Affectivity has become an operative concept for a variety of analyses of our everyday media-based public communications. However, it often remains unclear what affectivity is and how it can be used for analysing media-based public discussions. To clarify the role of affectivity in such analyses, I take a look back to the classical phenomenological analyses of affectivity provided by Edmund Husserl. I argue that based on Husserl’s analyses, affectivity is essentially a relation between the object and the affected (...) subject evoking responses in the subject. Accordingly, the role of affectivity in the opinion formation and other similar processes in media-based public discussions can be analysed as contingent sedimentations of the object’s such relations to the subject. As my analysis demonstrates, analyses of affectivity in the context of media-based communications do not capture their research object—affectivity—if affectivity is conceived as a feature of the media contents and not as a modality of experience. By analyzing the discussion on a health forum, we examine how wearing sanitary masks during the Covid-19 pandemic changed people’s lives and what adjustments were required. During our review, we encountered theories referred to by participants as “conspiracy theories” that led to heated exchanges on the forum. Surprisingly, these interactions promoted, rather than prevented, collective exploration and resulted in a rich discussion of the issues related to wearing masks. Using a combination of quantitative and qualitative methods, we first (...) analyze the dynamics of the discussion, its progression, and the conditions under which it was maintained over time, even given the radical expression of irreconcilable positions. Second, we examine the results of the discussion in terms of describing the problems triggered by the mask and the different authorities on which these descriptions were based. We conclude that the boundaries between science and non-science were occasionally blurred because of the wavering of scientific authorities and the uncertainty of the questions related to the pandemic, rather than because of a generalized distrust of science. We recognize that paradoxically, “conspiracist” theories contribute to the production of knowledge and that the adherence to these theories may stem more from the personal experiences of the individuals who profess them, rather than from the contaminating power of conspiracy theories. In this article we investigate the way modern democracies can deal with extremists in public discussion. The first part of the article conceptualizes political discussion insofar as it makes a contribution to the democratic process. We focus upon the democratic process as a way of dealing with conflicts between citizens that stem from differences in moral outlook. We reflect upon this process mainly in relation to its capacity to overcome possible political deadlocks, in the perspective of collective (...) decision making. In the second part we concentrate on the question of how public discussion in a modern democracy should look. Here, then, we take a similar perspective as Gutmann and Thompson (1996) in saying that we should try and define some central ‘rules of the game’ for public discussion. This study examines Wal-Mart representatives' presentation to the community on their site plan and Draft Environmental Impact Statement. Given the ongoing controversy and criticisms from local residents, it is interesting to see Wal-Mart's strategies in attenuating these risks and negative impacts. The discursive practices found here are: formulating prior citizen complaints by a neutral-sounding, legalistic language which works euphemistically or as a gloss. Citizen concerns are fitted into a problem-solution format where the solutions involve engineering technology. The Wal-Mart representatives display (...) their expertise through describing these technological answers. Scientific documents or tests are presented which point to counter-intuitive results. They draw on a discourse of `facts' and `information', but use these to make arguments in support of their proposals. In addition to displaying scientific-technological expertise, they avow openness to dialogue and willingness to work with the town. The Wal-Mart representatives present themselves as both technical experts and trustworthy partners, but they also may be seen as rhetor in using facts, findings, and documents to make an argument for their project. We propose the use of discussion structures as tools for analyzing policy debates in a way that enables the increased participation of lay stakeholders. Discussion structures are argumentation-theoretical tools that can be employed to tackle three barriers that separate lay stakeholders from policy debates: difficulty, magnitude, and complexity. We exemplify the use of these tools on a debate in research policy on the question of responsibility. By making use of discussion structures, we focus on the argumentative moves (...) performed by the parties involved in this debate. We conclude by discussing advantages and limitations of discussion structures and we trace several opportunities for further research on these instruments. (shrink)

