This article provides a critique of the controlling legal paradigm in Australia from related scientific and quality management perspectives. It shows key legal requirements are prescientific and hinder attainment of community health and sustainable development goals. It discusses regional arrangements which appear necessary to achieve national aims and the potential of a duty of care regulatory approach, in which dispute resolution is conceptualised as community service, like health or education provision.

Purpose/methods: This study investigated the relationship between ethics education and training, and the use and usefulness of ethics resources, confidence in moral decisions, and moral action/activism through a survey of practicing nurses and social workers from four United States (US) census regions. Findings: The sample (n = 1215) was primarily Caucasian (83%), female (85%), well educated (57% with a master's degree). no ethics education at all was reported by 14% of study participants (8% of social workers had no ethics education, (...) versus 23% of nurses), and only 57% of participants had ethics education in their professional educational program. Those with both professional ethics education and in-service or continuing education were more confident in their moral judgments and more likely to use ethics resources and to take moral action. Social workers had more overall education, more ethics education, and higher confidence and moral action scores, and were more likely to use ethics resources than nurses. Conclusion: Ethics education has a significant positive influence on moral confidence, moral action, and use of ethics resources by nurses and social workers. (shrink)

BackgroundReports suggest that some health care personnel fear retaliation from seeking ethics consultation. We therefore examined the prevalence and determinants of fear of retaliation and determined whether this fear is associated with diminished likelihood of consulting an ethics committee.MethodsWe surveyed registered nurses (RNs) and social workers (SWs) in four US states to identify ethical problems they encounter. We developed a retaliation index (1–7 point range) with higher scores indicating a higher perceived likelihood of retaliation. Linear regression analysis was performed to (...) identify socio-demographic and job characteristics associated with fear of retaliation. Logistic regression analysis was performed to determine whether fear of retaliation was associated with less likelihood of seeking consultation. Results Our sample (N = 1215) was primarily female (85%) and Caucasian (83%) with a mean age of 46 years and 17 years of practice. Among the sample, 293 (48.7%) RNs and 309 (51.3%) SWs reported access to an ethics consultation service. Amongst those with access, 2.8% (n = 17) personally experienced retaliation, 9.1% (n = 55) observed colleagues experience retaliation, 30.2% (n = 182) reported no experience with retaliation but considered it a realistic fear, and 50.8% (n = 305) did not perceive retaliation to be a problem. In logistic regression modeling, fear of retaliation was not associated with the likelihood (OR = 0.64; 95% CI = 0.22–1.89) or frequency of requesting ethics consultation (OR = 0.81; 95% CI = 0.27–2.38). Conclusion Fear of retaliation from seeking ethics consultation is common among nurses and social workers, nonetheless this fear is not associated with reduced requests for ethics consultation. In this powerful and wonderfully accessible meditation on psychoanalysis, hermeneutics, and social constructivism, Donnel Stern explores the relationship between two fundamental kinds of experience: explicit verbal reflection and "unformulated experience," or experience we have not yet reflected on and put into words. Stern is especially concerned with the process by which we come to formulate the unformulated. It is not an instrumental task, he holds, but one that requires openness and curiosity; the result of the process is not accuracy alone, (...) but experience that is deeply felt and fully imagined. Stern's sense of explicit verbal experience as continuously constructed and emergent leads to a central dialectic at the heart of his work: that between curiosity and imagination, on one hand, and dissociation and unthinking acceptance of the familiar on the other. The goal of psychoanalytic work, he holds, is the freedom to be curious, whereas defense signifies the denial of this freedom. We defend against our fear of what we would think, that is, if we allowed ourselves the freedom to think it. Stern also shows how the unconscious itself can be reconceptualized hermeneutically, and he goes on to explore the implications of this viewpoint on interpretation and countertransference. He is especially persuasive in showing how the interpersonal field, which is continuously in flux, limits the experience that it is possible for participants to reflect on. Thus it is that analyst and patient are together "caught in the grip of the field," often unable to see the kind of relatedness in which they are mutually involved. A brilliant demonstration of the clinical consequentiality of hermeneutic thinking, _Unformulated Experience_ bears out Stern's belief that psychoanalysis is as much about the revelation of the new in experience as it is about the