by providing trainers with exercises and tools which enable them to stimulate the development of good researchers across Europe. Feminist epistemologies hold that differences in the social locations of inquirers make for epistemic differences, for instance, in the sorts of things that inquirers are justified in believing. In this paper we situate this core idea in feminist epistemologies with respect to debates about social constructivism. We address three questions. First, are feminist epistemologies committed to a form of social constructivism about knowledge? Second, to what extent are they incompatible with traditional epistemological thinking? Third, do the answers to these questions (...) raise serious problems for feminist epistemologies? We argue that some versions of two of the main strands in feminist epistemology – feminist standpoint theory and feminist empiricism – are committed to a form of social constructivism, which requires certain departures from traditional epistemological thinking. But we argue that these departures are less problematic than one might think. Thus, (some) feminist epistemologies provide a plausible way of understanding how (some) knowledge might be socially constructed. (shrink)

Mainstream epistemologists don’t tend to discuss feminist epistemologies. They often don’t mention them in introductory courses or textbooks, and they almost invariably don’t take themselves to work on them. This is probably due to a suspicion that ‘feminist’ epistemologies are clouded by political motivations. In this paper I will argue two things. First, that this suspicion is misguided – a number of ‘mainstream’ epistemologists (specifically, hinge epistemologists), are in fact doing work which is entirely compatible with feminist epistemologies, and the (...) ‘extra ingredient’ required to turn a hinge epistemology into a feminist epistemology needn’t involve political motivations. And second, that bringing feminist epistemologies into the mainstream can benefit hinge epistemologies – by adding the extra ingredient which turns a hinge epistemology into a feminist epistemology, hinge epistemologists increase the motivations they can appeal to in support of their responses to scepticism. O objetivo do artigo é analisar a primeira parte do Livro V da Ética Nicomaqueia, dedicado a discutir a justiça, para mostrar que o método ali empregado não é dialético. Muitos estudiosos em anos recentes atribuíram a Ética Nicomaqueia como um todo o método descrito no Livro VII 1, cujo objetivo parece ser aquele de salvar as mais importantes opiniões sobre o assunto. Contrariamente a esta posição, pretendemos encontrar procedimentos característicos das investigações científicas tal como descritos nos Segundos Analíticos, II (...) 1-3 e 8-10, que, com respeito ao objeto da investigação, iniciam por responder à questão ei estin e prosseguem em busca da definição de sua essência através de passos sucessivos, um dos quais é a indicação de uma definição nominal. It is evident, in the face of the COVID-19 pandemic that has physicians confronting death and dying at unprecedented levels along with growing data suggesting that physicians who care for dying patients face complex emotional, psychological and behavioural effects, that there is a need for their better understanding and the implementation of supportive measures. Taking into account data positing that effects of caring for dying patients may impact a physician’s concept of personhood, or “what makes you, ‘you’”, we adopt Radha (...) Krishna’s Ring Theory of Personhood (RToP) to scrutinise the experiences of physicians working in intensive care units (ICU) using a fictional scenario that was inspired by real events. The impact of death and dying, its catalysts, internal constituents, external factors, dyssynchrony, and buffers, specific to ICU physicians, were identified and explored. Such a framework allows for ramifications to be considered holistically and facilitates the curation of strategies for conflict resolution. This evaluation of the RToP acknowledges the experience and wide-ranging effects it has on ICU physicians. As such, our findings provide insight into their specific needs and highlight the importance of support on a personal and organisational level. Although further research needs to be conducted, the RToP could serve as the basis for a longitudinal assessment tool supported by the use of portfolios or mentorship due to their provision of personalised, appropriate, specific, timely, accessible and long-term support. Application of Einstein special theory of relativity in chemistry seems to be superfluous; energies are too low. The average velocity of electron in hydrogen atom is 1/135 c, making its actual mass only 26,6 ppm bigger than the rest mass. However, for heavier elements relativistic effects have to be taken into account and, more, many phenomena cannot be explained without ascribing new mass to electrons, in accordance with Einstein theory. In this paper such phenomena are described: color of metallic gold (...) and Bi and Pb compounds, contraction of Ln-X bond of lanthanide trihalides, voltage of lead-acid and Zn/HgO battery, and the shape of gold clusters. Besides, essentials of Einstein theory and quantum chemistry were problems concerning the validity of Lavoisier law. (shrink)