Public concern over major agricultural product safety incidents, such as swine flu and avian flu, can intensify financial losses in the livestock and poultry industries. Crawler technology were applied to reviewed the Weibo social media discussions on the African Swine Fever incident in China that was reported on 3 August 2018, and used content analysis and network analysis to specifically examine the online public opinion network dissemination characteristics of verified individual users, institutional users and ordinary users. It was (...) found that: attention paid to topics related to “epidemic,” “treatment,” “effect” and “prevent” decrease in turn, with the interest in “prevent” increasing significantly when human infections were possible; verified individual users were most concerned about epidemic prevention and control and play a supervisory role, the greatest concern of institutional users and ordinary users were issues related to agricultural industry and agricultural products price fluctuations respectively; among institutional users, media was the main opinion leader, and among non-institutional users, elites from all walks of life, especially the food safety personnel acted as opinion leaders. Based on these findings, some policy suggestions are given: determine the nature of the risk to human health of the safety incident, stabilizing prices of relevant agricultural products, and giving play to the role of information dissemination of relevant institutions. Healthy eating policies have become a hot and thorny domain of public concern because they affect people’s liberties, life prospects, and public expenditures. However, what policies state institutions may legitimately enforce is a controversial matter. Is state paternalism for the sake of public health permissible? Could people be incentivized to eat in a healthier manner? Barnhill and Bonotti’s recent book tackle these issues in a manner that seeks to combine the liberal values of state neutrality and antipaternalism, (...) as well as the effectiveness and legitimacy of food policies. To do so, they rely on the accessibility model of public reason. Although Barnhill and Bonotti’s proposal fills an important gap in the field and the accessibility model of public reason overcomes some strictures of the Rawlsian account, their account of public reason faces some practical challenges. Indeed, the institutionalization of their framework seems to need the figure of a moderator of a deliberative panel. However, this figure would create a tension between the public reason framework and the common requirements of deliberative accounts. (shrink)

In Canada, there have been a growing number of criminal HIV nondisclosure cases where public health records have been subpoenaed to aid in police investigations and/or to be presented in court as evidence against HIV-positive persons. This has led some to suggest that nurses provide explicit warnings about the limits of confidentiality in relation to crimes related to HIV nondisclosure, while others maintain that a robust account of the limits of confidentiality will undermine the nurse–client relationship and the (...) class='Hi'>public health goals of reducing HIV/sexually transmitted infection transmission. This article engages with this issue by exploring whether and how public health nurses endeavor to control information about the limits of confidentiality at the outset of HIV posttest counseling. The data indicate variation in practices, as nurses pragmatically balance ethical and professional concerns; although some nurses intentionally withhold information about the risk of subpoena, others report talking to clients about confidentiality in ways that focus on the risk of harm associated with criminalization. The discussion argues that practice variation also illuminates medico-legal relations between health care and the criminal justice system. Data are drawn from qualitative interviews with 30 nurses working at four public health units in Ontario. (shrink)

What role, if any, should Confucianism play in the politics of our time? In some of my previous works, I claimed that modern liberal states are not permitted to promote Confucian values on the basis of their intrinsic merits. Yet, drawing insights from Joseph Chan’s moderate state perfectionism and John Rawls’s wide view of public political culture, I proposed the “wide view of moderate perfectionism.” According to this view, in public political discussion, citizens should be allowed to (...) deliberate whether and how Confucianism, among other reasonable moral doctrines, can make positive contributions to their social and political thinking and public policymaking, provided that certain conditions are met. This view has been criticized by some scholars, in particular Zhuoyao Li. Li argues that the practice of the wide view of moderate perfectionism would inevitably harm civility. In this article, I clarify and develop the wide view and respond to Li’s criticisms. (shrink)

ABSTRACT The paper explores the ethical aspects of introducing cultural circumcision of children into the EU public health system. We reject commonplace arguments against circumcision: considerations of good medical practice, justice, bodily integrity, autonomy and the analogy from female genital mutilation. From the unique structure of patient‐medicine interaction, we argue that the incorporation of cultural circumcision into EU public health services is a kind of medicalization, which does not fit the ethos of universal healthcare. However, we support a (...) utilitarian argument that finds hospital‐based circumcision safer than non‐medicalized alternatives. The argument concerning medicalization and the utilitarian argument both rely on preliminary empirical data, which depend on future validation. (shrink)

