Recently, the ethical rather than just the economic resonance of entrepreneurship has attracted attention with researchers highlighting entrepreneurship and ethics as interwoven processes of value creation and management. Recognising that traditional normative perspectives on ethics are limited in application in entrepreneurial contexts, this stream of research has theorised entrepreneurship and ethics as the pragmatic production of useful effects through the alignment of public—private values. In this article, we critique this view and use Kant's concept of reflective judgement as discussed (...) in his Critique of the Power of Judgement to theorise ethical entrepreneurial practice as the capacity to routinely break free from current conventions through the imaginative creation and use of self-legislating maxims. Through an analysis of the narratives of 12 entrepreneurs, we suggest there are three dimensions to reflective judgement in entrepreneurial contexts: (1) Social Performance; (2) Public Challenge and; (3) Personal Autonomy. Whilst the entrepreneurs were alive to the importance of commercial return, their narratives demonstrated further concern for, and commitment to, standards that they rationally and imaginatively felt as being appropriate. In our discussion, we integrate the findings into existing theoretical categories from entrepreneurship studies to better appreciate ethics within the context of value creation. (shrink)

This paper deals with forms of communication aiming at a better informed public or publics. The main idea is that democratic societies are dependent on toleration of a plurality of publics, and simultaneously there is a need for communication between the different publics. The ethos underlying this assumption is that democracy requires a transcendence of subjective conditions in order for the public(s) to gain legitimacy and recognition of opinions. Validity of opinions presupposes a public aspect that is available through communication. (...) More specifically, the validity in question is obtained through its claim on universality – i.e. the transcendence of purely private subjective conditions. This kind of validity is found in reflective judgment or enlarged thinking, as displayed in Kant’s third critique. In the last part of the paper it is discussed how new information technologies and the internet may contribute positively to facilitate modes of communication that are associated with the particularity at work in reflective thinking. Storytelling technologies and virtual realities are of particular interest in envisaging how this might work. (shrink)

The following paper seeks to examine whether, from the standpoint of a transcendental idealist, it is possible to have a phenomenology that can adequately disclose the nature and activity of person. First I establish that symbols are intuitive concretizations of the activity of person/Geist, and thus symbols are available to phenom- enological description. Then I raise the question of whether reflective judgment can be understood as a part of a possible phenomenology. I come to the conclusion that yes, (...) the process of reflective judgment is phenomenologically available; reflective judgment offers an experience of “what it is like to be a person”. However, it is clear that reflective judgment must borrow a rule from phenomenal/determinate experience in order to imaginatively analogize the transcendental creativity of person. Moral particularists and generalists alike have struggled over how to incorporate the role of moral salience in ethical reasoning. In this paper, I point to neglected resources in Kant to account for the role of moral salience in maxim formation: Kant's theory of reflective judgment. Kant tasks reflective judgment with picking out salient empirical particulars for formation into maxims, associating it with purposiveness, or intentional activity (action on ends). The unexpected resources in Kantian reflective (...) class='Hi'>judgment suggest the possibility of a particularist universalism, where recalcitrant particulars directly inform, and in some cases revise, moral principles. Such an account improves on particularist accounts of moral salience and moral perception: rather than deriving moral sensitivity solely from an agent's upbringing or cultural resources, the reflective dimension is situated alongside the universalist dimension of moral principles typically identified with Kantian ethics, allowing for a critical approach both to moral universals and to the reception of moral particulars. This article explores the role of reflective judgement in international relations through the lens of the Rwandan genocide in 1994. It argues that Hannah Arendt's writings on reflective judgement, and the dual perspectives of actor and spectator she articulates, offer us a set of conceptual tools with which to examine the failure of the international community to respond to the genocide as well as more broadly to understand the moral dilemmas posed by such crimes against humanity. Having identified (...) elements which form part of Arendt's concept of judgement, parallels in the case of Rwanda are found, drawing on both empirical evidence and recent interpretations of the genocide. The aim of this paper is to show that there is a genuine difficulty in Kant’s argument regarding the connection between mechanism and teleology. But this difficulty is not the one that is usually underlined. Far from consisting in a contradiction between the first and the third Critique, I argue that the genuine difficulty is intrinsic to the antinomy of reflective judgement: rather than having any hope of resolving anything, it consists in an inescapable conflict. In order to support (...) this claim, I show firstly why converting the thesis of the antinomy about mechanism into reflective judgement does not require renunciation of the universality of causality demonstrated in the first Critique. Then, I suggest that the actual difficulty with Kant’s argument is that there is a genuine conflict inherent in the reflective form of the antinomy. Finally, I examine in detail the antinomy of reflective judgement and compare it to the other Kantian antinomies in order to show that its uniqueness makes it uniquely troubling. This leads me to conclude that the Kantian resolution of the conflict between mechanism and teleology is unsatisfactory. (shrink)

