Despite great progress in our theoretical and empirical investigations of boredom, a basic issue regarding boredom remains unresolved: it is still unclear whether the construct of boredom is a unitary one or not. By surveying the relevant literature on boredom and arousal, the paper makes a case for the unity of the construct of boredom. It argues, first, that extant empirical findings do not support the heterogeneity of boredom, and, second, that a theoretically motivated and empirically grounded model of boredom (...) The goal of this paper is to provide an accurate grounding-based formulation of positivism in the philosophy of law. I start off by discussing some simple formulations, based on the ideas that social facts are always either full or partial grounds of legal facts. I then raise a number of objections against these definitions: the full grounding proposal rules out possibilities that are compatible with positivism; the partial grounding proposal fails, on its own, to vindicate the distinctive (...) role that is played by social facts within positivist accounts of law. Then, I present a more adequate and insightful formulation capable of solving their problems, which crucially relies on a robust notion of a social enabler. Finally, I model inclusive and exclusive positivism on the resulting template, and set out the advantages of the ground-enablers proposal. (shrink)

As a NP-hard problem that needs to be solved in real time, the dynamic task allocation problem of unmanned aerial vehicle swarm has gradually become a difficulty and hotspot in the current planning field. Aiming at the problems of poor real-time performance and low quality of the solution in the dynamic task allocation of heterogeneous UAV swarm in uncertain environment, this paper establishes a dynamic task allocation model that can meet the actual needs and uses the binary (...) wolf pack algorithm to solve it, so as to propose a dynamic task allocation method of heterogeneous UAV swarm in uncertain environment. In this method, a dynamic mechanism of attacking while searching and priority attacking of important targets is designed. A dynamic task allocation model of multitarget, multitask, heterogeneous multiaircraft platform and multiconstraint is established based on the target cost-effectiveness ratio and task execution time window. In addition, one-dimensional 0–1 coding method is adopted to encode the task allocation scheme. Furthermore, the wolf pack algorithm is introduced in brief. This paper focuses on the BWPA with the good computational robustness and strong global search ability to solve the dynamic allocation model. According to the simulation results, the designed task allocation method not only has good adaptability to the change of target and UAV number, as well as good stability and scalability, but also can effectively solve the dynamic task allocation problem of heterogeneous UAV swarm in unknown environment. Therefore, the established model and solution method can provide a useful reference for task allocation and other related problems. (shrink)

The paper discusses the self-reproduction ability of the existing technogenic civilization and the issues of the influence of self-reproduction mechanisms on the formation of axiological grounds for the use of digital technologies generated by this civilization. The self-reproduction of civilizational structures is considered through their constant repetition in the process of communication. In existing philosophical and sociological studies based on systems approach, the term autopoiesis, introduced for these purposes in the works of N. Luhmann, has already been used to describe (...) such processes. Considering the autopoiesis of the technogenic civilization, the articles relies on the works of V.S. Stepin to determine the main features of that civilization. As a result of the conducted research, it was revealed that the existing internal contradictions of the technogenic civilization that can lead and are already leading to its crisis, including the value one, are caused by simultaneous presence of mutually non-complementary autopoietic structures: (1) the ones related to the industrial and post-industrial era and to the scientific worldview; (2) and structures that have passed into modernity from the pre-industrial era, and yet still are have value and cultural significance in modern society. The author concludes that, forming the value foundations of the use of modern digital technologies, the technogenic civilization is forced to overcome the abovementioned gaps in its own autopoietic structures and create value systems free from these contradictions. Josiah Royce’s late masterpiece, ’The Problem of Christianity’, is based on a series of lectures he delivered at Manchester College, Oxford, in 1913. It presents his philosophical interpretation of Christianity’s fundamental ideas--community, sin, atonement, and saving grace; shows their relevance to the current confluence of world religions; and grounds his position upon a personal transformation into genuine loyalty toward the community of the entire human family. Biological agents can act in ways that express a sensitivity to context-dependent relevance. So far it has proven difficult to engineer this capacity for context-dependent sensitivity to relevance in artificial agents. We give this problem the label the “problem of meaning”. The problem of meaning could be circumvented if artificial intelligence researchers were to design agents based on the assumption of the continuity of life and mind. In this paper, we focus on the proposal made by enactive (...) cognitive scientists to design artificial agents that possess sensorimotor autonomy—stable, self-sustaining patterns of sensorimotor interaction that can ground values, norms and goals necessary for encountering a meaningful environment. More specifically, we consider whether the Free Energy Principle (FEP) can provide formal tools for modeling sensorimotor autonomy. There is currently no consensus on how to understand the relationship between enactive cognitive science and the FEP. However, a number of recent papers have argued that the two frameworks are fundamentally incompatible. Some argue that biological systems exhibit historical path-dependent learning that is absent from systems that minimize free energy. Others have argued that a free energy minimizing system would fail to satisfy a key condition for sensorimotor agency referred to as “interactional asymmetry”. These critics question the claim we defend in this paper that the FEP can be used to formally model autonomy and adaptivity. We will argue it is too soon to conclude that the two frameworks are incompatible. There are undeniable conceptual differences between the two frameworks but in our view each has something important and necessary to offer. The FEP needs enactive cognitive science for the solution it provides to the problem of meaning. Enactive cognitive science needs the FEP to formally model the properties it argues to be constitutive of agency. Our conclusion will be that active inference models based on the FEP provides a way by which scientists can think about how to address the problems of engineering autonomy and adaptivity in artificial agents in formal terms. Cora Diamond’s discussions of the ethics of our treatment of animals offer a critique of conceptions of morality which regard our ethical responses as founded on reasons which ought to be reasons for anyone. Diamond takes issue with accounts of our treatment of animals based on their possession of capacities which are shared with us. She offers instead a concept of the moral life, as a form of life—inherited, shared and negotiated—only within which can moral reasons count as reasons at (...) all. Our fellow creatures have some share in this life, but one that must be recognized as partial and problematic.In this discussion, we offer an account which is consistent with Diamond’s general perspective. But one which also offers a more generous account of ways in which the discoveries of the ethological sciences dynamically reshape the place of animals in our shared moral life. (shrink)

Norman Daniels's new book, Just Health, brings together his decades of work on the problem of justice and health. It improves on earlier writings by discussing how we can meet health needs fairly when we cannot meet them all and by attending to the implications of the socioeconomic determinants of health. In this article I return to the core idea around which the entire theory is built: that the principle of equality of opportunity grounds a societal obligation to meet (...) health needs. I point, first, that nowhere does Daniels say just what version of that principle he accepts. I then proceed to construct a principle on his behalf, based on a faithful reading of Just Health. Once we actually nail down the principle, I argue, we will find that there are two problems: it is implausible in itself, and it fails to ground a societal obligation to meet health needs. (shrink)

As we have seen in the transition form Part I to Part II of this book, the inductive riskiness of doxastic methods applied in testimonial uptake or prescribed as exemplary of religious faith, helpfully operationalizes the broader social scientific, philosophical, moral, and theological interest that people may have with problems of religious luck. Accordingly, we will now speak less about luck, but more about the manner in which highly risky cognitive strategies are correlated with psychological studies of bias studies and (...) human cognitive ecology. Chapter Four is concerned with connections between psychological study of biases and heuristics, and the comparative study of fundamentalism. The first section looks at work by psychologists and philosophers on our bias blind spot. Later sections ask, ‘In what ways might biases and heuristics play a special role in aiding our understanding of, and response to, fundamentalist orientation?’. The judgments we make in ignorance of our own biases Montaigne calls our importunate presumptions, and he suggests a host of practical factors that make them appealing. Montaigne, as I discuss in the first section, associates many of our errors with one or another kind of presumption, often about our similarity or differences from others, or from God. Our obvious psychographic diversity, and the polemical ground dynamics involved in our ‘culture wars’ are compounded on the agential side by the invisibility of our biases to ourselves. A number of person and social biases are described that plausibly affect all of our beliefs in domains of controversial views, religious views included. The second section continues to study of how etiological symmetry (similar patterns of belief-uptake) gives rise to religious contrariety (diverse narratives and theologies) in testimonial faith traditions, and what the implications of this are for philosophy of religion, generally, and for an improved comparative study of fundamentalism, in particular. Utilizing the work of philosophers such as Rachel Fraser and psychologists such as Emily Pronin and her co-authors, I offer a four-step genealogical account for how etiological symmetry so easily gives rise to religious contrariety. This account begins with the narrative nature of testimony in the Abrahamic family of religions, and how narrative content confounds our “source monitoring.” My genealogy also introduces what I term biased-closure inferences (BCI) as one of the key enablers of religious exclusivism and absolutism. These are the seemingly ‘logical’ but actually very self-serving inferences people often make, inferences from their own belief being true, to any belief contrary to it being false. Those who claim unique truth, epistemic access, and/or virtue and religious value for the home religion are no exception to the broad pertinence of bias studies across domains of controversial view. The proximate causes of belief are all that we can study, and in these there may be significant etiological symmetries. Yet those groups themselves, especially to the extent that they are exclusivist, are tunnel-visioned on claims of doctrinal uniqueness: on content differences of a theological sort. Comparative philosophy is met with the puzzlement that symmetric or essentially similar doxastic strategies should give rise not just to cognitive diversity, but to what we can call polarized or polemical contrariety, contrariety of a kind where each view adamantly rejects all others. Arguably, the more that theologies offer explanations of a counter-inductive sort, or profess counter-inductive thinking as exemplary of faith, the better evidential ground there for inferring that bias involved in the acquisition or maintenance of beliefs. This provides more substance to the question of when censure, and etiological challenges to faith-based beliefs are philosophically well-motivated. (shrink)

