A central charge against T. H. Green’s conception of positive freedom is that it confuses freedom and social justice. Rather than illuminating and elucidating the meaning of liberty, Green, so the criticism goes, under the disguise of a definition, recommends social ideals and principles such as social justice. The validity of such arguments is not the focus of my concern. I argue, instead, that contemporary efforts to defend social legislation, the welfare state, and socialism from the claims (...) of negative freedom overlook the important interplay between context, conceptual mutability, and conceptual relationality in the construction of normative political arguments. Green’s conceptualization of positive freedom unveils just such interplay. To reclaim the vital conceptual-normative role of positive freedom in the tradition of liberalism and its contemporary discourse is the task of this paper. (shrink)

Freedom is widely regarded as a basic social and political value that is deeply connected to the ideals of democracy, equality, liberation, and social recognition. This book explains why we should stop thinking of freedom as limited to a right to be left alone, and explores how Kantian philosophy and Jewish thought instead give rise to a concept of positive freedom. At heart, positive freedom must be understood as inextricably linked to the obligation to respect the autonomy and dignity of others.

A number of well-known Hegel-inspired theorists have recently defended a distinctive type of social freedom that, while bearing some resemblance to Isaiah Berlin’s famous description of positive freedom, takes its bearings from a theory of social recognition rather than a theory of moral self-determination. Berlin himself argued that recognition-based theories of freedom are really not about freedom at all but about solidarity, More strongly, he argued that recognition-based theories of freedom, like most accounts of (...) solidarity, oppose what Kant originally understood to be the essence of positive freedom, namely the setting of volitional ends in accordance with an individual’s exercise of his or her own reason, apart from social authority. In this chapter I argue that recognition might describe an essential social condition of positive freedom, or moral autonomy, as Kant and Berlin understand that term, but only with qualification: Only if recognition doesn’t imply a strong state of social solidarity, understood as a psychological state of identifying with, viz., feeling totally at home with and completely affirmed by, one’s society, and instead assumes only a weak form of democratic civic solidarity, can it function as a category of social freedom, and then only in the narrow sense of political freedom. To the degree that the different institutionalized forms of recognition in modern democracies compete with each other, social freedom will presuppose a second-order recognition of society’s affirmation of their freedom by those whose identities are invested in these forms, to wit: that such forms are or can be sufficiently harmonized with each other by means of judicious government policies and constitutional safeguards. Recognition that one is not overly dominated by a given social role or social expectation in living one’s life can enable one to become rationally reconciled to society and its primary recognition orders in a way that can be socially freedom-affirming. Detached in this way from any positive solidarity with society, recognition-based social freedom cum recognition of non-domination might also be conceived as a species of negative social freedom. I conclude that rational reconciliation remains at best an imperfectly achievable goal in modern societies marked by basic constitutional and institutional tensions. (shrink)

In this article, I respond to Eric Nelson’s claim that the most prominent versions of a positive concept of freedom all reduce to negative notions. I argue that in his otherwise scholarly and well-argued article, Nelson confuses a conceptual dispute with a normative one based on moral or political principle. Further, I point out that the traditional critique of positive conceptions of liberty, which rests on skepticism about perfectionist conceptions of political value, is lost if we see (...) the debate in the way Nelson lays it out. When these issues are disentangled, I suggest that there is indeed conceptual space for uniquely “positive” conceptions of freedom, and I suggest that the idea of “autonomy” can be taken for such a notion and indeed represents a value worth taking seriously in current discussions of justice. In recent years, political theorists have increasingly turned their attention to the past in search of conceptual renovation in the present. While recourse to the past has been a recurring thread throughout the history of political thought, the overlapping concern of recent scholarship has been to revisit seemingly exhausted political concepts with the aim of repurposing them for contemporary political challenges and realities. The three edited collections under review – Positive Freedom, Perfektionismus der Autonomie and Rethinking Liberty Before (...) Liberalism – are distinguished by their thoughtful attempts at retrieving and politicizing the concepts of positive freedom, post-Kantian perfectionism, and neo-Roman liberty in contemporary political thought. These retrievals present promising avenues for theoretical innovation, along with the ever-present risk of diminishing interpretive returns. (shrink)

