The essay explores sexual temperance in Aristotle's work and connects it to issues in sexual ethics.

Many people think that promiscuity is morally acceptable, but rape and pedophilia are heinous. I argue, however, that the view of sexual ethics that underlies an acceptance of promiscuity is inconsistent with regarding (1) rape as worse than other forms of coercion or assault, or (2) (many) sex acts with willing children as wrong at all. And the view of sexual ethics that would fully explain the wrong of rape and pedophilia would also rule out promiscuity. (...) I intend this argument neither as a case against promiscuity nor as either a mitigation of rape or a partial defense of pedophilia. My purpose is to highlight an inconsistency in many people's judgements. Whether one avoids the inconsistency by extending or limiting the range of practices one condemns, will depend on which underlying view of the ethics of sex one accepts. (shrink)

Human papillomavirus (HPV) is one of the most common sexually transmitted infections. It is a leading cause of cervical cancer in women but the virus is increasingly being linked to several other cancers in men and women alike. Since the introduction of safe and effective but also expensive vaccines, many developed countries have implemented selective vaccination programs for girls. Some however argue that these programs should be expanded to include boys, since (1) HPV constitutes non-negligible health risks for boys as (...) well and (2) protected boys will indirectly also protect girls. In this paper we approach this discussion from an ethical perspective. First, on which moral grounds can one justify not reimbursing vaccination for the male sex? We develop an ethical framework to evaluate selective vaccination programs and conclude that, in the case of HPV, efficiency needs to be balanced against non-stigmatization, non-discrimination and justice. Second, if vaccination programs were to be expanded to boys as well, do the latter then also have a moral duty to become immunized? Two arguments in favor of such a moral duty are well known in vaccination ethics: the duty not to harm others and to contribute to the public good of public health. However, we argue that these are not particularly convincing in the context of HPV. In contrast, we believe a third, more powerful but also more controversial argument is possible. In our view, the sexual mode of transmission of HPV constitutes an additional reason to believe that boys in fact may have a moral obligation to accept vaccination. (shrink)

The major difference between “new” and “old” natural law approaches to sexual ethics is that for new natural law theorists the moral evaluation of sex acts is always determined with reference to that basic form of human flourishing which is called marriage; old natural law theorists determine the morality of sex acts also with reference to the natural purpose of the sexual faculties. Ultimately, the old approach relies implicitly on prior value judgments to distinguish biological facts that (...) are axiologically or morally relevant from those that are not. It also appeals to values to ground the wrongness of immoral sex acts. In its pure form, the old natural law approach to sexual ethics lends itself to a misunderstanding of the unitive aspect of marriage. Irene Alexander’s article in last spring’s issue of this journal criticizes the new natural law account of sexual ethics, including Melissa Moschella’s defense of that view in a previous article also in this journal. Alexander claims that the NNL account adopts an empiricist view of nature and that NNL’s rejection of the perverted faculty argument is contrary to the Magisterium. Here Moschella responds to Alexander’s criticisms by clarifying NNL theorists’ understanding of the distinction between speculative and practical reason (...) through an explanation of Aquinas’s account of the four orders, correcting Alexander’s erroneous portrayal of NNL arguments against contraception, and arguing that the NNL account of sexual ethics is not only in line with magisterial teaching, but offers a better philosophical defense of that teaching than the view Alexander proposes. In this essay I follow one argument strand from Linda Singer's Erotic Welfare. How can we have a forward-looking and affirmative ideal of sexual freedom when the AIDS panic has altered the sexual landscape and instigated new justifications for oppressive sexual disciplines? How can we be sexual subjects when processes of commodification and disciplinary practices have constrained sexual expression while proliferating sexual fetishes? These are some of the questions this book formulates, without answering.

