Why equality cannot be conditional on a shared human “nature” but has to be for all For centuries, ringing declarations about all men being created equal appealed to a shared human nature as the reason to consider ourselves equals. But appeals to natural equality invited gradations of natural difference, and the ambiguity at the heart of “nature” enabled generations to write of people as equal by nature while barely noticing the exclusion of those marked as inferior by their gender, race, (...) or class. Despite what we commonly tell ourselves, these exclusions and gradations continue today. In Unconditional Equals, political philosopher Anne Phillips challenges attempts to justify equality by reference to a shared human nature, arguing that justification turns into conditions and ends up as exclusion. Rejecting the logic of justification, she calls instead for a genuinely unconditional equality. Drawing on political, feminist, and postcolonial theory, Unconditional Equals argues that we should understand equality not as something grounded in shared characteristics but as something people enact when they refuse to be considered inferiors. At a time when the supposedly shared belief in human equality is so patently not shared, the book makes a powerful case for seeing equality as a commitment we make to ourselves and others, and a claim we make on others when they deny us our status as equals. In the Freedom essay, Schelling charges that (1) idealism fails to grasp human freedom’s distinctiveness and that (2) this failure undermines idealism's attempt to refute pantheism, as exemplified by Spinoza. This raises two questions, which I will answer in turn: what, for Schelling, is distinctive of human freedom; and how does the idealists’ failure to grasp it render them unable to refute pantheism? To answer these questions, I will reconstruct Schelling’s argument that freedom has the distinctness of being the unconditioned (...) condition of the world’s intelligibility. My reconstruction will illustrate how Schelling’s notion of freedom as primal will grounds the alleged primacy of practical reason as Kant and Fichte conceive it. I will then consider three objections to Schelling’s argument. Throughout, I will develop the Schellingian idea that freedom is enacted in an unprethinkable decision that cannot be anticipated by any law or principle. (shrink)

This paper argues that the moral value of unconditional forgiveness is more complicated and constrained than it is often taken to be. When we unconditionally forgive, we engage with someone in a way that doesn’t take seriously their perspective about the meanings and values at stake in our relations with them. Other things being equal, this is problematic; it is normatively condescending, belittling the place of the other person’s moral agency in our relations with them. This doesn’t mean that (...) unconditional forgiveness is always bad or impermissible. It does, though, complicate how we should think about its moral value. (shrink)

The first (...) part of the paper examines and criticises those arguments which attempt to defend conditional love by appeal to the idea that love is based upon the properties of the beloved. The second part of the paper examines Harry Frankfurt's narrowly subjective conception of unconditional love and highlights certain counterintuitive consequences of it. The final section of the paper argues that the best kind of love will prompt us to adopt two perspectives with regard to the beloved. While loving does involve the narrowly subjective perspective defended by Frankfurt, it also demands that we strive for a more objective perspective, which takes into consideration the reasons we might be able to offer to render our commitment intelligible to others. In a larger context of an egalitarian project which aims to reformulate capitalism a job guarantee program in the form of a State as an Employer of Last Resort is considered superior to Unconditional Basic Income by many, namely Alan Thomas. This article claims that most of the arguments used to assert the superiority of SELR fail their objective, for the following reasons: first, SELR falls short in its reformulation of capitalism because neither SELR nor UBI alone can euthanize (...) the rentier class. Second, most accounts are based on a flawed assumption that UBI leads to rampage inflation. Third, if macroeconomic considerations are not enough to justify implementing SELR over UBI, then insisting on the superiority of SELR can only stem from two types of moral reasons: on one hand from a perfectionist view of empowering the worst-off through labor and on the other from demands and obligations of reciprocity. We argue that these two moral-based reasons fall short of providing a justification for the superiority of SELR over UBI. We conclude our paper defending the possibility of conciliating the two policies. (shrink)

