In the second half of the 20th century, Latin American poetry has had to deal with representing the phenomenon of forced disappearance in its various poetic productions. Some of those have incubated in the Central American civil wars, the dictatorial regimes of the Southern Cone and even in countries with supposed democratic stability such as Mexico and Colombia. Memorial de Ayotzinapa, by the Mexican poet Mario Bojórquez, and Carta de las mujeres de este país, by the Colombian poet and activist (...) Fredy Yezzed, experiment with the discursive forms of the long poem and the letter poem, respectively, to construct collective memories around a phenomenon that continues to take lives to this day. Bojórquez's text is concerned with constructing a testimony, apparently in situ, of the disappearance of the forty-three Mexican teacher trainees; Yezzed's work, for its part, refrains from referring to a specific event or place in order to provide a more complete testimony of the Colombian armed conflict, nearly seventy years old. The article analyzes the forms of the text, the subjects and their spaces of enunciation, as well as the memory strategies that are seen in both works. Thus, the testimonial status of poetry is confirmed, sometimes overshadowed by genres such as the novel and the short story. (shrink)

¿Cuáles son los márgenes de la cultura en la contemporaneidad? ¿Cómo se puede resistir desde estos? ¿Quiénes lo hacen o pueden hacerlo? Por supuesto, es imposible responder estas preguntas en esta corta presentación, tal vez sean imposibles de responder sin importar la extensión del texto que las analice. No obstante, nos parece necesario presentarlas para situarlas en un contexto que nos permita problematizar este dossier. Zygmunt Bauman4 planteó que tres campos de conocimiento: la filosofía de la historia, la antropología filosófica (...) y la estética, y un concepto: la cultura, emergieron en el siglo XVIII con el propósito de explicar la crisis de una forma de comprender y estar en el mundo, que se había pensado y vivido como natural y que parecía mutar en un orden radicalmente humano y, por ende, endeble, arbitrario y cambiante. El artículo contextualiza e investiga los detalles del «Mes de Reflexión Episcopal» organizado por el Departamento de Pastoral de Conjunto del Celam en julio de 1971, que reunió providencialmente varios obispos, algunos de los cuales no estuvieron en la II Conferencia General tres años antes, y que darían testimonio del espíritu de Medellín hasta el martirio o hasta una muerte trágica en cumplimiento de su misión: Oscar Arnulfo Romero, Juan Gerardi Conedera, Gerardo Valencia Cano y Raúl Zambrano Camader. El encuentro (...) se describe a partir de la revisión documental de las actas y de los pocos informes impresos. La tesis central del artículo es que el diálogo informal entre obispos, teólogos y otros expertos en el «Mes de Reflexión Episcopal» es fuente de propuestas novedosas para una Pastoral de Conjunto, contra la clericalización y el autoritarismo en la Iglesia latinoamericana. Desafortunadamente, no hay una reunión posterior similar debido a una controversia con la Congregación romana para los obispos. (shrink)

I argue against the Standard View of ignorance, according to which ignorance is defined as equivalent to lack of knowledge, that cases of environmental epistemic luck, though entailing lack of knowledge, do not necessarily entail ignorance. In support of my argument, I contend that in cases of environmental luck an agent retains what I call epistemic access to the relevant fact by successfully exercising her epistemic agency and that ignorance and non-ignorance, contrary to what the Standard View predicts, are not (...) modal in the sense that knowledge is. After responding to objections, I conclude by sketching an alternative account of ignorance centered on the notions of epistemic access and epistemic agency. (shrink)

