This introductory article provides an overview of the historiography of scientific secrecy from J.D. Bernal and Robert Merton to this day. It reviews how historians and sociologists of science have explored the role of secrets in commercial and government-sponsored scientific research through the ages. Whether focusing on the medieval, early modern or modern periods, much of this historiography has conceptualized scientific secrets as valuable intellectual property that helps entrepreneurs and autocratic governments gain economic or military advantage over competitors. Following (...) Georg Simmel and Max Weber, this article offers an alternative interpretation of secrecy as a tool to organize and to hierarchically order society. In this view, the knowledge content of secrecy is less important than its social-psychological effects. The authors argue that, in many instances, entrepreneurial researchers and governments use scientific secrets as an effective tool to manipulate the beliefs of their competitors and the larger public, and not necessarily to protect the knowledge that they hold. From Machiavelli and Guicciardini to Gracián and Richelieu, secrecy is a defining element in the politics of reasons of state, in the art of simulation and dissimulation. These techniques were considered instrumental in order to procure the very survival of the state in situations of permanent emergency. From politics as a secret art centered on the prince’s cabinet, we move gradually along an historical and theoretical path. From English liberalism that places the parliament at the center of (...) politics and the French Enlightenment that exalted the capacity of reason to enlighten the mind and help humankind to leave the state of minority, we move toward democracy as public knowledge, as a ‘house of glass', exposed to the scrutiny and control of public opinion. It is nonetheless clear that neither the proto-liberal parliament nor the subsequent parliamentary democracies will ever become the ‘houses of glass' that democratic ideologies champion. This essay discusses engagement against state secrecy and engagement for secrecy, free from interference. By exploring divisions introduced by state secrecy (through exclusion, subjection and oppression), it identifies the distortions of equal participation in political communities. The author introduces the notion of pata-politics in order to describe the false relation to the secrecy effect. Furthermore, the text examines key issues of today’s intelligence studies (such as democratic intelligence oversight and the balance of powers doctrine), (...) with special emphasis on the possible limits of a liberal approach. This article opens a special section on the politics of opacity and openness. The rise of transparency as a political and cultural ideal has left secrecy to accumulate negative connotations. But the moral discourse that condemns secrecy and rewards transparency may cause us to misread the symbiotic relationship between these terms. After providing a historical account of transparency in public and political life, this article therefore makes the case for working with the tension between these terms rather than (...) responding to the dyad as a choice. We need to find different ways of staying with the aporia of transparency-as-secrecy and secrecy-as-transparency. Despite common demands to support either transparency or secrecy in political and moral terms, we live with the tension between these terms and its inherent contradictions daily. Cecile Fabre’s Through a Glass Darkly offers a compelling account of the ethics of espionage drawn from both interpersonal morality and democratic and cosmopolitan political theory. Yet the spying that her theory finds permissible or prohibited does not map onto the spying that states undertake and that international law either explicitly or implicitly authorizes. That law allows or tolerates significant spying to promote compliance with diverse international legal regimes as well as advance other important public order values — well beyond (...) that allowed under Fabre's theory. This disconnect represents a challenge for her theory and ideal theory generally. This essay identifies these gaps and considers alternative approaches to addressing them. It argues that the political morality of spying should be explored through institutional moral reasoning that takes account of the actual practices, expectations, and institutions that states have created; it then offers a set of criteria for the international political morality of espionage. The essay concludes with a discussion of a key feature of all espionage, namely the secrecy of the methods used — as opposed to their goal of find others’ secrets. International law is both pushing transparency in many areas yet still allowing secret conduct by states, and these practices should also inform a theory of espionage. (shrink)

The promise to keep "secrets of state," once demanded and given, becomes virtually part of one's core identity. In the national security apparatus, one's pride and self-respect is founded in particular in the fact that one has been trusted to keep secrets in general and trusted with these particular secrets. I suggest that there are psycho-social aspects of promises made under these circumstances—bearing on self-image and self-respect, as well as status and acceptance in the larger society— that especially inhibit (...) violating these particular promises. The circumstances I have in mind apply to "secret societies" ranging from the Mafia or associations like the Masons to the CIA, and much more broadly to the Departments of Defense and State and the multitude of corporate contractors that do classified work for the Pentagon and the "intelligence community." Thus what is most feared by most prospective secret-tellers—with good reason— is social isolation, ostracism, exile, if they reveal the secrets of the group. If they are found out, they can expect the loss of friends and relationships, more or less irrevocably, as well as loss of job and career. What would a better secrecy system in a democracy look like? Let's take a moment to be utopian and consider some features it might have or omit, without asking what we could get from this Congress and this president or the next. (shrink)

