In a Bayesian dialogue two individuals report their Bayesian updated belief about a certain event back and forth, at each step taking into account the additional information contained in the updated belief announced by the other at the previous step. Such a process, which operates through a reduction of the set of possible states of the world, converges to a commonly known posterior belief, which can be interpreted as a dynamic foundation for Aumann’s agreement result. Certainly, if two individuals have (...) diverging interests, truthfully reporting one’s Bayesian updated belief at every step might not be optimal. This observation could lead to the intuition that always truthfully reporting one’s Bayesian updated belief were the best that two individuals could do if they had perfectly coinciding interests and these were in line with coming to know the truth. This article provides an example which shows this intuition to be wrong. In this example, at some step of the process, one individual has an incentive to deviate from truthfully reporting his Bayesian updated belief. However, not in order to hide the truth, but to help it come out at the end: to prevent the process from settling into a commonly known belief—the “Aumann conditions”—on a certain subset of the set of possible states of the world, and this way make it converge to a subset of the set of possible states of the world on which it will be commonly known whether the event in question has occurred or not. The strategic movement described in this example is similar to a conversational implicature: the correct interpretation of the deviation from truthfully reporting the Bayesian updated belief thrives on it being common knowledge that the announced probability cannot possibly be the speaker’s Bayesian updated belief at this step. The article shows that strategic quantity competition can be characterized by behavioral heterogeneity, once competing firms are allowed in a pre-market stage to optimally choose the behavioral rule they will follow in their strategic choice of quantities. In particular, partitions of the population of identical firms in which some of them are profit maximizers while others follow an alternative criterion, turn out to be deviation-proof equilibria both in simultaneous and sequential game structures. Our findings that in a (...) strategic framework heterogeneous behavioral rules may be consistent with individual incentives is a first attempt to provide a game-theoretic microfoundation of heterogeneity. A study is reported which focused on the problem-solving strategies employed by expert electronics engineers pursuing a real-world task: integrated-circuit design. Verbal protocol data were analysed so as to reveal aspects of the organisation and sequencing of ongoing design activity. These analyses indicated that the designers were implementing a highly systematic solution-development strategy which deviated only a small degree from a normatively optimal top-down and breadth-first method. Although some of the observed deviation could be described as opportunistic in nature, (...) much of it reflected the rapid depth-first exploration of tentative solution ideas. We argue that switches from a predominantly breadth-first mode of problem solving to depth-first or opportunistic modes may be an important aspect of the expert's strategic knowledge about how to conduct the design process effectively when faced with difficulties, uncertainties, and design impasses. In the standard formulation of game theory, agents use mixed strategies in the form of objective and probabilistically precise devices to conceal their actions. We introduce the larger set of probabilistically imprecise devices and study the consequences for the basic results on normal form games. While Nash equilibria remain equilibria in the extended game, there arise new Ellsberg equilibria with distinct outcomes, as we illustrate by negotiation games with three players. We need to acknowledge that the members of most modern societes adhere to different and partially contradictory moral convictions which to overcome we yet don’t have the intellectual means. Since such convictions typically include opions about which moral rules should be established as laws there will be disagreement about the correct rules of law as well. The article investigates the possibilities to find a system of laws that all can accept on the basis of such moral pluralism. It develops six (...) steps and models for the required justification. As the final step has the form of a strategic negotiation the concluding section explores which forms of representation and which deviations from unanimity are acceptable within this procedural model of justification. It is usually assumed in game theory that agents who interact strategically with each other are rational, know the strategies open to other agents as well as their payoffs and, moreover, have common knowledge of all the above. In some games, that much information is sufficient for the players to identify a "solution" and play it. The most commonly adopted solution concept is that of Nash equilibrium. A Nash equilibrium is defined a combination of strategies, one for each player, such (...) that no player can profit from a deviation from his strategy if the opponents stick to their strategies. Nash equilibrium is taken to have predictive power, in the sense that in order to predict how rational agents will in fact behave, it is enough to identify the equilibrium patterns of actions. Barring the case in which players have dominant strategies, to play