8 March, now known as International Women’s Day, is a day for feminist claims where demonstrations are organized in over 150 countries, with the participation of millions of women all around the world. These demonstrations can be viewed as collective rituals and thus focus attention on the processes that facilitate different psychosocial effects. This work aims to explore the mechanisms involved in participation in the demonstrations of 8 March 2020, collective and ritualized feminist actions, and their correlates associated with personal (...) well-being and collective well-being, collective efficacy and collective growth, and behavioral intention to support the fight for women’s rights. To this end, a cross-cultural study was conducted with the participation of 2,854 people from countries in Latin America and Europe, with a retrospective correlational cross-sectional design and a convenience sample. Participants were divided between demonstration participants and non-demonstrators or followers who monitored participants through the media and social networks. Compared with non-demonstrators and with males, female and non-binary gender respondents had greater scores in mechanisms and criterion variables. Further random-effects model meta-analyses revealed that the perceived emotional synchrony was consistently associated with more proximal mechanisms, as well as with criterion variables. Finally, sequential moderation analyses showed that proposed mechanisms successfully mediated the effects of participation on every criterion variable. These results indicate that participation in 8M marches and demonstrations can be analyzed through the literature on collective rituals. As such, collective participation implies positive outcomes both individually and collectively, which are further reinforced through key psychological mechanisms, in line with a Durkheimian approach to collective rituals. Este trabajo analiza los aspectos más destacados de la polémica entre Juan Carlos Bayón y Eugenio Bulygin acerca de las lagunas jurídicas, el principio de prohibición y el alcance de la discreción judicial. En esta disputa, Bulygin defiende cuatro tesis centrales, enunciadas en Normative Systems : una cuidadosa distinción entre normas y proposiciones normativas es esencial para resolver el problema de las lagunas jurídicas, la versión débil del principio de prohibición no sirve para mostrar que no existen lagunas, la (...) versión fuerte del principio de prohibición es verdadera solo cuando el sistema es completo, y en casos de lagunas jurídicas, los jueces tienen discreción para resolver estas situaciones. Sin embargo, Bayón señala que el problema no es la falta de distinción entre normas y proposiciones normativas sino el desacuerdo acerca de cuándo una solución jurídica es concluyente. La diferencia entre soluciones prima facie y concluyente es esencial porque en ciertas situaciones, el derecho no da una respuesta pero tampoco deja espacio para la discrecionalidad judicial. Según Bayón, en estos casos el principio de prohibición "todo lo que no está prohibido está permitido" juega un papel fundamental. Este trabajo muestra que los argumentos de Bayón son insuficientes para rechazar las tesis clásicas defendidas por Bulygin. In this paper I analyze the most relevant aspects of the controversy between Juan Carlos Bayón and Eugenio Bulygin about the existence of legal gaps, the so called "principle of prohibition" and the scope of judicial discretion. In this debate, Bulygin defends four classical theses advanced in his wellknown book, Normative Systems : a careful distinction between norms and norm propositions is actually needed in order to solve the problem of legal gaps, the analytical truth of the weak version of the principle of prohibition cannot guarantee the completeness of legal systems, the strong version of the principle of prohibition is true only if legal systems are complete, and judges have discretion in cases of legal gaps. However, Bayón claims that the problem is not the lack of distinction between norms and norm proposition but rather the identification of conclusive legal solutions. Conclusive legal solutions must be distinguished from the prima facie solutions provided by explicitly enacted norms. According to Bayón, the difference between conclusive and prima facie solutions is essential in legally irrelevant cases; in such cases the principle of prohibition plays an essential role because it entails the rejection of judicial discretion. In this paper I claim that the arguments advanced by Bayón fail to provide a sound ground for discarding the classical theses defended by Bulygin. (shrink)

