This study investigates the engagement of family firms in corporate social responsibility. We first compare their corporate social performance to non-family firms. Then, following recent evidence on the heterogeneity of family firms, we examine two factors that may influence CSP within family firms: the level of family control and the governance orientation of the country in which they operate. This research is based on a theoretical framework which considers both agency and socioemotional wealth influences on family firms CSR engagements. Overall, (...) we find that family firms exhibit lower CSP than non-family firms. But when focusing on family firms, our analyses show a curvilinear relationship between family control and CSP. At lower levels of control, family owners invest more in social initiatives to protect their SEW. Beyond a threshold level of control that we estimate at 36 % in our sample, economic considerations prevail over SEW and social performance starts decreasing. We also find that family firms operating in stakeholder-oriented countries are more attentive to social concerns than those operating in more shareholder-oriented countries. (shrink)

This article proposes and empirically tests a theoretical framework incorporating Reidenbach and Robin’s (J Bus Ethics 10(4):273–284, 1991 ) conceptual model of corporate moral development. The framework is used to examine the relation between governance and business ethics, as proxied by diversity management (DM), and financial reporting quality, as proxied by the magnitude of earnings management (EM). The level of DM and governance quality are measured in accordance with the ratings of Jantzi Research (JR), a leading provider of social and (...) governance research for institutional investors. This DM score is part of an index developed by JR that investment managers use to integrate DM criteria into their investment decisions. As expected, a negative relation between corporate DM development and financial reporting quality is found while controlling for other factors known in the literatures on governance and accounting choices to affect earnings quality. Despite some caveats presented in conclusion, this study contributes to the ethics, governance, and financial reporting literatures by studying the dynamics between governance and ethics in the prevention of EM. Although shared decision-making is a standard in medical care, unilateral decisions through process-based conflict resolution policies have been defended in certain cases. In patients who do not stand to receive proportional clinical benefits, the harms involved in interventions such as cardiopulmonary resuscitation seem to run contrary to the principle of non-maleficence, and provision of such interventions may cause clinicians significant moral distress. However, because the application of these policies involves taking choices out of the domain of shared decision-making, they face (...) important ethical and legal problems, including a recent challenge to their constitutionality. In light of these concerns, we suggest a re-conceptualization of informed non-dissent as an alternative approach in cases where the application of process-based policies is being considered. This clinician-directed communication model still preserves what is valuable in such policies and salvages professional integrity, while minimising ethical and legal challenges. (shrink)

The Constitutional State, in its initial configuration as a liberal Constitutional State, recognised a series of basic individual rights as fundamental rights. Subsequently, in the second half of the 20 th century, social, economic and cultural rights were integrated into the Constitution, creating the social Constitutional State. However, although said group of rights are always mentioned as a compact group, or a package of rights, in fact the second recognition only took place, in the strictest sense, with respect of social (...) and economic rights, and, to a much lesser degree, in respect of cultural rights. Largely, the cultural rights are forgotten rights in the Constitutional State, but today our society is multicultural. This is a contradiction. The text provides the basis for a progressive recognition of cultural rights in the Constitutional State. Also, the text discusses the benefits for all if we consider these rights as rights of the person, that is, as rights of all persons and not only of minorities. (shrink)

