Background Providing understandable information to patients is necessary to achieve the aims of the Informed Consent process: respecting and promoting patients’ autonomy and protecting patients from harm. In recent decades, new, primarily digital technologies have been used to apply and test innovative formats of Informed Consent. We conducted a systematic review to explore the impact of using digital tools for Informed Consent in both clinical research and in clinical practice. Understanding, satisfaction and participation were compared for digital tools versus the (...) non-digital Informed Consent process. Methods We searched for studies on available electronic databases, including Pubmed, EMBASE, and Cochrane. Studies were identified using specific Mesh-terms/keywords. We included studies, published from January 2012 to October 2020, that focused on the use of digital Informed Consent tools for clinical research, or clinical procedures. Digital interventions were defined as interventions that used multimedia or audio–video to provide information to patients. We classified the interventions into 3 different categories: video only, non-interactive multimedia, and interactive multimedia. Results Our search yielded 19,579 publications. After title and abstract screening 100 studies were retained for full-text analysis, of which 73 publications were included. Studies examined interactive multimedia, non-interactive multimedia, and videos, and most studies were conducted on adults. Innovations in consent were tested for clinical/surgical procedures and clinical research. For research IC, 21 outcomes were explored, with a positive effect on at least one of the studied outcomes being observed in 8/12 studies. For clinical/surgical procedures 49 outcomes were explored, and 21/26 studies reported a positive effect on at least one of the studied outcomes. Conclusions Digital technologies for informed consent were not found to negatively affect any of the outcomes, and overall, multimedia tools seem desirable. Multimedia tools indicated a higher impact than videos only. Presence of a researcher may potentially enhance efficacy of different outcomes in research IC processes. Studies were heterogeneous in design, making evaluation of impact challenging. Robust study design including standardization is needed to conclusively assess impact. (shrink)

Several attempts have been made to apply the choice-sensitive theory of distributive justice, luck egalitarianism, in the context of health and healthcare. This article presents a framework for this discussion by highlighting different normative decisions to be made in such an application, some of the objections to which luck egalitarians must provide answers and some of the practical implications associated with applying such an approach in the real world. It is argued that luck egalitarians should address distributions of health rather (...) than healthcare, endorse an integrationist theory that combines health concerns with general distributive concerns and be pluralist in their approach. It further suggests that choice-sensitive policies need not be the result of applying luck egalitarianism in this context. (shrink)

El presente artículo intentará mostrar el punto de transición que se da en el pensamiento merleau-pontyano entre un primado de la percepción y una rehabilitación ontológica de lo sensible. Dicho punto se refiere a una prioridad ontológica del mundo percibido, el cual pone de manifiesto el paso hacia una ontología de lo percibido, hacia la descripción del ser de lo percibido. Con ello podremos dar cuenta de la exposición del propio autor del modo en cómo la percepción puede ser entendida (...) como un verdadero acceso al ser: el primado de la percepción abarcaría una prioridad propiamente ontológica. El objetivo principal de esta investigación se situará en la exposición de una red conceptual que nos permita dar cuenta del fenómeno perceptivo que no sólo nos proporciona el mundo, tal y como se le aparece al sujeto, sino que intenta ir más allá del aspecto visible, intentará dar cuenta del ser de lo percibido. In der vorliegenden Arbeit geht es um Entscheidungsspielräume und Entscheidungsprozesse von hauptamtlichen Hospizmitarbeiterinnen und -mitarbeitern in ethisch relevanten Situationen. Wie sich diese Prozesse und Spielräume konkret in der Praxis gestalten, erforschten wir mittels einer qualitativen Studie, die wir in drei Hospizen in Nordrhein-Westfalen durchführten. Als ethische Haupthandlungsfelder nannten die befragten Pflegekräfte die Medikation in der präfinalen Phase, den Umgang mit terminaler Sedierung und mit der Flüssigkeitszufuhr und Ernährung am Lebensende. Entscheidungen innerhalb dieser Felder werden i. d. R. kollektiv getroffen. Die (...) individuellen Entscheidungsspielräume der Mitarbeiterinnen und Mitarbeiter betreffen hauptsächlich den Pflegestil und das auf den Gast bezogene Zeitmanagement. Die Gestaltung dieser Entscheidungsspielräume hängt dabei häufig weniger von einem Rahmenkonzept ab, wie es Leitbilder oder Ethikkodizes nahelegen könnten, als vielmehr von einer Anspruchsanpassung der Pflegenden in der Praxis, wie es Modelle eingeschränkter Rationalität nahelegen. Damit übernehmen die Pflegekräfte in einem Hospiz eine sich selbst beratende wie korrigierende Funktion in ethischen Fragen, die angesichts des individuellen Sterbens eines Gastes immer wieder von Neuem ausgehandelt werden. Because of its practical advantages, machine learning (ML) is increasingly used for decision-making in numerous sectors. This paper demonstrates that the integral characteristics of ML, such as semi-autonomy, complexity, and non-deterministic modeling have important ethical implications. In particular, these characteristics lead to a lack of insight and lack of comprehensibility, and ultimately to the loss of human control over decision-making. Errors, which are bound to occur in any decision-making process, may lead to great harm and human rights violations. It is (...) important to have a principled way of assigning responsibility for such errors. The integral characteristics of ML, however, pose serious difficulties in defining responsibility and regulating ML decision-making. First, we elaborate on these characteristics and their epistemic and ethical implications. We then analyze possible general strategies for resolving the assignment of moral responsibility and show that, due to the specific way in which ML functions, each potential solution is problematic, whether we assign responsibility to humans, machines, or using hybrid models. Then, we shift focus on an alternative approach that bypasses moral responsibility and attempts to define legal liability independently through solutions such as informed consent and the no-fault compensation system. Both of these solutions prove unsatisfactory because they leave too much room for potential abuses of ML decision-making. We conclude that both ethical and legal solutions are fraught with serious difficulties. These difficulties prompt us to re-weigh the costs and benefits of using ML for high-stake decisions. Not all homo sapiens are human subjects. This paper explores the lived experience of homo sapiens but not human that I call “lived flesh.” A lived experience/distinction that shouldn’t be possible on Merleau-Ponty’s account of human subjectivity in Phenomenology of Perception and “The Intertwining – The Chiasm.” The use of flesh is deliberate and emerges from my engagement with Merleau-Ponty’s Phenomenology of Perception and “The Intertwining – The Chiasm” through Toni Morrison’s Beloved, Hortense Spillers’ “Interstices: A Small Drama of Words” (...) and “Mama’s Baby, Papa’s Maybe: An American Grammar Book,” Amber Musser’s Sensual Excess: Queer Femininity and Brown Jouissance, and Audre Lorde’s Zami: A New Spelling of My Name. The affective, experiential, and ethical practices of american Blackwomxn in these texts problematize Merleau-Ponty’s account of human subjectivity and his account of the generality of Being (“The Intertwining – The Chiasm”). Merleau-Ponty’s effacement of raced, sexed, and gendered difference results in a construct of the human subject that cannot include all homo sapiens. (shrink)