In the first part of the 21st century, the complicated relationship between transparency and security reached a boiling point with revelations of extra-judicial CIA activities, near universal NSA monitoring and unprecedented whistleblowing – and prosecution of whistleblowers under the Espionage Act. This article examines the dual necessities of security and transparency for any democracy, and the manner in which whistleblowers radically saddle this Janus-faced relationship. Then I will move to contemporary examples of whistleblowing, showing how and why some prove more (...) damaging or beneficial than others. I will conclude with some suggestions as to practical reforms which might mitigate the seemingly inevitable pendulum-swinging between Snowden-style vigilantism and a panoptic security state. In the modern age, the political secret has acquired a bad reputation. With modern democracy’s ideal of transparency, political secrecy is identified with political crime or corruption. The article argues that this repression of secrecy in modern democracies falls short of a substantial understanding of the structure and workings of political secrecy. By outlining a genealogy of political secrecy, it elucidates the logic as well as the blind spots of a current culture of secrecy. It (...) focuses on two fundamental logics of secrecy, deduced from the Latin terms ‘ arcanum’ and ‘ secretum’. Whereas the logic of arcanum regards secrecy as a legitimate dimension of government, a modern logic of secretum is marked by an inextricable dialectics between the withdrawal and communication of knowledge, between secrecy and publicity. Here, the secret is not so much a piece of withheld knowledge as a ‘secrecy effect’ that binds the realm of secrecy to the public sphere by a dialectics of permanent suspicion and scandal. Instead of falling into the trap of this ‘secrecy effect’ it is worth taking a closer look at the tradition of thought on the arcana imperii, from Tacitus to early modern doctrines of raison d’état to Carl Schmitt. What this tradition deals with is the functionality of secrecy and its complicated relation to the law. The arcana tradition elaborates the crucial point of secrecy: its potential, but also its profound ambivalence. Secrecy opens up a discretionary space of action exempt from the rule of law, and, according to Carl Schmitt, ignores the law so as to allow it to become effective. Secrecy serves to protect and stabilize the state, but at the same time it opens a space of exception from the rule of law that breeds violence, corruption and oppression. Instead of seeing secrecy as the opposite of a political culture of transparency, it is more productive to regard secrecy as transparency's complement – a counterpart, however, that is marked by the profound paradox of being both a consolidation of and a threat to democracy. The exchange between Martin Buber and Franz Rosenzweig on the status of halakha is a well known, but also frustrating fixture in scholarship. For rather than responding to Rosenzweig’s critique, Buber seems to retreat in silence, claiming to be “unable to speak” about his position on Jewish Law. Scholars have generally tried to explain Buber’s failure to respond on philosophical and biographical grounds. What I propose, by contrast, is to revisit the question of Buber’s silence and secrecy from a (...) hermeneutical standpoint, arguing that Buber engaged in a deliberate strategy of concealment that constituted its own form of response. The hermeneutics of silence discloses a call for religious renewal that follows a state of Dialogvergessenheit, but which cannot be made audible. Neither dialogue nor its remembrance can be commanded. While Buber struggles with his Nichtredenkönnen, he also stands in a tradition of secretive hermeneutics – the Jewish hermeneutics of sod. Openness of knowledge was in the Dutch Republic no more a natural state of affairs than in other parts of Europe at the time, but it became dominant there at an earlier date than elsewhere. This puzzling phenomenon is the subject of this essay. The article shows that tendencies to secrecy in crafts and trades in the Netherlands were by no means absent and that public authorities were not principled supporters of openness. Openness of knowledge did not prevail (...) because arguments in favour of a free exchange of knowledge won the day against a rhetoric in defense of secrecy or because a rapid change in methods of production and marketing rendered the maintenance of craft secrecy practically impossible. The weakness of secrecy in the early-modern Netherlands, this essay argues, can be explained by the relative tardiness of the growth of the corporate system and the typical features of the institutional structure of the Dutch Republic. Craft secrecy in the Dutch Republic, as far as it existed before the middle of the eighteenth century, was normally based on a contractual