Uncommitted to work in primary sources, he was perhaps not at the level of Perry Miller, Vann Woodward, and Edmund Morgan. But Hofstadter had (...) a greater range and wider influence than these men, and the combination of intellectual and political history that he wrote was unique, as was the penetration of his intellect and his appealing sensibility.Hofstadter was born in Buffalo, New York, the son of a Lutheran mother and a father who was a secular Jew. The son went to the local University of Buffalo. While not as impoverished as this biography is inclined to make him, Dick Hofstadter "married up" after he fell in love with Felice Swados, the daughter of a Buffalo Jewish doctor who was also a student at the University. Swados introduced Hofstadter to the Marxist intellectual left of the 1930s, although he was himself a successful and intelligent student leader. In the years after their graduation, the couple had a tempestuous start to their marriage, but over the next several years they built a life in New York City. Felice became the medical columnist for Time; Dick productively completed a doctoral degree in history at Columbia University. They both continued their radical activities. In the late 1930s he was briefly a member of the American Communist Party, although Dick quickly resigned because of the authoritarian nature of the organization. Even then, however, he was more removed and skeptical than Felice, with more of an historian's impartiality and sense of the tragic. Felice's unambiguous commitments moved him, but Dick was, literally, only half-inclined to the Jewish left.Swados died of cancer in 1945, after they had moved to Washington, D.C., where Hofstadter was teaching at the University of Maryland. But a year later the devastated young man obtained a position at Columbia. At the same time he met and married Beatrice Kevitt, another capable woman with literary and editorial talent.In 1948 Hofstadter published what I still think is his masterwork, The American Political Tradition. A series of sharp portraits of leading politicians, [End Page 574] the book owed much to Hofstadter's leftist background. It was indebted to Marxist analyses, or at least to those of the sort promulgated by the great historian, Charles Beard, who saw economics as central to the study of national life. But Hofstadter did not see a clash between capitalists and their opponents in the United States. He viewed the entire tradition of American politicians as committed to a certain kind of exploitative social system, although his book did not quite have the edge suggested by this last phrase. Hofstadter became known as a "consensus" historian who had a monolithic sense of the American experience, although this monolith was not benign as was that of other practitioners of consensus.In the 1950s Hofstadter, now a prominent Columbia faculty member, moved away from some of the economic preconceptions of The American Political Tradition. Instead, in his two other important books, The Age of Reform (1955) and The Paranoid Style in American Politics (1965), he brought to bear on the American experience a group of concepts that he took from his study of the social sciences. Overall, these two books undermined his previous materialist interpretation of politics. Instead, Hofstadter found that irrational fears, psychological maladjustments, and concerns about status might motivate leaders and movements more than a rational appraisal of self-interest. In retrospect, this 1950s social science does not appear very enlightening, and so Hofstadter's absorption of it is not to be praised. On the other side, so many of his fellow historians attacked him for his interdisciplinary bent that his generous outreach looks more than daring. Hofstadter's own personal politics shifted, too. In the language of Antitrust, commercial bribery is a form of vertical arrangement subject to the same efficiency analysis that has found other vertical arrangements potentially beneficial to consumers. My analysis shows that actions condemned as commerical bribery in the Honda case may well have benefited Honda's dealer network once promotional free riding and other forms of rent seeking by dealers are considered. I propose that the (...) term "commercial bribery" should be avoided until after an ISCT analysis shows that the community is likely to have been harmed. We seek to change the conversation about brain death by highlighting the distinction between brain death as a biological concept versus brain death as a legal status. The fact that brain death does not cohere with any biologically plausible definition of death has been known for decades. Nevertheless, this fact has not threatened the acceptance of brain death as a legal status that permits individuals to be treated as if they are dead. The similarities between “legally dead” and “legally blind” (...) demonstrate how we may legitimately choose bright-line legal definitions that do not cohere with biological reality. Not only does this distinction bring conceptual coherence to the conversation about brain death, but it has practical implications as well. Once brain death is recognized as a social construction not grounded in biological reality, we create the possibility of changing the social construction in ways that may better serve both organ donors and recipients alike. Controversies about the diagnosis and meaning of brain death have existed as long as the concept itself. Here we review the historical development of brain death, and then evaluate the various attempts to justify the claim that patients who are diagnosed as brain dead can be considered dead for all legal and social purposes, and especially with regard to procuring their vital organs for transplantation. While we agree with most commentators that death should be defined as the loss of integration (...) of the functioning of the organism as a whole, we conclude that patients diagnosed as brain dead have not, in fact, lost this integrated functioning. We close with reflections on the implications of this conclusion generally and particularly with regard to organ transplantation, and