This book represents a considerable revision and expansion of Public Choice II. Six new chapters have been added, and several chapters from the previous edition have been extensively revised. The discussion of empirical work in public choice has been greatly expanded. As in the previous editions, all of the major topics of public choice are covered. These include: why the state exists, voting rules, federalism, the theory of clubs, two-party and multiparty electoral systems, rent seeking, bureaucracy, (...) interest groups, dictatorship, the size of government, voter participation, and political business cycles. Normative issues in public choice are also examined including a normative analysis of the simple majority rule, Bergson–Samuelson social welfare functions, the Arrow and Sen impossibility theorems, Rawls's social contract theory and the constitutional political economy of Buchanan and Tullock. In public philosophy, the question is how best to engage people with the fascinating yet complex mix of science and philosophy that underpins discussions of the good life. Reasoning about the good life implies adopting – consciously or not – a philosophy of life. For instance, the authors briefly compare three paths to the good life: Christianity (a religion), Stoicism (a philosophy), and Buddhism (which has both religious and philosophical strands). They discuss some of the issues that come up (...) when they engage in public philosophy about the good life by way of an in‐depth look at a particular example. Lastly, the authors explore a number of approaches to philosophical public discourse on these themes, based on their experiences as a public philosopher as well as on the published literature. Kant’s famous motto of enlightenment, “Sapere aude!”, is inseparably entwined with the demand for the “public use of reason”. There is no doubt that this also embraces the notion of a free and unrestricted exchange of ideas and indicates the potential beginning of a process in which “subjects” of the state and passive citizens are capable of developing into citizens of the world, and in which nation states are capable of developing into a kind of world community. This conception (...) of the public sphere also receives further concrete articulation in Kant’s Critique of Judgement, as Hannah Arendt already clearly recognized. In particular, the doctrine of reflective judgement, which is developed in that work, also allows us to derive several critical insights from Kant’s conception of enlightenment and the public sphere which are highly relevant to the contemporary intercultural discussion regarding the issue of the “Public Sphere”. Information posted by youth in online social media contexts is regularly accessed, downloaded, integrated, and analyzed by academic researchers. The practice raises significant social justice considerations for researchers including issues of representation and equitable distribution of risks and benefits. Use of this type of data for research purposes helps to ensure representation in research of the voices of youth who participate in these online contexts, at times discussing issues that are also under-represented. At the same time, youth whose data are (...) harvested are subject to the risks associated with this research, while receiving little if any direct benefit from the work. These risks include the potential loss of online social community as well as threats to participant rights and wellbeing. This paper explores the tension between the social justice benefit of representation and considerations that would suggest caution, the latter including inequitable distribution of research-related costs and benefits, and the traditional ethics concerns of participant autonomy and privacy in the context of youth participation in online discussions. In the final section, we propose guidelines and considerations for the conduct of online social media research to assist researchers to balance and respect representational and participant rights or wellbeing considerations, especially with youth. As many readers of Locke Studies are aware, the long-awaited publication of a scholarly edition of Locke’s published Abrégé and the transcription of an English “Epitome” of An Essay concerning Human Understanding (Essay) should be published in the near future. Both of these documents are tantalizing for aiding in the interpretation of the Essay because they are the author’s own efforts to clarify the argument and design of his great work prior to publication. This unique textbook utilizes an integrated, case-based approach to explore how the domains of bioethics, public health and the social sciences impact individual patients and populations. It provides a structured framework suitable for both educators (including course directors and others engaged in curricular design) and for medical and health professions students to use in classroom settings across a range of clinical areas and allied health professions and for independent study. The textbook opens with an introduction, describing the intersection of (...) ethics