relationship between individual actors rather than on any form of enforcement by public agencies. This book explores a hitherto unexamined possibility of justifiable disobedience opened up by John Rawls’ Law of Peoples. This is the possibility of disobedience justified by appeal to standards of decency that are shared by peoples who do not otherwise share commitments to the same principles of justice, and whose societies are organized according to very different basic social institutions. Justified by appeal to shared decency standards, disobedience by diverse state and non-state actors indeed challenge injustices in the (...) international system of states. The book considers three case studies: disobedience by the undocumented, disobedient challenges to global economic inequities, and the disobedient disclosure of government secrets. It proposes a substantial analytical redefinition of civil disobedience in a global perspective, identifying the creation of global solidarity relations as its goal. Michael Allen breaks new ground in our understanding of global justice. Traditional views, such as those of Rawls, see justice as a matter of recognizing the moral status of all free and equal person as citizens in a state. Allen argues that this fails to see things from the global perspective. From this perspective disobedience is not merely a matter of social cooperation. Rather, it is a matter of self determination that guarantees the invulnerability of different types of persons and peoples to domination. This makes the disobedience by the undocumented justified, based on the idea that all persons are moral equals, so that all sovereign peoples need to reject dominating forms of social organization for all persons, and not just their own citizens. In an age of mass movements of people, Allen gives us a strong reason to change our practices in treating the undocumented. Beginning from a definition of philosophical discourse which states the necessity of rhetoric meant as the whole of the linguistic devices aiming to persuade the interlocutor of truth and justice, the author points out that Pascal's text would be an outstanding example of such a discourse, while showing, nevertheless, the specificity of the rhetoric he employs. Such a specificity would aim to carry out a complex logic of the secret, concerning chiefly the ackowledgement and identification procedures of the subject of (...) the discourse-enunciation, and its pronominal and nominal markers.The author studies this logic on one hand by starting from the pragmatic patterns developed by the linguistics of enunciation, and on the other taking into account the philosophical, ethical and religious themes of the Jansenist thought in the XVIIth century. The distinction between concealment and secret leads the author to set up the forms of political rhetoric against the actual Pascalian aspects of philosophical rhetoric. Such a logic of the secret, which is the projection of the hidden God teologema into the field of philosophical discourse, would enable us to position as “absent” the subject producing this discourse and thus to transform what he states into a discourse of truth and justice. The very careful examination of the anonymity strategies and mostly of the writing tactics concerning the author's real name (anagram) would seem to confirm this conception of the rhetoric of Pascal's philosophical discourse. This article explores the social frameworks guiding expert and nonexpert perspectives on medicines safety in the U.K. Scientific experts from the Committee on the Safety of Medicines and the Medicines Commission were interviewed, and three nonexpertgroups, including patients and health professionals, were studied by the administration of questionnaires and focused group discussions. The research examined to what extent these groups subscribed to technocratic or democratic approaches to medicines regula tion and how this might be related to values toward technological risk. (...) The results reveal that there is substantial divergence between expert and nonexpert perspectives on medicines regulation, and that this derives as much from value differences as from any informational deficits. However, there seems to be some scope for shared values between some experts and some nonexperts, especially as regards state secrecy. The article concludes by discussing how those values could be used to foster a new "social contract of expertise" in which scientists are more democratically accountable and patients take more responsibility in governing medical risks. This paper discusses the criteria for acceptably holding citizens partly responsible for wrongs their state or its agents commit. Some proposed criteria are not, it argues, appropriately sensitive to the particular coercive relation between state and citizen. Others, which are, conceive of it wrongly and fail to match our judgments about a range of cases. Alternative criteria of breadth and joint authorship, built around Christopher Kutz's account of participation, better match these considered judgments as well as linking them (...) to a more powerful theoretical framework. In lieu of an abstract, here is a brief excerpt of the content:Walking the Bodhisattva Path/Walking the Christ PathU.S. Conference of Catholic BishopsCatholics and Buddhists brought together by Dharma Realm Buddhist Association, the San Francisco Zen Center, and the United States Conference of Catholic Bishops (USCCB) met 20-23 March 2003 in the first of an anticipated series of four annual dialogues. Abbot Heng Lyu, the monks and nuns, and members of the Dharma Realm