briefly make reference to alternative approaches to justifying the procurement of transplantable organs that do not depend upon a flawed approach to the diagnosis of death. First, the current methodology involving SRI fund divestiture of the securities of firms that engage in socially irresponsible activity often results in unacceptable unintended consequences. Second, in many cases the proper methodology for SRI funds may be purposely to include the securities of such firms in the portfolio in an effort to internalize socially irresponsible interfirm spillovers. This issue considers the ethics of a healthcare provider intervening into a patient’s genitalia, whether by means of cutting or surgery or by ‘mere’ touching/examination. Authors argue that the permissibility of such actions in the absence of a relevant medical emergency does not primarily turn on third-party judgments of expected levels of physical harm versus benefit, or on related notions such as extensiveness or invasiveness; rather, it turns on the patient’s own consent. To bolster this argument, attention is drawn to (...) the status of the genitals as ‘intimate’ anatomy—a status that is not fully erased by being in a medical context. In this editorial, we draw on the work of Talia Mae Bettcher on ‘intimate agency’ to explore why unconsented interventions into the genitalia may constitute a distinctive sort of personal violation compared to unconsented contact with various other parts of the human body. In their feature article, Marit van der Pijl and colleagues1 argue it is unethical for healthcare providers to perform unconsented episiotomies on persons in labour. In particular, they suggest that, outside of certain rare emergencies in which, for example, the person giving birth is incapacitated1 and the procedure cannot be delayed until consent becomes possible without introducing a significant risk of serious harm (call these ‘medically necessary’2 procedures), ‘presumed consent’ is the incorrect standard to apply. Instead, they stress that, especially when a proposed intervention involves a person’s genital, sexual or reproductive organs, the need to obtain their explicit consent in advance of proceeding must be honoured. As the authors note, the broader social significance of our genitalia—widely regarded as ‘private’ anatomy—is not erased by being in a medical context (see also 2–4). Although informed consent is important in clinical research, questions persist regarding when it is necessary, what it requires, and how it should be obtained. The standard view in research ethics is that the function of informed consent is to respect individual autonomy. However, consent processes are multidimensional and serve other ethical functions as well. These functions deserve particular attention when barriers to consent exist. We argue that consent serves seven ethically important and conceptually distinct functions. The first four functions pertain (...) principally to individual participants: (1) providing transparency; (2) allowing control and authorization; (3) promoting concordance with participants' values; and (4) protecting and promoting welfare interests. Three other functions are systemic or policy focused: (5) promoting trust; (6) satisfying regulatory requirements; and (7) promoting integrity in research. Reframing consent around these functions can guide approaches to consent that are context sensitive and that maximize achievable goals. (shrink)

: This paper presents a method of moral problem solving in clinical practice that is inspired by the philosophy of John Dewey. This method, called "clinical pragmatism," integrates clinical and ethical decision making. Clinical pragmatism focuses on the interpersonal processes of assessment and consensus formation as well as the ethical analysis of relevant moral considerations. The steps in this method are delineated and then illustrated through a detailed case study. Miller** (bio) and Robert D. Truog (bio)Traditionally the cessation of breathing and heart beat has marked the passage from life to death. Shortly after death was determined, the body became a cold corpse, suitable for burial or cremation. Two technological changes (...) in the second half of the twentieth century prompted calls for a new, or at least expanded, definition of death: the development of intensive care medicine, especially the use of mechanical ventilators, and the advent of successful transplantation of vital organs. Patients with profound neurological damage, leaving them incapable of breathing on their own and in an irreversible coma, could be maintained for some period of time with the aid of mechanical ventilation. The situation of these patients posed two ethical questions. Is it appropriate to stop life-sustaining treatment? If so, is it acceptable to retrieve vital organs for transplantation to save the lives of others before stopping treatment?In 1968, the Ad Hoc Committee of the Harvard Medical School to Examine the Definition of Brain Death proposed that death could be determined on the basis of neurological criteria, thus providing a positive answer to these two questions (Ad Hoc Committee 1968). According to the position of this committee, patients diagnosed with the cessation of brain function are dead, despite the fact that they breathe and circulate blood with the aid of mechanical ventilation. [End Page 185] Because they are dead, it is appropriate, indeed imperative, to stop mechanical ventilation. And because they are dead, it becomes ethical to procure vital organs for transplantation before stopping what otherwise would be life-sustaining treatment. Remarkably, this innovative neurological determination of death became, with little debate or controversy, the established position in medical ethics and the law throughout the United States.The Harvard Committee articulated the diagnosis of “irreversible coma,” but merely asserted that this condition constituted death. No explanatory rationale was provided. It fell to the President’s Commission for the Study of Ethical Problems in Medicine and Biomedical and Behavioral Research to provide an