An emerging view of science rejects an infallible observational given and takes consensus as the starting point for confirmation. Theory and Observation are seen as mutually correcting. I argue that the same is true of ethics, such as Rawls' "reflective equilibrium." Though epistemologically similar, their truth conditions may differ. Ethics may be reducible to physics; but even if it is not, that does not imply that it has no truth conditions. The abortion debate rages on. Yet the two most popular positions seem to be clearly mistaken. Conservatives maintain that a human life begins at conception and that therefore abortion must be wrong because it is murder. But not all killings of humans are murders. Most notably, self defense may justify even the killing of an innocent person.Liberals, on the other hand, are just as mistaken in their argument that since a fetus does not become a person until birth, a woman (...) may do whatever she pleases in and to her own body. First, you cannot do as you please with your own body if it affects other people adversely. Second, if a fetus is not a person, that does not imply that you can do to it anything you wish. This paper investigates three morphosyntactic alternations in Estonian – those between the exterior locative cases allative, adessive and ablative and the corresponding postpositionspeale‘onto’,peal‘on’ andpealt‘off’. Based on the Complexity Principle (e.g., Rohdenburg, Günter. 2002. Processing complexity and the variable use of prepositions in English. In Hubert Cuyckens & Günter Radden (eds.),Perspectives on prepositions, 79–100. Tübingen: Niemeyer), we expect cognitively more complex constructions to use more explicit (i.e., morphologically more substantial) marking by means of a postposition. Further, we expect variation to (...) be conditioned similarly in all three semantic categories. For each of the three alternations, a random sample of the two outcomes (case vs. postposition) from the Estonian National Corpus is used, resulting in 3,000 data points. Using properties of the Landmark phrase as independent variables in Bayesian mixed-effects logistic regression models, we predict the choice of postpositions over case-marked realisations. Of the patterns found, only the frequency-related one supports our complexity-related hypothesis. We conclude that the Complexity Principle, in its general form, has little explanatory power for the Estonian constructions at hand and, in particular, that the derived principle of ‘analytic support’ is not generally applicable. We show, however, that the grammatical knowledge of Estonian exterior locative cases and the corresponding postpositions is regulated by our three factors in a relatively uniform way. (shrink)

Henrich is a very prolific scholar, and the lack of English translations of most of his works may account in some measure for the fact that there has been surprisingly little sustained engagement with them by Anglo-American scholars, especially those working on Kant’s ethics. This article examines the work of the seventeenth-century thinker Catharine Trotter Cockburn with an eye toward explication of her trenchant empiricism, and the foundations upon which it rested. It is argued that part of the originality of Cockburn's work has to do with her consistent line of thought with regard to evidence from the senses and the process of abstract conceptualization; in this she differed strongly from some of her contemporaries. The work of Martha Brandt Bolton and Fidelis Morgan is (...) cited, and there is an auxiliary argument to the effect that Cockburn is probably better known as a playwright than she is as a philosophical thinker. The reception history of a text is frequently at odds with its origins. Colin Burrow notes the irony that despite its loud support of those in power, Virgil’s Aeneid is taken up and translated by the disempowered during the Renaissance. The same is partly true of Xenophon’s Cyropaedia. This paper examines the place of the Cyropaedia within the English humanist tradition, focussing on English translations of the text, and its interpretation within the speculum principis tradition. This history of the unique community of Theravada nuns known as siladhara, based at Amaravati and Chithurst Buddhist monasteries is presented in two parts. The history from its inception in the late 1970s until the years 2000 appeared in Buddhist Studies Review 23. This second part gives the most recent developments in the order, from 2000 to the present day, plus reflections on the future. The research is based on personal interview with founding members of the order as well as (...) email, telephone and written communications with nuns past and present. It considers the implications of the revived bhikkhuni ordination for the siladhara and addresses the possibilities for the future. It describes the founding of a parallel order of Theravada nuns in Western Australia, with some significant differences to the UK nuns. It concludes that in attempting a form of monasticism for women, giving all the advantages of renunciation but at the same time negotiating the difficult synthesis of Western expectations, traditional Theravada cultural norms and the monastic rule itself, it has largely succeeded. This essay enacts a particular instance of the challenge post-structuralism poses to the study of history. In simpler, language, it concerns the difference that point of view makes when people are giving account of events, whether at first or second hand. The problem is that if all accounts of events are determined through and through by the observer’s frame of reference, then one will never know, in any given case, what really happened.I encountered this problem in concrete terms while preparing (...) to teach a course in colonial American literature. I’d set out to learn what I could about the Puritans’ relations with American Indians. All I wanted was a general idea of what had happened between the English settlers and the natives in seventeenth-century New England; post-structuralism and its dilemmas were the furthest things from my mind. I began, more or less automatically, with Perry Miller, who hardly mentions the Indians at all, then proceeded to the work of historians who had dealt exclusively with the