How can we register the participation of a range of elements, extending beyond the human subject, in the production of HIV events? In the context of proposals around biomedical prevention, there is a growing awareness of the need to find ways of responding to complexity, as everywhere new combinations of treatment, behavior, drugs, norms, meanings and devices are coming into encounter with one another, or are set to come into encounter with one another, with a range of unpredictable effects. In (...) this paper I consider the operation of various framing devices that attribute responsibility and causation with regard to HIV events. I propose that we need to sharpen our analytic focus on what these devices do, their performativity—that is, their full range of worldly implications and effects. My primary examples are the criminal law and the randomized control trial. I argue that these institutions operate as framing devices: They attribute responsibility for HIV events and externalize other elements and effects in the process. Drawing on recent work in science and technology studies as well as queer theory, I set out an analytic frame that marks out a new role for HIV social research. Attentiveness to the performative effects of these devices is crucial, I suggest, if we want better to address the global HIV epidemic. (shrink)

Smoke and Mirrors is a passionate, richly nuanced work that shows television as a circus, a wishing well, and a cure for loneliness. Ranging from Ed Sullivan to cyberspace, from kid shows to cable, and from the cheap thrills of "action adventure" to the solemn boredom of PBS pledge week, Leonard argues for a whole new way of thinking about television. For Leonard, the situation comedy is a socializing agency, the talk show is a legitimating agency, the made-for-television movie is (...) the last redoubt of social conscience, and television criticism itself is the last refuge of time-serving thugs and postmodernists. Instead of scapegoating television as the cause of crime in our streets, stupidity in our schools, and spectacle rather than substance in our government, Leonard sees something else inside the box: an echo chamber and a feedback loop, a medium neither wholly innocent of nor entirely responsible for the frantic disorder it brings into our homes. Long-standing theoretical education frameworks and methodologies have failed to provide space for the role mental health can play in mediating educational consequences. To illustrate the need for such space, Ebony McGee and David Stovall highlight the voices of black undergraduates they have served in the capacities of teacher, researcher, and mentor. Building from the theoretical contributions of intellectual giants like Frantz Fanon and W. E. B. Du Bois, the authors attempt to connect oppressive social systems to the psyche of the (...) oppressed in a way that is relevant to black students. McGee and Stovall pose a challenge to the current research trend of attributing the survival of black students at traditionally white institutions primarily to grit, perseverance, and mental toughness, noting that research on the aforementioned qualities often fails to properly acknowledge multiple forms of suffering. Utilizing the lens of Critical Race Theory, the authors also challenge the construct of grit to consider the extent to which the mental health concerns of black students go undetected. Although critical race theorists have unmasked and attacked the racial trauma experienced at all levels of the educational system, the connection of CRT to mental health and wellness research is in its embryonic stages. For these reasons, McGee and Stovall argue that CRT scholars need to incorporate praxis to address mental health and wellness in order to address a fuller spectrum of black students' racialized worlds. Ultimately, they seek interdisciplinary perspectives that can help identify and foster strategies to support black students in the project and process of healing from multiple forms of racialized trauma they experience within and beyond their educational encounters. Building on research conducted in feminist organizations in Vancouver, British Columbia, on the unceded territories of the xʷməθkʷəy̓əm (Musqueam), Sḵwx̱wú7mesh (Squamish), and səlilwətaɬ (Tsleil-Waututh) Nations, this paper explores the role, relationship, and responsibility of advocating for antiracism and social justice in the context of antiracism projects in feminist nonprofit organizations. In doing so this paper asks: What do antiracism projects look like in feminist organizations? And how are these projects informed or interrupted by racialized and Indigenous activists within these spaces? (...) Using critical race theory’s composite counterstory, this paper uses storytelling methodologies to understand how racialized settlers and Indigenous folks can collaborate and thrive – as they have been doing – on occupied unceded territories in Canada. Based on a series of interviews with racialized and Indigenous activists engaging in feminist nonprofit organizations, these stories shed light on contemporary realities of colonization, including collaboration within white settler systems. The paper uses the Neo-Kantian distinction between Natural and Human sciences and its methodological implications to navigate W. E. B. Du Bois’s and Alain L. Locke’s theories of race. In tracing a continuity between these two figures, the paper also shows how their respective reliance on Neo-Kantian categories leads them to different results. The goal is to show how, while Du Bois’s Neo-Kantianism is best understood as a Diltheyan Neo-Kantianism of the psycho-physical unity of human nature influenced by an (...) anti-metaphysical orientation, Locke’s Neo-Kantianism can be seen as a Neo-Kantianism whose focus is the rejection of causality and of the causal nexus between biological and non-biological traits. Despite the recent rise in articles by American philosophers willing to deal with race, the sophistication of American philosophy's conceptualizations of American racism continues to lag behind other liberal arts fields committed to similar endeavors. Rebecca Tuvel’s controversial “In Defense of Transracialism” has been criticized for a lack of engagement with critical race theory. Disengagement with salient material on race is a consistent feature of the philosophical conversation out of which it arises. In this article, I trace the origins of feminist philosophy’s disengaged and distorted view of “transracialism” and racial passing through the work of Janice Raymond, Christine Overall, and Cressida Heyes, and consider some of the relevant work on passing that (...) is omitted in the philosophy of “transracialism.” Finally, I offer methodological suggestions to avoid such distortions and omissions in feminist philosophy. In this paper, questions regarding the cultural understanding of mixed race are explored, which have the ability to complicate the accepted portrayal of race in society as a black/white binary system. Thus, the acknowledgement of something other than this binary system offers new ways of theorizing about race, particularly concerning the sociopolitical implications of mixed-race designation. This paper argues that the visually mixed-race person has a certain direct ability to challenge the binary and its racist (...) logic. The emergence of Critical Race Theory marked an important point in the history of racial politics in the legal academy and the broader conversation about race and racism in the United States. More recently, CRT has proven an important analytic tool in the field of education, offering critical perspectives on race, and the causes, consequences and manifestations of race, racism, inequity, and the dynamics of power and privilege in schooling. This groundbreaking anthology is the first (...) to pull together both the foundational writings in the field and more recent scholarship on the cultural and racial politics of schooling. A comprehensive introduction provides an overview of the history and tenets of CRT in education. In more than half of its states, the USA has recently passed or proposed legislation to limit or ban public educational curricular reference to race, gender, sexuality, or other identity topics. The stated justifications for these legislative moves are myriad, but they share a foundational claim; namely, these topics are asserted to be politically and socially divisive such that they ought not to be included within state-controlled schools. In this paper, we consider the claims of divisiveness regarding these topics (...) and explore whether, even if taken in good faith, the popular versions of these arguments and actions are epistemically defensible. We conclude that these bans are an epistemic injustice and therefore argue for their end. The article proceeds to consider the foundational claims of epistemic injustice, followed by the invocation of epistemic standards by which the arguments for these bans can be evaluated. The article then transitions to a close application of these standards, weighing the possible epistemic gains and losses. Before concluding, we consider objections and explore the social and epistemic significance of these issues. (shrink)

