We show that three fundamental information-theoretic constraints -- the impossibility of superluminal information transfer between two physical systems by performing measurements on one of them, the impossibility of broadcasting the information contained in an unknown physical state, and the impossibility of unconditionally secure bit commitment -- suffice to entail that the observables and state space of a physical theory are quantum-mechanical. We demonstrate the converse derivation in part, and consider the implications of alternative answers to a remaining open question about (...) nonlocality and bit commitment. (shrink)

This article responds to Professor Romano’s piece in this issue. It concerns our ongoing debate with regard to the desirability of permitting issuers to choose the securities regulation regime by which they are bound. Romano favors issuer choice, arguing that it would result in jurisdictional competition to offer issuers share value maximizing regulations. I, in contrast, believe that abandoning the current mandatory system of federal securities disclosure would likely lower, not increase, U.S. welfare. Each issuer, I argue, would select a (...) regime requiring a level of disclosure less than is socially optimal because its private costs of disclosure would be greater than the social costs of such disclosure. Professor Romano and I agree on most of the basic analytic building blocks for deciding whether issuer choice is a desirable reform: belief in analyzing the problem in terms of the broadly accepted principles of modern financial economics; recognition that disclosure has costs as well as benefits; and acknowledgment that incentives exist for issuers to provide at least some disclosure. We nevertheless reach the opposite conclusion on the desirability of issuer choice. To start, Romano believes that issuers’ private costs of disclosure will not generally be greater than the social costs of such disclosure, whereas I show they will be. Romano argues as well that this is a special case in which any divergence of private and social costs that does exist will not lead to a market failure, at least one possibly correctable by public regulation. I show her argument to be unpersuasive. Finally, Romano interprets the existing empirical evidence as proving mandatory disclosure’s lack of social value, while I show that the evidence in fact does not point in either direction. Where, as here, the theoretical case for the existence of a market failure is strong and the current program for dealing with it is widely admired, the advocate of change should have the burden of proof. Professor Romano has not met this burden. If she is serious about advancing her proposal for issuer choice, she needs to show that despite the market failure inherent in issuer choice, there is inevitably an even greater failure in the regulatory response. Absent such a showing, mandatory disclosure should be retained. (shrink)

In this paper we argue that there are valuable consonances between democratic theory and music theory, and between democratization and musical performance and enjoyment. We suggest that this connection is not as trite as it may first appear, but that, since democracy is learned and practiced in a myriad ofways, music is one such place to learn democratic citizenship. The paper begins with a normative account of democratic theory that is present in two movements. The first, “foundations,” explicates the essential (...) components, criteria, and conditions of democracy. The second, “flows,” addresses the dynamism of democratization. Here is an account of what democracy looks like in action. We then turn to an explication of music theory and improvisation. Here, we focus on jazz as a way to hear the kind of interplay, responsiveness, accountability, discipline, and extemporaneousness that occurs in good jazz, and in authentic (radical) democracy. We study thorn forking and rosiness in the context of continuous logic. We prove that the Urysohn sphere is rosy (with respect to finitary imaginaries), providing the first example of an essentially continuous unstable theory with a nice notion of independence. In the process, we show that a real rosy theory which has weak elimination of finitary imaginaries is rosy with respect to finitary imaginaries, a fact which is new even for discrete first-order real rosy theories.

We develop a basic theory of rosy groups and we study groups of small Uþ-rank satisfying NIP and having finitely satisfiable generics: Uþ-rank 1 implies that the group is abelian-by-finite, Uþ-rank 2 implies that the group is solvable-by-finite, Uþ-rank 2, and not being nilpotent-by-finite implies the existence of an interpretable algebraically closed field.

We use the comparative method of language acquisition research to investigate children’s expression of directional expressions in two Eastern Mayan languages – K’iche’ and Mam. Both languages add clitics derived from verbs such as ‘go’ and ‘stay’ to their verb complex to express the direction an agent takes in the course of accomplishing an event. Historic changes to the prosodic structure of the verb complex in both languages explain why the directional clitics are predominately postverbal in K’iche’, while they occur (...) in preverbal and postverbal positions in Mam. Prosody explains why K’iche’ children initially produce clitics postverbally, while Mam children produce clitics both preverbally and postverbally. Prosody also explains why the children acquiring both languages produce morphemes in the verb complex that are relatively infrequent but prosodically prominent, while omitting obligatory morphemes that are prosodically weak. We define a notion of residue field domination for valued fields which generalizes stable domination in algebraically closed valued fields. We prove that a real closed valued field is dominated by the sorts internal to the residue field, over the value group, both in the pure field and in the geometric sorts. These results characterize forking and þ-forking in real closed valued fields (and also algebraically closed valued fields). We lay some groundwork for extending these results to a power-bounded T-convex (...) theory. (shrink)

