Ethical decision making measures are widely applied as the principal dependent variable used in studies of research integrity. However, evidence bearing on the internal and external validity of these measures is not available. In this study, ethical decision making measures were administered to 102 graduate students in the biological, health, and social sciences, along with measures examining exposure to ethical breaches and the severity of punishments recommended. The ethical decision making measure was found to be related to exposure to (...) ethical events and the severity of punishments awarded. School principals world-wide report high levels of strain and attrition resulting in a shortage of qualified principals. It is thus, crucial to identify psychosocial risk factors that reflect principals’ occupational wellbeing. For this purpose, we used the Copenhagen Psychosocial Questionnaire (COPSOQ-II), a widely used self-report measure covering multiple psychosocial factors identified by leading occupational stress theories. We evaluated the COPSOQ-II regarding factor structure and longitudinal, discriminant, and convergent validity using latent structural equation modeling in a large sample of Australian (...) school principals (N = 2,049). Results reveal that confirmatory factor analysis produced marginally acceptable model fit. A novel approach we call set exploratory structural equation modeling (ESEM-set), where cross-loadings were only allowed within a priori defined sets of factors, fit well, and was more parsimonious than a full ESEM. Further multitrait-multimethod models based on the set-ESEM confirm the importance of a principal’s psychosocial risk factors; Stressors and depression were related to demands and ill-being, while confidence and autonomy were related to wellbeing. We also show that working in the private sector was beneficial for showing a low psychosocial risk, while other demographics have little effects. Finally, we identify five latent risk profiles (high risk to no risk) of school principals based on all psychosocial factors. Overall the research presented here closes the theory application gap of a strong multi-dimensional measure of psychosocial risk-factors. (shrink)

Adults with chronic pain interpret ambiguous information in a pain and illness related fashion. However, limitations have been highlighted with traditional experimental paradigms used to measure interpretation biases. Whilst ambiguous scenarios have been developed to measure interpretation biases in adolescents with pain, no scenario sets exist for use with adults. Therefore, the present study: sought to validate a range of ambiguous scenarios suitable for measuring interpretation biases in adults, whilst also allowing for two response formats ; and investigate paradigm efficacy, (...) by assessing the effects of recent pain experiences on task responding. A novel ambiguous scenarios task was administered to adults. Participants were presented with 62 ambiguous scenarios comprising 42 that could be interpreted in a pain/pain-illness or non-pain/non-pain illness manner: and 20 control scenarios. Participants generated their own solutions to each scenario, then rated how likely they would be to use two researcher-generated solutions to complete each scenario. Participants also rated their subjective experiences of pain in the last 3 months. Tests of reliability, including inter-rater agreement and internal consistency, produced two ambiguous scenario stimulus sets containing 18 and 20 scenarios, respectively. Further analyses revealed adults who reported more recent pain experiences were more likely to endorse the pain/pain-illness solutions in the Likelihood Ratings Task. This study provides two new stimulus sets for use with adults in pain research and/or interventions. Results also provide evidence for a negative endorsement bias in adults. (shrink)

Thomas Hofweber takes the semantic paradoxes to motivate a radical reconceptualization of logical validity, rejecting the idea that an inference rule is valid just in case every instance thereof is necessarily truth-preserving. Rather than this “strict validity”, we should identify validity with “generic validity”, where a rule is generically valid just in case its instances are truth preserving, and where this last sentence is a generic, like “Bears are dangerous”. While sympathetic to Hofweber’s view that strict (...) validity should be replaced by something allowing for exceptions, I argue that this should instead be truth-conduciveness, a matter of a large majority of instances being truth-preserving. The fact that inference rules have uncountably many instances, I argue, can be handled by defining truth-conduciveness as relative to finite sets of instances. Moreover, I argue that Hofweber’s position, while seemingly radical, may be less so under closer scrutiny. For the mere claim that classical rules and unrestricted truth rules are generically valid (or truth-conducive) is not in itself controversial. Also, if there is an answer to the question of which of these are also strictly valid, then the claim that generic validity is the central notion in logic is at most an interest-relative matter, since there is then also a fact of the matter as to which inference rules are (not) strictly valid. If no solution operating with strict validity to the paradoxes can be had, however, then the claim that validity should be identified with a weaker notion is better motivated. I argue that it is reasonable, in view of past failures, to conjecture that no ordinary solution will score high enough relative to standard (uncontroversial) desiderata to merit justified belief. Hence, it is unknowable which solution is correct. I further argue that this is best explained by its being metaphysically indeterminate which solution is correct. If this conjecture is true, then we ought instead to think of validity as allowing exceptions, and then take the “true logic” to be one that takes both the classical rules and the truth rules to be valid, i.e., truth-conducive. This logic scores very high on the desiderata on logics, and is therefore preferable to any logic operating with strict validity. (shrink)