The aim of this article is to provide a critical examination of Berlin’s treatment of positive freedom by offering a review of his standard arguments against this concept. Throughout his essays and particularly in “Two Concepts of Liberty” Berlin connects the idea of positive freedom with such notions as monism, rationalism, and determinism. Each of these connections will be discussed separately. I will argue that most of Berlin’s arguments against positive liberty are somehow flawed. Although (...) Berlin valued positive freedom as one of the ultimate ends of life, his critical view of the concept should be tempered and contextualized since it was mostly based not on logical or conceptual grounds but on historical and interpretative considerations. L.T.Hobhouse's concept of liberty--the concept at the heart of new liberalism--is based on T.H. Green's positive freedom. However, this paper demonstrates that the former has its own distinct nature and can be usefully defined as 'liberty as welfare'. In a context of renewed interest in the link between liberty and ability/personal development, scholars have looked back to Green's positive liberty. But the complex nature of latter has led to scholarly disagreement about its definitive features. The paper argues (...) that Hobhouse's liberty has achieved what neither of Green's two liberties, juristic and true (or positive), have: accommodate concerns with personal development and social justice in a 'primary' concept of freedom. It is demonstrated that only Green's positive freedom, as opposed to his juristic freedom, internalises commitment to development and social justice, but for a number of reasons reviewed in the paper, it is not a primary concept. The first section of the paper examines and criticises Green's dismissal of juristic freedom and outlines the ways in which this concept could have been more viable. The second section demonstrates how Hobhouse's liberty achieves what Green's juristic freedom could have but did not--accommodate personal development and social justice in a concept of liberty that remains an opportunity concept. Is the Idealist conception of positive freedom doomed as politically dangerous? Decidedly yes, Berlin famously argues. The danger lies with manipulating positive freedom into a political tool of tyranny, coercing individuals to be free. The vehicle of manipulation is a conception of a divided self that underpins positive freedom. For, Berlin argues, conceptions of freedom derive directly from views of what constitutes a self. He cites the British Idealists as evidence for his criticism. (...) The case for Green’s immunity to Berlin’s criticism is now well established. Bosanquet, in particular, however, is a sitting duck to Berlin’s fire. Berlin’s fire, however, misses its target. Not only is Bosanquet immune to Berlin’s criticism, but Berlin’s criticism obscures the extent to which Bosanquet shares Berlin’s worry about the danger of concentrated political power. Moreover, Bosanquet institutionalizes positive freedom into a bulwark against political tyranny in a fashion that Berlin’s wholesale criticism of positive freedom forecloses. Bosanquet’s true self is equipped to resist being coerced to be free. Indeed, Berlin’s divided self ill-describes Bosanquet’s conception of self which being, instead, complex/dynamic/integrated, is at once spontaneous/energetic and habitual/automatic. Moreover, whereas he recognizes with Bosanquet that positive freedom is not merely an internal condition of the true self, but takes shape in society, Berlin’s holistic interpretation of the organic metaphor of society means that he sees only the “dark” side of that connection. Consequently, he misses the affirmative link, the “bright” side, that Bosanquet, employing a relational interpretation of the organic metaphor, forges between positive freedom and social institutions. In this new and entirely revised edition of his study of Green's theory of positive freedom, Ben Wempe argues that the far-reaching and beneficial influence of Green’s political doctrine, on public policy as well as in the field of political theory, was founded on a misinterpretation of his philosophical stand, since the metaphysical basis on which Green argued for his political position was largely neglected. The book discusses Green’s philosophical development and examines an important, hitherto underrated, influence that (...) went into the formation of his philosophical opinions. It then considers Green’s metaphysics and describes how some omissions from the concise version of his metaphysical doctrine, as it is found in his published works, may be remedied by reference to Green’s unpublished material. Green is primarily remembered today as a moral and political philosopher, many of his philosophical concerns owe their origins to the Victorian crisis of faith in which a widespread belief in the literal truth of Scripture confronted seemingly incompatible scientific theories. Green attributed this crisis to the inability of science and religion to find accommodation in the popular version of empiricism widely accepted by educated men and women of his day. Many of those critical of traditional liberalism have focused on the notion of freedom at the center of that approach, namely the (negative) idea of liberty as the absence of interferences with action. Building a plausible and normatively acceptable positive alternative, however, has faced numerous criticisms and challenges. In this paper I discuss what such critics of liberalism sec; as the; limitations of the traditional negative notion and sketch the core components of a positive alternative. Specifically I (...) suggest that the dimensions of liberty should contain the positive elements of capabilities and agent authenticity. After laying out the core of these ideas I briefly defend them against standard objections. In doing so, I argue that such a positive notion is necessary to capture the dominance of the language of freedom in contexts of resistance and struggle in the actual, non-ideal, world. (shrink)

I apply Karl Popper’s conception of critical rationality to the question of personal fulfilment. I show that such fulfilment normally depends upon the person achieving positive freedom, and that positive freedom requires negative freedom, including freedom of expression. If the state has legitimacy, its central duty must be the enforcement of those rules that provide the best prospects for personal fulfilment for the people under its jurisdiction. The state is therefore morally debarred from suppressing (...) freedom of expression. I consider and rebut arguments from falsity, harm, offence, and democratic principles, which are intended to show that the state should prohibit the expression of some types of content. This paper argues that recent accounts of Kantian virtue as “strengthened” inner freedom apply much more clearly to the avoidance of violations of perfect duties than to the fulfillment of imperfect duties, leaving us with the question of how inadequate commitment to morally required ends impacts the exercise of inner freedom. The question is answered through the development of a model of inner freedom that emphasizes the relationship between moral self‐governance and participation in an ethical community.

