How is art both distinct and different from the rest of human life, while also mattering in and for it? This central yet overlooked question in contemporary philosophy of art is at the heart of Georg Bertram's new aesthetic. Drawing on the resources of diverse philosophical traditions – analytic philosophy, French philosophy, and German post-Kantian philosophy – his book offers a systematic account of art as a human practice. This paper defends the Blockian Proviso against its critics, Kinsella in particular, and interprets it as a law of non-contradiction in the theory of just property rights. I demonstrate that one may not lawfully appropriate in such a way as to forestall others from appropriating an unowned land because such appropriation would result in conflict-generating norms, and conflict-generating norms are not rationally justifiable and just norms. The Blockian Proviso, which precludes forestalling, operates therefore at the level of original appropriation and (...) determines, according to the homestead principle of justice in first acquisition, what may and what may not be lawfully appropriated. Hence, the Blockian Proviso is not an add-on to the homestead principle but part and parcel thereof. (shrink)

A central theme in recent research on attitudes is the distinction between deliberate, "explicit" attitudes and automatic, "implicit" attitudes. The present article provides an integrative review of the available evidence on implicit and explicit attitude change that is guided by a distinction between associative and propositional processes. Whereas associative processes are characterized by mere activation independent of subjective truth or falsity, propositional reasoning is concerned with the validation of evaluations and beliefs. The proposed associative-propositional evaluation model makes specific assumptions about (...) the mutual interplay of the 2 processes, implying several mechanisms that lead to symmetric or asymmetric changes in implicit and explicit attitudes. Moral psychology—broadly speaking, the study of how people reason and act morally—has a long and productive history. Initially a subfield of philosophy, it posed groundbreaking questions about the nature of values and virtues, the balance of reason and emotion, and the gap between “is” and “ought.” In the twentieth century, the rise of psychology expanded the a priori philosophical enterprise into an empirical science. In psychology, perspectives of development, social interaction, cognition, and neuroscience brought new understanding and new questions. Over (...) the past few decades, moral psychology has emerged as one of the most vital fields in the human sciences. Modern technology offers an increasing number of tools for teaching mathematics, but technology adoption in schools encounters many barriers. The Technology Acceptance Model explains that technology usage is dependent on intentions, which rest on perceived ease of use and perceived usefulness. Less is known about the relationship between intentions and actual behaviour. In the current study we show that the level of cognitive investment on the part of the teachers, captured by the construct of Need for Cognition (NC), is crucial (...) in the use of technology in mathematical instruction, while controlling for a variety of background factors. Furthermore NC moderates the relationship between intentions and technology use, such that high NC weakens the relationship between the perceived usefulness of technology in pedagogy and its actual use. Can ownership status influence probability judgements under condition of uncertainty? In three experiments, we presented our participants with a recording of a real horse race. We endowed half of our sample with a wager on a single horse to win the race, and the other half with money to spend to acquire the same wager. Across three large studies, we found the endowment effect – owners demanded significantly more for the wager than buyers were willing to pay to acquire it. (...) However, we also found that probability estimates of each horse winning the race did not differ between owners and non-owners of the betting slip. Our results demonstrate that distorted perception of probability is unlikely to be a mechanism explaining the endowment effect. (shrink)

A widespread assumption in recent research on attitudes is that self-reported evaluations reflect conscious attitudes, whereas indirectly assessed evaluations reflect unconscious attitudes. The present article reviews the available evidence regarding unconscious features of indirectly assessed “implicit” attitudes. Distinguishing between three different aspects of attitudes, we conclude that people sometimes lack conscious awareness of the origin of their attitudes, but that lack of source awareness is not a distinguishing feature of indirectly assessed versus self-reported attitudes, there is no evidence that people (...) lack conscious awareness of indirectly assessed attitudes per se, and there is evidence showing that, under some conditions, indirectly assessed attitudes influence other psychological processes outside of conscious awareness. Robot ethics encompasses ethical questions about how humans should design, deploy, and treat robots; machine morality encompasses questions about what moral capacities a robot should have and how these capacities could be computationally implemented. Publications on both of these topics have doubled twice in the past 10 years but have often remained separate from one another. In an attempt to better integrate the two, I offer a framework for what a morally competent robot would look like and discuss a number (...) of ethical questions about the design, use, and treatment of such moral robots in society. Instead of searching for a fixed set of criteria of a robot’s moral competence I identify the multiple elements that make up human moral competence and probe the possibility of designing robots that have one or more of these human elements, which include: moral vocabulary; a system of norms; moral cognition and affect; moral decision making and action; moral communication. Juxtaposing empirical research, philosophical debates, and computational challenges, this article adopts an optimistic perspective: if robotic design truly commits to building morally competent robots, then those robots could be trustworthy and productive partners, caretakers, educators, and members of the human community. Moral competence does not resolve all ethical concerns over robots in society, but it may be a prerequisite to resolve at least some of them. (shrink)