I argue in this paper for the continued construction and maintenance of what I have called the ‘American Foucault’, whose principal preoccupation is with the question of how to be free within our contemporary political constraints and possibilities. (Such a Foucault can be found in the works of American writers such as W. E. Connolly, Todd May, and Thomas Dumm.) Appreciation of Foucault’s contribution to an understanding of freedom is too often (...) hampered, however, by the insistence on the part of many of the most influential of Foucault’s critics (and some of his defenders) that his particular mode of thinking is ultimately too irresponsible. It is thought that Foucault’s refusal to account for the grounds of his work vitiates his overall project. I argue that, if we distinguish between the ‘account-ability’ demanded by his critics and the ‘response-ability’ that his work permits, we will be in a better position to appreciate the timeliness of his conception of freedom. We propose a lexical account of event nouns, in particular of deverbal nominalisations, whose meaning is related to the event expressed by their base verb. The literature on nominalisations often assumes that the semantics of the base verb completely defines the structure of action nominals. We argue that the information in the base verb is not sufficient to completely determine the semantics of action nominals. We exhibit some data from different languages, especially from Romance language, which show that nominalisations focus (...) on some aspects of the verb semantics. The selected aspects, however, seem to be idiosyncratic and do not automatically result from the internal structure of the verb nor from its interaction with the morphological suffix. We therefore propose a partially lexicalist approach view of deverbal nouns. It is made precise and computable by using the Montagovian generative lexicon, a type theoretical framework introduced by Bassac, Mery and Retoré in this journal in 2010. This extension of Montague semantics with a richer type system easily incorporates lexical phenomena like the semantics of action nominals in particular deverbals, including their polysemy and felicitous copredications. Miranda Barbosa, inspirado na filosofia aristotélico-tomista, tentou construir o edifício de uma lógica pura, a priori, sem fundamentação nem na gnosiologia nem na ontologia. Neste sentido, subordina as contribuições da lógica matemática, do existencialismo e da fenomenologia ao seu intento maior. Por isso o designamos como “o último clássico” da filosofia em Portugal.

Democratic political action makes manifest the part that has no part—not as a protest against the policing order but its rejection through the affirmation of the equality of speaking beings. How can such an affirmation be supported? How can it endure? It is argued in this article that Foucault’s most distinctive contribution to philosophical practice is to be found in his distinctive mode of taking up historiography, exploring critically the conditions and limits of knowledge through archival work. The focus on knowledge would seem to place him in the critical lineage of Kant; however, his appeal to history and archival explorations reconfigure the relation between sensibility and the understanding in a way that suggests a different concern with the conditions of “a (...) possible knowledge.” After discussing how Foucault’s archival work engages a distinct sensibility, I suggest that his concern with knowledge can best be understood not within a transcendental project, however historicized, but within the logical space of Hegel’s Doctrine of the Concept, specifically the discussion of the Idea of cognition where it is a question of the twin processes of unifying subjectivity and objectivity as expressive of cognition’s “urge to truth.” Understood within this conceptual context, Foucault’s distinctive archival approach to what he calls “subjectivation” and “objectivation” allows us to appreciate the distinction between knowledge and truth in a way that leaves open the possibility of transformation. While COVID-19 has generated a massive burden of illness worldwide, healthcare workers (HCWs) have been disproportionately exposed to SARS-CoV-2 coronavirus infection. During the so-called ‘first wave’, infection rates among this population group have ranged between 10% and 20%, raising as high as one in every four COVID-19 patients in Spain at the peak of the crisis. Now that many countries are already dealing with new waves of COVID-19 cases, a potential competition between HCW and non-HCW patients for scarce resources can (...) still be a likely clinical scenario. In this paper, we address the question of whether HCW who become ill with COVID-19 should be prioritised in diagnostic, treatment or resource allocation protocols. We will evaluate some of the proposed arguments both in favour and against the prioritisation of HCW and also consider which clinical circumstances might warrant prioritising HCW and why could it be ethically appropriate to do so. We conclude that prioritising HCW’s access to protective equipment, diagnostic tests or even prophylactic or therapeutic drug regimes and vaccines might be ethically defensible. However, prioritising HCWs to receive intensive care unit (ICU) beds or ventilators is a much more nuanced decision, in which arguments such as instrumental value or reciprocity might not be enough, and economic and systemic values will need to be considered. The COVID-19 pandemic has generated an imbalance between the clinical needs of the population and the effective availability of advanced life support (ALS) resources. Triage protocols have thus become necessary. Triage decisions in situations of scarce resources were not extraordinary in the pre-COVID-19 era; these protocols abounded in the context of organ transplantation. However, this prior experience was not considered during the COVID-19 outbreak in Spain. Lacking national guidance or public coordination, each hospital has been forced to put forth independent (...) and autonomous triage protocols, most of which were, nonetheless, based on common ethical principles and clinical criteria. However, controversial, non-clinical criteria have also been defended by Spanish scientific societies and public institutions, including setting an age cut-off value for unilaterally withholding ALS, using ‘social utility’ criteria, prioritising healthcare professionals or using ‘first come, first served’ policies. This paper describes the most common triage criteria used in the Spanish context during the COVID-19 epidemic. We will highlight our missed opportunities by comparing these criteria to those used in organ transplantation protocols. The problems posed by subjective, non-clinical criteria will also be discussed. We hope that this critical review might be of use to countries at earlier stages of the epidemic while we learn from our mistakes. (shrink)

