Descartes' Meditations is one of the most thoroughly analyzed of all philosophical texts. Nevertheless, central issues in Descartes' thought remain unresolved, particularly the problem of the Cartesian Circle. Most attempts to deal with that problem have weakened the force of Descartes' own doubts or weakened the goals he was seeking. In this book, Stephen I. Wagner gives Descartes' doubts their strongest force and shows how he overcomes those doubts, establishing with metaphysical certainty the existence of a non-deceiving God and the (...) truth of his clear and distinct perceptions. Wagner's innovative and thorough reading of the text clarifies a wide range of other issues that have been left unclear by previous commentaries, including the nature of the cogito discovery and the relationship between Descartes' proofs of God's existence. Reason is precariously positioned in the Critique of Pure Reason. The Transcendental Analytic leaves no entry for reason in the cognitive process, and the Transcendental Dialectic restricts reason to noncognitive roles. Yet, in the Appendix to the Transcendental Dialectic, Kant contends that the ideas of reason can be used in empirical investigation and eventually knowledge acquisition. Given what Kant has said, how is this possible? Kant attempts to answer this in A663–A666/B691–B694 in the Appendix, where (...) he argues that principles of reason “have objective but indeterminate validity.” In Part I of this paper, I explain the full motivation behind this section. In Part II, I provide an exegesis of it. In particular, to reach his conclusion that principles of reason have objective but indeterminate validity, I interpret Kant as making three arguments from analogy. Finally, in Part III, I show that the first and third arguments fail—and what this means for Kant’s project. (shrink)

A script concordance test was developed as an innovative tool for assessing ethical reasoning ability. An SCT of 12 medical ethical vignettes were constructed from the UNESCO Casebook on Human Dignity and Human Rights. The vignettes were reviewed by a panel of 15 medical experts before administration to a panel of 18 clinicians. The clinician’s answers were used to constitute the scoring key. The SCT was then administered to first and final year medical students. Data were analysed using SPSS. Internal (...) consistency was assessed using Cronbach’s alpha. SCT performance was tested for association with sex, year of study and race by comparing the mean SCT scores between categories within each variable. Internal consistency as measured by Cronbach’s alpha values, ranging from 0.597 to 0.902, indicated high intra-vignette reliability for 10 of the vignettes. Inter-vignette reliability was high at 0.797. Mean SCT scores were not significantly different between students of different gender, year of study and ethnicity. However, each vignette was able to distinguish between overall poor and good test performers. The SCT was able to differentiate between students with varying degrees of ethical reasoning ability. In Kant’s Critique of Pure Reason and the Method of Metaphysics (CUP 2023), I argue that the first Critique is not only a ‘propaedeutic’ to metaphysics, but actually already establishes parts of metaphysics. These parts belong to what Kant calls transcendental philosophy. Additionally, I also provide an account of Kant’s critique of dogmatism and Wolff as its main defender. In this paper, I take up Luigi Filieri’s and Davide Dalla Rosa’s invitation to further develop my characterization of transcendental philosophy (...) and I respond to Michael Walschots’s objections against my interpretation of Kant’s critique of Wolff’s dogmatism. While Thomas Kuhn's theory of scientific revolutions does not specifically deal with validation, the validation of simulations can be related in various ways to Kuhn's theory: 1) Computer simulations are sometimes depicted as located between experiments and theoretical reasoning, thus potentially blurring the line between theory and empirical research. Does this require a new kind of research logic that is different from the classical paradigm which clearly distinguishes between theory and empirical observation? I argue that this is not (...) the case. 2) Another typical feature of computer simulations is their being ``motley'' (Winsberg 2003) with respect to the various premises that enter into simulations. A possible consequence is that in case of failure it can become difficult to tell which of the premises is to blame. Could this issue be understood as fostering Kuhn's mild relativism with respect to theory choice? I argue that there is no need to worry about relativism with respect to computer simulations, in particular. 3) The field of social simulations, in particular, still lacks a common understanding concerning the requirements of empirical validation of simulations. Does this mean that social simulations are still in a pre-scientific state in the sense of Kuhn? My conclusion is that despite ongoing efforts to promote quality standards in this field, lack of proper validation is still a problem of many published simulation studies and that, at least large parts of social simulations must be considered as pre-scientific. The systematic review of reasons is a new way to obtain comprehensive information about specific ethical topics. One such review was carried out for the question of why post-trial access to trial drugs should or need not be provided. The objective of this study was to empirically validate this review using an author check method. The article also reports on methodological challenges faced by our study.