The evolution of belt conveyors, as an important type of continuous conveying machinery, is examined here in a historical perspective. For this purpose, the selected period is from the ancient time, i.e. occurrence of conveying equipment, and up to the end of the nineteenth century. The basic postulation of a modern machine, including conveyors, is often interlinked to that of its ancestor, which may be simple and primitive. Ancient machines and principles of their work were the basis for later improvements (...) which also brought the inventions in engineering. For instance, Archimedes lifted water to high altitude with a screw, which was regarded as the ancestor of today’s screw conveyor and essentially his design has not changed since then. Bucket elevators also have their predecessors dating back to ancient times. In the concrete case of belt conveyors, a first trace can be found in the beginning of the seventeenth century, even classified as primitive example. During the Industrial Revolutions, various machines, such conveyors, appeared. The first modern-like belt conveyors are dedicated to the late eighteenth century due to the invention of Oliver Evans in USA and to the nineteenth century, by Lyster in England, Lopatine in Russia and Thomas Robins in USA. The technical solutions developed by the end of the nineteenth century were forerunners of the today’s belt conveyors, while the key operational principles have not changed. (shrink)

Virtually all epistemologists agree that truth is a necessary condition for knowledge. Assuming that our three-dimensional world is nested within a higher-dimensional space, I use multidimensional geometry to present a type of case which undermines this fundamental principle of epistemology. I further argue that we would be unlikely to revise our epistemic practices in light of new discoveries even if our world turned out to be substantially different and many of our beliefs turned out to be false.

Different views on the connection between relativism and feminist epistemologies are often asserted but rarely are these views clearly argued for. This has resulted in a confusingly polarised debate, with some people convinced that feminist epistemologies are committed to relativism (and that this is a reason so be suspicious of them) whilst others make similar criticisms of anti-feminist views and argue that relativism has no place in feminist epistemologies. This chapter is an attempt to clarify this debate. I begin by (...) asking the question “are feminist projects and goals best served by relativism, or by absolutism?” I then sketch out four broad positions one could take on the answer to this question, and evaluate arguments for each one. In the end I conclude that feminist projects can, at least sometimes, be served by relativism, and that the claim they can be served by anti-relativism is under-supported. (shrink)

Background:Moral distress is a complex phenomenon frequently experienced by critical care nurses. Ethical conflicts in this practice area are related to technological advancement, high intensity work environments, and end-of-life decisions.Objectives:An exploration of contemporary moral distress literature was undertaken to determine measurement, contributing factors, impact, and interventions.Review Methods:This state of the science review focused on moral distress research in critical care nursing from 2009 to 2015, and included 12 qualitative, 24 quantitative, and 6 mixed methods studies.Results:Synthesis of the scientific literature revealed (...) inconsistencies in measurement, conflicting findings of moral distress and nurse demographics, problems with the professional practice environment, difficulties with communication during end-of-life decisions, compromised nursing care as a consequence of moral distress, and few effective interventions.Conclusion:Providing compassionate care is a professional nursing value and an inability to meet this goal due to moral distress may have devastating effects on care quality. Further study of patient and family outcomes related to nurse moral distress is recommended. (shrink)

The diagnostic category of borderline personality disorder (BPD) has come under increasing criticism in recent years. In this paper, we analyze the role and impact of epistemic injustice, specifically testimonial injustice, in relation to the diagnosis of BPD. We first offer a critical sociological and historical account, detailing and expanding a range of arguments that BPD is problematic nosologically. We then turn to explore the epistemic injustices that can result from a BPD diagnosis, showing how they can lead to experiences (...) of testimonial injustice which impede patient engagement in meaning-making activities, thereby undermining standard therapeutic goals. We conclude by showing how our arguments bolster ongoing efforts to replace the diagnostic category of BPD with alternatives such as complex post-traumatic stress disorder. (shrink)

Argumenti sa inkongruentnim protivdelovima su elegantni i efektni, i privukli su prilicno veliku paznju kod odredjenog broja autora, koji su argumente kritikovali na razne nacine, ili ih branili. Rasprave su se pritom odaljile od originalnog Kantovog argumenta, i od duha tog vremena, i primila obelezja moderne filozofije i geometrije. U ovom tekstu bi trebalo da pokazem da Kant, kao (...) i oni koji su ga kasnije branili, nisu postigli svoj cilj - nije dat konkluzivan argument protiv relacionizma. (shrink)

In the literature of collective intentions, the ‘we-intentions’ that lie behind cooperative actions are analysed in terms of individual mental states. The core forms of these analyses imply that all Nash equilibrium behaviour is the result of collective intentions, even though not all Nash equilibria are cooperative actions. Unsatisfactorily, the latter cases have to be excluded either by stipulation or by the addition of further, problematic conditions. We contend that the cooperative aspect of collective intentions is not a property of (...) the intentions themselves, but of the mode of reasoning by which they are formed. We analyse collective intentions as the outcome of team reasoning, a mode of practical reasoning used by individuals as members of groups. We describe this mode of reasoning in terms of formal schemata, discuss a range of possible accounts of group agency, and show how existing theories of collective intentions fit into this framework.