her part in a Nash equilibrium a player must believe that the other players play their part, too. But an intelligent player must immediately realize that she has no ground for this belief. Take the case of a one-shot, simultaneous game. The Monty Hall game is one of the most discussed decision problems, but where a convincing behavioral explanation of the systematic deviations from probability theory is still lacking. Most people not changing their initial choice, when this is beneficial under information updating, demands further explanation. Not only trust and the incentive of interestingly prolonging the game for the audience can explain this kind of behavior, but the strategic setting can be modeled more sophisticatedly. When aiming to increase the odds (...) of winning, while Monty’s incentives are unknown, then not to switch doors can be considered as the most secure strategy and avoids a sure loss when Monty’s guiding aim is not to give away the prize. Understanding and modeling the Monty Hall game can be regarded as an ideal teaching example for fundamental statistic understandings. (shrink)

Strong Nash equilibrium and coalition-proof Nash equilibrium rely on the idea that players are allowed to form coalitions and make joint deviations. Both of these notions consider cases in which any coalition can be formed. Accordingly, there may arise “conflicts of interest” that prevent a player from choosing an action that simultaneously meets the requirements of two coalitions to which he or she belongs. Here, we address this observation by studying an organizational framework such that the coalitional structure is motivated (...) by real-life examples where players cannot form some coalitions and formulated in such a way that no conflicts of interest remain. We define an organization as an ordered collection of partitions of the player set such that any partition is coarser than the partitions that precede it. For any given organization, we introduce the notion of organizational Nash equilibrium. We analyze the existence of equilibrium in a subclass of games with strategic complementarities and illustrate how the proposed notion refines the set of Nash equilibria in some examples of normal form games. The recurrent court-related mediation discourse studies have focused on mediation participants’ willingness. Drawing on a corpus of five situated recorded court-related civil mediation data in China, this article takes one of the frequently-used mediation resources ‘I don’t want X/y’ as a case study of formulating mediation ‘wants’. It is intended to explore mediation participants’ exploitation of the court-related mediation resources to express their mediation willingness/ intentions: how the mediator manipulates either side of the participants’ mediation discursive concepts; how the mediator (...) shift the trajectory of narrating the participants’ mediation dispute-facts to judging on the dispute-facts; and how the mediator deviates himself from the third-party neutral mediators’ mediating role. The value of analyzing this formulation ‘I don’t want X/y’ is to reveal the fact that such mediation practices in their recurrent environments might go against the court-related mediation principles such as being self-willingness, neutrality and uprightness. This article contributes to formulate mediation ‘wants’ strategically and promote the court-related mediation practices in the service of sequentially unfolding mediation interaction effectively. We develop a theory of joint intention in contexts in which participants have mixed motives that can manifest in all-things-considered reasons to deviate from contributing to the desired project, e.g., contexts with collective action problems. Our theory is based on strategic equilibrium-based reasoning, which links the characterization of joint intention in terms of individual intentions with conditions on strategy profiles of the underlying strategic games. We use elements of equilibrium reasoning to construct a counterfactual account of joint intention (...) in the mixed-motive contexts, which extends the reach of the notion of joint intention considerably beyond that of previous formulations. Special attention is paid to all such aspects of (...) communication pragmatism that are reflected by the author’s (more or less controlled) deviations from the norm, aptly made to achieve communication goals. Within this framework, the study strives to show the different roles that the factor termed ‘expectation violation’ takes on when strategically applied by the author in the process of text creation. To support this description, numerous observations by authors such as Grice, Burgoon, Gombrich, Iser etc. are employed. By tackling the author’s viewpoint on text creation, a claim is advanced concerning the plausibility of certain conclusions, theories and, possibly, laws, by virtue of the identification and observation of selected multi-domain principles, phenomena and tendencies. Examining previous discussions on how to construe the concepts of gender and race, we advocate what we call strategic conceptual engineering. This is the employment of a (possibly novel) concept for specific epistemic or social aims, concomitant with the openness to use a different concept (e.g., of race) for other purposes. We illustrate this approach by sketching three distinct concepts of gender and arguing that all of them are needed, as they answer to different social aims. The first concept (...) serves the aim of identifying and explaining gender-based discrimination. It is similar to Haslanger’s