This article reconsiders how to judge judicial independence by using the Japanese judicature, one of the allegedly-most dependent judiciary branches. In their influential work, Ramseyer and Rasmusen argue that judges who once belonged to a leftist group take longer to reach a under the long-term conservative rule of Japan. Their method does not, however, deal appropriately with the possibility of judges not reaching this position because the judge dies, retires early, or is still at the early stage of her career. (...) Ramseyer and Rasmusen also mistakenly assume that all judges will eventually obtain this position. This article develops a survival analysis model of judicial careers and attempts to solve the problems of censoring, left truncation, and split population. We also offer a way to utilize a matching procedure to estimate average treatment effects on censored time-to-event as well as event occurrence. We re-analyze a corrected version of Ramseyer and Rasmusen's data using their and our methods. One of the most important findings is that, contrary to what Ramseyer and Rasmusen argue, leftist judges are not discriminated against in terms of the timing of promotion. (shrink)

The aim of the study is to determine the association between Behavioral Lifestyles and longevity in the elderly. A search strategy was conducted in the PsycInfo, Medline, PubMed, Web of Science, and Scopus databases. The primary outcome was mortality/survival. Four variables were analyzed to evaluate the role of potential moderators. Ninety-three articles, totaling more than 2,800,000 people, were included in the meta-analysis. We found that the lifestyles analyzed predict greater survival. Specifically, doing regular physical activity, engaging in (...) leisure activities, sleeping 7–8 h a day, and staying outside the BMI ranges considered as underweight or obesity are habits that each separately has a greater probability associated with survival after a period of several years. This paper seeks to think creatively about the body of research which claims there is a link between heavy metal music and adolescent alienation, self-destructive behaviours, self-harm and suicide. Such research has been criticised, often by people who belong to heavy metal subcultures, as systematically neglecting to explore, in a meaningful manner, the psychosocial benefits for individuals who both listen to contemporary heavy metal music and socialize in associated groups. We argue that notions of survival, strength, community, and rebellion (...) are key themes in contemporary heavy metal music. Through literary-lyrical analysis of a selection of heavy metal tracks, this paper aims to redress the balance of risk and benefit. We argue that listening to this type of music, the accompanying social relationships, sense of solidarity and even the type of dancing can ameliorate tumultuous and difficult emotions. Songs which could be read as negative can induce feelings of relief through the sense that someone else has felt a particular way and recovered enough to transform these emotions into a creative outlet. This genre of music may therefore not increase the risk of untoward outcomes in any simple sense but rather represent a valuable resource for young people in difficulty. (shrink)

Doctors’ survival predictions for terminally ill patients have been shown to be inaccurate and there has been an argument for less guesswork and more use of carefully constructed statistical indices. As statisticians, the authors are less confident in the predictive value of statistical models and indices for individual survival times. This paper discusses and illustrates a variety of measures which can be used to summarise predictive information available from a statistical model. The authors argue that models and statistical (...) indices can be useful at the group or population level, but that human survival is so uncertain that even the best statistical analysis cannot provide single-number predictions of real use for individual patients. In the following essay I (...) argue that Chuck Palahniuk's works ought to be read as a mortician's report on American culture. Chuck Palahniuk broke into the literary world by way of the movie version of his first novel: Fight Club (1995). He has gone on to write six other novels: Survivor (1999), Invisible Monsters (2000), Choke (2001), Lullaby (2002), and Diary (2003). He also has published an interesting travel book, Fugitives and Refugees; A Walk in Portland, Oregon (2003), but since this is not properly fiction, I will not discuss it in this essay.1Clearly, Palahniuk has already produced a corpus worthy of careful consideration and analysis. Yet, as a west coast writer, far from the literary circles and brokers of the east coast, indeed far away from the clubs of self-promotion and self-monitoring that censure and hold in tight grip the monopoly of criticism that highlights "worthy literature," Palahniuk has not attracted a lot of critical attention. It is only with his most recent work Choke that he has began to be widely reviewed and commented on. In the following I provide a thematic reconstruction of each one of the six published novels, in chronological sequence. I will argue that Palahniuk is not trying to write the "great American novel," although he is profiling himself as a quintessential "American" writer in the midst of post–Cold War megalomania and celebrated Pax Americana. He has taken on a culture that has become so gargantuan, [End Page 394] fragmented, and differentiated but