RESUMO Hans Jonas na obra O Princípio Responsabilidade: ensaio de uma ética para a civilização tecnológica (2006 [1979]) apresenta o diagnóstico de uma civilização debilitada e perecível, constantemente ameaçada pelos poderes do homem tecnológico. De posse desta análise, constrói uma proposta no sentido de novas fundações para o edifício ético a partir de uma responsabilidade. Jonas constata o caráter antropocêntrico de uma ética que não abrangia as consequências dos impactos oriundas da ação humana sobre o homem e a vida na (...) biosfera. Em seu ideário filosófico sobre a civilização tecnológica, estende as atitudes dos homens para além do agir próximo, reconhecendo um direito próprio da natureza. A recolocação conceitual da natureza, dotada de finalidade própria, expressa que o poder tecnológico promove os desafios morais da contemporaneidade, visto que há a possibilidade certa (causas) e incerta (consequências) de os efeitos acumulativos desta mesma tecnologia pôr em perigo a continuidade futura da vida sobre o planeta. O imperativo da responsabilidade resulta do poder do homem contemporâneo sobre si e sobre o planeta. Caracteriza-se por ser uma responsabilidade perante a natureza e perante o próprio homem. A concepção de responsabilidade em Jonas está em conformidade com uma nova exigência axiológica. É uma responsabilidade que se firma com a preservação da vida em um futuro distante e com a continuidade da vida tal como conhecemos. O que justifica um pretenso biocentrismo no princípio responsabilidade é o fato de que a continuidade da existência gera uma obrigação com a vida, porque dizer sim a ela é ser. O grande objetivo de uma nova abordagem biocêntrica, como o imperativo de Jonas, é de manter a existência da humanidade futura, em um futuro que existam candidatos a um universo moral em um mundo concreto – o autêntico objetivo da responsabilidade.: Hans Jonas in the book The imperative of the responsibility: in search of an ethics for the technological age (2006 [1979]) presents a diagnosis of a civilization weakened and perish, constantly threatened by the powers of technological man. Armed with this analysis, a proposal to build new foundations for the building from an ethical responsibility. Jonas notes the character of an anthropocentric ethic that did not cover the consequences of impacts arising from human action on man and life in the biosphere. In his philosophical ideas on the technological civilization extends men's attitudes beyond the next act, recognizing an inherent right of nature. The replacement of the conceptual nature, with its own purpose, expressed that technological power promote the moral challenges of contemporary times, since there is a certain possibility (causes) and uncertain (consequences) of the cumulative effects of this same technology to jeopardize the continued future life on the planet. The imperative of responsibility results from the power of modern man about himself and the planet. It is characterized by being a responsibility to nature and to the man himself. The conception of responsibility in Jonas is in accordance with a new demand axiological. It is a responsibility that is established with the preservation of life in the distant future and the continuity of life as we know. What justifies a purported biocentrism the principle responsibility is the fact that the continued existence creates a bond with life, because she is saying yes to be. The ultimate goal of a new approach biocentric, as the imperative of Jonas, is to maintain the existence of mankind in the future, a future in which there are candidates for a moral universe in a concrete world - the real goal of the responsibility. The United Nations Scientific, Education and Cultural Organisation (UNESCO) has commenced drafting a Universal Bioethics Declaration. Some in the relevant UNESCO drafting committee have previously desired to restrict its content to general principles concerning the application (but not necessarily the goals) of science and technology. As potentially a crucial agenda-setting statement of global bioethics, however, it is arguably important the Universal Bioethics Declaration transparently address major bioethical dilemmas in the field of public health, such as universal access to affordable, essential (...) medicines. Article 13 (Social Responsibility) of the Preliminary Draft Universal Bioethics Declaration states: ‘Any decision or practice shall ensure that progress in science and technology contributes, wherever possible, to the common good, including the achievement of goals such as: (i) access to quality health care and essential medicines, including for reproductive health and the health of children.’Cost effectiveness pricing systems, such as that most notably used in Australia’s Pharmaceutical Benefits Scheme (PBS), arguably represent one of the most scientifically effective mechanisms whereby public monies may be utilised to assist in the provision of medicines for the common good. They contain two essential elements: first, a process of scientific evaluation of objectively demonstrated therapeutic significance, and then, a fiscal lever (the government reimbursement price) attached to that evaluation.It is now well established that the US Pharmaceutical Research and Manufacturers Association (Pharma), through the assistance of the US Trade Representative (USTR), saw the Australia United States Free Trade Agreement (AUSFTA) as an opportunity to fulfill a legislative mandate to ‘eliminate ’ the cost-effectiveness pricing system in Australia’s PBS. One of the most remarkable features of the arguments raised against the PBS in this context was the fact that they made almost no reference to the normative discourse of bioethics or international human rights. Provisions such as Article 13 in UNESCO’s Universal Bioethics Declaration, although they will create no immediate obligations under international law, may play an extremely valuable role in legitimising the use of bioethical and human rights concepts in access to medicines debates surrounding multilateral and bilateral international trade deals such as the AUSFTA. The aim of this paper is to present a version of the principle of alternate possibilities which is not susceptible to the Frankfurt-style counter-example. I argue that PAP does not need to be endorsed as a necessary condition for moral responsibility and, in fact, presenting PAP as a sufficient condition maintains its usefulness as a maxim for moral accountability whilst avoiding Frankfurt-style counter-examples. In addition, I provide a further sufficient condition for moral responsibility – the twin world (...) condition – and argue that this provides a means of justifying why the protagonist in Frankfurt-style scenarios is still felt to be morally responsible. I conclude with the claim that neither the amended PAP nor the twin world condition is necessary for the ascription of moral responsibility; rather, what is necessary is simply that one of these conditions is satisfied. In this chapter we first discuss the main principles of justice and note the standard objections to them, which we believe necessitate a hybrid approach. The hybrid account we defend is primarily based on the distributive principle of sufficientarianism, which we interpret as the idea that each country should have the means to provide a minimally decent quality of life for each of its citizens. We argue that sufficientarian considerations give good reason to think that what we call the (...) ‘ability to pay objection’ should be taken much more seriously in this debate. Following this, our account emphasises what we believe are the two most important moral desiderata in any attempt to distribute responsibility for dealing with climate change: the ability to mitigate the problem and the making of culpable contributions to the problem. After noting that our proposal includes enough detail to be a useful start for policy makers, we defend our account against some potential objections. (shrink)

