Informed consent is a key condition for prenatal screening programmes to reach their aim of promoting reproductive autonomy. Reaching this aim is currently being challenged with the introduction of non-invasive prenatal testing (NIPT) in first-trimester prenatal screening programmes: amongst others its procedural ease—it only requires a blood draw and reaches high levels of reliability—might hinder women’s understanding that they should make a personal, informed decision about screening. We offer arguments for a renewed recognition and use of informed consent compared to (...) informed choice, and for a focus on value-consistent choices and personalized informational preferences. We argue for a three-step counselling model in which three decision moments are distinguished and differently addressed: (1) professionals explore women’s values concerning whether and why they wish to know whether their baby has a genetic disorder; (2) women receive layered medical-technical information and are asked to make a decision about screening; (3) during post-test counselling, women are supported in decision-making about the continuation or termination of their pregnancy. This model might also be applicable in other fields of genetic (pre-test) counselling, where techniques for expanding genome analysis and burdensome test-outcomes challenge counselling of patients. In the debate surrounding the introduction of non-invasive prenatal testing in prenatal screening programmes, the concept of routinisation is often used to refer to concerns and potential negative consequences of the test. A literature analysis shows that routinisation has many different meanings, which can be distinguished in three major versions of the concept. Each of these versions comprises several inter-related fears and concerns regarding prenatal screening and particularly regarding NIPT in three areas: informed choice, freedom to choose and consequences for (...) people with a disability. Three of the strongest arguments raised under the flag of routinisation are assessed for their validity: the threat that NIPT poses to informed choice, the potential increase in uptake of first-trimester prenatal screening and its consequences for social pressure to participate in screening or terminate affected pregnancies, and the negative consequences for disabled people. These routinisation arguments lack empirical or normative ground. However, the results of this analysis do not imply that no attention should be paid to possible problems surrounding the introduction of NIPT. At least two problems remain and should be addressed: there should be an ongoing debate about the requirements of informed choice, particularly related to an expanded scope of prenatal screening. Also, reproductive autonomy can only be achieved when expecting parents’ options are variegated, real and valuable, so that they can continue to choose whether or not to screen or to terminate a pregnancy. The introduction of non-invasive prenatal testing in healthcare systems around the world offers an opportunity to reconsider funding policies for prenatal screening. In some countries with universal access healthcare systems, pregnant women and their partners are asked to pay for NIPT. In this paper, we discuss two important rationales for charging women for NIPT: to prevent increased uptake of NIPT and to promote informed choice. First, given the aim of prenatal screening, high or low uptake rates are not intrinsically desirable (...) or undesirable. Using funding policies to negatively affect uptake, however, is at odds with the aim of screening. Furthermore, copayment disproportionally affects those of lower socioeconomic status, which conflicts with justice requirements and impedes equal access to prenatal screening. Second, we argue that although payment models may influence pregnant women’s choice behaviours and perceptions of the relevance of NIPT, the copayment requirement does not necessarily lead to better-informed choices. On the contrary, external influences on women’s personal choices for or against prenatal screening should ideally be avoided. To improve informed decision-making, healthcare systems should instead invest in adequate non-directive, value-focused pretest counselling. This paper concludes that requiring copayments for NIPT in universal access healthcare systems fails to promote reproductive autonomy and is unfair. (shrink)

Asking pregnant women to pay for non-invasive prenatal testing out of pocket leads to unequal access across socioeconomic strata. To avoid these social justice issues, first-trimester prenatal screening should be publicly funded in countries such as the Netherlands, with universal coverage healthcare systems that offer all other antenatal care services and screening programmes free of charge. In this reply, we offer three additional reasons for public funding of NIPT. First, NIPT may not primarily have medical utility for women and children, (...) but rather offers relevant information and reproductive options, and thus serves important autonomy interests of women. Second, public funding of NIPT can be justified because it results in a reduction of collectively borne costs associated with care and support for children with chromosomal abnormalities. It is important to note that this is not an argument for individual women to take part in screening or to terminate an affected pregnancy. However, it is a legitimate argument in policy making regarding funding arrangements for screening programmes. Finally, public funding would help to amend current misunderstandings among pregnant women, and thus to support informed consent for first-trimester prenatal screening. (shrink)

