Abstract:: This essay addresses the notion of public order from the point of view of biopolitics. With that aim, it relates the authoritarian response to social protest with the moral ordering of public space, using the case of the 15-M movement in Spain. Then, it reads the notion of public order as a dispositive, in the Foucauldian sense of the term. Departing from there, it presents a brief genealogical approach to the relations among sexual and racial ordering o public space. (...) Finally, in dialogue with Sarah Ahmed and Mary Douglas, it explores the role of the biopolitics of public order in the constitution and policing of the moral and physical, internal and external borders separating the political community from its various others. Vamos a tratar de comprender la concepción de la identidad en la obra de Butler, fundamentalmente a partir de El género en disputa. Profundizaremos para ello en su teoría de la performatividad, tratando tanto a los autores que posibilitaron su desarrollo (Austin, Derrida) como a algunos de sus críticos (especialmente Seyla Benhabib y Pierre Bourdieu). Nos preocupan especialmente las discusiones en torno a la constitución discursiva del sujeto, y el modo en que se plantea la oposición entre estar constituido por (...) el discurso y estar determinado por él. Trataremos finalmente de comprender el lugar de la obra de Butler en el panorama general del feminismo contemporáneo, explorando algunas de las razones que impiden interpretarla como un desplazamiento teórico que permanezca en el marco de la teoría feminista. El imperativo cultural de la monogamia impregna toda la arquitectura jurídica del Estado y, al mismo tiempo, la excede, saturando las relaciones sociales de formas no siempre evidentes. A partir de ese presupuesto, este trabajo se centra, geográficamente, en Brasil y, temporalmente, en el contexto abierto por la pandemia de covid-19, con el objetivo de defender la hipótesis de que la monogamia se ha visto reforzada en cuanto principio organizador del campo de la sexualidad y de las relaciones de parentesco (...) durante el episodio pandémico. El análisis propuesto pretende alertar, además, sobre las formas en que las normas de excepción implementadas durante las crisis pandémicas se sedimentan en el cuerpo social, pasando así a formar parte constitutiva del orden público. En la primera recurro a la contracultura drag negra y latina de los Estados Unidos para releer la negativa de Rosa Parks a ceder su asiento en el autobús. A continuación, se plantea una genealogía queer de los usos de la teatralidad en las formas contemporáneas del activismo urbano. A partir del encuentro entre ambas líneas temporales defiendo, en diálogo con la obra reciente de Judith Butler, la importancia de la (...) dimensión performativa de las intervenciones individuales en espacios de protesta para entender el alcance movilizador de la acción colectiva. Esta revisión de la idea de comunidad se pondrá en relación con el desarrollo de la medicina social urbana explorado por Michel Foucault para deslocalizar la resistencia a los procesos de estigmatización y normalización puestos en marcha por (...) la pandemia del sida para pensar, hoy, las biopolíticas emergentes en nombre del cuidado de la salud colectiva. Judith Butler draws on Emmanuel Levinas’ ethics in order to question processes of humanization and dehumanization taking place through various practices of representation of the face of the other. This is a singular reading leading Levinas’ work to the field of media representations conceived as an agonistic social landscape where the demand of the face is offered or, on the contrary, hidden from us. In that sense, Butler’s cultural transposition of Levinasian ethics entails a politicization of ethics which is indistinguishable, (...) at the end, from an ethic assault to the politics of representation. In this cultural bond among ethics and politics arise fundamental questions on responsibility linking it to the practice of cultural translation while offering alternatives to some common universalist shortcuts of contemporary ethical reflection.Keywords: Cultural translation, ethical responsibility, ethics of alterity. This paper addresses some relations between the spatial politics of queer assemblies in spaces of protest and the constitution of collective political subjects. It does so by exploring the spatial politics of queer activism within the global Occupy movements, in the light of Judith Butler’s work on the performative power of assembly and the ambivalences of the Foucauldian concept of heterotopia. Specific challenges faced by queer activists in various encampments will be addressed in order to expose some tensions between the (...) constitutive exclusions inherent to the constitution of spaces of protest and the processes of coalition building needed