This article investigates the relationship among the weak Pareto principle, the strong Pareto principle, and positive responsiveness in the context of voting. First, it is shown that under a mild domain condition, if an anonymous and neutral collective choice rule (CCR) is complete and transitive, then the weak Pareto principle and the strong Pareto principle are equivalent. Next, it is shown that under another mild domain condition, if a neutral CCR is transitive, then the strong Pareto (...) principle and positive responsiveness are equivalent. By applying these results, we obtain a new characterization of the method of majority decision. (shrink)

In this paper I respond to Coren’s argument against my 2016 paper in which I present a case for the principle of alternate possibilities as sufficient but not necessary for the ascription of moral responsibility ). I concede that Coren has identified aspects of my original position that are vulnerable to counter-examples. Nevertheless, through a simple amendment to my original argument I am able to respond to these counter-examples without undermining the foundations on which my 2016 paper was (...) built. Moreover, it is my contention that the main challenge Coren presents to my original paper involves making explicit that which is already implied within PAP. Therefore, while I acknowledge that my argument for PAP requires further clarification, this can be achieved without undermining my original position. (shrink)

Responsible Research and Innovation (RRI) has emerged as a science policy framework that attempts to import broad social values into technological innovation processes whilst supporting institutional decision-making under conditions of uncertainty and ambiguity. When looking at RRI from a ‘principled’ perspective, we consider responsibility and justice to be important cornerstones of the framework. The main aim of this article is to suggest a method of realising these principles through the application of a limited Rawlsian Difference Principle in the (...) distribution of public funds for research and innovation. There are reasons why the world's combined innovative capacity has spewed forth iPhones and space shuttles but not yet managed to produce clean energy or universal access to clean water. (Stilgoe 2013, xii) I derive great optimism from empathy's evolutionary antiquity. It makes it a robust trait that will develop in virtually every human being so that society can count on it and try to foster and grow it. It is a human universal. (de Waal 2009, 209) Responsible Research and Innovation (RRI) has emerged as a science policy framework that attempts to import broad social values into technological innovation processes whilst supporting institutional decision-making under conditions of uncertainty and ambiguity. In this respect, RRI re-focuses technological governance from standard debates on risks to discussions about the ethical stewardship of innovation. This is a radical step in Science & Technology (S&T) policy as it lifts the non-quantifiable concept of values into the driving seat of decision-making. The focus of innovation then goes beyond product considerations to include the processes and – importantly – the purposes of innovation (Owen et al. 2013, 34). Shared public values are seen as the cornerstone of the new RRI framework, while market mechanisms and risk-based regulations are of a secondary order. What are the values that could drive RRI? There are different approaches to the identification of public values. They can be located in democratically agreed processes and commitments (such as European Union treaties and policy statements) or they can be developed organically via public engagement processes. Both approaches have advantages and disadvantages. For instance, although constitutional values can be regarded as democratically legitimate, their application to specific technological fields can be difficult or ambiguous (Schroeder and Rerimassie 2015). On the other hand, public engagement can accurately reflect stakeholder values but is not necessarily free from bias and lobbyist agenda setting. We argue that if RRI is to be more successful in resolving policy dilemmas arising from poorly described and uncertain technological impacts, basic universal principles need to be evoked and applied. When looking at RRI from a ‘principled’ perspective, we consider responsibility and justice to be important cornerstones of the framework. One could describe them in the following manner: Research and innovation should be conducted responsibly. Publicly funded research and innovation should be focused fairly on socially beneficial targets. Research and innovation should promote and not hinder social justice. The main aim of this article is to suggest a method of realising these principles through the application of a limited Rawlsian Difference Principle in the distribution of public funds for research and innovation. This paper is in three parts. The first part discusses the above principles and introduces the Rawlsian Difference Principle. The second part identifies how RRI is currently applied by public funding bodies. The third part discusses the operationalisation of the Rawlsian Difference Principle in responsible funding decisions. (shrink)