Background and rationale Clinicians often encounter a variety of ethical challenges in their routine clinical practice, and it varies across healthcare and cultural settings of their practice. Despite of this, there are no clear-cut available guidelines concerning the right course of action in a given ethically challenging situation. A validated instrument that could capture the health care providers’ viewpoints in this regard is lacking from Indian settings. Thus, the current study aimed at developing an instrument to assess the HCP’s perspective (...) regarding different ethically challenging situations encountered in the Indian settings. Methods The questionnaire was developed by involving 15 medical experts. A mixed-method approach, Delphi-technique, and online survey were used for item generation and validation. Results The questionnaire comprised of 11 items representing four factors: health-resource constraints, medical responsibility of the HCP, obtaining patients/family members’ consent for the treatment, and treatment beyond the standard protocol. The gender and clinical disciplines of the participants were related to their level of endorsement for various domains of the ECCS-Q. Conclusions Ethical challenges in the clinical practice fall in different clusters. The clinicians’ course of action in such situations have many socio-demographic and professional determinants. Future studies are warranted to investigate these phenomena. (shrink)

Many research fields concerned with the processing of information contained in human faces would benefit from face stimulus sets in which specific facial characteristics are systematically varied while other important picture characteristics are kept constant. Specifically, a face database in which displayed expressions, gaze direction, and head orientation are parametrically varied in a complete factorial design would be highly useful in many research domains. Furthermore, these stimuli should be standardised in several important, technical aspects. The present article presents the freely (...) available Radboud Faces Database offering such a stimulus set, containing both Caucasian adult and children images. This face database is described both procedurally and in terms of content, and a validation study concerning its most important characteristics is presented. In the validation study, all frontal images were rated with respect to the shown facial expression, intensity of expression, clarity of expression, genuineness of expression, attractiveness, and valence. The results show very high recognition of the intended facial expressions. (shrink)

Legal reasoning settles morally pressing matters through a technique that largely bypasses open-ended moral argument. That technique makes central what certain persons validly decided in the past, for example in creating statutes, judicial resolutions, contracts, or wills. Identifying valid decisions is a lawyerly skill and, echoing legal practice, legal philosophy has paid considerable attention to validity criteria. But it has neglected to explore validity's point: whether, and if so exactly how, the special technique of validity contributes to (...) a legal system's ability to realise justice and human rights. Even the most sensible defences of the moral need for positive law have insufficiently probed this key step in the argument. This book lays bare the workings of legal validity, and shows why, and within what general limits, this technique equips legal systems with privileged tools to foster human well-being. In so doing, the book explains how power-conferring norms setting out validity criteria endow agents' intentions with 'performative' effect ('I hereby.') and can secure the requirement of justice that there be widespread convergence on specific patterns of conduct shaped through a cooperative effort. Legal meaning is accordingly systemic, resulting from the valid acts of multiple agents whose decisions can, by virtue of exercising legal power, also exercise moral power (authority). The main idea that we want to defend in this paper is that the question of what a logic is should be addressed differently when structural properties enter the game. In particular, we want to support the idea according to which it is not enough to identify the set of valid inferences to characterize a logic. In other words, we will argue that two logical theories could identify the same set of validities, but not be the same logic.