BackgroundGenetic/genomic testing (GGT) are useful tools for improving health and preventing diseases. Still, since GGT deals with sensitive personal information that could significantly impact a patient’s life or that of their family, it becomes imperative to consider Ethical, Legal and Social Implications (ELSI). Thus, ELSI studies aim to identify and address concerns raised by genomic research that could affect individuals, their family, and society. However, there are quantitative and qualitative discrepancies in the literature to describe the elements that provide content (...) to the ELSI studies and such problems may result in patient misinformation and harmful choices.MethodsWe analyzed the major international documents published by international organizations to specify the parameters that define ELSI and the recognized criteria for GGT, which may prove useful for researchers, health professionals and policymakers. First, we defined the parameters of the ethical, legal and social fields in GGT to avoid ambiguities when using the acronym ELSI. Then, we selected nine documents from 44 relevant publications by international organizations related to genomic medicine.ResultsWe identified 29 ELSI sub-criteria concerning to GGT, which were organized and grouped within 10 minimum criteria: two from the ethical field, four from the legal field and four from the social field. An additional analysis of the number of appearances of these 29 sub-criteria in the analyzed documents allowed us to order them and to determine 7 priority criteria for starting to evaluate and propose national regulations for GGT.ConclusionsWe propose that the ELSI criteria identified herein could serve as a starting point to formulate national regulation on personalized genomic medicine, ensuring consistency with international bioethical requirements. The use of technologies like artificial intelligence can drive productivity growth, efficiency and innovation. The goal of this study is to develop an anomaly detection method for locating flaws on the surface of sandwich panels using YOLOv5. The proposed algorithm extracts information locally from an image through a prediction system that creates bounding boxes and determines whether the sandwich panel surface contains flaws. It attempts to reject or accept a product based on quality levels specified in the standard. To evaluate (...) the proposed method, a comparison was made with a sandwich panel damage detection method based on a convolutional neural network and methods based on thresholding. The findings show that the proposed method, which is based on an object detector, is more accurate than the alternatives. The characteristics of the model, which can reject or accept a product according to the standard and limit allowable manufacturing flaws to obtain a quality product, also enable this system to improve industrial standards for producing sandwich panels while increasing speed. En este trabajo analizo la autonomía y relevancia normativa de las normas permisivas. En especial, mis propósitos principales son revisar dos tesis escépticas: los permisos y las normas permisivas pueden reducirse a otras formas normativas, e.g. derogación de prohibiciones, y no se producen diferencias significativas cuando se permite una conducta que no había sido previamente regulada. Ambas tesis son examinadas en relación a la naturaleza y función del principio de clausura normativa. La conclusión de este trabajo es que las normas (...) permisivas, y en particular las normas de clausura, pueden cumplir una importante función en los sistemas normativos y son una herramienta útil para analizar otros problemas como las lagunas del derecho y la discreción judicial. A continuación, se plantea una genealogía queer de los usos de la teatralidad en las formas contemporáneas del activismo urbano. A partir del encuentro entre ambas líneas temporales defiendo, en diálogo con la obra reciente de Judith Butler, la importancia de la (...) dimensión performativa de las intervenciones individuales en espacios de protesta para entender el alcance movilizador de la acción colectiva. The aim of the present study was to carry out a qualitative and quantitative synthesis of the existing literature studying the relationship between emotional intelligence and risk behavior. We conducted a systematic review and meta-analysis of the scientific evidence available relating both constructs. Particular attention was paid to identifying possible differences in this relationship as a function of the different conceptualizations of EI and the risk domain. The study was conducted following the Cochrane and PRISMA guidelines. Our results revealed a (...) significant negative relationship between EI and health-related risk behaviors. However, this relationship was not observed in other risk domains such as finance and gambling. The relationship between EI and risk behavior differed according to the risk domain studied, which supports the notion that risk is a domain-specific construct. The results associated with the health-related risk behaviors are consistent with existing literature about the positive impact of emotional abilities on the health domain. A more complete understanding of the emotional mechanisms that underlie risk behavior could help to establish action guidelines and improve programmes to prevent and reduce the negative effects of risk behavior on our society. Judith Butler draws on Emmanuel Levinas’ ethics in order to question processes of humanization and dehumanization taking place through various practices of representation of the face of the other. This is a singular reading leading Levinas’ work to the field of media representations conceived as an agonistic social landscape where the demand of the face is