Large-scale linkage of international clinical datasets could lead to unique insights into disease aetiology and facilitate treatment evaluation and drug development. Hereto, multi-stakeholder consortia are currently designing several disease-specific translational research platforms to enable international health data sharing. Despite the recent adoption of the EU General Data Protection Regulation, the procedures for how to govern responsible data sharing in such projects are not at all spelled out yet. In search of a first, basic outline of an ethical governance framework, we (...) set out to explore relevant ethical principles and norms. We performed a systematic review of literature and ethical guidelines for principles and norms pertaining to data sharing for international health research. We observed an abundance of principles and norms with considerable convergence at the aggregate level of four overarching themes: societal benefits and value; distribution of risks, benefits and burdens; respect for individuals and groups; and public trust and engagement. However, at the level of principles and norms we identified substantial variation in the phrasing and level of detail, the number and content of norms considered necessary to protect a principle, and the contextual approaches in which principles and norms are used. While providing some helpful leads for further work on a coherent governance framework for data sharing, the current collection of principles and norms prompts important questions about how to streamline terminology regarding de-identification and how to harmonise the identified principles and norms into a coherent governance framework that promotes data sharing while securing public trust. In this paper I analyze a view that is increasingly spreading among philosophers and even physicians. Many of them believe that it is right to apply the principle of responsibility for illness in the allocation of health care. I attempt to show that this idea is unacceptable.

ABSTRACT:The purpose of this paper is to formulate and defend a set of moral principles applicable to management. Our motivation is twofold: 1) to increase the coherence and utility of Integrative Social Contracts Theory (ISCT); and 2) to initiate an alternative stream of business ethics research. To those ends, we specify what counts as adequate guidance in navigating the ethical terrain of business. In doing so, a key element of ISCT, Substantive Hypernorms, is found to be flawed beyond repair. So (...) we propose and defend a remedy:prima faciemoral principles. This paper concerns the question of whether Pauli's Exclusion Principle (EP) vindicates the contingent truth of Leibniz's Principle of the Identity of Indiscernibles (PII) for fermions as H. Weyl first suggested with the nomenclature ‘Pauli–Leibniz principle’. This claim has been challenged by a time-honoured argument, originally due to H. Margenau and further articulated and champione by other authors. According to this argument, the Exclusion Principle—far from vindicating Leibniz's principle—would refute it, since the same reduced state, (...) viz. an improper mixture, can be assigned as a separate state to each fermion of a composite system in antisymmetric state. As a result, the two fermions do have the same monadic state-dependent properties and hence are indiscernibles. PII would then be refuted in its strong version (viz. for monadic properties). I shall argue that a misleading assumption underlies Margenau's argument: in the case of two fermions in antisymmetric state, no separate states should be invoked since the states of the two particles are entangled and the improper mixture—assigned to each fermion by reduction—cannot be taken as an ontologically separate state nor consequently as encoding monadic properties. I shall then conclude that the notion of monadic properties together with the strong version of PII are inapplicable to fermions in antisymmetric state and this undercuts Margenau's argument. The tragic crash of Air New Zealand's flight TE-901 into Mt. Erebus in Antarctica provides a fascinating case for the exploration of the notion of corporate moral responsibility. A principle of accountability that has Aristotelian roots and is significantly different from the usual strict intentional action principles is examined and defined. That principle maintains that a person can be held morally accountable for previous non-intentional behavior that has harmful effects if the person does not take corrective measures (...) to adjust his ways of behavior so as not to produce repetitions. The first issue of Business Ethics Quarterly was launched in 1991. At that time there were few general principles that could serve as guidelines for global business. However, since 1991 a plethora of such principles have been developed to serve as guidelines and evaluative mechanisms for global corporate responsibilities. But operationalizing these principles in practice has been a challenge for most transnational corporations and even for smaller, more local enterprises. This is because, in some cases, the principles ask too much (...) of companies. In other cases, the principles are ambiguous. And in still other cases,the principles, written by and large from a Western, rights-based perspective, cannot be operationalized in some cultural or religious settings. In this paper I will outline a series of dilemmas multinational enterprises face in the global market place, even when they sincerely sign on to one or another set of principles. These problems are not insurmountable, but in the imperfect world of commerce, require that our expectations of corporate responsibilities be satisficing rather than absolutist. (shrink)