Jacques Derrida’s ethics generates a vision of what the community of nations, states, people is and should be beyond a separation made by what he calls ‘interest’ by which he means that the human interiorizes everything outside himself in order to con­figure a self. For Derrida, forgiveness must not be in the service of any finality such as spiritual, social, national, psychological, and political orientation, since these are reconciliation for the sake of other goals rather than for­giveness. The ‘unconditional (...) forgiveness’ is against the ‘normalization’ by which I argue, in the first section, that Derrida means ‘interest.’ In the second section, through the notion of aporia, without a way out, it is argued that one is situated in the state of ‘difference’ by which Derrida means that an individual is not individual because of difference in identity with another individual, since the identity closes one to the other. Rather, one individual is different from another one by being open to itself and another one. In the forgiveness, this ‘difference’ entails abandoning oneself to the ‘other’ by which one is ‘forgiven for existing.’ The third section discusses Abraham’s sacrifice of his son to illustrate the absolute res­ponsibility for the ‘other’ by which we can rethink morality. Doubling unconditionals are exemplified by the Spanish example Venga quien venga, estaré contento ‘Whoever comes, I’ll be happy’. This curious and little studied construction is attested in various forms in a number of Romance and Slavic languages. In this paper, I provide a basic description of these constructions, focusing especially on Spanish, Czech, and Slovenian, and argue that they can be brought in line with analyses of run-of-the-mill unconditionals if one recognizes that the wh-structure within the unconditional antecedent is (...) a free relative and that the free relative is focused. The focused free relative introduces alternatives and thus gives rise to the denotation proposed by Rawlins :111–178, 2013) for English unconditionals. In the last part of the paper, I hypothesize that at least some non-doubling unconditionals could in fact have a doubling underlying structure, which is disguised by relative sluicing—clausal ellipsis with a relative pronoun remnant. Stuart White and others claim that providing welfare benefits to citizens who do not, and are not willing to, work breaches the principle of reciprocity. This, they argue, justifies placing a minimum work requirement on welfare recipients. This article seeks to rebut their claim. It begins by rejecting the attempt to ground the work requirement on a civic obligation to work. The article then explores the principle of reciprocity, and argues that the practice of reciprocity depends on the particular conception (...) of distributive justice adopted. An examination of different interpretations of egalitarian justice and their corresponding patterns of reciprocity demonstrates that unconditional welfare benefits are compatible with, and sometimes even warranted by, the principle of reciprocity. Unconditionals are syntactic conditionals whose affirmation affirms their consequent, unconditionally. Prominent instances were addressed by J.L. Austin ('There are biscuits if you want some') and Nelson Goodman (even-if 'semifactuals'). Their detailed features are explained in a Decision-Theoretic Semantics (DTS) which extends, by certainty and relevance conditions, the "CCCP" conditional probability construal of conditionals due to Ernest Adams and others. The construal of assertions of conditionals as conditional acts, defended by Keith DeRose and Richard Grandy in 1999 against objections arising from (...) Austin's unconditionals, is shown to be incompatible with any known version of CCCP. However, an ad-hoc decision-theoretic construal of their proposal is seen to work for Austin's unconditionals, albeit for these only. The DTS account of unconditionals hinges on stochastic independence or irrelevance conditions. For Austin's variant, it also involves changes in the expectations of non-indicator random variables, i.e. properly valuational relevance relations. The widely assumed speaker's knowledge presumption for assertion in general is reconstrued non-transcendently as a proposal to update to ostensible common certainty. This imperative replaces the factive 'T-axiom', KA-> A, of modal logical explications of knowledge to yield an doxastically imperatival, but evidence-sensitive theory of assertoric truth claims. On such a basis, Max Black's and G.E. Moore's ostensibilist account of assertors representing themselves as knowing is defended against Tim Williamson's 1996 and Igor Douven's 2006 respective deontic proposals for a knowledge or rational credibility requirement. Moreover, ostensibly unconditional, unhedged assertion is reconciled with a reality of dimly perceived potential defeaters on recognizing it to be a tacit semifactual, if need be. (shrink)

