Dr. McGee presents a cogent argument for the patentability of the diagnosis of gene forms that are found to be associated with disease or other phenotypic manifestations. We're convinced he's wrong. An analogy will help explain why.

This study provides current data on key questions about retraction of scientific articles. Findings confirm that the rate of retractions remains low but is increasing. The most commonly cited reason for retraction was research error or inability to reproduce results; the rate from research misconduct is an underestimate, since some retractions necessitated by research misconduct were reported as being due to inability to reproduce. Retraction by parties other than authors is increasing, especially for research misconduct. Although retractions are on average (...) occurring sooner after publication than in the past, citation analysis shows that they are not being recognised by subsequent users of the work. Findings suggest that editors and institutional officials are taking more responsibility for correcting the scientific record but that reasons published in the retraction notice are not always reliable. Between 1993 and 2002, 39 clinical trial staff were investigated for scientific misconduct by the Office of Research Integrity (ORI). Analysis of ORI case records reveals practices regarding workload, training and supervision that enable misconduct. Considering the potential effects on human subjects protection, quality and reliability of data, and the trustworthiness of the clinical research enterprise, regulations or guidance on use of clinical trial staff ought to be available. Current ORI regulations do not hold investigators or institutions responsible for supervision (...) and training of clinical trial staff. Given the important issues at stake, the definition of research misconduct should encompass the intentional or negligent mismanagement of scientific projects. BackgroundFor over 35 years, Africa has continued to host HIV vaccine trials geared towards overturning the HIV/aids pandemic in the continent. However, the methods of sharing the vaccines, when available remain less certain. Therefore, the study aims to explore stakeholders’ perspectives in the global South, in this case, Tanzania, on how HIV vaccines ought to be fairly shared.MethodsThe study deployed a qualitative case study design. Data were collected through in-depth interviews and focus group discussions with a total of 37 purposively (...) selected participants. This included researchers, institutional review board members, a policymaker, HIV/aids advocates, and community advisory board members. The data obtained were inductively and deductively analyzed.Results Findings indicate that HIV vaccines can be shared fairly under the principles of distributive justice (contribution, need and equality). Thus, contribution-based sharing ought to be utilized upon the necessity to prioritize vaccine access or subsidized trial benefits to host communities. Need-based sharing ought to be considered for non-host communities that are at an increased risk of HIV infection. Lastly, equal-based sharing would be useful at later stages of vaccine distribution or when the aforementioned principles are deemed morally inappropriate. However, none of the benefit-sharing approaches is free of limitations and a counterbalancing sense of unfairness.ConclusionFair sharing of HIV vaccines, when available, ought to be informed by the contribution, need and equality principles of distributive justice. Countries in the global south including Tanzania are likely to be prioritized during the distribution of the HIV vaccines due to their participation in HIV vaccine trials and due to the disproportionate HIV burden evident in the region. ABSTRACT The question of axiomatizability of first-order temporal logics is studied w.r.t. different semantics and several restrictions on the language. The validity problem for logics admitting flexible interpretations of the predicate symbols or allowing at least binary predicate symbols is shown to be ?1 1-complete. In contrast, it is decidable for temporal logics with rigid monadic predicate symbols but without function symbols and identity.

Global clinical trials depend on a range of standards in order for research results to be comparable. As standardization is more than a mere technical exercise, tensions can arise when things are not uniform. This paper uses empirical data from interviews with principal investigators as well as Clinical Research Organization and pharmaceutical industry representatives working in India’s clinical trial industry to critically examine the ways Indian researchers navigate quests for standardization. It turns the analytical lens to the often obfuscated work (...) of standardization aiming to transcend the biological and cultural specificity of research participants and research sites. Drawing on the concept of local biologies, it illustrates that the universal body presumed by clinical trial methodology is, in fact, a specifically Euro-American one: Indian participants not only need to be made globally comparable but also aligned with the drugs’ future consumers. Focusing on the tensions between biomedicine’s postulation of bodily universality and trial participants’ local biologies, this paper advances recent interventions problematizing the structural violence undergirding global clinical trials. It also contributes to the literature on local biologies in its discussion of how these are negotiated in Indian for-profit clinical trials. (shrink)