discovery of the old. Pateman challenges the way contemporary society functions by questioning the standard interpretation of an idea that is deeply embedded in American and British political thought: that our rights and freedoms derive from the social contract explicated by Locke, Hobbes, and Rousseau and interpreted in the United States by the Founding Fathers. The author shows how we are told only half the story of the original contract that establishes modern patriarchy. The sexual contract is ignored and thus men's patriarchal right over (...) women is also glossed over. No attention is paid to the problems that arise when women are excluded from the original contract but incorporated into the new contractual order. One of the main targets of the book is those who try to turn contractarian theory to progressive use, and a major thesis of the book is that this is not possible. Thus those feminists who have looked to a more "proper" contract- one between genuinely equal partners, or one entered into without any coercion- are misleading themselves. In the author's words, "In contract theory universal freedom is always a hypothesis, a story, a political fiction. Contract always generates political right in the forms of domination and subordination." Thus the book is also aimed at mainstream political theorists, and socialist and other critics of contract theory. The author offers a sweeping challenge to conventional understandings- of both left and right- of actual contracts in everyday life: the marriage contract, the employment contract, the prostitution contract, and the new surrogate mother contract. By bringing a feminist perspective to bear on the contradictions and paradoxes surrounding women and contract, and the relation between the sexes, she is able to shed new light on fundamental political problems of freedom and subordination. The subject of personal identity is one of the most central and most contested and exciting in philosophy. Ever since Locke, psychological and bodily criteria have vied with one another in conflicting accounts of personal identity. Carol Rovane argues that, as things stand, the debate is unresolvable since both sides hold coherent positions that our common sense, she maintains, is conflicted; so any resolution to the debate is bound to be revisionary. She boldly offers such a revisionary theory of (...) personal identity by first inquiring into the nature of persons. Rovane begins with a premise about the distinctive ethical nature of persons to which all substantive ethical doctrines, ranging from Kantian to egoist, can subscribe. From this starting point, she derives two startling metaphysical possibilities: there could be group persons composed of many human beings and muliple persons within a single human being. Her conclusions supports Locke's distinction between persons and human beings, but on altogether new grounds. These grounds lie in her radically normative analysis of the condition of personal identity, as the condition in which a certain normative commitment arises, namely, the commitment to achieve overall rational unity within a rational point of view. It is by virtue of this normative commitment that individual agents can engage one another specifically as persons, and possess the distinctive ethical status of persons. In behavioral ethics today, there is debate as to which theory of moral development is the best for understanding ethical decision making, thereby facilitating ethical behavior. This debate between behavioral ethicists has been profoundly influenced by the field of moral psychology. Unfortunately, in the course of this marriage between moral psychology and business ethics and subsequent internal debate, a simple but critical understanding of human being in the field of management has been obscured; i.e., that morality is not a secondary (...) phenomenon arising out of something else. Therefore, in this paper, we will argue that there is a need in behavioral ethics to shift our understanding away from the influence of contemporary moral psychology and back to management theorist Ghoshal’s :75–91, 2005) view of what it means to be human in which the moral is fundamental. To assist in this labor, we will build on the philosophical work of Emmanuel Levinas who sees ethics, regardless of the setting, as a metaphysical concern. What this means is that Levinas sees the essential moral character of human life and the reality of human agency as ontologically fundamental, or constitutive of human nature itself. In other words, the ethical is the “first cause” in regard to understanding the nature and action of the individual, including within organizations. Thus, morality in any sphere of human endeavor, including in business, is not merely epiphenomenal to some more fundamental reality. (shrink)

There is no broadly accepted definition of ‘life.’ Suggested definitions face problems, often in the form of robust counter-examples. Here we use insights from philosophical investigations into language to argue that defining ‘life’ currently poses a dilemma analogous to that faced by those hoping to define ‘water’ before the existence of molecular theory. In the absence of an analogous theory of the nature of living systems, interminable controversy over the definition of life is inescapable.