authoritative rationale in its 1981 report, Defining Death. The second paragraph of the report set the stage as follows: “The question addressed here is not inherently difficult or complicated. Simply, it is whether the law ought to recognize new means for establishing that the death of a human being has occurred” (President’s Commission 1981, p. 3). The Commission claimed that “death is a unitary phenomenon” (p. 7) and that the determination of death by neurological criteria, in terms of the absence of all brain function, is consistent with the traditional conception of death as the cessation of vital functioning of the organism as a whole. The key issue is the integrative functioning of the human organism, which ceases to exist, according to the Commission, when the whole brain, including higher cortical areas and the brain stem, fails to function. Although “brain-dead” patients do not appear to be dead—i.e., the reality of their death is “masked” by the activity of mechanical ventilation—the patient’s body has irreversibly lost all capacity for integrative functioning. In the words of the Commission: “When artificial means of support mask this loss of integration as measured by the old methods [cessation of respiration and heart beat], brain-oriented criteria and tests provide a new window on the same phenomenon” (p. 33). The President’s Commission was instrumental in developing and establishing “The Uniform Definition of Death Act”: “An individual who has sustained either (1) irreversible cessation of circulatory and respiratory functions, or (2) irreversible cessation of all functions of the entire brain, including the brain stem, is dead” (p. 2).Although the question posed by the President’s Commission was easy to articulate, the answer, over time, has proved complicated and controversial. Accepted medical practice already violates the dead donor rule. Explicitly jettisoning the rule—allowing vital organs to be extracted, under certain conditions, from living patients—is a radical change only at the conceptual level. But it would expand the pools of eligible organ donors.

Conventional medical ethics and the law draw a bright line distinguishing the permitted practice of withdrawing life-sustaining treatment from the forbidden practice of active euthanasia by means of a lethal injection. When clinicians justifiably withdraw life-sustaining treatment, they allow patients to die but do not cause, intend, or have moral responsibility for, the patient's death. In contrast, physicians unjustifiably kill patients whenever they intentionally administer a lethal dose of medication. We argue that the differential moral assessment of these two practices (...) is based on a series of moral fictions – motivated false beliefs that erroneously characterize withdrawing life-sustaining treatment in order to bring accepted end-of-life practices in line with the prevailing moral norm that doctors must never kill patients. We report new data from a survey of loneliness in Australia during the Covid-19 lockdowns of 2020–21, in order to identify those age groups most at risk of increased loneliness. Counter-intuitively, proportionately fewer elderly Australians experienced increased loneliness as a result of lockdowns, as compared with 44% of those aged 19–29 and 31% of those aged 40–49. To explain this pattern, we investigated how lockdowns disturbed the complex connections between types of place affordance and the age-specific cultural scripts that normally (...) give rise to a sense of belonging. For younger age groups, such scripts demand their identification with future orientations and a sense of belonging tied to the more distant and wide-ranging places of career advance, meeting, play, and pleasure that lockdown inhibited. By contrast, older retired cohorts were more inclined to frame their sense of belonging in the past through the maintenance of community connections and closer place-bonds of their locality, cultural places of memory and return that they were more happily confined to during lockdowns. I present a general theory for the initial domestication of plants and animals that is based on niche construction theory and incorporates several behavioral ecological concepts, including central-place provisioning, resource catchment, resource ownership and defensibility, and traditional ecological knowledge. This theory provides an alternative to, and replacement for, current explanations, including diet breadth models of optimal foraging theory, that are based on an outmoded concept of asymmetrical adaptation and that attempt to explain domestication as an adaptive response to resource imbalance (...) resulting from either environmental decline or human population growth. The small-scale human societies that first domesticated plants and animals share a number of basic interrelated attributes that when considered as an integrated and coherent set of behaviors provide the context for explaining initial domestication not as an adaptive response to an adverse environmental shift or to human population growth or packing but rather as the result of deliberate human enhancement of resource-rich environments in situations where evidence of resource imbalance is absent. “Clinical ethics consultants” have been practicing in the United States for about 50 years. Most of the earliest consultants—the “pioneers”—were “outsiders” when they first appeared at patients' bedsides and in the clinic. However, if they were outsiders initially, they acclimated to the clinical setting and became “insiders” very quickly. Moreover, there was some tension between traditional academics and those doing applied ethics about whether there was sufficient “critical distance” for appropriate reflection about the complex medical ethics dilemmas of the day (...) if one were involved in the decision making. Again, the pioneers deflected concerns by identifying and instituting safeguards to assure professional objectivity in clinical ethics consultation services. One might suggest that in moving inside and establishing normative practices, the pioneer clinical ethics consultants anticipated adoption