I propose a new formalist account of legal (/proximate) causation – one that holds legal causation to be a matter of amoral, descriptive fact. The account starts with a metaphysical relation, akin to but distinct from common-sense causation, and it argues that legal causation aligns exactly with that relation; it is unified and principled.

Suppose someone (P1) does something that is wrongful only in virtue of the risk that it will enable another person (P2) to commit a wrongdoing. Suppose further that P1’s conduct does indeed turn out to enable P2’s wrongdoing. The resulting wrong is agentially mediated: P1 is an enabling agent and P2 is an intervening agent. Whereas the literature on intervening agency focuses on whether P2’s status as an intervening agent makes P1’s conduct less bad, I turn this issue on its (...) head by investigating whether P1’s status as an enabling agent makes P2’s conduct more bad. I argue that it does: P2 wrongs not just the victims of ϕ but P1 as well, by acting in a way that wrongfully makes P1 accountable for ϕ. This has serious implications for compensatory and defensive liability in cases of agentially mediated wrongs. (shrink)

Este trabajo explora una línea posible del diálogo entre Walter Benjamin y Hannah Arendt mediante la presentación de algunas intermitencias entre dos figuras relevantes de su pensamiento sobre la historia, la figura que Benjamin determina en su abordaje del Angelus Novus pintado por Paul Klee, y la figura de Er en los términos en que Arendt la elabora a partir de una parábola kafkiana. Retomamos ambas figuras con el objetivo de mostrar en ellas el intento filosófico de organizar un (...) pensamiento crítico que resista la esclerosis del concepto moderno y progresivo de historia: en un contexto en que el pasado pareciera diluirse en la impotencia de su presencia y el futuro se presenta como reproducción apocalíptica del desastre, sostenemos que Benjamin y Arendt convocan al Angelus Novus y al Er kafkiano como imágenes capaces de dislocar el anquilosamiento de la crítica y el flujo epistemológico implicado en la crisis moderna de la experiencia. This contribution anchors the topic of transformative education in the discussion of human renewal. It posits that transformative education can only be perceived as an endeavour that encompasses the whole human being and the potential of humans to change and to adopt different perspectives on seeing and being in the world. The motif of the new human being (homo novus), as per the argument presented, can serve to develop a meaningful conceptual and praxis-related framework for education. Especially when considered (...) against the background of the debate on education serving the establishment of communities of belonging across cultures, in which ethics and values can be lived and probed. Social contract theory imagines political societies as resting on a fundamental agreement, adopted at a discrete moment in hypothetical time, that binds individual persons together into a polity and sets fundamental rules regarding that polity's structure and powers. Written constitutions, adopted at real moments in historical time, dictating governmental structures, bounding governmental powers, and entrenching individual rights, look temptingly like social contracts reified. Yet something essential is lost in this slippage between social contract theory and the practice of constitutionalism. Contractarian (...) blinders lead us to look for greater individualism, social unity, and coherence of principles than should be expected. Real constitutional orders appropriate, incorporate, and channel the histories and divisions of the societies they govern. Treating them as social contracts flattens and distorts them, making those engagements with the past or with social plurality appear anomalous and encouraging their minimization. Accordingly this article redirects attention to non-contractarian strands within constitutionalism's intellectual inheritance and lived practice. (shrink)

In later Edith Stein and Hedwig Conrad-Martius, finite existence appears to be necessarily intertwined with infinite being. In response to this observation, this paper puts particular focus on the experience of finite being in order to address the specifically phenomenological (i.e., experiential) aspects of Stein’s and Conrad-Martius’ metaphysics. As a consequence, instead of pointing to eternal or infinite being, finite experience is understood to – less specifically – transcend itself. Using the notion of actus essendi (priority of existence over (...) essence), I identify two ideas as specifically characterizing this transcendence: non-ownership of time (in Conrad-Martius), by which is questioned the coherence of inner time consciousness, as well as non-ownership of sense (in Stein), stipulating that the sense one intuitively and intellectively experiences in reference to objects is discovered, rather than made. Subsequently, the paper discusses how Stein’s and Conrad-Martius’ metaphysics of finite existence is reflected in their critical assessments of Heidegger’s existential finitude. (shrink)

This article explores the "New Man" as a politically and philosophically charged ideologeme at the end of the 1920s and the beginning of the 1930s in Germany and Russia. It argues that approaching the New Man as an allegory in Walter Benjamin's sense of the term is helpful in understanding its status at the crossroads of the political and utopian discourse of modernity. The aim of this article is to show the relationship between the Liber nouus de anima rationali, a work by Ramon Llull, and the psychological discourse in the thirtheenth century, by means of an analysis of its sources and the doctrinal and thematic context.