Different judgments by Christian communities on issues in sexual ethics involve different weightings of various sources of moral authority, different understandings of the normativity of the natural, and different assessments of the scope of freedom to be exercised in relation to the goods of marriage. These fundamental differences of interpretation can be exemplified by the ongoing Roman Catholic discussion of the legitimacy of voluntary sterilization in certain “hard cases.” The contributors to this issue of Christian Bioethics, in their (...) spirited exchange on that issue, exemplify the need for careful attention to the ways that differences of theological emphasis and moral method lead to different judgments in particular cases, both within and between particular Christian communities. In his treatment of the issues raised by the movements of women for equal rights a century ago, Michels anticipated controversies and conflicts about which people care deeply today. He took a clear position in support of the desirability of equality between the sexes. In consequence, it remains relevant to current debates within feminism over equality and difference and the corresponding challenge to, and feminist critique of, social science arising from the (re) emergence of "difference" feminism.Sexual Ethics constitutes (...) both an analysis of the "woman problem" and a document describing the wars between the sexes during this period and an important and overlooked piece of history of the classic sociological tradition. Michels observed that the national and economic conflicts in modern Europe were vast in scale and revealed sharply sensed injustices, and also that sex antagonisms are becoming more acute. He presented an argument, consistent with his theoretical position, about the seriousness of women's rights. Michels' discussions of sexuality, sexual morality, and the relations of the sexes had as its stimulus "the new sexual ethic" advocated by feminists. He pointed out that true equality required equality of rights to sexual liberty for women or chastity prior to marriage for men.Michels supported premarital chastity for men as an ideal, but he doubted that very many would practice it. Michels was virtually alone in the sociological tradition in seeking to illuminate the "struggle for love" between men and women by reference to the "erotic coquetry" in the sexual behavior of "lower animals." Despite his stand for equality of men and women in sexual matters, a recurrent theme in Sexual Ethics is that men are sexually more aggressive than women, at least in part due to social structures and cultural traditions. Michels advocated family planning (but opposed abortion) in the interests of marital and family happiness and economic well-being, especially for the poor.In his new introduction, Terry R. Kandal discusses Robert Michels' life. He explores, among other topics, Michels' treatment of the woman question and the reactions of Michels' contemporaries to the same question. He also discusses the feminist critique of social science, and the place of Michels in and the gender questions of our times. These three reflections look at the theological and ethical implications of sexual violence in light of the attention brought by #MeToo. The first explores ethnographic interviews which indicate that Church leaders, teachers, and parents contribute to rape culture by leaving sexual violence unaddressed in Christian sexual education, arguing that it must be reconstructed to eliminate the Church’s participation in a culture that promotes gender-based violence. This chapter examines the ethical matters that arise from Schopenhauer’s discussions of sexual love and sexual practices. It presents Schopenhauer's remarks on “pederasty”, among other “unnatural lusts”, and attempts to disentangle Schopenhauer’s judgements on these practices from the principles that guide them. It considers these practices in the light of Schopenhauer's ethics of asceticism and his ethics of compassion and concludes that Schopenhauer’s objections to them are not always moral in nature, strictly speaking, and where they (...) are moral, they are not always based on the “unnaturalness” of the practices, but rather the harm that he supposes they may cause. Much of modern ethics is built around the idea that we should respect one another’s autonomy. Here, “we” are typically imagined to be adult human beings of sound mind, where the soundness of our mind is measured against what we take to be the typical mental capacities of a neurodevelopmentally “normal” person—perhaps in their mid-thirties or forties. When deciding about what constitutes ethical sex, for example, our dominant models hold that ethical sex is whatever is consented to, while a (...) lack of consent makes sex wrong.1 Consent, in turn, is analysed in terms of autonomous decision-making: a “yes” or “no” that reflects the free and informed will of our idealised, sound-minded adult. Whether such models provide adequate normative guidance for ethical, much less good, sex between neurotypical human adults is an open question.2 3 When it comes to the ethics of sexual activity between humans and non-humans—robots, say—or between humans who don’t fit the rational stereotype, we hardly know where to begin.4–7 It is therefore heartening to see a number of papers in this issue tackling the difficult question how to respectfully facilitate or respond to the needs, desires, and decisions of people with different kinds or degrees of autonomy.8 For example, Sumytra Menon and colleagues9 explicitly discuss the notion of “borderline capacity” and argue, in the medical domain, for shared and supportive decision-making practices to “foster the autonomy of patients with compromised mental capacity while being mindful of the need to safeguard their well-being.” Touching on a similar theme, Zahra Ladan 10 asks how we should conceive of liberty in the case of persons with certain inborn physical or mental limitations. Bioethicists have virtually assumed that Tarasoff generated a duty to warn the sexual partners of an HIV‐positive man that they risked infection. Yet given the views of sex and of AIDS that have evolved in the gay community, in many cases the parallels to Tarasoff do not hold. Bioethicists should at the least attend to the community's views, and indeed should go beyond doing mere “professional ethics” to participate in the moral self‐exploration in which these views are located.

In response to Gilbert Meilaender 's innovative interpretation of Augustine and of Roman Catholic teaching, the author suggests that Meilaender attributes to Augustine a more positive view of sexual pleasure than the texts will support, that modern Roman Catholic teaching suggests that love should have priority over procreation as a meaning of sex; and that the moral logic of Meilaender's argument does not require a rejection of all reproductive technologies. As a result of his visit to Uganda, on behalf of the Catholic Fund for Overseas Development, theologian Kevin Kelly made the discovery that poverty and marginalization create windows of opportunity for the transmission of AIDS. In this book, Kelly brings together the whole of his thinking and experience as a teacher, moral theologian, and parish priest to challenge the thinking of the Church on sex and sexuality as moral issues for our time.

