It is commonly thought that neo-Hobbesian contractarianism cannot yield direct moral standing for marginal humans and animals. However, it has been argued that marginal humans and animals can have a form of direct moral standing under neo-Hobbesian contractarianism: secondary moral standing. I will argue that, even if such standing is direct, this account is unsatisfactory because it is counterintuitive and fragile.

This paper aims to show the advantages of the personal ethics perspective employed by the British idealists in the analysis of justice. In the context of Green’s and Bosanquet’s political theory, justice is a secondary moral ideal. Yet, it is argued here, their moral philosophy leads us, through a longer path, to the philosophical grounds we already occupy today: those of thinking about human rights as fundamental, not derivative, i.e. thinking about justice as a primary, not (...) secondary moral ideal. There are three related yet distinct philosophical claims here. First, the British idealists saw clearly the stand-off between justice and virtue. Second, the personal ethics of Green and Bosanquet, with some reconstruction offered here, outlines the way in which this stand-off can be resolved without undermining its significance. Third, the personal ethics perspective is beneficial for resolving some of the difficulties surrounding the institutional approach of implementing of social justice. (shrink)

A legal system consists of a complex body of practices—primary and secondary—, particularly practices of reasoning and justification. The intellectual, theorized aspect of legal order is embodied in legal doctrine: the corpus of norm-sentences, norms and rules, principles, doctrines and concepts used as basis for legal reasoning and justification. It includes elaborate conceptual structures of principles and doctrines, explicit and sophisticated forms of reflection and criticism. It is only when we have understood the nature of legal doctrine that (...) we can comprehend the workings of courts, lawyers and even legislatures. Concerning the need for a new conception of legal theory one question arises, above all, especially when external and internal observation as well as the critical reflection of the premises and presuppositions of all dealings with the law permit a degree of distance, the question, namely, whether it is not an increasing application of scientific methods that is needed, in the sense that the development of a legal theory from the beginning involves the integration of a norm-descriptive point of view and intellectual stand-point with the norm-prescriptive theory of law, by way of complementing each other, as it were (multi-level-approach to law). This, at least, appears to be the only way of clarifying also the relationship between le­gal theory and philosophy and the theory and sociology of law. The inevitable consequences of the development of a theory of norms and action also have to be drawn from this. (shrink)

The Ministry of Education of China put forward the concept of “core literacy system” for the first time in the “Opinions on Comprehensively Deepening Curriculum Reform and Implementing the Fundamental Tasks of Moral Education” issued in 2014. This is a new educational reform policy put forward by China based on fully combining China’s national conditions and the new requirements for human development in the 21st century, which has important guiding significance for China’s educational reform. After discussing the background, content, (...) and meaning of core literacy, this study points out the current situation and development trend of core literacy in primary and secondary schools in China and then puts forward guiding opinions on the development of core literacy in rural primary and secondary schools. With the widening gap between urban and rural education, rural people are in urgent need of high-quality educational resources. To narrow the gap between urban and rural education and promote the democratization of education in China, we must unswervingly implement the education reform with the core element system as the key field and main link. There are two primary traditions in philosophical theorizing about moral standing—one emphasizing Experience (the capacity to feel pain and pleasure) and one emphasizing Agency (complexity of cognition and lifestyle). In this article we offer an explanation for this divide: Lay judgments about moral standing depend importantly on two independent cues (Experience and Agency), and the two philosophical traditions reflect this aspect of folk moral cognition. In support of this two-source hypothesis, we present the results (...) of a series of new experiments providing evidence for our account of lay judgments about moral standing, and argue that these results lend plausibility to the proposed causal link between folk moral cognition and the philosophical traditions. The aim of this article is to give an account of the distinction between primary and secondary qualities in a way which allows the distinction a useful place in an explanation of scientific enquiry. this is done by modifying certain of locke's criteria for primacy, and by showing that this procedure has certain advantages over keith campbell's account of the distinction. in particular, i argue that primary qualities cannot be specified in a theory-neutral way, and that this (...) has important consequences for an account of scientific observation and the relation between the scientific and everyday images of the world. The understanding of the primary-secondary quality distinction has shifted focus from the mechanical philosophers’ proposal of primary qualities as explanatorily fundamental to current theorists’ proposal of secondary qualities as metaphysically perceiver dependent. The chapter critically examines this shift and current arguments to uphold the primary-secondary quality distinction on the basis of the perceiver dependence of color; one focus of the discussion is the role of qualia in these arguments. It then describes and criticizes reasons (...) for characterizing color, smell, taste, sound, and warmth and color as secondary qualities on the basis of our commonsense divisions among sensory modalities; Grice’s proposal for distinguishing among the sensory modalities is focal here. I provide an explanation of moral understanding. I begin by describing decisions, es- pecially moral ones. I detail ways in which deviations from an ideal of decision-making occur. I link deviations to characteristic critical judgments, e.g. being cavalier, banal, coura- geous, etc. Moral judgments are among these and carry a particular personal gravity. The question I entertain in following chapters is: how do they carry this gravity? In answering the question, I try “external” accounts of moral (...) understanding. I distin- guish between the ideas of a person and a life. The idea of a life essayed is of a network of relations to others. The character of those relations, e.g. friendship, is the object of our understanding of ourselves and our lives. I argue that one’s understanding of oneself conditions the context of decision-making. I elaborate one way of making moral under- standing answerable to truth using Plato’s metaphysics in the Philebus. Truth is valued and truth is essential to the independence of the moral such that seeming right and being right are distinct. However, truth is neither primary nor exhaustive of morality, because we have additional distinct resources for morally judging others. I turn instead to an “internal” account of moral understanding to answer the question regarding the personal gravity of moral criticism. Using Winch’s work on universalizabil- ity and fellowship, I argue that our conception of others must be sufficient to reflect their individuality within our moral understanding. Second, using Gaita’s work on remorse and the lucidity of self-reflection, I argue that the truth about ourselves and the wrong we do others can arrest and constrain our moral understanding and our authority. Moral understanding operates in a social milieu: argument, conversation and rational- ity. Arguments are grounded in meanings with primary (shared) sense, but solicit agree- ment in secondary sense—of what is similar, of what follows. Meaning in the secondary sense can be necessarily practical, creating practical necessities within points of view. Accounting for the consequences and understanding of disagreement is identified as pressing. An original contribution is the idea of critical authority. One’s articulation of moral meaning is controlled via the critical authority expressed using critical vocabulary. Accepting another’s critical authority is based, in differing domains, on our relation to them, e.g. friendship, trust, fellowship. The nature of inter-personal relations are delim- ited by the critical authority characteristic of those relations. Critical authority explains the independent and personal force of moral criticism. To be intelligible depends on accepting some critical authorities, though I allow for the intelligible repudiation of morality in some circumstances. Wronging someone is ex- plained as denying his critical authority, thus denying his relation to oneself, and thereby undermining his place in the moral world. The consequence of wrongdoing is the disinte- gration of the moral world. I defend against Nagel’s realism and Korsgaard’s constructivism. Both are committed to judging individuals but their accounts of morality undermine the intelligibility of the personal gravity of moral criticism. Developing the idea of Moral Consensus, I defend myself against the related charge of relativism. (shrink)

