Formulations of Mill's principle of utility are examined, and it is shown that Mill did not recognize a moral obligation to maximize the good, as is often assumed. His was neither a maximizing act nor rule utilitarianism. It was a distinctive minimizing utilitarianism which morally obligates us only to abstain from inflicting harm, to prevent harm, to provide for others minimal essentials of well being (to which rights correspond), and to be occasionally charitable or benevolent.

One aspect of the intellectual changes taking place in China in the late nineteenth and early twentieth centuries was the emergence of utilitarian ideas. Although it may be useful to think of modern Chinese thought from the perspective of the emergence of social Darwinism and nationalism, it is significant that the country's most progressive scholars at the turn of thecentury derived their inspiration from utilitarianism. In my dissertation, I analyze, interpret, and defend John Stuart Mill's proof of the principle of utility in the fourth chapter of his Utilitarianism. My purpose is not to glorify utilitarianism, in a full sweep, as the best normative ethical theory, or even to vindicate, on a more specific level, Mill's universalistic ethical hedonism as the best form of utilitarianism. I am concerned only with Mill's utilitarianism, and primarily with his proof of the principle of utility. (...) My overarching purpose guiding the entire work is to show that Mill proceeds intelligibly and systematically in pursuing a well-defined project in the fourth chapter of Utilitarianism, and that he successfully defends what he sets out to establish in his proof of the principle of utility. To this end, I devote the bulk of my efforts to studying and responding to traditionally popular and persistently enduring objections to the proof that are handed down from one generation to the next in the philosophical community as a standard companion to Utilitarianism. The primary objections to which I respond at length are the charges that Mill commits the naturalistic fallacy, the fallacy of equivocation, and the fallacy of composition in his proof. Secondary literature on the subject consists of journal articles and book chapters that treat one or another but not all of these problems. My research has convinced me that, although these commentaries are generally quite good, they are mutually incompatible, and they are neither severally nor jointly sufficient to produce the kind of comprehensive defense that would do justice to Mill's proof of the principle of utility. This kind of comprehensive defense is what I intend to contribute to secondary literature on the subject. Specifically, my ultimate contribution to secondary literature is an interpretation of Mill's proof of the principle of utility in its entirety, absolved of the three fallacies commonly attributed to the proof, yet faithful to the text at all points. How many serious mistakes can a brilliant philosopher make in a single paragraph? Many think that Mill answers this question by example—in the third paragraph of Chapter IV of Utilitarianism. Here is the notorious paragraph: The only proof capable of being given that an object is visible, is that people actually see it. The only proof that a sound is audible, is that people hear it: and so of the other sources of our experience. In like manner, I apprehend, the (...) sole evidence it is possible to produce that anything is desirable, is that people do actually desire it. If the end which the utilitarian doctrine proposes to itself were not, in theory and in practice, acknowledged to be an end, nothing could ever convince any person that it was so. No reason can be given why the general happiness is desirable, except that each person, so far as he believes it to be attainable, desires his own happiness. This, however, being a fact, we have not only all the proof which the case admits of, but all which it is possible to require, that happiness is a good: that each person's happiness is a good to that person, and the general happiness, therefore, a good to the aggregate of all persons. Utilitarianism is a “consequentialist” doctrine: that actions are right or wrong in proportion as they produce good or bad consequences. Mill’s version is also a “hedonistic” doctrine. Consequences are good insofar as they have more happiness or less unhappiness; bad, as they have more unhap- piness or less happiness; and by happiness and unhappiness, Mill means pleasure and pain. In English, the words “happiness” and “unhappiness” do not have the same connotations as “pleasure” and “pain.” “Happiness” implies feeling good about (...) one’s life as well as feeling good. “Happiness” is found in relationships with friends and loved ones and in a sense of accomplishment. “Pleasure” seems to be something that is momentary and more sensational. But according to Mill’s psy- chology, a happy life consists in many pleasures and few pains. The happiness of relationships with friends and loved ones is reducible to the joys and satisfactions in the moments of one’s life that arise from these relationships. The happiness of a sense of accomplishment consists of the pleasurable states of consciousness that arise from a sense of accomplishment. The happiness of self-respect and the unhap- piness of self-disrespect consist of the pleasurable and painful states of conscious- ness that these involve. This reduction of happiness and unhappiness to pleasures and pains is a controversial element in Mill’s philosophy. I leave it to the reader to think about that reduction. The