Ethical concepts are, or purport to be, normative. They make claims on us: they command, oblige, recommend, or guide. Or at least when we invoke them, we make claims on one another; but where does their authority over us - or ours over one another - come from? Christine Korsgaard identifies four accounts of the source of normativity that have been advocated by modern moral philosophers: voluntarism, realism, reflective endorsement, and the appeal to autonomy. She traces their history, showing (...) how each developed in response to the prior one and comparing their early versions with those on the contemporary philosophical scene. Kant's theory that normativity springs from our own autonomy emerges as a synthesis of the other three, and Korsgaard concludes with her own version of the Kantian account. I defend a neo-Kantian view wherein we are capable of being completely autonomous and impartial and argue that this ability can ground normativity. As this view includes an existentialist conception of the self, I defend radical choice, a primary component of that conception, against arguments many take to be definitive. I call the ability to use radical choice “existentialist voluntarism” and bring it into a current debate in normative philosophy, arguing that it allows that we can be distanced from (...) all ends at once so as to be completely impartial. Finally, I indicate how this can be the source of normativity as it provides a purely impartial reason for being rational. (shrink)

This paper seeks to clarify one of the deepest questions about the source or ground of normativity, while also presenting an essence-based approach to answering it. We call it the ‘Arché Question.’ Though all metanormative theories must address this question, very few realists have explicitly grappled with the challenge it poses; those who have appear to deny any need to give an answer. This paper investigates two puzzles in practical reason and proposes a solution to them. First, sometimes, when we are practically certain that neither of two alternatives is better than or as good as the other with respect to what matters in the choice between them, it nevertheless seems perfectly rational to continue to deliberate, and sometimes the result of that deliberation is a conclusion that one alternative is better, where there is no error in one’s previous judgment. Second, there are (...) striking differences between rational agents – some rational agents have most reason to pursue careers on Wall Street while others have most reason to take up a career in teaching, or scuba diving, or working for political causes. These differences aren’t plausibly explained by ‘passive’ facts about our psychology or their causal interaction with our environment; instead, these facts seem in some sense to ‘express who we are’. But what is this sense? These puzzles disappear if we adopt a novel view about the source of the normativity of reasons – some reasons are given to us and others are reasons in virtue of an act of will. We make certain considerations reasons through an act of will and thus sometimes make it true through an act of agency that we have most reason to do one thing rather than another. (shrink)

I present an outline of a normative and non selectionist theory capable of ascribing functional statements to biological items. Biological items are ussually exemplified by the organs as well as traits or behaviours. But we can consider representations too. In fact, my proposal is focused towards a teleosemantical theory of mental content. The teleosemantic approach explains the content of beliefs in terms of the biological functions of those states. Usually, teleosemantical theories of mental representation either ellaborate previously a general theory (...) of functions for biological items, this is the case for Millikan, Neander or Price, orassume a previous selectionist one, as Papineau does. But these proposals are frequently adaptationist in order to keep normatitvity in whatever functional adscription. The recent contributions to the state of the art show the problems of this kind of selectionist view. But they don’t consider the problem of normativity in functional adscriptions. And this problem become important when we pay attention to mental representations as biological facts. I propose an outline of a nonselectionist nor adaptationist account of biological functions capable of keeping normativity. My account is suitable to biological traits, in general, and mental representations characterized in terms of biological functions. (shrink)

