What began as a modest proposal that a mathematician and an economist write a short paper together blossomed, when Princeton University Press published Theory of Games and Economic Behavior. In it, John von Neumann and Oskar Morgenstern conceived a groundbreaking mathematical theory of economic and social organization, based on a theory of games of strategy. Not only would this revolutionize economics, but the entirely new field of (...) scientific inquiry it yielded--game theory--has since been widely used to analyze a host of real-world phenomena from arms races to optimal policy choices of presidential candidates, from vaccination policy to major league baseball salary negotiations. Dieser Beitrag diskutiert Oskar Morgensterns These von der Unmöglichkeit von Wirtschaftsprognose. Nach einer kritischen Rekonstruktion Morgensterns Argumente wird diese These in ihrer starken, apriorischen Lesart zurückgewiesen. Demgegenüber gestatten es die Ergebnisse empirischer Prognoseevaluationen, Morgensterns Überlegungen als kontingente Erklärungen des Scheiterns makroökonomischer Vorhersagen umzuinterpretieren. Der Beitrag schließt deshalb mit einer provokanten Konklusion, die bereits Morgenstern zog: der Forderung, Versuche makroökonomischer Vorhersage einzustellen.

The literature of economic theory, like that of philosophy, abounds in prefaces and prolegomena. Methodology and analysis of concepts take an important place in a science which has not found the sure path of development. But there is no sure path for methodology either. The selfconscious methodology of social science has been largely a borrowing from that of physical science, where procedures have developed to a stage of considerable maturity. But the analogy falls down where guidance is most needed, at (...) the points where social science is most likely to develop new concepts and new types of structure. Das Anliegen der Metaphysik, die Welt aus wenigen Grundprinzipien zu begreifen, ist seit Hume und Kant häufig als illusionär kritisiert worden. Dennoch hat die 'totgesagte' Metaphysik immer wieder 'Auferstehungen' erlebt. Auch in der Moderne werden die alten Fragen nach Welt, Mensch und Gott gestellt, doch geschieht dies vor einem veränderten wissenschaftlichen Hintergrund und auch häufig mit anderen Methoden. Insgesamt zeigt sich in der Moderne ein allmählicher Übergang von einer apriorischen zu einer hypothetischen, wissenschaftsorientierten Metaphysik. Die vorliegende Abhandlung thematisiert acht zentrale (...) Strömungen der Metaphysik seit der Mitte des 19. Jahrhunderts. Im Zentrum stehen dabei die philosophischen Weltbilder ihrer Hauptvertreter sowie ihre Standpunkte zum Leib-Seele-Problem und zum Problem der Willensfreiheit, aber auch ihre Stellungnahmen zu den Fragen nach Gott, Unsterblichkeit und dem Sinn des Lebens. This article analyses the evolution of penalties from Michel Foucault’s philosophy, verifying the departure of torture and giving rise to a disciplinary model. The aim is to find out the forms of power that society has exerted over the 19th century and the transition to ‘biopower’, where the purpose is to control all of society. In Brazil, the shift towards a punitive model becomes evident with the redemocratization that followed the National Constitution of 1988, which recognized the dignity of the (...) human person as the right to be upheld. In this context, the following question arises: Does the common Brazilian penitentiary system serve its corrective purpose? Is there a more effective way to deal with convicts, in terms of reducing recidivism rates? Mario Ottoboni founded the Association for the Protection and Assistance of Convicts (APAC). The present study proposes a study by APAC to answer these questions. APAC is an innovative institution that aims to fulfill the resocializing function of a sentence. This is a possible path for social reintegration. This study employed a deductive approach and was conducted using bibliographical research. (shrink)

Recent discussions among lawyers, philosophers, policy researchers and athletes have focused on the potential threat to privacy posed by the World Anti-Doping Agency’s (WADA) whereabouts requirements. These requirements demand, among other things, that all elite athletes file their whereabouts information for the subsequent quarter on a quarterly basis and comprise data for one hour of each day when the athlete will be available and accessible for no advance notice testing at a specified location of their choosing. Failure to file one’s (...) whereabouts, or the non-availability for testing at said location on three occasions within any 18-month period constitutes an anti-doping rule violation that is equivalent to testing positive to a banned substance, and may lead to a suspension of the athlete for a time period of between one and two years. We critically explore the extent to which WADA’s whereabouts requirements are in tension with existing legislation on privacy, with respect to UK athletes, who are simultaneously protected by UK domestic and EU law. Both UK domestic and EU law are subject to the European Convention on Human Rights (ECHR) Article 8, which establishes a right to “respect for private and family life, home and correspondence”. We critically discuss the centrality of the whereabouts requirements in relation to WADA’s aims, and the adoption and implementation of its whereabouts rules. We conclude that as WADA’s whereabouts requirements appear to be in breach of an elite athlete’s rights under European workers’ rights, health & safety and data protection law they are also, therefore, in conflict with Article 8 of the ECHR and the UK Human Rights Act 1998. We call for specific amendments that cater for the exceptional case of elite sports labour if the WADA requirements are to be considered legitimate. (shrink)

