It is commonly assumed that the pre-codified, customary law of war had little true influence on the decisions or behavior of combatants in the western world. Evaluating this assumption concerning the custom (or norm) of the giving of quarter to enemy combatants in the Texas War of Independence of 1835--1836, this paper finds a strong and widely accepted norm on this subject already by the early 19th century, which exerted significant influence on the behavior in and the results and consequences (...) of the war. The following of this custom of war by the Texian Army, on the one hand, and its intentional and preplanned breaking by the Mexican army headed by Santa Anna for the supposed military and psychological benefits that would accrue from it, on the other, such as in the cases of the Alamo and Goliad, led to severe internal and external consequences for the Mexican side in the short and long term that greatly contributed to their failure to achieve their objectives and to the Texian success in achieving theirs. These consequences indicate the importance of the norms of warfare, even in the pre-codification era, and the major potential costs involved in their breaking or disregard by decision makers. In keeping with other recent efforts, Fodor's CONCEPTS focuses on the metaphysics of conceptual content, bracketing such epistemological questions as, "How can we know the contents of our concepts?" Fodor's metaphysical account of concepts, called "informational atomism," stipulates that the contents of a subject's concepts are fixed by the nomological lockings between the subject and the world. After sketching Fodor's "what else?" argument in support of this view, we offer a number of related criticisms. All point to the same conclusion: (...) Protection of civilians has become enshrined as a core task for international peacekeeping missions. How to ensure that civilians are safe from violence and human rights abuses is central to developing military doctrine for peacekeeping; how safe civilians are from attack is central to how peacekeeping missions are assessed both by locals and international observers. However, protection of civilians is often seen as something that is done by active peacekeepers on behalf of passive civilians, potentially missing the ways in which (...) peacekeepers’ actions interact with strategies that civilians undertake on their own behalf. Integrating peacekeeper and civilian self-protection strategies is not trivial, either from a practical or a moral standpoint. Drawing on primary research among women in Liberia, as well as case studies of civilian protection elsewhere, this essay examines the ways in which working with civilians on protection—creating ‘hybrid’ systems of protection—inevitably entangles peacekeepers in civilians’ other social, political, and moral concerns, undermining at least a naïve impartiality. To retain their moral stance, peacekeepers ought to focus on using the safety they provide to allow different local actors to interact safely and, ideally, constructively. (shrink)

Philosophical writing on the welfare state has taken a defensive turn in recent years, largely in response to two related phenomena: the re-emergence of pro-market ideologies in the larger political culture and the imperiled condition of real world welfare states in a global economy in which national governments have diminishing capacities for shaping the social and economic lives of their citizens. But thanks in part to the tireless advocacy of Philippe Van Parijs, an even more radically redistributive form of public (...) provision than the welfare state has come onto the intellectual agenda—and the political agenda too, at least in Belgium and the Netherlands. Van Parijs proposes that all citizens be accorded an unconditional “basic income grant” as large as is compatible with the need to generate as much wealth as possible for redistribution. By now, this idea has many defenders. It also boasts a genealogy extending back to such writers as Tom Paine, François Huet, Edward Bellamy and G. D. H. Cole. But Van Parijs has become its best-known and most adept philosophical proponent, and this book represents his most sustained effort to date to investigate its normative foundations. (shrink)

Pantheism is a metaphysical and religious position. Broadly defined it is the view that (1) "God is everything and everything is God ... the world is either identical with God or in some way a self-expression of his nature" (H.P. Owen). Similarly, it is the view that (2) everything that exists constitutes a 'unity' and this all-inclusive unity is in some sense divine (A. MacIntyre). I begin with an account of what the pantheist's ethical position is formally likely to be (...) (e.g. objectivist etc.). I then discuss the relationship between pantheism and ecology in the context of the search for the metaphysical and ethical foundations for an ecological ethic. According to the subtitle of this anthology, the essays are intended to discuss and explore "the cohesive and disjunctive forces" existing between C. P. Snow's infamous "two cultures" of science and the humanities. As in all the colloquia on this subject, there tends to be a mishmash of problems in definition, with Snow's relatively simple and straightforward contrast lost in the shuffle of terms. The fact that in this volume no one agrees upon what science is tends to limit its (...) ability to solve Snow's problem, but, on the other hand, it offers many ruminations on the various meanings of science. Gyorgy Kepes, for instance, thinks of science mainly as a set of technologically sophisticated instruments and advocates that technicians and visual artists collaborate on the design of "light shows" and other flashy works of modern art, especially the design and execution of environmental art. Harry Levin, the well-known scholar of comparative literature, thinks that the division of intellectual activities into "scientific" and "cultural" might be better replaced with dividing scholars into "generalists" and "specialists," arguing that the human community needs a balanced representation of both camps. Talcott Parsons advocates the incorporation of scientific methods into traditionally humanistic considerations, proposing that social science is the logical amalgam of the two cultures. Parsons, by the way, is more commendable for practicing what he preaches than some of his colleagues in the social sciences, particularly Oscar Handlin, also represented in this volume. Altogether, sixteen points of view are included in the symposium, most filled with sonorous language and unsupported generalizations about matters of historical and current fact, but all of them literate and filled with challenging philosophical puzzles.—E. It contains three main texts Experience and Education, Freedom and Culture, and Theory of Valuation, plus essays and miscellany. The editors, Jo Ann Boydston and Barabara Levine, provide twenty-five pages of Appendices, and Steven M. Cahn has written and excellent Introduction. Type specimens are used to designate species. What is the nature of the relation between a type specimen and the species it designates? If species names are rigid designators, and type specimens ostensively define species, then that relation is, at the very least, a close one. Levine :325–338, 2001) argues that the relationship of type specimen to a named species is one of necessity—and that this presents problems for the individuality thesis. Namely, it seems odd that a contingently selected specimen (...) should belong to a species of necessity. In considering Levine’s argument, LaPorte suggests that recognizing the distinction between de re and de dicto necessity resolves Levine’s worries. I reconsider the motivating question: does a type specimen belong of necessity to the species that it designates? In light of taxonomic cases and practice the answer is clear: definitively not. This is particularly clear in the case of re-designation of types by taxonomic decree. I explain how this helps reveal how taxonomists prioritize competing theoretical commitments, and offer a defense of the individuality thesis as applied to these particular cases. In short, I demonstrate how to misidentify a type specimen. (shrink)

Feldman and Levin present a model for movement control in which the system is said to seek equilibrium points, active movement being produced by shifting frames of reference in space. It is argued that whatever merit this model might have is limited to an understanding of “the how” and not “the why” we move. In this way the authors seem to be forced into a dualistic position leaving the upper level of the proposed control hierarchy “floating.”.