to effectively overcome those very constitutive exclusions. El ciclo de protestas que se abrió en las primaveras árabes ha servido para revitalizar la reflexión teórica sobre el modo en que los procesos de agenciamiento político son indisociables de los modos de producción de los espacios de coalición. Es el caso de Judith Butler en Cuerpos aliados y lucha política, junto con otras autoras que han mostrado la importancia de pensar los modos de encuentro corporal, y las políticas de acceso a los espacios de aparición, como parte central (...) de la lucha y la reflexión política. En diálogo con estas y otras provocaciones teóricas, fundamentalmente en el ámbito de los estudios queer, este ensayo explora los modos de producción del espacio de coalición transfeminista y queer a partir de experiencias activistas recientes en la ciudad de Madrid.The cycle of protests opened by the Arab Springs has served to revitalize theoretical reflections on the interplay between the construction of political agency and the production of coalitional spaces. This is the case of Judith Butler in Bodies in Alliance and the Politics of the Street, along with other authors that have shown the importance of thinking bodily encounter, and the politics of accessibility to the space of appearance, as a central part of political reflection and struggle. In dialogue with these and other theoretical provocations, specially coming from Queer Studies, this essay explores the modes of production of the space of transfeminist and queer coalition drawing on recent activist experiences in the city of Madrid. 8 March, now known as International Women’s Day, is a day for feminist claims where demonstrations are organized in over 150 countries, with the participation of millions of women all around the world. These demonstrations can be viewed as collective rituals and thus focus attention on the processes that facilitate different psychosocial effects. This work aims to explore the mechanisms involved in participation in the demonstrations of 8 March 2020, collective and ritualized feminist actions, and their correlates associated with personal (...) well-being and collective well-being, collective efficacy and collective growth, and behavioral intention to support the fight for women’s rights. To this end, a cross-cultural study was conducted with the participation of 2,854 people from countries in Latin America and Europe, with a retrospective correlational cross-sectional design and a convenience sample. Participants were divided between demonstration participants and non-demonstrators or followers who monitored participants through the media and social networks. Compared with non-demonstrators and with males, female and non-binary gender respondents had greater scores in mechanisms and criterion variables. Further random-effects model meta-analyses revealed that the perceived emotional synchrony was consistently associated with more proximal mechanisms, as well as with criterion variables. Finally, sequential moderation analyses showed that proposed mechanisms successfully mediated the effects of participation on every criterion variable. These results indicate that participation in 8M marches and demonstrations can be analyzed through the literature on collective rituals. As such, collective participation implies positive outcomes both individually and collectively, which are further reinforced through key psychological mechanisms, in line with a Durkheimian approach to collective rituals. We analyse the relationship between applicability and effectiveness of legal norms from a philosophical perspective. In particular, we distinguish between two concepts of applicability. The external applicability of norms refers to institutional duties; a norm N is externally applicable if and only if a judge is legally obliged to apply N to some case c. Internal applicability refers instead to the sphere of validity of legal norms. A norm N is internally applicable to actions regulated by its sphere of validity. (...) We also explore the consequences of a thesis which maintains that applicability restricts the concept of effectiveness, so that only applicable norms can be considered effective. Our analysis illustrates that a proper reconstruction of the concept of applicability is of great importance not only for understanding the concept of effectiveness but also for providing insight into the nature of law. En este trabajo analizo la autonomía y relevancia normativa de las normas permisivas. En especial, mis propósitos principales son revisar dos tesis escépticas: los permisos y las normas permisivas pueden reducirse a otras formas normativas, e.g. derogación de prohibiciones, y no se producen diferencias significativas cuando se permite una conducta que no había sido previamente regulada. Ambas tesis son examinadas en relación a la