Brent Kious has recently attacked several arguments generally adduced to support anti-doping in sports, which are widely supported by the sports medicine fraternity, international sports federations, and international governments. We show that his attack does not succeed for a variety of reasons. First, it uses an overly inclusive definition of doping at odds with the WADA definition, which has global, if somewhat contentious, currency. Second, it seriously misconstrues the position it attacks, rendering the attack without force against a more balanced (...) construal of an anti-doping position. Third, it makes unwarranted appeals to matters Kious considers morally ‘clear’, while simultaneously attacking a position many others take to be equally morally ‘clear’, namely that of anti-doping. Such an inconsistency, attacking and appealing to the moral status quo as befits one’s argument, is not acceptable without further qualification. Fourth, his position suffers from a general methodological flaw of over-reliance upon argumentation by analogy. Moreover, it is argued that the analogies, being poorly selected and developed, fail to justify his conclusion that the anti-doping lobby lacks philosophical and moral authority for its stance. These issues are symptomatic of a more fundamental problem: any attempt at providing a blanket solution to the question of whether doping is morally acceptable or not is bound to run up against problems when applied to highly specific contexts. Thus, rather than reaching any particular conclusion for or against doping products or processes in this article, we conclude that an increased context-sensitivity will result in a more evenhanded appraisal of arguments on the matter. The crying curve across early infancy may reflect the developing interaction between circadian and homeostatic processes of sleep-wake regulation. Excessive crying may be interpreted as a misalignment of the two processes. On the basis of the proposed mechanism, excessive crying may be an honest signal of need, namely, to elicit parental resources to modulate the behavioral state.

Este artigo tem por objetiva geral descrever a linguagem musical sob a perspectiva da teoria histórico-cultural, conforme Vygotsky, seu principal representante. Neste sentido, procura-se também entender o conceito de mediação, como elemento articulador entre linguagem musical e o fenômeno pedagógico, produzido nos enredos intersubjetivos de professores e alunos. Nessa perspectiva, e com as contribuições da Base Nacional Comum Curricular (BNCC), que integra a música no ensino de Arte, identifica-se a relevância da linguagem musical na formação cidadã de estudantes da Educação (...) Básica. O presente estudo se caracteriza como uma pesquisa bibliográfica, amparada em obras originais de Vygotsky e de outros autores que escrevem a respeito da temática em questão, para embasamento aprofundado. Constatou-se que a música, enquanto linguagem, é dinâmica cujas habilidades e ações, construídas socialmente, são mediadas na interação professor-aluno. Portanto, a leitura que se faz da música, enquanto linguagem, não pode prescindir do caráter histórico-cultural, subjacente a toda e qualquer manifestação cultural. (shrink)

In their recent contribution to this journal, Brian D. Earp, Anders Sandberg, and Julian Savulescu argue that "the 'medicalization of love' need not necessarily be problematic, on balance, but could plausibly be expected to have either good or bad consequences depending upon how it unfolds." Although I find myself in agreement with the majority of the points the authors make to this end, as well as with the general thrust of their position, I am nevertheless left feeling rather unsatisfied by (...) their overall exposition. This is largely because they fail to provide any substantial love-specific argument, as I demonstrate in this paper. (shrink)

The long-term and complex supervisor-doctoral student relationship is often characterised by tension and frictions. In higher education research, models, and interventions that take the potential beneficial interpersonal effects of compassion into account seem to be scarce. Hence, the aim of this study was to conceptualise the potential role compassion could have in the cultivation of an affiliative and sustainable supervisor-doctoral student relationship. The concept of compassion was investigated and analysed in relation to a contemporary model of supervisor behaviours. Furthermore, a (...) systematic literature search in the scientific databases PubMed, PsychInfo, ScienceDirect, and Google Scholar was performed. The conceptual analysis revealed that the interpersonal domain, in which compassion could afford a shared sense of warmth, is neglected in previous definitions. Furthermore, the integration of compassion into a model of adaptive supervisor behaviour indicates a strong case for a salutary role for compassion in the supervisor-doctoral student relationship. However, the literature review showed that empirical data are lacking, and more studies are needed. The role of compassion deserves to be investigated empirically in this particular interpersonal context. (shrink)

The United Nations confirmed that privacy remains a human right in the digital age, but our daily digital experiences and seemingly ever-increasing amounts of data suggest that privacy is a mundane, distributed and technologically mediated concept. This article explores privacy by mapping out different legal and conceptual approaches to privacy protection in the context of datafication. It provides an essential starting point to explore the entwinement of technological, ethical and regulatory dynamics. It clarifies why each of the presented approaches emphasises (...) particular aspects and analyses the tensions that arise. The resulting overview provides insight into the main strengths and limitations of the different approaches arising from specific traditions. This analytic overview therefore serves as a key resource to analyse the usefulness of the approaches in the context of the increasing datafication of both private and public spheres.Specifically, we contrast the approach focusing on data subjects whose data are being ‘protected’ with others, including Fair Information Practice Principles, the German right to ‘informational self-determination’, and the South American ‘habeas data’ doctrine. We also present and contrast emerging approaches to privacy and discuss their intersection with datafication. In conclusion, we put forth that rather than aiming for one single solution that works worldwide and across all situations, it is essential to identify synergies and stumbling blocks between the various regulatory settings and newly emerging approaches.