well-known account, except that rather than offering a definition of ‘woman’ we focus on ‘gender’ as one among several axes of discrimination. The second concept of gender is to assign legal rights and social recognitions, and thus is to be trans-inclusive. We argue that this cannot be achieved by previously suggested concepts that include substantial gender-related psychological features, such as awareness of social expectations. Instead, our concept counts someone as being of a certain gender solely based on the person’s self-identification with this gender. The third concept of gender serves the aim of personal empowerment by means of one’s gender identity. In this context, substantial psychological features and awareness of one’s social situation are involved. While previous accounts of concepts have focused on their role in determining extensions, we point to contexts where a concept’s role in explanation and moral reasoning can be more important. Currently, although the implementation of corporate social responsibility (CSR) practices and its incorporation into business strategies is emphasised widely in developed countries as a key to sustainable growth and economic profitability, this term is still new to the Vietnamese market because of the low awareness of the importance of CSR practices, which leads to the failure of many firms. Since Vietnamese firms do not prioritise CSR implementation, Vietnam is experiencing an increasing shortage of skilled employees owing to a lack of (...) motivation. Therefore, this study examines the relationship between the corporate strategic objective (CSO), CSR practices and employee commitment, to provide recommendations to enhance motivation. This study used a quantitative approach and data from a questionnaire delivered to 869 enterprises in 2019 in Vietnam. Results suggest that the CSO had direct and indirect effects on employee commitment through the mediation of CSR practices. (shrink)

The objective of this article is to analyze the relationships between theories of strategic design and participatory design, in multiple commercial alliances between local entrepreneurs from different sectors and their integrated application in the urban context. Various authors have dealt with these strategic issues in isolation and less frequently have addressed them from the entrepreneurial experience. A review of the specific literature allows us to account for the main concepts involved in this approach. The case being analyzed refers (...) to a fitness-related venture in the city of La Plata, which articulated, together with other local actors, a collaborative strategy that led to the application of a superior business model for its sector. In addition, he capitalized on his role as an influencer on the social network Instagram, as a way to enhance the project’s comprehensiveness. The topics that are addressed synthesize the key concepts that allow us to interpret the praxis relieved. And from them, create a model that can be applied in other markets and territories to promote young local development. And in this way, different actors, complementary products and services serve to jointly promote a co-productive and self-managed culture. (shrink)

The study of social norms sprawls across all of the social sciences but the the concept lacks a unified conception and formal theory. We synthesize an account that can be applied generally, at the social scale of analysis, and can be applied to empirical evidence generated in field and lab experiments. More specifically, we provide new analysis on representing norms for application in empirical political science, and in parts of economics that do not follow the recent trend among some behavioral (...) economists to build models of the cognitive and motivational states of individuals taken “one at a time”. Foundational sources for our project are Bicchieri (2006, 2017), Kuran (1995), and Stirling (2012, 2016). From Bicchieri take that a norm exists in a social structure when a significant networked subset of individuals share descriptive and injunctive expectations that it regulates their interactions. From Kuran we take the insight that prevailing norms may come to be widely disliked by participants in networks but survive because norm suppress public displays of disenchantment. From Stirling we apply conditional game theory (CGT) to provide the technical resources for building our model of a norm-regulated social interaction. The study aimed to identify the relationship between correcting the deviations in the measurement of performance and achieving the objectives of control and the performance of the job at the Islamic University in the Gaza Strip. To achieve the objectives of the research, the researchers used the descriptive analytical approach to collect information. The questionnaire consisted of (20) statements distributed to three categories of employees of the Islamic University (senior management, faculty members, their assistants and members of the administrative board). (...) A random sample of 314 employees was selected and 276 responses were retrieved with a recovery rate of 88.1%. The Statistical Analysis Program (SPSS) was used to enter, process, and analyze the data. The results of the study showed a positive relationship between correcting deviations in performance measurement and achieving the control objectives represented by the functional performance in the Islamic University from the point of view of the members (senior management, faculty and their assistants, and the administrative board), where the relative weight