Bernardino of Siena and Giovanni of Capestrano, both preachers and among the most relevant figures of the Observance, shaped that branch of the Franciscan Order during the first half of the fifteenth century. After Bernardino's death in 1444 Giovanni zealously promoted his friend's canonization, which occurred in 1450. The Observants' first sanctified friar signaled the official legitimacy of this branch of the Order and Giovanni subsequently tried to establish L'Aquila, Bernardino's place of death, as the center of the Franciscan reform (...) movement.By exploring the visual impact of Giovanni of Capestrano's mission and preaching north of the Alps, this contribution analyzes... Teizm probabilistyczny a tradycyjna doktryna actus purus Teizm probabilistyczny Dariusza Łukasiewicza wyrasta z nieklasycznego rozumienia natury Boga, zwłaszcza atrybutów prostoty i wszechmocy. Redefinicja tych atrybutów w kategoriach współczesnej filozofii analitycznej powoduje, że teizm probabilistyczny jest bliższy teizmu otwartego niż klasycznego teizmu. Jednak niezwykle ważną zasługą tego podejścia jest opracowanie wszechstronnego komponentu naukowego dla teizmu otwartego, co powoduje, że teizm probabilistyczny umożliwia poszerzenie teizmu otwartego o perspektywę współczesnej nauki. Fundamentalnym znaczeniem teizmu probabilistycznego jest nie tyle pogodzenie występowania zdarzeń przypadkowych z (...) teorią opatrzności, co raczej danie możliwości teizmowi otwartemu do wypłynięcia na szerokie wody dzisiejszych debat teistycznych, toczonych wśród współczesnych naukowców, a nie tylko wśród filozofów i teologów. Bez tego teizm otwarty pozostaje w ramach wąskiej teologicznej perspektywy, interesującej tylko dla teologów chrześcijańskich lub naukowców wyznających światopogląd chrześcijański. (shrink)

Este trabalho foi desenvolvido a partir de uma apresentação feita na IV Semana Didático-Cultural e I Congresso de Pesquisa e Extensão da UEMG – Campus Barbacena. O título deste evento era História: Identidade e memória , e seu símbolo o quadro Angelus Novus de Paul Klee. Nosso objetivo era o de apresentar a relação entre o quadro e a temática do evento, para isso buscamos o apoio de três autores: Benjamin, dono do quadro, que demarcou a sua interpretação do (...) Angelus Novus comparando-o com o Anjo da história; Scholem, herdeiro do mesmo após a morte de seu amigo Benjamin, autor de um poema sobre o quadro de Klee; e Kafka, escritor que sempre povoou o debate epistolar dos dois anteriores, e que, apesar de não ter tido contato com o quadro de Klee, descreve o cenário em que é possível a sua produção. Por fim reavaliamos o quadro a partir do humor judaico que unifica a estes três autores, afim de redimensionar o valor de alerta representado pelo semblante aterrorizado do anjo de Klee. Nesta versão escrita a seqüência dos argumentos foi mantida, mas o texto foi substancialmente alterado para se adaptar ao novo veículo de divulgação. (shrink)