In this book, Gavin Rae analyses the foundations of political life by undertaking a critical comparative analysis of the political theologies of Carl Schmitt and Emmanuel Levinas. In so doing, Rae contributes to key debates in contemporary political philosophy, specifically those relating to the nature of, and the relationship between, the theological, the political, and the ethical, as well as those questioning the existence of ahistoric metaphysical, ontological, and epistemological foundations. While the theological is often associated with belief in a (...) fixed foundation such as God or the truth of a religion, Rae identifies another sense rooted in epistemology. On this understanding, the ontological limitations of human cognition mean that, ultimately, human truth is based in faith and so can never be certain. The argument developed suggests that Levinas’ conception of the political is grounded in theology in the sense of religion, particularly the revelations of Judaism. For this reason, Levinas claims that the political decision is based on how to implement a prior religiously-inspired norm: justice. Schmitt, in contrast, develops a conception of the political rooted in epistemic faith to claim that the political decision is normless. While sympathetic to Schmitt’s conception of theology and its relationship to the political, Rae concludes by arguing that the emphasis Levinas places on responsibility is crucial to understanding the implications of this. The continuing relevance of Schmitt’s and Levinas’ political theologies is that they teach us that, while the political decision is ultimately normless, we bear an infinite responsibility for the consequences of this normless decision. The article aims to show that the task of grounding categorial constituents in the specific founded acts of perception yields the problem field of phenomenological inquiry, within the framework of which remains Heidegger’s project of fundamental ontology. To achieve this goal the article reconstructs, first, the problem of the possibility of a priori correspondence between meaning and intuition of the intentional act; second, the phenomenological justification of extension of the traditional concept of truth, as a result of (...) which truth characteristic expands to intentional acts structured in a certain way, namely acts of total agreement between meaning and intuition (identification acts); third, the problem of the “categorial” in the phenomenological analysis of perception, which includes the extension of the concept of perception, limited in transcendental philosophy to the area of sensible intuitions, and justification of the specific categorial acts. On this basis, the article demonstrates that (1) phenomenology in a certain sense continues the project of transcendental philosophy, but the idea of a priori correspondence between notion and intuition within the framework of structural analysis of intentionality forms a new research problem. (2) The phenomenological understanding of truth in terms of the dynamics of empty and filled meaning intention is significant for the concept of truth presented by Heidegger in Being and Time. Heidegger explicates the concept of the truth in fundamental ontology based on the idea of identification. (3) The extension of the concept of object to its categorial constitution justified by Husserl provides fundamental ontology with the research subject. Heidegger interprets the categories, phenomenally represented in acts of categorial intuition, as a priori structures of the being of beings. The study also ascertains that new concepts of Husserl’s phenomenology saturate the conceptual framework of fundamental ontology. However, Heidegger also rethinks the key concepts of phenomenology in accordance with objectives which are different from the original objectives of the project of phenomenology designed by Husserl. Waldenfels’ phenomenological understanding of modernity is based on the understanding of “the foreign” as an essential definition of modernity. “The foreign” here is the characteristic of thinking explicated in cultural and social relationships, which should therefore be interpreted precisely in its phenomenal reality. Culture and politics in this context are more then a mere names for a collection of meanings and justifications of action. They become the expression of a meaningful context from which one can read-off the relation to “the (...) foreign” as the reference point for understanding the very meaning of modernity, its inner differentiation, the streams that determine it and the characteristics that are established in the individual determinants that denote its history. “The foreign” as a whole is grounded in corporality as the reality of its existence. Waldenfels maintains that modernity, taken as a whole, is understood in its orientation towards the foreign, in its relationship with the foreign that, eventually, results in the entire modernity being oriented towards the foreign. Modernity as such did not go astray, but it became oriented towards the foreign, it decided itself to accept some sort of “the foreign” as its identity, in which the philosophical discourse is established for its defence. The relationship towards corporality, postulated in this sense in modern theory, is a consequence of the relationship towards “the foreign”. That is why the problem of transformation of philosophy is not found in the new understanding of the mind, but in the discourse of new rationality, of phenomenological thinking of the particularity oriented towards the critique of the encompassing metaphysics of subjectivity and towards all sorts of rational assumptions bout the reality. Waldenfels’ interpretation of the modernity follows from the integrative insight into continuity of the thinking that determines it, and it is expressed by his summarisation of the crucial problems that determine its paths. It is in this sense that the phenomenological discourse is established, signifying the starting point of philosophical thinking at the turn of the century. (shrink)

Abstract Robert Stern's Understanding Moral Obligation is a remarkable achievement, representing an original reading of Kant's contribution to modern moral philosophy and the legacy he bequeathed to his later-eighteenth- and early-nineteenth-century successors in the German tradition. On Stern's interpretation, it was not the threat to autonomy posed by value realism, but the threat to autonomy posed by the obligatory nature of morality that led Kant to develop his critical moral theory grounded in the concept of the self-legislating moral agent. Accordingly, (...) Stern contends that Kant was a moral realist of sorts, holding certain substantive views that are best characterized as realist commitments about value. In this paper, I raise two central objections to Stern's reading of Kant. The first objection concerns what Stern identifies as Kant's solution to the problem of moral obligation. Whereas Stern sees the distinction between the infinite will and the finite will as resolving the problem of moral obligation, I argue that this distinction merely explains why moral obligations necessarily take the form of imperatives for us imperfect human beings, but does not solve the deeper problem concerning the obligatory nature of morality: why we should take moral norms to be supremely authoritative laws that override all other norms based on our non-moral interests. The second objection addresses Stern's claim that Kantian autonomy is compatible with value realism. Although this is an idea with which many contemporary readers will be sympathetic, I suggest that the textual evidence actually weighs in favor of constructivism. (shrink)

Modal metaphysics consumed much of the philosophical discussion at the turn of the century, yielding a number of epistemological insights. Modal analyses were applied within epistemology, yielding sensitivity and safety theories of knowledge as well as counterfactual accounts of the basing relation. The contemporary conversation has now turned to a new metaphysical notion – grounding – opening the way to a fresh wave of insights by bringing grounding into epistemology. In this paper, I attempt one such application, making (...) sense of the epistemic regress problem in terms of grounding. I argue that the relation that generates the epistemic regress is a grounding relation, showing that grounding can make sense of proposals by epistemic foundationalists and charting the course for similar applications to epistemic coherentism and epistemic infinitism. If it is right that grounding is involved in the epistemic regress, this points the way forward both for epistemologists and metaphysicians, revealing the prospects of solutions to the epistemic regress problem while providing grounding advocates with yet another example of grounding with which to theorize. The political independence of the United States of America was proclaimed in a Declaration of Independence by the Second Continental Congress, in Philadelphia, on July 4, 1776. Thomas Jefferson drafted the document, and the changes made in the text reflected the struggle among different factions in the revolutionary camp. Jefferson's initial version was fundamentally retained, however; and that is precisely what makes the Declaration of Independence not merely a legal document but a vivid example of a bourgeois revolutionary program expressing (...) in concentrated form the ideology of the radical wing of the American Enlightenment. The form of the Declaration was an address to world public opinion explaining the causes and bases for the decisive political break of the 13 British colonies with the home country. In fact it provided a general philosophical justification for the validity of revolutionary change in the social order by the people. The Declaration became the legal ground for the American system of government, sanctioning its independence and serving as the basis for the documents of a constitutional nature that followed. The treatment of the nature of man and his rights is the most important feature of the revolutionary conclusions of the Declaration. (shrink)

