The current state of Ukrainian society is characterized by socio-economic instability, there are dynamic, unique processes in which each person is involved. In this connection, there are increasing demands on the professionalism of specialists in the field of practical psychology, their philosophical counseling in the context of postmodernism, aimed at helping people become the subject of their life, work, social and value relationships, to teach them to find meanings and maximize self-actualization. This is represented in the change of priorities in (...) the professional development of practical psychologists, its focus on the development of specialists' subjectivity, their ability to independently solve professional and life tasks. An important role in enhancing the development of professionalism is the understanding of the essential characteristics of existential professional activity, expressed most often in professional meanings and values. The basis of a meaningful professional and personal life is the key ability of the practical psychologist to see and accept the needs of the profession and life and to find the most correct explanations for them. The purpose of the article is to investigate the importance and necessity of the activity of a practical psychologist, its peculiarities, the study of types of psychological aid: counseling, psychological rehabilitation, correction, psychotherapy, training, education and prevention; as well as the need to identify the main areas of professional activity of practical psychologists in the context of postmodernism. The study defines two main research areas of ideas about a rescuer psychologist. The first area is devoted to the issue of creating social representations about the specialist psychologist and his/her relations with representatives of other professional groups. The other area is represented by works focused on the direct analysis of the profession of psychologist, specific peculiarities of professional activity and personal characteristics of the psychologist. It is indicated that the study of the representations about rescuer psychologist’ (...) involves collective consciousness, and the main direction that allows to solve the reconstruction problem of idea about a rescuer psychologist in the system of categories and conceptual coordinates is psychosemantics. For this purpose, the method of associative experiment defines the basic constructs used by the population to evaluate the representation about a psychologist. The obtained words associations were used to develop a method of semantic scaling of the concept "Psychologist". The research has constructed the semantic profiles of perception of a civilian psychologist and a rescuer psychologist, their most pronounced characteristics were defined. With the help of multidimensional scaling the place of rescuer psychologist in psychosemantic space of psychologists of different kinds of activity was determined. Thus, the rescuer psychologist has the closest professional similarity with a military psychologist and forensic psychologist. According to the respondents' opinion, he/she mainly provides psychological correction and rehabilitation, he/she has to work in uncomfortable and dangerous conditions, and also to deal with both individual and group psychological problems. This article focuses on the problem of criminal liability for unlawful engagement in economic activities, analyses the emergence and development of this norm in criminal law and the ways of its optimal explanation. Special attention is paid to the problem of identification of illegality of activities, based on specific tax and economic regulation. The study concludes that criminal liability must be limited to a violation of fundamental requirements for the legality of business, and does not include particular abuses occurring in (...) legal business. The author also deals with the criteria of delimitation of criminal and administrative liability for unlawful engagement in economic activities. Under Article 202(1) of the Criminal Code of the Republic of Lithuania, application of criminal liability is limited by two alternative conditions: either a person illegally undertakes activity in entrepreneurial way or on a large scale. According to the paper, the above-mentioned regulation lacks clarity and leads to the risk of unfounded prosecutions. The author gives practical examples, where on the basis of inexplicable criterion of an entrepreneurial way, criminal charges are filed in respect of petty economic activities. Such practice is incompatible with the purposes and principles of criminal law. The paper proposes to delete the criterion of an entrepreneurial way from the definition, leaving the possibility of criminal liability only in case of large scale illegal economic activity. The article also substantiates the conclusion that prohibited business activities provided for in Article 202(2) of the Criminal Code actually defies logical explanation and should be removed from the regulation. At the end of the article, the author offers a sample of optimal legal wording of unlawful engagement in economic activities in criminal law. (shrink)

Based on the analysis of research literature, the content and functions of creative expression in musical and performing activities are revealed. It is characterized by the aesthetic nature of creative self-expression, internal harmony of will, emotional and intellectual intents of self-expression.

Since the idea of forbidden knowledge is rooted in the biblical story of Adam and Eve eating from the forbidden tree of knowledge, its meaning today, in particular as a metaphor for scientific knowledge, is not so obvious. We can and should ask questions about the autonomy of science.