Anscombe is usually seen as a critic of “Modern Moral Philosophy.” I attempt a systematic reconstruction and a defense of Anscombe’s positive theory. Anscombe’s metaethics is a hybrid of social constructivism and Aristotelian naturalism. Her three main claims are the following: (1) We cannot trace all duties back to one moral principle; there is more than one source of normativity. (2) Whether I have a certain duty will often be determined by the social practices of my community. For instance, (...) duties imposed by other people’s rights are socially constructed. In this article, I provide a characterisation of metaethical Kantian constructivism that withstands these criticisms. I start by offering a partial defence of Sharon Street’s practical standpoint characterisation. However, I argue that this characterisation, as presented by Street, is ultimately incomplete because it fails to demonstrate that the claims of Kantian constructivism constitute a distinctive contribution to metaethics. John Searle reflections on how to derive “Ought” from an “Is’” present a general theory of the sources of normativity within human civilizations. This chapter explores an alternative grounding of normativity on “laws of essence”, a grounding that proceeds by addressing the crucial problem of how to locate essences in a world of facts. This question at once summons up another, implicitly contained in the latter: is every (...) ethical norm (or moral norm, for we are not making a distinction between the two concepts here) ultimately religious in origin, as is most often supposed, or can one in fact conceive of sketching the outlines of a moral code that is immanent within the social relationship, a moral code that is sufficiently coherent and self-consistent to do without, at least in theory, a religious-type transcendence? Here, I should like to make a case for the second response by emphasizing that religion - whatever meaning one bestows on this notion, still undefined today - does not constitute the primary, irreducible social and historical fact that is most often supposed, but that it should itself be interpreted as the formulation of a more original and more universal formulation: the threefold obligation of giving, receiving, and repaying distinguished by Marcel Mauss in his famous Essay on the Gift. Of course, I shall not claim here to do more than sketch a few possible lines of argument. When engaging with classical Chinese ethics, we might end up wondering what kind of moral theorizing we ultimately are confronted with. The accounts and answers to specific practical problems are dispersed throughout the texts and expressed via various codes of composition, ranging from sayings to theoretical reflections to poems. However, what exactly the aim of these theories consists in is not explicitly addressed by systematic second-order reflections. In this article I try to shed some light on the understanding of moral (...) theorizing that underlies the transmitted texts. For this, I adopt an issue-centered approach that attempts to indirectly address the understanding of moral theorizing via the question about the source of normativity. That approach will be tested by drawing on the accounts of Mengzi 孟子 and Cheng Yi 程頤. First conclusions will show that moral theorizing can be understood as the simultaneous business of a moral anatomist and a moral painter. (shrink)

Readers of Theodor Adorno often have understood him as a "totalizing negativist." If it truly is the case that Adorno saw modern society as a realm of complete falsehood, however, his own social theory is unintelligible. In A Precarious Happiness, Peter E. Gordon aims to redeem Adorno from this negativist interpretation by showing that it arises from a basic misunderstanding of his work. Pushing against entrenched interpretations, Gordon argues that Adorno's philosophy is animated by a deep attachment to a concept (...) of happiness or human flourishing, and it is only by virtue of that normative standard that Adorno judges the world a catastrophic failure. Through a comprehensive reading of Adorno's work, A Precarious Happiness shows that in an imperfect world, the available standards of our flourishing are also imperfect. Looking beyond Adorno, Gordon suggests that the practice of social criticism, even if it is directed toward exposing what is "false," cannot succeed without appealing to an unrealized notion of what would be right. To my mind, the most urgent current task in the social sciences is one in the context of which the unduly cut-and-dried distinctions between positive and normative, between sociology and ethics, between secular pluralism and religious spirituality, and so on, should be abandoned. I would like to reclaim the legacy of a Marxian-type dialectic by stating that the social sciences today (and I would even risk speaking of a single present-day ‘social science’) have the threefold task of (1) thinking through (...) in depth the directions of a desirable social change, (2) asking what are the ‘resources for action’ already available for this end within the totality of social actors and (3) identifying the moral capacities that need to be stimulated and/or created so that the resources for action which are not yet available, but which are desirable under point (1), may be able to take root and flourish. I defy anyone to disentangle clearly and analytically the positive and normative parts of such a task …If the somewhat acrimonious debate on the status of the gift that I have had with Alain Caillé for the last two years continues to hold my interest and if I have eventually overcome my irritation in the face of what has occasionally seemed to me a failure of understanding linked to the defence of an ‘article of local faith’, it is because our debate is a fundamental part of the worthwhile task of the social sciences. Nevertheless, I shall make it clear straight away that the expression ‘sociological gift’ hardly satisfies me, in the light of the description of this task which I have just supplied. (shrink)

One of the most unsatisfactory sections of Robert Brandom's very complex and difficult book, Making it Explicit, is, unfortunately, the very first chapter.1 Brandom's general objective in this work is to displace the concept of representation from its position as the central explanatory concept in the philosophy of language and epistemology, and replace it with some set of explanatory concepts derived from the analysis of social action or practice. In particular, he wants to argue that the concept of a social (...) norm – a rule that determines, implicitly or explicitly, whether an action is correct or incorrect – can serve as a primitive concept in the development of a general theory of meaning. Successful execution of such a program would therefore constitute a vindication of some of the core intuitions underlying philosophical pragmatism. (shrink)