The intention of this paper is to point to the dilemma humanity may face in light of AI advancements. The dilemma is whether to create a world with less evil or maintain the human status of moral agents. This dilemma may arise as a consequence of using automated decision-making systems for high-stakes decisions. The use of automated decision-making bears the risk of eliminating human moral agency and autonomy and reducing humans to mere moral patients. On the other hand, it also (...) has the potential to bring tremendous benefits to humanity by decreasing human-induced harm in the world. After presenting how this dilemma may arise, I explore general avenues for addressing it. I will argue that we do not have to solve this dilemma in an all-or-nothing fashion and that a more nuanced approach may be suitable. However, the main point I want to highlight is that we need to have a principled way of addressing this dilemma, which is currently missing. (shrink)

Assunzione fondamentale è che i nostri dispositivi rappresentazionali possano essere difettosi. Si configura dunque come l'attività che consiste nell'identificare i difetti in tali dispositivi e mettere in atto strategie di miglioramento. Verranno illustrate le questioni fondamentali a cui una teoria di ingegneria concettuale deve rispondere: in cosa consiste esattamente questa attività? Come possiamo attuarla? Quali meccanismi regolano la formazione dei dispositivi rappresentazionali? Possiamo influire su (...) tali meccanismi? Verrà inoltre presentata un'obiezione all'ingegneria concettuale e varie risposte. -/- Conceptual engineering is a branch of philosophy characterised by a normative approach towards representation. The fundamental assumption of it is that our representational devices can be defective. Conceptual engineering is then the activity consisting of identifying the defects of such devices and putting in place ameliorative strategies. This paper illustrates the fundamental issues for a theory of conceptual engineering: what does this activity consist of? How can we implement it? What mechanisms regulate the formation of representational devices? Can we have an influence over those mechanisms? Moreover, it will be presented an objection to conceptual engineering and various responses to it. (shrink)

Recent research put forward the hypothesis that eye movements are integrated in memory representations and are reactivated when later recalled. However, “looking back to nothing” during recall might be a consequence of spatial memory retrieval. Here, we aimed at distinguishing between the effect of spatial and oculomotor information on perceptual memory. Participants’ task was to judge whether a morph looked rather like the first or second previously presented face. Crucially, faces and morphs were presented in a way that the morph (...) reactivated oculomotor and/or spatial information associated with one of the previously encoded faces. Perceptual face memory was largely influenced by these manipulations. We considered a simple computational model with an excellent match that expresses these biases as a linear combination of recency, saccade, and location. Surprisingly, saccades did not play a role. The results suggest that spatial and temporal rather than oculomotor information biases perceptual face memory. (shrink)

