Item context effects refer to the impact of features of a test on an examinee’s item responses. These effects cannot be explained by the abilities measured by the test. Investigations typically focus on only a single type of item context effects, such as item position effects, or mode effects, thereby ignoring the fact that different item context effects might operate simultaneously. In this study, two different types of context effects were modeled simultaneously drawing on data from an item calibration study (...) of a multidimensional computerized test (N = 1,632) assessing student competencies in mathematics, science, and reading. We present a generalized linear mixed model (GLMM) parameterization of the multidimensional Rasch model including item position effects (distinguishing between within-block position effects and block position effects), domain order effects, and the interactions between them. Results show that both types of context effects played a role, and that the moderating effect of domain orders was very strong. The findings have direct consequences for planning and applying mixed domain assessment designs. (shrink)

This paper reconstructs Oskar Becker’s phenomenology of race, a project he called “paraontology.” For Becker, a fervent National So-cialist, paraontology provided a phenomenological account of “na-ture”—a realm of ahistorical essences encompassing both the “super-historical” truths of mathematics and metaphysics and the “sub-historical” forces of “blood and soil.” The impetus for this reconstruc-tion is the re-emergence of this term in contemporary Black studies, where it is used to problematize ontology’s usefulness for thinking black life. This paper asks what the (...) possibility of such an iteration shows about Becker’s project and its investment in non-historical repetition, arguing it reveals a profound disavowal of the historical at the heart of Becker’s project rather than a phenomenological disclosure of the natural. This essay reconstructs Oskar Becker’s idiosyncratic conception of aesthetics and its importance for phenomenology. For Becker, the aesthetic is not simply one type of phenomenon among others; rather, it occupies a privileged position as, first, that phenomenon which is itself “wholly phenomenal,” and, second, that phenomenon which discloses the ontological structure of phenomenality itself (and is thus what he calls “hyperontological”). The paper first reconstructs Becker’s descriptive phenomenology of the aesthetic (which he restricts to the realm of (...) masterpieces of fine art). For Becker, the key characteristic for understanding the givenness of beauty is its sense of fragility, which he uses to reveal a complicated interweaving of temporality and modality at the heart of the aesthetic. This essay then shows how this is rooted in Becker’s larger ontological project of developing a phenomenology of the non-historical in dialogue with Heidegger’s early work, a project which began in 1927 with the publication of his magnum opus Mathematical Existence. Translation of Oskar Becker’s “Transcendence and Paratranscendence” (1937). The essay is the first announcement of Becker’s project of “paraontology,” a phenomenological investigation of essence that attempted to encompass both mathematical and “natural” entities (which he took to include racial identity).

This chapter offers a proceduralist argument against capital punishment. More specifically, it contends that the possibility of irrevocable mistakes precludes the just administration of the death penalty. At stake is a principle of political morality: legal institutions must strive to remedy their mistakes and to compensate those who suffer from wrongful sanctions. The incompatibility of remedy and execution is the crux of the irrevocability argument: because the wrongly executed cannot enjoy the morally required compensation, execution is impermissible. Along with defending (...) his key premises, Yost explains the complicated role that sentencing uncertainty plays in the argument. We perceive smells as perduring complex entities within a distal array that might be conceived of as smellscapes. However, the philosophical orthodoxy of Odor Theories has been to deny that smells are perceived as having a distal location. Recent challenges have been mounted to Odor Theories’ veracity in handling the timescale of olfactory perception, how it individuates odors as a distal entities, and their claim that olfactory perception is not spatial. The paper does not aim to dispute these criticisms. Rather, (...) what will be shown is that Molecular Structure Theory, a refinement of Odor Theory, can be further developed to handle these challenges. The theory is further refined by focusing on distal perception that requires considering the perceptual object as mereologically complex persisting odor against a background scene conceived of as a smellscape. What will be offered is an expansion of Molecular Structure Theory to account for distal smell perception within natural environments. (shrink)

We are immersed within an odorous sea of chemical currents that we parse into individual odors with complex structures. Odors have been posited as determined by the structural relation between the molecules that compose the chemical compounds and their interactions with the receptor site. But, naturally occurring smells are parsed from gaseous odor plumes. To give a comprehensive account of the nature of odors the chemosciences must account for these large distributed entities as well. We offer a focused review of (...) what is known about the perception of odor plumes for olfactory navigation and tracking, which we then connect to what is known about the role odorants play as properties of the plume in determining odor identity with respect to odor quality. We end by motivating our central claim that more research needs to be conducted on the role that odorants play within the odor plume in determining odor identity. (shrink)