and public health in clinical practice and the six key themes that inform the book's core learning objectives, followed by a guide to using the book. It then presents 22 case studies that address a broad spectrum of patient populations, clinical settings, and disease pathologies. Each pair of cases shares a core concept in bioethics or public health, from community perspectives and end-of-life care to medical mistakes and stigma and marginalization. They engage learners in rigorous clinical and ethical reasoning by prompting readers to make choices based on available information and then providing additional information to challenge assumptions, simulating clinical decision-making. In addition to providing a unique, detailed clinical scenario, each case is presented in a consistent format, which includes learning objectives, questions and responses for self-directed learning, questions and responses for group discussion, references, and suggested further reading. All cases integrate the six themes of patient- and family-centered care; evidence-based practice; structural competency; biases in decision-making; cultural humility and awareness of the culture of medicine; and justice, social responsibility and advocacy. This chapter shows how public philosophy presents multifaceted opportunities for us not only to contemplate the ethics and politics of our food supply and food choices but also to act upon these reflections. It also discusses the role of philosophers in food activism and considers the more egalitarian possibilities of food in a post‐COVID‐19 world. Philosophy can be used to assess the ethics and power inequalities within the food industry. The aim is to expand “foodie culture” into an ethical (...) foodie culture while highlighting vegetarian restaurants and creating accessible vegetarian recipes. Food systems include animals, humans, and the ecosystem, which are embedded within neocolonialist practices of “former” colonial powers exercising economic and cultural dominion over formerly colonized nations. Food choice can be a form of activism for anyone but especially for women of color who bear the disproportionate brunt of the harms associated with the factory farming industry and climate change. The theme of this book is benchmarking in the public sector and part of the interest to analyze the importance that benchmarking has gained in the sector -as a tool for improvement and innovation of public management- where States commit efforts to achieve quality, efficiency and effectiveness in the services it provides. The study is exploratory and descriptive, employing a qualitative methodology that combines a bibliographic analysis for the elaboration of the theoretical framework and the definition of the (...) types and dimensions of benchmarking, with the identification and description of experiences from the empirical evidence surveyed. In a special chapter, the importance, scope and dimensions of benchmarking of product design (comparative evaluation of product design or industrial design) is discussed for the state assessment in design and development of new products for micro, small and medium producers. Our approach includes the different policies and actions to support Micro, Small and Medium Industries (MiPyMIs), which are undertaken from subnational states. RESUMEN. Proponents of public reason views hold that the exercise of political power ought to be acceptable to all reasonable citizens. This article elucidates the common structure shared by all public reason views, first by identifying a set of questions that all such views must answer and, second, by showing that the answers to these questions stand in a particular relationship to each other. In particular, we show that what we call the ‘rationale question’ is fundamental. This fact, and (...) the common structure more generally, are often overlooked or distorted within the literature. As a result, we argue, several prominent argumentative moves made by both critics and defenders of public reason are unsuccessful. Our overall conclusion is that discussions of public reason views would be more fruitful if they made consistent use of the common structure we identify. (shrink)

This chapter explores how what is dismissed as “trans activism” is often public philosophy. It considers how so‐called “public philosophy” on trans issues often does a substantially worse job of living up to the name. The chapter discusses how the dichotomy between “trans activism” and “public philosophy” provides a pretext for marginalizing trans voices. To draw on Black feminist philosophical thought, lived experience is a criterion for knowledge of the needs of marginalized people. Like other marginalized communities, (...) trans communities have encountered many areas in which hermeneutical liberation is needed. Public philosophy as trans activism is often systemically and systematically ignored or willfully misinterpreted as being biased and motivated by self‐interest, whereas anti‐trans (public) philosophy is seen as asking the important questions. Smith’s book Awaiting the King interrogates the religious nature of contemporary politics and the political nature of Christian practice, and in doing so draws Augustine out of the ivory tower to which many have confined him, putting the late-antique theologian into a conversation with a host of contemporary voices.