naturaleza y función del principio de clausura normativa. La conclusión de este trabajo es que las normas (...) permisivas, y en particular las normas de clausura, pueden cumplir una importante función en los sistemas normativos y son una herramienta útil para analizar otros problemas como las lagunas del derecho y la discreción judicial. A considerable number of books and papers have analyzed normative concepts using new techniques developed by logicians; however, few have bridged the gap between the English legal culture and the Continental tradition in legal philosophy. This book addresses this issue by offering an introductory study on the many possibilities that logical analysis offers the study of legal systems. The volume is divided into two sections: the first covers the basic aspects of classical and deontic logic and its connections, advancing an (...) explanation of the most important topics of the discipline by comparing different systems of deontic logic and exploring some of the most important paradoxes in its domain. The second section deals with the role of logic in the analysis of legal systems by discussing in what sense deontic logic and the logic of norm-propositions are useful tools for a proper understanding of the systematic structure of law. Organ transplantation is a lifesaving procedure for end-organ damage and remains up to today as the most cost-effective alternative to treat these conditions. However, the main limitation to performing organ transplants is the availability of donor organs suitable for transplantation. To increase the donor pool, expanding organ donation from the conventional neurologic determination of death (NDD) to include circulatory determination of death (DCD) has been a well-established method of increasing donors in other countries. In this article, we discuss the clinical (...) and ethical considerations for introducing DCD in Chile. The concepts we have used could very well be translatable to other similar countries which have not implemented this donation system yet. The most relevant issue to date is that DCD needs to alter the care of dying patients to obtain quality donor organs. In some countries, including Chile, there are some cultural barriers regarding withdrawal-of-care. These barriers include confusing withdrawal of care with acceleration of death, which leads to many practitioners refusing to remove artificial life support, and in turn only minimize ventilatory support or switch to a T-tube (without extubation). This cultural barrier could be overcome with careful consideration of the opinions of healthcare workers, family members, community and policy-based stakeholders. We also identified ethical issues related to informed consent of both donor and recipients, among other relevant ethical considerations. In conclusion, DCD donation in Chile can increase organ donation numbers in one of Latin America's countries with the lowest effective donor rate. However, this opportunity must be taken with caution to avoid the opposite effect if this policy is not well implemented, respecting the sound ethical principles mentioned in this paper. (shrink)

Las sociedades humanas se estructuran según el principio de la organización holográfica: en ellas, las partes -básicamente, los sujetos que las constituyen- reflejan -y, en cierto modo, son- el todo social en el que habitan. Por esta causa, ese todo es algo más que la suma de sus partes -es una realidad infinitamente reflexiva y, así, autotrascendente. A diferencia de lo que ocurre con los hologramas ópticos o biológicos, el holograma social humano no se configura en el espacio ni en (...) la materia física, sino que tiene como medio propio el ámbito de las conciencias. Se trata de un ámbito transubjetivo, cuya forma peculiar de objetividad es justamente esa transubjetividad. De ahí que la ontología clásica, objetivista, no pueda representarlo. Una intuición adecuada del mismo exige una ontología capaz de capturar el carácter fractal -ontológicamente fracturado- del objeto social. Esta obra explora las bases de esa ontología a través del examen de la competencia social propia de nuestra especie, de la socialidad humana y la compleja estructura modal que la caracteriza. Este trabajo es una crítica a la distinción entre lagunas de conocimiento y reconocimiento. En Normative Systems, Alchourrón y Bulygin sostienen que estas indeterminaciones en la aplicación del derecho son problemas diferentes. Según AB, las lagunas de conocimiento surgen por nuestro deficiente conocimiento de las circunstancias del caso, pero las lagunas de reconocimiento se producen por la vaguedad del lenguaje. Para resolver las lagunas de conocimiento, los juristas usan presunciones y para resolver las lagunas de reconocimiento es preciso redefinir los (...) conceptos. Sin embargo, AB no ofrecen una reconstrucción