The thought and work of the Jesuit Francisco Suárez (1548-1617) is widely acknowledged as the culmination point of the contribution of the theologians and jurists of the so-called School of Salamanca to the development of modern Western law. This collection of studies on the legal work of Suárez explores some of his major forays into the law. Both his theoretical system-building as well as his interventions in practical questions are covered. The social and ethical framework of opposition toward homosexuality and, for example, gay marriage and gay parenting must be understood both from the process of institutionalism within Western society and from the essentialist view of human beings and the construction of their identities.This essentialist context of humanity and society, however, must be put in opposition to the social definition of human existence and identity. The latter are the dynamic and never-completed result of personal and social interrelation.Therefore, they cannot be separated (...) into abstractions denominating the essence of humanity and society, nor may they be viewed as clear-cut atomic or autonomous realities. On the basis of this opposition, I criticize the arguments against accepting and positively integrating homosexuality within society, especially through an analysis of the interpersonal aspects of the formation of gay identity and of gay parenting. Qu'un interet renouvele se manifeste aujourd'hui pour la versant epistemologique de l'oeuvre de Gaston Bachelard peut se comprendre au regard de l'histoire contemporaine de la philosophie des sciences. Cette histoire a ete dominee durant la plus grande partie du XXe siecle par une doctrine - celle de l'empirisme (ou positivisme) logique - promue a Vienne a la fin des annees 1920 par une institution originale, le Cercle de Vienne qui publie son manifeste en 1929, et s'organise comme un mouvement a (...) visee universelle et progressiste - celui de la conception scientifique du monde. La tradition francaise de la philosophie des sciences a pris d'entree de jeu un tout autre chemin. Si elle ne les a pas ignorees, elle a refuse de souscrire aux theses majeures du positivisme logique lorsqu'il s'est presente a elle. Elle a toujours lie etroitement philosophie et histoire des sciences. Dans le titre de ce petit livre ecrit durant l'annee universitaire 1967-1968 sous la direction de Georges Canquilhem, Dominique Lecourt a avance l'expression d'epistemologie historique pour signaler, a propos de Gaston Bachelard, cette particularite. Recently some bioethicists and neuroscientists have argued for an imperative of chemical cognitive enhancement. This imperative is usually based on consequentialist grounds. In this paper, the topic of cognitive self-enhancement is discussed from a Kantian point of view in order to shed new light on the controversial debate. With Kant, it is an imperfect duty to oneself to strive for perfecting one’s own natural and moral capacities beyond one’s natural condition, but there is no duty to enhance others. A Kantian (...) approach does not directly lead to a duty of chemical cognitive self-enhancement, but it also does not clearly rule out that this type of enhancement can be an appropriate means to the end of self-improvement. The paper shows the benefits of a Kantian view, which offers a consistent ideal of self-perfection and teaches us a lesson about the crucial relevance of the attitude that underlies one’s striving for cognitive self-improvement: the lesson of treating oneself as an end in itself and not as mere means to the end of better output. This article explores the role of financial markets for sustainable development. More specifically, the authors ask to what extent financial markets foster and facilitate more sustainable business practices. The authors highlight that their current role is rather modest and conclude that, on the old paths, a paradoxical situation exists. On one hand, financial market participants increasingly integrate environmental, social, and governance criteria into their investment decisions, whereas on the other hand, in terms of organizational reality, there seems to be no (...) real shift toward more sustainable business practices. The authors identify two main challenges within the field of sustainable investments that are relevant for entering new avenues that may help overcome this situation. First, a reorientation toward a long-term paradigm for sustainable investments is important. Second, ESG data must become more trustworthy. From a theoretical point of view, the authors finally highlight the potential market consequences when ESG investment criteria are used. (shrink)