This article is the second step in our research into the Symbol Grounding Problem (SGP). In a previous work, we defined the main condition that must be satisfied by any strategy in order to provide a valid solution to the SGP, namely the zero semantic commitment condition (Z condition). We then showed that all the main strategies proposed so far fail to satisfy the Z condition, although they provide several important lessons to be followed by any new proposal. (...) Here, we develop a new solution of the SGP. It is called praxical in order to stress the key role played by the interactions between the agents and their environment. It is based on a new theory of meaning—Action-based Semantics (AbS)—and on a new kind of artificial agents, called two-machine artificial agents (AM²). Thanks to their architecture, AM2s implement AbS, and this allows them to ground their symbols semantically and to develop some fairly advanced semantic abilities, including the development of semantically grounded communication and the elaboration of representations, while still respecting the Z condition. In this paper, I address the grounding problem for contemporary Russellian panpsychism, or the question of how consciousness as an intrinsic nature is connected to dispositions or powers of objects. I claim that Russellian panpsychists cannot offer an adequate solution to the grounding problem and that they should reject the claim that consciousness, as an intrinsic nature, grounds the powers of objects. Instead, I argue that they should favour the identity theory of powers, where categorical and (...) dispositional properties are identified. I maintain that the identity theory serves as a better ontological basis for panpsychism since it avoids the grounding problem. Apart from that, I also argue that identity theory panpsychism is a position more parsimonious than Russellian panpsychism since it introduces fewer entities while successfully avoiding the grounding problem. Based on these considerations, I conclude that identity theory panpsychism is an option worth considering. (shrink)

I argue that consideration of certain cases of severe depression reveals a problem for desire-based theories of welfare. I first show that depression can result in a person losing her desires and then identify a case wherein it seems right to think that, as a result of very severe depression, the individuals described no longer have any desires whatsoever. I argue that the state these people are in is a state of profound ill-being: their lives are going very poorly (...) for them. Yet desire theories get this case wrong. Because no desires are being frustrated, the desire theorist has no grounds for ascribing ill-being; indeed, because the individuals described seem utterly without desire, the desire theorist has no grounds for treating these people as subjects of welfare ascription at all. I argue that these results are unacceptable; therefore, we should reject desire-based theories of well-being and ill-being. (shrink)

This article explains problems and opportunities created by standardized ethics initiatives (e.g., the UN Global Compact, the Global Reporting Initiative, and SA 8000) from the perspective of stakeholder theory. First, we outline differences and commonalities among currently existing initiatives and thus generate a common ground for our discussion. Second, based on these remarks, we critically evaluate standardized ethics initiatives by drawing on descriptive, instrumental, and normative stakeholder theory. In doing so, we explain why these standards are helpful tools when it (...) comes to ‘managing’ stakeholder relations but also face considerable limitations that can eventually hamper their successful expansion. We suspect that this discussion is necessary to conduct meaningful empirical research in the future and also to provide managers with a more clear-cut picture about a successful application of such initiatives. Third, we outline possible ways to cope with the identified problems and thus demonstrate how standard-setting institutions can improve the initiatives they offer. (shrink)

In his early works, Habermas wants to preserve both, the German idealist notion which gives primacy to self-reflection in the history of the human species, and the Marxist materialist conception that self-reflection is based on the material conditions of existence. ;Such dual preservation cannot be maintained; for the primacy given to self-reflection by German idealism is based on a prior spiritualization of the conditions of reflection. It is precisely with those alienated conditions that Habermas's "neo-Marxism" seeks to limit "materialistically" critical (...) self-reflection. This is a bad overcoming of Hegel, since it preserves the Spirit as alienated otherness. ;However, Habermas's more recent linguistic turn evinces an attempt to ground critical self-reflection by means of a de-historicized anticipation of an ideal speech situation through the formal rules of cogency of speech. ;An atheistic reading of Hegel's conception of life, which regards universal life as "congealed space" or pure positivity, allows for a transition to Marx's practical communism. ;The existential attitudes towards death have as their ontological correlate, the motion of life; that is, historical acts may be regarded as attempts to appropriate objectivity which, as pure positivity, cannot be appropriated in principle, especially after the notion of an all-encompassing transcendental subjectivity, which posits the object as alienated subject, has been rejected. ;In the early Marx, historical and social investigations were limited by the primacy of the subject, the object being subordinated to it. To this extent, he naively remained at the level of ideology, i.e., "lived relations." In this manner, the unconditioned supersensible, in the form of a transcendental subjectivity, clouds the examination of the objective conditions of existence. ;The mature Marx's turn to the object expresses the elimination of the unconditioned, and the concomitant consideration of social reality as the basis of positive and negative ideologies, to the extent that the consciousness of freedom arose from the forced emancipation of consciousness from and by material conditions. – The conjunction of three plausible theses about the nature of causal powers—that they are intrinsic, that their effects are produced mutually, and that the manifestations they are for are essential to them—leads to a problem concerning the ability of causal powers to work together to produce manifestations. I call this problem the problem of fit. Fortunately for proponents of a power-based metaphysic, the problem of fit is not insurmountable. Fit can be engineered if powers are (...) properties whose natures are determined holistically. However, this power holism does not come without a cost, as a power-based metaphysic must be supplemented by a certain amount of additional machinery in order to avoid the problem. (shrink)

In the last decades there has been a great controversy about the scientific status of emotion categories. This controversy stems from the idea that emotions are heterogeneous phenomena, which precludes classifying them under a common kind. In this article, I analyze this claim—which I call the Variability Thesis—and argue that as it stands, it is problematically underdefined. To show this, I examine a recent formulation of the thesis as offered by Scarantino (2015). On one hand, I raise some issues (...) regarding the logical structure of the claim. On the other hand, and most importantly, I show that the Variability Thesis requires a consensus about what counts as a relevant pattern of response in different domains, a consensus that is lacking in the current literature. This makes it difficult to assess what counts as evidence for or against this thesis. As a result, arguments based on the Variability Thesis are unwarranted. This raises serious concerns about some current empirical theories of emotions, but also sheds light on the issue of the scientific status of emotion categories. (shrink)

The construction of a systematic philosophical foundation for logic is a notoriously difficult problem. In Part One I suggest that the problem is in large part methodological, having to do with the common philosophical conception of “providing a foundation”. I offer an alternative to the common methodology which combines a strong foundational requirement with the use of non-traditional, holistic tools to achieve this result. In Part Two I delineate an outline of a foundation for logic, employing the new (...) methodology. The outline is based on an investigation of why logic requires a veridical justification, i.e., a justification which involves the world and not just the mind, and what features or aspect of the world logic is grounded in. Logic, the investigation suggests, is grounded in the formal aspect of reality, and the outline proposes an account of this aspect, the way it both constrains and enables logic, logic's role in our overall system of knowledge, the relation between logic and mathematics, the normativity of logic, the characteristic traits of logic, and error and revision in logic. This paper uses the conceptual apparatus of Wittgenstein’s later philosophy to tackle a foundational issue in the philosophical literature on group identity, namely, the problem of difference. This problem suggests that any appeal to a collective identity is oppressive because it imposes a shared identity on the members of a group and suppresses the internal differences of the group. I develop a Wittgensteinian view of identity that dissolves this problem by showing the conceptual confusions on which it (...) rests. My Wittgensteinian view of identity tries to establish two main theses: first, that identity is bound up with difference and presupposes heterogeneity; and second, that the solidarity of identity groups, far from being obstructed by differences, actually requires diversity. Drawing from gender and sexuality studies, I use the mechanism of disidentification to show how there can be shared identities and identity-based solidarity without the erasure of differences. O'Donovan's gracefully written book is a late but welcome addition to an already large body of literature spawned directly or indirectly by A. Nygren's epoch-making Agape and Eros, the first installment of which appeared in 1930. Most of the ground that it covers is aptly described as a battlefield "on which the smoke still hangs heavy". Interestingly enough, Augustine is the first Latin writer to make extensive use of the expression amor sui or "self-love," which occurs some one-hundred and fifty (...) times throughout his voluminous corpus. Although once accepted virtually without question, his views on this crucial subject have not met with universal approval in our century. Nygren was convinced that Augustine had dealt a lethal blow to the self-denying agape of the Gospel by synthesizing it with the essentially self-regarding eros of Platonic philosophy. Others have since rallied to Augustine's defense, but without always doing full justice to the complexity of his thought. Hence the need for a global assessment of the problem based on a careful scrutiny of the evidence at hand. (shrink)