It is widely recognized that conceptual and theoretical innovations and the employment of new instruments and experimental techniques are important factors in explaining the growth of scientific knowledge in chemistry. This study examines another dimension of research in chemistry, collaboration and co-authorship. I focus specifically on Theodore Richards’ career and publications. During the period in which Richards worked, co-authorship was beginning to become more common than it had been previously. Richards was the first American chemist to be awarded a Nobel (...) Prize and he was at the forefront in this new trend in chemistry. He collaborated more than was typical for his time, with many scientists, in different sized groups, and he often had persistent collaborative relationships, extending over a number of years. Further, it appears that these collaborations benefited Richards, his collaborators, and the field of chemistry as a whole. (shrink)

Much attention has been focused in recent years on the ethical acceptability of physicians receiving gifts from drug companies. Professional guidelines recognize industry gifts as a conflict of interest and establish thresholds prohibiting the exchange of large gifts while expressly allowing for the exchange of small gifts such as pens, note pads, and coffee. Considerable evidence from the social sciences suggests that gifts of negligible value can influence the behavior of the recipient in ways the recipient does not always realize. (...) This paper examines a number of questions about the degree to which the clinical practice of medicine is affected, if at all, by the legal systems in four countries: Chile, Germany, Japan and the United States. The focus on these four countries in four different regions of the world offers a unique perspective within which to examine medical treatment decisions made by patients and their proxies or surrogates, the potential role for universal written instruments such as advance directives, the cross-professional (...) tensions between clinical and legal concerns in very distinct cultures, and the degree to which legal activities can change or affect clinical realities in the context of these different political and health care systems. We have incorporated, whenever relevant, the insights of many disciplines, including the social sciences, in analyzing the existing interrelations between law and behavior in this specific context. Der Beitrag untersucht, inwieweit die klinische Praxis in vier Ländern mit unterschiedlichen Rechtssystemen und Berufskulturen durch Rechtsnormen oder das Verständnis von Recht beeinflußt wird. Es wird gefragt, welche Funktion rechtliche Interventionen bei der Veränderung von Verhaltensnormen in unterschiedlichen Gesundheitssystemen haben können. Folgende Themenbereiche werden diskutiert: Entscheidungen über die medizinische Behandlung, die von Patienten und ihren Angehörigen oder Stellvertretern getroffen werden; die mögliche Rolle umfassender schriftlicher Verfügungen wie z.B. der Patiententestamente ; die berufsübergreifenden Spannungen zwischen medizinischen und rechtlichen Belangen in sehr unterschiedlichen Kulturen; der Einfluß, den gesetzgeberische Aktivitäten im Kontext der verschiedenen politischen und Gesundheitssysteme auf die medizinische Wirklichkeit haben. Antisemitism is on the rise. Recently, discussions have considered so-called “no-go zones for Jews” (city areas Jews should avoid to reduce the likelihood of being attacked). In this context and drawing from attribution theory, we examined if news consumers perceive a Jewish hate crime victim as partly responsible for being attacked when news coverage explicitly emphasizes that the victim displayed religious symbols (kippah) in a certain inner-city location. We conducted a quota-based survey experiment (N = 392) in Germany (4 groups, (...) between-subjects design) and randomly exposed participants to news coverage about an anti-Semitic attack. The article either emphasized that the Jewish victim displayed religious symbols (kippah) or not, and highlighted the specific location of the attack (Berlin synagogue vs. deprived inner-city district of Berlin). Moderated mediation analysis suggested that participants perceived the victim’s behavior to be more provocative when the news article highlighted that the victim displayed religious symbols and when the attack occurred in a deprived Berlin district. Yet, effects were only detected for individuals with low (vs. high) levels of education. Perceived provocativeness in turn increased victim blaming indicating that some individuals indirectly regarded the Jewish victim to be partly responsible for being attacked. (shrink)