In this article, I offer a theoretical account of a central yet surprisingly overlooked form of legal influence or control, one that I refer to as the law’s ‘exhortative’ influence. The law exercises an ‘imperative’ influence when it purports to control agents’ behavior by imposing on them legal duties to act or refrain from acting in the legally desired or repelled way. By contrast, it exercises what I call an exhortative form of influence when it aims at impacting agents’ reasons (...) for action whilst refraining from mandating or prohibiting the legally desired or repelled conduct. The law’s exhortative control or influence must be distinguished not only from its imperative influence, but also from what I call the law’s merely ‘instructive’ form of influence, such as the one provided by so-called power-conferring laws. Though I illustrate the functioning of this special form of legal control—the law’s exhortative influence—by using primarily the example of the law of contracts, the article offers novel insights about law in general as a mode of social ordering by developing a theory of the structure of ‘legal incentives’. Legal incentives, I contend, are the means through which the law exercises its exhortative influence. Clearly distinguishing different techniques of legal influence is not only of analytical interest, but should invite us to think of accounts of the justification of legal authority that consider the similarities but also the differences in the moral significance of these diverse techniques. In spite of the considerable literature nowadays existing on the issue of the moral exclusion of nonhuman animals, there is still work to be done concerning the characterization of the conceptual framework with which this question can be appraised. This paper intends to tackle this task. It starts by defining speciesism as the unjustified disadvantageous consideration or treatment of those who are not classified as belonging to a certain species. It then clarifies some common misunderstandings concerning what this means. Next, (...) it rejects the idea that there are different kinds of speciesism. Such an idea may result from confusion because there are (1) different ways in which speciesism can be defended; and (2) different speciesist positions, that is, different positions that assume speciesism among their premises. Depending on whether or not these views assume other criteria for moral consideration apart from speciesism, they can be combined or simple speciesist positions. But speciesism remains in all cases the same idea. Finally, the paper examines the concept of anthropocentrism, the disadvantageous treatment or consideration of those who are not members of the human species. This notion must be conceptually distinguished from speciesism and from misothery (aversion to nonhuman animals). Anthropocentrism is shown to be refuted because it either commits a petitio principia fallacy or it falls prey to two arguments: the argument from species overlap (widely but misleadingly known as “argument from marginal cases”) and the argument from relevance. This rebuttal identifies anthropocentrism as a speciesist view. (shrink)

The Uniform Determination of Death Act (UDDA) provides that “an individual who has sustained either (1) irreversible cessation of circulatory and respiratory functions or (2) irreversible cessation of all functions of the entire brain, including the brain stem, is dead.” We show that the UDDA contains two conflicting interpretations of the phrase “cessation of functions.” By one interpretation, what matters for the determination of death is the cessation of spontaneous functions only, regardless of their generation by artificial means. By the (...) other, what matters is the cessation of both spontaneous and artificially supported functions. Because each UDDA criterion uses a different interpretation, the law is conceptually inconsistent. A single consistent interpretation would lead to the conclusion that conscious individuals whose respiratory and circulatory functions are artificially supported are actually dead, or that individuals whose brain is entirely and irreversibly destroyed may be alive. We explore solutions to mitigate the inconsistency. (shrink)

Requiring family authorization for apnea testing subtracts health professionals control over death determination, a procedure that has traditionally been considered a matter of clinical expertise alone. In this commentary, we first provide evidence showing that health professionals’ (HPs) disposition to act on death determination without family’s prior consent could be much lower than that referred to by Berkowitz and Garrett (2020). We hypothesize that HPs may have reservations about their own expertise as regards death, and may thus hesitate to impose (...) their views on patients’ families. We then address the theoretical question of clinical expertise in death determination by distinguishing judgments about facts (e.g., the presence or absence of spontaneous breathing) from interpretations given of these facts (i.e., their meaning for the vital status of an individual). We argue that, while clinicians may claim some expert authority on the former, they hold no particular authority on the latter. (shrink)

Engaging and thought-provoking, this book examines how we see and treat animals and argues that we should extend equal rights to all species, human and non-human alike. Looking at both the use of animals for the production of food, as well as the suffering of wild animals, this book advocates for society to seriously take into account the interests of all animals and argues that we have a duty to treat animals with much greater care, consideration and respect. Este artigo apresenta um quadro conceitual para examinar a questão do especismo. Começa definindo-o como a consideração ou tratamento desfavorável injustificado daqueles que não pertencem a uma determinada espécie. A seguir, esclarece alguns dos mal-entendidos comuns acerca do que é e do que não é o especismo. Depois disso, argumenta contra a confusão entre (1) os diferentes modos em que se pode defender o especismo; e (2) as diferentes posições que assumem o especismo como uma de suas premissas. Dependendo se (...) essas últimas aceitam ou não outros critérios para a consideração moral à parte do especismo, podem ser posições especistas simples ou combinadas. Mas o especismo segue sendo em todos os casos a mesma ideia. Finalmente, este artigo examina o conceito de antropocentrismo, que define como o tratamento ou consideração desfavorável daqueles que não são membros da espécie humana. O conceito de antropocentrismo difere do de especismo e do de misoteria (animadversão para com os animais não humanos). Não obstante, pode-se concluir que o antropocentrismo é uma forma de especismo, à luz do que indicam, entre outros, o argumento da sobreposição de espécies e o argumento da relevância. (shrink)