This paper explores the relationship between business experience in cross-sector partnerships and the co-creation of what we refer to as ‘dynamic capabilities for stakeholder orientation,’ consisting of the four dimensions of sensing, interacting with, learning from and changing based on stakeholders. We argue that the co-creation of dynamic capabilities for stakeholder orientation is crucial for CSPs to create societal impact, as stakeholder-oriented organizations are more suited to deal with “wicked problems,” i.e., problems that are large, messy, and complex. By means (...) of a grounded theory approach of inductive research, we collected and interpreted data on four global agri-food companies which have heterogeneous experience in participating in CSPs. The results of this paper highlight that only companies’ capability of interacting with stakeholders continually increases, while their capabilities of sensing, learning from, and changing based on stakeholders first increase and then decrease as companies gain more experience in CSP participation. To a large extent, this can be attributed to the development of corporate strategies on sustainability after a few years of CSP participation, which entails a shift from a reactive to a proactive attitude towards sustainability issues and which may decrease the need or motivation for stakeholder orientation. These findings open up important issues for discussion and for future research on the impact of CSPs in a context of wicked problems. (shrink)

The main aim of the paper is to reconstruct and analyse two methodological approaches to the problem of universals, presented in Bocheński’s papers “Powszechniki jako treści cech w filozofii św. Tomasza z Akwinu” and “The Problem of Universals.” It is argued that, although these approaches are rather different from historical and methodological points of view, they are still based on the same ontological ground, viz. on immanent realism. The article provides a detailed analysis and comparison of the respective (...) views. Justification is provided for the claim that Bocheński was an immanent realist and some of Bocheński’s detailed solutions are highlighted that may be of particular importance for further debate over the problem of universals. A couple of minor critical comments concerning some of Bocheński’s analyses are presented at the end of the paper. (shrink)

It should now be recognized that codes are central to life and to understanding its more complex forms, including human culture. Recognizing the ‘conventional’ nature of codes provides solid grounds for rejecting efforts to reduce life to biochemistry and justifies according a place to semantics in life. The question I want to consider is whether this is enough. Focussing on Eigen’s paradox of how a complex code could originate, I will argue that along with Barbieri’s efforts to account for the (...) origins of life based on the ribosome and then to account for the refined codes through a process of ambiguity reduction, something more is required. Barbieri has not provided an adequate account of emergence, or the basis for providing such an account. I will argue that Stanley Salthe has clarified to some extent the nature of emergence by conceptualizing it as the interpolation of new enabling constraints. Clearly, codes can be seen as enabling constraints. How this actually happens, though, is still not explained. Stuart Kauffman has grappled with this issue and shown that it radically challenges the assumptions of mainstream science going back to Newton. He has attempted to reintroduce real possibilities or potentialities into his ontology, and argued that radically new developments in nature are associated with realizing adjacent possibles. This is still not adequate. What is also involved, I will suggest, utilizing concepts developed by the French natural philosopher Gilbert Simondon, is ‘transduction’ as part of ‘ontogenesis’ of individuals in a process of ‘individuation’, that is, the emergence of ‘individuals’ from preindividual fields or milieux. Based on the heterogeneous multiscale method, this paper presents a finite volume method to solve multiscale convection-diffusion-reaction problem. The paper constructs an algorithm of the optimal order convergence rate in H1-norm under periodic medias.

Voluntarist accounts of secession are those that attempt to ground a moral right to secede in autonomy. This paper argues that no such account is likely to succeed. After describing the serious problems that plague the most straightforward Voluntarist approach, I examine two recent accounts that employ novel approaches designed to avoid those difficulties. I argue that both accounts fail, shedding considerable doubt on the possibility of a plausible autonomy-based account of the moral right to secede. Today’s societies face the minorities that want recognition and respect for cultural differences. Kymlicka names it the challenge of multiculturalism. It is considered that identity and recognition problems have recently come to the fore because of a transformation in the perception of subject, truth, reason caused by postmodernism. Kymlicka claims that even if it is more difficult to live together today, it is not because of the so-called post-truth age. In his opinion, we have never reached absolute common grounds before, (...) either. So, it is not true that we cannot get common grounds by we do not believe metaphysical truths anymore. He already believes that a sense of justice does not count on the metaphysical truths, but it can be based on social identities and a sense of belonging. So, he thinks that an overlapping consensus is possible. However, I will defend a different perspective about pluralism and living together. I think that modus vivendi is an undeniable universal fact. For this reason, an overlapping consensus as a model of living together can only be possible domestically at the expense of a global modus vivendi. (shrink)

Can addiction be credibly invoked as an excuse for moral harms secondary to particular decisions to use drugs? This question raises two distinct sets of issues. First, there is the question of whether addiction is the sort of consideration that could, given suitable assumptions about the details of the case, excuse or mitigate moral blameworthiness. Most discussions of addiction and moral responsibility have focused on this question, and many have argued that addiction excuses. Here I articulate what I take to (...) be the best argument for this view, based on the substantial difficulty that people with severe addiction experience in controlling drug-related behavior. This, I argue, may in some cases be sufficient to ground a mitigating excuse, given the way in which addiction undermines agents’ responsiveness to relevant moral reasons to do otherwise. Much less attention has been devoted to a second set of issues that critically affect the possibility of applying this mitigating excuse in particular cases, derived from the ambivalent nature of agential control in addiction. In order to find a fitting response to moral harm, the person with the right standing to blame must make a judgment about the extent to which the agent possessed certain morally relevant capacities at the time of the act. In practice, this will often prove tremendously difficult to assess. The ethical challenge for the person with the right standing to blame is fundamentally one of making a judgment about matters that seem underdetermined by the available evidence. (shrink)

We can distinguish two liberal paradigms that stand in opposition to each other. Liberalism as non-domination seeks to eliminate identities resulting from domination and oppression and hindering the emancipation of individuals. Liberalism as recognition holds that ‘the idea of a human world without identities makes no sense’ (Appiah) and considers identities to have their source in individual liberty and to provide the grounds for pluralism. The two liberal paradigms come to largely different results regarding the role of the state and (...) civil society. The paradigm of non-domination tends to enforce individual rights, if necessary against a hostile cultural and religious context. The paradigm of recognition defends mostly individual liberties, if necessary at the expense of certain individual rights. Liberalism stands here in front of a major dilemma: Either it protects individual rights in the sense of freedom as non-domination, or it defends individual liberties in Isaiah Berlin's tradition of negative liberty– in too many cases and in too many parts of the world, liberalism, understood in the terms presented here, cannot have it both ways. This review article argues that the liberal paradigms of non-domination and recognition are complementary; liberalism is about both recognition and non-domination. Following policy recommendation can be drawn: (1) Democratic institutions (parliament, political parties and constitutional courts) and democratic rights (right to vote, right of assembly and freedom of speech) are most efficient in fighting domination. (2) Although social identities are not fixed and open to change, they cannot be engineered by the state or civil society organizations and grow out of some form of social consensus. (3) The consensus around identities takes place within the pluralist public and civil sphere of a community. (4) While the support in the development of individual capabilities by the state is effective against domination, also history and collective memory help to overcome the traumatic experience of domination. (5) Systemic transformation requires the support from below, notably from the civil society, and is based on individual liberties. (shrink)