The study of the relationship between reasoning and emotional processes is not new in Psychology. There are currently two main approaches to understanding the aspects related to these processes called emotional intelligence: the ability model and the trait model. This study focuses on the latter, analyzing the factor structure, reliability, and validity of the Trait Emotional Intelligence Questionnaire in a Brazilian sample. 4314 adults with ages ranging from 18 to 60 years answered the TEIQue and other online instruments measuring emotional (...) regulation, impulsiveness, alexithymia, loneliness, quality of life, positive and negative affect, personality traits, emotional perception, emotional understanding, and reasoning tests. The original four-factor structure of the TEIQue was replicated, Cronbach’s alphas ranged from 0.60 to 0.89 for the facets, and from 0.76 to 0.90 for the factors and global score. The correlations followed theoretically expected directions, showing a stronger pattern for self-report measures than for performance tasks. Our results corroborated previous studies with the TEIQue, confirming the psychometric adequacy of the instrument in the Brazilian context. Future studies may focus on participants with lower levels of education and additional external criteria, such as career preferences, job performance, and health. (shrink)

First-year university students have multiple motives for studying and these motives may interact. Yet, past research has primarily focused on a variable-centered, dimensional approach missing out on the possibility to study the joint effect of multiple motives that students may have. Examining the interplay between motives is key to better explain student differences in study success and wellbeing, and to understand different effects that interventions can have in terms of wellbeing and study success. We therefore applied a student-centered, multidimensional approach (...) in which we explored motivational profiles of first-year university students by combining three dimensions of motives for studying which have been shown to be differently related to academic functioning. Using cluster analysis in two independent, consecutive university student cohorts, we identified four meaningful profiles and coined them motivational mindsets. We validated the four mindset profiles not only within each student sample but also found almost identical profiles between the student samples. The motivational mindset profiles were labeled: high-impact mindset, low-impact mindset, social-impact mindset, and self-impact mindset. In addition to validating the paradigm, we developed a mindset classification tool to further use these mindsets in practice and in future research. (shrink)

Background: nursing students are required to think reflectively in both real and simulated clinical practice. Although the Reflective Thinking instrument is reliable in its measurement of reflective thinking, its validity is unknown. Method: confirmatory factor analysis was undertaken in an iterative manner within a non-equivalent control-group study to measure nursing students’ reflective thinking and satisfaction with high-fidelity simulation. The validity and reliability of the Reflective Thinking instrument was tested. Results: the resulting instrument consisted of 15 items across four factors. The (...) final model was plausible as it demonstrated ‘goodness of fit’; however, it had neither convergent or discriminatory validity, nor reliability. Internal consistency was fair to reasonable for the four subscales. Conclusion: the testing of the Reflective Thinking instrument using confirmatory factor analysis is a vital initial step in the modification of this instrument. Further development using exploratory factor analysis will enhance the instrument’s relevance within high-fidelity simulation. (shrink)

A number of single- and dual-process theories provide competing explanations as to how reasoners evaluate conditional arguments. Some of these theories are typically linked to different instructions—namely deductive and inductive instructions. To assess whether responses under both instructions can be explained by a single process, or if they reflect two modes of conditional reasoning, we re-analysed four experiments that used both deductive and inductive instructions for conditional inference tasks. Our re-analysis provided evidence consistent with a single process. In two new (...) experiments we established a double dissociation of deductive and inductive instructions when validity and plausibility of conditional problems were pitted against each other. This indicates that at least two processes contribute to conditional reasoning. We conclude that single-process theories of conditional reasoning cannot explain the observed results. Theories that postulate at least two processes are needed to account for our findings. (shrink)