Medical Genetics is a relatively new field of scientific work that involves a lot of enthusiastic professionals, both in routine (clinical) and research (scientific projects). In either field, different geneticists feel different responsibilities for their work, either because they are different people (personal responsibility) or because they have a different rank in the respective departments (professional responsibility). Aims: To describe individuals’ perceptions of the activities that take place within the cancer genetics clinic, the relationships between these activities and how these relationships are sustained. Design: Qualitative interview study. Participants: Forty individuals involved in carrying out cancer genetics research in either a clinical (n = 28) or research-only (n = 12) capacity in the UK. Findings: Interviewees perceive research and clinical practice in the subspecialty of cancer genetics as interdependent. The boundary between research and clinical practice is described (...) as vague or blurred, and this ambiguity is regarded as being sustained by a range of methodological, ethical and economic factors. The implications of these findings for the “therapeutic misconception” are explored. It is argued that while research participation is seen as having therapeutic benefit for individual patients, the interviewees are not labouring under any misconceptions about the relationship between research and clinical care. It is suggested that concepts such as the “therapeutic misconception” may have less relevance in highly technological specialities that are characterised by a developing evidence base. (shrink)

Bien que les approches basées sur les déficits soient encore prédominantes en formation à l’enseignement, on reconnaît de plus en plus l’apport potentiel des approches basées sur les forces, afin de développer une identité professionnelle positive. Conséquemment, nous avons expérimenté une activité innovante d’écriture réflexive, basée sur la psychologie positive, auprès de 50 stagiaires en enseignement préscolaire/primaire au Québec. L’analyse de ces empreintes offre de dégager divers aspects constitutifs de l’identité professionnelle des stagiaires, de décrire l’évolution du processus de construction (...) identitaire, ce qui permet d’apprécier la contribution de ce type d’activité pour rendre ce processus plus explicite. The scientific and technological development of modern society determines the need to monitor the innovative activities of universities, departments, and teaching staff. One of the leading factors influencing the formation of professional competencies of cadets studying at a military University is the innovative activity of departments. According to the authors of the article, the quality of training of future military specialists depends on this. The article reveals the aspects of creating conditions for creative self-development of cadets and their (...) active participation in round tables on scientific and technical topics at the Department of military higher education. It is concluded that the innovative activity of University departments has a great influence on the motivation of cadets to participate in scientific work under the guidance of the teaching staff, and also ensures the development of the intellectual potential of future military specialists. Euthanasia has once again become headline news in the UK, with the announcement by Dr Michael Irwin, a former medical director of the United Nations, that he has helped at least 50 people to die, including two between February and July 1997. He has been quoted as saying that his ‘conscience is clear’ and that the time has come to confront the issue of euthanasia. For the purposes of this article, the term ‘beneficent voluntary active euthanasia’ (BVAE) will be used: (...) beneficent from the prima facie principle of beneficence, to do good, and voluntary to indicate that this must be carried out at the request of a competent client. This implies adherence to another prima facie principle, that of respect for autonomy. Active implies that something is done or given with the intention of hastening death. The word euthanasia itself simply means ‘good death’. This article examines the moral positions of two nurses and one junior doctor towards the subject of BVAE and an attempt is made to represent the main conflicting moral positions. The central arguments against BVAE and counterarguments are presented. The conclusion reached is that consenting adults should not be prevented from availing themselves of BVAE if another consenting adult (a medical doctor) is available and capable of carrying out their wishes. This being the case, it is suggested that BVAE should be available as an option in hospices and in the community. The aims of this article are: to generate debate among professionals; to present a three-way discussion that might be useful as a focus for educational purposes, particularly at undergraduate level; to challenge professionals to confront the issue of euthanasia; and to plead the case of those who request assistance in exercising autonomy by gaining control over their own deaths. Transparency of textbook activities, i.e., the degree