Buddhist Association hosted the dialogue at the (...) City of Ten Thousand Buddhas in Talmage, California. The community had transformed their Confucius Hall into a chapel, with a large, newly constructed wooden cross on a wall above an altar facing out from a raised platform, so the Catholic delegation would have a space for worship. A special poster announcing the theme of the conference, "Walking the Bodhisattva Path/Walking the Christ Path," showing a Buddhist dharma wheel at one foot of a bridge and a Celtic cross at the other foot, had been created by the hosting community.The daily schedule for the dialogue did not interfere with the monastic routine at the City of Ten Thousand Buddhas, which included early morning chanting (4:00-5:00 am), daily rituals in the Buddha Hall, and the single large meal for monastics before noon to which all participants were invited. Catholics and Buddhists meeting in the dialogue began each day with an optional forty-five minutes of quiet sitting together in the monastery meditation hall, each following their own form of meditation and prayer. There was a Eucharist on Friday and Saturday evenings for the Catholics and to which the Buddhists were invited, and additional meals of breakfast and supper throughout the meeting at the City's Jyun Kang Restaurant.Fourteen Buddhists and fourteen Catholics participated in the formal discussions. Each participant spoke on what it means to them to follow Christ or the way of the Bodhisattvas or enlightened beings. In addition to speaking, each participant distributed a short passage, usually from a traditional text, on this topic. Several passages from Master Dogen's Shobogenzo and the Gospel of John were among those shared by the group. Other passages shared were taken from the Avatamsaka Sutra and the Shurangama Sutra and from the other gospels and the writings of Zen master HakuinZenji, the Dalai Lama, Korean Zen Master I-sahn Hye-yeon, the teachings of Master [End Page 247] Hsuan Hua, Shantideva, Origen, St. Ignatius, St. Benedict, the author of The Cloud of Unknowing, St. John of the Cross, and Chiara Lubich. A minute of silence separated the fifteen-minute segments for each presentation. With so large a group, most of the time in the formal sessions involved listening to series of presentations; however, during discussion periods the participants asked several challenging questions of one another.Some participants noted the tension they felt between belonging to a particular religious group and the need to let go of any consequential narrowness. The goal of the discussion was to promote understanding of the differences and similarities between Christianity and Buddhism. At one point, the participants noted several concerns about mutual enrichment: whether Buddhist methods can be separated from Buddhism and Christian methods from Christianity, and what specific aspects of Christian practice truly enrich Buddhists and which Buddhist practices likewise enrich Christians. Several times participants discussed their understanding of terms such as transformation, grace, the incarnation and the passion of Jesus, discernment of spirits, prayer, Buddha-nature, and related terms. There was consensus that Buddhists and Catholics can practically help one another regarding mental cultivation and religious precepts. They expressed this consensus in their choice of the topic forthe next dialogue, "Transformation of Hearts and Minds: Chan/Zen-Catholic Approaches to Precepts."The group agreed to reconvene in 2004 to respond to six presentations, three from each side, on different aspects of this topic.Chairing the sessions were Rev. Heng Sure for the Dharma Realm Buddhist Association, Rev. Taigen Dan Leighton for the San Francisco Zen Center, and Bishop John Webster for the United States Conference of Catholic Bishops. If we are looking for an Ur-explanation for the persistence of the Ur-myth, or any other myth, in our literature, could we not more directly find it in the structure of a mind which does not have to remember in order to imitate? The occasion of both myth and literature is the social life of the species which, in Starobinski's sense, is a history of continual eviction; but as regards the apparatus of thought by which this social life is reflected (...) in art it is more a history of assimilation and repetition. "The work of the brain," to cite a recent article in Scientific American, "is to create a model of a possible world rather than to record and transmit to the mind a world that is metaphysically true…Different worlds are presumably constructed by similar species."1 And, presumably, similar worlds are constructed by similar species. Weisinger hints briefly at something like this in his essay "The Mythic Origins of the Creative Process," but one has the clear impression, as his title suggests, that he would like to have the [myth/ritual] cart before the creative horse.2 However much this may satisfy our longing to crown our literature, if not creativity itself, with a mythic genealogy, it seems a wistful hypothesis. Doctoral programs at U.S. universities play a critical role in the development of human resources both in the United States and abroad. This volume reports the results of an extensive study of U.S. research-doctorate programs in five broad fields: physical sciences and mathematics, engineering, social and behavioral sciences, biological sciences, and the humanities. Research-Doctorate Programs in the United States documents changes that have taken place in the size, structure, and quality of doctoral education since the widely used 1982 editions.
