This essay challenges the widely accepted principle that a person is morally responsible for what he has done only if he could have done otherwise. The author considers situations in which there are sufficient conditions for a certain choice or action to be performed by someone, So that it is impossible for the person to choose or to do otherwise, But in which these conditions do not in any way bring it about that the person chooses or acts as he (...) does. In such situations the person may well be morally responsible for what he chooses or does despite his inability to choose or to do otherwise. Finally the author considers certain suggestions for revising the principle he rejects or for replacing it with a principle of an altogether different kind. (shrink)

From its use in literary theory, film criticism and the discourse of games design, Salomé Voegelin expands 'possible world theory' to think the worlding of sound in music, in art and in the everyday. The modal logic of possible worlds, articulated principally via David K. Lewis and developed through Maurice Merleau-Ponty's phenomenological life-worlds, creates a view on the invisible slices of the world and reflects on how to make them count, politically and aesthetically. The Possibility of Philosophy presents the notes Maurice Merleau-Ponty prepared for three courses he taught at the Collège de France. Two of these courses were the last he taught before his unexpected death in 1961.

Drawing upon the life and work of S. Kay Toombs, I explore the impact and import of phenomenological accounts of disability for the existentialist tradition. Through the case of multiple sclerosis, a noncongenital, late-onset, and degenerative disability, I show how the general structures that emerge from its lived experience largely support a mere-difference view of disability and highlight the need for an equitably habitable world. I further argue that phenomenological accounts of disability demonstrate accessibility to be the defining feature of (...) what it means to be embodied as we are. I conclude with a discussion of the more general philosophical relationship between disability, embodiment, and existentialism. (shrink)

Our moral obligations can sometimes be collective in nature: They can jointly attach to two or more agents in that neither agent has that obligation on their own, but they – in some sense – share it or have it in common. In order for two or more agents to jointly hold an obligation to address some joint necessity problem they must have joint ability to address that problem. Joint ability is highly context-dependent and particularly sensitive to shared (or even (...) common) beliefs. As such, joint ability can be deliberately generated in a given collection of agents by providing information related to collective goals and contributory actions. As moral agents, we regularly face problems wherein the outcome of our actions depends on how others choose. There are two ways of deliberating about our own choices in such cases. We can either think of our choices as best responses to others’ choices (I-mode reasoning). Or we can think of our own choices as contributions to the collectively best option (even when we do not know how others are (likely) to choose) (we-mode reasoning). In deliberating about the right (individual) course of action vis-à-vis collective action problems, agents regularly we-frame the case at hand, that is, they include options in their deliberation that are only collectively available, and they we-reason with regard to their individual contributory actions. It is a necessary condition for collective obligations that potential collaborators facing a joint necessity case have grounds to privilege we-reasoning over reasoning in I-mode. (shrink)

Timothy Williamson has defended the claim that any philosophically satisfying conception of modality that encompasses possible worlds semantics (PWS) commits us to the Barcan Formula. His argument depends on the assumption that the domain of what there is (the domain of the actual world) has to be identified with the domain D(@), where @ is the index or possible world that in PWS represents , or stands for , the actual world. I work out an interpretation of the (...) relation between PWS and possible worlds terminology that makes it plausible to reject that assumption. (shrink)

Recent work in the philosophy of emotion focuses on challenging dualistic conceptualizations. Three of the most obvious dualisms are the following: 1. emotion opposes reason; 2. emotion is subjective, while reason is objective; 3. emotion lies internal to the subject, while reason is external. With challenges to these dualisms, one of the more interesting questions that has surfaced is the idea of emotional appropriateness in a particular context. Here, consider a widely held belief in the United States associates racialized groups (...) with specific emotions—most notably African American women with anger. Clearly these emotional attributions are essentialistic--and hence racist. But this response is too easy. The acknowledgement that emotion lies both internally in the subject and externally in the world opens the possibility of attributing an emotional temperament to a population group. Yet if an identity group has an emotional temperament, can they be accountable for emotionally appropriate behavior? (shrink)