específica de la vaguedad y ello afecta al análisis de esos tipos de lagunas. En particular, AB creen que la vaguedad es un problema epistémico y, por ello, un sistema completo puede ofrecer una respuesta correcta para cada caso individual aun cuando no podamos conocer esa solución. Pero, cuando se asume que la vaguedad es un problema epistémico, entonces no existen mayores razones para distinguir entre lagunas de conocimiento y lagunas de reconocimiento. This paper analyzes the distinction between gaps of knowledge and gaps of recognition. In Normative Systems, Alchourrón and Bulygin claim that both indeterminacies are different problems that arise in the application of general norms to individual cases. Where through ignorance of certain properties of the facts, we cannot determine whether an individual case belongs to a generic case, we speak of gap of knowledge. On the contrary, gaps of recognitions are caused by the semantic indeterminacy of the concepts which define a generic case. In order to solve gaps of knowledge, jurists use legal presumptions, but the solution of a gap of knowledge requires the redefinition of a certain concept. However, AB believe that vagueness is only an epistemic problem. For this reason, they conclude that a complete normative system resolves every possible individual case even though we can still find epistemic indeterminacies. However, this paper shows that if vagueness is characterized as an epistemic problem, there will be no relevant reason for stressing the distinction between gaps of recognition and gaps of knowledge. In mice, dosage compensation of X‐linked gene expression is achieved through the inactivation of one of the two X‐chromosomes in XX female cells. The complex epigenetic process leading to X‐inactivation is largely controlled by Xist and Tsix, two non‐coding genes of opposing function. Xist RNA triggers X‐inactivation by coating the inactive X, while Tsix is critical for the designation of the active X‐chromosome through cis‐repression of Xist RNA accumulation. Recently, a plethora of trans‐acting factors and cis‐regulating elements have been suggested (...) to act as key regulators of either Xist, Tsix or both; these include ubiquitous factors such as Yy1 and Ctcf, developmental proteins such as Nanog, Oct4 and Sox2, and X‐linked regulators such as Rnf12. In this paper we summarise recent advances in our knowledge of the regulation of Xist and Tsix in embryonic stem (ES) and differentiating ES cells. (shrink)

En este trabajo ofrezco un análisis de algunas de las ideas más importantes sostenidas por Ricardo Caracciolo en su ensayo sobre hechos y justifi cación de las decisiones judiciales. Estas tesis son: a) tesis de la aplicación posible. Las normas generales sólo se pueden aplicar a los casos que ellas regulan; b) tesis de la aplicación efectiva. Una norma general es aplicada a un hecho sólo si la premisa que describe ese hecho es verdadera. Este artículo muestra que hay buenas (...) razones para revisar ambas tesis ya que ellas pasan por alto una distinción relevante entre distintos sentidos de ‘casos individual’: casos individuales de un universo del discurso y casos individuales de un caso genérico. Como consecuencia de ello, se señala que es necesario modelar un concepto de justifi cación jurídica que no presuponga a esas mencionadas tesis. (shrink)

Este trabajo analiza los aspectos más destacados de la polémica entre Juan Carlos Bayón y Eugenio Bulygin acerca de las lagunas jurídicas, el principio de prohibición y el alcance de la discreción judicial. En esta disputa, Bulygin defiende cuatro tesis centrales, enunciadas en Normative Systems : una cuidadosa distinción entre normas y proposiciones normativas es esencial para resolver el problema de las lagunas jurídicas, la versión débil del principio de prohibición no sirve para mostrar que no existen lagunas, la versión (...) fuerte del principio de prohibición es verdadera solo cuando el sistema es completo, y en casos de lagunas jurídicas, los jueces tienen discreción para resolver estas situaciones. Sin embargo, Bayón señala que el problema no es la falta de distinción entre normas y proposiciones normativas sino el desacuerdo acerca de cuándo una solución jurídica es concluyente. La diferencia entre soluciones prima facie y concluyente es esencial porque en ciertas situaciones, el derecho no da una respuesta pero tampoco deja espacio para la discrecionalidad judicial. Según Bayón, en estos casos el principio de prohibición "todo lo que no está prohibido está permitido" juega un papel fundamental. Este trabajo muestra que los argumentos de Bayón son insuficientes para rechazar las tesis clásicas defendidas por Bulygin. In this paper I analyze the most relevant aspects of the controversy between Juan Carlos Bayón and Eugenio Bulygin about the existence of legal gaps, the