In this paper we discuss the application of a new machine learning approach – Argument Based Machine Learning – to the legal domain. An experiment using a dataset which has also been used in previous experiments with other learning techniques is described, and comparison with previous experiments made. We also tested this method for its robustness to noise in learning data. Argumentation based machine learning is particularly suited to the legal domain as it makes use of the justifications of decisions (...) which are available. Importantly, where a large number of decided cases are available, it provides a way of identifying which need to be considered. Using this technique, only decisions which will have an influence on the rules being learned are examined. (shrink)

In this article, we examine the political and educational relevance of Hannah Arendt’s account of friendship. Drawing from Arendt’s central works on friendship, we offer a novel interpretation of the concept by connecting the notion with the idea of educational ‘love for the world’, amor mundi. With this interpretation, we seek to demonstrate that the concept of friendship has both direct educational and indirect political significance. Thereby, we distinguish our interpretation from two previous understandings of the educational relevance of the (...) Arendtian notion of friendship—those by (1) Aaron Schutz and Marie G. Sandy, and (2) Morten T. Korsgaard—in which friendship is either assigned a specifically political role (as in (1)) or its significance to education is narrowly understood (as in (2)). We argue our interpretation of friendship offers both a new contribution to the understanding of the relationship between education and politics in the context of Arendt scholarship, and a novel way of thinking about the educational significance of friendship in the context of contemporary democratic politics, especially the prevailing political polarization. VVe argue in this essay that the real violence in schools is a result of the structural violence of oppresive social conditions that force students, especially low-income African American and Latino males, tofeel vulnerable, angry, and resistant to the normative expectations of “police-like” school environments. Instead of making attempts to transform these oppressive conditions and explore alternatives outsideof these frameworks, schools utilize the ideological state apparatuses (ISA’s) to justify the construction of certain students (e.g., African American and Latino males) as (...) “violent/deviant/disabled” therebymaking it an individual rather than a social problem. On the other hand, we contend, a political economic analysis of educational contexts makes critical linkages between race, class, and disabilityand in doing so offers an alternative way of re-theorizing identity. Additionally this argument will aIso demonstrate how a political economic analysis exposes and re-orients one towards a collective (global) struggle for social transfornlation in critical multicultural contexts. Lackey’s (2007) class of “selfless assertions” is controversial in at least two respects: it allows propositions that express Moorean absurdity to be asserted warrantedly, and it challenges the orthodox view that the speaker’s belief is a necessary condition for warranted assertibility. With regard to the former point, I critically examine Lackey’s broadly Gricean treatment of Moorean absurdity and McKinnon’s (2015) epistemic approach. With regard to the latter point, I defend the received view by supporting the knowledge account, on which knowledge (...) is the necessary condition for warranted assertion. After examining two defenses of KA, by Montminy and Turri, I propose two alternative approaches. Although I remain neutral between them, I develop in more detail the view which classifies “selfless assertions” as “presentations”, a type of assertives distinct from genuine assertions. This account is motivated further by allowing for the expansion of the normative approach to other assertives, a feature we may be interested in, in the light of a recent wave of normative accounts of speech acts. O utopianismo científico de Neurath é a proposta para que as ciências sociais se envolvam na elaboração, desenvolvimento e comparação de cenários contrafactuais, as ‘utopias’. Tais cenários podem ser entendidos como peças centrais de experimentos de pensamento científicos, isto é, em exercícios da imaginação que não apenas promovem a revisão conceitual, mas também estimulam a criatividade para lidar com problemas vivenciados, já que utopias são esforços para imaginar como o futuro poderia ser. Ademais, experimentos de pensamento utópicos podem oferecer conhecimento (...) científico para informar debates e decisões políticas, contribuindo para formatar a sociedade. Este ensaio reconstrói um evento histórico como um exemplo da metodologia utopianista de Neurath. No final dos anos 1970 e início dos anos 1980, uma comissão científica e política designada pelo parlamento da Alemanha Ocidental inventou e comparou quatro cenários para políticas energético-econômicas futuras. Conclusões da comissão informaram decisões políticas que puseram a Alemanha Ocidental (e depois reunificada) em um caminho para se tornar uma potência industrial verde. Uma parte fundamental do trabalho da comissão envolveu um apelo à imaginação, permitindo a caracterização sob a metodologia de Neurath. (shrink)