In this article I give a naturalistic-cum-formal analysis of therelation between beauty, empirical success, and truth. The analysis is based on the onehand on a hypothetical variant of the so-called `mere-exposure effect' which has been more orless established in experimental psychology regarding exposure-affect relationshipsin general and aesthetic appreciation in particular (Zajonc 1968; Temme 1983; Bornstein 1989;Ye 2000). On the other hand it is based on the formal theory of truthlikeness andtruth approximation as presented in my From Instrumentalism to Constructive Realism (...) (2000).The analysis supports the findings of James McAllister in his beautifulBeauty and Revolution in Science (1996), by explaining and justifying them.First, scientists are essentially right in regarding aesthetic criteria useful for empiricalprogress and even for truth approximation, provided they conceive of them as less hard thanempirical criteria. Second, the aesthetic criteria of the time, the `aesthetic canon', maywell be based on `aesthetic induction' regarding nonempirical features of paradigms of successfultheories which scientists have come to appreciate as beautiful. Third, aestheticcriteria can play a crucial, schismatic role in scientific revolutions. Since they may well be wrong, they may, in the hands of aesthetic conservatives, retard empirical progress and hence truth approximation, but this does not happen in the hands of aesthetically flexible, `revolutionary' scientists.We may find totallyopposite things beautiful: a simplemathematical principle as well as a series of unrepeatable complex contingencies. Over the past three or four decades, the concept of medical ethics has changed from a limited set of standards to a broad field of debate and research. We define medical ethics as an arena of moral issues in medicine, rather than a specific discipline. This paper examines how the disciplines of health care ethics and health care law have developed and operated within this arena. Our framework highlights the aspects of jurisdiction and the assignment of responsibilities . This theoretical (...) framework prompted us to study definitions and changing responsibilities in order to describe the development and interaction of health care ethics and health law. We have opted for the context of the Dutch debate about end-of-life decisions as a relevant case study. We argue that the specific Dutch definition of euthanasia as ‘intentionally taking the life of another person by a physician, upon that person’s request’ can be seen as the result of the complex jurisdictional process. This illustrates the more general conclusion that the Dutch debate on end-of-life decisions and the development of the two disciplines must be understood in terms of mutual interaction. (shrink)

In this article, caring, remembering and sharing memory are presented as moral responses, the case study being Alzheimer’s disease (AD). Memory connects memories and images, while care connects individuals, which is an ethical issue. When a person’s memory is lost, the care of others becomes the only thread connecting them to the world. AD deprives a person of memories, body control, makes it impossible to remember, communicate, move, recognize the environment, and disrupts consciousness. Caring for a patient with a neurodegenerative (...) brain disease requires constant reminding and reiteration; the presence of a caring person reminds of what the patient themselves can no longer remember. Lost memories do not mean that life or relational values have also lost their meaning. The description of the memory movement emphasizes the importance of repetition in the moral act. Highlighting the matter of care, also in scientific work, is the aim of this text. To care is to remember, on behalf of the AD patient, about the patient’s life. Within bioethical research, moral responses are an important point for projects which seek to improve the condition of patients—not only the condition of health but also the comfort of life. This improvement will not be possible without attentive, committed caregivers and their responsible attitude in the face of the phenomenon of memory loss. (shrink)

In his unpublished 1979 Lectures on the Philosophy of Mind, Saul Kripke offers a knowledge argument against materialism focusing on deaf people who lack knowledge of auditory experience. Kripke's argument is a precursor of Frank Jackson's better‐known knowledge argument against materialism (1982). The paper sets out Kripke's argument, brings out its interest and philosophical importance, and explores some similarities and differences between Kripke's knowledge argument and Jackson's.

Polyphony of Anxiety. The Interview with Stefano Micali about His Book Phenomenology of Anxiety.

Three related intuitions are explicated in this paper. The first is the idea that there must be some kind of probabilistic version of the HD-method, a 'Hypothetico-Probabilistic method', in terms of something like probabilistic consequences, instead of deductive consequences. According to the second intuition, the comparative application of this method should also be functional for some probabilistic kind of empirical progress, and according to the third intuition this should be functional for something like probabilistic truth approximation. In all three cases, (...) the guiding idea is to explicate these intuitions by explicating the crucial notions as appropriate 'concretizations' of their deductive analogs, being 'idealizations'. It turns out that the comparative version of the proposed HP-method amounts to the likelihood comparison method applied to the cumulated evidence. This method turns out to be not only functional for probabilistic empirical progress but also for probabilistic truth approximation. The latter is based on a probabilistic threshold theorem constituting for this reason the analog of the deductive success theorem. (shrink)