of easiness for teachers to process and comprehend them, needs to be researched in terms of both materials design and materials use. This article reports on a study that investigates the impact of teachers’ professional experience and transparency of textbook activities on teachers’ actual perception of the transparency of materials. The study adopted a mixed-methods design and collected quantitative data via a five-point scale survey from 115 secondary school teachers as well as (...) interview data from 15 informants. Data analysis reveals that both teachers’ professional experience and transparency of textbook activities affect the degree of easiness teachers perceived as they understand and interpret the activities for pedagogical purposes. However, discrepancy exists between transparency in materials design and transparency in teachers’ perception. Lack of pedagogical knowledge about the relationship between teaching objectives, steps, and assessment and strong existing cognitive schemata developed from the stereotype of processing a familar set of teaching materials might hamper teachers’ perception of transparency. The importance of professional competence lies in the effective application of job-oriented knowledge and skills which guarantee one’s successful adaptation to the work. This study analyzes the perception of the importance of physical activity and sports professionals’ competence in working with individuals with disabilities in Spain. As a descriptive quantitative study, face-to-face interviews were conducted through a survey to extract the data. The sample consisted of 214 PAS professionals working with people with disabilities. According to the results, the (...) analyzed constituents of professional competence are important for adequate performance, with the exception of competences of leadership and use of new technologies. It was also found that the perceived importance of each element of professional competence varies according to age, experience and training. Based on the obtained results, the degree of importance of each constituent of professional competence and its implication for the access of people with disabilities to high-quality physical activity and sports services was determined. This research focuses on dinner conversations in family-style group care. Children, who cannot live with their biological families anymore, are given shelter in these family-style group care settings. For the development of an attachment relationship between children and their Professional Foster Parents, it is important that the children feel that they are listened to in order to get an affective and intimate relationship with the parents. In this conversation-analytic research we analysed PFPs’ involvement in multiple activities simultaneously, namely listening (...) and eating, which is referred to as ‘multi-activity’. The analyses have shown systematic ways in which PFPs coordinate their involvement in the activities of ‘doing’ listening and eating, which are when parents avert their gaze from the telling child, they break the social rule which states that hearers need to look at speakers during the telling. We found that when averting their gaze, PFPs do head nods and linguistic means or positioning their bodies in the direction of the telling child. This research contributes to knowledge about interaction between adolescents and PFPs. It further contributes to knowledge about how human beings are able to coordinate multiple activities simultaneously. (shrink)

BackgroundEuthanasia is performed on occasion, even on newborns, but is highly controversial, and it is prohibited by law and condemned by medical ethics in most countries.AimTo characterise and compare the judgments of lay persons, nurses, and physicians of the acceptability of actively ending the life of a damaged newborn.MethodsConvenience samples of 237 lay persons, 214 nurses, and 76 physicians in the south of France rated the acceptability on a scale of 0–10 of giving a lethal injection in 54 scenarios composed (...) of all combinations of 4 within-subject factors: gestational age of 6,7, or 9 months; 3 levels of severity of either perinatal asphyxia or of genetic disease; attitude of the parents about prolonging care unknown, favourable, or unfavourable; and decision made individually by the physician or collectively by the medical team. Overall ratings were subjected to cluster analysis and each cluster to analysis of variance and graphic representation.ResultsLay persons (mean acceptability rating 4.29) were significantly more favourable to euthanasia than nurses (2.84), p<.005, or physicians (2.12), p<.005. Five clusters were found with different judgment rules, i.e., how the information was integrated. More physicians (30 per cent) than nurses (14 per cent), p<.01, or lay persons (11 percent), p<.01, rated euthanasia as never, under any condition, acceptable. Most, however, asserted that it was increasingly acceptable as the factors combined to favour it, especially when the parents desired to stop treatment. More physicians (45 per cent) and nurses (46 per cent) than lay persons (21 per cent), p<.01, used a complex conjunctive rule (level of parent’s