Soundscapes affect people’s health and wellbeing and contribute to the perception of environments as restorative. This paper continues the validation process of a previously developed Perceived Restorativeness Soundscape Scale (PRSS). The study takes a novel methodological approach to explore the PRSS face and construct validity by examining the qualitative reasons for participants’ numerical responses to the PRSS items. The structure and framing of items are first examined, to produce 44 items which are assessed on a seven-point Likert agreement scale, (...) followed by a free format justification. Ten English speaking participants completed the PRSS interpretation questionnaire in two cafes in Montréal, Canada. Interpretation of participant free format responses led to six themes, which related to either the individual (personal attributes, personal outcomes), the environment (physical environment attributes, soundscape design) or an interaction of the two (behaviour setting, normality and typicality). The themes are discussed in relation to each Attention Restoration Theory (ART) component, namely Fascination, Being-Away, Compatibility, and Extent. The paper concludes by discussing the face and construct validity of the PRSS, as well as the wider methodological and theoretical implications for soundscape and attention restoration research, including the terminology importance in items measuring ART components and the value of all four components in assessing perceived restorativeness. Although deductive reasoning is a closed system, one's beliefs about the world can influence validity judgements. To understand the associated functional neuroanatomy of this belief-bias we studied 14 volunteers using event-related fMRI, as they performed reasoning tasks under neutral, facilitatory and inhibitory belief conditions. We found evidence for the engagement of a left temporal lobe system during belief-based reasoning and a bilateral parietal lobe system during belief-neutral reasoning. Activation of right lateral prefrontal cortex was evident when subjects inhibited a prepotent (...) response associated with belief-bias and correctly completed a logical task, a finding consistent with its putative role in cognitive monitoring. By contrast, when logical reasoning was overcome by belief-bias, there was engagement of ventral medial prefrontal cortex, a region implicated in affective processing. This latter involvement suggests that belief-bias effects in reasoning may be mediated through an influence of emotional processes on reasoning. (shrink)

Kant's Critique of Pure Reason, his main work of theoretical philosophy, frequently uses metaphors from law. In this first book-length study in English of Kant's legal metaphors and their role in the first Critique, Sofie Møller shows that they are central to Kant's account of reason. Through an analysis of the legal metaphors in their entirety, she demonstrates that Kant conceives of reason as having a structure mirroring that of a legal system in a natural right framework. (...) Her study shows that Kant's aim is to make cognisers become similar to authorized judges within such a system, by proving the legitimacy of the laws and the conditions under which valid judgments can be pronounced. Law is a powerful force in human civilization. The growth and stability in society are generally linked with the gradual development of a system of legal rules, in addition to the instruments for their regular and effective enforcement. Law can be used to protect or harm the interest of man. This dimension raises the issue of the ‘validity of law’. The legal positivists posit that law is a ‘moral-neutral’ entity, and once it is enacted by the appropriate authority, it cannot (...) be adjudged immoral or unjust, by any standard outside the province of the law in question. The valid law for the legal positivists is law as enacted by the appropriate authority within agiven legal system. The Naturalists think otherwise. Cicero for instance believes that the validity of law is rooted on right reason in agreement with nature. In this paper I am more persuaded by the arguments of the Naturalists. I however present liberally the standpoints of the two opposing schools of thought – The naturalists and the positivists, with emphasis on the works of John Kelsen, Justice Homles, Cicero and Aquinas. Reasoning research suggests that people use more stringent criteria when they evaluate others' arguments than when they produce arguments themselves. To demonstrate this “selective laziness,” we used a choice blindness manipulation. In two experiments, participants had to produce a series of arguments in response to reasoning problems, and they were then asked to evaluate other people's arguments about the same problems. Unknown to the participants, in one of the trials, they were presented with their own argument as if it was (...) someone else's. Among those participants who accepted the manipulation and thus thought they were evaluating someone else's argument, more than half rejected the arguments that were in fact their own. Moreover, participants were more likely to reject their own arguments for invalid than for valid answers. This demonstrates that people are more critical of other people's arguments than of their own, without being overly critical: They are better able to tell valid from invalid arguments when the arguments are someone else's rather than their own. Recent scholarship has shown that the success of Pascal’s wager rests on precarious grounds. To avoid notorious problems, it must appeal to considerations such as what probability we assign to the existence of various gods and what religion we think provides the greatest happiness in this life. Rational judgments concerning these matters are subject to change over time. Some claim that the wager therefore cannot support a steadfast commitment to God. I argue that this conclusion does not follow. By drawing (...) upon the line of reasoning employed in getting married, I explain how unstable considerations can provide a sufficient rational foundation for a stable commitment. (shrink)