offered or, on the contrary, hidden from us. In that sense, Butler’s cultural transposition of Levinasian ethics entails a politicization of ethics which is indistinguishable, (...) at the end, from an ethic assault to the politics of representation. In this cultural bond among ethics and politics arise fundamental questions on responsibility linking it to the practice of cultural translation while offering alternatives to some common universalist shortcuts of contemporary ethical reflection.Keywords: Cultural translation, ethical responsibility, ethics of alterity. This paper addresses some relations between the spatial politics of queer assemblies in spaces of protest and the constitution of collective political subjects. It does so by exploring the spatial politics of queer activism within the global Occupy movements, in the light of Judith Butler’s work on the performative power of assembly and the ambivalences of the Foucauldian concept of heterotopia. Specific challenges faced by queer activists in various encampments will be addressed in order to expose some tensions between the (...) constitutive exclusions inherent to the constitution of spaces of protest and the processes of coalition building needed to effectively overcome those very constitutive exclusions. El ciclo de protestas que se abrió en las primaveras árabes ha servido para revitalizar la reflexión teórica sobre el modo en que los procesos de agenciamiento político son indisociables de los modos de producción de los espacios de coalición. Es el caso de Judith Butler en Cuerpos aliados y lucha política, junto con otras autoras que han mostrado la importancia de pensar los modos de encuentro corporal, y las políticas de acceso a los espacios de aparición, como parte central (...) de la lucha y la reflexión política. En diálogo con estas y otras provocaciones teóricas, fundamentalmente en el ámbito de los estudios queer, este ensayo explora los modos de producción del espacio de coalición transfeminista y queer a partir de experiencias activistas recientes en la ciudad de Madrid.The cycle of protests opened by the Arab Springs has served to revitalize theoretical reflections on the interplay between the construction of political agency and the production of coalitional spaces. This is the case of Judith Butler in Bodies in Alliance and the Politics of the Street, along with other authors that have shown the importance of thinking bodily encounter, and the politics of accessibility to the space of appearance, as a central part of political reflection and struggle. In dialogue with these and other theoretical provocations, specially coming from Queer Studies, this essay explores the modes of production of the space of transfeminist and queer coalition drawing on recent activist experiences in the city of Madrid. A considerable number of books and papers have analyzed normative concepts using new techniques developed by logicians; however, few have bridged the gap between the English legal culture and the Continental tradition in legal philosophy. This book addresses this issue by offering an introductory study on the many possibilities that logical analysis offers the study of legal systems. The volume is divided into two sections: the first covers the basic aspects of classical and deontic logic and its connections, advancing an (...) explanation of the most important topics of the discipline by comparing different systems of deontic logic and exploring some of the most important paradoxes in its domain. The second section deals with the role of logic in the analysis of legal systems by discussing in what sense deontic logic and the logic of norm-propositions are useful tools for a proper understanding of the systematic structure of law. Uno de los principales problemas de la filosofía de la psicopatología contemporánea consiste en definir qué tipo de estados mentales son aquellos que denominamos delirantes. A esto se le ha denominado el “problema tipológico de los delirios”. El principal objetivo de este artículo es examinar las principales alternativas filosóficas contemporáneas a este problema: el doxasticismo—de acuerdo con el cuál los delirios deben ser caracterizados como creencias—y al anti-doxasticismo—el cuál niega el estatuto doxásticos de los delirios y ofrece una caracterización alternativa. (...) Para examinar el debate, el artículo presentará las principales características de ambas posiciones y sus fundamentos. Después, examinaremos los principales argumentos esgrimidos contra el doxasticismo y las respuestas y contraargumentos por parte de las alternativas doxásticas. Finalmente, expondremos algunas cuestiones conceptuales y desafíos abiertos relacionados con el debate y que, a nuestro juicio, deberían de marcar la hoja de ruta de los filósofos de la mente interesados en los delirios en los próximos años. The concept of mental privacy can be defined as the principle that subjects should have control over the access to their own neural data and to the information about the mental processes and states that can be obtained by analyzing it. Our aim is to contribute to the current debate on mental privacy by identifying the main positions, articulating key assumptions and