This essay answers two questions that continue to drive debate in moral and legal philosophy; namely, ‘Is a risk of harm a wrong?’ and ‘Is a risk of harm a harm?’. The essay’s central claim is that to risk harm can be both to wrong and to harm. This stands in contrast to the respective positions of Heidi Hurd and Stephen Perry, whose views represent prominent extremes in this debate about risks. The essay shows that there is at least one (...) category of risks – intentional impositions of risk on unconsenting agents – which can be both wrongful and harmful. The wrongfulness of these risks can be established when, on the balance of reasons, one ought not to impose them. The harmfulness of these risks can be established when the risks are shown to set back legitimate interests. In those cases where risks constitute a denial of the moral status of agents, risks set back agents’ interest in dignity. In these ways, the essay shows that there are instances when a risk can constitute both a wrong and a harm. (shrink)

Relating Narratives is a major new work by the philosopher and feminist thinker Adriana Cavarero. First published in Italian to widespread acclaim, Relating Narratives is a fascinating and challenging new account of the relationship between selfhood and narration. Drawing a diverse array of thinkers from both the philosophical and the literary tradition, from Sophocles and Homer to Hannah Arendt, Karen Blixen, Walter Benjamin and Borges, Adriana Cadarero's theory of the `narratable self' shows how narrative models in philosophy and (...) literature can open new ways of thinking about formation of human identities. By showing how each human being has a unique story that can be told about them, Adriana Cavarero inaugurates an important shift in thinking about subjectivity and identity which relies not upon categorical or discursive norms, but rather seeks to account for `who' each one of us uniquely is. In disagreement with Claudia Baracchi’s controversial thesis that there is a “simultaneity and indissolubility” if not an “identity” of intelligence (nous) and perception (aisthēsis) at the core of Aristotle’s philosophy, I will argue that Aristotle maintains a fundamental distinction between these cognitive faculties. My goal in this paper is to examine specific parts of two central and complex passages, VI.8, 1142a12-30 and VI.11, 1143a33-b15, from the Nicomachean Ethics to show that Baracchi’s view is unpersuasive. I will show that Aristotle considers (...) nous to be a different capacity than mere perception and one through which particulars and indemonstrable principles become intelligible. Moreover, I will show that Aristotle considers that the objects of nous differ in kind from those that sensation (our senses) and perception (inference from our senses) grasp. After examining critically Baracchi’s thesis in light of a close reading of those two relevant passages, I will conclude the paper by showing the significance of Aristotle’s claim that a state is defined in terms of its objects of apprehension for understanding the distinction between nous and aisthēsis. This article discusses three major dilemmas embedded in women's labor migration by focusing on undocumented Latina migrants in Israel. The first is that to break the cycle of blocked mobility in their homelands, migrant women must take jobs that they would have never taken in their countries of origin, despite uncertainty about possible economic outcomes. The second dilemma is that the search for economic betterment leads Latina migrants to risk living and working illegally in the host country, forcing them to (...) remain on the margins of society. The third dilemma relates to the role of mothers who, to secure a better future for their children, are forced to leave them behind, thus subverting the traditional definition of motherhood. The absence of an egalitarian notion and the practice of citizenship for non-Jews leave undocumented labor migrants in Israel without prospects for incorporation into the society. (shrink)

This essay focuses on anthropomorphism as both a form of hype and fallacy. As a form of hype, anthropomorphism is shown to exaggerate AI capabilities and performance by attributing human-like traits to systems that do not possess them. As a fallacy, anthropomorphism is shown to distort moral judgments about AI, such as those concerning its moral character and status, as well as judgments of responsibility and trust. By focusing on these two dimensions of anthropomorphism in AI, the essay highlights negative (...) ethical consequences of the phenomenon in this field. (shrink)

While firms' engagement with Corporate Social Responsibility has been associated with positive performance impacts, little is known about the incorporation of the United Nations 2030 Agenda into business practices. Precisely, although the literature suggests that firms are pursuing the Sustainable Development Goals (SDGs), there are limited insights on their strategy to implement them in the context of developing countries. To address this gap, we conducted a comprehensive large-scale investigation of 2030 Agenda adoption by Brazilian companies. Accordingly, the analysis of our (...) multicase study reveals (1) variations on the business opportunities brought by the SDGs depending on the firm position in the value chain, (2) which SDGs and target stakeholders are addressed through corporate policies and practices, (3) the different ways firms embrace the SDGs to pursue ambidexterity. Our findings clarify how firms in the developing countries interpret the institutional pressures and assemble their internal resources to respond to the SDGs challenges. Boundary conditions and policy implications are further discussed. (shrink)