Decision-making capacity in children and adolescents in healthcare requires thorough assessment: the minor's maturity, understanding of the decision, risk of the situation and contextual factors needs to be explored. The intention was to design and validate a test—the Maturtest—to assess the maturity of minors in decision-making processes in healthcare. A reasoning test on moral conflicts for adolescents was designed to infer the degree of maturity of minors applied to decision-making regarding their own health. The test was completed by a sample (...) of 441 adolescents aged from twelve to sixteen, with a corresponding analysis of their psychometric skills to measure feasibility, viability, reliability, validity, and sensitivity to change. Psychometric test results showed viability, reliability, validity, and sensitivity to change. High correlation between the test score and the reference method were notable. A high stability was obtained with an intraclass correlation coefficient. The average response time of the test was twenty-three minutes. This test measures the moral maturity of adolescents. It is presented as an objective, useful, valid, reliable tool, easy to fill out, edit and apply in a healthcare context. It helps to assess the maturity of minors faced with a decision. (shrink)

Newton’s Principia introduces four rules of reasoning for natural philosophy. Although useful, there is a concern about whether Newton’s rules guarantee truth. After redirecting the discussion from truth to validity, I show that these rules are valid insofar as they fulfill Goodman’s criteria for inductive rules and Newton’s own methodological program of experimental philosophy; provided that cross-checks are used prior to applications of rule 4 and immediately after applications of rule 2 the following activities are pursued: (1) research addressing observations (...) that systematically deviate from theoretical idealizations and (2) applications of theory that safeguard ongoing research from proceeding down a garden path. In this paper we design a new logical system to explicitly model the different deductive reasoning steps of a boundedly rational agent. We present an adequate system in line with experimental findings about an agent’s reasoning limitations and the cognitive effort that is involved. Inspired by Dynamic Epistemic Logic, we work with dynamic operators denoting explicit applications of inference rules in our logical language. Our models are supplemented by (a) impossible worlds (not closed under logical consequence), suitably structured according to (...) the effect of inference rules, and (b) quantitative components capturing the agent’s cognitive capacity and the cognitive costs of rules with respect to certain resources (e.g. memory, time). These ingredients allow us to avoid problematic logical closure principles, while at the same time deductive reasoning is reflected in our dynamic truth clauses. We further show that our models can be reduced to awareness-like plausibility structures that validate the same formulas and we give a sound and complete axiomatization with respect to them. This approach to the agent’s internal deductive reasoning is finally combined with actions of external information. (shrink)