addressing central arguments. First, we map the different positions found in current literature. We distinguish between those who dismiss (...) concerns about mental privacy and those who endorse them. In this latter group, we establish a further disagreement between conservative and liberal strategies to protect mental privacy. Then, we address the first discussion by articulating and criticizing different skeptical views on mental privacy. Finally, we try to identify what are the unique features of neural data and examine how they may be connected to the ways in which neurotechnological mindreading could put mental privacy at risk. We suggest that even if neural data is unique, it may not require new strategies to protect people from its misuse. However, identifying the special features and risks of neurotechnological mind-reading is necessary for the second discussion on mental privacy to properly take off. (shrink)

Children and adolescents are not indifferent to the dramatic impact of the COVID-19 pandemic, and the need to be forced to live in confinement. The change in life to which they have been abruptly subjected forces us to understand the state of their mental health in order to adequately address both their present and future needs. The present study was carried out with the intention of studying the consequences of confinement on anxiety, sleep routines and executive functioning of 1,028 children (...) and adolescents, aged from 6 to 18 years, residing in Spain to; assess if there are differences regarding these consequences in terms of sex and age; how anxiety affects executive functioning in males and females; and to examine the possible correlations between the measured variables. For this purpose, an online questionnaire containing five sections was designed: the first section gathers information on sociodemographic and health data, while the following sections gather information from different standardized scales which measure anxiety, sleep and executive functions, whose items were adapted in order to be completed by parents, and/or legal guardians. The statistical analyzes carried out highlights significant differences in executive functioning between males and females. In turn, in regards to age, greater difficulties were detected in anxiety in the 9 to 12 age group and greater sleep disturbances between 13 and 18 year olds. On the other hand, significant differences were found in intra-sexual executive functioning depending on whether they presented greater or lesser anxiety, with executive functioning being more tendentiously maladjusted in males than in females, revealing a significantly relevant effect size. Positive correlations are obtained between state anxiety and sleep and executive functioning alterations. Finally, through Path Analysis, it is verified that state anxiety is the variable with the greatest weight within the model that would explain the alteration in the executive functioning of the present sample. Abstract:: This essay addresses the notion of public order from the point of view of biopolitics. With that aim, it relates the authoritarian response to social protest with the moral ordering of public space, using the case of the 15-M movement in Spain. Then, it reads the notion of public order as a dispositive, in the Foucauldian sense of the term. Departing from there, it presents a brief genealogical approach to the relations among sexual and racial ordering o public space. (...) Finally, in dialogue with Sarah Ahmed and Mary Douglas, it explores the role of the biopolitics of public order in the constitution and policing of the moral and physical, internal and external borders separating the political community from its various others. Los fenómenos que suelen asociarse con los sistemas complejos, como la emergencia o la autorregulación, parecen estar envueltos en cierta oscuridad. En primer lugar, las definiciones ofrecidas tienden a ser demasiado generales e inclusivas. En segundo lugar, no se suele aclarar el estatuto de este tipo de fenómenos: si son enteramente debidos al sujeto, o si poseen partes esenciales no reducibles a ningún otro fenómeno. El presente artículo analiza, desde el punto de vista de los sistemas complejos, las nociones de (...) emergencia y autorregulación. Se discuten los principales problemas que estas presentan y se perfilan algunas soluciones que podrían usarse de cara a elaborar una ontología de los sistemas complejos. Haciendo uso de estas soluciones, se proponen algunas definiciones de los principales fenómenos que componen un sistema complejo para, finalmente, ofrecer una definición de este tipo de sistema. Estas definiciones y soluciones se elaboran mediante el uso de herramientas filosóficas tales como la mereología o la teoría de la fundamentación. (shrink)