of all the paragraphs was (74.25%). The study recommended the need to ensure that the actual performance of the planned performance is matched and decisions are taken to correct the serious deviations and take the necessary measures in terms of retraining and change in regulations, wages and bonuses and punishment of the culprit, neglect and negligence by mistake. Joseph Heath'sCommunicative Action and Rational Choicestands out clearly as one of the most astute and original of the several critiques of Jurgen Habermas's theory of communicative action to have emerged in the last decade. Heath refrains from engaging merely in skirmishes with various details of Habermas's theory; he rather aims directly at its core issue: the critique of instrumental reason. Heath argues that Habermas's key criticism—that instrumental reason cannot account for successful communication—is not critical enough. Heath argues that instrumental reason (...) cannot account even for the successfulmonologicalaction. Heath then claims that one can construct a critical rational theory without much of the problematic addenda that Habermas requires, particularly the need for a tripartite theory of validity claims. Ideal theorists aim to describe the ideally just society. Problem solvers aim to identify concrete changes to actual societies that would make them more just. The relation between these two sorts of theorizing is highly contested. According to the benchmark view, ideal theory is prior to problem solving because a conception of the ideally just society serves as an indispensable benchmark for evaluating societies in terms of how far they deviate from it. In this paper, I clarify the benchmark view, (...) argue that existing criticisms of it are unsuccessful, and develop a novel redundancy objection to the benchmark view and the claim of priority it allegedly entails. I then consider the extent to which ideal theory might facilitate problem solving without being prior to it and argue that it can only play a modest role in this regard. The upshot is that ideal theory is neither required for nor especially relevant to problem solving—but it is not completely irrelevant either. It facilitates problem solving to some limited degree, but no more, say, than theorizing about dystopia. (shrink)

The Principle of the Common Cause is usually understood to provide causal explanations for probabilistic correlations obtaining between causally unrelated events. In this study, an extended interpretation of the principle is proposed, according to which common causes should be invoked to explain positive correlations whose values depart from the ones that one would expect to obtain in accordance to her probabilistic expectations. In addition, a probabilistic model for common causes is tailored which satisfies the generalized version of the principle, at (...) the same time including the standard conjunctive-fork model as a special case. There are two different, and somewhat competing, strategic explanations for why firms certify for ISO 14001. On the one hand, firms may seek to reinforce their present strategies thereby further enhancing their competitive advantage. On the other hand, firms may use ISO 14001 as a mechanism to reorient their strategies, so that a clear signal is sent about the firm's change in strategic positioning. This paper aims to identify the most likely explanation for early adopters of ISO 14001. (...) Using a matched pair design, we test these alternative explanations on a sample of US firms that certified for ISO 14001 in the first two years after its introduction. In particular, we tested whether ISO 14001 was used to reinforce or reorient firm strategies in respect to the natural environment, corporate social responsibility, quality, and internationalization. We found that firms that certified early for ISO 14001 had considerable environmental legitimacy and a strong international presence. We also found that the firm's commitment to corporate social responsibility and quality were not significantly different between certified and non-certified firms. These findings suggest that early adopters of ISO 14001 leaned towards reinforcing rather than reorienting their firm strategy, which calls into question the ultimate reach of ISO 14001. (shrink)

The research aims to study the role of strategic and operational planning as approach for crises management in UNRWA - Gaza Strip field- Palestine. Several descriptive analytical methods were used for this purpose and a survey as a tool for data collection. Community size was (881), and the study sample was stratified random (268). The overall findings of the current study show that strategic and operational planning is performed in UNRWA. The results of static analysis show that there (...) are a relation between strategic and operational planning and crises management. In spite this relation existence, it need more improvement and expanding. Also there are shortcomings in the way that organization manages the crises before and after they occur. A crisis management is only practicing during the crisis. The study suggests that UNRWA must invest in more resources to enhance strategic and operational palming and improve other methods to face potential crises in the future. (shrink)