Multiple selves is a conventional assumption in behavioural welfare economics for modelling intrapersonal well-being. Yet an important question is which self has normative authority over others. In this paper, we advance an argument for what we call the ‘ontological approach’ to personal identity in behavioural welfare economics. According to this approach, ethical questions – such as which preference should be granted normative authority over another – can be informed by the ontological criterion of personal persistence, which aims at determining what (...) it takes for an individual to persist from one time to another. An overview on archaeological evidence, provided by Colagè and d’Errico, reveals that the timing, location, and pace of cultural innovations are more consistent with scenarios that take culture, rather than genetic evolutionary processes, as the key driving force for human cognition. The authors elaborate on those mechanisms by which cultural evolution operates, with a specific focus on cultural exaptation and cultural neural reuse.

An assertion is existentially known if and only if: (i) the speaker knows that the sentence she uses to make the assertion expresses a true proposition; (ii) she makes the assertion based on that knowledge; and (iii) she does not believe, have justification for, or know the proposition asserted. Accordingly, if existentially known assertions could be made correctly—as argued by Charlie Pelling in his ‘Assertion and the Provision of Knowledge’—this would show that the norm of assertion cannot be the speaker's (...) belief in, justification for or knowledge of the proposition. In this paper, I try to show that Pelling's argument is inconclusive, as it rests on two assumptions which can be resisted. In turn, I offer a pair of alternative strategies to explain how we can deal with existentially known assertions under the assumption that the speaker's knowledge is the norm of assertion. (shrink)

Conversation analysts have noted that, in psychotherapy, formulations of the client's talk can be a vehicle for offering a psychological interpretation of the client's circumstances. But we notice that not all formulations in psychotherapy offer interpretations. We offer an analysis of formulations that are diagnostic: that is, used by the professional to sharpen, clarify or refine the client's account and make it better able to provide what the professional needs to know about the client's history and symptoms. In doing so, (...) these formulations also have the effect of shepherding the client's account towards subsequent therapeutic interpretation. In a coda, we notice that sometimes the formulations are designed discreetly. We examine one such discreet formulation in detail, and show how its very ambiguity can lead to its failure as a diagnostic probe. (shrink)

En primer lugar, se representa el modelo educativo centrado en la transmisión de conceptos, sin duda el más arraigado y tradicional en el contexto europeo-continental. En segundo lugar, se procede examinando el paradigma formativo por problemas, enfocado en el desarrollo de la capacidad analítica. En tercer lugar, se ilustra el método (...) educativo que entrena el discernimiento, impulsando la capacidad de elección, entre una multitud de opciones posibles, y empoderando la toma de decisiones racionalmente motivadas. Epistemic logic is one of the most exciting areas in medieval philosophy. Neglected almost entirely after the end of the Middle Ages, it has been rediscovered by philosophers of the twentieth century. Epistemic Logic in the Later Middle Ages provides the first comprehensive study of the subject. Ivan Boh explores the contrast between epistemic and alethic conceptions of consequence, the general epistemic rules of consequence, the search for conditions of knowing contingent propositions, the problems of substitutivity in intentional contexts, (...) the considerations of epistemic/doxastic iterated modalities, and the problems of composite and divided senses in authors ranging from Abelard to Frachantian. Boh concludes with a comparison between medieval endeavors and the epistemic logic of our own times. Written in a clear and readable style with minimal symbolic apparatus, this book employs modern symbolism and conceptual frameworks, and complements the studies of the syntacticand semantic dimensions of medieval logic. Responsible management learning has emerged as a discipline to prepare managers to act as responsible leaders that can effectively address such pressing challenges. This article aims to extend current knowledge on RML in the domain of corporate sustainability through the application of threshold concepts, novel ideas which provide a doorway to new knowledge and transform a learner’s mindset. Specifically, after conducting a systematic review of the management literature, (...) we identify 33 CS threshold concepts that are useful for mainstream managers and practitioners in their RML process. We group them into six CS threshold concept themes that can help managers understand the complexities and interconnectedness that characterize CS. Finally, we map CS threshold concepts with key competences for effective RML. Therefore, our contribution relies on translating existing CS theoretical frameworks into transformative, specific, understandable and applicable pieces of knowledge that might help mainstream managers to embed CS principles in their daily management practices. We use this editorial essay as a call for a more effective use of new technologies, such as mobile apps and Web 2.0 tools, to educate students and other relevant stakeholders on business ethics, corporate social responsibility, and sustainability topics. We identify three overarching reasons that justify the need for new ways of teaching that further incorporate technology to foster the innovative thinking needed to tackle imminent societal grand challenges such as climate change and increasing inequality. First, we are facing (...) a new generation of millennials and Generation Z students who are digital natives and more likely to search for educational content on their electronic devices. Second, new technologies offer opportunities to reach students globally, helping to democratize education. Third, we posit that the intrinsic characteristics of societal grand challenges, which are complex, uncertain, and evaluative, can benefit from technology as an effective translator of multilayered concepts into more digestible action items. Our essay ends with a brief summary of the four essays included in the thematic symposium: “There is an App for that! The Use of New Technologies and Apps in Ethics, Corporate Social Responsibility and Sustainability Education.”. (shrink)