at the same time so rich, so self-reflexive, so historicized and also so mimicked that one novel cannot tell its story in one narrative with one dramatic thread. Many novels, many short cuts, many vignettes, are necessary: one polyphonic, asynchronous, temporally bi-directional, hyper-textual, and cyber-encyclopedic novel made up of individual novels, where each novel is the Bildungsroman of an American hero but told in reverse. These heroes, I will argue, are testimonies to the resilient power of individuals to resist even the most invasive and persistent onslaughts by culture on the physic life of freedom and individuality. I will also argue that he is neither a commercial nor academic writer; that is, he is not the kind of writer who writes either in order to maintain a living or secure tenure. He is a writer with a mission, a vision, and a very distinctive style. The stories that Palahniuk tells are stories that begin at the end, and end at the beginning: they are turned around Bildungsromans. They are, in other words, about unmaking, uncoupling, and disentangling our selves from the normal self into which we have been socialized. These stories are, thus, about the discovery of moral resources that lay dormant in the very simplicity of human solidarity and trust in our will to survive morally untainted, or at least redeemable. ​In the wake of the extremely divisive 2016 presidential election, many US Americans are feeling deeply unsettled by the sense that the basic norms that govern life in our society are in a state of flux. How might we best describe and analyze the experience of living in a society that is so divided, a society whose very normative structure seems to be disintegrating? What problematic behaviors might arise in this situation? And how might we continue to work for positive (...) social change without further disrupting the normative order of our society? In this paper, I explore some insights into these issues that can be found in the work of Mexican phenomenologist Jorge Portilla, whose fascinating essays on cultural politics are just beginning to be translated into English. Portilla lived at a time in which his society’s normative structure was also in a state of flux. He argues that this state of normative disintegration generates a widely shared sense of zozobra—a profound anxiety that is not a psychological state but a state of existence, and that tends to provoke a number of defensive reactions that may be familiar to us today. “Access to medicines” is a broad concept. After a review of three authoritative frameworks that help to identify its constitutive components, this essay summarizes the actual situation on the ground in low- and middle-income countries on the basis of recent empirical work. An analysis of survey data from 36 countries concluded that developing countries should promote generic medicines as a key policy option for improving access to medicines. Taking an international perspective to that recommendation, this essay reviews the World (...) Trade Organization's Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS) and, particularly, how this agreement has been applied in practice. As shown by the experience of Thailand, Brazil, and the Philippines, in order to deal effectively with international pressures for an excessive application of the TRIPS Agreement, some sort of conversion experience appears to be required, which then leads to a switch from a private enterprise, supply-driven approach to a public health vision that insists on universal and affordable access. But moral conviction is not sufficient. In order to muster and sustain the political will to face down international forces, civil society and government offices must be able and ready to show the costs and other adverse consequences of the TRIPS-based model for medicines. This calculation needs to reach beyond the health sector and calls for new alliances, nationally as well as internationally. (shrink)

I show that though ming does involve the realization of the fundamental unity of opposites, the realization of this unity does not force the Zhuangzi to endorse a 'radical relativist' stance on morality, since the perspective of the Sage through ming is shown to be a privileged perspective. Overall, the Zhuangzi does not endorse any normative stance on morality. Rather, it endorses a way (...) of life that will ensure one's own personal survival and the survival of this fundamental unity of opposites. The process of evolution is largely absent from philosophical legal literature, to the extent that the possibility of a genetic origin of rights has not been explored. This is striking given that human rights theory stems from natural law and natural rights, which seems to imply a potential link with natural selection. Furthermore, the concept of nature has played a significant role in the philosophical foundations of international legal norms of rights and responsibilities. On the surface it may seem desirable (...) to link rights to genetics. However, this approach can undermine criticism of genetic research and risks subordinating rights-based analysis to a problematic endeavour. The article looks to the discourse of ‘geneticization’ to provide a critique of future research into ‘law as evolution’. It recommends shifting jurisprudential thinking beyond the confines of bioethics, in line with future advances in biological research into the genetic origins of rights. (shrink)

