Con frecuencia el avance y uso del conocimiento han sido relacionados como uno de los indicadores más importantes para el desarrollo económico y bienestar social de países y regiones. Sin embargo, independientemente de los factores teórico metodológicos que impulsan el desarrollo del conocimiento, el acceso a este activo intangible se encuentra limitado a diversas condiciones económicas, sociales, culturales e incluso del mismo conocimiento per se que cada individuo desarrolla dentro de la sociedad. El objetivo principal de este trabajo de investigación (...) consiste en realizar un análisis teórico desde una perspectiva sociológica de la ciencia y la tecnología, sobre el papel que desempeña la universidad pública en la democratización del conocimiento al interior de su comunidad y de la sociedad en general, señalando los principales avances y obstáculos que ésta presenta durante la difusión del mismo. One major objection to social rights is a failure of determining which precise social and economic claims should be granted rights status. The social rights debate has grappled with this ‘indeterminacy problem’ for quite some time, and a number of proposals have emerged aimed at fixing the content of these rights. In what follows I examine three distinct approaches to fleshing out the idea of a minimum threshold: social rights as the fulfilment of basic needs, social rights as the securing (...) of a minimally decent life and social rights as a requirement of citizenship. Each of these proposals progressively expands on what the minimum threshold of social rights requires and, conversely, what obligations they generate on part of the state. I will show that none of these approaches is entirely satisfactory and suggest that the social rights debate look elsewhere to determine its content. (shrink)

Courts play a key role in deciding on public health controversies, but the legitimacy of judicial intervention remains highly controversial. In this article I suggest that we need to carefully distinguish between different reasons for persistent disagreement in the domain of public health. Adjudicating between public health controversies rooted in factual disagreements allows us to investigate more closely the epistemic capacities of the judicial process. While the critics typically point out the lack of appropriate expertise of judges—in particular with respect (...) to health and public health—we should not move too fast in inferring from this a generalized competence problem. This article offers four reasons for vindicating the importance of judicial intervention in factual disagreements: the relative independence of judges from the political establishment, the judicial commitment to evidence, the specific nature of judicial reasoning and an additional voice for the people in the policy-making process. The judiciary is a key policy actor that is involved in deciding health rights and policy by intervening in the policy process through a variety of judicial mechanisms, yet the appropriate extent of its involvement remains contentious. Taking the competence objection seriously requires understanding it as an epistemic problem about how courts assess empirical and scientific evidence in order to competently adjudicate controversial health claims. This paper examines recent advances in social epistemology to develop insights for the epistemic competence of (...) the judiciary from a system‐oriented approach. I outline three epistemic features that set the judiciary and the judicial decision‐making process apart from other types of decision‐makers in health policy: the distribution of epistemic power, the epistemic authority of a justified believer, and the principle of disinterestedness. Finally, I relate these insights back to the judicial decision‐making process with a specific focus on recent court decisions in health rights and health policy in Chile. (shrink)

A basic income is typically defined as an individual’s entitlement to receive a regular payment as a right, independent of other sources of income, employment or willingness to work, or living situation. In this article, we examine what it means for the state to institute a right to basic income. The normative literature on basic income has developed numerous arguments in support of basic income as an inextricable component of a just social order, but there exists little analysis about basic (...) income within a jurisprudential or philosophical rights perspective. In our view, strong reasons of either a principled or a pragmatic nature in support of instituting a basic income scheme nevertheless often fall short of ascribing to basic income a distinctive Hohfeldian rights status. This article aims to partially redress this gap by examining two sets of questions. First, what are the implications – ethical and practical – of adopting basic income as a legal right as opposed to a mere policy? Second, we also enquire whether there should be such a right: what, if anything, is the ethical foundation that warrants granting basic income a distinctive legal rights status? This article suggests that any such foundation