Bu arada kadınla ilgili kökleri yaratılış anlatısına giden ontolojik suçluluğu ve cezayı hak ettiği inanışlarının Hz. Peygamber'in sünnetiyle ret edilmesinin önemi dikkatten kaçmaktadır. Kur'an'ın deyimiyle eza çeken kadına muhabbet ve ilgi gösterip desteklemenin sünnette vurgulanması da meselenin ihmal edilen bir yönüdür. Oysaki nasıl cüzzamlı Hz. Anselm’in (1033-1109) Proslogion adlı eserinin 3. bölümünde “kendisinden daha büyüğü düşünülemeyen” şeklinde tanımlanan; Tanrı’nın var olmamasının da düşünülemeyeceğini, bu yüzden de varolmamasının imkansızlığı üzerinde kurulu yeni bir argüman bulunduğunu öne süren bazı araştırmacılar, bu argümanı mümkün dünyalar semantiği yardımıyla formüle edip, “modal ontolojik argüman” şeklinde adlandırmışlardır. Çağdaş epistemoloji içerisinde, dışsalcı, güvenilirci ve erdeme dayalı epistemolojik tartışmaların bir benzerini, dini epistemoloji içerisinde etkili bir şekilde yer edinen ve reformcu epistemoloji olarak bilinen yaklaşım üzerinden görebilmek mümkündür. Alvin Plantinga, Nicholas Wolterstorff ve William Alston gibi filozofların öne çıktığı bu yaklaşımın ana iddiası, kanıta ya da argümana dayanmaksızın, Tanrı’nın varlığına inanmanın bütünüyle doğru, rasyonel, makul ve güvenilir olacağı şeklindeki bir tezdir. Kanıtın, gerekçelendirme için zorunlu bir koşul olmadığı fikri, algısal deneyimlerin gerekçelendirilmesine benzer şekilde, dini deneyimlerin de öyle olduğu ve (...) dolayısıyla, aynı epistemik statüye sahip olması gerektiğini öne süren, eşitlik tezine dayanır. İlk ortaya çıktığı günden bugüne, üzerinde çokça konuşulan ve tartışılan bir yaklaşım olan reformcu epistemoloji, özellikle son beş yıl içerisinde, oldukça farklı bir hale gelmiştir. Zira bu yaklaşımı, kanıtsalcılıkla uyumlu, erdem epistemolojisiyle bağlantılı ve diğer teistik dinler üzerinden değerlendiren yeni çalışmalar ortaya çıkmıştır. Bu nedenle, bu makalede, reformcu epistemoloji ana hatlarıyla ele alınmıştır. Studies of epistemic communities and collaborative research in the social sciences have deepened the understanding of how science works, and more specifically how the social dimensions of scientific practice both enable and impede social scientists in realizing their epistemic goals. Two types of studies of epistemic communities are distinguished: general theories of epistemic communities aim to construct accounts of theoretical change applicable to all social scientific specialties, whereas historical studies emphasize the contingencies that affect specific social scientific disciplines, subfields, or (...) institutions. Although collaborative research plays a less pronounced role in the social sciences than in the natural sciences, collaboration has enabled social scientists to investigate topics that would otherwise be difficult to investigate. Felsefe tarihinin başlangıcı için yapılan tanımlamalarda ise mitos kavramının yerine logos kavramının tercih edilmesi iki kavram arasında bir farklılığı ortaya koymak için yapılmaktadır. Bu ayrımın nedeni ise mitos’un daha çok dinsel içerikle anılması logos’un ise içerisinde bir tür akılsallık barındırması şeklindeki yorumlarda kendini göstermektedir. Ancak söz konusu ayrımın ilk doğa filozofu/ilk felsefeci olarak nitelendirilen Thales için geçerli olup olmadığı geçmişte olduğu gibi günümüzde de halen tartışılmaktadır. (...) Felsefe tarihi yazımlarında ilk sıraya konan Thales’in anılan kavramları gerçekten farklı şekilde yorumlayıp yorumlamadığı bizce de tartışmaya açık bir husustur. The article examines Thomas Kuhn's work in the history of science with special attention to its relevance to subsequent developments in social epistemology. The article begins with a discussion of Kuhn's historical work, and the so-called historical turn in philosophy of science. It then examines Kuhn's views on textbook science, followed by an analysis of Kuhn's views on the relationship between the history of science and the philosophy of science. Then it discusses Kuhn's contributions to our understanding of the social (...) dimensions of scientific inquiry. Finally, it discusses his influence on the social epistemology of science and the sociology of science. (shrink)