European-Indian encounter. At first, it was a question of deciding which of these authors to believe, for it quickly became apparent that there was no unanimity on the subject. As I read one, however, I discovered that the problem was more complicated than deciding whose version of events was correct. Some of the conflicting accounts were not simply contradictory, they were completely incommensurable, in that their assumptions about what counted as a valid approach to the subject, and what the subject itself was, diverged in fundamental ways. Faced with an array of mutually irreconcilable points of view, points of view which determined what was being discussed as well as the terms of the discussion, I decided to turn to primary sources for clarification, only to discover that the primary sources reproduced the problem all over again. I found myself, in other words, in an epistemological quandary, not only unable to decide among conflicting versions of events but also unable to believe that any such decision could, in principle, be made. It was a moral quandary as well. Knowledge of what really happened when the Europeans and the Indians first met seemed particularly important, since the result of that encounter was virtual genocide. This was the kind of past “mistake” which, presumably, we studied history in order to avoid repeating. If studying history couldn’t put us in touch with actual events and their causes, then what was to prevent such atrocities from happening again? This article examines the criteria for determining when a local authority owes a duty of care at Common Law, concurrent with statutory obligations, in light of the decisions of the House of Lords in X (Minors) v Bedfordshire County Council and M (A Minor) v Newham Borough Council. The various policy arguments employed by their Lordships are analysed and located within current debate regarding the purpose and scope of the tort of negligence. It is argued that, in relevant circumstances, (...) class='Hi'>English courts should have regard to the European Convention on Human Rights in order to conclude whether it is ‘just and reasonable’ to impose a duty of care. The cases under discussion raised issues under several Articles of the Convention (Article 6 and Article 8, in particular), and their impact upon the decision of the House of Lords, as well as the facts themselves, is assessed. This article examines the principle of state immunity from the civil jurisdiction of national courts as it has been applied to officials. In Jones v Saudi Arabia the House of Lords held that individual officials should have the benefit of immunity, notwithstanding the possibility of criminal prosecution as agreed by states parties to the United Nations Convention Against Torture. It is incontrovertible as a matter of international and English law that the state itself is immune from suit in torture (...) claims but there was scant authority prior to Jones requiring the extension of immunity to individual officials. There are two key hurdles for the torture victim to surmount: first, it must be demonstrated that the forum state has jurisdiction to make and adjudicate rules regarding the relevant conduct and, secondly, that any claim to immunity should be denied. It is argued that the assertion of civil jurisdiction over torture which has taken place in another country is permissible under English rules on conflict of laws and would not be excessive in view of the recognition of criminal jurisdiction by states parties to the United Nations Convention Against Torture and under customary international law. It is further argued that to allow civil suit against the torturer (but not the state) would not offend the principles of public international law that relate to immunity, nor should it breach the State Immunity Act 1978. Indexicality is a feature of predicates and predicate components (verbs, adjectives, adverbs and the like) as well as of referring expressions. With classic referring indexicals such as 'I' or 'that' a distinctive rule takes us from token and context to some item present in the content which is the semantic correlate of the token. Predicates and predicate components may function in an analogous fashion. For example 'thus' is an indexical adverb which latches onto some manner of performance present in its (...) context. 'John sang thus', said while indicating someone singing discordantly, claims that John sang discordantly. The phenomenon of predicatival indexicality is widespread in English and is expressed in a variety of idioms. Indexical predication plays important epistemological and psychological roles and the notion may have other interesting philosophical applications. (shrink)

Clothing is central to the worlds described in early modern utopian texts: of twenty-three utopian texts written and published in England between 1516 and 1656, 91 percent mention dress, and 82 percent contain more extensive description or comment upon clothing. Written by elite authors for elite readers, these texts assign clothing a leading role in the establishment and maintenance of social order in a range of areas, including governance, social and religious control, personal expression, and ideological stance. Extending new verbs is important in becoming a productive speaker of a language. Prior results show children have difficulty extending verbs when they have seen events with varied agents. This study further examines the impact of variability on verb learning and asks whether variability interacts with event complexity or differs by language. Children in the United States, China, Korea, and Singapore learned verbs linked to simple and complex events. Sets of events included one or three agents, and children were asked (...) to extend the verb at test. Children learning verbs linked to simple movements performed similarly across conditions. However, children learning verbs linked to events with multiple objects were less successful if those events were enacted by multiple agents. A follow-up study rules out an influence of event order. Overall, similar patterns of results emerged across languages, suggesting common cognitive processes support children's verb learning. (shrink)