must be grounded in comparative evaluation and discusses several comparative strategies available to basic income advocates. The aim of this article is not to offer a definite argument in favor of a legal right to basic income, but to chart several lines of argument that a rights perspective might add to the contemporary discussion. This paper focuses on an emergency basic income as a tool for avoiding financial insecurity during the time of pandemic. The authors argue that paying each resident a monthly cash amount for the duration of the crisis would serve to protect them from the economic fallout.They suggest three reasons why the EBI proposal is particularly well-suited to play an important role in a comprehensive public health response to COVID-19: it offers an immediate and agile response; it prioritizes the most vulnerable (...) in the affected population; and it promotes a solidaristic response to the pandemic crisis. Tal análise se justifica em vista de Kant, no escrito sobre a religião, apresentar a definição da ação por dever e da ação moralmente má nos termos de hierarquia e ordem moral dos móbiles, formulação que, aparentemente, não é apresentada no âmbito da fundamentação da moral. Background:The acquisition of experience is a major concern for nurses in intensive care units. Although the emotional component of the clinical practice of these nurses has been widely studied, greater examination is required to determine how this component influences their learning and practical experience.Objective:To discover the relationships between emotion, memory and learning and the impacts on nursing clinical practice.Research design:This is a qualitative phenomenological study. The data were collected from open, in-depth interviews. A total of 22 intensive care unit nurses (...) participated in this research between January 2012 and December 2014.Ethical considerations:The School of Nursing Ethics Committee approved the study, which complied with ethical principles and required informed consent.Findings:We found a clear relationship between emotion, memory and the acquisition of experience. This relationship grouped three dimensions: (1) satisfaction, to relieve the patient’s pain or discomfort, give confidence and a sense of security to the patient, enable the presence of family members into the intensive care unit and provide family members with a realistic view of the patient’s situation; (2) error experience, which nurses feel when a patient dies, when they fail to accompany a patient in his or her decision to abandon the struggle to live or when they fail to lend support to the patient’s family; and (3) the feel bad–feel good paradox, which occurs when a mistake in the patient’s care or handling of his or her family is repaired.Conclusion:Emotion is a capacity that impacts on nurses’ experience and influences improvements in clinical practice. Recalling stories of satisfaction helps to reinforce good practice, while recalling stories of errors helps to identify difficulties in the profession and recognise new forms of action. The articulation of emotional competencies may support the development of nursing ethics in the intensive care unit to protect and defend their patients and improve their relationships with families in order to maximise the potential for patient care. Background The practice of health advocacy in nursing has been defined as a process aimed at promoting the independence and autonomy of users of health services, in addition to providing information on healthcare decision-making and offering support for decisions taken. Ethical considerations Ethics approval was not required to conduct this review. Aim This integrative review aims to synthesize evidence in the literature on health advocacy in professional nursing practice. Methods An integrative review methodology guided by Whittemore and Knalf was used. (...) Studies were identified by conducting searches on PubMed, Scopus, Web of Science, CINAHL, and LILACS databases. Of 2179 records, 34 studies matched the inclusion criteria. Results The main aspects involved in the practice of health advocacy by professional nurses are related to the ethical principles of the nursing profession, such as protecting patients seeking autonomy and care. Furthermore, the practice of health advocacy by nurses requires an empathetic attitude, responsibility, and assertive communication. Conclusion The diverse possibilities for the practice of advocacy synthesized in this study allow nurses to approach and become familiarized with the topic, being able to acquire and complement knowledge that will reflect on their professional practice in different work environments such as the educational field, in hospital practice, or basic health care. This paper aims to propose an invitation to look at the kind of childhood we have been constructing from the practices of Special Education, in articulation with the practices of Early Childhood Education. It problematizes the discursive webs formed in this articulation, considering the way that Special Education teachers working with Early Childhood in public