This article examines the contributions made towards eugenic thought in the late nineteenth and early twentieth centuries by Havelock Ellis . Ellis was a significant social reformer who worked on the problems of sexuality from a scientific–naturalist secular perspective. In the later phases of his work, after he had completed much of his writing on sexuality, Ellis concentrated on issues of feminism and eugenics—problems he thought were interlinked. In this paper, I integrate his ideas about these subjects, and consider the (...) ways in which Ellis and other liberal social reformers created a ‘eugenic subject’ in order to frame their arguments about social problems. In this article, we examine the political and educational relevance of Hannah Arendt’s account of friendship. Drawing from Arendt’s central works on friendship, we offer a novel interpretation of the concept by connecting the notion with the idea of educational ‘love for the world’, amor mundi. With this interpretation, we seek to demonstrate that the concept of friendship has both direct educational and indirect political significance. Thereby, we distinguish our interpretation from two previous understandings of the educational relevance of the (...) Arendtian notion of friendship—those by (1) Aaron Schutz and Marie G. Sandy, and (2) Morten T. Korsgaard—in which friendship is either assigned a specifically political role (as in (1)) or its significance to education is narrowly understood (as in (2)). We argue our interpretation of friendship offers both a new contribution to the understanding of the relationship between education and politics in the context of Arendt scholarship, and a novel way of thinking about the educational significance of friendship in the context of contemporary democratic politics, especially the prevailing political polarization. In December 2013, the Nonhuman Rights Project (NhRP) filed a petition for a common law writ of habeas corpus in the New York State Supreme Court on behalf of Tommy, a chimpanzee living alone in a cage in a shed in rural New York (Barlow, 2017). Under animal welfare laws, Tommy’s owners, the Laverys, were doing nothing illegal by keeping him in those conditions. Nonetheless, the NhRP argued that given the cognitive, social, and emotional capacities of chimpanzees, Tommy’s confinement constituted (...) a profound wrong that demanded remedy by the courts. Soon thereafter, the NhRP filed habeas corpus petitions on behalf of Kiko, another chimpanzee housed alone in Niagara Falls, and Hercules and Leo, two chimpanzees held in research facilities at Stony Brook University. Thus began the legal struggle to move these chimpanzees from captivity to a sanctuary, an effort that has led the NhRP to argue in multiple courts before multiple judges. The central point of contention has been whether Tommy, Kiko, Hercules, and Leo have legal rights. To date, no judge has been willing to issue a writ of habeas corpus on their behalf. Such a ruling would mean that these chimpanzees have rights that confinement might violate. Instead, the judges have argued that chimpanzees cannot be bearers of legal rights because they are not, and cannot be persons. In this book we argue that chimpanzees are persons because they are autonomous. (shrink)

VVe argue in this essay that the real violence in schools is a result of the structural violence of oppresive social conditions that force students, especially low-income African American and Latino males, tofeel vulnerable, angry, and resistant to the normative expectations of “police-like” school environments. Instead of making attempts to transform these oppressive conditions and explore alternatives outsideof these frameworks, schools utilize the ideological state apparatuses (ISA’s) to justify the construction of certain students (e.g., African American and Latino males) as (...) “violent/deviant/disabled” therebymaking it an individual rather than a social problem. On the other hand, we contend, a political economic analysis of educational contexts makes critical linkages between race, class, and disabilityand in doing so offers an alternative way of re-theorizing identity. Additionally this argument will aIso demonstrate how a political economic analysis exposes and re-orients one towards a collective (global) struggle for social transfornlation in critical multicultural contexts. Critical analyses of international financial markets tend to explain changes over recent decades in terms of a resurgent liberalism. This paper employs a systems theoretical approach to argue that there has been a far more fundamental transformation in the operations of these financial markets than simply a shift towards more liberalized regimes of regulation. The use of risk as resource and the systematic randomness of these new operational trends have perverse implications not only for the integrity of political systems but (...) also for the neoliberal promoters and players inside the new complex system of global finance. The "theory of mind" framework has been the fastest growing body of empirical research in contemporary psychology. It has given rise to a range of positions on what it takes to relate to others as intentional beings. This book brings together disparate strands of ToM research, lays out historical roots of the idea, and indicates better alternatives.