Liberalism is often claimed to be at odds with feminism and critical race theory (CRT). This article argues, to the contrary, that Rawlsian liberalism supports the central commitments of both. Section 1 argues that Rawlsian liberalism supports intersectional feminism. Section 2 argues that the same is true of CRT. Section 3 then uses Young’s ‘Five Faces of Oppression’—a classic work widely utilized in feminism and CRT to understand and contest many varieties of oppression—to illustrate how Rawlsian liberalism supports (...) diverse feminist and CRT projects, and why it may be critical to achieve solidarity between feminism, CRT, and Rawlsian liberalism. Kant is regarded as the spokesman of the contemporary declaration of human rights and the forerunner of global citizenship theory. However, this noble image has been questioned by critics for his comment of empirical racial hierarchy stated in the pre-critical period: Kant’s moral law applies only to the white race with the “full personality”. Around the question of whether Kant’s pure moral philosophy was impregnated by his racist view, the defenders of Kant either adopt the negative defense strategy (...) of affirming the transcendental moral philosophy and negating the racial thought, or try to justify the consistency of Kant’s theory from the perspective of his later philosophy of right. The deficiency of these two justifications is that they do not directly deal with the relationship between moral philosophy and race theory. When Kant developed a mature moral theory in the mid-1780s, he also constructed a systemically mature race theory under the guidance of teleology principles to defend the unity of mankind in a different world. This theory can be used as the explanatory basis to prove the universality of Kant’s moral philosophy, which reflects the deep correlation between moral philosophy and race theory. From this perspective, it can not only make up for the lack of defenders and respond to the critics’ doubts, but also portray a consistent egalitarian image of Kant. (shrink)