standard rationality hypothesis implies that behaviour can be represented as the maximization of a suitably restricted utility function. This hypothesis lies at the heart of a large body of recent work in economics, of course, but also in political science, ethics, and other major branches of social sciences. Though the utility maximization hypothesis is venerable, it remains an area of active research. Moreover, some fundamental conceptual problems remain unresolved, or at best have resolutions that are too recent (...) to have achieved widespread understanding among social scientists. The main purpose of the Handbook of Utility Theory is to make recent developments in the area more accessible. The editors selected a number of specific topics, and invited contributions from researchers whose work had come to their attention. In the introductory chapter of his essay on Utilitarianism, John Stuart Mill says his aim is to contribute towards the understanding of utilitarianism and towards ‘such proof as it is susceptible of’. He immediately adds that ‘this cannot be proof in the ordinary and popular meaning of the term’ because ‘ultimate ends are not amenable to direct proof’. A proof that something is good has to show that it is ‘a means to something admitted to be good without proof’. But, (...) he goes on, this does not imply that a formula of ultimate ends can only be accepted on ‘blind impulse, or arbitrary choice’. Is j s mill's concept of liberty basically utilitarian? the 'utilitarian' justifies action if it promotes the ends of happiness or pleasure. But for mill liberty is neither defined nor justified by reference to any felicific calculus. Rather, His concept of liberty seems to be based on (1) natural rights theory and (2) a consideration of its social benefits.

The main result of this paper is a formal argument for the principle of maximizing expected utility that does not rely on the law of large numbers. Unlike the well-known arguments by Savage and von Neumann & Morgenstern, this argument does not presuppose the sure-thing principle or the independence axiom. The principal idea is to use the concept of transformative decision rules for decomposing the principle of maximizing expected utility into a sequence of normatively reasonable (...) subrules. This paper summarizes and rebuts the three standard objections made by social choice theorists against interpersonal utility. The first objection argues that interpersonal utility is measningless. I show that this objection either focuses on irrelevant kinds of meaning or else uses implausible criteria of meaningfulness. The second objection argues that interpersonal utility has no role to play in social choice theory. I show that on the contrary interpersonal utility is useful in formulating goals for social choice. (...) The third objection argues that interpersonal utility in social choice theory can be replaced by clearer notions. I show that the replacements proposed are unsatisfactory in either interpersonal utility's descriptive or explanatory role. On the orthodox view in economics, interpersonal comparisons of utility are not empirically meaningful, and "hence" impossible. To reassess this view, this paper draws on the parallels between the problem of interpersonal comparisons of utility and the problem of translation of linguistic meaning, as explored by Quine. I discuss several cases of what the empirical evidence for interpersonal comparisonsof utility might be and show that, even on the strongest of these, interpersonal comparisons are empirically underdetermined and, if (...) we also deny any appropriate truth of the matter, indeterminate. However, the underdetermination can be broken non-arbitrarily (though not purely empirically) if (i) we assign normative significance to certain states of affairs or (ii) we posit a fixed connection between certain empirically observable proxies and utility. I conclude that, even if interpersonal comparisons are not empirically meaningful, they are not in principle impossible. (shrink)

This article argues that there is a natural solution to carry out interpersonal comparisons of utility when the theory of gambles is supplemented with a group operation of joint receipts. If so, three types of people can exist, and the two types having multiplicative representations of joint receipt have, in contrast to most utility theories, absolute scales of utility. This makes possible, at least in principle, meaningful interpersonal comparisons of utility with desirable properties, thus resolving (...) a long standing philosophical problem and having potentially important implications in economics. ABSTRACT:The purpose of this paper is to formulate and defend a set of moral principles applicable to management. Our motivation is twofold: 1) to increase the coherence and utility of Integrative Social Contracts Theory (ISCT); and 2) to initiate an alternative stream of business ethics research. To those ends, we specify what counts as adequate guidance in navigating the ethical terrain of business. In doing so, a key element of ISCT, Substantive Hypernorms, is found to be flawed beyond repair. (...) So we propose and defend a remedy:prima faciemoral principles. In spite of his importance as jurist, philosopher, and social scientist, and leader of the Utilitarian reformers, the only previous edition of his works was a poorly edited and incomplete one brought out within a decade or so of his death. Eight volumes of the new Collected Works, five of correspondence, and three (...) of writings on jurisprudence, appeared between 