Capital punishment—the legally authorized killing of a criminal offender by an agent of the state for the commission of a crime—stands in special need of moral justification. This is because execution is a particularly severe punishment. Execution is different in kind from monetary and custodial penalties in an obvious way: execution causes the death of an offender. While fines and incarceration set back some of one’s interests, death eliminates the possibility of setting and pursuing ends. While fines and incarceration narrow (...) one’s routes to happiness, death eliminates its possibility. Not surprisingly, there is much debate about the moral permissibility of capital punishment. This entry maps the terrain of this debate. The first section discusses justifications of the death penalty as they appear in major theories of punishment. The second section surveys moral objections to execution that apply to most justifications. The third addresses procedural criticisms, which do not target the morality of execution so much as the justice of its implementation. (shrink)

At least some of your beliefs are commitments. When you believe that P as a commitment, your stance on P is such that you believe it on the basis of your considered judgement. Sometimes, you also believe that you believe P. Such self‐beliefs can also be commissive in a sense, as when they are reflective endorsements of your lower‐order commissive beliefs. In this paper I argue that one's commissive self‐beliefs ontologically constitute one's lower‐order commissive beliefs because one's commissive self‐beliefs instantiate (...) the same inferential dispositions that are constitutive of one's lower‐order commissive beliefs. Constitutive relations between commissive self‐beliefs and first‐order commissive beliefs are maximally epistemically secure because they do not result from any epistemic procedure by which one must try (and possibly fail) to detect one's first‐order commissive beliefs. This maximal epistemic security suffices to warrant one's commissive self‐beliefs, such that one possesses commissive self‐knowledge of an especially privileged sort. (shrink)

Kant famously insists that free will is a condition of morality. The difficulty of providing a demonstration of freedom has left him vulnerable to devastating criticism: critics charge that Kant's post-Groundwork justification of morality amounts to a dogmatic assertion of morality's authority. My paper rebuts this objection, showing that Kant offers a cogent demonstration of freedom. My central claim is that the demonstration must be understood in practical rather than theoretical terms. A practical demonstration of x works by bringing x (...) into existence, and what the demonstration of freedom brings into existence is a moral will, a will regulated by the moral law and capable of acting in accordance with it. Since to act morally is to act freely, bringing a moral will into existence actualizes our capacity for freedom and demonstrates that we possess it. To confirm the viability of such a demonstration, Kant must establish that agents can regulate their wills by practical principles, and that practical judgments are efficacious of themselves (i.e., that non-Humean motivational internalism is true). Kant, I argue, is successful on both counts. (shrink)

We link Ivancovsky et al.'s novelty-seeking model (NSM) to computational models of intrinsically motivated behavior and learning. We argue that dissociating different forms of curiosity, creativity, and memory based on the involvement of distinct intrinsic motivations (e.g., surprise and novelty) is essential to empirically test the conceptual claims of the NSM.

We propose expanding the authors’ shared novelty-seeking basis for creativity and curiosity by emphasizing an underlying computational principle: Minimizing prediction errors (mismatch between predictions and incoming data). Curiosity is tied to the anticipation of minimizing prediction errors through future, novel information, whereas creative AHA moments are connected to the actual minimization of prediction errors through current, novel information.

Nietzsche distinguished between two forces in art: Apollonian, which represents order and reason, and Dionysian, which represents chaos and energy. Economists, Ward argues, have operated for too long under the assumption that their work reflects the scientific, Apollonian principals that inform physics when they simply do not apply to economics: 'constants' in economics stand in for variables, and the core scientific principles of prediction and replication are all but ignored by economists. Ward encourages economists to reintegrate the standard rigor of (...) the scientific method into their work while embracing the fact of the shape-shifting changeability of human beings. Economists can still aspire to scientific standards, as is demonstrated by the success of biology, in which there is considerable Dionysian variability. Economists must avoid the temptation to wish away dynamic complexity and diversity and must recognize, among other things, that the desire to take risks is fundamentally human. We examine two different descriptions of the behavioral functions of the hippocampal system. One emphasizes spatially organized behaviors, especially those using cognitive maps. The other emphasizes memory, particularly working memory, a short-term memory that requires iexible stimulus-response associations and is highly susceptible to interference. The predictive value of the spatial and memory descriptions were evaluated by testing rats with damage to the hippocampal system in a series of experiments, independently manipulating the spatial and memory characteristics of a behavioral task. No (...) dissociations were found when the spatial characteristics of the stimuli to be remembered were changed; lesions produced a similar deficit in both spatial and nonspatial test procedures, indicating that the hippocampus was similarly involved regardless of the spatial nature of the task. In contrast, a marked dissociation was found when the memory requirements were altered. Rats with lesions were able to perform accurately in tasks that could be solved exclusively on the basis of reference memory. They performed at chance levels and showed no signs of recovery even with extensive postoperative training in tasks that required working memory. In one experiment all the characteristics of the reference memory and working memory procedures were identical except the type of memory required. Consequently, the behavioral dissociation cannot be explained by differences in attention, motivation, response inhibition, or the type of stimuli to be remembered. As a result of these experiments we propose that the hippocampus is selectively involved in behaviors that require working memory, irrespective of the type of material that is to be processed by that memory. In this paper, I will critique Paul Draper’s recent model of God’s motivational structure, according to which God can make hard choices. I will argue that this model illegitimately treats value in a purely teleological way, as something to be promoted. Following T.M. Scanlon’s work on value theory, when we consider the fact that value is to be respected rather than merely promoted, this realization will significantly foreclose on the possible cases in which hard choices can conceivably be made by (...) God. Most importantly, I challenge the idea that God can face hard choices between aesthetic and moral value in the way Draper suggests. (shrink)