Many problems that arise when providing pharmacy services may contain some ethical components and the aims of this study were to develop and validate a scale that could assess difficulties of ethical issues, as well as the frequency of those occurrences in everyday practice of community pharmacists. Development and validation of the scale was conducted in three phases: generating items for the initial survey instrument after qualitative analysis; defining the design and format of the instrument; validation of the instrument. The (...) constructed Ethical Issue scale for community pharmacy setting has two parts containing the same 16 items for assessing the difficulty and frequency thereof. The results of the 171 completely filled out scales were analyzed. The Cronbach’s α value of the part of the instrument that examines difficulties of the ethical situations was 0.83 and for the part of the instrument that examined frequency of the ethical situations was 0.84. Test–retest reliability for both parts of the instrument was satisfactory with all Interclass correlation coefficient values above 0.6,. The 16-item scale, as a self assessment tool, demonstrated a high degree of content, criterion, and construct validity and test–retest reliability. The results support its use as a research tool to asses difficulty and frequency of ethical issues in community pharmacy setting. The validated scale needs to be further employed on a larger sample of pharmacists. (shrink)

One point that definitions of art experience disagree about is whether this kind of experience is qualitatively different from experiences related to ordinary objects and everyday contexts. Here, we follow an ecological approach assuming that art experience has its own specific quality that is, not least, determined by typical contexts of art presentation. Practically, we systematically observe typical phenomena of experiencing art in ecologically valid or real-world settings such as museum contexts. Based on evidences gained in this manner, we emulate (...) and implement essential properties of ecological contexts (e.g., free choice of viewing distance and time, large scale of artworks and exhibition-like context) in controlled laboratory experiments. We found, for instance, that for large scale paintings by Pollock and Rothko preferred viewing distances as well as distances inducing most intense art experiences including Aesthetic Aha insights were much larger than typical viewing distances realized in lab studies. Following Carbon’s (2019) terminology of measurement strategies of art experience, the combined use of “Path #1” (real-world context) and “Path #2” (mildly controlled, still ecologically valid settings and contexts), enables us to understand and investigate much closer what is really happening when people experience art. Emotion recognition plays an important role in children’s socio-emotional development. Research on children’s emotion recognition has heavily relied on stimulus sets of photos of adults posed stereotyped facial configurations. The Child Affective Facial Expression set is a relatively new stimulus set that provides researchers with photographs of a diverse group of children’s facial configurations in seven emotional categories—angry, sad, happy, fearful, disgusted, surprised, and neutral. However, the large size of the full CAFE set makes it less ideal for research in (...) children. Here, we introduce two subsets of CAFE with 140 photographs of children’s facial configurations in each set, diverse in the race and ethnicity of the models, and designed to produce variability in naïve observers. The subsets have been validated with 1000 adult participants. (shrink)

Traditional research on emotion-face processing has primarily focused on the expression of basic emotions using adult emotional face stimuli. Stimulus sets featuring child faces or emotions other than basic emotions are rare. The current study describes the acquisition and evaluation of the Qingdao Preschooler Facial Expression set, a facial stimulus set with images featuring 54 Chinese preschoolers’ emotion expressions. The set includes 712 standardized color photographs of six basic emotions, five discrete positive emotions, and a neutral expression. The validity (...) of the pictures was examined based on 43 adult raters’ online evaluation, including agreement between designated emotions and raters’ labels, as well as intensity and representativeness scores. Overall, these data should contribute to the developmental and cross-cultural research on children’s emotion expressions and provide insights for future research on positive emotions. (shrink)

