Think of this paper as an exercise in applied philosophy of language. It has both semantic and deontic concerns. More than about the meaning of ‘marriage,’ it is about how one goes about determining the meaning of social kind terms like ‘marriage’. But it is equally about the place of philosophy of language in the legislative sphere, and inter alia, about the roles and responsibilities of philosophers in public life.

Two central tenets of externalist theories of word individuation are: the claim that some terms derive their meaning from causal connections to the world , and the claim that some terms derive them from intentional connections to the linguistic community . A normative conception of language underlies the latter claim . It is this conception which motivates the reliance on a principle of literal interpretation in interpreting ascriptions of intentional content. ;The new theory of grammar initiated by Chomsky yields radically (...) individualistic conceptions of language and of mind incompatible with those underlying communalist theories of conceptual content. ;The feasibility of the principle of literal interpretation postulated by normativist theories depends on the possibility of identifying the language of the subject. This condition grounds an important distinction between cases of deference to science and cases of deference to communal norms. For while our shared commitments to science are a function of our sharing the same world, and thus transcend language communities, commitments to linguistic norms differ essentially across language communities. ;The conception of language and concept acquisition underlying normativism leaves unexplained the facts of language change. Moreover, the problem of concept-individuation, which communalism seeks to solve by appeal to an individual's normative commitments, merely resurfaces as that of individuating linguistic communities. ;Subjectivism provides an explanation of language change, as well as an important insight into the historical chain picture of the reference of names. ;Moreover, the view that humans are innately endowed with concepts is problematic for an externalist theory of concept-individuation. Conventional behavior is behavior engaged in because of, or due to, convention. There are two senses of “due to”: the convention explains my behavior by actually causing it; or the convention explains my behavior by providing reasons I have for engaging in this behavior. Either way, behaviors cannot be explained by conventions unless the conventions exist; and conventions cannot provide me with (conscious) reasons for engaging in my behavior unless I know what they are. I argue that, far from causing (...) behavior, conventions are the results of behavior: conventions exist, in the sense in which they may be said to exist at all, only retrospectively. Moreover, as natural language speakers, we are ever at best in the position of thinking we know what the conventions are. But thinking one is acting conventionally is not the same thing as acting conventionally. Claims about the role of convention in linguistic competence interestingly both mirror and differ from claims about the role of genes in evolutionary theory, as I briefly pointout by way of conclusion. I present several arguments which provide what I consider to be a definitive argument against certain forms of masculine language in their so-called sexually neutral usage. In the first part, I concentrate on the use of the word and I defend the idea that it embodies a perverse contingent a priori. In the second part, I examine how this pernicious a prioriinfects the pronominal system of French. I conclude with an undoubtedly surprising linguistic and feminist criticism of a recent decision (...) by the Office de la langue franbec to feminize job titles, arguing instead that the problem lies elsewhere and hence so does an efficient solution. My aim in this paper is two?fold. I start by contrasting three versions of externalist arguments based on etiological considerations, whose differences are not often appreciated. My purpose in doing so is to isolate one of these versions of externalism as most supportive of current anti?individualist attitudes toward the mental. My second aim is to show that this version, which I call (for reasons soon to be clear) Dialectal Etiology , is marred to a greater extent than the other two (...) by an important problem of language individuation.ii.. According to the argumentative theory of reasoning, humans have evolved reasoning abilities for argumentative purposes. This implies that some reasoning skills should be universals. Such a claim seems to be at odd with findings from cross-cultural research. First, a wealth of research, following the work of Luria, has shown apparent difficulties for illiterate populations to solve simple but abstract syllogisms. It can be shown, however, that once they are willing to accept the pragmatics of the task, these participants can perform (...) at or near ceiling. Second, historical, sociological and anthropological research has been used to claim that some Eastern cultures have not developed argumentation. These claims are the result of oversimplifications and of a selective view of the data. A closer looks reveals instead very elaborate forms of argumentation, in Chinese culture particularly. Third, cross-cultural psychologists have carried out an extensive research program aimed at showing that Easterners do not rely on the principle of non-contradiction and that they use holistic rather than analytic thinking. A review of these experiments shows that no qualitative difference emerges in the way Easterners and Westerners deal with argumentation and that in the proper context both populations can easily have recourse to holistic or analytic thinking. It is possible to conclude from this critical review that the reasoning skills involved in argumentation seem to be universal even though they can be used in different ways in various cultural contexts. We contend that diagrams are tools not only for communication but also for supporting the reasoning of biologists. In the mechanistic research that is characteristic of biology, diagrams delineate the phenomenon to be explained, display explanatory relations, and show the organized parts and operations of the mechanism proposed as responsible for the phenomenon. Both phenomenon diagrams and explanatory relations diagrams, employing graphs or other formats, facilitate applying visual processing to the detection of relevant patterns. Mechanism diagrams guide reasoning about how (...) the parts and operations work together to produce the phenomenon and what experiments need to be done to improve on the existing account. This paper considers the early reception of Einstein's theory of relativity in the Arab world, with emphasis directed to its popularization. Educated Arabs generally had no contention with Einstein's political, religious or cultural background. On the contrary, they viewed him as the genius of the age and defended him against his critics.