This article describes our efforts to screen and enrol clinical trial participants conscientiously in the COVID-19 pandemic setting. We present the standard screening and enrolment process prior to, and our process of adapting to, the pandemic. Our goal was to develop a way to screen and enrol people for clinical trials that was both equitable and effective. In addition, we outline the steps our research department took to ensure that ethical, clinical and logistical factors were considered when matching a patient (...) to a clinical trial. (shrink)

Unethical pro-organizational behaviors are unethical, but prosocially-motivated, acts intended to benefit one’s organization. This study examines the extent to which employees are willing to perform UPB to benefit a liked leader. Based on social exchange theory, we hypothesized that LMX would mediate the association of interpersonal justice with UPB willingness. Moral identity and positive reciprocity beliefs were examined as moderators. Higher LMX was significantly and positively related to UPB willingness, and the indirect effect of interpersonal justice on UPB via LMX (...) was significant and positive. These findings suggest that LMX and interpersonal justice could have a previously-unexplored dark side. Moral identity had a negative direct relationship with UPB, but it did not moderate the relationship of LMX with UPB. Thus, LMX facilitates UPB willingness even when employees are high in moral identity. LMX is associated with many positive outcomes, but our results show that high LMX may also increase willingness to perform unethical behaviors to benefit one’s leader. These results contribute to the literature by identifying a potential negative outcome associated with high LMX. (shrink)

A survey of university students tested whether committing animal abuse during childhood was related to approval of interpersonal violence against children and women in families. Respondents who had abused an animal as children or adolescents were significantly more likely to support corporal punishment, even after controlling for frequency of childhood spanking, race, biblical literalism, and gender. Those who had perpetrated animal abuse were also more likely to approve of a husband slapping his wife. Engaging in childhood violence against less powerful (...) beings— animals—may generalize to the acceptance of violence against less powerful members of families and society—women and children. Openness and transparency are becoming hallmarks of responsible data practice in science and governance. Concerns about data falsification, erroneous analysis, and misleading presentation of research results have recently strengthened the call for new procedures that ensure public accountability for data-driven decisions. Though we generally count ourselves in favor of increased transparency in data practice, this Commentary highlights a caveat. We suggest that legislative efforts that invoke the language of data transparency can sometimes function as “Trojan Horses” through which other political (...) goals are pursued. Framing these maneuvers in the language of transparency can be strategic, because approaches that emphasize open access to data carry tremendous appeal, particularly in current political and technological contexts. We illustrate our argument through two examples of pro-transparency policy efforts, one historical and one current: industry-backed “sound science” initiatives in the 1990s, and contemporary legislative efforts to open environmental data to public inspection. Rules that exist mainly to impede science-based policy processes weaponize the concept of data transparency. The discussion illustrates that, much as Big Data itself requires critical assessment, the processes and principles that attend it—like transparency—also carry political valence, and, as such, warrant careful analysis. Only recently have sociologists considered the role of nonhuman animals in human society. The few studies undertaken of battered women and their animal companions have revealed high rates of animal abuse co-existing with domestic violence. This study examines several aspects of the relationship between humans and animals in violent homes. The study explored the role of companion animals in the abusive relationship through in-depth, semi-structured interviews with clients at a battered women's shelter. In particular, the study focused on the use (...) of companion animals by women's violent partners to control, hurt, and intimidate the women; the responses of the animals to the women's victimization; and the role of pets as human surrogates and the resulting symbolic interaction between human and nonhuman family members. The significance of the findings for family violence research and application are discussed, as well as the broader implications for sociological investigation of human-animal interaction. (shrink)

Sociologists have largely ignored the role of animals in society. This article argues that human-animal interaction is a topic worthy of sociological consideration and applies a sociological analysis to one problematic aspect of human-animal relationships - animal cruelty. The article reformulates animal cruelty, traditionally viewed using a psychopathological model, from a sociological perspective.The article identifies social and cultural factors related to the occurrence of animal cruelty. Ultimately, animal cruelty is a serious social problem that deserves attention in its own right, (...) not just because of its association with human violence. (shrink)

There can be no doubt that Kant thought we should be reflective: we ought to care to make up our own minds about how things are and what is worth doing. Philosophical objections to the Kantian reflective ideal have centred on concerns about the excessive control that the reflective person is supposed to exert over her own mental life, and Kantians who feel the force of these objections have recently drawn attention to Kant’s conception of moral virtue as it is (...) developed in his later work, chiefly the Metaphysics of Morals. Melissa Merritt’s book is a distinctive contribution to this recent turn to virtue in Kant scholarship. Merritt argues that we need a clearer, and textually more comprehensive, account of what reflection is, in order not only to understand Kant’s account of virtue, but also to appreciate how it effectively rebuts long-standing objections to the Kantian reflective ideal.