The primary concern of environmental ethics pushed to the limit is the question of survival. An ethic of survival would concern the possibility of morality in an environmental crisis that promises humanity immeasurable damage, suffering, and even the possibility of species extinction. A phenomenological analysis of the question of moral response to such future catastrophe reveals—in Heideggerian fashion contra-Heidegger—that the very question positions us in a relation of responsibility towards a world and a humanity that lies beyond (...) one’s reach and extends into the future. Responsibility, then, arises as a constituting element that defines humanity and therefore cannot be bracketed away or suspended in a time of crisis. Through a reading of Hans Jonas’ notion of responsibility and a critique of some major notions of Environmental Ethics, this article argues that an ethic of survival is conditioned by the survival of humanity as a moral, responsible species. The main challenge of this responsibility is further suggested to be the clash between the autonomy and dignity of the individual and the vital needs of the larger community in the struggle for survival. This guest column suggests that we should follow Hannah Arendt in resisting the urge to expound doctrines or systems and, instead, should disclose the processes of our thought as they are “in motion.” While we should not hesitate to express judgments, our aim in intellectual work should be to occasion (and experience) surprise. Like Arendt, we should candidly express “the bliss of thought” as we think and write. On this basis, the political arena can become “a space for self-analysis (...) and (by analogy with psychoanalysis) continuous rebirth.” And it is only on this basis, Kristeva argues, that reconstruction, after a century of unprecedented destruction, be accomplished without our succumbing to nostalgia. Efforts at reconstruction must be undertaken, as Arendt undertook them, “in light of the history of nihilism” and “in the name of sheer survival.” Kristeva joins Arendt in advising against a return to foundationalism while at the same time urging the development of a kind of “re-foundationalism.” Kristeva concludes by showing how, in these attitudes, Arendt's thinking was—despite her notorious dismissal of psychoanalysis—in tune with those of Freud. Panel data from a survey of small-scale farmers in the North Carolina Piedmont are used to investigate the survival of black smallholders. Results of a multivariate analysis show that owning tobacco quota and having high gross farm income, high amounts of on-farm household labor and small household size increase the propensity to survive in agriculture. Over the five-year period studied, approximately 50 percent of the original respondents were no longer actively operating farms. The small- and medium-sized tourism and hospitality enterprises are the main forms of enterprises in Macao. This study put forward a new framework of survival and sustainable development from the perspective of competitive advantage and regional soft environment, which significantly holds theoretical and practical research value. The study obtained cross-sectional data of 317 small- and medium-sized tourism and hospitality enterprises in Macao through a large-scale questionnaire survey. This article used exploratory factor analysis and confirmatory factor analysis to (...) test the reliability and validity of each factor system and its measurement scale. The variance analysis is used to judge the differences between the elements. The regression analysis is used to verify the hypothesis of a causal relationship between factors. The structural equation analysis is used to fit the model and make necessary amendments. The results reveal that the government service environment has a significant positive impact on the ability of an entrepreneur. In addition, the regional soft environment significantly impacts the competitive advantage of small- and medium-sized tourism and hospitality enterprises in Macao. Contrary, the impact of laws of Macao on the acquisition of financial resources and the promotion of entrepreneur ability and innovation ability is found insignificant. In conclusion, the results showed that market of Macao lacks venture investors where enterprises cannot obtain funds through angel financing or risk financing. (shrink)

Adaptive Intelligence is a dramatic reappraisal and reframing of the concept of human intelligence. In a sweeping analysis, Robert J. Sternberg argues that we are using a fatally-flawed, outdated conception of intelligence; one which may promote technological advancement, but which has also accelerated climate change, pollution, the use of weaponry, and inequality. Instead of focusing on the narrow academic skills measured by standardized tests, societies should teach and assess adaptive intelligence, defined as the use of collective talent in service (...) of the common good. Research Integrity (RI) is high on the agenda of both institutions and science policy. The European Union as well as national ministries of science have launched ambitious initiatives to combat misconduct and breaches of research integrity. Often, such initiatives entail attempts to regulate scientific behavior through guidelines that institutions and academic communities can use to more easily identify and deal with cases of misconduct. Rather than framing misconduct as a result of an information deficit, we instead conceptualize Questionable Research Practices (...) (QRPs) as attempts by researchers to reconcile epistemic and social forms of uncertainty in knowledge