Cognitive science is, more than anything else, a pursuit of cognitive mechanisms. To make headway towards a mechanistic account of any particular cognitive phenomenon, a researcher must choose among the many architectures available to guide and constrain the account. It is thus fitting that this volume on contemporary debates in cognitive science includes two issues of architecture, each articulated in the 1980s but still unresolved: " • Just how modular is the mind? – a debate initially pitting encapsulated mechanisms against (...) highly interactive ones. • Does the mind process language-like representations according to formal rules? – a debate initially pitting symbolic architectures against less language-like architectures. " Our project here is to consider the second issue within the broader context of where cognitive science has been and where it is headed. The notion that cognition in general—not just language processing—involves rules operating on language-like representations actually predates cognitive science. In traditional philosophy of mind, mental life is construed as involving propositional attitudes—that is, such attitudes towards propositions as believing, fearing, and desiring that they be true—and logical inferences from them. On this view, if a person desires that a proposition be true and believes that if she performs a certain action it will become true, she will make the inference and perform the action. (shrink)

We contrast reactive and endogenously active perspectives on brain activity. Both have been pursued continuously in neurophysiology laboratories since the early 20thcentury, but the endogenous perspective has received relatively little attention until recently. One of the many successes of the reactive perspective was the identification, in the second half of the 20th century, of the distinctive contributions of different brain regions involved in visual processing. The recent prominence of the endogenous perspective is due to new findings of ongoing oscillatory activity (...) in the brain at a wide range of time scales, exploiting such techniques as single-cell recording, EEG, and fMRI. We recount some of the evidence pointing to ways in which this endogenous activity is relevant to cognition and behavior. Our major objective is to consider certain implications of the contrast between the reactive and endogenous perspectives. In particular, we relate these perspectives to two different characterizations of explanation in the new mechanistic philosophy of science. In a basic mechanistic explanation, the operations of a mechanism are characterized qualitatively and as functioning sequentially until a terminating condition is realized. In contrast, a dynamic mechanistic explanation allows for non-sequential organization and emphasizes quantitative modeling of the mechanisms's behavior. For example, with appropriate parameter values a set of differential equations can be used to demonstrate ongoing oscillations in a system organized with feedback loops. We conclude that the basic conception of mechanistic explanation is adequate for reactive accounts of brain activity, but dynamical accounts are required to explain sustained, endogenous activity. A new theoretical approach to language has emerged in the past 10–15 years that allows linguistic observations about form–meaning pairings, known as ‘construc- tions’, to be stated directly. Constructionist approaches aim to account for the full range of facts about language, without assuming that a particular subset of the data is part of a privileged ‘core’. In this paper I discuss the four Women and Labour conferences which were held in Australian capital cities over the seven years between 1978 and 1984. I explore the ways in which the history of Australian feminist activism during this period could be written, questioning in particular the claim that the Women and Labour conferences have been central to the history of Australian feminism. I discuss the ways in which a historical sense could be established, using writings about the conferences (...) as historical ‘evidence’, that race and ethnic divisions between women had not been important to the ‘women's movement’ until 1984. In other words, I challenge the construction of this conference as a turning point – not only in the feminist politicization of immigrant and Aboriginal women, but also in the politicization of all feminists about race and ethnic divisions. More broadly, I am interested in how a history would be written if it aimed to get to the ‘truth’ about racism and about the feminist activism of immigrant women. How would the apparent lack of written ‘evidence’ – at least until 1984 – of immigrant women's feminist activism, and of the awareness of Australian feminists about issues of racism, be written into this history? In addition, I suggest that it is important to the writing of feminist history in Australia that published documentation has been mostly produced by anglo women, and is thus partial and mediated by the lived, embodied experiences of anglo women. Finally, my intention is to interrogate commonly understood narratives about Australian feminist history, to challenge their seamlessness, and to suggest the importance of recognizing the tension within feminist discourses between difference as benign diversity and difference as disruption. In two experiments, participants had to choose between a sure and a risky option. The sure option was presented either in a gain or a loss frame. Need was defined as a minimum score the participants had to reach. Moreover, choices were made under two different time constraints and with three different levels of induced need to be reached within a fixed number of trials. The two experiments differed with respect to the specific amounts to win and the need levels. (...) The $$2 \times 2 \times 3$$2×2×3 design was a within-subject design. Data were evaluated on an overall and on a group level, the latter based on participants’ stated risk preference and on revealed preferences using cluster analysis across subjects. Overall, the results showed riskier behavior when the choice options were presented as losses as compared to gains and when the induced need was highest. Time limits enhanced the framing effect. This paper focuses attention on the stakeholder attribute of legitimacy. Drawing upon institutional and stakeholder theories, I develop a framework of stakeholder legitimacy based on its three aspects—legitimacy of the stakeholder as an entity, legitimacy of the stakeholder’s claim, and legitimacy of the stakeholder’s behavior. I assume that stakeholder legitimacy is socially constructed by management and that each of its three aspects exists in degree in the manager’s perception. Wikipedia is known as a free online encyclopedia. Wikipedia uses largely transparent writing and editing processes, which aim at providing the user with quality information through a democratic collaborative system. However, one aspect of these processes is not transparent—the identity of contributors, editors, and administrators. We argue that this particular lack of transparency jeopardizes the validity of the information being produced by Wikipedia. We analyze the social and ethical consequences of this lack of transparency in Wikipedia for all users, but (...) especially students; we assess the corporate social performance issues involved, and we propose courses of action to compensate for the potential problems. We show that Wikipedia has the appearance, but not the reality, of responsible, transparent information production. (shrink)