This article examines the operation of “reasonable steps” as a statutory standard for analysis of the availability of the defence of belief in consent in sexual assault cases and concludes that application of section 273.2(b) of the Criminal Code, as presently worded, often undermines the legal validity and correctness of decisions about whether the accused acted with mens rea, a guilty, blameworthy state of mind. When the conduct of an accused who is alleged to have made a mistake about whether (...) a complainant communicated consent is assessed by the hybrid subjective-objective reasonableness standard prescribed by s. 273.2, many decision-makers rely on extra-legal criteria and assumptions grounded on their personal experience and opinion about what is reasonable. In the midst of debate over what the accused knew and what steps were “reasonable” given what the accused knew, the legal definition of consent in section 273.1 is easily over-looked and decision-makers focus on facts that are legally irrelevant and prejudice rational deliberation. -/- That is precisely what we see here; the result is often failure to enforce the law. The author proposes: -/- (a) that section 273.2 be amended to reflect the significant developments achieved in sexual consent jurisprudence since enactment of the provision in 1992; and -/- (b) that, in the interim, the judiciary act with resolve to make full and proper use of the statutory and common law tools that are presently available to determine whether the accused acted with mens rea in relation to the absence of sexual consent. Legal reasoning settles morally pressing matters through a technique that largely bypasses open-ended moral argument. That technique makes central what certain persons validly decided in the past, for example in creating statutes, judicial resolutions, contracts, or wills. Identifying valid decisions is a lawyerly skill and, echoing legal practice, legal philosophy has paid considerable attention to validity criteria. But it has neglected to explore validity's point: whether, and if so exactly how, the special technique of validity contributes to a legal system's (...) ability to realise justice and human rights. Even the most sensible defences of the moral need for positive law have insufficiently probed this key step in the argument. This book lays bare the workings of legal validity, and shows why, and within what general limits, this technique equips legal systems with privileged tools to foster human well-being. In so doing, the book explains how power-conferring norms setting out validity criteria endow agents' intentions with 'performative' effect ('I hereby.') and can secure the requirement of justice that there be widespread convergence on specific patterns of conduct shaped through a cooperative effort. Legal meaning is accordingly systemic, resulting from the valid acts of multiple agents whose decisions can, by virtue of exercising legal power, also exercise moral power (authority). In short, the book articulates why it is morally necessary that validity does not primarily turn on moral considerations. (shrink)

And are religious beliefs in need of being grounded in religious experience in order to be rationally justified? Although it seems pretty obvious that a great many adherents of all religions (...) find reasons for their beliefs in their religious traditions rather than in their personal religious experiences, one could note that usually these traditions present religious experiences of their founder figures as constituting evidence for their authenticity and truthfulness ; the supposed mystical experiences of some adherents of a given religious tradition are often treated by their co-believers as an important evidence which increases credibility of their own religious convictions. Many recent thinkers imagine that a new way of life, or a new kind of thinking, is beginning to unfold on the basis of the discovery that reason is an outmoded concept and that the projects of Western philosophy are defunct. Postmodernist thinkers, in particular, have tried to describe the way things look from a post?philosophical, post?rational point of view. Jean?François Lyotard's The Postmodern Condition argues against the possibility of a comprehensive understanding of contemporary social and intellectual activities, while (...) most of the essays in Literature and the Question of Philosophy also reject the idea that there can be a valid comprehension of the elements found in textual or in ethical and political phenomena. Yet in every instance, the effort to establish a post?philosophical, post?rational way of looking at things involves an unwitting exercise of the rational power to conceive of a situation in terms of the relative disposition of its elements. Furthermore, the themes and ideas of post?philosophy can be shown to have originated within the two grand narratives of modern philosophy that Lyotard has incorrectly pronounced passe. Postmodemism's confusion about itself shows the continuing relevance of Hegel's concept of Reason. (shrink)

In Squaring the Circle in Descartes’ Meditations, Stephen Wagner aims to show that Descartes’ project in the Meditations is best understood as a ‘strong validation of reason’ i.e., as proving in a non-circular way that human reason is a reliable, truth-conducive faculty. For such an enterprise to qualify as a ‘strong’ validation, Wagner contends, skeptical doubt must be given its strongest force. The most stringent doubt available in the Meditations is the deceiving God. To rule out (...) the possibility that an omnipotent God created humans so that their best functioning cognitive faculties provide misleading information about what the world is like, Descartes must prove that a non-deceiving God exists. Furthermore, only a non-circular proof will count as a ‘validation.’ Wagner spells out the requirements of non-circularity as involving a proof for God’s existence that is not deductive, does not simply achieve a clear and distinct perception of God’s existence, and proceeds on the basis of perceptions that remain true even when the reasons underlying them are not attended to any longer by the meditator. After 100+ years of studying syllogistic reasoning, what have we learned? Well, Riesterer and colleagues suggest that we have learned to throw away most of the data! If that seems like a bad idea to you then, be assured, that the authors agree with you. The sad fact is that the conclusion of “No Valid Conclusion” (NVC) is one of the most frequently selected responses in syllogistic reasoning but these “majority data” have been ignored by most researchers. In the epicenter of his attempt to justify the “objective validity” of morality and freedom in the Critique of Practical Reason, Kant introduces a so-called fact of reason, which is rendered as the fact that human beings are consciou s of the moral ought’s categorical authority. However, few parts of Kant’s thinking have bemused commentators as much as this. In this article, the author explores a set of intersecting problems related to the fact of reason: (1) the (...) problem of its general argumentative role in Kant’s practical philosophy, (2) the problem of the fact as a brute fact. He argues that both problems can be understood and resolved only if we regard Kant’s introduction of the fact of reason as an implicit attempt to articulate intrinsic problems with reductive explanations of morality. His main claim, which has been surprisingly absent in most interpretations of Kant’s fact of reason, will be that the fact of reason functions as an undeniable yet improvable fact (similar to mathematical principles) from which other practical truths (such as the objective reality of freedom) can be derived. As Kant says unambiguously in the Jäsche-Logic : the “reality” of the moral law “is an axiom.”. (shrink)