In professional soccer, players, coaches, and researchers alike recognize the importance of cognitive skills. Research addressing the relevance of cognitive skills has been based on the cognitive component skills approach or the expert performance approach. Our project aimed to combine the strengths of both approaches to develop and validate cognitive tasks measuring inhibition and cognitive flexibility in a soccer-specific setting with a soccer-specific motor response. In the main study 77 elite youth soccer players completed a computerized version of the standard (...) flanker and number–letter tasks as well as flanker and number–letter tasks requiring a soccer-specific motor response in a soccer-specific setting. Results show good reliability for both tasks. For the SoccerBot360 number–letter task, switch effects for response times and accuracy and acceptable convergent validity were shown. A flanker effect for response time but not accuracy was apparent. Due to no acceptable convergent validity, the flanker task was revised and 63 adult soccer players participated in a follow-up validation study in the SoccerBot100. The revised flanker task showed the flanker effect for response time, but not for accuracy. However, acceptable convergent validity for response time was present. Thus, the soccer-specific number–letter and to some extent the soccer-specific flanker task show potential to be used as a valid cognitive diagnostic tool by soccer clubs. (shrink)

A number of recent works consider treating validity as a primitive notion rather than one defined in some standard manner. There seem to have been three motivations. First, to understand how truth and validity interact in potentially paradoxical settings. Second, to argue that validity is in fact afflicted with paradoxes analogous to the semantic paradoxes. Third, to develop a ‘deflationary’ conception of validity or consequence. This article treats the notion of validity as a primitive notion (...) and shows how to provide a consistent theory of classical validity (and self-applicative truth), conservative over Peano arithmetic. This paper treats entailment as a subrelation of classical consequence and deducibility. Working with a Gentzen set-sequent system, we define an entailment as a substitution instance of a valid sequent all of whose premisses and conclusions are necessary for its classical validity. We also define a sequent Proof as one in which there are no applications of cut or dilution. The main result is that the entailments are exactly the Provable sequents. There are several important corollaries. Every unsatisfiable set (...) is Provably inconsistent. Every logical consequence of a satisfiable set is Provable therefrom. Thus our system is adequate for ordinary mathematical practice. Moreover, transitivity of Proof fails upon accumulation of Proofs only when the newly combined premisses are inconsistent anyway, or the conclusion is a logical truth. In either case Proofs that show this can be effectively determined from the Proofs given. Thus transitivity fails where it least matters — arguably, where it ought to fail! We show also that entailments hold by virtue of logical form insufficient either to render the premisses inconsistent or to render the conclusion logically true. The Lewis paradoxes are not Provable. Our system is distinct from Anderson and Belnap''s system of first degree entailments, and Johansson''s minimal logic. Although the Curry set paradox is still Provable within naive set theory, our system offers the prospect of a more sensitive paraconsistent reconstruction of mathematics. This paper presents an effort to induce a Bayesian belief network (BBN) from crime data, namely the national crime victimization survey (NCVS). This BBN defines a joint probability distribution over a set of variables that were employed to record a set of crime incidents, with particular focus on characteristics of the victim. The goals are to generate a BBN to capture how characteristics of crime incidents are related to one another, and to make this information available to domain specialists. The (...) novelty associated with the study reported in this paper lies in the use of a Bayesian network to represent a complex data set to non-experts in a way that facilitates automated analysis. Validation of the BBN’s ability to approximate the joint probability distribution over the set of variables entailed in the NCVS data set is accomplished through a variety of sources including mathematical techniques and human experts for appropriate triangulation. Validation results indicate that the BBN induced from the NCVS data set is a good joint probability model for the set of attributes in the domain, and accordingly can serve as an effective query tool. The condition of liberty which Sen used in his famous theorem on the impossibility of the Paretian liberal was defined in terms of individual preferences. The preference-based approach has been the subject of much criticism, which led to the evolution of the game-theoretic analysis of rights. In this approach no references to individual preferences are made. Two questions are examined in this paper: how can different types of right be distinguished within a game-theoretic setting, and how do rights come into (...) existence? These questions are addressed on the basis of ideas originating from legal theory The discussion shows that an analysis of rights should take account of the whole legal system of which a legal norm forms part. Furthermore, it reveals that preferences should be re-introduced into the formal study of individual rights. (shrink)