This article tries to define what discrimination is and to understand in particular detail its most important instances: those in which the satisfaction of interests is at stake. These cases of discrimination will be characterized in terms of deprivations of benefits. In order to describe and classify them we need to consider three different factors: the benefits of which discriminatees are deprived, the criteria according to which such benefits are denied or granted, and the justification that such deprivation of benefits (...) may have (or lack). This definition intends to present discrimination as a concept that may be useful not only to examine certain social phenomena, but also, more widely, to ethical theory in general. (shrink)

El estudio examina mediante una revisión sistemática la literatura científica. La metodología se basó en la aplicación de los principios de la declaración PRISMA. Los resultados indicaron que la mayor producción de estudios fue en 2021, con predominancia de idioma inglés, España como el mayor productor, Reino Unido con el mayor número de revistas y el uso de realidad aumentada como la estrategia más estudiada. La producción científica en educación, y más particularmente en metodologías aplicada a la educación, ha generado (...) una serie de estudios bibliométricos, los cuales han demostrado la evolución de las mismas en lapsos de tiempo diversos. En este artículo se presenta un abordaje general de la teoría de la justicia social de John Rawls. Revisamos algunas críticas desde diversos frentes teóricos. Consideramos que la justicia social permite enjuiciar las consecuencias regresivas para la humanidad del capitalismo en su fase neoliberal y comenzar a imaginar otros mundos posibles.

During the second half of the twentieth century, historians of science have shown a considerable interest in ‘presentism’, a term first applied to the kind of history of science in which past knowledge is judged to celebrate and legitimize modern science. Taking Herbert Butterfield’s The Whig interpretation of history as a point of reference, ‘presentism’ has been usually associated with ‘Whig history’ or ‘Whiggish history’. Nevertheless, Butterfield’s essay is one of many approaches to this question. In this article, I examine (...) Hélène Metzger’s La méthode philosophique dans l’histoire des sciences, a major theoretical contribution of ‘presentism’. I argue that the papers she published in the 1930s are among the most important critical reflections on ‘presentism’ written by a historian of science before 1950. Through this examination, I demonstrate that Hélène Metzger‘s ideas can provide historians of science with a useful set of tools to reflect upon ‘presentism’, beyond the narrow definition of the latter as ‘Whig history’. Este trabajo analiza algunas de las dimensiones fundamentales de la influencia de la obra temprana de Martin Heidegger sobre la teoría política de Hannah Arendt. Como se sabe, la pensadora judía cursó algunos de sus más cruciales años universitarios bajo la tutoría del profesor alemán. En tal sentido, tanto la perspectiva hermenéutico-fenomenológica como los conceptos de “mundo” y praxis resultaron decisivos para definir, junto con la experiencia del totalitarismo, el sentido y la profundidad de la teoría política arendtiana. En líneas (...) generales, se espera que la investigación permita no solo entender varias de las nociones centrales del pensamiento de Arendt dentro de su horizonte de sentido original, sino además visibilizar algunas de las potencialidades que la obra temprana de Heidegger posee a la hora de repensar la política y la pluralidad humana. Insofar as development implies economic growth, the term 'sustainable development' appears to some as a contradiction in terms. However, such conclusions still lack a thorough examination of the conceptual structure of the two terms between which there is a purported contradiction. In order to address this issue, the present paper scrutinises some of the assumptions which underwrite the ideologies of sustainability and of development. It is argued that there are key assumptions which both ideas have in common, and that sustainable (...) development is thus perfectly coherent on a conceptual level. It is alternatives which retain either term (such as 'sustainable degrowth') that are embroiled in paradox. The paper then examines two concepts for criticising the ideology of economic growth in other terms: dépense and conviviality. It is argued that the latter is preferable to the former for the purpose of developing post-sustainable critiques of growth. (shrink)

I argue that a standard formulation of hinge epistemology is host to epistemic relativism and show that two leading hinge approaches (Coliva’s acceptance account and Pritchard’s nondoxastic account) are vulnerable to a form of incommensurability that leads to relativism. Building on both accounts, I introduce a new, minimally epistemic conception of hinges that avoids epistemic relativism and rationally resolves hinge disagreements. According to my proposed account, putative cases of epistemic incommensurability are rationally resolvable: hinges are propositions that are the objects (...) of our belief-like attitudes and are rationally revisable in virtue of our overarching commitment to avoid systematic deception in our epistemic practices.