Is it possible to have moral knowledge? ‘Moral justification skeptics’ hold it is not, because moral beliefs cannot have the sort of epistemic justification necessary for knowledge. This skeptical stance can be summed up in a single, neat argument, which includes the premise that ‘Inductive arguments from non-moral premises to moral conclusions are not possible.’ Other premises in the argument may rejected, but only at some cost. It would be noteworthy, therefore, if ‘inductive inferentialism’ about morals were shown (...) to be at least possible. Some philosophers may suppose that inductive moral arguments from non-moral premises cannot get off the ground, but I show that a perfectly legitimate inductive moral argument exists. This argument has non-moral premises and a moral conclusion, its premises are related to its conclusion in the right way, and it avoids some of the problems of other, better-known arguments from ‘Is’ to ‘Ought’. Jonathan Lowe argues that metaphysics should be restored to a central position in philosophy, as the most fundamental form of rational inquiry, whose findings underpin those of all other disciplines. He portrays metaphysics as charting the possibilities of existence, by idetifying the categories of being and the relations of ontological dependency between entities of different categories. He proceeds to set out a unified and original metaphysical system: he defends a substance ontology, according to which the existence of the world s (...) one world in time depends upon the existence of persisting things which retain their identity over time and through processes of qualitative change. And he contends that even necessary beings, such as the abstract objects of mathematics, depend ultimately for their existence upon there being a concrete world of enduring substances. Within his system of metaphysics Lowe seeks to answer many of the deepest and most challenging questions in philosophy. (shrink)

Internalism holds that epistemic justification is determined by what is internal to the mind, not by facts about the mind-independent world. This paper introduces and defends a new kind of internalism that is rooted in rationalist ideas that have been neglected in recent epistemology, despite inspiring internalist projects in cognitive science. Ignoring rationalist insights has, I argue, damaged the prospects for internalism, by needlessly saddling internalists with empiricist burdens. Internalists can refuse these burdens by accepting a better philosophy of mind. (...) Rather than looking to 17th century rationalists, I look to Kant, and especially his idea that normativity is grounded in the constitution of agency and mind. A Kantian approach can avoid stock objections to internalism, I argue, and can also capture all the alleged benefits of externalism. The paper is structured as follows. In §2, I get back to basics and consider more ways to satisfy the core internalist template than have become standard. I draw attention to rationalist insights about how normativity could be grounded in the constitution of mind, and hypothesize that if internalism respects these insights, some problems disappear. I develop this hypothesis in §3 with a Kantian view. I further defend this view in §4. I conclude in §5 by explaining why Kantian internalism answers the latest challenges to internalism. (shrink)