production. Drawing on previous literature, we define epistemic uncertainty as the inherent intellectual unpredictability of scientific inquiry, while social uncertainty arises from the human-made conditions for scientific work. Our core argument—developed on the basis of 30 focus group interviews with researchers across different fields and European countries—is that breaches of research integrity can be understood as attempts to loosen overly tight coupling between the two forms of uncertainty. Our analytical approach is not meant to relativize or excuse misconduct, but rather to offer a more fine-grained perspective on what exactly it is that researchers want to accomplish by engaging in it. Based on the analysis, we conclude by proposing some concrete ways in which institutions and academic communities could try to reconcile epistemic and social uncertainties on a more collective level, thereby reducing incentives for researchers to engage in misconduct. I analyse here some histories of people who lived in concentration camps and told their experiences: De Gaulle Anthonioz (La Traversée de la nuit), Geoffroy (Au temps des crématoires…), Semprun (L’Écriture ou la vie). These histories represent the lives of survivors, but they are also a form of literary expression with a narrative structure that codifies a genre. More particularly, I focus the attention on the incipit, a strategic place in which some of the specific features of the global meaning (...) and structural organization of the whole text can be seized. My hypothesis is that in histories of survival, already in the incipit, the authors strive to convey the emblematic value of their history: an extreme and traumatic experience which is difficult to express. The analysis of these incipit shows that experiences related to concentration camps, to be expressed, need an elaborated message and that an artistic aim can contribute to the representation of these experiences. From the structural viewpoint, histories of survival amplify a dichotomy existing in several literary genres and currents: ‘external reference’ and ‘internal organization’, mimetic ‘truth’ and narrative ‘structure’, ‘reality’ and ‘convention’, ‘experience’ and ‘narration’. In my opinion, histories of survival solve theseoppositions by reconciling some contraries through the use of oxymora. Even narratives structures or key figures such as the author, the narrator, the observer, the witness and so on, tend to become oxymora. The study of these features (and combination) is pertinent for anthropology (by seizing facts thanks to elaborated ‘ways of uttering’ authors often redefine forms of humanity) and for semiotics (any form of expression, even if original, has to be collectively shared and based on a system of signs). In my opinion, a joint semiotic and anthropological approach can help analysing histories of survival as a ‘literary genre’ and as a ‘historical tragic phenomenon’. (shrink)

An evolutionary approach to historical linguistics can be enlightening when not only the mechanisms, but also the statistical methods are considered from neighboring disciplines. In this short paper, we apply survival analysis to investigate what factors determine the lifespan of words. Our case study is on post-classical Greek from the 4th century bc to the beginning of the 8th century ad. We find that lower frequency and phonetically longer lexemes suffer earlier deaths. I have argued that insofar as sociological research seeks to elicit information from individuals directly (rather than by the use of documents, etc.), it necessarily involves the formation of a social relationship between investigator and subject(s) which may in time modify either party. I have concentrated on the effects of the research relationship on the investigator, effects which I claim are denied and systematically eliminated by being processed through a methodology which attempts to create a formal hiatus between the researcher (...) and his facts, and to present the facts in such a way as to be readily communicable and verifiable by the professional community. One important area of investigation is thus that of how the research results are achieved or constructed, and in particular, an investigation of the variety of ways in which research situations can affect investigators. This area is beginning to be explored, but is frequently obscured by the methodological orthodoxy which denies its existence. To see the matter in this way, however, is to continue to be dominated by this orthodoxy even whilst challenging it, for it is to continue seeing the problem in terms of a better understanding of researcher interference. The question I am trying to pose is, what can the researcher learn, not in the sense of what he can extract in his predefined terms from the research situation, but in the sense of what the subjects have to tell him. That this is a highly problematic question is indicated by the history of the methodological tradition which has attempted to answer it - the hermeneutic or verstehen tradition embodied by Dilthey and Collingwood, which influenced Max Weber heavily, and through him most of sociology to a greater or lesser extent. My account of the research methods used in “participant observation” in recent times indicates that usually only lip service is paid to verstehen. Weber's own attitude toward it is also instructive. Whilst regarding the possibility of understanding as well as explanation as an asset unique to social science, he regarded an account based solely on verstehen