Foucault appears now and again in the work of Charles Taylor, but fleetingly, almost hauntingly. This is not surprising because Taylor and Foucault share many ideas and yet remain starkly opposed. This is especially true of Taylor's most recent work, his monumental Sources of the Self: The Making of the Modern Identity. In it he is characteristically brilliant, in the sense that he attempts to illuminate a great many things all at once. Foucault is mentioned here and there in that (...) work, along with a great many others. However, I would claim that Foucault's presence is much more sustained than the index would have us believe. In fact, one might say that Foucault is the shadow cast by Taylor's brilliance. (shrink)

For 'Army of One', photographer Elisabeth Real looks beyond these numbers to the individual soldier. Like Kant, Foucault challenges us to rethink the way we relate freedom and truth by stressing the idea of "maturity" understood as a release from the "self-incurred tutelage" (the expression is from Kant) that otherwise characterizes so much of our lives. Though, rather than linking freedom and truth via the concept of autonomy (or lawfulness), as Kant does, Foucault outlines a possible experience of ethics as an individualizing ideal that contrasts with the model of establishing codes within a conception of (...) moral order. Foucault's project can be read as attempting to decouple ethics from the epistemological concern with the objectivity of a moral order in order to reconnect it to the formation of a political sensibility that sees truth(fulness) in a certain practice of freedom, as opposed to seeing our freedom confirmed or granted by a certain kind of (mode of relating to the) truth. I call this reading of Foucault's investigations into ethics the "methodological/prescriptive" approach (asking and responding to what we can do, ethically-speaking) and contrast it with the sketch of an alternative reading which I call "ontological/historical" (asking and responding to what we are, ethically-speaking). This reading, instead of pushing beyond Kant in the direction of a Nietzschean sensibility, rather challenges Kant's moral law from the space of a Hegelian insistence on the (historical) realization or actualization of freedom in and through the normative constraints structuring existing power-relations. The author examines the outstanding texts in Saint Augustine's works about hapiness -specially in De beata uita, Confessiones, and De Trinitate-, in order to establish interlinking points with the Ciceronian books related to this subject. The Hortensius (specially frg. 36, 39 and 79 Müller), is a reiterated and coincident reference in the different Augustine's works. It also acts as a key into other many passages of the classical philosophical tradition. On the other hand, Augustin modifies and perfects elements there contained, (...) because of his assimilation of the New Testament tradition related to this topic. (shrink)

The most recent studies concerning the compositional structure of Seneca's dialogues all agree in stating that its basic organization is due to rhetorical criteria. From this perspective, the article analyzes the general nature of refutation in Consolatio ad Helviam matrem as well as different passages from the dialogue, traditionally considered to be digressions, in order to establish its functionality. We can see from this that the apparently deliberative tenor of the Consolation is endowed with judicial and epideictic elements, and can (...) thus clarify its compositional sequence and lines of thought. This work considers the novelty of Neoplatonism against platonic philosophy, characterising the former by three principie points: the monopolaristic conception, the One which is productive (a self difftisive One-Good) remaining as indefinable or ineffable and its consequences and implications. Plotino's metaphysics, therefore, finds itself before a new problem, not put by Plato: to give reason of the One, and with this, of the production of the many from the One, and in its resolution he introduces an irreductable novelty into not (...) only the platonic categories, but also into Greek thought (as the idea of positive infinitude).