attitude x level of severity of damage x consultation with team or not) rather than a simple additive rule.ConclusionsUnlike lawand medical ethics, most of the lay persons. nurses, and physicians judged the acceptability of euthanasia as a function of the circumstances. Most health professionals combined the factors in a conjunctive (multiplicative), rather than additive, fashion in accordance with legislation for adults in the Netherlands and elsewhere that requires a set of criteria to be fulfilled before it is legitimate to end apatient’s life. Professional autonomy is often described as a claim of professionalsthat has to serve primarily their own interests. However, it can also beseen as an element of a professional ideal that can function as astandard for professional, i.e. medical practice. This normativeunderstanding of the medical profession and professional autonomy facesthree threats today. 1) Internal erosion of professional autonomy due toa lack of internal quality control by the medical profession; 2)the increasing upward pressure on health care expenses (...) that calls for ahealth care policy that could imply limitations for the professionalautonomy of physicians; 3) a distorted understanding of theprofession as being based on a formal type of knowledge and relatedtechnology, in which other normative dimensions of medical practice areneglected and which frustrates meaningful communication betweenphysicians and patients. To answer these threats a normative structureanalysis of medical practice is presented, that indicates whichprinciples and norms are constitutive for medical practice. It isconcluded that professional autonomy, normatively understood, should bemaintained to avoid the lure of the technological imperative and toprotect patients against third parties' pressure to undertreatment.However, this professional autonomy can only be maintained if members ofthe profession subject their activities and decisions to a criticalevaluation by other members of the profession and by patients and ifthey continue to critically reflect on the values that regulate today'smedicine. There has been much controversy concerning the benefits of the certification (professionalization) of financial planners and the merits of various compensation systems; this study examined the controversy insofar as it concerned ethical orientation rather than competence issues. The study was delimited to financial planners practicing in the United States of America. It was found that Certified Financial Planner (CFP) designees manifested higher ethical orientation scores than non-designees. Fee-based planners manifested no significantly different ethical orientation scores as compared to their counterparts. (...) There was a time in the history of philosophy that the phrase “public philosophy” would have been redundant. In this chapter, the authors survey the debate about the professionalization and institutionalization of philosophy between Scott Soames and Robert Frodeman and Adam Briggle. They present an exploration of an example of how professional and non‐professional philosophers may benefit each other. The authors argue that nonprofessional philosophers (whom we might also call “outsider philosophers”) can offer new ways of looking at (...) the canon and broaden the subject matter of philosophy. They present a look forward to the future of interactions between professionalized and outsider philosophers. In an effort to make possible a future where such collaboration is normalized within the broader activity of philosophizing, the authors elucidate both the opportunities and challenges for collaboration. Recent scholarly and practitioner research on the work of non-governmental organizations has been concerned with questions about the moral legitimacy of humanitarian aid in settings of armed conflict. At issue is the extent to which NGO activities are said to affect the conduct and outcome of warfare, thereby potentially implicating humanitarian aid in the partisan interests which it has traditionally eschewed as a condition of its legitimacy. This paper explores how such issues are taken up in the explanations offered by (...) humanitarian aid operatives in descriptions of the work they carry out in settings of armed conflict. Drawing on a corpus of conversational material recorded in open-ended interviews with representatives of various NGOs that operate in Israel and the Occupied Palestinian Territories, I examine how speakers work to make themselves accountable to demands for sympathetic affiliation with the losing parties in the Palestinian-Israeli conflict while maintaining a non-aligned stance relative to the partisan considerations that animate that conflict’s conduct. Both in first-hand narrative accounts of personal transformation and in descriptions of contrastive examples where professional colleagues are said to maintain a too-sympathetic affiliation with the partisan concerns of the Palestinian population whose needs they service, speakers work to provide for the legitimacy of their professional activities in the context of otherwise conflicting demands for moral accountability. Since the nineteenth century, the debate around the process