This paper explores whether terrorist violence could be morally justified or excused. It defends the absolute immunity of innocent people against those who might want to sacrifice them for other goals. The defense is based on recognizing people’s stringent natural duty of nonmaleficence, which entails an obligation on moral agents to refrain from intentionally bringing about harm or significant risk of it to the innocent. The paper is divided into two parts. The first part distinguishes between unconditional and conditional (...) critics’ arguments regarding the use of terrorist violence, and between a narrow and a broad definition of terrorism. While unconditional critics accept the narrow definition or one akin to it because they equate terrorism with murder, conditional critics accept the broad definition or one akin to it because they attempt to justify or excuse the use of terrorism based, e.g., on an analogy with a just war approach, consequentialism, moral relativism, supreme emergency or last resort. Exception is taken with the latter arguments since they attempt to justify or excuse morally unjustifiable and inexcusable actions such as the deliberate use of violence against the innocent. The second part explores plausible conditional critics’ reasons for justifying or excusing the 9/11/01 attacks and find them wanting. If the argument works, then, with minor modifications, it could also apply to the 3/11/04 attacks in Madrid, the 7/7/05 attacks in London, and similar attacks elsewhere. (shrink)

Over the past decade, non-invasive prenatal testing (NIPT) has been adopted into routine obstetric care to screen for fetal sex, trisomies 21, 18 and 13, sex chromosome aneuploidies and fetal sex determination. It is predicted that the scope of NIPT will be expanded in the future, including screening for adult-onset conditions (AOCs). Some ethicists have proposed that using NIPT to detect severe autosomal AOCs that cannot be prevented or treated, such as Huntington’s disease, should only be offered to prospective parents (...) who intend to terminate a pregnancy in the case of a positive result. We refer to this as the ‘conditional access model’ (CAM) for NIPT. We argue against CAM for NIPT to screen for Huntington’s disease or any other AOC. Next, we present results from a study we conducted in Australia that explored NIPT users’ attitudes regarding CAM in the context of NIPT for AOCs. We found that, despite overall support for NIPT for AOCs, most participants were not in favour of CAM for both preventable and non-preventable AOCs. Our findings are discussed in relation to our initial theoretical ethical theory and with other comparable empirical studies. We conclude that an ‘unconditional access model’ (UAM), which provides unrestricted access to NIPT for AOCs, is a morally preferable alternative that avoids both CAM’s fundamental practical limitations and the limitations it places on parents’ reproductive autonomy. The article examines one of the many philosophical problems that arise in the discussion on the prospects of unconditional basic income implementation. The author believes that the question of the future of labor should be reviewed in a social-philosophical perspective. The analytical potential of philosophical thinking can be useful in predicting the consequences of implementing the basic income initiative. The article proceeds from the premise that in the 21 st century the idea of basic income application turns from a (...) utopian project into real measures roadmap. The economic well-being provided by the widespread use of technical means makes it possible to seriously plan the transfer of many workers employed in the sector of services and non-material production to basic income. The author points out that first of all it is necessary to assess the consequences of such a measure for the people. Traditionally, capitalist society has been built around a narrative that hard work is well rewarded. The opposition of labor and free time has shaped consumption patterns and life strategies for several generations. In the conclusion, the author suggests to consider whether, by removing such a system-forming element from the social structure, the society itself will be put under threat. It may turn out that an initiative aimed at changing society for the better will actually turn out to become a personal disaster for many people who will not be able to find a use for themselves in the new world, which is already not built around labor. Among other things, the author draws attention that contemporary capitalism, by actualizing the idea of basic income, abolishes the very opportunity of human choice. Virtually all human activity transforms into alienated labor. (shrink)