El artículo es uno de los resultados de la tesis denominada: El derecho administrativo desde el nuevo contexto constitucional a partir del cine colombiano: Dos mujeres y una vaca y El abrazo de la serpiente, realizada como trabajo final para la Maestría en Derecho Administrativo de la Universidad Autónoma Latinoamericana. En el artículo Cine y Derecho se plantean como dos producciones culturales de honda trascendencia en las sociedades actuales y, particularmente el cine aborda nuevas miradas sobre diversos fenómenos sociales, políticos (...) y jurídicos, que le permite evidenciar matices, lecturas y puntos de vista. Por esto el artículo tiene como objetivo repensar el Derecho Administrativo utilizando el análisis fílmico como herramienta para descifrar las conexiones entre cine y ésta disciplina jurídica. Para ello se analizan dos películas en función de visibilizar sus conexiones con el Derecho Administrativo. En Dos mujeres y una vaca se evidencia que la película constituye una interpelación desde el séptimo arte a una sociedad que no se reconoce en la memoria de la guerra que ha padecido y a un Estado que no garantiza eficazmente las seguridades vitales, derechos y propiedades de los ciudadanos. En el caso El abrazo de la serpiente la película constituye un llamado para que el Estado fomente una visión más amplia y holística de la naturaleza que reconozca la integralidad y codependencia de todos los elementos naturales en el ecosistema. Ambas películas hacen un llamado al Estado que supone generar un cambio de paradigma, transformar profunda y fundamentalmente la administración pública, orientar la vocación de servicio público al bien común. Introduction: Loss of employment is an experience that is lived and interpreted differently depending on a series of individual variables, including the psychological resources available to the affected person, as well as their perception of their degree of employability. Losing one’s job can be one of the most painful and traumatic events a person has to withstand. Following a dismissal, the worker needs to overcome a period of emotional adaptation to the loss. But that period of grieving can also condition (...) the process of job search of the person, and be influenced by different variables, highlighting the age and work experience. The objective of this study is to analyze the relationship between intensity and type of affliction due to the loss of employment in older workers and their level of employability. Method: We carried out a descriptive, analytical, cross-sectional study. The sample consisted of 140 unemployed participants, from 19 to 65 years of age, users of job Orientation in the Public Employment Service of Andalusia (España). Of the total participants, 66 were unemployed and over 45 years of age. They all took the Labour Insertion Potential Assessment Test, and the Texas Inventory revised adapted to job loss Results: Significant differences are shown in the grieving process due to loss of employment between both groups, with the older unemployed living the process more intensely. In relation to the employability potential, differences are found between both groups in terms of availability, perceived difficulties and fears. Interrelationships between total grieving intensity and the importance that older jobseekers give to work are also indicated. Conclusion:Loss of employment and the psychological and health consequences of this situation are identified with those that arise in the grieving process. Older workers present a series of features that determine that their job loss grieving process is more intense and lasts longer than that of other younger workers, regardless of whether the job loss was recent or not. On the other hand, it is shown that the intensity of grieving is related to the decrease of certain variables that are part of the concept of employability. (shrink)

Este artículo pretende realizar un análisis semiótico del rito dancístico del pascol, el cual se distingue por ser una de las prácticas culturales más importantes de los indígenas rarámuri que radican en la región de barrancas de la sierra occidental del noroeste de México. A través del análisis de la semiosis de este rito dancístico intentaremos mostrar cómo es el proceso de significación interpretativa que le otorgan los rarámuri para explicar su cosmovisión. Se tendrá como finalidad dar cuenta que esta (...) práctica cultural es un símbolo esencial del proceso de la asociación de signos cuya acción o influencia compone una parte sustantiva de la cosmovisión de este grupo étnico, que tiene entre sus principales funciones mantener algunos preceptos socioculturales para la estabilidad futura de las familias y la comunidad. We analyse the relationship between applicability and effectiveness of legal norms from a philosophical perspective. In particular, we distinguish between two concepts of applicability. The external applicability of norms refers to institutional duties; a norm N is externally applicable if and only if a judge is legally obliged to apply N to some case c. Internal applicability refers instead to the sphere of validity of legal norms. A norm N is internally applicable to actions regulated by its sphere of validity. (...) We also explore the consequences of a thesis which maintains that applicability restricts the concept of effectiveness, so that only applicable norms can be considered effective. Our analysis illustrates that a proper reconstruction of the concept of applicability is of great importance not only for understanding the concept of effectiveness but also for providing insight into the nature of law.