Within the domain of public health, vector-borne diseases are among the most vehemently discussed issues. Recent scientific breakthroughs in genome editing technology provided a solution to this issue in the form of a gene drive that might decrease and even eradicate vector-borne diseases. Gene drives are engineered, and designed genes that can break typical inheritance rules and be passed to almost all of the carrier’s offspring. This genome editing and gene drive technology has become a powerful tool for ecological (...) and environmental engineering, through which man can manipulate his surroundings, adjusting it to himself and directly mastering evolution and the ecosystem. Although the gene drive technology has been perceived as promising in the public health domain, ecological implications of its use are not to be underestimated. The primary aim of this paper is to overcome the ongoing discussion which mostly focuses on whether priority should be given to the environment or to public health, and to find an adequate answer and solution. In this quest to find the proper answer and solution, Pierre Teilhard de Chardin’s thought might be useful, especially his concepts of the biosphere and the noosphere which may provide some clarifications as to why we are at the moment so cautious with gene drive technology and how we need to move towards a better common future on earth. American intellectuals, artists, politicians, and activists have stressed the non-unitary, diversified, and oppositional dynamics of all things public. Public reason as a political ideal aims to reconcile reasonable disagreement; however, is public reason itself the object of reasonable disagreement? Jonathan Quong, David Estlund, Andrew Lister, and some other philosophers maintain that public reason is beyond reasonable disagreement. I argue this view is untenable. The idea of public reason is at the center of John Rawls's political philosophy. Public reason is a standard by which we measure laws and political institutions. This chapter discusses the practice of public reason, the moral basis of public reason, and the challenge posed by religious critics of public reason. It provides three possible answers to the question: What is the moral basis for endorsing this particular conception of democratic politics – public reason? (...) It is Rawlsian concept of justice – the ideal of a fair system of social cooperation between free and equal citizens – which provides the moral basis for public reason. In what way might public statues wrong people? In recent years, philosophers have drawn on speech act theory to answer this question by arguing that statues constitute harmful or disrespectful forms of speech. My aim in this paper will be add a different theoretical perspective to this discussion. I will argue that while the speech act approach provides a useful starting point for thinking about what is wrong with public statues, we can get a fuller understanding of (...) these wrongs by drawing on resources from recent work in situated affectivity. I will argue that public statues can be understood as affective artifacts and that this can both help us understand both the deep affective wrongs caused by public statues and offer a possible explanation as to why some people are so strongly opposed to their removal. Current technology and surveillance practices make behaviors traceable to persons in unprecedented ways. This causes a loss of anonymity and of many privacy measures relied on in the past. These de facto privacy losses are by many seen as problematic for individual psychology, intimate relations and democratic practices such as free speech and free assembly. I share most of these concerns but propose that an even more fundamental problem might be that our very ability to act as autonomous and purposive (...) agents relies on some degree of privacy, perhaps particularly as we act in public and semi-public spaces. I suggest that basic issues concerning action choices have been left largely unexplored, due to a series of problematic theoretical assumptions at the heart of privacy debates. One such assumption has to do with the influential conceptualization of privacy as pertaining to personal intimate facts belonging to a private sphere as opposed to a public sphere of public facts. As Helen Nissenbaum has pointed out, the notion of privacy in public sounds almost like an oxymoron given this traditional private-public dichotomy. I discuss her important attempt to defend privacy in public through her concept of ‘contextual integrity.’ Context is crucial, but Nissenbaum’s descriptive notion of existing norms seems to fall short of a solution. I here agree with Joel Reidenberg’s recent worries regarding any approach that relies on ‘reasonable expectations’ . The problem is that in many current contexts we have no such expectations. Our contexts have already lost their integrity, so to speak. By way of a functional and more biologically inspired account, I analyze the relational and contextual dynamics of both privacy needs and harms. Through an understanding of action choice as situated and options and capabilities as relational, a more consequence-oriented notion of privacy begins to appear. I suggest that privacy needs, harms and protections are relational. Privacy might have less to do with seclusion and absolute transactional control than hitherto thought. It might instead hinge on capacities to limit the social consequences of our actions through knowing and shaping our perceptible agency and social contexts of action. To act with intent we generally need the ability to conceal during exposure. If this analysis is correct then relational privacy is an important condition for autonomic purposive and responsible agency—particularly in public space. Overall, this chapter offers a first stab at a reconceptualization of our privacy needs as relational to contexts of action. In terms of ‘rights to privacy’ this means that we should expand our view from the regulation and protection of the information of individuals to questions of the kind of contexts we are creating. I am here particularly interested in what I call ‘unbounded contexts’, i.e. cases of context collapses, hidden audiences and even unknowable future agents. (shrink)