of professionalization of higher education has been characterized by two extreme positions. For some critics the process carries the risks of instrumentalizing knowledge and of leading the university to succumb under the demands of the market or the state; for other theorists it represents a concrete opportunity for the university to open up to the real needs of society and for reorienting theoretical and fragmented disciplines towards the resolution of concrete and (...) challenging problems. This article pursues three objectives. Firstly, we show that the debate is usefully informed not only by ideas of what a university is, but also by ideas of a profession. We suggest that both ideas help to overcome the conflict between the two afore-mentioned antagonist perspectives. Secondly, we demonstrate that a certain understanding of a profession can prevent the risk of viewing knowledge exclusively as scientific expertise and reducing training to the acquisition of technical skills. The position on professions adopted here is inspired by the Scottish philosopher Alasdair MacIntyre, whose work is instructive in understanding professions as “rational practical activities”, embedded in a social context with their own internal goods. Our third objective, therefore, is to argue, with MacIntyre, that the presence of professions within the university opens up the opportunity to rescue forms of rationality that are oriented towards action and, by implication, promotes spaces of training that are resistant to exclusively corporate or governmental interests and criteria of mere effectiveness. The purpose of this article is to outline a systematic answer to the question of collective autonomy, its conceptual nature and lmimits, and apply it by way of example to the case of the engineering profession.In the first section, it is argued that a professional activity involves systematic knowledge and proficiency, a form of continuous improvement of the related bodies of knowledge and proficiency, as well as two levels of understanding: a local one, which is the ability to (...) justify and explain professional acts, and a global one, which involves a conception of the whole profession and its ethical principles.The second section is devoted to a conceptual analysis of professional ethics. It is argued that it consists of a general conception of professionality, a particular conception of the profession under consideration, and a conception of the normative requirements made by the societal envelope of the professional activity, in particular basic norms of democracy.The third section draws conclusions with respect to the nature and limits of professional autonomy. It is shown that such autonomy is much more restricted than its apparent extent. Examples from engineering and other professions are provided. (shrink)

The cause of ethical failure in organisations often can be traced to their organisational culture and the failure on the part of the leadership to actively promote ethical ideals and practices. This is true of all types of organisations, including the professions, which in recent years have experienced ongoing ethical problems. The questions naturally arise: what sort of professional culture promotes ethical behaviour? How can it be implemented by a profession and engendered in the individual professional? The answers (...) to these questions are of interest to business ethicists since the causes of ethical problems in business are often the same and the professions, as ethically challenged organisations, make useful and informative analogues for the measures to be adopted or avoided when the attempt is made to raise the ethical standards of business.Given this focus on the professions, it will be argued that the usual, direct attempts to control unethical behaviour by using codes of ethics, legislation and self-regulatory regimes, are not successful. In the last several years, philosophical enthusiasm for applied professional ethics has spread from medicine to law, education, government, engineering, business, and to other professional and semiprofessional fields. Each involves an institutional structure within which professional practitioners provide specific services to those who seek them, and within which practitioner behavior in providing these services is regulated by both formal and informal institutional codes and conventions. Recent work in applied ethics has forced reinspection of these codes and conventions (...) and of the moral features of the professional practices they govern—from client confidentiality to the exchange of fees—and has revealed characteristic dilemmas and conflicts which are endemic to these areas of professional activity. Indeed, in some cases—for instance, in the de-paternalization of medicine—the inquiries of applied professional ethicists have begun to produce quite striking changes in professional practice itself. It arises from a specific professional work, its subject, methodology, and stylistic originality that allow to build ideal models of professional acting. Professional ethics lies at the intersection of the individual personal sphere, socially important results of professional activity and human values.