This article examines William Morris’s idea of Englishness, considered through a critique of his concept of fellowship or community. It looks at the charge that Morris wrongly neglected the importance of nationality as a focus for organization in socialism, preferring instead an internationalist ideal, based on an unworkable model of small-scale community. I defend Morris against these claims by arguing that Morris’s socialism was consistent with expressions of nationality and that his communitarianism was grounded on a concept of enjoyable labour, (...) not friendship as is often supposed. This paper aims to argue for the thesis that it is not a priori morally justified that the first phase of space colonisation is based on sexual reproduction. We ground this position on the argument that, at least in the first colonisation settlements, those born in space may not have a good chance of having a good life. This problem does not depend on the fact that life on another planet would have to deal with issues such as solar (...) radiation or with the decrease or entire absence of the force of gravity. These issues could plausibly be addressed given that the planets or settlements we will feasibly colonise could be completely transformed through geoengineering processes. Likewise, the ability of humans to live in space could be enhanced through genetic modification interventions. Even if, however, the problems concerning survival in space were solved, we think that, at least in the first period of colonisation of space or other planets, giving birth to children in space could be a morally irresponsible choice since we argue, the life we ​​could give them might not be good enough. We contend that this is the case since when we decide to have a baby. We argue that it is not morally right to be content that our children have a minimally sufficient life worth living; before we give birth to children in space, we should make sure we can give them a reasonable chance of having a good life. This principle applies both on Earth - at least where you can choose - and for space travel. (shrink)

This article addresses the problem of the nature of mental imagery from a new perspective. It suggests that sign-theoretical approach as elaborated by C. S. Peirce can give a better and more comprehensive explanation of mental imagery. Our empirical findings follow the methodology of cognitive semiotics and they show that (i) properties of mental images are heterogeneous in nature; (ii) properties of mental images are dependent on the characteristics of object-stimulus; (iii) properties of mental images are dependent on (...) individual differences in imaginary capacities. This suggests that, contrary to representational accounts, mental imagery is not based on one dominant representational format. Imagery constitutes a complex system of signs consisting of several sign elements and dynamic relations. A sign-theoretical account may give a better explanation of the nature of mental imagery, as it accommodates heterogenous evidence from this experiment. (shrink)

This article critically engages Paul Moser’s “Divine Hiddenness Response” to the problem of evil—an approach to have recently come out of traditional free-will theism. I begin with identifying the initial common ground between Mosers thought and process theology that arguably coincides with what can be called the "Four Noble Truths of Christianity. ” Howevery when confronted with the problem of evil that threatens the credibility of these truths. Moser offers an epistemic strategy to address this threat without modifying (...) the classical concept of omnipotence and without having a full-explanation theodicy. I will argue that, far from helping the situation, this approach exacerbates it and is therefore strongly undesirable. In addition, Moser’s assumption of the absence of an adequate theodicy is unjustified in light of the demonstrable merits of process theodicy in accomplishing what omnipotence-preserving approaches cannot do—defusing the defeaters to Christianity’s Four Noble Truths effectively. Thusy it is desirable andy in the absence of better optionsy epistemically obligatory that omnipotence be modified and replaced with a version of God’s perfect power that is more coherent and evidence-based, and is also in line with a significant strand within the Bible. According to the “paradox of knowability”, the moderate thesis that all truths are knowable – ... – implies the seemingly preposterous claim that all truths are actually known – ... –, i.e. that we are omniscient. If Fitch’s argument were successful, it would amount to a knockdown rebuttal of anti-realism by reductio. In the paper I defend the nowadays rather neglected strategy of intuitionistic revisionism. Employing only intuitionistically acceptable rules of inference, the conclusion of the argument is, firstly, not ..., (...) but .... Secondly, even if there were an intuitionistically acceptable proof of ..., i.e. an argument based on a different set of premises, the conclusion would have to be interpreted in accordance with Heyting semantics, and read in this way, the apparently preposterous conclusion would be true on conceptual grounds and acceptable even from a realist point of view. Fitch’s argument, understood as an immanent critique of verificationism, fails because in a debate dealing with the justification of deduction there can be no interpreted formal language on which realists and anti-realists could agree. Thus, the underlying problem is that a satisfactory solution to the “problem of shared content” is not available. I conclude with some remarks on the proposals by J. Salerno and N. Tennant to reconstruct certain arguments in the debate on anti-realism by establishing aporias. (shrink)