abstract This article briefly examines Onora O'Neill's account of the relation between normative principles and practical ethical problems with an eye to suggesting that philosophers of practical ethics have reason to adopt fairly high moral ambitions to be edifying and instructive both as educators and as advisors on public policy debates.

According to the principle of alternate possibilities (PAP), a person is morally responsible for an action only if he could have done otherwise. PAP underlies a familiar argument for the incompatibility of moral responsibility with determinism. I argue that Harry Frankfurt's famous argument against PAP is unsuccessful if PAP is interpreted as a principle about blameworthiness. My argument turns on the maxim that "ought implies can" as well as a "finely-nuanced" view of the object of blame. To (...) reject PAP on the blameworthiness interpretation, we must reject either this maxim or the finely-nuanced view or some other apparently innocuous assumption. (shrink)

Many now accept that Frankfurt-style cases refute the principle of alternative possibilities (PAP). But, in this paper I argue that even if Frankfurt-style cases refute PAP they do not refute a related principle: the principle of avoidable blame (PAB). My argument develops from the observation that an agent in a Frankfurt-style case can be aware of the nature of their situation without this undermining their moral responsibility. I then argue that PAB captures all that is important (...) about PAP such that the refutation of PAP is of no concern as long as PAB survives. (shrink)

The term ‘responsible AI’ has been coined to denote AI that is fair and non-biased, transparent and explainable, secure and safe, privacy-proof, accountable, and to the benefit of mankind. Since 2016, a great many organizations have pledged allegiance to such principles. Amongst them are 24 AI companies that did so by posting a commitment of the kind on their website and/or by joining the ‘Partnership on AI’. By means of a comprehensive web search, two questions are addressed by this study: (...) Did the signatory companies actually try to implement these principles in practice, and if so, how? What are their views on the role of other societal actors in steering AI towards the stated principles? It is concluded that some three of the largest amongst them have carried out valuable steps towards implementation, in particular by developing and open sourcing new software tools. To them, charges of mere ‘ethics washing’ do not apply. Moreover, some 10 companies from both the USA and Europe have publicly endorsed the position that apart from self-regulation, AI is in urgent need of governmental regulation. They mostly advocate focussing regulation on high-risk applications of AI, a policy which to them represents the sensible middle course between laissez-faire on the one hand and outright bans on technologies on the other. The future shaping of standards, ethical codes, and laws as a result of these regulatory efforts remains, of course, to be determined. (shrink)

Distribution of responsibility is one of the main focus areas in discussions about climate change ethics. Most of these discussions deal with the distribution of responsibility for climate change mitigation at the international level. The aim of this paper is to investigate if and how these principles can be used to inform the search for a fair distribution of responsibility for climate change adaptation on the local level. We found that the most influential distribution principles on the (...) international level were in turn built on one or more of seven basic principles: (P1) equal shares, (P2) desert, (P3) beneficiary pays, (P4) ability, (P5) self-help, (P6) limited responsibility for the worst off, and (P7) status quo preservation. It was found that all the basic principles, but P1, P3, and P7, are to some extent translatable to local climate adaptation. Two major problems hamper their usefulness on the local level: (1) several categories of agents need to take on responsibility; and (2) emissions do not work as a base for all principles. P4, P5, and P6 are applicable to local adaptation without changes. P4 is of particular importance as it seems to solve the first problem. P2 is applicable only if the second problem is solved, which can be achieved by using risk of harm instead of emissions as the basis for desert. (shrink)