so called "principle of prohibition" and the scope of judicial discretion. In this debate, Bulygin defends four classical theses advanced in his wellknown book, Normative Systems : a careful distinction between norms and norm propositions is actually needed in order to solve the problem of legal gaps, the analytical truth of the weak version of the principle of prohibition cannot guarantee the completeness of legal systems, the strong version of the principle of prohibition is true only if legal systems are complete, and judges have discretion in cases of legal gaps. However, Bayón claims that the problem is not the lack of distinction between norms and norm proposition but rather the identification of conclusive legal solutions. Conclusive legal solutions must be distinguished from the prima facie solutions provided by explicitly enacted norms. According to Bayón, the difference between conclusive and prima facie solutions is essential in legally irrelevant cases; in such cases the principle of prohibition plays an essential role because it entails the rejection of judicial discretion. In this paper I claim that the arguments advanced by Bayón fail to provide a sound ground for discarding the classical theses defended by Bulygin. (shrink)

In this paper, I consider some problems concerning the structure of legal systems. In order to do this, I basically analyze the promulgation and derogation of legal rules. Frequently, promulgation has been referred to as the introduction of a rule into, and derogation as the removal of a rule from, a normative system. I try to show that there is more to it than that. One of the main ideas of the paper is that the enactment or derogation of a (...) legal rule by an authority na restricts the competence of all lower authorities: Once a rule R has been enacted by an authority na, authorities inferior to na cannot remove R from the normative system; and when R has been derogated by na, lower authorities do not have the competence to introduce R into the system. Further important questions include: What happens with derogated rules? What is the structure of the set of derogated rules? When does a rule belong to a derogated set, and when is it removed from a derogated set? These questions are very important for a theory of legal systems, and I try to give some possible answers. Perhaps the main conclusion of the paper is that promulgation and derogation can be considered very similar processes with respect to legal systems. (shrink)

En "Legal Reasons, Sources and Gaps", Raz señala que las lagunas jurídicas existen sólo cuando el derecho habla con voz incierta o cuando habla con muchas voces, pero que no hay lagunas cuando el derecho guarda silencio. En este último caso habría reglas de clausura, analíticamente verdaderas, que impiden la ocurrencia de esas lagunas. Según Raz, si hay una laguna en un sistema jurídico, entonces no es verdadero ni falso que exista una razón concluyente para ejecutar cierta acción. Así, una (...) de las contribuciones más importantes de Raz a la solución del problema de las lagunas jurídicas es subrayar que el discurso jurídico no está completamente controlado por la bivalencia. Sin embargo, a menudo se sostiene que el rechazo de la bivalencia conduce a contradicciones. Si esta afirmación fuese verdadera, entonces la solución de Raz al problema de las lagunas jurídicas se vería seriamente amenazada. En este artículo mostramos, con ayuda de una herramienta analítica sofisticada, i.e., la lógica de la verdad de G.H. von Wright, que el rechazo de la bivalencia sólo nos compromete a aceptar la conclusión trivial de que puede haber proposiciones que no son verdaderas ni falsas. Una forma clásica de explicar el significado de una oración es establecer sus condiciones deverdad. Sin embargo, dado que sólo las oraciones declarativas encajan con este tipo de análisis, las oraciones (e.g. imperativas) que carecen de valor de verdad quedan fuera de este análisis. Con el objeto de evitar esta dificultad, algunas veces se ha sugerido que el cumplimiento de un imperativo les el valor semántico de I, y que este valor depende del concepto de verdad. En este artículo, explicamos (...) esta sugerencia mediante un lenguaje artificial: el lenguaje LN. Nuestra propuesta consiste en suministrar una reconstrucción del concepto de eficacia a partir de la relación de cumplimiento, analógamente a la reconstrucción del concepto de verdad a partir de la relación de satisfacción. Nuestras conclusiones principales son las siguientes: 1) el significado de una oración imperativa es establecido por sus condiciones de eficacia y 2) esta teoría del significado de los imperativos suministra una base semántica, adeucada para la lógica deóntica.A classical way of explaining the meaning of certain sentences is to establish their truth-conditions. However, since