In jurisprudential literature, the adjective ‘defeasible’ appears as a predicate of many terms: concepts, laws, rules, reasoning, justification, proof, and so on. In this paper, we analyze the effects of some versions of the thesis of the defeasibility of legal norms on the reconstruction of the notion of legal validity. We analyze some possible justifications of this thesis considered as a claim concerning validity, and enquire into two possible sets of problems related to the defeasibility of the criteria (...) of identification of a legal system. We also provide a formalization of some options regarding defeasible criteria of identification, which can be used as a tool for meta-jurisprudential analysis. BackgroundThe aim of this study was to explore the construct validity and diagnostic properties of the Reading the Mind in the Eyes Test in non-demented patients with amyotrophic lateral sclerosis.MaterialsA total of 61 consecutive patients and 50 healthy controls were administered the 36-item RMET. Additionally, patients underwent a comprehensive assessment of social cognition via the Story-Based Empathy Task, which encompasses three subtests targeting Causal Inference, Emotion Attribution, and Intention Attribution, as well as global cognitive [the Edinburgh Cognitive and Behavioral (...) ALS Screen ] and behavioral screening [the Frontal Behavioral Inventory ; the Dimensional Apathy Scale ; the Beck Depression Inventory ; and the State and Trait Anxiety Inventory-Y]. The construct validity of the RMET was tested by regressing it within a stepwise model that encompassed as predictors the abovementioned cognitive and behavioral measures, covarying for demographic and motor confounders. Receiver-operating characteristics analyses allowed exploring intrinsic and post-test properties of the RMET both in discriminating patients from HCs and in identifying patients with a defective SET-EA performance.ResultsThe RMET was solely predicted by the SET-EA and SET-IA. RMET scores showed high accuracy both in discriminating patients from HCs and in identifying patients with a defective SET-EA score, with adequate-to-optimal both intrinsic and post-test properties.DiscussionThe RMET is a convergently and divergently valid measure of affective social cognition in non-demented ALS patients, also featuring optimal intrinsic and post-test diagnostic properties in both case-control and case-finding scenarios. Although the use of possible worlds in semantics has been very fruitful and is now widely accepted, there is a puzzle about the standard definition of validity in possible-worlds semantics that has received little notice and virtually no comment. A sentence of an intensional language is typically said to be valid just in case it is true at every world under every model on every model structure of the language. Each model structure contains a set of possible worlds, and (...) models are defined relative to model structures, assigning truth-values to sentences at each world countenanced by the model structure. The puzzle is why more than one model structure is used in the definition of validity. There is presumably just one class of all possible worlds and just one model structure defined on this class that does correctly the things that model structures are supposed to do. (These include, but need not be limited to, specifying the set of individuals in each world as well as various accessibility relations between worlds.) Why not define validity simply as truth at every world under every model on this one model structure? What is the point of bringing in more model structures than just this one?