This paper provides a brief comparative overview of the development of the reproductive sciences especially in agriculture in the UK and the US. It begins with the establishment by F. H. A. Marshall in 1910 of the boundaries that framed the reproductive sciences as distinct from genetics and embryology. It then examines how and where the reproductive sciences were taken up in agricultural research settings, focusing on the differential development of US and UK institutions. The reproductive sciences were also pursued (...) in medical and biological settings, and I discuss how the intersections among all three allowed the circulation of both ideas and scientists’ careers. Across the twentieth century, scientific leadership in the reproductive sciences alternated between the UK and US, and these patterns are elucidated. I conclude with thoughts on future research that might emphasize the elaboration of industrialization processes in agriculture and new capacities to transform both reproductive processes and their products—life itself—as biopower comes to be more ambitiously understood as extending across all species. The present paper argues that there is ample corpus evidence of statistical preemption for learners to make use of. In the case of argument structure constructions, a verbi is preempted from appearing in a construction A, CxA, if and only if the following probability is high: P(CxB|context that would be suitable for CxA and verbi). For example, the probability of hearing a preemptive construction, given a context that would otherwise be well-suited for the ditransitive is high for verbs like explain (...) that overwhelmingly appear in the dative, and low for verbs like tell that readily appear in the ditransitive. Strength of statistical preemption is determined both by this probability, and by the frequency (ln (F)) of a verb in a preemptive construction when the context is at least as well suited to the preempted construction. The critiques of preemption by Stefanowitsch (Cognitive Linguistics 19: 513–531, 2008, this volume) are countered by arguing that the relevant probabilities were not considered. Moreover, we find evidence that constructions are somewhat less constrained when yoked to non-alternating verbs, as Stefanowitsch (cf. this volume) suggests should be the case. (shrink)

The completion of the Human Genome Project has opened up unprecedented possibilities in healthcare, but also ethical and social dilemmas in terms of how these can be achieved. Genomic information can be seen as a "global public good" (GPG), in that it is represented by knowledge in the public domain and across national boundaries. Lack of investment, infrastructure and expertise in developing countries means that they are unable to take advantage of these GPG characteristics to address their health needs, fuelling (...) fears of a growing "genomics divide". Some have suggested an international knowledge sharing and capacity building network, a Global Genomics Initiative, as a means to harness the potential of genomics to reduce inequalities in health between North and South. Three UNESCO declarations also call for cooperation between developed and developing countries in genomics research and science and technology in general. Using international relations theories around global governance and networks as a conceptual framework, this paper examines whether these initiatives are likely to succeed in providing effective governance of genomics. Medical intervention in childbirth raises a number of ethical issues which have received too little attention in American obstetrics. A number of these issues are surveyed in the first section of this essay. In the second section, the hospital and the roles characteristically ascribed to patients, staff, and obstetrical practitioners are shown to provide an unsatisfactory social setting for birth. Several proposals for improving existing arrangements or for providing alternatives are offered. It is argued that procedures for eliciting and maintaining (...) fidelity to patient values for the birth experience are crucial elements in acceptable care. Juris-Data is one of the largest case-study base in France. The case studies are indexed by legal classification elaborated by the Juris-Data Group. Knowledge engineering was used to design an intelligent interface for information retrieval based on this classification. The aim of the system is to help users find the case-study which is the most relevant to their own.The approach is potentially very useful, but for standardising it for other legal document bases it is necessary to extract a legal classification (...) of the primary documents. Thus, a methodology for the construction of these classifications was designed together with a framework for index construction. The project led to the implementation of a Legal Case Studies Engineering Framework based on the accumulated experimentation and the methodologies designed. It consists of a set of computerised tools which support the life-cycle of the legal document from their processing by legal experts to their consultation by clients. (shrink)