Strategic leadership and corporate sustainability have recently come together in conspicuously explicit fashion through the emergence of top management team positions with dedicated corporate sustainability responsibilities. These TMT positions, commonly referred to as “Chief Sustainability Officers,” have found their way into the upper echelons of many of the world’s largest corporations alongside more traditional TMT positions including the CEO and CFO. We explore this phenomenon and consider the following two questions: Why are corporate sustainability positions being installed to the (...) TMT?What effects do corporate sustainability TMT positions have at their organizations? We consider these questions through strategic leadership and neoinstitutional theoretical frameworks. Through the latter, we also engage with Weberian considerations of bureaucracy. We find that the reasons why corporate sustainability TMT positions are installed can be in response to a crisis at the corporation for which its legitimacy is challenged. We also find the corporate sustainability TMT position can be installed proactively in an effort to realize external opportunities that may have otherwise gone unrealized without concerted attention and coordination afforded by a strategic level position. Regarding effects, we determine the position can relate to the establishment of bureaucratic structures dedicated to corporate sustainability within the corporation through which formalized processes and key performance indicators to drive corporate sustainability performances are established. In the face of our finding that many corporate sustainability TMT positions are being removed despite having only relatively recently been introduced to their respective TMTs, we find that the successful implementation of bureaucratic machinery can help considerations to sustainability extend beyond the tenure of a corporate sustainability position within the TMT. In this book I examine various forms of indeterminacy in the law and scrutinize (i.a. by way of game theoretical models) the conditions under which they can be strategically used. In particular, I analyze the advantages and disadvantages of indeterminacy in the wording of laws, contracts, and verdicts. Legal texts are particularly interesting insofar as they address a heterogeneous audience, are applied in a variety of unforeseeable circumstances and must, at the same time, lay down clear and unambiguous standards. I (...) argue for the claim that semantic vagueness is less relevant than commonly supposed in the debate, while other forms of indeterminacy (in particular, polysemy and standard-relativity) are underrated or altogether ignored. This misconception is, as I argue, due to a systematic confusion between semantic vagueness and these forms of indeterminacy. Once it is resolved, the value of indeterminacy can be clearly shown. The research about strategic human resource management (SHRM) has suggested that human resource professionals (HRPs) have the opportunity to play a greater role in contributing to organizational success if they are effective in developing systems and policies aligned with the organization's values, goals, and mission. We suggest that HRPs need to raise the standard of their performance and that the competitive demands of the modern economic environment create implicit ethical duties that HRPs owe to their organizations. We define ethical (...) stewardship as a model of governance that honors obligations due to the many stakeholders and that maximizes long-term organizational wealth creation. We propose that if HRPs adopt an ethical stewardship framework and the qualities of transformative leaders, they will be more aware of their ethical duties to their organizations and more effective in helping their organizations to create increased wealth, achieve desired organizational outcomes, and establish work environments that are more satisfying to employees. This article reacts against the undesirable ideological separation between dialectical and rhetorical approaches to argumentative discourse. It argues that a sound evaluation of argumentation requires an analysis that reveals all aspects of the discourse pertinent to critical testing. To explain the rationale of the various moves made in the discourse and the strategic patterns behind them, not only the interlocutors' dialectical goals must be taken into account, but also their rhetorical goals. After explaining how rhetorical insight can be instrumental (...) in deepening and justifying a dialectical analysis, an integrated analysis is made of the rhetorical strategies that are brought to bear in an advertorial published by the oil company Shell. Although political argumentation is not institutionalized in a formal sense, it does have recurrent patterns and characteristics. Its constraints include the absence of time limits, the lack of a clear terminus, heterogeneous audiences, and the assumption that access is open to all. These constraints make creative strategic maneuvering both possible and necessary. Among the common types of strategic maneuvering are changing the subject, modifying the relevant audience, appealing to liberal and conservative presumptions, reframing the argument, using condensation symbols, (...) employing the locus of the irreparable, and argumentative use of figures and tropes. It is difficult to evaluate strategic maneuvering in political argumentation, however, because the activity types dictate wide latitude for the arguers, so there are few cases of unquestionable derailment. The unfinished, posthumously published second volume of Jean-Paul Sartre's Critique of Dialectical Reason consists for the most part of a study of the evolution of the Soviet Union under the reign of Stalin. Essentially, Sartre sees this history as amounting to a lengthy deviation from the goal of socialism, a deviation that