The standard liberal sexual ethic maintains that consent is the only requirement for ethical sexual relations. While consent is certainly necessary for an adequate sexual ethic (and it’s important to know what it involves), I argue that it’s far from sufficient. The key claims that I advance are the following: (1) The consent-only model of sexual ethics affirms a “casual” view of sex and therefore it can’t make sense of and properly combat what’s worst in (...) the sexual domain: namely, the grave evil of sexual violence. (2) The consent-only model of sexual ethics fails properly to recognize the special significance of human sexuality and the nature of erotic love and its role in human sexual fulfillment and therefore it can’t make sense of and properly support what’s best in the sexual domain: namely, a committed erotic loving relationship. A more adequate sexual ethic, I maintain, would be a more traditionalist one that involves the following: it would give proper recognition to the special significance of human sexuality, avoid dehumanization in sexual desire, and encourage and support committed erotic love and its role in human fulfillment. Moreover, it would regard this as requiring that we cultivate sexual virtues such as chastity, modesty, and fidelity, and that we encourage and support life-long monogamous marriage as the proper context for human sexual relationship. Guynn offers an innovative new approach to the ethical, cultural, and ideological analysis of medieval allegory. Working between poststructuralism and historical materialism, he considers both the playfulness of allegory (its openness to multiple interpretations and perspectives) and its disciplinary force (the use of rhetoric to naturalize hegemonies and suppress difference and dissent). Ultimately, he argues that both tendencies can be linked to the consolidation of power within ruling class institutions and the persecution of demonized others, notably women and sexual (...) minorities. In ‘Is prostitution harmful?’ I argue that if casual sex is acceptable, then so is prostitution.1 Anna Westin, in ‘The harms of prostitution: critiquing Moen's argument of no-harm’, raises four objections to my view.2 Let me reply to these in turn.Westin's first objection is that it is ‘fundamentally problematic [to] categorise sexual ethics into merely two types’, the type that accepts casual sex and the type that does not. The reason why, she explains, is that this ‘incompletely frames (...) the contemporary discourse in sexual ethics’. Omitted in Sexual Ethics are about seventy pages presenting contemporary debates between the methods and anthropologies of traditionalists and revisionists (most of TSP chapters 2 and 3). New in Sexual Ethics are “Questions for Reflection” at the end of each chapter and a brief discussion of “conscience” (xxv–xxvi).In both books, the authors offer a “historically conscious and revisionist approach” to Catholic sexual morality (SE, 221). Beginning with “two magisterial principles” in “Catholic moral, sexual tradition”—procreation and the confines of marriage—the authors note different theological bases for these principles—nature and reason, respectively (xiii–xiv)—and propose a significant shift in focus from the “‘nature’ of the act” to “the meaning of the act for the human person” (xvii). Chapter 1, which could stand on its own, provides a helpful, “brief history” of “sexual morality in the Catholic tradition,” undergirding the authors’ historical (in contrast with a classicist) approach. In chapter 2, the theological crux of the argument, Todd Salzman and Michael Lawler proceed to explore methodological developments and tensions in magisterial teaching, choosing “the principle of the human person adequately considered,” theologically articulated in Gaudium et spes, as the basis for their proposal of a “unitive sexual anthropology” (47). This holistic anthropological approach to the sexual person attempts to shift the magisterium’s “focus on acts and absolute norms” in sexual ethics to a method more akin to its social ethics, focusing on general principles, interrelationships, and the common good (59). Central to their [End Page 226] argument is a reworking of the concept of complementarity purged “of every suggestion of either gender or sexual inequality” (63). The remainder of the book illustrates “how these principles apply in real, concrete, particular human relationships” (87).To critique the argument of Sexual Ethics necessarily implicates The Sexual Person, which is beyond the scope of this review. Nevertheless, it is reasonable to ask whether the same argument presented as a “renewed Catholic anthropology” (in TSP) for professional theologians functions equally well as a “theological introduction” to sexual ethics (in SE) for a lay (nonscholarly) audience. Chapter 6, “Artificial Reproductive Technologies,” is the most successful in this regard, exploring a range of ethical concerns (e.g., means versus ends, burden of proof, presumptions against, appropriate cautions, and consideration of the common good) to arrive at a qualified expansion of magisterial teaching, which becomes a guide to personal discernment. Other topics in Sexual Ethics include marriage and contraception (chapter 3), cohabitation and premarital sexuality (chapter 4), and homosexuality (chapter 5).Overall, Sexual Ethics functions better as an introduction to Catholic sexual teaching and moral anthropology than as an introduction to sexual ethics. For example, reworking the concept of “complementarity”—despite the authors’ inclination “to abandon both the word and the idea” (63)—may be necessary for reconstructing Catholic tradition, but is not necessarily the most helpful starting point for sexual ethics. Sexual Ethics will be challenging for readers lacking theological training and will be of most interest to those already committed to and invested in magisterial teaching. My recommendation would be to use The Sexual Person as a teacher’s guide when assigning Sexual Ethics.