Voluntary sustainability standards that establish global rules for firms’ environmental and/or social conduct and allow for verification of firm compliance via third-party certification hold the promise to govern firms’ sustainability conduct in a globalizing world economy. However, the recent proliferation of competing and overlapping global sustainability standards that have been developed by various stakeholders with different agendas, creates uncertainties for firms that likely reduce their propensity to adopt any standard. Without widespread adoption these standards cannot effectively govern firm conduct and (...) in contrast create barriers for firms’ access to export markets. We suggest that the uncertainties associated with competing standards and the effect of these uncertainties on standard certification decisions are especially large for firms in emerging economies because these firms lack access to information about current and future standards and the resources to obtain certifications to multiple standards. We theoretically propose and empirically identify three distinct sources of sustainability standard uncertainty: diversity of customer requirements, dynamism of customer requirements, and the unpredictability of the future evolution of standard and propose that each of these sources reduces firms’ propensity to obtain certification to any standard. Our empirical results based on certifications to food safety standards by a sample of 97 Mexican food exporting firms confirm that three distinct sources of sustainability standard uncertainty exist and that all of them negatively impact certification. We discuss ethical implications and offer recommendations for both suppliers as well as standard setting organizations. (shrink)

In the wake of Stalin's death, many Soviet scientists saw the opportunity to promote their methods as tools for the engineering of economic prosperity in the socialist state. The mathematician Leonid Kantorovich (1912–1986) was a key activist in academic politics that led to the increasing acceptance of what emerged as a new scientific persona in the Soviet Union. Rather than thinking of his work in terms of success or failure, we propose to see his career as exemplifying a distinct form (...) of scholarship, as a partisan technocrat, characteristic of the Soviet system of knowledge production. Confronting the class of orthodox economists, many factors were at work, including Kantorovich's cautious character and his allies in the Academy of Sciences. Drawing on archival and oral sources, we demonstrate how Kantorovich, throughout his career, negotiated the relations between mathematics and economics, reinterpreted political and ideological frames, and reshaped the balance of power in the Soviet academic landscape. This article analyzes the adoption of voluntary environmental management programs by firms operating in Mexico. Mexican firms can obtain national certification (Clean Industry) and/or international certification (ISO 14001). Based on institutional entrepreneurship theory, we posit that the role played by first movers as institutional entrepreneurs is crucial if these programs are to become established with sufficient strength and appeal. This understanding is especially important in an environment where more than one program can be adopted. We tested several hypotheses on the (...) behaviors of 1328 facilities operating in Mexico, half of which (664) had certified environmental management programs. Of the 664 certified facilities, 217 were classified as early adopters. Three variables predicted the likelihood of a facility being an early adopter: (1) connected to international market, (2) in the maquila sector, and (3) linked to an industry association that offers free resources. In virtue of what does a linguistic act count as an insult? I discuss five main approaches to this question, according to which an insult is determined by (i) the semantic properties of the expression used; (ii) the insulter, her intention, or attitudes; (iii) the addressee and her personal standard; (iv) the features of the speech act performed; and (v) the standard of the relevant social group. I endorse the last, objectivist account, according to which an act x counts as (...) an insult if and only if x is assessed as demeaning when addressed at A by the standard of the relevant social group at t. Positive reappraisal strategies have been found to reduce negative affect following the recall of negative personal events. This study examined the restorative effect of two mood-repair instructions (self-compassion vs benefit-focused reappraisal) and a control condition with no instructions following a negative Mood Induction Procedure by using the guided recall of a negative autobiographical event. A total of 112 university students participated in the online study (81% women, Mage: 21.0 years). Immediately following the negative memory recall, participants were randomised to each (...) condition [(self-compassion: n = 36, benefit-focused: n = 39) or a control condition (n = 37)]. Repeated measures ANOVAs 3 (Repair condition) × 3 (Time of mood assessment: pre-recall, post-recall, post-regulation) showed that, as expected, negative mood (sadness, shame, and guilt) worsened significantly after the guided recall in all groups (p <.001). After the mood-repair intervention, participants in the self-compassion and benefit-focused conditions showed a significant reduction in negative mood (p <.019), while such improvement was not observed in the control group. Self-compassion and benefit-focused reappraisal functioned similarly as mood repair strategies after experiencing negative affect induced by the recall of negative personal memories. Implications in the context of autobiographical memory biases are discussed. (shrink)