In an effort to delineate a more plausible account of political change, this paper reads Pierre Bourdieu’s social theory as a corrective to exaggerated enthusiasm about the emancipatory force of reflection. This revised account valorizes both Bourdieu’s insights into the acquired, embodied, durable nature of the political habitus and judgment theorists’ trust in individuals’ reflection as a perpetual force of novelty and spontaneity in the public sphere of democratic societies. The main purpose of this exercise is to reveal the (...) mix of continuity and discontinuity that is characteristic of most transformations in the political common sense of democratic societies. In other words, this paper seeks to offer a more complex understanding of the inertial character of reflective judgment and of the difficulty of shifting the categories that define the political common sense. By cross-pollinating the ever-growing literature on reflective judgment and Bourdieu’s sombre theory of politics, we can better calibrate our expectations regarding the possibilities of significant democratic transformation in late capitalist societies. In this article, I develop an account of judgment that I term embodied reflective judgment, which implies that thinking and feeling are connected, entangled, and crucial for critical judgment. How we think about something can prompt an emotional response, and that response can prompt further reflection necessary for critical judgment. I clarify the relationship between thinking and feeling in judgment by foregrounding guilt feelings as a specific issue that individuals and political collectivities must deal (...) with to make embodied reflective judgment possible. I examine the relation between logic and nature in terms of ‘reflection’, the word that Hegel uses at the end of theEncyclopaedia Logicto describe the self-sundering or externalization of the idea into nature. Although nominally the term ‘reflection’ seems to denote a uniquely mental process and is often used so by Hegel in his early critique ofReflexionsphilosophie, in his later writings it also has an irreducibly ontological significance. Hegel describes logic's opening-out to nature as a movement of ‘reflection’ [Widerschein] and (...) he follows Kant in describing the shift from the finite to the infinite in the relation between nature and thought as one of reflective judgement. Although Hegel generally considers reflection to be uniquely concerned with finite cognition and the constitution of finite things, I argue that in his embrace of reflective judgement he sees a key role for reflection in the relation of logic, nature and spirit. Reflections on Little Rock is one of Hannah Arendt’s most controversial writings. Read from the perspective of the political philosopher, it appears even more contentious than her famous remarks in Eichmann in Jerusalem. In the last two decades, a number of critical contributions have been published addressing this essay, highlighting how it casts serious doubts on the correctness of Arendt’s dealing with the racial question and, more generally, on the tenability of central elements of her political thought – e.g., her (...) distinction between the political and the social. However, only occasional – and, as I will try to demonstrate, quite imprecise – analyses of the implications of RLR for an understanding of Arendt’s view of judgment have been produced. The aim of the present article is to reread what both Arendt’s position on judgment and its main contemporary reformulation, advanced by Linda Zerilli, imply for the making of political choices in pluralistic societies. The existing body of scholarship on Kant’s Critique of Judgment is rife with disagreement. At the centre of much of this disagreement is the issue of precisely what Kant understands to be taking place in a harmonization of the cognitive faculties. Is aesthetic reflective judgment to be identified with, or separated from, this harmonious state of the faculties of imagination and understanding? If aesthetic judgment is identified with this state, as is argued herein, then upon what (...) is a judgment of beauty to be based? These questions are addressed by focussing on two closely related aspects of Kant’s theory of reflective judgment; the role Kant assigns to the power of desire (i.e., to the will) and to the causal structure implicated in reflective judgment. In brief, we argue that a judgment of beauty is not, strictly speaking, something that I do, but is better described that something that happens of itself. (shrink)