A number of important legal theorists have recently argued for metaphysically realist approaches to legal determinacy grounded in particular semantic theories or theories of reference, in particular, views of meaning and reference based on the works of Putnam and Kripke. The basic position of these theorists is that questions of legal interpretation and legal determinacy should be approached through semantic meaning. However, the role of authority (in the form of lawmaker choice) in law in general, and democratic systems in particular, (...) require that these realist solutions to the problem of legal determinacy be rejected, or at least significantly revised. Architecture and Deconstruction Case of Peter Eisenman and Bernard Tschumi -/- Introduction Towards deconstruction in architecture Intensive relations between philosophical deconstruction and architecture, which were present in the late 1980s and early 1990s, belong to the past and therefore may be described from a greater than before distance. Within these relations three basic variations can be distinguished: the first one, in which philosophy of deconstruction deals with architectural terms but does not interfere with real architecture, the second one, in which (...) a collaboration between Jacques Derrida and a group of architects interested in his concepts is commenced, and the third one, in which completed or only designed objects or new concepts of deconstruction created by architects gain their supremacy over philosophy. The following book analyses these three possible ways, first of all with the reference to Peter Eisenman and Bernard Tschumi. -/- Peter Eisenman -/- Misreading… and Other Errors -/- The issue of relations between Peter Eisenman’s work and philosophy of deconstruction may be referred to his activity more than ten years preceding his direct collaboration with Jacques Derrida (in 1985) and organisation of the exhibition Deconstructivist Architecture at Museum of Modern Art in New York (in 1988). As soon as at the stage of designing the first houses (House I-III, 1967-1970), which almost entirely inscribed in formalistic aesthetics of Modernism, the architect analysed the problem of architecture dependence on its assumptions. All his later designs may be treated as consequence of this initial interest in relations between practice and theory, and at the same time as an introduction to manipulations later on led at the level of metaphysics of architecture. Beginning with the issue of presence, considered in comments to House VI (1972), the number of ideas having their analogies in philosophy of deconstruction increased. The text entitled The End of the Classical: The End of the Beginning, The End of the End (1984), in which Eisenman criticised questions of representation in architecture, its delusive strive for truth and comparably unattainable attempts at ultimate definition of elementary rules, should be acclaimed the breaking point. This attitude was extended by numerous strategies disturbing architecture rules defined at metaphysical level in an essay Moving Arrows, Eros, and Other Errors: an Architecture of Absence (1986). The issue of Eisenman’s passage from formalism to deconstruction has already been much discussed in the literature (Rosalind Krauss, Thomas Patin among others), still it should be mentioned that the threads similar to Derrida’s concept included in Eisenman’s writing reveal untranslatability of architecture and philosophy. -/- Choral Works or Separate tricks -/- In 1985-1986 a series of seven disputes between Jacques Derrida and Peter Eisenman took place. The pretext for them were designs concerning Parc de la Villette in Paris. The situation of many months of collaboration between a notable philosopher of the second half of the 20th c. and an architect that already had a huge theoretical oeuvre, ended up with a publication of a large volume entitled Chora L Works and it became at the same time a vast study area for historians of contemporary architecture and philosophers. Derrida’s contribution to concept works were his considerations over the idea of chôra, the properties related to this concept were about to be reflected in shapes of the park. Therefore, Chora L Works became an example of the abilities of contemporary art, both in its capability of translation from philosophical ideas to artistic forms and its resistance to tradition of representing in architecture some phenomena and values originating outside this discipline. In the final period of their collaboration both interlocutors started to polemicise with each other more decidedly, what became a separate part of their thought exchange. The exchange of letters between Derrida and Eisenman at the turn of 1989 ended up the period of their direct contacts, nevertheless, at this time precisely a large group of experts in issues of deconstruction joined the discussion and extended the revealed in the former dispute problems into more than ten years of further considerations and publications. Except for a long text by Jeffrey Kipnis, who had participated in the meetings of the philosopher and the architect, there appeared also comments of researchers of artistic theories (K. Michael Hays, Thomas Patin), philosophers (Andrew Benjamin), and even experts in Greek literature (Maria Theodorou or Ann Bergren). Following these debates a contemporary reflection on architecture has saturated with indeed numerous concepts originating in philosophy of deconstruction. -/- Architecture which imitates mute philosophy -/- The series of Jacques Derrida and Peter Eisenman meetings, which took place in the period of 1985-1987, induced many authors to make comments. Some of them (Jeffrey Kipnis, Ann Bergren, Maria Theodorou) developed the subject of chôra which was introduced to the discussion by Derrida. The problem that was about to be solved was the question of tying up the concept of chôra with architecture, including Eisenman’s architecture and the series of meetings within frames of Chora L Works project. Kipnis on this occasion paid attention to chôra and its character of anachronia which infects any being created within chôra. In other words any event has its counterpart (analogon) in another, earlier event. He demonstrated the similarity of structure of many events and statements from the times of Derrida and Eisenman’s meetings to the almost identical behaviour of figures in Plato’s dialogue Timaeus. The loss of beginning present in this phenomenon was appropriate to both features of chôra and the effects of typical analyses of philosophy of deconstruction. Bergren’s analyses focused on accentuating gender of chôra, which, according to this author, had been neglected hitherto in discussions. She collated chôra descriptions with characteristics of women in myths, early Greek epic and philosophy and she arrived at a conclusion that chôra has features of a single woman and a married one at the same time. And yet Theodorou’s studies showed that in the Homeric epics chôra is not treated as an idea but is related with single things and events. The other part of the comments (represented by Andrew Benjamin and K. Michael Hays’ utterances) concerns Eisenman’s attitude to tradition which was treated as a variety of iteration understood philosophically. Benjamin commenced his considerations at the point of closeness between a definition of tradition and a concept of chôra understood as perpetuation (placement). A problematic issue was for him Eisenman’s complex relation to tradition based on its contest and affirmation at the same time. Overcoming the simple subordination to tradition – according to Benjamin – was based on awareness of the role of repetition in culture not known before. Hays made an attempt to explain the pleasure and torment of repetition with the support of Sigmund Freud and Roland Barthes’ concepts. According to Hays repetitions are attempts of a single being to a certain primal state perceived as free of any tension. In a similar way Rosalind Krauss explained a motif of a grate present in Modernistic art and also exceptionally frequent in Eisenman’s work. -/- Annex Architecture is still writing Balzac novels. Peter Eisenman and literature -/- Architecture’s approach to writing, script or literature, present within Peter Eisenman’s work, is an exceptional phenomenon, furthermore a complex one. The article considers four possible relations. The first one relates to Eisenman’s characteristics as a person extremely gifted with the ability to wordplay, which very ‘play’ reveals skills to create architectural images. In the second approach the attention has been paid to Eisenman’s interests – in the first period of his oeuvre – in linguistic works by Noam Chomsky and his transformational-generative grammar. The third kind of relations applied to overcoming the need for autonomy of architecture (and of modernist aesthetics at the same time) and renew interests in questions of meaning in architecture. The fourth sort of relations occurred when Eisenman started to create reflections of historic or literary narrations in architecture – ‘stone stories’ and architectural fictions of their kind. -/- Bernard Tschumi -/- From perversion to deconstruction In Bernard Tschumi’s writings from the 1970s and 1980s we can find a transposition of important threads of post-structuralist ideas deriving from Georges Bataille, Roland Barthes and Jacques Derrida’s works. The analysis of the architect’s writings also shows roots in Phillippe Sollers, Michel Foucault and Denis Hollier’s works. The analysis of borrowed elements from the beginnings of Tschumi’s theoretical activity may be helpful in explaining the contents of his later writings motre inspired by philosophy of deconstruction. The set of his earliest views was inspired by Marxism, Neo Marxism and French Structuralism, mainly by the writings of Henri Levebre and Guy Debord. From the thought of Levebre Tschumi took interest for city as not only a question of urbanistics but also a political issue. From Debord’s concepts he borrowed a conviction about the role of situational violation for changes in the society structure. Some of these beliefs were preserved in his own concepts of architecture as an event. From this period derived also his will to change conservative elements of social structure not by means of political revolution but of theoretical and creative activity. Tschumi acknowledged that the effective way of the proceedings towards achieving his aims would be accepting the role of both a critical intellectualist and architecture expert who would not hide away his left-wing orientation. The speculations defined by the architect as ‘revolting analyses’ were about to characterise contradictions which tear the society apart, penetrate architecture and constitute the basis of culture. Spreading away of the conscience of false assumptions hidden away in various disciplines could have weakened cohesion of a conservative society and influence the will to change among the elites. This way the beginnings of political revolution were rooted in philosophy of architecture. In 1977 Tschumi published his text entitled The Pleasure of Architecture inspired by Roland Barthes’s The Pleasure of the Text, it also included some concepts derived from Georges Bataille and Jacques Derrida. First of all the author used Barthes’s concept which made an assumption that literary activity is pervaded by the spirit of resistance towards social rules, and Tschudi transferred this remark onto architecture. From the ideas of Bataille, acquainted via Holier’s work, he derived his belief that two concepts of space, a conceptual one (defined as Pyramid) and a sensual one (defined as Labirynth), not losing their distinct features, they join in the concept of experienced space which exceeds contradictions. The exceeding itself was defined as the basic rule of architecture and it was referred to situations in which architecture not only negates social needs, but also disavows its own tradition. Crossing the borders applies not only to political issues or permanent rules of the very discipline but also interfering with other fields (especially literature and film). The fact that architecture is associated with organising events turned Tschumi’s attention to questions of violence that result from upsetting architectural order of a given building by its users and the one hand, and on the other from forcing the users to specific acts imposed by this very order. The analysis of the concepts used by Tschumi in his early writings indicates that they are close to definitions that would occur in his reflection in the following years influenced by philosophy of deconstruction. -/- Approaching deconstruction Tschumi in his theories developed in the 1980s presumed that the current social world had undergone a deep process of decay, and the reaction against which ought to be based on ordering-up actions, and also preserving the main outline of disintegration of the whole and its elements in the state of conflict. The statements concerning the nature of the contemporary to Tschumi social relations were applied by him to the world of architecture, this led him to coming up with designing strategies that took into consideration the destabilised character of conditions in which works of architecture were created. New ways of conduct invented by Tschumi drew their inspiration from literature and research on literature, psychoanalysis, structural linguistics, structuralism and post structuralism, and eventually also deconstruction philosophy. The proposed methods were opposed by their author both to functionalism continuity trends and postmodern architecture. Tschumi’s proposals contradicted any forms of conservatism or traditionalism in political sphere as well as in reference to tendencies in architecture. They were not simple contradictions of social or architectural rules, they intrude them from the inside, weaken or escalate the already existing incongruities, they move the boundaries between the areas. Revolutionary illusions about the possibility of radical changes were replaced with strategies which completed, tainted or test former rules in the series of formal games of permutation and combination. Quite different from avant-garde formalism Tschumi’s games were not about maintaining the autonomy of a given area, but on the contrary – polluting it with other areas’ influences. Tschumi enjoyed demonstrating illusions of architecture concerning simple relations between form and function, or between form and meaning. Making use of Freud, Lacan and Foucault’s research he introduced a category of “madness” into architecture allowing an observation that the recognised norms are nothing but merely ones of many possible principles of behaviour, and their recognised status resulted from unjustified hindering innovativeness which is crucial for architecture. To reborn architecture’s capability of changing Tschumi also made use of Barthes’s discoveries concerning rules of narration and works by writers who applied in their writing knowledge on linguistics. Making a work’s author unclear by various mechanical transformations of its elements was however apparent only, and formal rigours imposed on the process of designing liberated possibilities difficult to obtain in more traditional creative action. Another mode of acting introduced by Tschumi was combining his work of elements deriving from outside architecture; joining space records with notation of motion and events accompanying architectural objects among others. These architectural and extra-architectural elements were not unified, on the contrary their heterogenous and conflictual character was stressed. This is how shock, anxiety and instability, typical for live in great metropolises, infiltrated architecture. Taking some ideas of deconstruction philosophy as a pattern Tschumi also took into critical consideration in his essays traditional in architecture oppositions between form and figuration, or theory and practice. By combining various inspirations he eventually worked out an idea of architectural event, which he understood as a series of actions contesting its own field, redefining its sources, principles and elements. An event, understood in this way, was not so much producing works as rather creating conditions of their production and at the same time designing the society different from a hierarchic one. -/- Park of deconstruction Among numerous philosophical strategies of deconstruction most frequently used was questioning the practice of strong opposition of two reasons. In many cases Bernard Tschumi’s writings just consider functioning of the conflict juxtaposition of the ideas of structure and ornament or theory and practice in history of architecture. Violation of traditional relations between terms of this kind, both old and modern, raised Jacques Derrida’s objections, when he was induced for the first time to co-operate with architects’ milieu. During this long lasting thought exchange the philosopher eventually acknowledged Bernard Tschumi’s arguments for reasoning the encroachment of architecture’s fundamental rules. Deconstruction applied in architecture was not a simple transposition or analogy of practices that had been applied by philosophy of deconstruction. We may even say that considering architectural terms became an important formula of deconstruction. Architecture understood in philosophical way became something beyond the practice and theory of its own discipline, a sort of metaphysics of both philosophy and architecture. The deliberate encroachment of simplicity of dividing architecture into theory and practice, for the first time became a clear aim for Tschumi in his drawings and texts entitled The Manhattan Transcripts. The contents of this series of works was a record of characteristic features of this New York district in such a way that not only objects were the subject of the record but also relations between objects, people and events. The record was about to take into consideration a conflict character of elements of this representation and at the same time to avoid applying to them the rule of mimetism. The record became a form of reflection over the very record by an increased control over the ways of representation. Architecture which was considered in the The Manhattan Transcripts was not directed to fulfill the needs of inhabitation or production, it was rather related with hitherto usually marginalised liminal situations: building ostentatiously big monuments, religious cult, war etc. Architecture operating in these relations focused also the attention on the included in it continuous tendency to overpass its own restrictions, the role of violence as its not recognised factor, or the meaning of excess and shock in its operation. Architecture moving from reason towards madness became even more visible in the design of Parisian Parc de la Villette, whose pavilions were defined as folies (in French it means both small park buildings and follies). The park was supposed to be on the one hand a reflection of traditional society disintegration while on the other it questioned basic rules of producing a work of architecture. The traditional rules of designing, based on ordering up, were replaced with the strategies of dysfunction and dissociation. In Tschumi’s opinion methods of this kind may be equivalent of what Derrida named différance. Instead of aiming at mergence, any diversity, plays or variations were strengthen. Tschumi’s texts, in which he explained his attitude, were completed by Derrida’s extent statement entitled Point de folie – Maintenant l’architecture. Derrida’s article is the most significant of all his statements on architecture as a form of thinking and activity. According to the philosopher, architecture should divide space (in French defined as espacement), what enables both thinking and action – it arranges the space of an event. Tschumi’s buildings, defined as folies, in an essential way destabilise any created order, and at the same time they refresh it. Derrida’s statement suggests that architecture may become both metaphor of an order merging a language or a society but also of inner forces which deconstruct and reconstruct it. Therefore architecture is at the same time a construction, a deconstruction and a reconstruction. Parc de la Villette stands out in this system with its attempt to step beyond the scheme of an easy repetition and its heading for chances of achieving more radical otherness. -/- Conclusion Destruction as construction. Paradoxes of deconstruction in architecture -/- Scepticism about persistence and common importance of fundamental values of human culture evinced in philosophers and writers’ works as early as in Greek antiquity, nevertheless it was not expressed so strongly as in the second half of the 20th century. Especially in Heidegger’s work Being and Time (although originated in 1927, still influential in all later philosophy) the following states were characterised: the state of losing the ground (Abgrund), of being out of sight (Unheimlichkeit) and of being out of dwelling (Un-zuhause-sein) – as the basis of self-confidence of conscious being there (Dasein). The entire criticism of philosophy of home and dwelling draws the inspiration from this early writing of the German philosopher, it combines crisis of basic terms of metaphysics with social conditions which are dictated by living in large metropolis. The crisis of both metaphysical foundation and home appears to be similar to the situation of weakening the relations between a man and his dwelling in extensively expanding cities. Whereas philosophy, as well as many disciplines of social sciences, have diagnosed for a long time the destabilisation of fundamental ideas of Western culture and crucial changes in the ways of dwelling, architecture itself occurred to be “the last fortress of metaphysics” (J. Derrida). Among contemporary architects, Peter Eisenman and Bernard Tschumi were the ones who engaged most decidedly in the issues of critical analysis of architecture foundation and its social role. Both the architects noticed new formulas of contemporary social and individual existence, tremendously different from the entire history, and at the same time they affirmed lack of adequacy of architecture concepts to new situations. Both Eisenman and Tschumi used to describe the existing architecture as a tool for consolidation of highly integrated and hierarchised societies, and also as a discipline extremely uncoincidental with the current character of social life based on ideas of freedom and diversity. The means to transform architecture and make a factor of further social changes out of it, was a concept that accentuated revealing the inner contradictions of this discipline, and considering them in designing strategies. Eisenman’s activity, in regard of what has just been noticed, was focused on questioning the basic rules of traditionally comprehended architecture, especially the rule of purpose. The American architect noticed that the concept of architecture as fulfilment the need of location, hides away the fact that the location has to be constantly reconsidered, and hence it is overtaken by change (dislocation). Therefore new concept of architecture propounded architectural activity to translocate the concept of location – more than before – but also to change its status perpetually. Such comprehended architecture should claim, as its main purpose, the constant revision of this purpose and create itself anew permanently. Even Eisenman’s earliest designs of houses nos. I-IV broke with such values as the sense of safety, closeness and familiarity, and just on the contrary they accentuated senses of strangeness, homelessness and loss of confidence. The contradictions within architecture noticed by Tschumi referred to combination of intellectual and sensual values in architecture, when their non-appropriation was defeated by an additional condition, namely the way of experience based on pleasure of excess, marked by insanity. The features of folly were especially visible in his designs of gardens, where the order of planning was mixed with sensual experience introduced by particular elements (both the ones created by nature, and the buildings defined as folies). Parc de la Villette designed by the French architect in Paris put in question not only the common understanding of purpose in architecture but also the ideas of order and integrity, as its plan was based on the combination of independent layers with records of grids of points, various lines and planes. The architecture that collides inadequate elements with each other was supposed to be a kind of an event with no beginning and no end. The architecture treated as an event became a form of a space weakened articulation that maintains its diversity and lack of accordance of the elements building it up. The analyses of Eisenman and Tschumi’s theoretical writings indicate how much the aims of architecture have actually changed; instead of supporting social persistence, the architecture is rather intensifying contradictions, and instead of providing people with the sense of safety, it sublimes danger. From simple acts of defamiliarisation, increasing the distance to itself and enhancing the role of theory, through discomfort, anxiety, not feeling someone at home, weirdness, excess, shock and violence, architecture reached the edge of stability and uncertainty, only to make an attempt at penetrating what is impossible and unutterable, and recording what cannot become the subject of any records. -/- . In recent work, Rawls, Nozick, and the ?democratic?socialist? theory of Markovi? and Gould, attempt to ground rival models of just economic relations on the basis of conflicting interpretations of human freedom. Beginning with a philosophical conception of humans as essentially free beings, each derives a different system of basic rights and freedoms: (1) the familiar democratic civil and political rights of citizenship in the West (Rawls); (2) the classical bourgeois market freedoms ? ?life, liberty, and property? (Nozick); and (3) democratic (...) socialist rights of self?management of the work?place (Gould and Markovi?). I argue that each of these theorists implicitly assumes a different but ungrounded ?social paradigm of human agency? concerning the particular forms of human choice which are singled out as most important for a free, human life. None of these theories contains the methodological resources for showing why the forms of human agency it ?emancipates? are more important than the forms it suppresses or ignores. In order to overcome this impasse and provide a way of evaluating such rival paradigms of free agency, I elaborate a methodology based on the idea that a free society must provide its members with ?equality in the social bases of self?respect?. I use this methodology to argue that all three of the above conceptions are blind to problems of human agency, freedom, and dignity posed by the modern phenomena of welfare dependency, unemployment, and a self?stultifying division of labor. Recent developments in criminal legislation of the Republic of Lithuania among other significant novelties include the criminalization of illicit enrichment as criminal offence. Such offence presents new legal instrument for the law enforcement in dealing with individuals who acquire property in doubtful ways. The crime of illicit enrichment is rather a novelty within the context of criminal legislation. Such novelty was largely based upon the requirements of United Nations Convention against Corruption, which stipulates the implementation of such legal measure. According (...) to the article Twenty of the convention, “Subject to its constitution and the fundamental principles of its legal system, each State Party shall consider adopting such legislative and other measures as may be necessary to establish as a criminal offence, when committed intentionally, illicit enrichment, that is, a significant increase in the assets of a public official that he or she cannot reasonably explain in relation to his or her lawful income”. While the convention was undoubtedly major factor for making grounds for said developments the need to widen the scope of confiscation of property and impound illegally acquired wealth were the driving forces behind the political will to support amendments to the Criminal Code. At same time the new offence of illicit enrichment presents significant challenges for the investigative bodies with the prosecution as well as the courts establishing such offences. First and foremost, the techniques of criminalization and legal wording of the offence are new and do not go well with the established principles of criminalization. Unnatural features of the corpus of the crime listed in the code (article No. 1891 of the Criminal Code of Lithuania) involve criminal act lacking attributes illegitimacy, complications regarding guilt of the accused. In addition, doubts and questions regarding the fundamental principles of criminal procedure, due process concerns, and problems of the balance of the rights of the accused with the right of the society to recover illicitly acquired wealth. The relationship of illicit enrichment to other criminal acts committed by the same accused is also of a great importance in establishing sources of such enrichment. As for the time of submission of present article, one hundred and seven interrogations on the illicit enrichment were on and lasting while only three simplified judgments and one proper court sentence were passed. The reasons for such slow implementation of the law are the ambiguities of the definition of law, as well as limitations of regulations, insufficiencies in asset declaration systems, lack of theoretical background and complete absence of court practice on such cases. Two of the existing convictions are analyzed from the point of view of establishment of guilt, the evidence set in the case, the grounds of adequacy of such convictions. The examples presented give basis to judge the adequacy of the new law an opportunity to predict the future rulings of the courts. Necessity of the improvements of the law becomes quite obvious on the basis of the analysis. Strong criticisms, various scientific suggestions on the improvements of the regulations, namely on the constitution of guilt, wording of the criminal act are presented by the author. (shrink)

