The Pareto principle is in fact the fundamental concept of welfare economics. However, it has serious analytical and heuristic limits, is selective and conservative in nature and use, and is heavily normative notwithstanding the pretensions by advocates of its positive character.

Certainly principles of criminal liability may be understood as rules or norms outlining orders or prohibitions and standing out among other norms with their weight, for legal culture, legal doctrine, etc. In such a classic approach they are norms defining basic rights and obligations in the applicable criminal law. However, is it the only possible and cognitively interesting meaning of the word “principle” in jurisprudence? From the semiotic point of view, they can occur in three forms: special-kind norms, teleological (...) directives, rules which constitute valid performance of conventional activities. In an extra-directival sense these principles may be understood as models-descriptions of shaping the system of criminal law. From a theoretical and practical point of view principles addressed to the legislator are extremely weighty—they can be called rules constructing the system of criminal liability. I develop a challenge to reductive views of knowing that φ that appeal to what I call a gradable property. Such appeal allows for properties that are intrinsically very similar to the property of knowing that φ, but differ significantly in their normative significance. This violates the independently plausible claim Pautz (2017) labels the small difference principle.

I have been supposing that for the theory of reasoning, explicit belief is an all-or-nothing matter, I have assumed that, as far as principles of reasoning are concerned, one either believes something explicitly or one does not; in other words an appropriate "representation" is either in one's "memory" or not. The principles of reasoning are principles for modifying such all-or-nothing representations. This is not to deny that in some ways belief is a matter of degree. For one thing implicit belief (...) is certainly a matter of degree, since it is a matter of how easily and automatically one can infer something from what one believes explicitly. Furthermore, explicit belief is a matter of degree in the sense that one believes some things more strongly than others. Sometimes one is only somewhat inclined to believe something, sometimes one is not sure what to believe, sometimes one is inclined to disbelieve something, sometimes one is quite confident something is not so, and so forth. It is a striking fact from reverse mathematics that almost all theorems of countable and countably representable mathematics are equivalent to just five subsystems of second order arithmetic. The standard view is that the significance of these equivalences lies in the set existence principles that are necessary and sufficient to prove those theorems. In this article I analyse the role of set existence principles in reverse mathematics, and argue that they are best understood as closure conditions on the powerset (...) of the natural numbers. The aim of this article is to examine Frege’s view of the context principle in his mature philosophical doctrine. Here, the author argues that the context principle is embodied in the contextual explanation of value-ranges presented in Basic Laws of Arithmetic. The contextual explanation of value-ranges plays essentially the same role as the context principle in The Foundations of Arithmetic. It is supposed to show how a reference to natural numbers is possible. Moreover, the author argues against the (...) class='Hi'>view that the context principle should be separated from the recarving thesis. This aspect of Frege’s view leads the author to the rejection of the purely referential view of the context principle, which is fairly widely accepted in the current literature. (shrink)