The text presents a short account of the history of the philosophically relevant key concepts of feminist theory – sex and gender. Those concepts were crucial in the process of the constitution of gender studies as well as for the manouvering of feminist practice. On the other hand, however, as Judith Butler demonstrates exceptionally, these concepts are also the points of a fruitful debate, opening the possibility for resignification, different ways of thinking about the fundamental assumptions of feminist theory. While (...) it leaves feminist theory devoid of a firm,fixed position, ensuing instability, it offers a specific, subversive potential for a theory in general, while expanding the domains of inclusiveness in practice. Tekst nastoji ponuditi drugačiju paradigmu razumijevanja identiteta genealoškim čitanjem figure guvernante u Engleskoj XIX. stoljeća. Pokazujući da je ovu figuru nemoguće razumjeti ukoliko se uklone iz vida klasne pretpostavke njenog rodnog identiteta, i specifične pozicije koju je zauzimala na tržištu rada i u proizvodnji drugih žena, tekst nastoji dovesti u pitanje kontekst patrijarhata kao kontekst koji omogućava definiranje identiteta žene. Umjesto tog okvira, tekst pokušava uvesti drugačiji okvir koji se razrađuje kao sustav privatnog i javnog.

This short contribution is written on the occasion of the book discussion of Sophie Loidolt’s Phenomenology of Plurality: Hannah Arendt on Political Intersubjectivity at the Institute for Philosophy and Social Theory. It presents an attempt to read the two key notions Loidolt elaborates in her book – spaces of meaning and spaces of the public and private – from a critical perspective offered by Judith Butler’s taking up of Arendt’s work. Offering Butler’s conception of social ontology through several major points (...) of contestation with Arendt, I argue against an all too simple reduction of her understanding of the political and normativity to poststructuralist ones. The human voice does not deceive. The one who is speaking is inevitably revealed by the singular sound of her voice, no matter “what” she says. We take this fact for granted—for example, every time someone asks, over the telephone, “Who is speaking?” and receives as a reply the familiar utterance, “It’s me.” Starting from the given uniqueness of every voice, Cavarero rereads the history of philosophy through its peculiar evasion of this embodied uniqueness. She shows how this history—along with (...) the fields it comprehends, such as linguistics, musicology, political theory, and studies in orality—might be grasped as the “devocalization of Logos,” as the invariable privileging of semantike over phone, mind over body. Female figures—from the Sirens to the Muses, from Echo to opera singers—provide a crucial counterhistory, one in which the embodied voice triumphs over the immaterial semantic. Reconstructing this counterhistory, Cavarero proposes a “politics of the voice” wherein the ancient bond between Logos and politics is reconfigured, and wherein what matters is not the communicative content of a given discourse, but rather who is speaking. La construcción sociocultural de la promesa, como el primer vínculo de amor, produce acuerdos sucesivos, que se desarrollan en la reciprocidad del compromiso; lo prometido y lo concreto que se percibe socialmente, a través de las negociaciones, entre momentos de disputa y de afecto, entre la confianza y la responsabilidad, que convocan discernimientos éticos. Francisco Munguía Villalta (1976-2020) fue un talentoso, prolijo y multifacético artista costarricense. Produjo una obra vastísima, en distintos formatos y técnicas. Creía en el poder transformador del arte y en consecuencia produjo una obra socialmente comprometida y guiada por la convicción de que el arte debía ser accesible, integrador, participativo y didáctico. Desarrolló un lenguaje plástico anclado en su vocación de humorista gráfico, y ello junto a su afición por el voluntariado y el trabajo comunitario, le permitieron establecer nexos comunicativos (...) de extraordinaria familiaridad con la gente. Su universo iconográfico de tira cómica y su narrativa llena de parodia y sátira, transitaba entre calcomanías, cerámicas y pinturas. Sus obras murales lograron no solo cambiar el paisaje urbano, sino además reafirmar el sentido de comunidad, pues su metodología participativa aspiraba a restituir el poder de personas y colectivos para adueñarse de sus propios espacios públicos. Sin ahondar en una revisión cronológica del recorrido del artista, ni en un análisis lógico de su amplia producción, este documento comparte una mirada general a aspectos que se consideran emblemáticos de la obra de Munguía Villalta; se rinde homenaje a su memoria y se celebra la vitalidad del extraordinario legado plástico que nos dejó.