This paper offers an original solution to the problem of the many, built on a foundation of powers-based causation. At its most basic, the solution should be understood as a type of maximality response, and on those grounds its originality might be questioned. However, it is argued that novelty of the solution owes as much to the meta-metaphysical context in which the solution is framed as it does the model of causal powers. Remember how Kim Mental causation, Clarendon Press, Oxford, 1993b) used to argue against non-reductive physicalism to the effect that it cannot accommodate the causal efficacy of the mental? The argument was that if physicalists accept the causal closure of the physical, they are faced with an exclusion problem. In the original version of the argument, the dependence holding between the mental and the physical was cashed out in terms of supervenience. Due to the work or Fine and others, we (...) have since come to realize that modal notions are not well-suited to perform the work of properly characterizing dependence. As a consequence of this, an increasingly larger community of contemporary metaphysicians prefer to spell out mental-physical dependence in terms of a non-causal and non-reductive notion called grounding, which is intended to target a particular sort of metaphysical relation that takes us from ontologically less fundamental features of the world to that which is more fundamental. In this paper I join forces with those who think that this shift in focus is on the right track. More specifically, I will argue that the grounding physicalist can solve the exclusion problem in a way that is preferable to the supervenience-based nonreductive physicalist solution, as well as in a way that is compatible with the externalist picture of the mental. This contribution thematizes the Gadamerian legacy in the context of the Italian philosophical debate, attempting to understand whether this debate can contribute to rethink the vitality of the hermeneutic tradition and the future of its possible developments. When, in 1972, Gianni Vattimo, one of the key figures in contemporary Italian thought, published his seminal translation of Truth and Method, Gadamerian themes began to circulate, in Italy, based on a specific interpretation: The Italian hermeneutic debate received the project of Truth and (...) Method as a kind of philosophical defense of the humanistic tradition. As the inventor of the "weak thought," Vattimo defended the idea that the 'weakening' of the project of the world's scientific rationalization could enhance other experiences related to truth, namely humanistic, artistic, literary, and religious ones. Just like then, the triumph of scientific rationality and calculative thinking places contemporary hermeneutics in front of a daunting task. One must ask whether hermeneutics, in order to remain faithful to the Gadamerian project, should remain essentially a project of metatheoretical foundations of textual interpretation, endowed with a historically and linguistically informed approach, or it should rather radically rethink its relationship to the problem of 'method.' To avoid this deflation of the Gadamerian tradition, one possible way forward is to orient hermeneutic research toward a 'hard' and philosophically grounded idea of objectuality/objectivity, but at the same time not methodologically sterile, that is, not flattened on the methods of the 'hard sciences'. Philosophical investigation in synthetic biology has focused on the knowledge-seeking questions pursued, the kind of engineering techniques used, and on the ethical impact of the products produced. However, little work has been done to investigate the processes by which these epistemological, metaphysical, and ethical forms of inquiry arise in the course of synthetic biology research. An attempt at this work relying on a particular area of synthetic biology will be the aim of this chapter. I focus on the reengineering of (...) metabolic pathways through the manipulation and construction of small DNA-based devices and systems synthetic biology. Rather than focusing on the engineered products or ethical principles that result, I will investigate the processes by which these arise. As such, the attention will be directed to the activities of practitioners, their manipulation of tools, and the use they make of techniques to construct new metabolic devices. Using a science-in-practice approach, I investigate problems at the intersection of science, philosophy of science, and sociology of science. I consider how practitioners within this area of synthetic biology reconfigure biological understanding and ethical categories through active modelling and manipulation of known functional parts, biological pathways for use in the design of microbial machines to solve problems in medicine, technology, and the environment. We might describe this kind of problem-solving as relying on what Helen Longino referred to as “social cognition” or the type of scientific work done within what Hasok Chang calls “systems of practice”. My aim in this chapter will be to investigate the relationship that holds between systems of practice within metabolic engineering research and social cognition. I will attempt to show how knowledge and normative valuation are generated from this particular network of practitioners. In doing so, I suggest that the social nature of scientific inquiry is ineliminable to both knowledge acquisition and ethical evaluations. (shrink)