In the law, it is generally acknowledged that there are intuitive differences between reasoning with rules and reasoning with principles. For instance, a rule seems to lead directly to its conclusion if its condition is satisfied, while a principle seems to lead merely to a reason for its conclusion. However, the implications of these intuitive differences for the logical status of rules and principles remain controversial.A radical opinion has been put forward by Dworkin (1978). The intuitive differences led him to (...) argue for a strict logical distinction between rules and principles. Ever since, there has been a controversy whether the intuitive differences between rules and principles require a strict logical distinction between the two. One of the goals of medicine is to improve well-being, in line with the principle of beneficence. Likewise, scientists claim that the goal of human embryonic stem cell research is to find treatments for diseases. In hESC research, stem cells are harvested from a 5-day-old embryo. Surplus embryos from infertility treatments or embryos created for the sole purpose of harvesting stem cells are used in the research, and in the process the embryos get destroyed. The use of human embryos for (...) research purpose raises ethical concern. In this context, the religious leaders play the role to be the moral compass and “reality check” to engage with the public. In Malaysia, the Ministry of Health has outlined the Guidelines for Stem Cell Research and Therapy, reflecting on Islamic principles. Since there has not been much focus on the viewpoints of other faiths in Malaysia, this study attempts to explore the ethical guiding principles deliberated by religious leaders from the Buddhist, Hindu and Catholic traditions and identify if there is a common ground between the mainstream religious views and principles of medical ethics, in relation to hESC research. Eleven religious leaders representing the Buddhist, Hindu and Catholic traditions were interviewed. Interestingly, though reasoning of religious leaders came from different angles, their underlying concerns revolve around the values of “do no harm” and “intention to save lives”. These values are also the key principles in medical ethics. The findings are applied to answer the question as to whether religious and medical guiding principles can co-exist and complement in ethical decision-making, without compromising the values. Stephen Nathanson's clear-sighted abridgment of Principles of Political Economy, Mill's first major work in moral and political philosophy, provides a challenging, sometimes surprising account of Mill's views on many important topics: socialism, population, the status of women, the cultural bases of economic productivity, the causes and possible cures of poverty, the nature of property rights, taxation, and the legitimate functions of government. Nathanson cuts through the dated and less relevant sections of this large work and includes significant material omitted in (...) other editions, making it possible to see the connections between the views Mill expressed in Principles of Political Economy and the ideas he defended in his later works, particularly On Liberty. Indeed, studying Principles of Political Economy, Nathanson argues in his general Introduction, can help to resolve the apparent contradiction between Mill's views in On Liberty and those in Utilitarianism, making it a key text for understanding Mill’s philosophy as a whole. The Principle of Sufficient Reason is very seldom, if ever, referred to in the works of whom we might think of as the eminent Asian metaphysicians. In spite of this, the big picture metaphysical views available in the thought of philosophers such as Nāgārjuna, Fazang and Nishida appear to share certain structural features with views more familiar to us from our own tradition; views that explicitly accept or reject the Principle of Sufficient Reason. Nāgārjuna looks to develop a kind of (...) metaphysical infinitism, Fazang an extreme form of coherentism, and Nishida a species of foundationalism. These three positions - infinitism, coherentism and foundationalism - are typically thought to exhaust the spread of possibilities by those working within the Western tradition. -/- In spite of their similarities to positions advanced within our own tradition, the cosmologies of many of the giants of Asian philosophy are characterised by their rather striking conclusions. Amongst such conclusions for Nāgārjuna is that everything is empty; for Fazang that everything is identical to everything else; and for Nishida that everything depends on absolute nothingness. If the Principle of Sufficient Reason is playing a role in the derivation of such striking conclusions, then it looks that there are more options regarding the metaphysical structure of the world available to us than our own tradition typically courts. If, on the other hand, these striking cosmological conclusions are arrived at without any consideration of sufficient reason, then there may well be ways of reasoning about the overarching structure of reality that are powerful but unfamiliar to Western thinking. In this contribution, I explore what, if any, role the PSR might be playing in the thought of Nāgārjuna , Fazang and Nishida, and what we might be able to learn from it. (shrink)

One of the main motivations for having a compositional semantics is the account of the productivity of natural languages. Formal languages are often part of the account of productivity, i.e., of how beings with finite capaci- ties are able to produce and understand a potentially infinite number of sen- tences, by offering a model of this process. This account of productivity con- sists in the generation of proofs in a formal system, that is taken to represent the way speakers grasp (...) the meaning of an indefinite number of sentences. The informational basis is restricted to what is represented in the lexicon. This constraint is considered as a requirement for the account of productivity, or at least of an important feature of productivity, namely, that we can grasp auto- matically the meaning of a huge number of complex expressions, far beyond what can be memorized. However, empirical results in psycholinguistics, and especially particular patterns of ERP, show that the brain integrates informa- tion of different sources very fast, without any felt effort on the part of the speaker. This shows that formal procedures do not explain productivity. How- ever, formal models are still useful in the account of how we get at the seman- tic value of a complex expression, once we have the meanings of its parts, even if there is no formal explanation of how we get at those meanings. A practice-oriented view of modeling gives an adequate interpretation of this re- sult: formal compositional semantics may be a useful model for some ex- planatory purposes concerning natural languages, without being a good model for dealing with other explananda. Moral philosophy has long been dominated by the aim of understanding morality and the virtues in terms of principles. However, the underlying assumption that this is the best approach has received almost no defence, and has been attacked by particularists, who argue that the traditional link between morality and principles is little more than an unwarranted prejudice.