In a recent study, Becker and Elliott [Becker, C., & Elliott, M. A. . Flicker induced color and form: Interdependencies and relation to stimulation frequency and phase. Consciousness & Cognition, 15, 175–196] described the appearance of subjective experiences of color and form induced by stimulation with intermittent light. While there have been electroencephalographic studies of similar hallucinatory forms, brain activity accompanying the appearance of hallucinatory colors was never measured. Using a priming procedure where observers were required to indicate (...) the presence of one of eight target colors we compared electrophysiological correlates of hallucinatory color with brain states associated with other visual phenomena. Different target colors were accompanied by different patterns of EEG activation. However, in general, we found that the appearance of hallucinatory colors is preceded by a power decrease in the lower alpha band alongside an increase in gamma band frequencies. We argue that decreasing activity in the lower alpha band acts as a gating mechanism, inducing a switch in perception between different colors. The increasing gamma activation may correlate with the formation of a coherent conscious percept. (shrink)

: Duncan Pritchard has recently highlighted the problem of veritic epistemic luck and claimed that a safety‐based account of knowledge succeeds in eliminating veritic luck where virtue‐based accounts and process reliabilism fail. He then claims that if one accepts a safety‐based account, there is no longer a motivation for retaining a commitment to reliabilism. Hardly anyone disputes that discrimination can be a grave moral wrong. Yet this consensus masks fundamental disagreements about what makes something discrimination, as well as precisely why acts of discrimination are wrong. Benjamin Eidelson develops systematic answers to those two questions. He claims that discrimination is a form of differential treatment distinguished by its special connection to the differential ascription of some property to different people, and goes on to argue that what makes some cases of discrimination intrinsically wrongful (...) is that they manifest an attitude of disrespect for the personhood of those who are disfavored. He endeavors to specify what this attitude consists in, and to demonstrate how attending to its character can help us to better understand the moral dimensions of different forms of wrongful discrimination. This article critically examines Busk's Democracy in Spite of the Demos, which critiques the “categorical imperative of democracy.” Although Busk effectively challenges the commitment to value-neutral democratic procedures as the foundation for legitimate law, his alternative, curtailing powerful interests ability to manipulate voters using “socially necessary delusions,” risks establishing elite rule. This article instead proposes basic liberal rights as the normative foundation for legitimate public order and militant democracy as its most effective institutional safeguard, arguing that this combination better realizes (...) human emancipation. Our understanding of human visual perception generally rests on the assumption that conscious visual states represent the interaction of spatial structures in the environment and our nervous system. This assumption is questioned by circumstances where conscious visual states can be triggered by external stimulation which is not primarily spatially defined. Here, subjective colors and forms are evoked by flickering light while the precise nature of those experiences varies over flicker frequency and phase. What’s more, the occurrence of one subjective experience (...) appears to be associated with the occurrence of others. While these data indicate that conscious visual experience may be evoked directly by particular variations in the flow of spatially unstructured light over time, it must be assumed that the systems responsible are essentially temporal in character and capable of representing a variety of visual forms and colors, coded in different frequencies or at different phases of the same processing rhythm. La prévalence des situations de maltraitance sur enfants demeure importante, celles-ci intervenant habituellement dans le cadre familier de la jeune victime. Si de nombreux aspects théoriques et cliniques des formes de maltraitance sont aujourd’hui étudiés, peu de travaux se centrent sur les questions spécifiques des transgressions commises par les grands-parents. À partir d’une vignette clinique, l’auteur montre l’utilité d’une prise en charge s’appuyant sur les temps successifs que constituent l’évaluation et le traitement. Tenir un cadre et évaluer, c’est-à-dire faire émerger (...) d’un côté les ressources, de l’autre les défaillances, représente par essence un temps constructif. Quatre catégories principales de fonctionnement psychique des grands-parents maltraitants sont retrouvées. Comme la plupart de ceux-ci relèvent de soins individuels et familiaux, on gagne en efficacité par une diffraction des tâches via un travail en réseau. (shrink)