only declarative sentences fit this kind of analysis, sentences (e.g. imperatives) which lack truth-value remain outside the theory of meaning. In order to avoid this difficulty, it is sometimes suggested both that compliance with an imperative I is the semantic value of I, and that this value is dependent on the concept of truth. In this article, we explain this suggestion with the help of a constructed language: the artificial language NL. Our proposal Is to provide a reconstruction of the concept of effectiveness from the relation of compliance, on the analogy of the reconstruction of the concept of truth from the relation of satisfaction. Our main conclusions are: 1) the meaning of a imperative sentence would be established by its effectiveness-conditions and 2) this theory of meaning of imperatives would provide a semantic basis, suitable to the deontic logic. Unfounded—conspiracy and health—beliefs about COVID-19 have accompanied the pandemic worldwide. Here, we examined cross-nationally the structure and correlates of these beliefs with an 8-item scale, using a multigroup confirmatory factor analysis. We obtained a two-factor model of unfounded (conspiracy and health) beliefs with good internal structure (average CFI = 0.98, RMSEA = 0.05, SRMR = 0.04), but a high correlation between the two factors (average latent factor correlation = 0.57). This model was replicable across 50 countries (total N = 13,579), (...) as evidenced by metric invariance between countries (CFI = 0.96, RMSEA = 0.06, SRMS = 0.07) as well as scalar invariance across genders (CFI = 0.98, RMSEA = 0.04, SRMS = 0.03) and educational levels (CFI = 0.98, RMSEA = 0.04, SRMS = 0.03). Also, lower levels of education, more fear of COVID-19, and more cynicism were weakly associated with stronger conspiracy and health beliefs. The study contributes to knowledge about the structure of unfounded beliefs, and reveals the potential relevance of affective (i.e., fear of COVID-19) and cognitive (i.e., cynicism) factors along with demographics, in endorsing such beliefs. In summary, we obtained cross-cultural evidence for the distinctiveness of unfounded conspiracy and health beliefs about COVID-19 in terms of their structure and correlates. (shrink)

BackgroundMany procedures currently require the use of bone grafts to replace or recover bone volume that has been resorbed. However, the patient’s opinion and preferences must be taken into account before implementing any treatment. Researchers have focused primarily on assessing the effectiveness of bone grafts rather than on patients' perceptions. Thus, the aim of this study was to explore patients' opinions regarding the different types of bone grafts used in dental treatments.MethodsOne hundred patients were randomly chosen participated in the study. (...) A standardized survey of 10 questions was used to investigate their opinions regarding the different types of bone grafts used in dental treatments. Descriptive statistics were calculated for the different variables, and absolute frequencies and percentages were used as summary measures. A value of p <0.05 was selected as the threshold for statistical significance.ResultsThe highest rate of refusal was observed for allografts and xenografts. The grafts with the lowest rates of refusal were autologous grafts and alloplastics. No significant differences were found between the various types of bone grafts in the sociodemographic variables or the refusal/acceptance variable. Similarly, no significant relations were observed between a specific religious affiliation and the acceptance/refusal rates of the various types of graft.ConclusionsAllografts and xenografts elicited the highest refusal rates among the surveyed patients, and autologous bone and alloplastics were the most accepted bone grafts. Moreover, no differences were found in the sociodemographic variables or religious affiliations in terms of the acceptance/refusal rates of the different bone grafts. (shrink)

The aim of this paper is to defend moral relativism from the accusation that it would make it irrational to classify past changes in public opinion as instances of moral progress, for they would constitute an improvement only from our current point of view. The argument is this. For our assessment of a change in public opinion as an instance of moral progress to be rational, we need to take the moral claims made before the change to be false simpliciter (...) while being open to the possibility that we ourselves change our minds at some point. These two things can be made compatible if we construe moral relativism as taking the truth of moral claims to be relative to the context of assessment. Thus understood, moral relativism is in fact the only view that makes room for talk of moral progress, as the rest of candidate positions make it irrational. (shrink)