Modern zoos strive to educate visitors about zoo animals and their wild counterparts’ conservation needs while fostering appreciation for wildlife in general. This research review examines how zoos influence those who visit them. Much of the research to-date examines zoo visitors’ behaviors and perceptions in relation to specific exhibits, animals and/or programs. In general, visitors have more positive perceptions and behaviors about zoos, their animals and conservation initiatives the more they interact with animals, naturalistic exhibits, and zoo programming/staff. Furthermore, zoo (...) visitors are receptive to conservation messaging and initiatives at zoos, and are more likely to participate in on-site conservation opportunities as opposed to after their visits. The research also suggests that repeat visitors are even more inclined to seek out conservation efforts compared to those visiting zoos for the first time. While current research suggests that repeat-visitors are more likely to engage in conservation efforts, little is known about causal factors related to such findings, and almost no research exists to-date comparing the conservation efforts of visitors vs. non-visitors. This latter comparison will likely play a greater role in future zoo visitor research, since it poses one of the most important metrics for evaluating the specific effects visiting a zoo can have on people engaging in conservation efforts in general. Andreas Stokke presents a comprehensive study of lying and insincere language use. He investigates how lying relates to other forms of insincerity and explores the kinds of attitudes that go with insincere uses of language. -/- Part I develops an account of insincerity as a linguistic phenomenon. Stokke provides a detailed theory of the distinction between lying and speaking insincerely, and accounts for the relationship between lying and deceiving. A novel framework of assertion underpins the analysis of various kinds of (...) insincere speech, including false implicature and forms of misleading with presuppositions, prosodic focus, and semantic incompleteness. -/- Part II sets out the relationship between what is communicated and the speaker's attitudes. Stokke develops the view of insincerity as a shallow phenomenon that is dependent on conscious attitudes rather than deeper motivations. The various of ways of speaking while being indifferent toward what one communicates are covered, and the phenomenon of 'bullshitting' is distinguished from lying and other forms of insincerity. Finally, an account of insincere uses of interrogative, imperative, and exclamative utterances is also given. (shrink)

So‐called nudge policies utilize insights from behavioral science to achieve policy outcomes. Nudge policies try to improve people's decisions by changing the ways options are presented to them, rather than changing the options themselves or incentivizing or coercing people. Nudging has been met with great enthusiasm but also fierce criticism. This paper provides an overview of the debate on the ethics of nudging to date. After outlining arguments in favor of nudging, we first discuss different objections that all revolve around (...) the worry that nudging vitiates personal autonomy. We split up this worry into different dimensions of autonomy, such as freedom of choice, volitional autonomy, rational agency, and freedom as nondomination. We next discuss worries that nudging is manipulative, violates human dignity, and prevents more important structural reform. Throughout, we will present responses that proponents of nudging can muster. On the whole, we conclude that the objections fail to establish that the nudge program as a whole should be rejected. At the same time, they give us important guidance when moving towards an ethical assessment of nudges on a case‐by‐case basis. Towards the end, we provide some possible ways forward in debates around the ethics of nudging. (shrink)

Traditionally, the manufacturer/operator of a machine is held (morally and legally) responsible for the consequences of its operation. Autonomous, learning machines, based on neural networks, genetic algorithms and agent architectures, create a new situation, where the manufacturer/operator of the machine is in principle not capable of predicting the future machine behaviour any more, and thus cannot be held morally responsible or liable for it. The society must decide between not using this kind of machine any more (which is not a (...) realistic option), or facing a responsibility gap, which cannot be bridged by traditional concepts of responsibility ascription. This article investigates structural aspects of source domains in metaphorical mappings with regard to their manifestation in public discourse data. Specifically, it analyses the organization of source concepts into mininarratives or "scenarios" that dominate the discourse manifestations of source domains. The material consists of examples from a bilingual corpus of British and German public debates about the &European Union.& The data show that while the two national samples share some basic mappings between the source and target domains, they each are (...) characterised further by specific scenarios that provide focal points for conceptualizing the target topic. The scenarios can also be shown to carry evaluative and attitudinal biases that are related to particular political dispositions and preferences of the respective national discourse communities. In conclusion, it will be argued that the analysis of scenarios is a necessary complement to the study of source domains and of domain-mappings in metaphorical language use. (shrink)

In _The Boundaries of Babel_, Andrea Moro tells the story of an encounter between two cultures: contemporary theoretical linguistics and the cognitive neurosciences. The study of language within a biological context has been ongoing for more than fifty years. The development of neuroimaging technology offers new opportunities to enrich the "biolinguistic perspective" and extend it beyond an abstract framework for inquiry. As a leading theoretical linguist in the generative tradition and also a cognitive scientist schooled in the new imaging (...) technology, Moro is uniquely equipped to explore this. Moro examines what he calls the "hidden" revolution in contemporary science: the discovery that the number of possible grammars is not infinite and that their number is biologically limited. This radical but little-discussed change in the way we look at language, he claims, will require us to rethink not just the fundamentals of linguistics and neurosciences but also our view of the human mind. Moro searches for neurobiological correlates of "the boundaries of Babel" -- the constraints on the apparent chaotic variation in human languages -- by using an original experimental design based on artificial languages. He offers a critical overview of some of the fundamental results from linguistics over the last fifty years, in particular regarding syntax, then uses these essential aspects of language to examine two neuroimaging experiments in which he took part. He describes the two neuroimaging techniques used, but makes it clear that techniques and machines do not provide interesting data without a sound theoretical framework. Finally, he discusses some speculative aspects of modern research in biolinguistics regarding the impact of the linear structure of linguistics expression on grammar, and more generally, some core aspects of language acquisition, genetics, and evolution.