Samuel Clarke is best known to historians of science for presenting Isaac Newton’s views to a wider audience, especially in his famous correspondence with G. W. Leibniz. Clarke’s independent writings, however, reveal positions that do not derive from, and do not coincide with, Newton’s. This essay compares Clarke’s and Newton’s ideas on the cause of gravity, with a view to clarifying our understanding of Newton’s views. There is evidence to suggest that Newton believed God was directly responsible for gravity, and (...) this interpretation has been promoted by a number of scholars. By comparing Newton’s views with those of Clarke, however, it can be seen that Newton did not subscribe to the kind of occasionalist approach to gravity that Clarke developed. Clarke insisted that matter was categorically incapable of being endowed with powers or forces and that therefore what looks like gravitational attraction has to be performed directly by God or by angels. By comparing Clarke’s pronouncements with Newton’s, it becomes clear that Newton adopted the more standard line: that the first cause, God, operated in nature through secondary causes and that gravitational attraction was just such a secondary (albeit occult) cause. A formal, logical, theory of events is developed and used as the basis for a definition of causation and to provide a pragmatics for causal counterfactuals. The theory begins with with a logical formalization of events as represented in the planner strips. The resulting inertial theories include a common sense law of inertia and their pragmatics is based on the principle of chronological minimization. The theory of events is then developed by removing some of the simplifying assumptions of the strips (...) representation. To begin with the assumption that events always succeed, given that their preconditions are true when they occur, is dropped. Instead a common sense law of change is introduced with the effect that events normally succeed but may fail if some qualification (some unusual or unexpected condition) arises. The pragmatics of the resulting causal theories is provided by refining the pragmatics of inertial theories. In particular, where there is a conflict between change and inertia, preference is given to change. The resulting defeasibility of events makes it possible to remove the strips assumption that only one event occurs at any given time; as conflicting events now result in failure rather than inconsistency. However it is desirable to provide a means for adjudicating between conflicting events. Consequently the theory is extended so that qualification preferences can be specified and the pragmatics are refined accordingly. A further strips assumption is that the effects of an event are invariant. In order to remove this assumption a distinction is drawn between primary events, events of the kind described above, and secondary events. Secondary events are invoked by primary events in appropriate contexts, they are causally dependent on primary events and when successful produce the additional, variant, effects of the primary events which invoke them. As a result, both the context-dependent effects of events (their ramifications) and non-deterministic events (events whose outcome is uncertain) can be represented. The theory of primary and secondary events is then used as the basis for a definition of causation which can be seen as providing a formal account of Mackie's definition of a cause as an inus condition. A major theme of this paper is the conflict between the opposite but complementary principles of change and inertia. For much of the paper the emphasis is on restricting the effects of inertia and favouring change. The resulting imbalance becomes unnatural when considering the combined effects of several events. However the definition of causation makes it possible to state a law of change and inertia, which is used to regulate change and inertia and thus ensure a proper balance between them: while caused change is preferred to inertia, inertia is preferred to uncaused change. The theory is then used to provide a pragmatics for causal counterfactuals, thereby extending the representation of actual causal reasoning to counterfactual causal reasoning. This is illustrated by the use of causal counterfactuals in order to obtain explanations. (shrink)

Philosophers and natural scientists have often drawn a distinction between two kinds of properties that physical objects may have. It is particularly associated with atomistic accounts of matter, and is as old as the ancient Greek theories of Democritus and Epicurus. According to the atomists, matter consists of tiny particles ‐ atoms ‐ having no other properties than those such as shape, weight, solidity, and size. Other putative properties ‐ for example, those of color, taste, and smell ‐ were regarded (...) as the names of experiences caused by the impact of particles on an observer, and had no independent existence as qualities in the object. Since the seventeenth century it has been normal to characterize the division between these two supposedly different kinds of properties as the primary‐secondary quality distinction. (shrink)

In this paper, I argue that Book II, Chapter viii of Locke' Essay is a unified, self-consistent whole, and that the appearance of inconsistency is due largely to anachronistic misreadings and misunderstandings. The key to the distinction between primary and secondary qualities is that the former are, while the latter are not, real properties, i.e., properties that exist in bodies independently of being perceived. Once the distinction is properly understood, it becomes clear that Locke's arguments for it are (...) simple, valid and (in one case) persuasive as well. (shrink)
