Recent evaluation of the practice of euthanasia and related medical decisions at the end of life in the Netherlands has shown a slight decrease in the frequency of physician-assisted death since the enactment of the Euthanasia Law in 2002. This paper focuses on the absence of euthanasia cases concerning patients with dementia and a written advance euthanasia directive, despite the fact that the only real innovation of the Euthanasia Law consisted precisely in allowing physicians to act upon such directives. The (...) author discusses two principal reasons for this absence. One relates to the uncertainty about whether patients with advanced dementia truly experience the suffering they formerly feared. There is reason to assume that they don’t, as a consequence of psychological adaptation and progressive unawareness (anosognosia). The second, more fundamental reason touches upon the ethical relevance of shared understanding and reciprocity. The author argues that, next to autonomy and mercifulness, “reciprocity” is a condition sine qua non for euthanasia. The absence thereof in advanced dementia renders euthanasia morally inconceivable, even if there are signs of suffering and notwithstanding the presence of an advance euthanasia directive. This does not mean, however, that advance euthanasia directives of patients with dementia are worthless. They might very well have a role in the earlier stages of certain subtypes of the disease. To illustrate this point the author presents a case in which the advance directive helped to create a window of opportunity for reciprocity and shared decision-making. (shrink)

It has long been thought that Romans did not hunt before the time of Scipio Aemilianus because hunting was not an activity for respectable citizens. This article shows that this tradition arose from a nineteenth-century bias for hunting on horseback. The tradition was supported principally by Polybius' account of Scipio's hunting and a quotation from Sallust. Although we now recognize that Greeks and Romans in general hunted on foot, this bias has predisposed the discussion against the discovery of evidence for (...) the actual practice of hunting among the early Romans. The archaeological evidence from new excavations in Latium and previously uncited historical and legal evidence for hunting in the Republican period demonstrate that, precisely as we would expect, Romans from the earliest days hunted. Hunting as an aristocratic sport, as a communal activity associated with the military preparation of soldier-citizens, and as a practical means of survival for the poorer countrymen, were all present in Roman society. Further, Polybius' account of Scipio's hunting, contrary to what has been argued, indicates that the cause of disapproval was not the fact that Scipio hunted, but rather that he hunted instead of pleading cases in the forum. Supporting evidence from Cato the Elder, Ennius, and Plautus shows that hunting was a common and accepted activity among Romans of the mid-Republic. Finally, Sallust's criticism of hunting cannot be assumed to represent Roman views, since he condemns farming and hunting together, and we know Romans highly respected farming. No evidence supporting a negative view of hunting in Roman society is found, and the positive evidence in sum demonstrates conclusively that in all periods Romans did indeed hunt. (shrink)

The effects of school inspections on school improvement have been investigated only to a limited degree. The investigation reported on in this article is meant to expand our knowledge base regarding the impact of school inspections on school improvement. The theoretical framework for this research is partly based on the policy theory behind the Dutch Educational School Supervision Act (the latter includes assumptions about how school inspections lead to school improvement). Interviews and a survey with school inspectors gave insight into (...) how school inspectors implement the Supervision Act and how they assess schools, and stimulate schools to improve. The results of ten case studies showed that all schools started to improve after a school visit. The innovation capacity of the school and the school environment do not seem to contribute to school improvement after school inspections. No effects were found on school-improvement processes of the number of insufficient scores that schools received from inspectors, the extent of feedback and suggestions for improvement, and the number of agreements. The provision of feedback about weaknesses, the assessment of these weak points as unsatisfactory, and the agreements between an inspector and the school regarding improvement activities do appear to make a difference in promoting school improvement. This discloses the logical form of the book by distinct reading units, linked into a fashioned hierarchical tree. The text becomes much clearer and every reader can enjoy, finally, its formal and literary qualities.