We investigate these questions in some detail and conclude that for many intensional languages the puzzle points to a genuine difficulty: the standard definition of validity is insufficiently motivated. We begin (Section 1) by showing that a plausible and natural account of validity for intensional languages can be based on a single model structure, and that validity so defined is analogous in important respects to the standard account of validity for extensional languages. We call this notion of validity "validity!", and in Section 2 we contrast it with the standard notion, which we call "validity2". Several attempts are made to discover a rationale for the almost universal acceptance of validity2, but in most of these attempts we come up empty-handed. So in Section 3 we investigate validity! for some intensional languages. Our investigation includes providing axiomatizations for several propositional and predicate logics, most of which are provably complete. The interplay of philosophical ambitions and technical reality have given birth to rich and interesting approaches to explain the oft-claimed special character of mathematical and logical knowledge. Two projects stand out both for their audacity and their innovativeness. These are logicism and proof-theoretic semantics. This dissertation contains three chapters exploring the limits of these two projects. In both cases I find the formal results offer a mixed blessing to the philosophical projects. Chapter 1. Is a logicist bound to the claim (...) that as a matter of analytic truth there is an actual infinity of objects? If Hume’s Principle is analytic then in the standard setting the answer appears to be yes. Hodes’s work pointed to a way out by offering a modal picture in which only a potential infinity was posited. However, this project was abandoned due to apparent failures of cross-world predication. I re-explore this idea and discover that in the setting of the potential infinite one can interpret first-order Peano arithmetic, but not second-order Peano arithmetic. I conclude that in order for the logicist to weaken the metaphysically loaded claim of necessary actual infinities, they must also weaken the mathematics they recover. Chapter 2. There have been several recent results bringing into focus the super-intuitionistic nature of most notions of proof-theoretic validity. But there has been very little work evaluating the consequences of these results. In this chapter, I explore the question of whether these results undermine the claim that proof-theoretic validity shows us which inferences follow from the meaning of the connectives when defined by their introduction rules. It is argued that the super-intuitionistic inferences are valid due to the correspondence between the treatment of the atomic formulas and more complex formulas. And so the goals of proof-theoretic validity are not undermined. Chapter 3. Prawitz (1971) conjectured that proof-theoretic validity offers a semantics for intuitionistic logic. This conjecture has recently been proven false by Piecha and Schroeder-Heister (2019). This chapter resolves one of the questions left open by this recent result by showing the extensional alignment of proof-theoretic validity and general inquisitive logic. General inquisitive logic is a generalisation of inquisitive semantics, a uniform semantics for questions and assertions. The chapter further defines a notion of quasi-proof-theoretic validity by restricting proof-theoretic validity to allow double negation elimination for atomic formulas and proves the extensional alignment of quasi-proof-theoretic validity and inquisitive logic.Abstract prepared by Will Stafford extracted partially from the dissertation. This dissertation explores conflicts between religion and medicine, cases in which cultural and religious beliefs motivate requests for inappropriate treatment or the cessation of treatment, requests that violate the standard of care. I call such requests M-requests (miracle or martyr requests). I argue that current approaches fail to accord proper respect to patients who make such requests. Sometimes they are too permissive, honoring M-requests when they should not; other times they are too strict. I propose a phronesis-based approach to decide (...) whether to honor an M-request or whether religious beliefs are medically valid. This approach is culturally sensitive, takes religious beliefs seriously, and holds them to a high ethical standard. This approach uses a principle of belief evaluation developed by Linda Zagzebski: The Principle of Rational Belief, which is founded upon Aristotelian virtue ethics. In addition to the Principle, I propose a concrete set of conditions to assist caregivers in clinical case evaluations. In the final chapters, I apply the phronesis-based approach to well-known adult cases such as the refusal of blood transfusions by Jehovah’s Witnesses and requests for continued (futile) care by Orthodox Jews at the end of life. Also, I consider cases involving children such as African female circumcision and cases of faith healing. I argue that The Principle of Rational Belief should define the threshold of the kinds of M-requests for children that can be honored, but I allow a lower threshold for M-requests made by competent adult patients. The purpose of this cross-sectional investigation was to examine the item characteristics, factor structure, reliability, convergent validity, and construct validity of the Psychobiosocial States in Physical Education (PBS-SPE) scale. In Study 1, a sample of 1,030 students (582 girls and 448 boys, 10 to 19-year-olds), drawn from middle or high schools, rated the intensity of the 20 items version of the PBS-SPE scale thinking about the feelings they had usually experienced in physical education classes. In Study 2, an (...) additional sample of 1,025 students (578 girls, 447 boys, 10 to 19-year-olds), rated the 16 items of the final version of the scale. Two subsamples also completed an affective-related measure (i.e., the Physical Activity Enjoyment Scale) and two motivation scales often used in the physical education domain (i.e., the Teacher-Initiated Motivational Climate in Physical Education Questionnaire and the Situational Motivation Scale). Exploratory structural equation modeling and confirmatory factor analyses of the data showed that a two-factor, 16-item solution (i.e., 8 pleasant/functional items and 8 unpleasant/dysfunctional items) of the PBS-SPE scale reached satisfactory fit indices. Multi-group comparisons provided support for measurement and structural invariance across samples, gender, and age. Convergent and construct validity was also upheld. Overall, the findings offer support for the use of a new instrument in the assessment of psychobiosocial states in physical education settings. (shrink)