Patricia Churchland's Neurophilosophy argues for Eliminative Materialism, but it is vulnerable to criticism under the following heads: (1) It fails to offer a satisfactory account of the subjective quality of experience, and misinterprets arguments by Nagel and Jackson on subjectivity. (2) Its treatment of intentionality results in a most implausible denial of the immediate ?aboutness? of thoughts, and the view of the mental as essentially what it is interpreted to be cannot be sustained. (3) The attempt to counter the argument (...) that logical relations between the content of mental states cannot be reduced to causal relations obtaining at the level of neurobiology is unsuccessful. (4) The view that the prepositional attitudes of common?sense psychology are seriously flawed is not made out, and the claims that ?folk? psychology constitutes a theory, and one which could and ought to be eliminated, are both self?defeating. Although providing aid in conflict is implicitly political, involving humanitarian actors and aid in conflict resolution initiatives, as Weiss advocates, risks diluting the primary responsibility of humanitarian aid to alleviate suffering.

There appears to be a growing disquiet amongst academics surrounding the ascendancy of 'responsible' investment that is egoist or self-interested in character — 'business case' responsible investment. This ascendancy has in no small measure been associated with the uptake of United Nations Principles for Responsible Investment (PRI) as a de facto standard for mainstream responsible investment. This article contributes to this disquiet. It does this by examining how egoist 'responsible' investors (as endorsed by the PRI) might have behaved had they (...) been around in the 1970s, 1980s and early 1990s during days of the anti-apartheid socially responsible investment (SRI) movement. Armed with near perfect (hindsight grade) enhanced analytics, it is clear that the signals that such egoist ' responsible' investors would have sent to company management in terms of the apartheid issue would have been highly muddled and therefore ineffective. The net conclusion is that there is nothing inherently or inevitably ' responsible' about egoist investment and that the aversion to behaving ethically amongst institutional investors must be challenged and not swept under a carpet of rhetoric. After briefly sketching common-morality principlism, as presented in Principles of Biomedical Ethics, this paper responds to two recent sets of challenges to this framework. The first challenge claims that medical ethics is autonomous and unique and thus not a form of, or justified or guided by, a common morality or by any external morality or moral theory. The second challenge denies that there is a common morality and insists that futile efforts to develop common-morality approaches to bioethics limit diversity and (...) prevent needed moral change. This paper argues that these two critiques fundamentally fail because they significantly misunderstand their target and because their proposed alternatives have major deficiencies and encounter insurmountable problems. Nanoparticles have multifaceted advantages in drug administration as vaccine delivery and hence hold promises for improving protection of farmed fish against diseases caused by pathogens. However, there are concerns that the benefits associated with distribution of nanoparticles may also be accompanied with risks to the environment and health. The complexity of the natural and social systems involved implies that the information acquired in quantified risk assessments may be inadequate for evidence-based decisions. One controversial strategy for dealing with this kind of (...) uncertainty is the precautionary principle. A few years ago, an UNESCO expert group suggested a new approach for implementation of the principle. Here we compare the UNESCO principle with earlier versions and explore the advantages and disadvantages by employing the UNESCO version to the use of PLGA nanoparticles for delivery of vaccines in aquaculture. Finally, we discuss whether a combined scientific and ethical analysis that involves the concept of responsibility will enable approaches that can provide a supplement to the precautionary principle as basis for decision-making in areas of scientific uncertainty, such as the application of nanoparticles in the vaccination of farmed fish. Responses to the COVID-19 pandemic have been widely criticized for being too delayed and indecisive. As a result, the precautionary principle has been endorsed, applauded, and proposed to guide future responses to global public health emergencies. Drawing from controversial issues in response to COVID-19, especially in Vietnam, this paper critically discusses some key ethical and legal issues of employing the precautionary principle in public health emergencies. Engaging with discussions concerning this principle, especially in environmental law where the (...) precautionary principle first appeared as a guiding principle with objective content(s), this paper formulates the precautionary principle as ‘in dubio pro salus’, which is about advising, justifying and demanding states to proactively prepare for scenarios arising out of any public health emergency. It distinguishes the precautionary principle into moderate and hard versions. A moderate version largely takes a holistic approach and fulfils a series of criteria specified in this paper, while a hard version either permits restrictive measures to be deployed primarily on a hypothetic basis or expresses an instrumental mentality. The hard version should be rejected because of the ethical and legal problems it raises, including risk-risk tradeoffs, internal paradoxes, unjustified causing of fear and unreasonable presupposition. Ultimately, this paper defends the moderate version. (shrink)