In this commentary, I critically assess Rex Welshon’s position on the neural substrates of ownership unity. First, I comment on Welshon’s definition of ownership unity and underline some of the problems stemming from his phenomenological analysis. Second, I analyze Welshon’s proposal to establish a mechanistic relation between neural substrates and ownership unity. I show that it is insufficient and defend my own position on how neural mechanisms may give rise to whole subjects of experience, which I call the neuro-integrative account (...) of consciousness. Lastly, I comment on Welshon’s philosophical contribution and claim that it leaves the reader theoretically stranded. (shrink)

This article explores several entanglements between human judgments of intentionality and morality (blame and praise). After proposing a model of people’s folk concept of intentionality I discuss three topics. First, considerations of a behavior’s intentionality a ff ect people’s praise and blame of that behavior, but one study suggests that there may be an asymmetry such that blame is more affected than praise. Second, the concept of intentionality is constitutive of many legal judgments (e.g., of murder vs. manslaughter), and one (...) study illustrates people’s subtle considerations of intentionality in making those judgments. Third, controversial recent studies suggest that moral considerations can affect judgments of intentionality, and an asymmetry may exist such that blame a ff ects those judgments more than praise. I report two new studies that may shed light on these recent findings, and I discuss several theoretical models that might account for the impact of moral considerations on intentionality judgments and for the relationship between the two more generally. A long series of studies in social psychology have shown that the explanations people give for their own behaviors are fundamentally different from the explanations they give for the behaviors of others. Still, a great deal of uncertainty remains about precisely what sorts of differences one finds here. We offer a new approach to addressing the problem. Specifically, we distinguish between two levels of representation ─ the level of linguistic structure (which consists of the actual series of words used in (...) the explanation) and the level of conceptual structure (which consists of the concepts these words are used to express). We then formulate and test hypotheses both about self-other differences in conceptual structure and about self-other differences in the mapping from conceptual structure to linguistic structure. According to contemporary understanding of the universal tree of life, the traditionally recognized kingdoms of eukaryotic organisms—Protista, Fungi, Animalia and Plantae—are irregularly interspersed in a vast phylogenetic tree. There are numerous groups that in any Linnaean classification advised by phylogenetic relationships would form sister groups to those kingdoms, therefore requiring us to admit them the same rank. In practice, this would lead to the creation of ca. 25-30 new kingdoms that would now be listed among animals and plants as “major (...) types of life”. This poses problems of an aesthetic and educational nature. There are, broadly speaking, two ways to deal with that issue: a) ignore the aesthetic and educational arguments and propose classification systems that are fully consistent with the Hennigian principles of phylogenetic classification, i.e. are only composed of monophyletic taxa; b) ignore Hennigian principles and bunch small, relatively uncharacteristic groups into paraphyletic taxa, creating systems that are more convenient. In the paper, I present the debate and analyze the pros and cons of both options, briefly commenting on the deeper, third resolution, which would be to abandon classification systems entirely. Recent advances in eukaryotic classification and phylogeny are commented in the light of the philosophical question of the purpose and design principles of biological classification systems. Weltweit entstehen Eigenrechte der Natur. Ecuador verankert die Anerkennung von Rechten der Natur 2008 in der Verfassung (Art. 71-74, ECU Constitucion 2008). Gerichte in Kolumbien, Australien, Indien und Neuseeland sprechen Flüssen eigene Rechte zu (vgl. Gutmann 2021). Seit 2022 verleiht ein spanisches Gesetz auch in Europa der Lagune „Mar Menor“ rechtlichen Eigenstatus (ESP Ley 30.09.2022, 237 BOE I 135131). Diese Entwicklung resultiert aus starken kollektiven Protesten und interveniert tiefgreifend in bestehende soziale Strukturen und Weltsichten: (I) Was ist das Verhältnis des (...) Menschen zur Natur und zum Recht? (II) Wo knüpfen Rechte der Natur an bestehende rechtliche Formen an? (III) Welches Verhältnis besteht zwischen Recht und Natur? (IV) Wie lassen sich Rechte der Natur ausgestalten und ausüben? (V) Warum sind Rechte der Natur begründet? (VI) Wann verändern solche Rechte die Natur oder uns? Die vorliegende Gedankenskizze will theoretische Linien der Figur von „Rechten der Natur“ abstecken. Philosophische und juristische Ansatzpunkte werden nur angerissen. Der Wert des Abrisses ist nicht vertiefte Argumentation, sondern Abtasten von Zusammenhängen und Fragen. Eigen-Rechte der Natur rütteln an Grundpfeilern des modernen, subjektiv geprägten Rechtsverständnisses (mindestens westlicher Kultur) und gehen konstruktiv gleichzeitig genau daraus hervor. Dieses strukturelle Paradox lässt sich durch ein auch kollektives Verständnis dieser Rechte auflösen oder mindestens systemisch produktiv aushalten und entfalten. (shrink)