There are a number of important links and similarities between public health and safety. In this extended essay, Gregg D. Caruso defends and expands his public health-quarantine model, which is a non-retributive alternative for addressing criminal behavior that draws on the public health framework and prioritizes prevention and social justice. In developing his account, he explores the relationship between public health and safety, focusing on how social inequalities and systemic injustices affect health outcomes and crime rates, (...) how poverty affects brain development, how offenders often have pre-existing medical conditions (especially mental health issues), how involvement in the criminal justice system itself can lead to or worsen health and cognitive problems, how treatment and rehabilitation methods can best be employed to reduce recidivism and reintegrate offenders back into society, and how a public health approach could be successfully applied within the criminal justice system. Caruso's approach draws on research from the health sciences, social sciences, public policy, law, psychiatry, medical ethics, neuroscience, and philosophy, and he delivers a set of ethically defensible and practically workable proposals for implementing the public health-quarantine model. The essay begins by discussing recent empirical findings in psychology, neuroscience, and the social sciences that provide us with an increased understanding of the social and neurological determinants of health and criminal behavior. It then turns to Caruso's public health-quarantine model and argues that the model provides the most justified, humane, and effective approach for addressing criminal behavior. Caruso concludes by proposing a capability approach to social justice grounded in six key features of human well-being. He argues that we cannot successfully address concerns over public health and safety without simultaneously addressing issues of social justice—including the social determinants of health (SDH) and the social determinants of criminal behavior (SDCB)—and he recommends eight general policy proposals consistent with his model. Should we stop treating smokers who refuse to give up smoking? Should we put a tax on fatty foods and ban vending machines in schools to address the obesity epidemic? Should parents be required to have their children vaccinated? Are some of our screening programmes (...) unethical Downs syndrome screening, for example or should we be screening people for more conditions, such as Huntington disease? Such questions are at the heart of public health ethics. Holland shows that to understand and debate these issues requires philosophy: moral philosophies, such as utilitarianism and deontology, as well as political philosophies such as liberalism and communitarianism. And philosophy informs other aspects of public health, such as epidemiology and health promotion. The aim of this book is to provide a lively, accessible and philosophically informed introduction to such issues. It is an ideal textbook for students taking courses in public health ethics. Public health ethics, like the field of public health it addresses, traditionally has focused more on practice and particular cases than on theory, with the result that some concepts, methods, and boundaries remain largely undefined. This paper attempts to provide a rough conceptual map of the terrain of public health ethics. We begin by briefly defining public health and identifying general features of the field that are particularly relevant for a discussion of public health (...) ethics.Public health is primarily concerned with the health of the entire population, rather than the health of individuals. Its features include an emphasis on the promotion of health and the prevention of disease and disability; the collection and use of epidemiological data, population surveillance, and other forms of empirical quantitative assessment; a recognition of the multidimensional nature of the determinants of health; and a focus on the complex interactions of many factors—biological, behavioral, social, and environmental—in developing effective interventions. SummaryThis article offers a novel and comprehensive account of Walter Bagehot's political thought. It ties together an interpretation of Bagehot's liberal commitment to norms of discussion and deliberation, with an analysis of Bagehot's extensive arguments about the institutions of representative government. We show how Bagehot's opposition to American-style presidentialism, to parliamentary democracy, and to proportional representation were profoundly shaped by his conceptions of government by discussion, and the rule of public opinion. Bagehot's criticisms of English parliamentarianism, both (...) of its pre-1832 and post-1832 varieties were also motivated by those principles, as was his own proposal for parliamentary reform. By examining the whole range of Bagehot's writings on representative government and by connecting his institutional recommendations to his liberal principles, we are also able to better clarify Bagehot's position in Victorian political thought. The article concludes with a discussion of the debate leading up to the Second Reform Act, in which we elucidate Bagehot's disagreements with other prominent exponents of liberalism including John Stuart Mill, the “university liberals,” and Robert Lowe.