Konstantin Pollok offers the first book-length analysis of Kant's theory of normativity that covers foundational issues in theoretical and practical philosophy as well as aesthetics. Interpreting Kant's 'critical turn' as a normative turn, he argues that Kant's theory of normativity is both original and radical: it departs from the perfectionist ideal of early modern rationalism, and arrives at an unprecedented framework of synthetic a priori principles that determine the validity of our judgments. Pollok examines the hylomorphism in Kant's theory of (...) normativity and relates Kant's idea of our reason's self-legislation to the 'natural right' tradition, revealing Kant's debt to his predecessors as well as his relevance to contemporary debates on normativity. We apply methods of abduction derived from propositional probabilistic reasoning to predicate probabilistic reasoning, in particular inductive logic, by treating finite predicate knowledge bases as potentially infinite propositional knowledge bases. It is shown that for a range of predicate knowledge bases and several key propositional inference processes this procedure is well defined, and furthermore yields an explanation for the validity of the induction in terms of 'reasons'.

In this paper we describe a general way of formalizing reasoning behaviour. Such a behaviour may be described by all the patterns which are valid for the behaviour. A pattern can be seen as a sequence of information states which describe what has been derived at each time point. A transition from an information state at a point in time to the state at the (or a) next time point is induced by one or more inference steps. We choose to (...) model the information states by partial models and the patterns either by linear time or branching time temporal models. Using temporal logic one can define theories and look at all models of that theory. For a number of examples of reasoning behaviour we have been able to define temporal theories such that its (minimal) models correspond to the valid patterns of the behaviour. These theories prescribe that the inference steps which are possible, are “executed” in the temporal model. The examples indicate that partial temporal logic is a powerful means of describing and formalizing complex reasoning patterns, as the dynamic aspects of reasoning systems are integrated into the static ones in a clear fashion. Citing Kant, the author defines an idea of reason as a concept of the unconditioned totality of the conditions of the conditioned. A theoretical idea is valid if it conforms to the real; but a practical idea can be justified only by an appeal to the unconditioned obligation to realize it. Having introduced these terms and theses, the author examines the ontological and cosmological arguments as attempts to prove the reality of the ideas. Kant insists that our actions ought to conform to objective moral rules, and that these rules apply to us regardless of whether we feel inclined to conform to them. Can he establish the truth of these claims? ;His writings on moral philosophy contain not a single answer to this question but two distinct and incompatible ones. In the Groundwork of the Metaphysics of Morals, Kant argues that the basic norm that underlies our moral judgments, the Moral Law, is valid for (...) us because it is rooted in the freedom of our rational nature. But, in the Critique of Practical Reason, he argues that the Law is a fact that requires no justification and that this fact allows us to reason from morality to freedom. Is one of these arguments more convincing than the other? ;It would seem not. For each argument, I try to show, begs the question against an empirically-minded view of morality. More specifically, in the Groundwork Kant uncritically assumes that the freedom of rational agency enjoys a kind of independence from the motivational influence of sensible desires; while, in the second Critique, he similarly assumes that this motivation plays no role in an account of the validity of moral judgments. ;But I also try to show that Kant would have offered a more satisfying solution to the problems of moral theory had he modelled his views about agency more closely upon other views he holds about the self in its theoretical employment. The idea is this: Kant holds that theoretical knowledge requires a unified knowing subject, that a subject as varied as are its individual sense-experiences can never know the way the world is. I suggest that he could have defended an analogous claim about the connection between moral knowledge and the unity of agency; that is, were an agent as varied as are its individual desires, it could never know the way the world ought to be. I do not contend that this alternative solution is completely convincing, but I do hold that it offers an attractive response to central difficulties in the Groundwork and second Critique. (shrink)

