There is a long-standing debate about whether poetry can make a substantive contribution to philosophy with compelling arguments to show that poetry and philosophy involve distinct modes of thought and aims, albeit with similar concerns. This paper argues that reading lyric poetry can play a substantive role in philosophy by helping the philosopher understand how to forge connections with the perspectives of others. The paper takes the view that poetry is not directly philosophical but can play an important role in (...) developing the philosopher's awareness of how perspective shapes beliefs and thought processes. Following Robert Nozick, David Lewis, and Helen Beebee, it argues for the need to broaden our conception of the aims of philosophy beyond aiming for conclusive proof, at the least where philosophical inquiry is focused on questions of value. Islamic Perspectives on the Principles of Biomedical Ethics presents results from a pioneering seminar in 2013 between Muslim religious scholars, biomedical scientists, and Western bioethicists at the research Center for Islamic Legislation & Ethics, Qatar Faculty of Islamic Studies. _Pragmatic Perspectives in Phenomenology_ offers a complex analysis of the pragmatic theses that are present in the works of leading phenomenological authors, including not only Heidegger and Merleau-Ponty, as it is often the case within Hubert Dreyfus’ tradition, but also Husserl, Levinas, Scheler, and Patocka. Starting from a critical reassessment of existing pragmatic readings which draw especially on Heidegger’s account of Being-in-the-world, the volume’s chapters explore the following themes as possible justifications for speaking about the pragmatic turn in phenomenology: the (...) primacy of the practical over theoretical understanding, criticism of the representationalist account of perception and consciousness, and the analysis of language and truth within the context of social and cultural practices. Background Investigative genetic genealogy (IGG) is a technique that involves uploading genotypes developed from perpetrator DNA left at a crime scene, or DNA from unidentified remains, to public genetic genealogy databases to identify genetic relatives and, through the creation of a family tree, the individual who was the source of the DNA. As policymakers demonstrate interest in regulating IGG, it is important to understand public perspectives on IGG to determine whether proposed policies are aligned with public attitudes.Methods We conducted eight (...) focus groups with members of the public (N = 72), sampled from four geographically diverse US regions, to explore general attitudes and perspectives regarding aspects of IGG practices, applications, and policies. Five major topics were explored in each focus group: when IGG should be used; who should perform IGG; how to approach consent for genetic database users; what systems of oversight should govern IGG practitioners; and whether to notify database users if their data are involved in law enforcement (LE) matching.Results Participants were supportive of IGG in most scenarios, especially for cold and violent cases. The favorable attitudes toward IGG were, however, tempered by distrust of law enforcement among some participants. All participants agreed that databases must inform users if IGG is allowed, but they did not agree on how individual database users should be allowed to opt out or whether to notify them if their data are involved in specific investigations. All participants agreed that IGG should be subject to some prescriptive guidelines, regulations, or accountability mechanisms.Conclusions These findings suggest broad public support for IGG, and interest in developing systems of accountability for its practice. Our study provides useful insight for policy makers, genomic database stewards, law enforcement, and other stakeholders in IGG’s practice, and suggests multiple directions for future research. International Perspectives on End-of-Life Law Reform aims to address this question by drawing on ten case studies of end-of-life law reform from the United Kingdom, the United States, Canada, the Netherlands, Belgium and Australia. Consider a terrible situation that too many women find themselves in: 85,000 women are raped in England and Wales alone every year. Many of these women do not bring their cases to trial. There are multiple reasons that they might not want to testify in the courts. The incredibly low conviction rate is one. Another reason, however, might be that these women do not want the fact that they were raped to become the most salient thing about them. More specifically, (...) they do not want it to be the thing that others attend to the most—that others find most noticeable and memorable. In this paper, I introduce the notion of ‘harmful salience perspectives’ to help to explain this and related phenomena. This refers either to attention on things that should not be salient, or not enough attention on things that deserve to be made salient. Following ideas within the feminist literature on objectification, I argue that we can be harmed when aspects of our identity that do not reflect our personhood—our agency, rationality, personality, and so on—are more prominent in the minds of others than aspects that do reflect our personhood. Crucially, these ways of attending do not need to implicate false beliefs and harmful ideologies to be harmful, but can be harmful in their own right. (shrink)

