Some biologists now argue in favour of a pluralistic approach to plant activities, understandable both from the classical perspective of physiological mechanisms and that of the biology of behaviour involving choices and decisions in relation to the environment. However, some do not hesitate to go further, such as plant “neurobiologists” or philosophers who today defend an intelligence, a mind or even a plant consciousness in a renewed perspective of these terms. To what extent can we then adhere to pluralism in (...) the study of plant behaviour? How does this pluralism in the study and explanation of plant behaviour fit into, or even build itself up, in a broader history of science? Is it a revolutionary way of rethinking plant behaviour in the twenty-first century or is it an epistemological extension of an older attitude? By proposing a synthesis of the question of plant behaviour by selected elements of the history of botany, the objective is to show that the current plant biology is not unified on the question of behaviour, but that its different tendencies are in fact part of a long botanical tradition with contrasting postures. Two axes that are in fact historically linked will serve as a common thread. 1. Are there several ways of understanding or conceiving plant behaviour within plant sciences and their epistemology? 2. Can the behaviour of a plant be considered in the same way as that of an animal? The working hypothesis defended in this article consists in showing that the current opposition between growth, development and reductionist physiology on the one hand and the biology of behaviour involving sensitivity and choices in plant activity on the other hand has been built up through the history of botany. This paper elucidates the philosophical origins of the conception of plants as machines and analyses the contemporary technical and ethical consequences of that thinking. First, we explain the historical relationship between the explicit animal machine thesis of Descartes and the implicit plant machine thesis of today. Our hypothesis is that, although it is rarely discussed, the plant machine thesis remains influential. We define the philosophical criteria for both a moderate and radical interpretation of the thesis. Then, assessing the compatibility of (...) current botanical knowledge with both interpretations, we find that neither withstands scrutiny. We trace how biological and agricultural sciences have historically relied upon thinking of plants as machines and how they continue to do so today through rhetoric centred on breeding, biotechnology, and production. We discuss some of the most important legal and ethical consequences of obscuring the vitality of plants. Finally, we explore less reductive and destructive ways of thinking about, and using, plants. Many activities towards plants are directly related to environmental crisis issues. However, our actions towards plants are little theorized in philosophy and ethics. After a brief presentation of the history, state of the art, and current issues of plant ethics, I critically illustrate how the theoretical threads of current ethics should be clarified, and, more importantly, contextualised, to promote the application of concrete measures. Particular attention is paid to the ethics of plant flourishing as applied to different fields and types (...) of plants. The treatment of wild and ornamental plants is, thus, explicitly distinguished from that of improved agricultural varieties, themselves distinguishable according to modes of cultivation. I thus propose and discuss several recommendations and concrete courses of action to promote an ethics of plants, while pointing out its limitations. (shrink)

Il s’agira de montrer pourquoi et comment la place que tient la vegetation joue un role mediateur fondamental en tant que principe de premiere importance, y compris et surtout ici pour la vie humaine decrite par Watsuji. Ce faisant, l’objectif est double. D’une part, montrer, a la suite d’Augustin Berque, la coherence de la visee mesologique initiale de l’auteur (...) en donnant un fondement theorique a ses exemples vegetaux. D’autre part, se recentrer sur le role mesologique de la vegetation permet de relativiser la place du climat et donc du determinisme environnemental souvent surevalues dans beaucoup de traductions et commentaires de Fūdo. Why is American punishment so cruel? While in continental Europe great efforts are made to guarantee that prisoners are treated humanely, in America sentences have gotten longer and rehabilitation programs have fallen by the wayside. Western Europe attempts to prepare its criminals for life after prison, whereas many American prisons today leave their inhabitants reduced and debased. In the last quarter of a century, Europe has worked to ensure that the baser human inclination toward vengeance is not reflected by state (...) policy, yet America has shown a systemic drive toward ever increasing levels of harshness in its criminal policies. Why is America so short on mercy? In this deeply researched, comparative work, James Q. Whitman reaches back to the 17th and 18th centuries to trace how and why American and European practices came to diverge. Eschewing the usual historical imprisonment narratives, Whitman focuses instead on intriguing differences in the development of punishment in the age of Western democracy. European traditions of social hierarchy and state power, so consciously rejected by the American colonies, nevertheless supported a more merciful and dignified treatment of offenders. The hierarchical class system on the continent kept alive a tradition of less-degrading "high-status" punishments that eventually became applied across the board in Europe. The distinctly American, draconian regime, on the other hand, grows, Whitman argues, out of America's longstanding distrust of state power and its peculiar, broad-brush sense of egalitarianism. Low-status punishments were evenly meted out to all offenders, regardless of class or standing. America's unrelentingly harsh treatment of trangressors--this "equal opportunity degradation"-- is, in a very real sense, the dark side of the nation's much vaunted individualism. With respect to Confucius, Hu Shi believed that the critical attitude engendered in the May Fourth era had brought Confucius down from a high pedestal and put him on a par with the contemporaries of his time. Hu Shi's main assessment of Confucius (...) as an ancient philosopher was shown in his doctoral dissertation and the later published A History of Ancient Chinese Philosophy, both appeared in the May Fourth era. Examining turning points in historical thought in a variety of cultures, the essay here deal with reorientations in historical thinking in the pre-modern period since Antiquity, mainly in ancient Greece and China and in medieval Christian Europe.

In this study, we examine the nature of the relationship between ethical leadership and unethical pro-organizational behavior (UPB), defined as unethical behavior conducted by employees with the aim of benefiting their organization, and whether the strength of the relationship differs between subordinates experiencing high and low identification with supervisor. Based on three-wave survey data obtained from 239 public sector employees in China, we find that ethical leadership has an inverted u-shaped (curvilinear) relationship with UPB. As the level of ethical leadership (...) increases from low to moderate, UPB increases; as the level of ethical leadership increases from moderate to high, UPB decreases. Further, we find that the strength of this inverted u-curve relationship differs between subordinates with high and low identification with supervisor. That is to say, the inverted u-shaped relationship between ethical leadership and UPB was stronger when subordinates experienced high levels of identification with supervisor. The theoretical and managerial implications of our findings for understanding how to manage UPB in an organizational context are discussed. (shrink)

Transformations in the biological, medical and legal processes of infertility, substantial modifications in family structure and the advancement of methods and techniques of reproductive technology will affect the next step in both legal and medical terms to address the regulation of bioethics and law in Kosovo. There is a need to establish perspectives in both ethical and professional terms, since the Republic of Kosovo is in the process of drafting a Civil Code. Many of these issues have been raised and (...) addressed during the review and evaluation of family law in the context of harmonisation and inclusion of this law in the Civil Code of the Republic of Kosovo. During the several meetings of official members with different interest groups regarding family law, the need has been raised to regulate family law to be included in the Civil Code for motherhood and fatherhood in the case of reproduction with biomedical assistance, as well as for the birth contract as a donation for another person (so-called surrogate motherhood). These bioethical and legal issues indicate the urgent need for legal harmonisation of a multidimensional platform specifically based on the principles of public health and universal human rights Conclusion.