1968 and 1981, published by the Athlone Press. John Stuart Mill proposed that all policy precepts, be they in the areas of morality or prudence or aesthetics, are all subordinate to the precepts of the Art of Life. The value which he assumes in defining the Art of Life is the Principle of Utility. This principle, being normative rather than fact, can admit of no proof based solely on deductive inference. Yet Mill proposed considerations that he believed capable of rationally persuading one to accept his (...) principle as the basic principle for the Art of Life. This paper aims to evaluate this argument. In particular, it tries to show that a crucial step, often thought to be a logical howler, is not to be so simply dismissed. It is shown that if one accepts certain theses from Mill's philosophy of science and of social science, concerning the composition of causes, then the crucial step is fully justified. It is also suggested that these theses of Mill's philosophy of science are mistaken. So Mill's proof of utility is, after all, unsound, but the reconstruction proposed shows it to be much more plausible and much more philosophically interesting than is often thought. (shrink)

In summary, the question of how to construe the procedure called reversibility cannot be given an absolute answer. No one moral interpretation of the principle is universally applicable, that is, applicable to all moral issues. The decision concerning which to apply cannot be made a priori, but only in context - that is, only when we are faced with a particular moral problem. Moreover, there appears to be no rule which would enable us to choose which version is correct (...) in a particular case. It is a matter of judgment.That the various versions represent a moral progression from lower to higher constructions is debatable. We have seen that the altruism of reversibility3 - the ethic of care - may recommend itself in some personal relations to the point of making either version of reversibility4 irrelevant. Similarly, it is not clear that reversibility3 is always higher than reversibility2. For example, parents in trying to decide what is morally best for a young child should often - in the spirit of the second construction - substitute the judgment of their mature selves for the judgment of the immature self of the child. Moreover, this substitution may not be justifiable in terms of either utility or autonomy.If I seem to have ignored reversibility1 in this discussion that is because I consider it outside morality: it is, if anything, a principle of self-interested calculation. If Baier is correct in holding that we teach children to think morally when we get them to take the standpoint of others, that requires, I believe, getting them beyond the stage of crude reciprocity. If Piaget and Kohlberg are correct in their developmental claims, we cannot immediately teach children reversibility4 but must help them progress through the other two versions. There is some basis for thinking that children can transcend egoism and sympathize with others much earlier than Kohlberg allows - an important consideration in the development of a system of moral education. That point has been pursued by Michael Pritchard in his critique of Kohlberg. Pritchard, p 44. My point is a different one: even granting Kohlberg's theory of development (which asserts, for example, that a particular cognitive ability is required to think like a Kantian), it does not follow that the moral thinking which accompanies the highest cognitive stage is morally superior to the moral thinking which accompanies the lesser cognitive stages. That it is cognitively easier to master reversibility3 than reversibility4 does not settle the question of which is morally superior. Rather than arguing about which moral version of reversibility is morally best- a pointless debate if the desirability of a version is understood as contingent upon appropriateness with respect to context - we should instead celebrate the richness of the concept of reversibility. In teaching students the moral point of view by getting them to put themselves in another's place, we would not be asking them to master a rigid formula, but rather to be sensitive to the decisional context and to make a thoughtful judgment about which version of reversibility is most appropriate to that context. We would not be teaching them either moral relativism or moral absolutism, but the complexity of trying to make a moral decision by applying an ancient and philosophically rich ethical principle. Public health ethics is a subfield of bioethics that focuses on population health. This study aims to conform the principles of biomedical ethics to Islamic values in the context of public health. It culturally helps to optimize health care delivery. The approach is based on the method of immanent critique. The principle of the common good in Islam has a rational justification to draw public interests and ward off harms. The rule of “no harm”, with an emphasis on the (...) preferability of preventing harm to increase benefits, is consistent with the principle of utility, intending to produce a maximum balance of benefit over harm in the context of public health. Thus, on the one hand, the government is obliged to prevent harm and improve public benefits and, on the other hand, as a steward of health and with reference to the article “limitation of the ownership dominance”, it has the right to protect public health with the least justifiable harm. Islam attention to human dignity, individual justice and good will in the rule of