The notion of a defendant submitting a false guilty plea due to the penal incentive offered is not an uncommon phenomenon. While the practice has been legitimised based on the defendant’s voluntary informed consent, it has often been argued that the structure of the plea-bargaining practice is coercive. Such can be the case whenever the plea offer entails a significant sentence differential, discrepancy in the form of punishment (a non-custodial sentence relative to a custodial one), or when the alternative of (...) pleading guilty includes the risk of capital punishment. Having said that, plea-bargains have often been classified as a “non-coercive offer”, whether due to their advantageous mutual character according to a baseline conception of coercion or being an offer that one can overcome according to an irresistible psychological account. While many scholars have struggled with the ambiguous notion of “coercive offers,” the paper offers an alternative approach, arguing that it is the type of reasons to be considered within the offer that renders the bargain less than fully autonomous. It will be argued that the plea-bargain proposition infuses irrelevant (guilt-uncorrelated) penal considerations unrelated to the question of guilt. Such considerations are the wrong kind of reason for the guilty-plea decision, and due to the defendant’s dependency on the plea offer, they distort the defendant’s intentional character of her autonomous decision. It is part of the conception of the guilty plea. Though a defendant may autonomously intend to consider irrelevant penal considerations, such a decision cannot be genuinely considered a decision regarding the admission of guilt. (shrink)

Socialist courts are supposed to apply the law, not make it, and socialist legality denies judicial decisions any precedential status. In 2011, the Chinese Supreme People’s Court designated selected decisions as Guiding Cases to be referred to by all judges when adjudicating similar disputes. One decade on, the paucity of citations to Guiding Cases has been taken as demonstrating the incongruity of case-based adjudication and the socialist legal tradition. Citations are, however, an imperfect measure of influence. Reproduction of language uniquely (...) traceable to Guiding Cases can also be evidence of their impact on judicial decision-making. We employ a local alignment tool to detect unattributed text reuse of Guiding Cases in local court decisions. Our findings suggest that Guiding Cases are more consequential than commonly assumed, thereby complicating prevailing narratives about the antagonism of socialist legality to case law. (shrink)

Resumen Este artículo aborda dos reescrituras de William Shakespeare en la dramaturgia chilena actual, Shakespeare falsificado: reconstrucción falsificada de un manuscrito censurado de Luis Barrales y La Tempestad de Juan Radrigán. Para ello propone la reescritura como ejercicio metadramático, un gesto consciente, dramático y político, que busca dialogar y discutir con el original, inscribiendo la nueva perspectiva autorial en el continuum de la tradición cultural. Dentro de este enfoque, el trabajo expone, en primer lugar, las características de la dramaturgia renacentista (...) inglesa como una praxis híbrida, colaborativa, refundidora y política. Luego, caracteriza ambas reescrituras como prácticas que muestran la vigencia y continuación de un canon cultural, literario y dramático, por medio de las distintas modulaciones que se imprimen desde estas nuevas voces. Asimismo, las perspectivas de Barrales y Radrigán se exhiben como gestos políticos expresados hacia sus contextos.The following article approaches two rewritings of William Shakespeare’s work within current Chilean playwriting:Shakespeare falsificado: reconstrucción falsificada de un manuscrito censurado, by Luis Barrales andLa Tempestad, by Juan Radrigán. It proposes rewriting as a metadramatic exercise, a conscious gesture -both political and dramatic- that seeks to establish dialogue and discussion with its original, inscribing a new authorial perspective within the cultural tradition continuum. With this approach, this work exposes, first, characteristics from English renaissance dramaturgy as a hybrid praxis, collaborative, refounding and political. Then, it characterises both rewritings as practice that showcase the currency and continuation of a cultural, literary and dramatic canon through different articulations that print themselves in our voices. Likewise, Barrales and Radrigan’s perspectives display themselves as political gestures expressed towards their contexts. (shrink)

According to the Motive of Duty Thesis, a necessary condition for an action to have moral worth is that it be motivated at least in part by a normative assessment of the action. However, this thesis has been subject to two powerful objections. It has been accused of over-intellectualizing moral agency, and of giving the wrong verdict when it comes to people who hold false moral theories that convince them that their actions are in fact morally wrong. I argue that (...) both of these objections can be convincingly answered using resources from the Guise of the Good view, which holds that for an agent to intend to requires that they take Φing to be good. Furthermore, I argue that combining the motive of duty thesis with the Guise of the Good view allows us to recognize an important further condition on moral worth—namely, that the agent recognize that their reason for action requires, rather than merely permits, their action. Thus, while no action lacks moral worth in virtue of being motivated by no normative evaluation at all, an action can still lack moral worth in virtue of failing to be motived by the correct normative evaluation, namely that the action is required.