This book analyses the use of the crucial concept of 'taste' in the works of five major seventeenth-century French authors, Méré, Saint Evremond, La Rochefoucauld, La Bruyère and Boileau. It combines close readings of important texts with a thoroughgoing political analysis of seventeenth-century French society in terms of class and gender. Dr Moriarty shows that far from being timeless and universal, the term 'taste' is culture-specific, shifting according to the needs of a writer and his social group. The notion of (...) 'taste' not only helped to shape a new dominant culture, but also registered the conflicts within that culture between a view of taste that presupposted the values of 'polite society' as an exclusive (though not necessarily aristocratic) group, and a view that stressed the value of the classical-humanist tradition as a source of standards ratified by a broader public. this study sheds light not only on the central concept, but also on the individual authors discussed and on the norms of French classical literature in general. In _The Sources of Normativity_, Christine M. Korsgaard argues that unconditional obligation can be accounted for in terms of practical identity. My argument in this paper is that practical identity cannot play this foundational role. More specifically, I interpret Korsgaard's argument as beginning with something analogous to Kant's fact of reason, viz. with the fact that our minds are reflective. I then try to show that her determination of this fact is inadequate and that this causes the argument concerning (...) practical identity to fail. Finally, I argue that a conception of the fact of reason more in line with what I take to be Kant's own is necessary to account for unconditional obligation. (shrink)

This article argues that political realists have at least two strategies to provide distinctively political normative judgements that have nothing to do with morality. The first ground is instrumental normativity, which states that if we believe that something is a necessary means to a goal we have, we have a reason to do it. In politics, certain means are required by any ends we may intend to pursue. The second ground is epistemic normativity, stating that if something is (...) true, this gives us a reason to believe it. In politics, there are certain empirical regularities that ought to be acknowledged for what they are. Both sources are flawed. Instrumental normativity only requires coherence between attitudes and beliefs, and one can hang on to false beliefs to preserve attitudes incompatible with reality. I may desire to eschew power relations, and accordingly I may imagine politics to be like a camping trip. Epistemic normativity, on the other hand, operates critically, striking down existing normative claims. It shows us that politics is nothing like a camping trip, but it doesn’t tell us what we should do about it. We conclude by showing that if the two are taken together, they remedy each other’s flaws. This paper addresses the question "In virtue of what do practical reasons have normative force or justificatory power?" There seems to be good reason to doubt that desires are the source of normativity. However, I argue that the reasons to be suspicious of desire-based accounts of normativity can be overcome by a sufficiently sophisticated account. The position I defend in this paper is one according to which desires, or more generally, proattitudes, do constitute values and provide rational justifications (...) of actions when they are organized in the right way. Anglo-American authors have paid little attention to a subtle distinction that has important jurisprudential implications. It is the distinction between sources of law and the legal norms which can be derived from sources by means of interpretation. The distinction might also be rendered as a threefold one, separating sources of law from legal norms and both of these from that which mediates their relation, namely, methods of legal interpretation. This paper intends to state the “source-norm” distinction clearly (...) and to give examples of jurisprudential insights that are missed, and mistakes that may be made if the distinction is not given its due. Nearly all of the scant comparative work on Søren Kierkegaard and Confucius places the two starkly at odds with each other. Kierkegaard is pictured as the paradigmatic exemplar of the Western self: a discrete rights-bearing and volitional atom who is quite alone in the world, while Confucius, by contrast, is the paradigmatic exemplar of the Eastern self: a complex and irreducibly embedded communitarian bundle of relations and rich social roles. In this article, I challenge this oppositional approach, since it is (...) both erroneous and obscures fruitful dialogue between the two on conceptually commensurate problems. I argue (1) that Kierkegaard offers a relational ontology of the self which moves in a Confucian direction, (2) that subjectivity and relational reciprocity are not fundamentally at odds in the two thinkers, (3) that both thinkers value a life of harmonious integration that entails right relation to others, and finally (4) that Confucius’ appeal to Heaven as a source of normativity allows for salutary social critique of prevailing ethical norms and practices, in a way that provides important comparative insights with Kierkegaardian theism. A discussion of Christine Korsgaard's The Sources of Normativity.

This article is an attempt to identify the sources of normativity in virtue ethics. The starting point for the analyzes presented here is the book by Dominika Dzwonkowska Environmental virtue ethics. In § 1, I present the basic theses and assumptions of this approach to ethics. Then, with reference to the concept of the moral subject proposed by Dzwonkowska, I ask whether it constitutes the primary source of normativity (§ 2). I argue that environmental virtue ethics can (...) be ascribed to arguments shared by supporters of the so-called constitutive arguments in metaethics (§ 3). Their position is based on the recognition that moral norms, obligations, etc., derive from the constitutive features of the subject. I call such an approach internalist and contrast it with the non-internalist approach, the outline of which I propose in § 4. In the Conclusion, I suggest that the pragmatic considerations and conservatism of researchers speak in favor of the internalist approach. (shrink)