Controlled elicitation of linguistic and psycholinguistic experimental data facilitate strong inferences about phonological, syntactic, semantic and pragmatic structures and functions, yet neglect the ecological validity of responses. Ecological validity in this paper refers to whether data gathered under controlled conditions are commensurate with routine problem solving and language use in natural settings. All methods produce "white room" effects that compromise data gathering and analysis. Unexamined folk knowledge and experiences also guide the investigator s interpretation of data from field (...) research, laboratories, testing sessions, and target sentences. Story recall data from children in a combined second-third grade classroom and their narrative responses to cartoons without sound are used to illustrate ecological validity issues. The child's spontaneous, imaginative narratives about the story and cartoons resemble adult folk theory, and their semantic content reveal sociocultural knowledge essential for understanding subjects ' reasoning and information processing skills. This thesis challenges a general prejudice against visualization in the history of logic and mathematics, by providing a semantic analysis of two graphical representation systems--a traditional Venn diagram representation system and an extension of it. While Venn diagrams have been used to solve problems in set theory and to test the validity of syllogisms in logic, they have not been considered valid proofs but heuristic tools for finding valid formal proofs. ;I present Venn diagrams which have been used in (...) logic as a formal system of representation equipped with its own syntax and semantics. I also show that Venn-I, with the rules of transformation that I specify, is sound and complete. The soundness of Venn-I refutes a worry that mathematicians and logicians have about graphical representation: Fallacies often have arisen from the misuse of diagrams in mathematical proofs, especially in geometry. However, the validity of the transformation rules assures us that the correct application of these rules will not lead to fallacies. ;I extend Venn-I so that this new system has a general way to convey disjunctive information. A new formation rule is introduced and new transformation rules are added. I call this extended system Venn-II. The semantics of Venn-II is formalized as an extension of the semantics of Venn-I. The soundness and completeness of Venn-II are also proven. I then show that Venn-II and a monadic first-order language are equivalent in their expressiveness. ;The analysis of Venn-I and Venn-II leads to interesting issues which have their analogues in other deductive systems. I conclude the thesis with a discussion of some fundamental differences between graphical systems and linguistic systems. (shrink)

The prevention of sexual violence is a major goal of sexual health. In cases of accused sexual offenders, the assessment of diminished criminal responsibility of the accused is one of the most important procedures undertaken by experts in the German legal system. This assessment follows a two-stage method assessing first the severity of a paraphilic disorder and then second criteria for or against diminished capacity. The present study examines the predictive validity of two different sets of criteria for the (...) assessment of criminal responsibility in the context of paraphilic disorders combined with sexual offending. Two exemplary case vignettes of two suspected sexual offenders were developed to assess the criteria. For each participant, one of the two exemplary case vignettes was randomly presented. The presentation of the two different sets of criteria was also randomized, so that each participant was assigned only one of the two criteria sets to rate one of the presented cases. N = 349 participants from different professional backgrounds completed their assessments and were included in the data analysis. The data were evaluated using logistic regression. Results show that the more recently published criteria set predicts both the severity of the disorder as well as the diminished capacity twice as good as the older criteria set of Boetticher et al. currently used regularly for forensic court reports. In preliminary conclusion, the new criteria of Briken and Müller form an empirically based assessment of criminal responsibility. However, the proposed criteria cannot replace an extensive exploration of the accused person and a careful file analysis. Validity and reliability of the results are also limited due to the methodical choice of a vignette study. (shrink)

The author investigates how the conception of legal validity as a specific mode of existence, adopted by Kelsen in Allgemeine Theorie der Normen (General Theory of Norms), can be reconciled with a conception of the legal system in which conflicts of legal norms remain of logical concern. To this end he makes use of Ludwig Wittgenstein's picture theory of the proposition as set out in the Tractatus Logico-Philosophicus. The conclusion is that in order to reconcile the two conceptions, the (...) legal system itself must be conceived of as consisting of three sub-systems, namely, (i) a sub-system of perceptible legal judgments, (ii) a sub-system of valid legal conditions, and (iii) a sub-system of observable social practices.