Communication occupies a key place in the professional activities of physical education instructors, who involve students in physical culture and health activities, create conditions for them to master the experience of such activities through the implementation of health-preserving technologies in the process of student-centered education. The aim of the research is to investigate the psychological and pedagogical peculiarities of professional and communicative competence formation in future physical education instructors in postmodern education. The research involved 32 students; it was (...) conducted in 2019-2021. Questionnaire survey of students was carried out according to the authors’ fact-finding questionnaire, aimed at studying the state of professional and communicative competences formedness in conformity with motivational, cognitive, behavioural, value-based, emotional-volitional criteria. The ascertaining stage of the experiment revealed insufficient level of professional and communicative competences formedness in the students according to the specified criteria. The formative stage of the experiment, which provided the creation of a communication-oriented educational environment for students, revealed an increase in the number of students with high and sufficient levels of professional and communicative competences formedness. An increase in the level of students’ mastering of theoretical knowledge in the field of physical education and sports to form professional and communicative competences during their study of mandatory and optional components of the educational program was also established. A high level of professional and communicative competences and theoretical knowledge of future physical education instructors, formed during their studies at a higher educational institution, will contribute to improving the efficiency of their future professional activities. The article deals with the systemic-synergetic aspects of personal security in the postmodern society. The theoretical concepts of the system genesis of the structural and functional organization of a person's professional safety have been improved according to the parameters of the sphere of professional functioning, the age range and labor conditions. The article proves that the performance of professional activities in special conditions is often combined with danger to health and life. Ensuring human life in special conditions (...) requires the use of the specialist's adaptive resources, which ensure the activation of the productive processes of activity and determine the construct of the professional health of the specialist's personality. The active involvement of the individual in the professional sphere is reflected in the manifestation of professional safety as a specific indicator of the safe functioning of the individual in the course of professionalization. Understanding the security of a person at the level of the subject of acquiring professional experience contains the experience of a state of social satisfaction, which ensures the protection of the professional interests of the individual, quantified in the parameters of satisfying the urgent need for professional realization in the complex of subjective and personal qualities. The formation of the education professional has been a top subject of studies during the history of education in Brazil and must be a human formation directly related to his or her emancipation as a social, individual person. This is his or her truth citizenship and sine qua non to the formation of a new man for the construction of a human culture. In this sense, the concept of man is the fundamental axis of formation of the education (...) class='Hi'>professional. Theoretical matrices that have given rise to individualism and its powerful concepts are analyzed, as well as the new dominant ideas that, in an explicit or implicit way, construct in our society by different forms of social consciousness. There is a firm conviction that the understanding of man as alive, active, and conscious in material existence, according to concrete life, looks as the formation of consensus, organic emancipating scientific fundamental of radial change in social relations on a global society and with the possibility of human culture. Objective:To describe the professional values of the nurse lectures according to 241 nursing students, who participated voluntarily, in three different universities of Bogotá.Methodology:This is a quantitative, descriptive cross-sectional study that applied the Nurses Professional Values Scale—permission secured—Spanish; three dimensions of values were applied: ethics, commitment, and professional knowledge.Ethical consideration:Project had ethical review and approval from an ethics committee and participants were given information sheets to read before they agreed to participate in the project.Findings:It was concluded that nursing (...) students, in general, do perceive these values in their professors, and they give priority to the dimension of ethics, followed by the knowledge dimension, and finally, commitment.Discussion:It is evident that professional values are transmitted by professors and students place importance to such values. Values related to the other’s care are paramount in nursing training in Colombia as well as in other countries.Conclusion:It was found that participating students observed professors directly in relation to values focused on direct patient care, respect for privacy, respect for life, while matters related to professional improvement, participation in unions were not actually analyzed may be due to poor promotion activities and unions during undergraduate studies. The results obtained are primary approach to the study of values related to nursing, a topic which needs to be researched, something vital to all the country offering nursing training programs. Most professionals have the arduous task of managing their own dual loyalty: in one contextual relationship, they are members of a profession while simultaneously they are employed as members of a locally established organisation. This sense of a dual loyalty has to be taken into account when professional bureaucracies develop ethics programmes. This article focuses on universities. Accounting for the dual loyalty of academic professionals, it is the objective of the study to contribute to the most appropriate ethics programmes (...) in such an academic context. Based on a review of the literature, we identify which ethical issues commonly emerge in educational and research activities. Then we offer a conceptual analysis of the conditions required for each different strategy of ethics management. We argue that none of the four theoretically derived strategies is applicable solely on its own. For universities it is most promising to design ethics programmes based on the guiding values of the academic community, including integrity measures for universities and corrective measures for students. The argument developed in this article is assumed to be widely applicable in assessing the appropriateness of ethics management strategies in other professional settings. (shrink)