Isaiah Berlin made a now classic distinction between negative and positive conceptions of freedom. This book, first published in 2005, introduces a fresh way of looking at these conceptions and presents a new defence of the positive conception of freedom. Revealing how the internal debate between various versions of negative freedom give rise to hybrid conceptions of freedom which in turn are superseded by various versions of the positive conception of freedom, Silier (...) concludes that Marx’s concrete historical account of positive freedom resolves many of the key debates in this area and provides a fruitful framework to evaluate the freedoms and unfreedoms that are specific to capitalism. The concept of positive liberty includes both the regulative autonomy to do what we will and the constitutive autonomy to become what we will. However, the latter represents the full meaning of the idea. Liberty in this meaning is a creative power: we are most free in the positive sense when we give our defining constitutive rules to ourselves. The original conceptual model for liberty as creativity did not belong to classical Greek tradition but came to us from (...) Judaism. The religious idea of spontane- ous, supra-natural, existential self-sufficiency provided the template for the idea of positive liberty, often described explicitly as a god-like power, by writers including Rousseau, Kant, Hegel and Marx. The value of creativity became secularized in modernity as a core belief in politics, morality and the arts. (shrink)

Current symptom-based DSM and ICD diagnostic criteria for mental disorders are prone to yielding false positives because they ignore the context of symptoms. This is often seen as a benign flaw because problems of living and emotional suffering, even if not true disorders, may benefit from support and treatment. However, diagnosis of a disorder in our society has many ramifications not only for treatment choice but for broader social reactions to the diagnosed individual. In particular, mental disorders impose a sick (...) role on individuals and place a burden upon them to change; thus, disorders decrease the level of respect and acceptance generally accorded to those with even annoying normal variations in traits and features. Thus, minimizing false positives is important to a pluralistic society. The harmful dysfunction analysis of disorder is used to diagnose the sources of likely false positives, and propose potential remedies to the current weaknesses in the validity of diagnostic criteria. Privacy is often linked to freedom. Protection against unreasonable searches and seizures is a hallmark of a free society, and pervasive state‐sponsored surveillance is generally considered to correlate closely with authoritarianism. One link between privacy and freedom is prominent in the library and information studies field and has recently been receiving attention in legal and philosophical scholarship. Specifically, scholars and professionals argue that privacy is an essential component of intellectual freedom. However, the nature of intellectual freedom (...) and its link to privacy are not entirely clear. My aim in this article is to offer an account of intellectual freedom as a type of positive freedom. I will argue that a full account of intellectual freedom must involve more than an absence of constraints. Rather, intellectual freedom is at least partly a function of the quality of persons’ agency with respect to intellectual endeavors. Such an account best explains the relation between intellectual freedom and privacy and avoids problems with conceptions of intellectual freedom based solely on constraints. (shrink)

Public and research libraries have long provided resources in electronic formats, and the tension between providing electronic resources and patron privacy is widely recognized. But assessing trade-offs between privacy and access to electronic resources remains difficult. One reason is a conceptual problem regarding intellectual freedom. Traditionally, the LIS literature has plausibly understood privacy as a facet of intellectual freedom. However, while certain types of electronic resource use may diminish patron privacy, thereby diminishing intellectual freedom, the opportunities created (...) by such resources also appear liberty-enhancing. Adjudicating between privacy loss and enhanced opportunities on intellectual freedom grounds must therefore provide an account of intellectual freedom capable of addressing both privacy and opportunity. I will argue that intellectual freedom is a form of positive freedom, where a person’s freedom is a function of the quality of her agency. Using this view as the lodestar, I articulate several principles for assessing adoption of electronic resources and privacy protections. (shrink)

Why are moral actions beautiful, when indeed they are? This paper assesses the view, found most notably in Schiller, that moral actions are beautiful just when they present the appearance of freedom by appearing to be the result of internal harmony (the Schillerian Internal Harmony Thesis). I argue that while this thesis can accommodate some of the beauty involved in contrasts of the ‘continent’ and the ‘fully’ virtuous, it cannot account for all of the beauty in such contrasts, and (...) so needs to be weakened considerably (to the Internal Harmony Thesis). To account for the remaining beauty that cannot be fully accommodated even by this revised thesis, as well as the beauty contained in contrasts that involve agents who experience internal conflict as a result of being sensitive to different sources of moral value to an appropriate extent, a number of further theses need to be posited: namely, that the beauty of some moral actions is to be accommodated in terms of internal disharmony (the Internal Disharmony Thesis), and in terms of a felt harmony between the appreciator of the action and the executor of the action (the Affective Harmony Thesis). As such, in contrast to Schiller, I suggest that we need to take a pluralist and context-sensitive approach to accommodating the beauty of moral actions. (shrink)