In this paper, I relate values-based practice (VBP) to clinical judgment more generally. I consider what claim, aside from the fundamental difference of facts and values, lies at the heart of VBP. Rather than, for example, construing values as subjective, I argue that it is more helpful to construe VBP as committed to the uncodifiability of value judgments. It is a form of particularism rather than principlism, but this need not deny the reality of values. Seen in this light, (...) however, VBP is part of a broader conception of clinical judgment that can be compared with Kant’s conception of reflective judgment. This is a useful way of marking similarities between a number of issues raised in philosophy, which can inform a better understanding of clinical judgment. (shrink)

An influential strand in philosophy of science claims that scientific paradigms can be understood as relativized a priori frameworks. Here, Kant’s constitutive a priori principles are no longer held to establish conditions of possibility for knowledge which are unchanging and universally true, but are restricted only to a given scientific domain. Yet it is unclear how exactly a relativized a priori can be construed as both stable and dynamical, establishing foundations for current scientific claims while simultaneously making intelligible the transition (...) to a subsequent framework. In this article, I show that important resources for this problem have been overlooked in Kant’s theory of reflective judgement in the third Critique. I argue that Kant accorded the task of formulating new scientific laws to reflective judgement, which is charged with forming new ‘universals’ that guide the experience of nature. I show that this is the very task attributed to the relativized a priori: the constitution of a given conceptual framework, not of the conditions for object-reference as such. I conclude that Kant’s considered conception of science encompasses the operations of both reflective and determining judgement. Relativizations of the a priori should follow Kant’s lead. (shrink)

Kant’s concern for the universal validity of aesthetic judgment turns on its providing a needed bridge between our understanding of the world as governed by mechanical laws and our ability freely to realize our true humanity. That obliges us to find beauty in nature that is expressive of our ethical and moral values. It shapes the way we should understand aesthetic judgment itself.

THE FUNDAMENTAL QUESTION of the "Analytic of the Beautiful" in the "Critique of Aesthetic Judgment" is easy enough to identify. On what basis, if any, could one claim some sort of universal a priori validity for judgments of the form, "This is beautiful"? In Kant's well-known analysis of this question, the issue is reformulated as: By what right could one claim that another person ought (...) to feel pleasure in the presence of certain objects? Let us call this the "basic question."' There is controversy enough about what Kant means by this basic question and how a deduction of the validity of such judgments is supposed to work. However, shortly after Kant began serious work on a "Critique of Taste" in ~787, the whole issue became even more complicated when the proposed work became a full-blown Critique of Judgment. This essay explores the relation between worldly orientation and rational comprehension in Kant. Both require subjective grounds of differentiation that were eventually developed into a contextualizing principle for reflective judgement. This kind of judgement can proceed either inductively to find new universals or by analogy to symbolically link different objective spheres. I will argue that the basic orientational function of reflective judgement is to modally differentiate the formal horizonal contexts of field, territory, domain and habitat laid out in (...) the Introduction to theCritique of the Power of Judgement. This article builds on Arendt’s development of a Kantian politics from out of the conception of reflective judgment in the Critique of Judgment. Arendt looks to Kant’s analysis of the beautiful to explain how political thought can be conceived. And yet Arendt describes such Kantian reflection as an empirical undertaking that justifies itself only in relation to the abstract principle of the moral law. The problem for such an account is that the autonomy of the moral law (...) appears to be at odds with the social cohesion of Kantian political life. The ensuing contradiction can be deemed the antinomy of political judgment. Kant’s conception of reflective judgment offers such an inquiry considerably more to work with than Arendt uncovers. In particular, the regulative principle of the purposiveness of nature that is shown to direct all reflection can be seen to offer the solution to this antinomy. (shrink)

Bioethics faces two closely linked problems: though the concept of human dignity is widely acclaimed, it becomes highly controversial as soon as we try to define its content and meaning extension; we strongly need a method or theory of reasoning that allows us to determine the relation between moral principles and concrete cases. In a broader although strict philosophical sense these two problems of recent bioethics are related with Kant’s concepts of ‘Autonomy’ and ‘reflective judgement’, which can be combined (...) in view of a threefold logic of establishing rules. Such logic is anticipated in Montesquieu’s doctrine of the distribution of powers, since by defining and executing rules we also have to identify the cases of their application .Thus we can understand the relation between moral concepts or principles and facts or concrete cases as a dynamical relation constituting its moments, and therefore can comprehend human dignity rather as a ‘regulative idea’, then as a concept that has to be definitely defined. The legislative sense of law of Kant's first two Critiques shows what conditions must be met to assure that every constituent within an ideal context will be treated equally. The evaluative and judicial sense of law that relates to reflective judgment in the third Critique and can be carried forward to the philosophy of right has the more difficult task of reconciling conflicting interests that manifest themselves in more limited regional contexts.