Public surveys conducted in many countries report widespread willingness of individuals to donate a kidney while alive to a family member or close friend, yet thousands suffer and many die each year while waiting for a kidney transplant. Advocates of financial incentive programs or “regulated markets” in kidneys present the problem of the kidney shortage as one of insufficient public motivation to donate, arguing that incentives will increase the number of donors. Others believe the solutions lie—at least in part—in facilitating (...) so-called “altruistic donation;” harnessing the willingness of relatives and friends to donate by addressing the many barriers which serve as disincentives to living donation. Strategies designed to minimize financial barriers to donation and the use of paired kidney exchange programs are increasingly enabling donation, and now, an innovative program designed to address what has been termed “chronologically incompatible donation” is being piloted at the University of California, Los Angeles, and elsewhere in the United States. In this program, a person whose kidney is not currently required for transplantation in a specific recipient may instead donate to the paired exchange program; in return, a commitment is made to the specified recipient that priority access for a living-donor transplant in a paired exchange program will be offered when or if the need arises in the future. We address here potential ethical concerns related to this form of organ “banking” from living donors, and argue that it offers significant benefits without undermining the well-established ethical principles and values currently underpinning living donation programs. Domestic violence is an important social problem that strongly impacts the healthcare system. It is estimated that two to four million women are physically abused each year by their husbands, ex-husbands, or boyfriends. Many of these abused women enter the medical system as patients with physical injuries, somatic symptoms, or psychiatric problems. These patients represent a large proportion of women patients in a variety of clinical settings: 22–35% of women presenting to emergency departments, up to 37% of obstetric patients, and (...) over 25% of women seeking primary care. In diesem Zusammenhang setzt er sich mit Tendenzen auseinander, die derzeit in der Psychoanalyse im Umgang mit Traumata zu beobachten sind: Steht ein Trauma im Zentrum ihrer Aufmerksamkeit, tendierten Psychoanalytiker dazu, darin ein für ihre klinische Arbeit spezielles oder gar außergewöhnliches Problem zu sehen, das nach »etwas Anderem« als der grundlegenden Methode der Psychoanalyse verlangt. Demgegenüber wird die Auffassung vertreten, dass ein Trauma untrennbar mit dem Seelenleben verwoben (...) ist. So etwas wie eine nichttraumatische Psychopathologie, so der Autor, gibt es nicht. What is the ethical impact of artificial intelligence assistants on human lives, and specifically how much do they threaten our individual autonomy? Recently, as part of forming an ethical framework for thinking about the impact of AI assistants on our lives, John Danaher claims that if the external automaticity generated by the use of AI assistants threatens our autonomy and is therefore ethically problematic, then the internal automaticity we already live with should be viewed in the same way. He takes (...) advantage of this paradox of internal automaticity to downplay the threats of external automaticity to our autonomy. We respond in this paper by challenging the legitimacy of the paradox. While Danaher assumes that internal and external automaticity are roughly equivalent, we argue that there are reasons why we should accept a large degree of internal automaticity, that it is actually essential to our sense of autonomy, and as such it is ethically good; however, the same does not go for external automaticity. Therefore, the similarity between the two is not as powerful as the paradox presumes. In conclusion, we make practical recommendations for how to better manage the integration of AI assistants into society. (shrink)

Third World debt, seen as distant from the realm of international affairs and ethics, is often subject to abstract economic analysis. Bauer argues that the way in which debt is addressed by debtors and lenders is heavily politicized and should be subjected to ethical scrutiny.

The analysis of identity in cases of memory loss, particularly in Alzheimer’s disease, sheds light on relevant philosophical and practical concerns, such as decision-making processes, autonomy, and the improvement of interaction with patients. Literature on psychological continuity recognizes identity when there are no disruptions in memory, which is certainly not the case in Alzheimer´s disease. Narrative identity, particularly in its relational and non-relational versions, delivers tools which are not exempt from difficulties. Either the caregivers’ narrative or the patient’s narrative is (...) dismissed. Furthermore, if there is a contradiction of narratives in relational theories, we are advised to either find the best narrative or seek agreement. However, one option rejects one narrative, while the other is unattainable in practice for the case in question. Hence, we propose drawing from ironism (Rorty, 1989), which suggests duality of dialogues when dealing with problems. This will be used to defend that the narratives of both, a person with Alzheimer and those close to them, are valid when constituting identity of the former. In this case, we will articulate and defend relational ironism, which allows us to embrace inconsistent narratives without seeking agreements. According to this, personal identity in this case is in constant tension between the narratives of those who suffer Alzheimer’s disease and the narratives of those close to them. We close illustrating possible benefits for how best to interact with patients. (shrink)