In the early seventies, American feminist literary criticism had little patience for psychoanalytic interpretation, dismissing it along with other forms of what Mary Ellmann called “phallic criticism.”1 Not that psychoanalytic literary criticism was a specific target of feminist critics, but Freud and his science were viewed by feminism in general as prime perpetrators of patriarchy. If we take Kate Millett’s Sexual Politics2 as the first book of modern feminist criticism, let us remark that she devotes ample space and energy to (...) attacking Freud, not of course as the forerunner of any school of literary criticism, but as a master discourse of our, which it to say masculinist, culture. But, although Freud may generally have been a target for feminism, feminist literary critics of the early seventies expended more of their energy in the attack on New Criticism. The era was, after all, hardly a heyday for American psychoanalytic criticism; formalist modes of reading enjoyed a hegemony in the literary academy in contrast with which psychoanalytic interpretation was a rather weak arm of patriarchy.Since then, there have been two changes in this picture. In the last decade, psychoanalytic criticism has grown in prestige and influence, and a phenomenon we can call psychoanalytic feminist criticism has arisen.3 I would venture that two major factors have contributed to this boom in American psychoanalytic criticism. First, the rise of feminist criticism, in its revolt against formalism, has rehabilitated thematic and psychological criticism, the traditional mainstays of psychoanalytic interpretation. Because feminism has assured the link between psychosexuality and the socio-historical realm, psychoanalysis now linked to major political and cultural questions. Glistening on the horizon of sociopolitical connection, feminism promises to save psychoanalysis from its ahistorical and apolitical doldrums.The second factor that makes psychoanalytic reading a growth industry in the United States is certainly more widely recognized: it is the impact of French post-structuralist thought on the American literary academy. There is, of course, the direct influence of Lacanian psychoanalysis which promotes language to a principal role in the psychoanalytic drama and so naturally offers fertile ground for crossing psychoanalytic and literary concerns. Yet I think, in fact, the wider effect in this country has come from Derridean deconstruction. Although deconstruction is not strictly psychoanalytic, Freud’s prominent place in Derridean associative networks promises a criticism that is, finally, respectably textual and still, in some recognizable way, Freudian. Although this second, foreign factor in the growth of American psychoanalytic criticism seems far away from the realm of homespun feminist criticism, I would content that there is a powerful if indirect connection between the two. I would speculate that the phenomenal spread of deconstruction in American departments of English is in actuality a response to the growth of feminist criticism. At a moment when it was no longer possible to ignore feminist criticism’s challenge to the critical establishment, deconstruction appeared offering a perspective that was not in opposition to but rather beyond feminism, offering to sublate feminism into something supposedly “more radical.” Jane Gallop, professor of humanities at Rice University, is the author of Intersections: A Reading of Sade with Bataille, Blanchot, and Klossowski , The Daughter’s Seduction: Feminism and Psychoanalysis , and Reading Lacan . This article analyzes how a number of writers in English articulated their attitudes toward southern Africa's indigenous mammal megafauna from c.1840 to just before the First World War. In changing contexts of declining wild animal numbers, it examines how attitudes and the expression of those attitudes—together with developments in biology—altered with the modernization of government and the economy. To some extent, it also explores the human and other values placed on certain species of animals, including ideas about extinction, notions (...) of what constitutes "vermin," and evolving opinions on nature and environmental conservation. While I am not convinced that Mother Tongues actually demonstrates the similarity between the plurality of languages and (...) the plurality of sexes, my reading nonetheless does find its thesis in this sentence. I would say that Johnson's project in this book is to "make the 'one' impossible," that throughout this book, Johnson continually and consistently argues against the "appeal" of "the 'one'"—repeatedly locates herself in, and exhorts us to join her in, resistance to the powerful seductions of "the 'one.'"In the sentence I just quoted, the word "one" is in quotation marks because the word is not quite the proper name for what Johnson is talking about. When I use the phrase "the 'one'" here, as I do in my title ("Making the 'One' Impossible"), and as I will do throughout this paper, the word "one" will always be in quotation marks, scare quotes.In Mother Tongues, "the 'one'" goes by a number of different names. In the last paragraph of the first chapter, for example, where we found our thesis, it is called "universality." At times, Johnson productively follows meanings which appear in a translation but are not in the original.The first time this occurs is in the first chapter, in a section entitled "Translation." Johnson is looking at two different English translations of Kafka's The Trial: an "old translation" she "happened to have on hand" and "a more recent edition" in which the old translation "had been revised." Studying the first sentence of the novel in the original and the two translations, Johnson seizes on the word traduce, which she finds in the old translation but not the revision and proclaims: "The translation... is thus even better than the original" [16, emphasis added].The next chapter of Mother Tongues gives us a sense of where, theoretically, this insubordination comes from: "the theory that transformed literary studies utterly transformed the practice of translation. Filled with punning twists, and itself a valorizer of word games and magic, this work has not a lot to do with bilingualism (in the standard sense), not (...) a lot to do with aesthetics (again, in the standard academic