Kant's “Religion Within the Boundaries of Mere Reason” seems an odd element in Kant's oeuvre. Parts of it seem like scholastic theology or an arbitrary effort to reconcile the Kantian philosophical system with the doctrines of Christianity1. One of the most troubling notions is that of radical evil. Not only is the motivation for introducing the notion unclear, it is also difficult to grasp the line of argumentation, and furthermore accept its conclusion that there must be an innate propensity for (...) evil in human nature. The vague introduction of the concept of grace exacerbates the puzzlement even further. Nevertheless, I claim that the notions of radical evil and grace form a significant addition to Kant's conception of moral life lacking in his earlier works in ethics, Groundwork to the Metaphysic of Morals and the Critique of Practical Reason. I contend that the depiction of human moral life is not exhausted by the consciousness of duty and the endless pursuit toward virtue. Moral life is characterized also by the ongoing introspection of character accompanied by the hope for moral transformation as manifested by the notions of radical evil and grace. (shrink)

With Arendt's insight regarding the need of judgment in the background, this paper pursues the ways in which the need for theory, or political philosophy, articulates Rawls' overall approach in order to tell just from unjust institutions. It suggests that the Kantian mould of reflective judgment gives form to the construction of a theory of justice via the mechanism of reflective equilibrium. The need for theory so devised has to constantly move between the demands of theory (...) itself — the social contract tradition as understood by Rawls — and the demands of action understood as the guide that our considered judgments lend to our understanding of the social world. Finally, it is also suggested that a particular grasp of the lessons of historical experience, as a way of fulfilling the need for theory that lies in the heart of the exercise of judgment, is what renders the Rawlsian proposal theoretically attractive, and what constantly underlies the construction of his theory via the particular exemplification and the theoretical rendering of the moral semantics underlying democratic culture. Currently fashionable among critics of enlightenment thought is the charge that Kant's ethics fails to provide an adequate account of character and its formation in moral and political life. G. Felicitas Munzel challenges this reading of Kant's thought, claiming not only that Kant has a very rich notion of moral character, but also that it is a conception of systematic importance for his thought, linking the formal moral with the critical, aesthetic, anthropological, and biological aspects of his philosophy. Munzel traces Kant's multifaceted definition of character through the broad range of his writings, and then explores the structure of character, its actual exercise in the world, and its cultivation. The relative indifference to Kant's interpretation of aesthetics and teleology can no doubt be accounted for in several ways. Partly, it is simply that the natural approach to Kant is to begin with the Prolegomena, and then depending on one's interests, to move directly to Kant's treatment of the problem of knowledge or ethical action--thereby leaving Kant's independent analysis of judgment for last, if at all. ABSTRACT The focus of this essay is Kant's argument in the Groundwork for the Metaphysics of Morals III that regarding oneself as rational implies regarding oneself as free. After setting out an interpretation of how the argument is meant to go, I argue that Kant fails to show that regarding oneself as free is incompatible with accepting universal causal determinism. However, I suggest that the argument succeeds in showing that regarding oneself as rational is inconsistent with accepting universal causal determinism (...) if one accepts a certain, plausible view of the explanation of events. This essay reconstructs the argument of Kritik der Urteilskraft §§76 –77 by placing it in the context of the “Critique of Teleological Judgment”. What role does the problematic and historically so successful figure of the intuitive understanding play in the antinomy of teleological judgment? The answer is considered indispensable to address the issue of the reception of §§76 – 77. The claim is that these sections institute the “closure” of transcendental philosophy—a closure fundamentally misunderstood by the post Kantians. (...) On the series of distinctions drawn to characterize the “peculiarity” of our human understanding and, by contrast, that of a non-human mind hinges the specific transcendental character of Kant’s philosophy. Once the condition that sustains those distinctions is abandoned transcendental philosophy is abandoned as well. (shrink)