he regards as thoroughly intelligible in light of social and historical circumstances. Some ten years after abandoning his work on this book, on the occasion of the (...) Soviet invasion of Czechoslovakia, Sartre concluded that this ‘deviation’ was permanent. At the same time, Sartre believed, as he had stated already in Volume I of the Critique, that the post-Stalinist era must be characterized as ‘One World’, a historical turning away from the plurality that had prevailed in all of past human history. The present essay attempts to capture Sartre's approach to history as ongoing ‘totalization’ – conflict-filled, subject to contingency and chance and the frequent occurrence of ‘holes’, and nevertheless intelligible. Although Stalin died many decades ago, and the Soviet Union itself no longer exists as such, it is argued here that Sartre's approach in this book is very useful as a key to the present time. Future history is indeed unpredictable, but Sartre's techniques of historical analysis remain valid. It is also contended, more controversially, that today the ideal of democracy may be in the process of following the path of socialism in the direction of permanent deviation. (shrink)

This paper brings two major research lines in current sociology together. Research on social networks has long focused primarily on network effects but meanwhile also addresses the emergence and dynamics of networks. Research on trust in social and economic relations shows that networks have effects on trust. Using game theory, we provide a simple model that allows for an integrated and simultaneous analysis of network effects on trust and for the endogenous emergence of the network. The model also allows for (...) characterizing the value of the network. We use standard assumptions on full strategic rationality. Strategic Reliabilism is a framework that yields relative epistemic evaluations of belief-producing cognitive processes. It is a theory of cognitive excellence, or more colloquially, a theory of reasoning excellence (where 'reasoning' is understood very broadly as any sort of cognitive process for coming to judgments or beliefs). First introduced in our book, Epistemology and the Psychology of Human Judgment (henceforth EPHJ), the basic idea behind SR is that epistemically excellent reasoning is efficient reasoning that leads in a robustly reliable (...) fashion to significant, true beliefs. It differs from most contemporary epistemological theories in two ways. First, it is not a theory of justification or knowledge – a theory of epistemically worthy belief. Strategic Reliabilism is a theory of epistemically worthy ways of forming beliefs. And second, Strategic Reliabilism does not attempt to account for an epistemological property that is assumed to be faithfully reflected in the epistemic judgments and intuitions of philosophers. If SR makes recommendations that accord with our reflective epistemic judgments and intuitions, great. If not, then so much the worse for our reflective epistemic judgments and intuitions. (shrink)

This paper presents an attempt to bridge the gap between logical and cognitive treatments of strategic reasoning in games. There have been extensive formal debates about the merits of the principle of backward induction among game theorists and logicians. Experimental economists and psychologists have shown that human subjects, perhaps due to their bounded resources, do not always follow the backward induction strategy, leading to unexpected outcomes. Recently, based on an eye-tracking study, it has turned out that even human subjects (...) who produce the outwardly correct ‘backward induction answer’ use a different internal reasoning strategy to achieve it. The paper presents a formal language to represent different strategies on a finer-grained level than was possible before. The language and its semantics help to precisely distinguish different cognitive reasoning strategies, that can then be tested on the basis of computational cognitive models and experiments with human subjects. The syntactic framework of the formal system provides a generic way of constructing computational cognitive models of the participants of the Marble Drop game. (shrink)

Corporate philanthropy describes the action when a corporation voluntarily donates a portion of its resources to a societal cause. Although the thought of philanthropy invokes feelings of altruism, there are many objectives for corporate giving beyond altruism. Meeting strategic corporate objectives can be an important if not primary goal of philanthropy. The purpose of this paper is to share insights from a strategic corporate philanthropic initiative aimed at increasing the pool of frontline customer contact employees who are performance-ready, (...) while supporting curriculum development and infrastructure improvement for selected university business programs, creating a win-win situation for the company and the universities. This paper will address three objectives. First, we will examine the evolution of strategic philanthropy from the traditional view to its current position as a strategic option. Second, we will address the recruitment of front line talent needs (customer facing jobs in sales, customer service, and marketing) based on the profit maximization model of strategic philanthropy. The author gives an analysis of the strategic manoeuvring in the justification of legal decisions from a pragma-dialectical perspective by showing how a judge tries to reconcile dialectical and rhetorical aims. On the basis of an analysis and evaluation of the