This anthology provides an in-depth analysis and discusses the issues surrounding nudging and its use in legislation, regulation, and policy making more generally. The 17 essays in this anthology provide startling insights into the multifaceted debate surrounding the use of nudges in European Law and Economics. Nudging is a tool aimed at altering people's behaviour in a predictable way without forbidding any option or significantly changing economic incentives. It can be used to help people make better decisions to influence human (...) behaviour without forcing them because they can opt out. Its use has sparked lively debates in academia as well as in the public sphere. This book explores who decides which behaviour is desired. It looks at whether or not the state has sufficient information for debiasing, and if there are clear-cut boundaries between paternalism, manipulation and indoctrination. The first part of this anthology discusses the foundations of nudging theory and the problems associated, as well as outlining possible solutions to the problems raised. The second part is devoted to the wide scope of applications of nudges from contract law, tax law and health claim regulations, among others. This volume is a result of the flourishing annual Law and Economics Conference held at the law faculty of the University of Lucerne. The conferences have been instrumental in establishing a strong and ever-growing Law and Economics movement in Europe, providing unique insights in the challenges faced by Law and Economics when applied in European legal traditions. Possibility offers a new analysis of the metaphysical concepts of possibility and necessity, one that does not rely on any sort of "possible worlds." The analysis proceeds from an account of the notion of a physical object and from the positing of properties and relations. It is motivated by considerations about how we actually speak of and think of objects. Michael Jubien discusses several closely related topics, including different purported varieties of possible worlds, the doctrine of "essentialism," natural (...) kind terms and alleged examples of necessity a posteriori. The book also offers a new theory of the functioning of proper names, both actual and fictional, and the discussion of natural kind terms and necessity a posteriori depends in part on this theory. Irene Binini offers new ways of connecting Abelard's modal views with other parts of his logic, semantics, metaphysics and theology. Further, the work also provides a comprehensive study of the logical context in which Abelard's theories originated and developed, by presenting fresh evidence about many 11th- and 12th-century sources that are still unpublished. In "A Problem in Possible-World Semantics," David Kaplan presented a consistent and intelligible modal principle that cannot be validated by any possible world frame (in the terminology of modal logic, any neighborhood frame). However, Kaplan's problem is tempered by the fact that his principle is stated in a language with propositional quantification, so possible world semantics for the basic modal language without propositional quantifiers is not directly affected, and the fact that on careful inspection his principle does (...) not target the world part of possible world semantics—the atomicity of the algebra of propositions—but rather the idea of propositional quantification over a complete Boolean algebra of propositions. By contrast, in this paper we present a simple and intelligible modal principle, without propositional quantifiers, that cannot be validated by any possible world frame precisely because of their assumption of atomicity (i.e., the principle also cannot be validated by any atomic Boolean algebra expansion). It follows from a theorem of David Lewis that our logic is as simple as possible in terms of modal nesting depth (two). We prove the consistency of the logic using a generalization of possible world semantics known as possibility semantics. We also prove the completeness of the logic (and two other relevant logics) with respect to possibility semantics. Finally, we observe that the logic we identify naturally arises in the study of Peano Arithmetic. (shrink)

This paper is inspired by and develops on E. J. Lowe’s work, who writes in his book The Possibility of Metaphysics that ‘metaphysical possibility is an inescapable determinant of actuality’ (1998: 9). Metaphysics deals with possibilities – metaphysical possibilities – but is not able to determine what is actual without the help of empirical research. Accordingly, a delimitation of the space of possibilities is required. The resulting – controversial – picture is that we generally need to know whether something is (...) possible before we can know whether it is actual. In order to appreciate this picture, we need to understand Lowe’s slogan: ‘essence precedes existence’ (Lowe 2008: 40). This slogan has both an ontological and an epistemic reading. The ontological reading is related to the now familiar idea that essence grounds modality, as popularised by Kit Fine. The epistemic reading suggests that we can know the essence of some entity before we know whether or not that entity exists. However, this idea is often met with puzzlement and Lowe himself sadly passed away before he had a chance to clarify this framework. I will present the framework as I understand it, develop it on my own terms, and put forward a qualified defence of it. I will also illustrate how the framework can be put to use with a case study concerning the discovery of transuranic elements. (shrink)

This paper is an informal presentation of the ideas presented formally in ”Relative-Sameness Counterpart Theory”. Relative-sameness relations -- such as being the same person as -- are like David Lewis’s “counterpart” relations in the following respects: (i) they may hold over time or across worlds between objects that aren’t cross-time or cross-world identical (I propose), and (ii) there are a multiplicity of them, different ones of which may be variously invoked in different contexts. They differ from his counterpart relations, however, (...) in that they are weak equivalence relations (transitive, symmetric and weakly reflexive). The likenesses to counterpart relations make them suitable for an analysis of de-re temporal and modal predications. The difference renders the resulting counterpart theory immune to standard criticisms of Lewis’s Counterpart Theory (e.g., in Hazen 1979, and Fara and Williamson 2005). The use of sameness as opposed to similarity relations in the analysis of de-re temporal and modal predication renders the resulting truth conditions as statable in terms that proponents of Kripke’s identity-based analysis can accept.