Background: Current practice frequently fails to provide care consistent with the preferences of decisionally-incapacitated patients. It also imposes significant emotional burden on their surrogates. Algorithmic-based patient preference predictors (PPPs) have been proposed as a possible way to address these two concerns. While previous research found that patients strongly support the use of PPPs, the views of surrogates are unknown. The present study thus assessed the views of experienced surrogates regarding the possible use of PPPs as a means to help make (...) treatment decisions for decisionally-incapacitated patients. -/- Methods: This qualitative study used semi-structured interviews to determine the views of experienced surrogates [n=26] who were identified from two academic medical centers and two community hospitals. The primary outcomes were respondents’ overall level of support for the idea of using PPPs and the themes related to their views on how a PPP should be used, if at all, in practice. -/- Results: Overall, 21 participants supported the idea of using PPPs. The remaining five indicated that they would not use a PPP because they made decisions based on the patient’s best interests, not based on substituted judgment. Major themes which emerged were that surrogates, not the patient’s preferences, should determine how treatment decisions are made, and concern that PPPs might be used to deny expensive care or be biased against minority groups. -/- Conclusions: Surrogates, like patients, strongly support the idea of using PPPs to help make treatment decisions for decisionally-incapacitated patients. These findings provide support for developing a PPP and assessing it in practice. At the same time, patients and surrogates disagree over whose preferences should determine how treatment decisions are made, including whether to use a PPP. These findings reveal a fundamental disagreement regarding the guiding principles for surrogate decision-making. Future research is needed to assess this disagreement and consider ways to address it. In this volume, we present a collection of writings each offering their own novel perspective with respect to question of realism. No doubt it has gathered much attention of recent philosophical debates; and one of its characteristic aspects, among those it has had a most notable impact, has been in blurring the more the rigid way of thinking the traditional demarcations between "continental" and "analytic" philosophy. This volume, then, offers a contribution to some of the many discussions on realism (...) not only in the spirit that there is still much more to be said on the matter, but also in the recognition that a renewal of the discussion is necessary and should bypass old divisions. This is not to say that this volume departs entirely from any "old" sort of realism, or uncritically treats its object of study as creatable ex nihilo. Far from that, it moves from a broadly shared conviction that, if we are to re-position realism and see its present or future as not yet set into stone--that is, a way in which reality "must be" more than just be--a certain historicism cannot be left out of the picture of realism. Where there is data there are questions of ownership, leaks, and worries about misuse. When what’s at stake is data on our brains, the stakes are high. This book brings together philosophical analysis and neuroscientific insights to develop an account of ‘brain data’: what it is, how it is used, and how we ought to take care of it. Emerging trends in neuroscience appear to make mental activity legible, through sophisticated processing of signals recorded from the brain. This can include (...) Artificial Intelligence (AI), with algorithms classifying brain signals for further processing. These developments will have ramifications for concepts of the brain, the self, and the mind. They will also affect clinical practices like psychiatry, by modifying concepts of mental health and introducing AI-based diagnostic and treatment strategies. The issues arising are vastly complicated, little understood, but of high importance. Philosophical Perspectives on Brain Data clarifies complex intersections of philosophical and neuroscientific interest, presenting an account of brain data that is comprehensible. This account can be the basis for evaluating practices based on brain data. As such, the book aims to open a novel space for evaluating hitherto arcane areas of academic research in order to provide the necessary scope for understanding their real-world consequences. Moral certainty refers to those aspects of morality- moral acting, feeling, and thinking-that are beyond doubt, explanation, and justification. The essays in this book explore the concept of moral certainty and its application and usefulness in contemporary moral debates. The study deals with some of the central issues concerning the notion of death as discussed in Theravāda (Pāli Buddhism) as well as Mahāyāna Buddhism. What is the sense that death is regarded as an instance of duḥkha (Sanskrit) or dukkha (Pāli)? The research claims that here, firstly, the word duḥkha/dukkha is used as an adjective (which means ‘unsatisfactory’) rather than a noun (which means 'pain' or 'suffering'). Secondly, by death, the Buddha did not mean the act of dying but (...) the experience of someone's death or the idea of death. The Buddha also talked about deathlessness as the goal. Here, deathlessness does not amount to accepting something eternal but developing a proper perspective towards death by meditations such as that on impurity ( аśubhabhāvanā ) and contemplation on death ( maraṇānussati ). If the cessation of the cycle of rebirths and re-deaths ( punarmṛtyu ) is the ultimate goal that the arhat (Sanskrit), or arahant (Pāli), achieves, then the same should apply to Tathāgata. In that case, the problem suggests itself: how could the question of Tathāgata’s existence after death be accounted for as an unanswerable ( avyākṛta )? The study opines that the reason behind this is the profound, immeasurable, unfathomable nature attributed to Tathāgata. The research also discusses the basic difference between the attitudes on death in Śrāvakayāna and Mahāyāna. Lastly, it deals with the question of whether termination of one’s own life is permissible in Buddhism under certain conditions. (shrink)

One of the enduring concerns of moral philosophy is deciding who or what is deserving of ethical consideration. Much recent attention has been devoted to the "animal question" -- consideration of the moral status of nonhuman animals. In this book, David Gunkel takes up the "machine question": whether and to what extent intelligent and autonomous machines of our own making can be considered to have legitimate moral responsibilities and any legitimate claim to moral consideration. The machine question poses a fundamental (...) challenge to moral thinking, questioning the traditional philosophical conceptualization of technology as a tool or instrument to be used by human agents. Gunkel begins by addressing the question of machine moral agency: whether a machine might be considered a legitimate moral agent that could be held responsible for decisions and actions. He then approaches the machine question from the other side, considering whether a machine might be a moral patient due legitimate moral consideration. Finally, Gunkel considers some recent innovations in moral philosophy and critical theory that complicate the machine question, deconstructing the binary agent--patient opposition itself. Technological advances may prompt us to wonder if the science fiction of computers and robots whose actions affect their human companions could become science fact. Gunkel's argument promises to influence future considerations of ethics, ourselves, and the other entities who inhabit this world. (shrink)

Could a sufficiently detailed computer simulation of consciousness replicate consciousness? In other words, is performing the right computations sufficient for artificial consciousness? Or will there remain a difference between simulating and being a conscious system, because the right computations must be implemented in the right way? From the perspective of Karl Friston's free energy principle, self-organising systems (such as living organisms) share a set of properties that could be realised in artificial systems, but are not instantiated by computers with (...) a classical (von Neumann) architecture. I argue that at least one of these properties, viz. a certain kind of causal flow, can be used to draw a distinction between systems that merely simulate, and those that actually replicate consciousness. Since this property is instantiated by all systems that conform to the free energy principle (not just conscious beings), the account on offer here can be extended to draw a distinction between simulating and being a certain type of system, more generally. In particular, this may inform meta-ethical accounts of artificial moral status and artificial moral agency. (shrink)

Celle-ci survient parfois au terme d'une longue initiation, ou elle ne survient pas, tant il paraît difficile de jeter un regard surplombant sur un monde labile et opaque.