Abstract Both parties in the active philosophical debate concerning the conceptual character of perception trace their roots back to Kant's account of sensible intuition in the Critique of Pure Reason. This striking fact can be attributed to Kant's tendency both to assert and to deny the involvement of our conceptual capacities in sensible intuition. He appears to waver between these two positions in different passages, and can thus seem thoroughly confused on this issue. But this is not, in fact, the (...) case, for, as I will argue, the appearance of contradiction in his account stems from the failure of some commentators to pay sufficient attention to Kant's developmental approach to philosophy. Although he begins by asserting the independence of intuition, Kant proceeds from this nonconceptualist starting point to reveal a deeper connection between intuitions and concepts. On this reading, Kant's seemingly conflicting claims are actually the result of a careful and deliberate strategy for gradually convincing his readers of the conceptual nature of perception. ABSTRACT This paper examines the significance to professional decision‐making of the concept of the ‘merits’. The merits serve in practical affairs to delineate considerations appropriate to ethical decision‐making and require in particular the avoidance of ‘self‐interest’. Drawing on the example of politics, it is argued that the boundaries of the ‘merits’are never fixed across professional fields but rather are determined by the distinctive character of the professional's fiduciary responsibilities; and that properly understood, the merits may demand some ‘self‐interested’considerations which in (...) the common conception would be rejected. The political example also suggests how the ‘ethical’conflict over the accepted boundaries of the merits can mask fundamental normative and political differences which would be better made explicit. In the past decade, digital technology, fiber optics, cellular phones, satellite television, home computers, and the Internet have substantially transformed business, education, and leisure practices. These technologies are becoming so integrated into our daily routines that their ubiquity often goes unnoticed. We are, nonetheless, in the midst of a telecommunications revolution, and the healthcare industry is becoming a major player. The burgeoning field of home-based telemedicine is evidence of this.

Several philosophers of science and metaphysicians claim that the dispositional properties of fundamental particles, such as the mass, charge, and spin of electrons, are ungrounded in any further properties. It is assumed by those making this argument that such properties are intrinsic, and thus if they are grounded at all they must be grounded intrinsically. However, this paper advances an argument, with one empirical premise and one metaphysical premise, for the claim that mass is extrinsically grounded and is thus an (...) extrinsic disposition. Although the argument concerns mass characterized as a disposition, it applies equally well whether mass is a categorical or dispositional property; however, the dispositional nature of mass is relevant to some important objections and implications discussed. Understanding how meaning mechanisms are unleashed in film has been at the center of numerous theoretical surveys of the last few years. Emphasis has especially fallen on seeing as a constructive, meaningful activity and on the diegetic implications of vision. This book is an attempt to extend film theorizing into a new realm, where hearing proves as important as seeing and where the relevance of filmic narrative is differently explored. New paths for future research are suggested by means of associations (...) with the works of linguists or philosophers who have never addressed film theory directly in their writings. Nonetheless, several concepts posited by them (relevance, natural versus non-natural meaning or the notion of Mental spaces) find their application in the present survey. A wide range of examples starting with point-of-view and editing occurrences, passing through the use of music and sound and culminating with the study of whole filmic ensembles, enables the reader to re-examine code-bound or, on the contrary, deviational structures. These are often drawn from familiar sources, proving that not only art films of the Eisenstein or Godard type enhance innovative meaning spaces. Finally, the viewer is seen as a «silly little kitty», an active not passive receiver of textual structures who relies on patterns of known visual or aural backgrounds open to an unlimited field of perspectives. Alors que la guerre était associée au masculin, quelques femmes en France ont combattu au cours des guerres civiles des XVIe-XVIIe siècles ou ont servi dans les armées royales, qu’accompagnaient de plus de nombreuses civiles. Avec la Révolution française, le service dans la garde nationale et, moins directement, dans l’armée est lié à la citoyenneté. En réclamant le port des armes au sein de la garde nationale, des militantes révolutionnaires revendiquaient ainsi un des droits politiques du citoyen, ce qui provoqua (...) un ferme refus. Mues par le désir de défendre la République et de partager avec les hommes la gloire de se battre pour elle, des citoyennes s’engagèrent par ailleurs individuellement dans les armées, où elles continuèrent à servir après le décret du 30 avril 1793 qui les en chassait. Les demandes d’armement des militantes et les réponses qui leur sont apportées, ainsi que les histoires, les propos des soldates et les réactions qu’elles ont suscitées permettent d’analyser l’association entre masculin, armes et citoyenneté et d’étudier les mécanismes de l’exclusion des femmes des armées. A review of the paradigms of social influence – suggestion, imitation, normalization, conformity, compliance, conversion – leads me to diagnose a triple malaise: the shrinkage of paradigms to cognitive dual-processing theories of information; the dominant methodology of laboratory experiments falls short of the reality of (mass) communication; and the focus of social influence on inter-subjectivity is only half of the story. I will suggest two extensions of social influence theory to include mass media communication and the inter-objectivity of artefacts. We (...) need to be able to conceptualize the modalities of why, how and to what effect somebody might put up a wall to influence neighbours instead of contenting themselves with putting up a public note ‘Do not trespass!’. Social influence by fait accompli needs to be within the remit of social psychology, otherwise it loses its relevance in a technological society where artefacts mediate most inter-personal relations.
