Oliver Sacks MD, Clinical Professor of Neurology at the Albert Einstein College of Medicine in New York, talked with Anthony Freeman during his visit to London in January 1995 to publicize his recently published book An Anthropologist on Mars. The interview is preceded by an overview of the book.

“Tell me," Wittgenstein once asked a friend, "why do people always say, it was natural for man to assume that the sun went round the earth rather than that the earth was rotating?" His friend replied, "Well, obviously because it just looks as though the Sun is going round the Earth." Wittgenstein replied, "Well, what would it have looked like if it had looked as though the Earth was rotating?” What would it have looked like if we looked at all (...) sciences from the viewpoint of Wittgenstein’s philosophy? Wittgenstein is undoubtedly one of the most influential philosophers of the twentieth century. His complex body of work has been analysed by numerous scholars, from mathematicians and physicists, to philosophers, linguists, and beyond. This volume brings together some of his central perspectives as applied to the modern sciences and studies the influence they may have on the thought processes underlying science and on the world view it engenders. The contributions stem from leading scholars in philosophy, mathematics, physics, economics, psychology and human sciences; all of them have written in an accessible style that demands little specialist knowledge, whilst clearly portraying and discussing the deep issues at hand. Abstract:The purpose of this paper is to suggest that at least one strain of what has come to be called “stakeholder theory” has roots that are deeply libertarian. We begin by explicating both “stakeholder theory” and “libertarian arguments.” We show how there are libertarian arguments for both instrumental and normative stakeholder theory, and we construct a version of capitalism, called “stakeholder capitalism,” that builds on these libertarian ideas. We argue throughout that strong notions of “freedom” and “voluntary action” are the (...) best possible underpinnings for stakeholder theory, and in doing so, seek to return “stakeholder theory” to its managerial and libertarian roots found in Freeman (1984). Without the former, all outcomes would be arbitrary; without the latter, all outcomes would be predetermined. In neither case would there be any way of putting one's will into effect. So much is clear, yet establishing that precarious balance has proved so difficult that Kant himself declared ‘freedom of the will’ to be one of only three metaphysical problems which lie beyond (...) the powers of the human intellect . Western debate on this topic reflects a complex ethical and religious inheritance. Insights from Greek philosophy and Hebrew scripture were combined and filtered through Christian and Jewish traditions which developed in late antiquity and through the middle ages. What have ethics to do with consciousness? First, it is consciousness that makes morality possible. Second, neither subject fits comfortably into currently popular reductive schemes. As a consequence both have tended to be isolated in a ghetto, shut off from the rest of the intellectual scene. So believes Mary (...) This article explores the ethical concept of neutrality through use of a psychiatric clinical vignette. In this case a psychiatry resident is faced with the treatment of a patient who was found by the FBI to be in possession of child pornography. Although not accused of any other crimes, the patient was a fugitive from the law and requesting treatment for pedophilia. Faced with the pressures of limited resources and anxiety about the patient's dangerousness to others, the resident and his (...) supervisor tried to strike a balance between the ethical principles of neutrality and beneficence. Through this vignette, the importance of neutrality, as well as how it can be compromised by other pressures such as expediency and anxiety, is explored. (shrink)

Individuals are generally held to be morally and legally responsible only for actions carried out freely and deliberately, that is to say, for actions that result from our free choice. However, there is a quite widespread view that all of our actions are the result of the scientific laws that govern our physical bodies. If this should prove to be the case, then human choice would be an illusion, and therefore -- on the generally accepted principle just stated -- personal (...) responsibility would be a meaningless concept and blame and punishment would be inappropriate responses to wicked or criminal acts. In this paper I shall argue that we need to disentangle ‘responsibility’ from ‘choice'. I shall also outline reasons for holding that responsibility is ultimately a first-person matter -- I am responsible if I feel responsible, irrespective of choice -- and I shall briefly consider some of the consequences of this approach. Gay marriages (as such) are not as yet allowed anywhere but the demand for them is increasing. Most countries take a liberal attitude towards marriage: few obstacles are put in its way. But objections to gay marriages continue to be raised. These objections are refuted and the case for gay marriage is assessed through the prism of various forms of liberalism. The normative argument for allowing gay marriage is shown to be both strong and consistent with many of the values (...) upheld by the opponents of such unions. (shrink)

Inequality in the family is the most damaging of all forces in women’s lives. It is overtly preserved by religious, customary, and state laws that formally enshrine discrimination against women and is perpetuated by de facto lack of access to nominally protective systems and remedies. International law and its implementation mechanisms provide an arena for confronting resistance to gender equality in the family, calling states to account at the highest level as well as providing a platform for domestic advocacy. CEDAW (...) and the jurisprudence of its monitoring body, the Committee on the Elimination of Discrimination against Women, clearly state the paramount value of protecting the individual human rights of family members rather than maintaining family “protection” and privacy at the expense of the women within it. By ratifying, States theoretically commit themselves to this progressive position. However, the politics of state and community identity make for a more complex picture that includes multiple, sometimes overlapping, levels of acceptance and rejection. Taking as a case study the current initiative to adopt a new General Recommendation to address the economic consequences of family relations and their dissolution, this Article draws on the CEDAW Convention and the CEDAW Committee’s work to suggest a practical application of international standards to address the tangle of legal systems and identity that have disadvantaged women for centuries. Placing this initiative within the context of multiple family law regimes and the multicultural debate, the right to exit and the concept of freedom to associate and to disassociate are emphasized as crucial in confronting the phenomenon of discriminatory identitybased family legal regimes. The Article concludes with an illustration of the harmonization process required by the CEDAW Convention, taking the new General Recommendation as a model approach for meeting the international equality norms while preserving community or State identity. I do not approach the question of free will as a scientist, like Colin Blakemore, or a lawyer, like David Hodgson, or philosopher, like Daniel Dennett, but as a priest -- someone who feels responsible for my own actions and who is called upon to counsel and absolve such as come to me with their shame and their guilt. Should I say that their sense of responsibility is illusory? Or should I encourage them to accept responsibility, and then to deal (...) with it in the various ways -- religious, psychological and practical -- that are open to them? (shrink)