Critical Race Theory (C.R.T.) has developed out of a deep dissatisfaction that many black legal scholars in the U.S. felt with liberal civil rights discourse, a discourse premised upon the ideals of assimilation, ‘colour-blindness’ and integration. In addition, the emergence of the Critical Legal Studies movement provided Critical Race theorists with an innovative lexicon and practice which allowed them to develop a critique of traditional race analysis and U.S. law. Patricia Williams has played a key role (...) in the formation of the C.R.T. movement and is concerned with many of the C.R.T. themes: the understanding that traditional civil rights law has benefited whites more than blacks, the ‘call to context’, and the critique of liberalism by the assertion that racism is routine and not aberrational. Following the C.R.T. belief that form and substance are connected, Williams has also extended the boundaries of another C.R.T. theme by (largely) eschewing the conventional genre of legal writing in much of her work, including her two books, The Alchemy of Race and Rights and The Rooster's Egg. This was one of the issues Williams discussed in an interview that commenced when she visited Britain in 1997 to deliver the Reith Lectures. (shrink)

In this article, Barbara Applebaum examines “the inability to disagree claim” as it arises in objections made by those who want to ban “critical race theory” from being taught in schools and universities. Employing insights from the recent scholarship around willful hermeneutical ignorance, she discerns the important role that marginalized conceptual resources play in conditions of just and constructive dialogue. When such resources are misinterpreted and denied uptake, the resulting harm impedes the epistemic agency of marginally situated knowers. (...) This paper addresses the much-debated question about the fate of Kant's race theory in the 1790s by examining his use of the concepts of “germs” [Keime] and “predispositions” [Anlagen] in the Religion within the Bounds of Bare Reason of 1793. Following the well-received “anthropological interpretation” of the essay on radical evil that draws productive analogies with his philosophy of history, it proposes a “new anthropological interpretation” that focuses on concepts borrowed from his philosophy of race. Against those (...) who have argued that Kant changed his mind about his race theory in the 1790s, this interpretation of Religion shows that he continued to use its main concepts well into his late period, even introducing them into his moral philosophy for the first time. Ideal theory in social and political philosophy generally works to hide philosophical theories’ complicity in sustaining the structural violence and maintenance of white supremacy that are foundational to settler colonial societies. While non-ideal theory can provide a corrective to some of ideal theory’s intended omissions, it can also work to conceal the same systems of violence that ideal theory does, especially when framed primarily as a response to ideal theory. This article takes a decolonial approach (...) to exploring the limitations of non-ideal theory in its ability to respond to and redress the continuing harms done to Indigenous peoples by settler colonialism, including by outlining non-ideal theory’s relationship to a colonial politics of recognition. This paper examines the polemical nature of anti-racist education and discourse in America today. On one side of this issue are those who think of the efforts toward inclusion, diversity, and the pursuit of social justice in academia as serving positive ends. On the other side are those who oppose and vilify such efforts as evidence of the destructive ethos of liberal education. This has led to a situation where universities and schools across the country have seen professors and teachers, (...) including philosophers, experience backlash for speaking seriously and courageously about confronting the problem of racism in society. One recent example of this anomaly is the kind of faux outrage or moral panic that drives the hysteria against Critical Race Theory, an inquiry that examines the intersection of race and law in the United States, as well as unearthing the reality of structural racism in America, often disguised in the mainstream liberal approaches to racial justice. This faux moral panic has been used by legislatures across the country, as the raison d’être, to pass bans and enforce policies or rules that restricts how professors (including philosophers), and teachers can talk about race, systemic racism, structural oppression, or the problem of racial injustice in the classroom. In this paper, I explore how this polemical situation creates significant challenges and unique possibilities for the discourse of philosophy, especially for those who are interested in becoming antiracist philosophers, in the context of such legal rules and restrictions. Ideas of racial genetic determinism, though unsupported by scientific evidence and atavistic, are common and readily apparent in American medical education. These theories of biologic essentialism have documented negative effects in learners, including increased measures of racial prejudice.

This essay argues that Merleau-Ponty’s phenomenology of embodiment can be an extremely helpful ally for contemporary feminist theorists, critical race theorists, and disability studies scholars because his work suggests that the gender, race, and ability of bodies are not innate or fixed features of those bodies, much less corporeal indicators of physical, social, psychic, and even moral inferiority, but are themselves dynamic phenomena that have the potential to overturn accepted notions of normalcy, naturalness, and normativity. Taking seriously Merleau-Ponty’s (...) insistence that our bodies are the means by which we directly engage with the world, I suggest, encourages us to be attentive to how an individual’s or group’s gender, race, and bodily abilities differentially affect how their bodies are responded to by other bodies. The responses of others, in turn, directly influences the significance of an individual’s actions within that situation. This essay provides a critical examination of specific feminist philosophers, critical race scholars, and disability theorists who creatively utilize Merleau-Pontian insights to illustrate, and ultimately combat, the insidious ways in which sexism, racism, and “compulsory able-bodiedness”, impoverish the lived experience of both oppressors and the oppressed, largely by predetermining the meaning of their bodily interactions in accordance with institutionalized cultural expectations and norms. From Character to Color was written to explore Critical Race Theory from logical, moral, and educational standpoints, as these relate to history, people and racial groups.