goodness implies that Islam, beyond distributive justice, knows that human flourishing and the cultivation of moral virtues are a requisite for the realization of social justice. The present study discusses about the adjustment of the principles of PHE to the principles of the Islamic jurisprudence and, at the same time, it explains why the optimal PH in Muslim societies requires research in order to define accurate indicators of benefit and harm based on the teachings of revelation and reason. Some people have supposed that utility is good in itself, non-in-strumentally good, as distinct from good because conducive to other good things. And in modern versions of this view, utility often means want-satisfaction, as distinct from pleasure or happiness. For your want that p to be satisfied, is it necessary that you know or believe that p, or sufficient merely that p is true? However that question is answered, there are problems with the view that want-satisfaction is a (...) non-instrumental good. What if you want something only because you have a false belief? What if the time at which you want that p is fifty or five hundred years before the time to which p itself refers? To meet these difficulties, qualifications have to be introduced, and much has been written about how exactly these qualifications are to be framed.1 There is however what may be a rather more serious objection to the view that want-satisfaction is a non-instrumental good, or rather to the combination of that view with the principle that it is sufficient for your want that p to be satisfied simply that p is true. The objection is that this combination forces you to give undue weight to the mere acquisition of desires when you come to make judgements about changes in the value of things. It forces you to say that for any true proposition p, which initially you do not want to be true, your mere acquisition of a desire that p will, other things being equal, make the world better. Non-instrumental value can be increased merely by multiplying desires, even though everything else remains the same. Surely, however, improving the world is not as easy as that. (shrink)

The thesis that rationality consists in the straight-forward maximization of utility has not lacked critics. Typically, however, detractors reject the Humean picture of rationality upon which it seems based; they seek to emancipate reason from the tyranny of the passions. It is, then, noteworthy when an attack on this thesis comes from ‘within the ranks.’David Gauthier's paper ‘Reason and Maximization’ is just such an attack; and for this reason, among others, it is interesting. It is not successful, though. In (...) defense of this conclusion, we shall begin by relating the essentials of Gauthier's argument. Then we shall examine in some detail Gauthier's claim that the principle of straighforward max-imization fails to be self-supporting. We shall argue that Gauthier's defense of this claim is at best incomplete. In the case of cognitively impaired persons, the question arises whether it is compatible with humane healthcare not only to treat, but also to use these patients for research purposes. Some bioethicists and theologians have formulated a general duty of solidarity, also pertaining to cognitively impaired persons, as a justification for research on these persons. (...) If one examines this thesis from the theory of justice according to John Rawls, it is revealed that such a duty of solidarity cannot necessarily be extrapolated from Rawls' conception of justice. This is at least true of Rawls' difference principle, because accordingto the difference principle only those measures are justifiable which serve the interest of the respective least well off. Those measures which would engender additional injury for the least well off could not be balanced by any utility according to Rawls. However, John Rawls' difference principle is subordinate to the first principle, which is that each person has an equal right to the most extensive basic liberty compatible with the same liberty for others. These primary goods are determined by the freedom and integrity of the person. This integrity of decisionally impaired persons would be in danger if one would abstain from research and thus forego the increase in knowledge related to their disease. Thus one could conclude, at least from Rawls' first principle, that society must take on a duty to guarantee the degrees of freedom for cognitively impaired persons and thus also support the efforts for their healing. This paper offers a contemporary pan-denominational and postmodern Jewish theology. It utilizes the tools of Jewish theological scholarship within a uniquely midrashic format. This format of creative narrative text and scholarly commentary grounds these theological principles within the recognizable stylized system of traditional Jewish exegesis. Rabyam’s theology and the accompanying integral commentary reflect and elucidate feminist, postmodern theological concerns and attitudes. It is my contention that this unique theology is a vital contribution to an inclusive twenty-first century understanding of the (...) Divine. Though the principles of faith alone speak to a general audience, when combined with the annotated commentary, they fill a gap in current scholarship and contribute to a more holistic understanding of a post-modern Judaism not confined to a particular denomination or particular ethos. These principles reflect a Jewish world that is ‘fragmentary, contradictory and turbulent’, as theologian Emile Fackenheim argued. (shrink)