We submit this brief in support of the Nonhuman Rights Project’s efforts to secure habeas corpus relief for the elephant named Happy. We reject arbitrary distinctions that deny adequate protections to other animals who share with protected humans relevantly similar vulnerabilities to harms and relevantly similar interests in avoiding such harms. We strongly urge this Court, in keeping with the best philosophical standards of rational judgment and ethical standards of justice, to recognize that, as a nonhuman person, Happy should be (...) released from her current confinement and transferred to an appropriate elephant sanctuary, pursuant to habeas corpus. A disconnect remains between theories about responsible management and application in real-life organizations. Part of the reason is due to the complexity and holistic nature of the field, and the fact that many of the benefits of aligning business objectives with changing societal conditions are of an intangible nature. Human resource management is an increasingly important part of the field with benefits including talent retention, higher levels of motivation, and improvements in organizational cohesion. This paper sets out an experiment run (...) at a large Spanish university to try to analyze the impact on worker productivity of a responsible management stance by an employer. Based on the Corporate Social Performance model, the paper examines the issue from the point of view of responsibilities, responsiveness, and outcomes, and considers the cost/benefit effect of incorporating a social responsibility variable into the wage structure to measure the impact on productivity. An overview on archaeological evidence, provided by Colagè and d’Errico, reveals that the timing, location, and pace of cultural innovations are more consistent with scenarios that take culture, rather than genetic evolutionary processes, as the key driving force for human cognition. The authors elaborate on those mechanisms by which cultural evolution operates, with a specific focus on cultural exaptation and cultural neural reuse.

If we are to believe the proponents of the Theory of Practice and of Rational Choice, the gap between these two paradigmatic approaches cannot be bridged. They rely on ontological premises, theories of motivations and causal models that stand too far apart. In this article, I argue that this theoretical antinomy loses much of its edge when we take as objects of sociological investigation processes of historical change, that is, when we try to specify in theoretical terms how and in (...) which conditions historical actors enact and endorse shifts in patterns of relations as well as shifts in the symbolic and cognitive categories that make these relations significant. I substantiate this argument in light of the distinction between two temporalities of historical change: first, the long waves of gradual change and, second, the short waves of moments of breaks and ruptures. Along the way, I develop an argument about the conditions of emergence of self-limiting norms and the centrality of epistemic beliefs in situations of high disruption. (shrink)

Identifying, classifying, and analyzing arguments in legal discourse has been a prominent area of research since the inception of the argument mining field. However, there has been a major discrepancy between the way natural language processing (NLP) researchers model and annotate arguments in court decisions and the way legal experts understand and analyze legal argumentation. While computational approaches typically simplify arguments into generic premises and claims, arguments in legal research usually exhibit a rich typology that is important for gaining insights (...) into the particular case and applications of law in general. We address this problem and make several substantial contributions to move the field forward. First, we design a new annotation scheme for legal arguments in proceedings of the European Court of Human Rights (ECHR) that is deeply rooted in the theory and practice of legal argumentation research. Second, we compile and annotate a large corpus of 373 court decisions (2.3M tokens and 15k annotated argument spans). Finally, we train an argument mining model that outperforms state-of-the-art models in the legal NLP domain and provide a thorough expert-based evaluation. El trabajo utiliza las herramientas conceptuales de la discusión sobre injusticia epistémica para analizar tres contextos de cuidado emocional y la atención a la salud mental, tales como: las redes sociales de apoyo informal, la atención terapéutica y la atención psiquiátrica. El propósito es mostrar el tipo de dinámicas sociales que, en dichos contextos, derivan en una exclusión del testimonio de las personas que recurren a ellas. La tesis central sostiene que entender las diversas dinámicas sociales que propician los distintos (...) tipos de exclusiones, implica desglosar circunstancias sociales de diferente calado, algunas de las cuales se encuentran interrelacionadas, como lo representan la producción de sesgos derivados de diferentes tipos de prejuicios (de identidad o participación), mientras que, otras, responden a la constitución de un exceso de credibilidad otorgado a determinados campos expertos. De esta forma la invitación es a pensar que la restitución de la justicia epistémica en este tipo de atención y cuidado no depende ni de la corrección de una sola instancia social, ni de la mejora de un solo sistema experto. Positive reappraisal strategies have been found to reduce negative affect following the recall of negative personal events. This study examined the restorative effect of two mood-repair instructions (self-compassion vs benefit-focused reappraisal) and a control condition with no instructions following a negative Mood Induction Procedure by using the guided recall of a negative autobiographical event. A total of 112 university students participated in the online study (81% women, Mage: 21.0 years). Immediately following the negative memory recall, participants were randomised to each (...) condition [(self-compassion: n = 36, benefit-focused: n = 39) or a control condition (n = 37)]. Repeated measures ANOVAs 3 (Repair condition) × 3 (Time of mood assessment: pre-recall, post-recall, post-regulation) showed that, as expected, negative mood (sadness, shame, and guilt) worsened significantly after the guided recall in all groups (p <.001). After the mood-repair intervention, participants in the self-compassion and benefit-focused conditions showed a significant reduction in negative mood (p <.019), while such improvement was not observed in the control group. Self-compassion and benefit-focused reappraisal functioned similarly as mood repair strategies after experiencing negative affect induced by the recall of negative personal memories. Implications in the context of autobiographical memory biases are discussed. (shrink)