Designing and building complex artifacts like simulation models often rely on the strategy of modularity. My main claim is that the validation of simulation models faces a challenge of holismHolism because modularityModularity tends to erode over the process of building a simulation model. Two different reasons that fuel the tendency to erosion are analyzed. Both are based on the methodologyMethodology of simulation, but on different levels. The first has to do with the way parameter adjustment works in simulation; the (...) second comes from how different groups of software programmers work together. The chapter will conclude by drawing lessons about how holism challenges the validation of simulation and by discussing a corollary to conformational holism: the boundary between validation and verification tends to become blurred, thus undermining a strategy that insists on keeping them separate. The paper suggests a novel methodology for determining the state of legal doctrine on a particular issue by legal scholars. This methodology is inspired by the philosophical field of phenomenology. In particular, the tool of eidetic reduction developed by Edmund Husserl is applied to reach inter-subjectively valid assessments of doctrine. The methodology developed here argues that scholars who wish to discover legal doctrine on a particular issue need to first define general paradigms that explain the relevant legal field. Then, they (...) should develop a hypothesis about the law on the particular issue that concurs with the essential qualities of all these paradigms. Finally, to determine if a hypothesis about the content of the law should be accepted or rejected, it must be checked against legal sources that often include judgments. Reasoning by analogy should be used to learn from judgments with the same policy implications as the doctrine suggested by the hypothesis. The paper offers several heuristics—demonstrated with examples from international law—that can be used to find judgments that have the same policy implications without determining conclusively what these implications are. This essay in metaphysics seeks to preserve the insights of rationalism and empiricism, but repudiates the epistemological models prevailing in the last three centuries. The problem is the self-validation of reason and with it ontology. Under the stimulus of an object, awareness arises sui generis. Understanding, continuous with awareness in contrast to the Kantian mediation via the Schematism, is the completion of awareness. The object impinges on reason in virtue of "being what it is," and thus a (...) realism is espoused. Categorial and linguistic or symbolic structures of reason are denied as the ultimate conditions of experience. The point is to find the source of all rational frames and empirical appeals. The case is built on the reflexivity of reason, and the whole argument turns on internal relations. The rallying cry is back to "entities" in their total concreteness, which leads to discussions of Being and power. The position is ably argued, the perspective fresh, but the highly ornate style tends to obscure the reader's view of the issues.—P. S. (shrink)

This paper engages with the curriculum at Madame de Maintenon's school for girls at Saint‐Cyr to raise and address a set of questions: What is it to teach someone to reason? The curricular materials of Saint‐Cyr suggest that learning to reason is a matter of practice. How is one to distinguish autonomous reason giving from habituation or automatic trained responses? How can practices in reason giving informed by social mores have objective validity? Moreover, if we think (...) of the role of a philosopher as the cultivation of rational faculties and recognize that how this role is played is bound up with social norms, by what standards ought we to evaluate whether a philosophical educator is good or bad? Intertwined with the discussion is also a question about the limits of philosophy for the question. (shrink)

Reason's capacity to take us where we did not expect to go could also lead to a curious diversion from what one might expect to be the straight line of evolution. We have evolved a capacity to reason because it helps us to survive and reproduce. But if reason is an escalator, then although the first part of the journey may help us to survive and reproduce, we may go further than we needed to go for this (...) purpose alone. We may even end up somewhere that creates tension with other aspects of our nature. In this respect, there may after all be some validity in Kant 's picture of tension between our capacity to reason, and what it may lead us to see as the right thing to do, and our more basic desires.