Economic methodologists most often study the relations between models and reality while focusing on the issues of the model's epistemic relevance in terms of its relation to the ‘real world’ and representing the real world in a model. We complement the discussion by bringing the model's constructive mechanisms or self-implementing technologies in play. By this, we mean the elements of the economic model that are aimed at ‘implementing’ it by envisaging the ways to change the reality in order to bring (...) it more in line with the model. We are thus concerned mainly not with the ways to change the model to ‘fit’ the reality, but rather with the model's own armature that is supposed to transform the world along theoretical lines. The case we study is Arrow–Debreu–McKenzie general equilibrium model. In particular, we show the following: gradient methods and stability could be regarded as constructive mechanisms of general equilibrium modeling in the context of market socialism debates; the obsession of general eq.. While the history of Cold War social and human sciences has become an immensely productive line of inquiry and has generated some exciting research, a lot remains still to be done in studying more deeply the known stories, venturing into the unknown ones and, in particular, looking in greater detail at the Soviet side of the Iron Curtain. In our expository introduction to this special issue, we demonstrate how its articles enhance our understanding of the postwar social and human sciences. (...) The special issue invites us to rethink the role of the local intellectual and disciplinary contexts in the postwar cultures of knowledge; to pay more attention to the networks and institutions that fostered communication across the Iron Curtain; to trace various asymmetries at work in the divided academic world and the ambiguous status of many actors who enable the East–West contacts despite the general hostility and ideological cleavages; and finally to arrive at a more differentiated and complex view of the whole intellectual landscape in the history of social and human sciences opening up once all the Cold War protagonists, including the countries of the eastern bloc, are subject to a detailed study. This project, we believe, is worthwhile not just for the sake of historical accuracy but also for understanding and changing the societies we live in, which are often still contaminated by the maladies of the Cold War. If we are to believe the proponents of the Theory of Practice and of Rational Choice, the gap between these two paradigmatic approaches cannot be bridged. They rely on ontological premises, theories of motivations and causal models that stand too far apart. In this article, I argue that this theoretical antinomy loses much of its edge when we take as objects of sociological investigation processes of historical change, that is, when we try to specify in theoretical terms how and in (...) which conditions historical actors enact and endorse shifts in patterns of relations as well as shifts in the symbolic and cognitive categories that make these relations significant. I substantiate this argument in light of the distinction between two temporalities of historical change: first, the long waves of gradual change and, second, the short waves of moments of breaks and ruptures. Along the way, I develop an argument about the conditions of emergence of self-limiting norms and the centrality of epistemic beliefs in situations of high disruption. (shrink)