argumentation given by the US Supreme Court in the famous Holy Trinity case, it is shown how in a case in which the judge wants to make an exception to a legal rule for the concrete case tries to (...) meet the dialectical reasonableness norm by seeing to it that his standpoint is sufficiently defended according to the requirements of the burden of proof of a judge in a rational critical discussion and how he tries at the same time to be rhetorically convincing for the legal audience by presenting the decision as a choice that is in line with the argumentation schemes and starting points that can be considered as accepted by the legal community in the US and by the US community as a whole. The debate about the Strategic Foul has been rumbling on for several decades and it has predominantly been fought on moral grounds. The defenders claim that the rules of a game must be supplemented by the ‘ethos’ of the game, by its conventions or informal rules. Critics of the Strategic Foul argue that to break the rules deliberately, in order to gain an advantage, is morally wrong, spoils the game, or is a form of cheating. Rather than entering (...) the moral maze I will argue that the Strategic Foul rests on a conceptual mistake. I will contrast the Strategic Foul with the idea of Efficient Breach in the economic approach to law in order to bring out some of the salient features. While doing so I will attempt some cross-fertilisation between jurisprudential insights and philosophical reflection on game rules. Finally, I will re-cast Searle’s distinction between constitutive and regulative rules in order to bring out the conceptual mistake more clearly. (shrink)

Why do people enter devoted relationships when they can continue looking for better partners? The “strategic ignorance” account holds that remaining ignorant about alternative partners is a signal that you are a high‐quality partner. Despite this intuition, the authors show that evolution favors a “look while allowing your partner to look” strategy, unless the costs of being rejected by a looking partner are extremely high. Thus, the origins of love must be found elsewhere.

This essay argues that defences of strategic fouling in sport are enriched and supported by better recognizing the role of play in sport. A common characteristic of play is its disengagement from the everyday, in particular its moral disengagement. If sport in its best manifestations is a species of play, then we should expect to find some moral disengagement there. And indeed we do in a variety of ways. Strategic fouling affords a useful example to illustrate and support (...) this claim and to examine the limits of that sort of disengagement. It is argued that while strategic fouling is morally problematic, it can be a sort of playful ‘competitive shenanigan’ that should be tolerated at times for the way it adds to the challenge and drama of sport. This allows us to better recognize the complexity and depth of sport and the way it reflects fundamental human values. Like everyday life, sport challenges us to weigh morality, perfection, and play against each other in ways that give each sphere of value its due and that contribute to rewarding and meaningful activities and lives. We examine the process of strategization of Corporate Social Responsibility (CSR) within 12 Israeli firms using a longitudinal qualitative approach. We analyzed the process of CSR strategization under Jarzabkowski’s framework. Our findings identify the differentiating characteristics of CSR strategization processes, including the requirement for informative communications rather than persuasive negotiations, and the absence of resistance within the organizational community. These unique aspects of CSR strategization may be attributed to the moral and value-centric nature of CSR activity.

The present debate over the creation and potential deployment of lethal autonomous weapons, or ‘killer robots’, is garnering more and more attention. Much of the argument revolves around whether such machines would be able to uphold the principle of noncombatant immunity. However, much of the present debate fails to take into consideration the practical realties of contemporary armed conflict, particularly generating military objectives and the adherence to a targeting process. This paper argues that we must look to the targeting process (...) if we are to gain a fuller picture of the consequences of creating or fielding lethal autonomous robots. This paper argues that once we look to how militaries actually create military objectives, and thus identify potential targets, we face an additional problem: the Strategic Robot Problem. This paper investigates the role that the stylistic device of praeteritio (or paralipsis) can play in arguers’ attempts to reconcile their rhetorical with their dialectical aims by manoeuvring strategically when carrying out particular discussion moves of the dialectical procedure for resolving a dispute. First, attention will be paid to the ways in which praeteritio can be realized in discourse. Next, an analysis is given of the effects the use of praeteritio may have as a result of the presentational means that (...) are employed. This analysis will be used to establish the possibilities for strategic manoeuvring with this device in the different stages of an argumentative discussion. Finally, an indication is given of how the types of strategic manoeuvring that a praeteritio can be instrumental in may derail, and in which violations of the rules for critical discussion such derailed manoeuvrings may result.