of their routines and professionalization of the field. The currently leading cognitive theory of consciousness, Global Workspace Theory,1,2 postulates that the primary functions of consciousness include a global broadcast serving to recruit internal resources with which to deal with the current situation and to modulate several types of learning. In addition, conscious experiences present current conditions and problems to a "self" system, an executive interpreter that is identifiable with brain structures like the frontal lobes and precuneus.1Be it human, animal or artificial, an autonomous agent3 is said to be (...) functionally conscious if its control structure (mind) implements Global Workspace Theory and the LIDA Cognitive Cycle, which includes unconscious memory and control functions needed to integrate the conscious component of the system. We would therefore consider humans, many animals4 and even some virtual or robotic agents5,6 to be functionally conscious. Such entities may approach phenomenal consciousness, as found in human and other biological brains, as additional brain-like features are added.Here we argue that adding mechanisms to produce a stable, coherent perceptual field7 in a LIDA controlled mobile robot might provide a small but significant step toward phenomenal consciousness in machines.>8 We also propose that implementing several of the various notions of self in such a LIDA controlled robot may well prove another step toward phenomenal consciousness in machines. This book challenges fundamental doctrines of established medical ethics. It is argued that the routine practice of stopping life support technology causes the death of patients and that donors of vital organs (hearts, liver, lungs, and both kidneys) are not really dead at the time that their organs are removed for life-saving transplantation. Although these practices are ethically legitimate, they are not compatible with traditional medical ethics: they conflict with the norms that doctors must not intentionally cause the death of (...) their patients and that vital organs can be obtained only from dead donors. The aim of this book is to undertake an ethical examination that aims to honestly face the reality of medical practices at the end of life. This involves exposing the misconception that stopping life support merely allows patients to die from their medical conditions, that there is an ethical bright line separating withdrawal of life support from active euthanasia, and that determination of death of hospitalized patients prior to vital organ donation is consistent with the established biological conception of death. A novel ethical justification is required for procuring vital organs from still-living donors. It is contended that in the context of plans to withdraw life support, donors of vital organs are not harmed or wronged by organ procurement prior to death, provided that valid consent is obtained for stopping treatment and organ donation. In view of serious practical difficulties in facing the truth regarding organ donation, an alternative pragmatic account is developed for justifying current practices that relies on the concept of transparent legal fictions. In sum, it is the thesis of this book that to preserve the legitimacy of end-of-life practices, we need to reconstruct medical ethics. (shrink)

As clinical ethics consultants move toward professionalization, the process of certifying individual consultants or accrediting programs will be discussed and debated. With certification, some entity must be established or ordained to oversee the standards and procedures. If the process evolves like other professions, it seems plausible that it will eventually include a written examination to evaluate the core knowledge competencies that individual practitioners should possess to meet peer practice standards. The American Society for Bioethics and Humanities has published core knowledge (...) competencies for many years that are accepted by experts as the prevailing standard. Probably any written examination will be based upon the ASBH core knowledge competencies. However, much remains to be done before any examination may be offered. In particular, it seems likely that a recognized examining board must create and validate examination questions and structure the examination so as to establish meaningful, defensible parameters after dealing with such challenging questions as: Should the certifying examination be multiple choice or short-answer essay? How should the test be graded? What should the pass rate be? How may the examination be best administered? To advance the field of health care ethics consultation, thought leaders should start to focus on the written examination possibilities, to date unaddressed carefully in the literature. Examination models—both objective and written—must be explored as a viable strategy about how the field of health care ethics consultations can grow toward professionalization. (shrink)

Can we legitimately speak of ethicsexperts? Recent literature in philosophy and medical ethics addresses this important question but does not offer a satisfactory answer. Part of the problem is the absence of an examination of what it means to be an expert in general. I therefore begin by reviewing my analysis of expertise which appeared earlier in this journal. We speak of two kinds of experts: persons whose expertise is in virtue of what theyknow (epistemic expertise), or what theydo (performative (...) expertise). Applying this analysis to the domain of ethics, I argue that we may speak of ethical expertise in three epistemic senses: a) expertise indescriptive ethics, b) expertise inmetaethics, c) expertise innormative ethics, and in a performative sense: d) expertise inliving a good life. Bioethics is a hybrid discipline. As a theoretical enterprise it stands for untrammeled inquiry and argument. Yet it aims to influence medical practice and policy. In this article we explore tensions between these two dimensions of bioethics and examine the merits and perils of a “Socratic” approach to bioethics that challenges “the conventional wisdom.”.