sense), but a great deal to do with both. Whether the title is read (and Sommer's point is to forward the notion of alternate readings) as the aesthetics of bilingualism or as an account of what a bilingual might make of aesthetics, there is a startling amount of content in the work.Briefly, Sommer essays to make the case that our multicultural society is distinctly better off for being multicultural and multilingual (or at least, in some threatening sense, emergently bilingual) because the literal bilingual has a distinct advantage over her or his monolingual counterpart. The bilingual can play language games, and those games shock, amuse, or jolt—whatever it is that they do, they rouse us out of any state of intellectual torpor into which we might have fallen and they serve to make us all individuals who, in Du Bois' memorable phrase, have "double consciousness."Thus Sommer does in fact mean for her title to be read in at least two ways: Her work attempts to valorize and vindicate a sort of unofficial bilingualism (one of the blurbs on the back of the paperback edition begins by saying "Knowing a second language entails some unease... "), while she also attempts to let us in on the notion that there is an aesthetic that develops from the use of more than one code. Sommer plays remarkably on all these concepts: She is familiar with the standard, overt scholarship on bilingualism—she can cite work by sociolinguists and others. At the same time, as an author known for previous work on literature, especially with regard to Latin America, she is also familiar with much of the standard historical work in aesthetics, including Kant. Citing thinkers such as Kenji Hakuta, William J. Bennett, Wittgenstein, and Elena Poniatowska, Sommer leaves the reader somewhat bedazzled and breathless but better off for having read her work.Her overall thesis, if one may attempt to employ such a phrase, is that bilingualism and code-switching create for us the same sort of uneasiness and inevitable access to the unconscious that works of art and literature produce—and that the edginess that is a concomitant of code-switching is beneficial. Her first chapter "Choose and Lose" reminds Americans that the United States has always been a multilingual place and focuses on how much can be gained from attempting to forward the notion. If there is any difficulty to Sommer's work, it is that she practices what she preaches. [One irate journalist wrote:] "How can immigrants identify with America if they can't read Lincoln's words in the language in which they were spoken?(out of many, one) to a multicultural boarding house,...?" No need to be upset at this harangue. It's obviously a joke, even if the author missed it (a common asymmetry in bilingual humor). Notice that the translation from Latin assumes that English-only citizens don't understand the very slogan they hold dear.(p. 26)But of course the joke is to some extent on Sommer and on all of us, as she no doubt intends. It is highly unlikely that the journalist did get the humor, and the only funny part of the entire tirade is that we—assuming we have enough formal education—may be able to make something out of it... The purpose of this contemporary history study is to analyse nursing strategy documents produced by NHS Trusts in England in the period 2009–2013, through a process of discourse analysis. In 2013 the Francis Report on the Mid-Staffordshire NHS Foundation Trust was published. The Report highlighted the full range of organisational failures in a Trust that valued financial efficiency over patient care. The analysis that followed, however, dwelt heavily on the failings of the nurses. Nursing strategy documents at that time served (...) to set the future direction for NHS Trusts, prescribing specific value frameworks for each nursing workforce. However, the values chosen frequently conflicted with each other pitting nursing values against a managerial trope. It is argued that documents provided a response to wider NHS concerns and high-profile failures in care, particularly the Francis Report, paying lip service to staff engagement whilst maintaining a corporate focus. Nursing values were placed firmly within a managerialist discourse, one that has needed to be re-evaluated in the current Covid-19 pandemic. Wider implications of the research suggest discussion of value conflict may be beneficial within nursing education and a truly local approach to strategy creation would potentially promote staff buy-in to strategy documents. The New Curriculum Standards for teaching English introduced major changes in the culture of teaching and learning English in the Peoples Republic of China. Changes have been linked to changing goals for English instruction and a revision of Confucian values in schooling. In this article, we argue that this English curriculum proposes a new role, with new demands, for English-as-foreign-language teachers in the PRC. In order to implement the curriculum reform successfully, teachers involved in the (...) reform are required to have a shared understanding of its nature, purposes and scope. However, little is known about to what extent EFL teachers understand and engage with their new roles. This study examines teachers’ understandings of the new curriculum and of the new, demanding role of teachers implied by the curriculum. This is a mixed methods study involving an analysis of the curriculum document, a survey of EFL teachers and semi-structured interviews with a sample of teachers in the cohort. The findings suggest that many teachers know the content of the curriculum document, but expressed uncertainty about the implications of changes, uncertainty about what a shift to student-centered teaching and learning means and confusion about new professional development demands. The findings of this study have wider implications for EFL teachers, teacher educators, researchers and policy makers in the PRC and similar national contexts. This article highlights that, from an international perspective, introducing new ideas and practices should consider teachers’ existing understanding and experiences of the curriculum as well as the way in which they understand the purposes of the changes, and should promote a shared understanding of policy intentions.