Medical academics are increasingly bringing critical race theory (CRT) or its corollaries to their discourse, to their curricula, and to their analyses of health and medical treatment disparities. The author argues that this is an error. The author considers the history of CRT, its claims, and its current presence in the medical literature. He contends that CRT is inimical to usual academic modes of inquiry and has obscured rather than aided the analysis of social and medical treatment disparities. (...) Remedies for racism suggested by CRT advocates will not work and some of them will make things worse. Academic medicine should avoid the embrace of CRT and should maintain an allegiance to rigorous empirical inquiry and to treating patients not as essentialized ethnic group members but as individual human beings in need of care. In this paper, I argue that so called “systematic critiques” of the liberal conception of law in Catherine MacKinnon and Critical Race Theory which have traditionally been seen to reject liberalism should really be understood as subjecting the liberal conception of law as impartial and just to an immanent critique. Critical Race Theory and MacKinnon both seek to unmask the seemingly neutral subject which authorizes law as in reality a hegemonic and oppressive subject. They also employ (...) the tools of liberalism, demanding justice and equal protection under the law. I argue that the apparent contradiction of their demands can be understood by seeing the subject itself as combining these contradictions at the level of the relation between the unconscious and consciousness. The ego strives for rational self‐organization while the unconscious contains sedimented socially transmitted prejudice. There is thus room within both for the struggle for freedom and justice espoused by liberalism at the conscious level as well as for the unconscious perpetuation of prejudice and domination. I conclude that MacKinnon’s work and that of CRT show that liberalism must not be abandoned as post‐structuralism does, but that liberals is in fact aided by its critics. (shrink)

I once planned to write an essay detailing the advantages of a Deweyan approach to philosophical race theory. This essay would have developed my views in a way that highlighted their distinctly Deweyan resonances and debts. A recent essay by Ron Mallon gave me the opportunity to set this plan in motion, as Mallon’s reflections on social constructionism seemed likely to benefit from Deweyan insights. Unfortunately, or fortunately, setting to work on the project led to the distressing but (...) edifying realization that this plan carried with it certain risks, risks made particularly dire by the race-theoretic context. “The Influence of Dewey on Race Theory” will credit this background with an argument that unfolds in two intertwined registers. It will interrogate the impulse to work through Dewey, and it will use the lessons from this exercise—lessons, broadly, about parochialism and politics—as resources for critically engaging Mallon’s argument. Why is racism so tenacious? Drawing from recent methodological innovations in the study of racism, this essay explores the appeal of racism and the erotics of race within the imagination. The slippery nature of racism, and its ability to alter its manifestations with ease and hide behind various disavowals, facilitates the racialization of both religious thought and social institutions.

Derrick Bell’s work challenges the dichotomy that separates legitimate legal reasoning from “mere” fiction through hybrids that play across science fiction, Platonic dialogue, and autobiography. Despite its merits, I argue that Bell’s position reifies and strengthens, rather than deconstructs, structures of tyranny; it maintains the problematic rhetorical construction of United States race relations in terms of the black–white divide, either alienating, or leaving little or no room for other racial groups constructively to revise power and identity. In contrast, bell (...) hooks’, Mari Matsuda’s and Robert Chang’s work, though tentatively sketched, construes current race and gender relations in terms of a chiaroscuro of power, rather than a simple dichotomy. As scholars and researchers examine the material effects of NCLB, efforts to improve the educational system and its effects must also explore the relationship between policy and racial ideologies including discursive fantasies. Social commentators have long asked whether racial categories should be conserved or eliminated from our practices, discourse, institutions, and perhaps even private thoughts. In _A Theory of Race_, Joshua Glasgow argues that this set of choices unnecessarily presents us with too few options. Using both traditional philosophical tools and recent psychological research to investigate folk understandings of race, Glasgow argues that, as ordinarily conceived, race is an illusion. However, our pressing need to speak to and make sense (...) of social life requires that we employ something like racial discourse. These competing pressures, Glasgow maintains, ultimately require us to stop conceptualizing race as something biological, and instead understand it as an entirely social phenomenon. (shrink)