In this essay, I connect the sexual victimization of women, children, and pet animals with the violence manifest in a patriarchal culture. After discussing these connections, I demonstrate the importance of taking seriously these connections because of their implications for conceptual analysis, epistemology, and political, environmental, and applied philosophy. My goal is to broaden our understanding of issues relevant to creating peace and to provide some suggestions about what must be included in any adequate feminist peace politics.

Building on the innovative work of _Unformulated Experience,_ Donnel B. Stern continues his exploration of the creation of meaning in clinical psychoanalysis with _Partners in Thought_. The chapters in this fascinating book are undergirded by the concept that the meanings which arise from unformulated experience are catalyzed by the states of relatedness in which the meanings emerge. In hermeneutic terms, what takes place in the consulting room is a particular kind of conversation, one in which patient and analyst serve as (...) one another’s partner in thought, an emotionally responsive witness to the other’s experience. Enactment, which Stern theorizes as the interpersonalization of dissociation, interrupts this crucial kind of exchange, and the eventual breach of enactments frees analyst and patient to resume it. Approaching the link between dissociation and enactment via hermeneutics, metaphor, and narrative, among other perspectives, Stern weaves an experience-near theory of psychoanalytic relatedness that illuminates dilemmas clinicians find themselves in every day. Full of clinical illustrations showing how Stern works with dissociation and enactment, _Partners in Thought_ is destined to take its place beside Unformulated Experience as a major contribution to the psychoanalytic literature. Carol Zaleski's book is the first objective, comprehensive survey of the mass of evidence surrounding near-death experiences: the extraordinary visions and ecstatic feelings reported by people who have survived a close brush with death. Comparing recent near-death narratives with those of a much earlier period she finds both profound similarities and striking contrasts.

Many scientists believe that there is a uniform, interdisciplinary method for the prac- tice of good science. The paradigmatic examples, however, are drawn from classical ex- perimental science. Insofar as historical hypotheses cannot be tested in controlled labo- ratory settings, historical research is sometimes said to be inferior to experimental research. Using examples from diverse historical disciplines, this paper demonstrates that such claims are misguided. First, the reputed superiority of experimental research is based upon accounts of scientific methodology (Baconian inductivism (...) or falsificationism) that are deeply flawed, both logically and as accounts of the actual practices of scientists. Second, although there are fundamental differences in methodology between experimental scien- tists and historical scientists, they are keyed to a pervasive feature of nature, a time asymmetry of causation. As a consequence, the claim that historical science is methodo- logically inferior to experimental science cannot be sustained. (shrink)

In this paper I argue that, in addition to having an obligation to resist the oppression of others, people have an obligation to themselves to resist their own oppression. This obligation to oneself, I argue, is grounded in a Kantian duty of self-respect.

How to formulate the doctrine of relativism -- Evaluating the doctrine of relativism.

This research tested the hypothesis that prudence and altruism, in situations involving future desires, follow a similar developmental course between the ages of 3 and 5 years. Using a modified delay of gratification paradigm, 3- to 5-year-olds were tested on their ability to forgo a current opportunity to obtain some stickers in order to gratify their own future desires — or the current or future desires of a research assistant. Results showed that in choices involving current desires, altruistic behavior was (...) unrelated to age. However, prudence and altruism involving future situations were correlated with one another and with age. Children under 4 years of age demonstrated significantly less futureoriented prudence than the older children (F(1,49) = 15.75; p<.001) and significantly less altruism involving future situations (F(1,49) = 33.24; p<.001). The data for the 3-year-olds, but not for the older children, also showed agepartialled correlations between the two future-oriented choice situations. These results suggest that between 3 and 4 years, children acquire the ability to deal with future-oriented situations through the development of some common mechanism which affects both future-oriented prudence and altruism.