This paper contains a summary of public support for the idea of unconditional basic income in the Czech Republic in the first part. Interest in unconditional income can be found both in the Czech political sphere and in the social sciences community. In the second part, the article theoretically analyzes the possible sources of unconditional basic income funding. The aim of this paper is to support argumentation in favor of the implementation of BI by a systematic analysis (...) of the real possibilities of its funding through the state tax revenues. The feasibility of funding a BI scheme using taxes on labor, property, consumption, environmental taxes, financial transaction tax, and tax on the transfer of information is considered. Consideration is also given to administrative savings that the basic income system could bring. Due to political enforceability of BI, it is important to contemplate and discuss the distortions and other problems of proposed changes in taxation, which would not be negligible as can be expected. In this paper I demonstrate that the quantum correlations of polarization observables used in Bell’s argument against local realism have to be interpreted as conditional quantum correlations. By taking into account additional sources of randomness in Bell’s type experiments, i.e., supplementary to source randomness, I calculate the complete quantum correlations. The main message of the quantum theory of measurement is that complete correlations can be essentially smaller than the conditional ones. Additional sources of randomness diminish correlations. One can say another (...) way around: transition from unconditional correlations to conditional can increase them essentially. This is true for both classical and quantum probability. The final remark is that classical conditional correlations do not satisfy Bell’s inequality. Thus we met the following conditional probability dilemma: either to use the conditional quantum probabilities, as was done by Bell and others, or complete quantum correlations. However, in the first case the corresponding classical conditional correlations need not satisfy Bell’s inequality and in the second case the complete quantum correlations satisfy Bell’s inequality. Thus in neither case we have a problem of mismatching of classical and quantum correlations. The whole structure of Bell’s argument was based on identification of conditional quantum correlations with unconditional classical correlations. (shrink)

Drawing on philosophy, history, and critical theory, Unconditional Life introduces a new perspective on the significance of post-war international law developments. The book examines the public discourse regarding technological risk in World War II texts of unconditional surrender, in the World Trade Organisation's EC-Biotech dispute, and in the International Court of Justices' Nuclear Weapons Advisory Opinion. The volume describes international law in terms of its management of, and relation to, the risks associated with technological innovation in war and (...) in trade. It proposes that international law, too, is itself a kind of technology: one intended to manage the material and existential risks inherent in the creation of a new international, postcolonial, political community emerging out of the Second World War. Members of this community are imagined to possess a universal quality: humanness, which itself is underscored by a power of invention. Yoriko Otomo demonstrates how international lawyers' inability to adjudicate questions of large-scale technological risk is due to the competing and intractable claims of international law.Offering a feminist analysis of the political economy that has created this crisis of governance, the book provides a way of understanding the structural inequities that will need to be addressed if international law is to remain a relevant forum for the adjudication of war and trade into the 21st century. This article, inspired by the Derridean thinking of hospitality, attempts to reflect upon the conditions of peace and hospitality, taking a reading of Kant's ‘Toward Perpetual Peace’ as its guiding thread. It endeavours to show that the peace that inhospitable nations maintain between themselves is necessarily illusory, as they continue to amass the restrictive conditions of their hospitality. The hypothesis is proposed that the guiding thread that links the elements of the hyperbolic ethics that Derrida deploys in his ‘questions of (...) responsibility’ seminars indeed concerns this unconditional condition of peace, of which hospitality is the first law. Much philosophy of the last few decades has witnessed a turn toward otherness and a corresponding calling into question of the autonomy of the agent. In my paper I attempt to re-conceive what agency is in light of this emphasis placed on otherness. I undertake this reconsideration through an analysis of the concepts of unconditionality in Kant and of conditioning by the other in Levinas. Through these analyses I arrive at a new concept: the unconditioning of the agent by the (...) other. I then provide some description of this concept by considering the interpretation of the theological concept of creation in Augustine, Kant, and Levinas. (shrink)

Even if unconditional truth is unattainable in principle, the ideal of unconditional truth has an important role to play in practice, according to Habermas. Habermas' position can be construed as descriptive or prescriptive. Either way, it faces considerable challenges. As a description, it raises classic philosophical problems. As a prescription, it raises many of the practical problems of religious fundamentalism, as Rorty argues. Trying to avoid the theoretical problems inherent to the concept of unconditional truth by non-epistemic (...) means is not promising. (shrink)