We define a class of formal systems inspired by Prawitz’s theory of grounds. The latter is a semantics that aims at accounting for epistemic grounding, namely, at explaining why and how deductively valid inferences have the power to epistemically compel to accept the conclusion. Validity is defined in terms of typed objects, called grounds, that reify evidence for given judgments. An inference is valid when a function exists from grounds for the premises to grounds for the conclusion. Grounds are (...) described by formal terms, either directly when the terms are in canonical form, or indirectly when they are in non-canonical form. Non-canonical terms must reduce to canonical form, and two terms may be said to be equal when they converge towards equivalent grounds. In our systems these properties can be proved through rules distinguished according to whether they concern types or logic. Type rules involve type introduction and elimination, equality for application of operational symbols, and re-writing equations for non-canonical terms. The logic amounts to a sort of intuitionistic system in a Gentzen format. To conclude, we show that each system of our class enjoys a normalization property. (shrink)

Frangeskou’s point of departure in his juxtaposition of Levinas and Kant is the problem of transcenden- tal schematism but not the tension between autonomy and heteronomy as it is common for most of the published literature. Thus, the middle ground between Levinas and Kant is occupied by Heidegger, but also by Franz Rosenzweig with his “biblical” version of ecstatic temporality. Levinassian diachrony is described by Frangeskou as a new form of ecstatic temporality, different from the interpretations given by Heidegger (...) and Rosenzweig. It is analogous to transcendental schematism of reason. We briefly com- pare Frangeskou’s interpretation with Marc Richir’s notion of transcendental schematism which also goes back to Levinassian diachronic temporality. Richir’s schematism functions as a medium joining together heterogenous elements such as the layer of “phenomenological”, i.e., the unstable and flick- ering sense, and the layer of “symbolic”, i.e., the organised and stabilised sense. In a similar way, for Frangeskou, diachronic temporality provides a synthesis (though, not a synchronisation) of God, the world and a man. (shrink)