Studies on ‘Big Science’ have shifted our perspective from the complexity of scientific objects and their representations to the complexity of sociotechnical arrangements. However, how scientists in large-scale research attend to this complexity to facilitate and afford knowledge production has rarely been considered to date. In this article, we locate organizational complexity on the level of organizing practices that follow multiple and divergent logics. We identify three strategies of managing organizational complexity, drawing on existing literature on large-scale research as well (...) as own empirical research. The three strategies are: segmenting research infrastructure, introducing elements of bureaucratic governance, and implementing standards and standardization. We illustrate these strategies with examples from our empirical case study on experimental particle physics research at CERN’s Large Hadron Collider. While the strategies we identified help to cope with the complexity of some organizational tasks by dividing, ordering, or mediating between divergent organizational logics, we find that organizational complexity overall is not reduced but rather displaced. We argue that dealing with complexity is a dynamic and ongoing process, which inevitably generates novel organizational complexity. (shrink)

Evidence for the association of ‘soluble’ enzymes in vivo is extensive and compelling. These associations occur in all compartments of the cell of both prokaryotes and eukaryotes. Several factors present in vivo promote these associations among enzymes whose association in vitro is often too weak to detect. Several physiological advantages of the associated enzyme complexes can be identified, most (but not all) of which are the consequence of microcompartmentation of metabolites (substrate channeling). Substrate channeling of intermediates by either a ‘direct (...) transfer’ process or ‘proximity effects’ can occur. The latter mechanism does not require the special molecular features needed for the direct transfer mechanism and may, therefore, exist in more general situations in the cell. Criticisms of these views are discussed. We argue that these criticisms have been largely answered by experiment and theory in recent years. Studies on simple systems in vitro, nevertheless, contribute important insights concerning the more complex phenomena in vivo. (shrink)

Güvenilirci (reliabilist) bilgi teorisi, çağdaş epistemik gerekçelendirme kuramları içerisinde, dışsalcı (externalist) kuramın bir türü olarak kendisine yer bulmaktadır. Kısaca, bir inancı gerekçelendiren şeyin o inancın oluşturulduğu sürecin güvenilirliği olduğunu öne süren bu yaklaşım, bu bilişsel süreçleri özne dışı unsurlara bağladığı içinde dışsalcı bir pozisyonda yer almaktadır. Bu bilgi teorisinin tam karşı konumunda yer alan içselci (internalist) bilgi teorisi ise, özne merkezli bir yaklaşımla, doğru inancı gerekçelendirecek yöntemin, kişinin kendi zihinsel yapısından yola çıkarak, belli kognitif süreçler sonucunda ulaşılabileceğini öne sürmektedir. Epistemik (...) gerekçelendirme kuramları içerisinde birçok tartışmada kendisine yer bulan bu iki bilgi teorisi, kendi içerisinde de birçok farklı kurama kapı aralamıştır. Burada içselci bilgi teorisinden ortaya çıkan erişim içselciliği, farkındalık içselciliği gibi kuramları ve dışsalcı bilgi teorisinden ortaya çıkan süreç güvenilirciliği, gösterge güvenilirciliği ve erdem güvenilirciliği gibi farklı türden kuramları örnek olarak verebiliriz. Öte yandan çağdaş epistemolojideki bu tartışmalar, dini epistemoloji içerisinde de kendisine yer bulmuştur. Özellikle Alvin Plantinga, kendi dini epistemolojisi içerisinde dışsalcı bir tutum sergilemiş ve son dönem çalışmaları içerisinde de güvenilirci bir anlayışla Tanrı inancının epistemik mahiyetini ortaya koymaya çalışmıştır. Bu makalede öncelikle dışsalclık ve onun bir türü olan güvenilirci bilgi anlayışını ve bu kuramlara getirilen eleştirileri ele almaya çalışacağız, daha sonra A. Plantinga’nın son dönem dini epistemolojisinin de yönünü belirleyen güvence (warrant) kavramını açıklayıp, bu kavramın bütün teist dinlere uygulanabilirliğini sorgulayacağız. (shrink)