ABSTRACT Kant's third antinomy introduces freedom as the unconditioned cause that allows reason to form a synthesis of causal linkage. What different thinking conditions, I ask, does this antinomy open up for reason even to entertain any possibility of success? Reason's ability to form a synthesis depends on acknowledging the role in Kant's argument of a subject that does not need to be envisioned as a standpoint—whether intelligible or empirical, as Kant's explicit solution has it—but, rather, as the site of (...) a relationship between the series and its outside. We may call it “unconditioned subjectivity,” clarifying from the outset that subjectivity in this sense names a structural position that plays an exceptional role in the series: it is the element that exceptionally introduces a boundary, a fleeting moment of closure. Unconditioned subjectivity would name the relationship and boundary that anchor the phenomenal series time and again. I argue, moreover, that the synthesis of causality forming here coheres as a dynamic system that is not stable or self-contained but, rather, contingent and “in progress.” Perhaps unexpectedly, the potential of this antinomy to form this dynamic system hinges on the fact that its antithesis denies freedom. This essay draws attention to the question how a strong notion of unconditional responsibility in the face of the other’s mortality is related to the historical experience of a disastrous violence that seems to annihilate not only numerous bodies, lives, identities and histories but, rather, any responsible religio to the other – whether living or dead. It is well known, that Levinas claimed that human responsibility demands not to let the other alone in his death. But if the other (...) is already dead – like numerous others who share the same fate – keeps human responsibility silent, then? And how is this religio of human responsibility related to forms of disastrous violence which seem to deny it? (shrink)

Forgiveness is a compelling Christian ideal. By contrast, to many philosophers it is not clear that forgiveness should be endorsed as a moral requirement; some argue that unconditional forgiveness is morally wrong. Those who are required to exercise forgiveness can feel that their own dignity and moral worthiness is diminished by such requirement if insignificant recognition was given to the harms they suffered as victims. This is particularly significant when thinking about women’s lives. Forgiveness and justice occasion particularly painful (...) quandaries in feminist ethics. However, an important stream of feminist ethics—namely the ethics of care—can make a convincing case in favor of forgiveness. A main goal of an ethics of care is preserving relationships for which, in the less than ideal conditions of human life, forgiveness is essential. Thus, the ethics of care casts additional light on the tension between pursuing forgiveness and justice. By spelling out these various dilemmas, I illustrate how a feminist ethics and a feminist philosophy of religion can be fruitful intellectual allies. A feminist ethics will benefit from cautious reliance on religious wisdom, concomitantly acknowledging the need for forgiveness and qualifying the requirements of forgiveness such that this ideal does not become, once again, oppressive for women. And a feminist philosophy of religion should be to some extent informed by feminist ethical goals, helping to unveil religious resources that give credit to our ongoing need for forgiveness, without however overlooking the importance of (gender) justice. ABSTRACT Refugees, as forced migrants, have suffered displacement under conditions not of their own choosing. In 2000 there were thought to be 22 million refugees of whom 6 million were HIV positive. While the New Zealand government has accepted a number of HIV positive refugees from sub‐Saharan Africa, this hospitality is under threat due to negative public and political opinion. Epidemic conditions raise the social stakes attached to sexual exchanges, contagion becomes a major figure in social relationships and social production, (...) and the fears of the contagious nature of those ‘just off the plane’ connect refugees to an equally deep‐seated fear of racial miscegenation. Jacques Derrida’s notion of unconditional hospitality is a dream of a democracy which would have a cosmopolitan form. This means that one cannot decide in advance which refugees one might choose to resettle. This paper will use Derrida’s notion of unconditional hospitality to emphasise the fragility of HIV positive refugees’ position, caught between becoming newly made New Zealand subjects while at the same time having that subjecthood threatened. For Derrida, both ethics and politics demand both an action and a need for a thoughtful response (a questioning without limit). (shrink)