as only “a peculiarly plausible hypothesis” which required causal verification before it could be accepted. Verstehen, in other words, was a source of insight but such insights had to be checked against the facts. The trouble is, as we have seen, that “facts” represent a particular construction put upon certain features of social relationships. It provides an ethnocentricity based not simply on the researcher's interests, theories and problem definitions (though these are important), but on his methodology, which translates everything into a digestible (and, ideally, quantifiable) and mutually comparable language. As has recently been realised, this poses considerable difficulties when the societies in question are not in important respects amenable to “factualisation” - for example when magic and religion play a large part in them. The recent debate on understanding other societies and the role of rationality in doing so, has exposed just that feature of verstehen that Weber's treatment buried: that is, that in order for societies to be fully understood, an acceptance of their terms is necessary; a translation of these terms into the language of social licence distorts and truncates understanding, more drastically for some social phenomena than others. On the other hand, if this is not done, it is hard to see what systematic basis of comparison there will remain. The situation that I have described is however more complex than this, for the researchers in my illustrations have had experiences and learned things which are not always the result of total conversion, but rather the impact of a new way of thought and life upon their own. On this basis, they have gained insights which they have found it impossible to incorporate into the accepted framework of “research.” The status of these insights and their potential for future inclusion in normal research seems to me to present great difficulties. Basically there are two possibilities: either to make what counts as “research,” “data,” and so on, more flexible, and/or to develop the scrutiny of the experiences and insights in question to such a point as to be able to incorporate them into the public and verifiable research process. The dangers of the first alternative are subjectivism and loss of verifiability, and of the second vulgarisation and distortion. But a few examples will serve to illustrate the difficulty entailed in clearly discerning the way ahead. Evans-Pritchard's attitude towards Zande magic is completely ambiguous. He admits to adopting it for periods to enable communication, but drops it as soon as communication stops. His analysis is an outstanding example of its incorporation into social science with the minimum of distortion and the maximum of sensitivity. On ideals in which he continued to believe outside Zande society - as he evidently did not believe in magic - such as God, good and evil and courage, he is extremely reserved, though he does claim to have learned from the Azande, i.e., either he was able to incorporate without change what they taught him into his own frame of reference, or they stimulated him to broaden it. Castaneda seems to have had even more difficulty. He was certainly stimulated and helped to solve personal problems both within and by expanding his own terms, but he also finally accepted that he could not see the new world Don Juan was showing him without abandoning his own terms. What hope there is in this area would seem to lie in the painstaking reanalysis of their experiences by such workers as Evans-Pritchard and Castaneda. In the meantime, I hope I shall not be taken to be arguing for the inclusion of every passing emotion of the researcher into his report. It is one thing to argue that the use of a methodology which necessarily excludes such experiences as irrelevant is systematically misleading; it is another, having admitted them, to go beyond treating them as a problem and to attempt to capitalise on them. It is notable that within the literary and artistic tradition to which I have alluded we can recognise and sometimes agree upon those writers who have made of their experiences and knowledge of the world something worthwhile, and confer on them the title of “artist;” yet the state of literary criticism is, if anything, even more anarchic than that of sociology, and is very far from providing us with criteria to decide how best to proceed. The fast levels of industrialization, urbanization, globalization, and expansion of mass consumption that most countries in the world are experiencing today have led to environmental destruction and climate change, eventually threatening the survival of the Earth and humanity. Especially in the case of South Korea, where per capita greenhouse gas emissions have risen to the third highest in the world, there is an urgent need to raise public awareness of the risks of climate change and initiate a more active (...) societal response. This study examines Korean news media trends related to sustainability and explore suggestions for sustainable measures in the Anthropocene. In this way, a total of 1,203 articles was collected, including material from the news archives of newspapers, broadcasting TV, and Internet news channels. The articles have been analyzed by means of word-count-based analysis and topic modeling. The results of this study suggest that there is a need to develop and activate articles that contain more information about the effectiveness of the social response to sustainability and climate change in the Anthropocene.