Epistemolojik olarak bilgiye başvuran ve bilme faaliyetinde bulunan insanın, Kur’an’da önemli bir yeri vardır. Buradaki bilme faaliyetini, salt teolojik bir buyruk olarak, yani Allah’ı bilmek olarak değil, doğru bilgi ile yanlış bilgi arasında hem teorik hem de ahlaki bir farklılık olarak anlamak ve Kur’an'da insana epistemik özellikler atfedildiğini ve böylece insanın epistemik başarılarından dolayı övüldüğünü söyleyebilmek mümkündür. Bu açıdan bakıldığında herhangi bir önermeye yönelik olarak rasyonel bir tutum benimseyen, yani bilen özne ile bu faaliyette isteyerek ve istemeyerek giren kişinin durumu (...) arasında bir fark olduğu açıktır. Doğrusu bu farkın epistemik önceliği kadar, ahlaki önceliği de dikkate değerdir. Nitekim buradaki ahlaki üstünlük, doğru bilgiyi hedefleme ve ona ulaşma noktasında ortaya çıkan erdemdir. Doğru bilgiye ulaşmanın entelektüel bir erdem olduğu düşünüldüğünde, Kur’an’ın Erdem epistemolojisi üzerinden değerlendirilmesi bu noktada önemlidir. Doğrusu erdemli bir bilişsel faaliyet, Kur'an’da açık bir şekilde ana fikir olarak ortaya konulur ve buna göre cehaletten kaçınmak ve doğru bilgiye ulaşmak için erdemli bir çaba göstermek önem taşır. Kur’an’daki ifadeleri bilgeliğe ulaşmak olarak anlayacak olursak, asıl hedef; bilgi ve anlayışımızın, entelektüel ve ahlaki vicdanımızı veya takvamızı güçlendirmesi için kullanılabileceği söylenilebilir ve bu inanç, erdem epistemolojisine dayalı bir yaklaşım içerisinde şekillendirilebilir. Hristiyan inancı içerisinde merkezi konuma sahip olan mevzulardan birisi de, İsa’nın ölümünden üç gün sonra diriltildiğine yönelik olan inançtır. Hristiyan eskatolojisinin de dayanak noktasını oluşturan bu mevzu, dinler tarihi ya da teoloji gibi disiplinlerin içerisinde tartışıldığı gibi, çeşitli Hristiyan düşünürlerce, din felsefesi disiplini içerisinde de tartışılmıştır. Din felsefesi açısından bakıldığında, konunun merkezi konumda olması, bu mevzunun rasyonel bir zeminde tartışılıp tartışılamayacağını da beraberinde getirmektedir. Bu bağlamda, özellikle din felsefesi içerisinde birçok Hristiyan düşünür tarafından konu ele alınmış ve farklı çevrelerce de (...) mevzuya yönelik karşı itirazlar dile getirilmiştir. Bu noktada yapılan tartışmaların içeriğine baktığımızda, mucize kavramı önem taşımakla birlikte, Hristiyan düşünürlerin argüman haline getirdikleri ve bir delil olarak öne sürdükleri “Boş mezar” ve “Tanıklıklar gibi birçok farklı husususun din felsefesi açısından tartışıldığını söyleyebiliriz. Ayrıca bazı ateist düşünürlerin bu delillere yönelik itirazları olmakla birlikte, bazı Hristiyan tarihçilerinde konuya ilişkin ciddi itirazları bulunmaktadır. Biz de bu makalemizde, İsa’nın ölümünden sonra dirilişinin rasyonel bir şekilde izahının nasıl olabileceği sorusunu merkeze alıp, konuyu Hristiyan düşünürlerin bakış açısından değerlendirmeye çalıştık. Bu noktada İslam gibi farklı dinlerde ve farklı anlatılarda karşımıza çıkan Hz. İsa figürünü konumuzun dışında tuttuğumuzu ayrıca belirtelim. Çünkü bizim yazımızın konusunu oluşturan kişi Hristiyan inancındaki İsa ve bu din içerisinde önem taşıyan kutsal metinler ve bu metinlerde geçen anlatılar oldu. Bu açıdan bakıldığında yazımız içerisinde, konuya ilişkin doğrudan bir teoloji ya da dinler tarihi çerçevesinde değerlendirme yapmaktan çok, din felsefesi içerisinde bize sunulan tartışmalardan yola çıkarak eleştirilerimizi ve tahlillerimizi dile getirmeye çalıştığımızı ifade edebiliriz.