schools regard childhood. Such discussions have derived from the uneasiness of thinking about how we have been producing childhood, given the policy of expanding mandatory attendance (...) to four-year-old children. The analytical exercise, inspired by the discourse analysis proposed by Michel Foucault, has enabled us to question the production of subjects, truths and realities in the “confessions” of the interviewed teachers, in which we have identified two ways of thinking about and producing childhood: captured childhood, which is produced through the operationalization of normalization practices by Special Education, determined by the will to knowledge and the will to power over childhood; and childhood as heterotopy, produced as a powerful movement of resistance and denaturalization of normalizing practices – childhood regarded from other places, as an infinite, multiple, non-nameable, ever undetermined becoming, as an invitation to thought: what can we do in the encounter with childhood? La dimensión de los problemas sociales en México, exige mayor participación de los ciudadanos, revisando, proponiendo, vigilando y exigiendo gobiernos honestos, comprometidos en su función de servicio a la población y con resultados positivos. Se demanda contar con información verídica, de inclusión con acceso para todos. Entre las propuestas se contemplan plataformas en las redes de Internet para la transparencia y la rendición de cuentas de la Administración Pública. Este trabajo presenta un estudio exploratorio basado en una encuesta que se (...) aplicó a 100 personas en la ciudad de Querétaro en abril de 2017. El objetivo principal es detectar si las personas tienen acceso al Internet, interés por información política y si a través del gobierno electrónico se podría recuperar credibilidad y confianza. Los resultados muestran desinterés y apatía general sobre la actividad política, los mecanismos de información vigentes no son claros, ni accesibles para los involucrados, comparativamente los insumos en la cultura y el modelo tradicional de educación contrastan con las propuestas del gobierno electrónico para ciudadanías globales. La conclusión considera necesario equilibrar y actualizar planes, estrategias y esfuerzos en programas educativos que motiven y preparen, desde edades tempranas una ciudadanía políticamente activa, interesada e informada en el desarrollo del gobierno, que sepa elegir líderes políticos formados en valores cívicos y éticos y que con transparencia aseguren calidad en educación, servicios de salud, trabajo, sustento y vivienda. Introduction: The importance attached to ethical practice and related informed consent varies among health professionals and is further influenced by working environments, level of knowledge, experience and societal values and beliefs. The objective of this study is to evaluate the ethical conduct of professors, undergraduates and graduate students through questionnaires answered by patients. Methods: One hundred twenty patients at the dental clinics of three different dental schools in São Paulo State were interviewed based on objective and discursive questions about signed (...) informed consent, participation in scientific research, photographs during treatment, requested saliva samples, tooth donation requests, and information about tooth destination after removal. A frequency distribution was used for a statistical analysis of the data. Results: In all, 65.8% of the patients had given signed informed consent for treatment and 12.5% had not done so; 10.8% did not know if they had participated in scientific research; 54.2% were photographed during dental procedures and 47.1% of them had signed an authorization form; 6.6% were requested to provide a saliva sample and 66.6% of them had signed an authorization form to that effect; 16.1% had a tooth donation requested and 64.4% of them had signed an authorization form to that effect; and 61.3% did not know the destination of the tooth after removal, when donation was not requested. Conclusions: The majority of the patients had signed an informed consent form for treatment, photographs, saliva samples and tooth donation. En la teoría etnológica y política contemporánea, la conceptualización de las acciones de adscriptos étnicos en términos de acciones orientadas por intereses constituye el núcleo conceptual de la definición de lo político. Comunalizaciones, movimientos culturales, democracia plural radical, reivindicaciones de derechos colectivos diferenciados, son todas ellas nociones que refieren a acciones colectivas y a la producción de identidades sobre la base de orientaciones culturales o ethos comunes en el ámbito de la esfera pública. La interpretación de tales expresiones como formas (...) institucionalizadas y públicas de acción colectiva se funda en un concepto de vida política como "vida común", como "acción colectiva pública". La siguiente presentación se propone interrogar los márgenes categoriales sobre los que se construye y fundamenta la teoría etnopolítica contemporánea, analizando las nociones de "común" que ponen en circulación como así también la tensión