This article describes a theory about the ambition of most Inspectorates to realise 'school improvement through inspection'. Literature about a number of direct and indirect interventions, such as reciprocity, communication and feedback is used to build a theoretical model stating the relations between working methods of school inspectors, reactions of schools and resulting effects and side effects. Finally two types of inspections strategies are described that can be used in different types of schools. We expect schools with a low innovation (...) capacity and few external impulses to be helped best by a directive approach in which an inspector clearly points to the strong and weak points of the school, the probable causes of their level of functioning, and potential ways for improvement. The inspector should pressure the school to change by making written agreements on how to change and by asking the school to work out these agreements in an improvement plan. A school with a high innovation capacity and strong external impulses is expected to do better with a more reserved inspection approach. Inspectors only need to provide this school with some insight into their strong and weak points. (shrink)

It is the argument of this paper that many aspects of Lucan's characterization in the Bellum Civile of Caesar and Pompey, and of the conflict itself, reflect a ritual combat for kingship such as the combat and murder codified in the myth of Romulus and Remus. It was a well-established convention by Ennius's time, further developed in the late Republic, that the conflict between the founding brothers over control of Rome was the ultimate cause for the Civil Wars. The religious (...) basis of this myth can be found in the rites of the priest of Diana at Aricia, the rex nemorensis, which were still extant in Lucan's time. The evidence for Lucan's use of this paradigm is reviewed, and Book 3 of the Bellum Civile is then reassessed in the terms that it suggests. The themes of sacred place , scared combat, and the necessary murder are most clearly presented in Book 3. It is further argued that seeming inconsistencies in the nature of the gods in Lucan's epic can be at least partially resolved if we understand that the gods must remain aloof and outside the action while the ritual takes place, even though they themselves have instituted the ritual of kingship murder, and will, when it is completed, receive the murderer as their ritually validated priest-king. In the conclusion, ways are suggested in which this paradigm, if accepted, begins to clarify various puzzling choices Lucan has made elsewhere in the epic regarding his narrative of events, his development of character, and the recurrent images of lightning, tree, and blood-sacrifice owed to the gods. Despite many reservations, Transition to an Ordinal Metaphysics is interesting because it continues a tradition which takes the metaphysical enterprise seriously, which attempts to examine the nature and function of metaphysics, and which attempts to communicate the insights and conceptual power of what Ross terms the ordinal approach to that enterprise.

The optimal design of cables under selfweight and concentrated loads is considered and the maximum feasible span for a given permissible stress is evaluated. All solutions are obtained in a closed analytical form.

It has recently been argued that hope is polysemous in that it sometimes refers to hoping and other times to being hopeful. That it has these two distinct senses is reflected in the observation that a person can hope for an outcome without being hopeful that it will occur. Below, I offer a new argument for this distinction. My strategy is to show that accepting this distinction yields a rich account of two distinct ways in which hope can be lost, (...) ways that map onto the two senses of hope: A person can lose hope either by ceasing to hope for an outcome (hopelessness) or by ceasing to be hopeful that it will obtain (despair). Thinking about these negative attitudes in these two ways, I contend, is explanatorily rich and fruitfully reveals how they differ in phenomenology, behavioral differences, and the ways in which a person can escape them. Since the BBS article in which Premack and Woodruff (1978) asked “Does the chimpanzee have a theory of mind?,” it has been repeatedly claimed that there is observational and experimental evidence that apes have mental state concepts, such as “want” and “know.” Unlike research on the development of theory of mind in childhood, however, no substantial progress has been made through this work with nonhuman primates. A survey of empirical studies of imitation, self-recognition, social relationships, deception, role-taking, and perspective-taking suggests (...) that in every case where nonhuman primate behavior has been interpreted as a sign of theory of mind, it could instead have occurred by chance or as a product of nonmentalistic processes such as associative learning or inferences based on nonmental categories. Arguments to the effect that, in spite of this, the theory of mind hypothesis should be accepted because it is more parsimonious than alternatives or because it is supported by convergent evidence are not compelling. Such arguments are based on unsupportable assumptions about the role of parsimony in science and either ignore the requirement that convergent evidence proceed from independent assumptions, or fail to show that it supports the theory of mind hypothesis over nonmentalist alternatives. Progress in research on theory of mind requires experimental procedures that can distinguish the theory of mind hypothesis from nonmentalist alternatives. A procedure that may have this potential is proposed. It uses conditional discrimination training and transfer tests to determine whether chimpanzees have the concept “see.” Commentators are invited to identify flaws in the procedure and to suggest alternatives.