After the criticism that Martin Heide-gger made of Western metaphysics some authors like Gilson or Fabro, among others, wanted to enter into confrontation giving them the oppor-tunity to study in depth most important theses of authors like Thomas Aquinas and his esse philo-sophy. Gilson’s theses had an important impact on the world of Thomism, but Lawrence Dewan, also a Thomist, wanted to defend against Gilson the traditional interpretation of Cayetano and Capreolo, which until now had been regarded as the most (...) celebrated commentators of Thomas. This article investigates a specific point of this confrontation: the causation of esse. El legado de Martin Heidegger con su crítica a la metafísica occidental ha suscitado numerosos estudios en torno a la perenne cuestión acerca del ser, la metafísica y el fundamento mismo de la filosofía. Étienne Gilson, entre otros autores, fue un medievalista que tomó el pulso al pensador alemán para demostrar que Tomás de Aquino no esencializó el ser, como aquél pretendía. Sin embargo, junto con el Francés, en torno a la filosofía del ser tomista surgieron otros estudiosos que quisieron confrontar el tomismo gilsoniano con lo que entendían era un modo más adecuado de entender el verdadero tomismo. Uno de los puntos más interesantes sobre esta confrontación es, sin duda, el papel del esse tomista en la comprensión de la causalidad, entrando aquí en juego, a posteriori, interesantes cuestión en torno a la relación entre el pensamiento tomista y el aristotélico. Sanciona este trabajo la confusión cayetanista en la inspección del actus essendi como esse actualis existentiae, defendiendo el valor del esse desde una recta lectura a propósito de la división capreolista, más ajustada al dictado del Aquinate: ser formal como complementum substantiae y esse como complementum suppositi. El esse recobra la dignidad metafísica que le otorga Aquino, más densa que el simple valor de existencia, con la diferenciación de una vertiente de composición sustancial y una línea de composición entitativa (...) en la que el esse adquiere relevancia como actus essendi asimilativo, plegados a tal fórmula actus informandi simpliciter y actus subsistendi. In 2009, WW Norton published ‘The Red Book’, a book written by Jung in 1913-1914 but not previously published. Snippets of information about the likely contents of the Red Book had been in circulation for years, and there was much debate and eager anticipation of its publication within the Jungian field and the larger reading public. In 2010, a conference was held at the San Francisco Jungian Institute which brought together an international group of distinguished scholars in analytical psychology to (...) explore and address critical contextual aspects of ‘The Red Book’ and to debate its importance for current and future Jungian theory and practice. __The Red Book: Reflections on C.G. Jung’s _Liber Novus_ is based on that conference, the individual papers have been thoroughly revised and updated for this book and address some of the important questions and issues that were raised at that conference in response to the presentation of these papers. As yet there has been very little published about ‘The Red Book’. __The Red Book: Reflections on C.G. Jung’s _Liber Novus_ will contribute to setting the agenda for further research, both scholarly and clinical, in response to Jung’s account of his experiences between 1913-1914, when arguably, the future course of his entire project was set in motion. This book will be essential reading for any Jungian interested in the importance of The Red Book, analytical psychologists, trainee analysts, those with an interest in the history of ideas and historians. Pues bien, junto con esta vuelta al estudio de la filosofía peripatética, ha surgido como en paralelo un nuevo interés por la filosofía del ser de Tomás de Aquino, en particular por su noción de esse ut actus essendi. Esto ha desembocado en diversas líneas de investigación, a veces confrontadas, que (...) han versado sobre todo en la cuestión de la recepción tomasiana de la noción de ente y los aspectos en ella implicados. En este trabajo se procurará dar a conocer algunos aspectos importantes de esta recepción, así como de esas distintas líneas de interpretación confrontadas. Abstract: The past 20th century has witnessed a renewed interest in the approaches of Aristotelian philosophy, especially from the hand of the German philosopher Martin Heidegger. Well, along with this return to the study of peripatetic philosophy, a new interest in the philosophy of being of Thomas Aquinas has emerged as a parallel, particularly in his notion of esse ut actus essendi. This has led to various lines of research, sometimes confronted, which have dealt mainly with the question of the Tomasian reception of the notion of being and the aspects involved in it. La conception de l’Un unitrine de Nicolas de Cues fait de l’unité de l’Un un résultat. L’unité résulte d’un mouvement infini, d’une conversion : unitas, aequalitas, connexio. L’unité comme résultat n’est pas l’Un neutre et immédiat, l’unitas initiale, mais l’Un médiatisé qui s’est égalisé sans se diviser en s’actuant comme relation infinie à soi. L’Un vit de sa propre histoire a priori. Il se réfléchit sans être. Nous comparons cette pensée cusaine de l’Unum in se à celle, thomiste, de l’Esse (...) per se subsistens qui ne se précède pas à lui-même dans son acte d’être, qui est unique et immédiat, immuable, infini, éternel, parce qu’il est. El trabajo intenta mostrar, a partir de una introducción historiografica, uno de los modos posibles en que pueden vincularse el sistema filosófico de Nicolas de Cusa [1401 -1464], a traves de la reformulación que hace el Cusano de la coincidentia oppositorum en el Trialogus De possest' [1460], con la teoria sustancialista de Baruch de Spinoza [1632 -1677], tal como es presentada en el Liber Primus de su Ethic.