Conversation analysts have noted that, in psychotherapy, formulations of the client's talk can be a vehicle for offering a psychological interpretation of the client's circumstances. But we notice that not all formulations in psychotherapy offer interpretations. We offer an analysis of formulations that are diagnostic: that is, used by the professional to sharpen, clarify or refine the client's account and make it better able to provide what the professional needs to know about the client's history and symptoms. In doing so, (...) these formulations also have the effect of shepherding the client's account towards subsequent therapeutic interpretation. In a coda, we notice that sometimes the formulations are designed discreetly. We examine one such discreet formulation in detail, and show how its very ambiguity can lead to its failure as a diagnostic probe. (shrink)

Statements of degree appear to falsify basic doctrines in Tractatus Logico-Philosophicus. I offer a fresh formulation of the challenge and assess a solution proposed on Wittgenstein’s behalf by Sarah Moss. I find that Moss’s proposal fails. The proposal rides in part on novel interpretations of pronouncements by Wittgenstein on the nature of the elementary proposition. I find that the interpretations cannot be sustained but that Moss’s textual case hints at important and overlooked features of the Tractarian program. I develop Wittgenstein’s (...) comparison of propositions to measuring instruments and apply it throughout, showing that it captures philosophical commitments in Tractatus that otherwise tend to slip from view. Frege's account of indirect proof has been thought to be problematic. This thought seems to rest on the supposition that some notion of logical consequence ? which Frege did not have ? is indispensable for a satisfactory account of indirect proof. It is not so. Frege's account is no less workable than the account predominant today. Indeed, Frege's account may be best understood as a restatement of the latter, although from a higher order point of view. O utopianismo científico de Neurath é a proposta para que as ciências sociais se envolvam na elaboração, desenvolvimento e comparação de cenários contrafactuais, as ‘utopias’. Tais cenários podem ser entendidos como peças centrais de experimentos de pensamento científicos, isto é, em exercícios da imaginação que não apenas promovem a revisão conceitual, mas também estimulam a criatividade para lidar com problemas vivenciados, já que utopias são esforços para imaginar como o futuro poderia ser. Ademais, experimentos de pensamento utópicos podem oferecer conhecimento (...) científico para informar debates e decisões políticas, contribuindo para formatar a sociedade. Este ensaio reconstrói um evento histórico como um exemplo da metodologia utopianista de Neurath. No final dos anos 1970 e início dos anos 1980, uma comissão científica e política designada pelo parlamento da Alemanha Ocidental inventou e comparou quatro cenários para políticas energético-econômicas futuras. Conclusões da comissão informaram decisões políticas que puseram a Alemanha Ocidental (e depois reunificada) em um caminho para se tornar uma potência industrial verde. Uma parte fundamental do trabalho da comissão envolveu um apelo à imaginação, permitindo a caracterização sob a metodologia de Neurath. (shrink)

Recent theological anthropology emphasizes a dynamic and integral understanding of the human being, which is also related to Karl Rahner's idea of active self-transcendence and to the imago Dei doctrine. The recent neuroscientific discovery of the “visual word form area” for reading, regarded in light of the concept of cultural neural reuse, will produce fresh implications for the interrelation of brain biology and human culture. The theological and neuroscientific parts are shown in their mutual connections thus articulating the notion that (...) human beings shape and transcend themselves both at the biological and at the cultural level. This will have relevant implications for the timely topic of human uniqueness in science and theology, and in proposing a new research perspective in which theology may consider culture along with its biological import, but not necessarily in strictly evolutionary terms alone. One of the areas of concern raised by cross-border reproductive travel regards the treatment of women who are solicited to provide their ova or surrogacy services to foreign consumers. This is particularly troublesome in the context of developing countries where endemic poverty and low standards for both medical care and informed consent may place these women at risk of exploitation and harm. We explore two contrasting proposals for policy development regarding the industry, both of which seek to promote ethical outcomes (...) and social justice: While one proposal advocates efforts to minimize cross-border demand for female reproductive resources through the pursuit of national self-sufficiency, the other defends cross-border trade as a means for meeting the needs of vulnerable groups. Despite the conflicting objectives of the proposed strategies, the paper identifies common values and points of agreement between the two, including the importance of regulations to safeguard those providing ova or surrogacy services. In this brief, we argue that there is a diversity of ways in which humans (Homo sapiens) are ‘persons’ and there are no non-arbitrary conceptions of ‘personhood’ that can include all humans and exclude all nonhuman animals. To do so we describe and assess the four most prominent conceptions of ‘personhood’ that can be found in the rulings concerning Kiko and Tommy, with particular focus on the most recent decision, Nonhuman Rights Project, Inc v Lavery.

Certain cognitive and philosophical aspects of the concept of conceivability with intended or established diversion from reality are discussed. The “coherence gap problem” arises when certain fragments of the real world are replaced with imaginary situations while most details are ignored. Another issue, “the spectator problem”, concerns the participation of the conceiver himself in the world conceived. Three different examples of conceivability are used to illustrate our points, namely thought experiments in physics, a hypothetical world devoid of consciousness , and (...) virtual reality. (shrink)