The public largely supports the use of animals in biomedical research, but only if they are sure that the animals are treated humanely. The scientific community has provided these assurances. Is this a truthful claim? I argue that when examined systematically, the claim that animals in research are treated humanely is not truthful by any existing definition of the word. This article does not argue for or against the morality of using animals in research; rather, the reasoning set forth herein (...) argues that in this use of animals, the scientific community is not being truthful to the public. Experts play an important role in society, but there has been little investigation about the nature of expertise. I argue that there are two kinds of experts: those whose expertise is a function of what theyknow (epistemic expertise), or what theydo (performative expertise). Epistemic expertise is the capacity to provide strong justifications for a range of propositions in a domain, while performative expertise is the capacity to perform a skill well according to the rules and virtues of a practice. Both (...) epistemic and performative experts may legitimately disagree with one another, and the two senses are conceptually and logically distinct. (shrink)

Attention is often dichotomized into controlled vs. automatic processing, where controlled processing is slow, flexible, and intentional, and automatic processing is fast, inflexible, and unintentional. In contrast to this strict dichotomy, there is mounting evidence for context-specific processes that are engaged rapidly yet are also flexible. In the present study we extend this idea to the domain of implicit learning to examine whether flexibility in automatic processes can be implemented through the reliance on contextual features. Across three experiments we show (...) that participants can learn implicitly two complementary sequences that are associated with distinct contexts, and that transfer of learning when the two contexts are randomly intermixed depends on the distinctiveness of the two contexts. Our results point to the role of context-specific processes in the acquisition and expression of implicit sequence knowledge, and also suggest that episodic details can be represented in sequence knowledge. For over a century, the Danish thinker Søren Kierkegaard has been at the center of a number of important discussions, concerning not only philosophy and theology, but also, more recently, fields such as social thought, psychology, and contemporary aesthetics, especially literary theory. Despite his relatively short life, Kierkegaard was an extraordinarily prolific writer, as attested to by the 26-volume Princeton University Press edition of all of his published writings. But Kierkegaard left behind nearly as much unpublished writing, most of which (...) consists of what are called his "journals and notebooks." Kierkegaard has long been recognized as one of history's great journal keepers, but only rather small portions of his journals and notebooks are what we usually understand by the term "diaries." By far the greater part of Kierkegaard's journals and notebooks consists of reflections on a myriad of subjects--philosophical, religious, political, personal. Studying his journals and notebooks takes us into his workshop, where we can see his entire universe of thought. We can witness the genesis of his published works, to be sure--but we can also see whole galaxies of concepts, new insights, and fragments, large and small, of partially completed but unpublished works. Kierkegaard's Journals and Notebooks enables us to see the thinker in dialogue with his times and with himself. Volume 6 of this 11-volume series includes four of Kierkegaard's important "NB" journals, covering the months from early May 1849 to the beginning of 1850. At this time Denmark was coming to terms with the 1848 revolution that had replaced absolutism with popular sovereignty, while the war with the German states continued, and the country pondered exactly what replacing the old State Church with the Danish People's Church would mean. In these journals Kierkegaard reflects at length on political and, especially, on ecclesiastical developments. His brooding over the ongoing effects of his fight with the satirical journal Corsair continues, and he also examines and re-examines the broader personal and religious significance of his broken engagement with Regine Olsen. These journals also contain reflections by Kierkegaard on a number of his most important works, including the two works written under his "new" pseudonym Anti-Climacus and his various attempts at autobiographical explanations of his work. And, all the while, the drumbeat of his radical critique of "Christendom" continues and escalates. Kierkegaard wrote his journals in a two-column format, one for his initial entries and the second for the extensive marginal comments that he added later. This edition of the journals reproduces this format, includes several photographs of original manuscript pages, and contains extensive scholarly commentary on the various entries and on the history of the manuscripts being reproduced.