What is 'positive freedom'? Whereas negative freedom may be characterised as an absence of coercion or physical prevention, and republican freedom as an absence of interpersonal domination, positive freedom resists such pithy treatment. The term is widely taken to refer to a variety of seemingly distinct goods, including but not limited to actually exercisable options or capabilities, collective self-determination, psychological self-government, and self-realisation or flourishing. In this paper I aim to bring the positive (...) conception into better focus by tracing the positive tradition through some of its twists and turns, and considering in what ways it might qualify as a single tradition. Drawing on the lessons of this survey, I then suggest a way of thinking about the nature of positive freedom that’s both principled and historically informed. (shrink)

World peace was a common theoretical consideration among philosophers during Europe’s Enlightenment period. The first robust essay on peace was written by Charles Irénée Castel de Saint- Pierre, which sparked an intellectual debate among prominent philosophers like Jean- Jacques Rousseau and Jeremy Bentham, who offered their own treatises on the concept of peace. Perhaps the most influential of all such writings comes from Immanuel Kant, who argues that world peace is no “high- flown or exaggerated notion” but rather a natural (...) result of the rational progression of the human species. U.S. President Woodrow Wilson, the mastermind behind the formation of the League of Nations in 1920 that provided the scaffolding to today’s United Nations, read Kant’s philosophy while he was a student at the College of New Jersey (now Princeton University). Some have argued that it is no coincidence that the per-son responsible for embarking upon the first serious political pursuit of world peace on a global scale was familiar with Kant. Indeed, William Galston claims that “Woodrow Wilson’s Fourteen Points [for world peace] were a faithful transcription of both the letter and spirit of Kant’s Perpetual Peace.”3 Historical connections aside, the question remains as to whether Kant’s philosophy is a viable conception of peace in a contemporary context. Using the conceptual distinction of positive and negative peace provided by Johan Galtung, I argue that Kant’s philosophy does provide the scaffolding for a viable conception of peace. In particular, I provide particular examples as to what social rights must be included in a Kantian model of peace. (shrink)

The critical aspects of deep brain stimulation are usually the focus of the ethical debate about the implantation of electrodes into the brain of patients with Parkinson’s disease. Above all, potential postoperative side effects on personality caused by DBS mark the debate. However, rehabilitation of agility and mobility by DBS can be posited against critical aspects. Therefore, the purpose of this article is to emphasize the hitherto neglected positive aspects of that technology. A detailed study of the rehabilitation of (...) controlled movements will thus be the object of this article. The possibility to move again in a controlled way will be discussed as freedom of movement. The concept freedom of movement is being linked to the observation of feelings of euphoria and joy that can occur after surgery for patients with PD stimulated in the subthalamic nucleus. This is done based on phenomenological analysis and qualitative interviews, in which the relation between freedom of movement and feelings of joy becomes clear. The aim here is to show that these feelings of exaltation express an essential feeling of freedom – a bodily felt freedom – which is grounded in movement and can be regained by STN-DBS. (shrink)

This study explores freedom and equality as necessary constituents of a liberal democratic state. At the same time, equality and freedom conflict in various respects. It is examined how such conflicts may optimally be resolved while taking seriously the interests involved. These inquiries have far-reaching consequences for the justification of the liberal democratic state. Equal rights are generally considered to be an integral part of a liberal democratic state, but on what foundation are such rights based? Various attempts (...) have been made to provide such a foundation from a moral framework. Some important and influential positions are examined critically and an alternative perspective is offered. "Equality" is approached straightforwardly, without appealing to obscure notions while seeking an outcome that may universally be accepted. Rationality is an important feature in this respect. The question to what extent freedom should be allowed to citizens is another important issue. Granting citizens freedom is beneficial for the liberal democratic state as a whole and for citizens themselves. The limits of freedom must, however, be defined carefully. The search for a simple solution is balanced against the need to do the complexities of individual cases justice. In addition, it is not the task of a liberal democratic state to influence people’s convictions concerning equality ; only equal treatment should be guaranteed. (shrink)

The Bell–Kochen–Specker theorem shows that, in any Hilbert space of dimension of at least 3, it is impossible to assign noncontextual definite values to all observables in such a way that the quantum-mechanical predictions are reproduced. This leaves open the issue of what subsets of observables may be assigned definite values. Clifton has shown that, for a system of at least two continuous degrees of freedom, it is not possible to assign simultaneous noncontextual values to two coordinates and their (...) conjugate momenta.