In this paper, the principal objections to unconditional forgiveness are canvassed, primarily that it fails to take wrongdoing seriously enough, and that it displays a lack of self-respect. It is argued that these objections stem from a mistaken understanding of what forgiveness actually involves, including the erroneous view that forgiveness involves some degree of condoning of the offence, and is incompatible with blaming the offender or punishing him. Two positive reasons for endorsing unconditional forgiveness are considered: respect for (...) persons and human solidarity; and it is argued that the latter provides more plausible grounds for it than the former. The CP-violation problem and unconditional tests of discrete symmetries T and CPT are investigated in the exact quantum theory (QT) beyond the usually used Lee-Oehme-Yang (LOY) theory, which is based on the famous Weisskopf-Wigner (WW) approximation. New unconditional CP-violation effects, independent from those known before, new unconditional tests of the CPT and T invariances, and new results for correlations are derived. The Corpus of English Philosophy Texts (CEPhiT) is part of the Coruña Corpus of English Scientific Writing (CC) following CETA (Corpus of English Texts on Astronomy). In accordance with the rest of the Corpus, CEPhiT has been compiled for the description of philosophical texts written in English in the eighteenth and nineteenth centuries. The sampling method employed requires the collection of extracts of 10,000 words. This method has been followed in CETA and CEPhiT, with samples from 40 different authors in (...) the latter, both from Europe and North America. Text selection is based on some extralinguistic criteria, such as year of publication, sex, geographical provenance and text-types/genres. The corpus contains samples belonging to six different genre categories. This taxonomy, as well as some other extralinguistic information, can be used to search the corpus. CEPhiT, like CETA, is released on CD-Rom with Coruña Corpus Tool (CCT), purpose-designed software by IrLab. (shrink)

Conditionality is a modal feature (in only the trivial sense, in the case of the material conditional). For φ to be conditioned on ψ is for the appearance of φ and ψ to be connected in some way over some region of modal space.

In this paper I address the question 'How is knowledge of logical truths possible'. The sought-after explanation should be independent of what the true story about logical truth is. In particular, I try to account for the epistemic warrant that is conferred upon logical beliefs when they are neither inferred from other beliefs nor grounded on empirical evidence or testimony. The need for such an account is motivated by the apparent failure of the notions ofanalyticity on the one hand and (...) intuition on the other in addressing the relevant question. I end up defending an account according to which warranted logical beliefs can be grounded on pure reasoning: they can be inferentially formed on the basis of pieces of suppositional reasoning. I present a novel account of unconditional obligation and of its relationship to conditional obligation and bring this account to bear upon Chisholm's puzzle concerning contrary-to duty obligation.

Eliminativists about free will and moral responsibility argue that no action can be free and responsible because in order to be actions, our movements must be caused by features of our character or will. However, either the will is constituted by states that are themselves produced by events outside our control, or it is constituted by our own choices, which must themselves stem from our will in order to be up to us. Thus, any attempt to account for freedom and (...) responsibility seems to either run into an infinite regress or leave the ultimate causes of our actions up to something outside our agency. Compatibilists attempt to respond to this challenge by arguing that we need not have control over our will in order to be free, but only to have control of our actions on the basis of our will. Libertarians, on the other hand, argue that we can be free so long as our choices are caused indeterministically and chosen for reasons. -/- I argue that both approaches ultimately leave the constitution of the will up to non-agential factors because the dominant accounts view all choices—including those that constitute the will—as essentially events caused by other events, leaving no function for agents to perform. In response, I argue that we can avoid eliminativism if we take the will to be irreducible to events such as choices and also our own. Through an examination of recent non-volitionist approaches that allow for responsibility for non-deliberative action, I argue that such accounts presuppose a Heideggerian view of agency on which all action and deliberation occur on the basis of an underlying projection of possibilities into which we are thrown. Heidegger’s account of temporality in turn allows us to own ourselves in the present by retrieving our past as always already chosen in light of our self-projection into the future. Agents are thus self-constituting beings capable of owning themselves and independent of causation by prior events. Freedom and responsibility are therefore irreducible features of agency. (shrink)

Sen’s Liberal paradox describes a conflict between weak Pareto, minimal liberalism, and either transitivity or a best element over a domain of individual preferences. This paper examines variants of that paradox with varying amounts of unconditional preferences. We define a notion of unconditional preferences under which, in the absence of Pareto, there can be no cycles. We then define a stronger condition, that makes an individual’s preferences for her own private attributes independent of all other attributes. Under this (...) assumption, there can be no cycles with or without Pareto. We also show there exists a social decision function satisfying those conditions. We then determine the probability of a cycle assuming a much weaker independence condition that does not restrict the domain. This probability converges to one as the number of non-private attributes within the social states increases. Finally, we use simulations to determine the probability that liberalism and Pareto conflict with best elements, maximal elements, and transitivity separately. (shrink)