entre universalismo y particularismo que hacen emerger. In the contemporary political and ethnological theory, the conceptualization of the ethnic ascribed people actions in terms of "interest actions" is the conceptual core of the definition of politics. Communalizations, cultural movements, radical pluralist democracy, differentiated collective rights claims, are all notions that refer to collective action and the production of identities based on cultural orientations or common ethos in the field of public sphere. The interpretation of such expressions, as institutionalized and public forms of collective action, is based on a concept of political life as "common life", as "public collective action". The following article proposes to inquire the categorical margins on which the contemporary ethno-political theory is built and founded, analyzing not only the notions of "common" put into circulation but also the tension between universalism and particularism that do emerge themselves. Pensadores griegos y orientales, filósofos antiguos, medioevales y modernos, han tocado el tema de lo corporal de manera fragmentaria que reducen lo corpóreo a mero instrumento. Para evitar este tipo de interpretaciones, queda el expediente de acudir a la síntesis holística; a la versión del "cuerpo total" que somos. La economía imperante es la del "cuerpo poseído". Se tasa, vende y desecha en el mercado la fuerza de trabajo. Se ejerce sobre él una violencia que nos rebasa en todos los (...) frentes; es radical, porque atenta contra la integridad y la dignidad de los cuerpos. Restañar las heridas corporales de nuestros pueblos requiere de la formulación y siembra del conocimiento de la Ética del cuerpo que deberá ir acompañada por un proceso de reconstrucción simbólica de la idea de "cuerpo" en el que todos participemos. Si armonizan necesidades y capacidades corporales propias y ajenas y compaginan nuestras acciones con el respeto al entorno natural, casa del cuerpo, podremos vislumbrar que vamos sobre el camino correcto. The Greek and Eastern thinkers, ancient, medieval and modern philosophers, have dealt with the body only in a fragmentary way that sees it as a mere instrument. To avoid this kind of interpretation we resort to a holistic synthesis-the "total body" version that we really are. The dominant economics is the one of the "possessed body" that can be priced, sold and disposed of as working force. An overpowering violence is applied to it; it is a radical violence as it attempts on bodies' integrity and dignity. The healing of the wounded bodies of our people requires formulating and planting the seeds of the body's ethics that will accompany the reconstruction of an idea of body to be shared by all of us. If we harmonize our own and others' body's needs and abilities, and our actions are in accordance with our natural surroundings, we will be able to make out the right path. (shrink)

Economists use the term ‘stylized fact’ in many contexts, though the meaning of this phrase and the motivation for using such a concept is unclear. In this paper, we provide a philosophical analysis of stylized facts, which aims to be methodologically interesting and useful. While our framework applies to all principled uses of stylized facts, we illustrate its core features by applying it to Nicholas Kaldor's initial and exemplary use of stylized facts in growth economics.

In this paper, we intend to discuss how, according to Peirce’s semiotics, gestures can be conceptualized and described as diagrams. We are not concerned with answering when, why or how gestures emerged as semiotic motor activities. As a prerequisite for the very formulation of these problems, we are rather interested in discussing the theoretical conditions which should be fulflled for gestures to be characterized as iconic processes - and more specifcally as diagrammatic processes. The frst step is to summarize a (...) systematic analysis of the variety of iconic signs, elaborated by Peirce, followed by his typology of hypoicons in order to describe the hypoiconic class of diagrams. A vivência das crianças ciganas no mundo apresenta várias lacunas que vêm sendo estudadas por pesquisadores da área da sociologia, antropologia, psicologia e educação, com a intenção de compreender a forma como as escolas enfrentam o desafio de ensinar, com êxito, crianças de etnias diferentes. Discutir acerca da vida da criança cigana e o brincar no seu processo de escolarização frente aos olhos dos professores se constitui no nosso principal objetivo. A ênfase maior deste estudo está centrada na percepção dos (...) professores sobre a inserção das crianças ciganas no processo de escolarização na rede regular de ensino, assim como conhecer de que forma o lúdico está inserido no ambiente educacional e se vem contribuindo para diminuir o insucesso escolar de alunos/as de etnia cigana. As discussões feitas neste artigo contribuirão para o debate em busca de uma educação intercultural que valorize práticas lúdicas e partilhem a ideia de construir um futuro juntos e, consequentemente, com a construção de uma sociedade inclusiva e atuante.
